Message from the President
Dear members,
My oh my. What a year! Successful professional boxers prepare for a fight and do their best to research and train for various scenarios; but it’s impossible to plan for everything, and eventually they’ll have to adapt to new challenges. Much like boxers, real estate professionals must decide if they are willing to adapt.
One thing I know for sure is that REALTORS® adapt for success. We’ve seen that repeatedly this year. Notably, real estate is facing the biggest shift in practice in decades (if not in history) due to the NAR settlement after the class action lawsuit loss in 2023 ($1.78B automatically tripled due to anti-trust laws).
The settlement requirements have resulted in all active practitioners assessing their business practices to continue serving their clients and customers to remain compliant, and continue to receive the covering of the settlement umbrella. While we can agree this wasn’t something we planned to do, I think we would also agree that honing our skills to have these new conversations has resulted in better communication between agents and customers alike. I am proud of your continued commitment to serving our community as the professionals I know you’re capable of being.
Also, this year the voice of our membership was heard when you voted to approve the unification of GTR and PRO/CPRO! We hosted a series of townhall style meetings and listened to your feedback and concerns; as well as maintaining a robust website with all the facts and details pertaining to the merger. This resulted in record voter turnout from both sides of the bay, overwhelmingly in favor of the merger!
I am proud to say that we are now one big happy real estate family! The day we received the official results that the merger had passed I experienced a range of emotions; varying from “WOO-HOO” to “OH…WOW… now the hard work begins”.
While the Board of Directors has had a lot to give input and guidance on during the process, the lion’s
share of the tasks fell on our combined staffs. It’s been a pleasure watching them navigate different cultures, philosophies, and leadership styles to continue progress on the unification process of the merger. While the process hasn’t always been easy, their dedication to serving our members has shined brightly. Please join me in thanking all our staff members as you see them at events or around the association offices. Not unlike the way members weren’t planning to reevaluate our business practices, our association staff members weren’t planning on having to completely shift their roles to adapt to our new merged association. The positive conversations happening amongst staff are resulting in a better product for our members.
Throughout the entire merger process we have kept a philosophy of “keep what is good from each association, leave what is not good, and create something new and better”. I truly believe that the best is yet to come!
It's been my incredible honor to represent you on the local, state, national and international levels. I will continue to strive for excellence with every opportunity I have to showcase our incredible members.

HURRICANE RELIEF EFFORTS
As of Oct. 23, the total estimated insured losses from Hurricane Milton are $2,799,386,318 with a total of 237,231 claims. Of those claims, 190,623 are for residential properties. The number of claims and estimated losses are expected to increase.
Homeowners and renters in 17 affected counties may be eligible for FEMA disaster assistance to cover uninsured losses. FEMA may be able to help with serious needs, displacement, temporary lodging, basic home repair costs, personal property losses or other disaster-caused needs.
• Claims under private flood insurance policies: 2,311 (most flood policies are through FEMA’s Flood Insurance Program, not private)
• Claims closed with payments to policyholders: 4,303
• Claims closed without payments to policyholders: 3,212
• Commercial property claims: 1,259
• Percent of claims closed: 9.5%

Dispute Between REALTORS® in Different Boards
Case #17 - 2
REALTOR® A cooperated in the sale of a commercial property with REALTOR® B, the listing broker. REALTOR® A is a member of the XYZ Board of REALTORS®, and his office is located in the XYZ Board. Both the property and REALTOR® B’s office are located within the jurisdiction of the ABC Board of REALTORS® where REALTOR® B is a member. A dispute arose between REALTORS® A and B over the division of the commission.
REALTOR® A filed a request for arbitration with the Professional Standards Committee of his Board. The President of the Board, when advised of the contractual dispute, subsequent to the Grievance Committee finding the matter arbitrable and of a mandatory nature, notified the President of REALTOR® B’s Board and requested interboard arbitration in accordance with Article 17 of the Code of Ethics. The arbitration request was brought before the Grievance Committee of REALTOR® B’s Board which also determined that the dispute was arbitrable and of a mandatory nature.
One week before being notified of his Grievance Committee’s decision, REALTOR® B filed suit against REALTOR® A. The Board of Directors of the ABC Board notified REALTOR® B to appear and answer to a charge of violation of Article 17 when REALTOR® B did not withdraw the suit subsequent to being informed that both Grievance
Committees had found the issue arbitrable and mandatory.
REALTOR® B described his contractual dispute to the Directors and stated that he knew REALTOR® A had requested arbitration because he had received a copy of the request. REALTOR® B maintained that he had filed suit because REALTOR® A was in another Board’s jurisdiction and he did not think anything would come of the request since he, REALTOR® B, was not a member of the XYZ Board.
REALTOR® B was advised that since both Grievance Committees had determined the matter was arbitrable and mandatory that interboard arbitration was being scheduled to hear the dispute. The Board of Directors concluded that his action in filing suit was not in itself in violation of Article 17 but advised REALTOR® B that if he failed to withdraw from the suit and participate in the interboard arbitration, he could be found in violation of Article 17.

Q: A buyer submitted an offer to purchase real property, which the seller signed and returned. A few days after this contract was formed, the buyer inspected the property and decided the price was too high. He crossed out the existing purchase price, inserted a lower price, initialed and dated the change, and sent this revised contract to the seller. The seller wants to reject this offer and walk away from the transaction. Can the seller do this?
A: No. The parties formed a contract, which still exists. The buyer proposed an amendment to reduce the price, but that was just a proposed amendment. The seller can accept, reject or counter that proposed amendment, but unless an amendment is eventually accepted, the existing contract continues to go forward on its original terms.
Q: Since the the MLS is removed the offer of compensation field, can I put the offer of compensation in the remarks?
A. No. Offers of compensation cannot bemade in the remarks section of the MLS or anywhere in the MLS. Bonuses and other forms of renumeration to a broker in the MLS may be viewed as compensation.

Just like Cinderella’s journey, navigating these partnerships requires careful planning, clear communication and a solid understanding of potential pitfalls.
No Fairy Tales in Business Partnerships
Entering a business partnership can be exciting, but it’s important to remember that there are no fairy tales here. To avoid turning your dream collaboration into a nightmare, consider these key steps:
1. Be Proactive: Before going into a partnership, outline the “deal” and the “exit plan.” This means clearly defining each partner’s roles, responsibilities and contributions. Discuss what will happen if the partnership doesn’t work out. Having a well-thoughtout exit strategy can save a lot of heartache in the future.
