This month we focus on the future of the multifamily industry – the Forty Under 40 HAA’s top young professionals under the age of 40. You can get to know our 40 honorees a little better as you flip through the pages of this month’s issue, starting on Page 28. These individuals were carefully selected from more than 200 wonderful applicants and were named the best of the best within multifamily.
As President of this member-driven association, and a peer to these exceptional young professionals, it is my honor to recognize the top tier of our industry! As I read through this year’s list, I couldn’t help but think of how much the honorees’ love for this association shows through their accolades and involvement in HAA, in their companies, communities and the industry. Congratulations again to all honorees.
All 40 of these young professionals have poured themselves into the multifamily world with passion and drive. Their dedication and stamina for the industry is proof that we must continue to nurture young professionals because it leads to successful professionals. By continuing this cycle of cultivating and recognizing young profes sional talent with this program, we continue our history of shaping great leaders, that will continue the associations legacy of developing even more future leaders!
Speaking of programs, HAA offers multiple great programs for all our young adults in the multifamily industry that will sharpen their skills.
For those members looking to enhance their leadership skills, the HAA’s Leadership Lyceum Program is one to consider. This development program identifies highcaliber, effective, well-informed industry professionals and educates them on HAA’s mission. If you have three or more years of multifamily property management expe rience and have served on an HAA committee, you are a perfect candidate! HUD to require carbon monoxide detectors by the end of 2022.
AS WE HAVE previously noted, earlier this year HUD announced that all federally assisted units must be equipped with carbon monoxide detection systems no later than De cember 27, 2022. This requirement applies to units covered under Public Housing (PH), Housing Choice Voucher (HCV), Project Based Voucher (PBV), Project Based Rental Assis tance (PBRA), Section 202 Supportive Housing for the Elderly (Section 202) and Section 811 Supportive Housing for Persons with Disabili ties (Section 811).
This new federal requirement comes after the passage of the Consolidated Appropria tions Act of 2021. The Act set aside funds to as sist in keeping Americans safe during the COVID-19 pandemic. A portion of those funds will be dedicated to landlord and tenant out reach and education about the dangers of car bon monoxide.
According to the National Center for Housing Management, public housing agencies and au thorities may use their Operating Funds or Capital Funds to purchase and install carbon monoxide detectors. Owners of properties with units subsidized by either Project-Based or Ten ant-Based Vouchers are responsible for cover ing the expense on their own. Projects covered under a Project-Based Rental Assistance con tract or under the Section 202 or 811 programs can use their reserves for replacement, residual receipts, general operating reserves, owner con tributions, or choose to seek secondary financ ing to fund the installation project.
The notice emphasizes the importance owners, agents, landlords and other public housing officials must place on properly in stalling and maintaining carbon monoxideproducing fixtures. A flyer on resident education is forthcoming, and additional materials will continue to be made available on HUD’s website for free.
Starting on January 1, 2023, Harris County will institute new pool permit fees for pools at multifamily properties in unincorporated Harris County.
For new pools and for properties with a change of ownership, management will be re quired to go through the plan review and in spection process and pay for an annual permit. Existing pools and properties without ownership changes will receive the annual permitting inspection and pay the permit fee each year. If a pool fails the permitting inspec tion, a reinspection will occur and the applica ble fees will apply.
When initially approached by Harris County, the proposed annual permit fee was $150. After several meetings and discussions, HAA was successful in getting the county to reduce that fee to $125. The fee for new pools and change of ownership will be also be $125.
While this is a new fee designed to cover the cost of service, it is of note that it is lower than the city of Houston plan review/inspection/ permit fees which can range from $180 to $200.
If you are reading this before November 8, there is still time to vote! If you are reading it before November 4, there is even time left to Early Vote!
With rising crime rates and property taxes, this election is critical for our industry and will see us elect nearly every state office from Gov ernor to State Representative, as well as every member of our Congressional delegation. In addition, and of particular interest to us, we will vote on all Judges of County Commissioners Court, including Harris County, County Com missioners for Precincts 2 and 4, criminal and civil court Judges and Justices of the Peace.
We encourage you to vote all the way down ballot. Most voters are generally educated about who is running at the top of the ticket, whether that’s for president, members of Con gress or the Senate or the Governor.
But for our industry, the important races start in the middle of your ballot at the earliest. Some of you will see ballots upwards of 10 pages long, meaning that to get to these im portant races for County Judge or Commis sioner or County Civil Court Judge or Justice of the Peace, you will need to go to page five in some cases.
These down ballot races can directly influ ence your everyday life and your business. We all know how important our Justices of the Peace are in conducting trials fairly and effi ciently, but we also need judges on those last pages of the ballot that will uphold the law and help reduce crime.

THE YEAR WAS 1621. The date was November 24. The Plymouth colonists and the Wampanoag shared an autumn harvest feast. Who would have thought that their meal would be thought of centuries into the future and celebrated by millions?
But wait! It wasn’t until the author of a well-known child’s poem bugged a U.S. president, who finally heeded to many requests to officially proclaim Thanksgiving as a national holiday.
That’s right (according to the History Channel website), Sarah Josepha Hale, the author of “Mary Had a Little Lamb,” launched a campaign to establish Thanksgiv ing as a national holiday. For over three decades, Ms. Hale tried to get the govern ment to declare a national holiday. It wasn’t until 1863, during the height of the Civil War, that President Lincoln finally proclaimed Thanksgiving as our national holiday.
So, it appears that the Thanksgiving holi day, as we know it today, was born out of a time of tremendous strife in our country. If the country could give thanks during that pe riod of time in our history, it stands to reason that we should be able to find a way to give thanks during present times, even though we are coming out of a pandemic.
Since this is the time to think about what we are thankful for, from a legal standpoint, what thanks can we give? Well, believe it or not, there are many things from a legal standpoint in the apartment industry that we can appreciate. Here’s my Top 10 list:
If you asked me in 2019 what “Zoom” was, I would probably try to think of some DC Comics superhero. No longer. Technology (not only Zoom, but also Teams, Google and others) has allowed us to have many webi nars, meetings and events without leaving
the confines of our home or office. Although one could argue we have lost the benefit of some personal connections, it certainly is a time saver and convenient to be able to click a button and get all the infor mation you need. It’s also cool to be wearing shorts during business meetings!
Since this is the time to think about what we are thankful for, from a legal standpoint, what thanks can we give? Well, believe it or not, there are many things from a legal standpoint in the apartment industry that we can appreciate.
over the last couple of years, many courts have been able to get back to a speedy evic tion process.
The Supreme Court of Texas has issued a number of emergency orders which provide that all courts in Texas may, without a partici pant’s consent, allow or require anyone in volved in any hearing, deposition or other proceeding of any kind – including but not lim ited to a party, attorney, witness, court reporter or juror – to participate remotely, such as by teleconferencing, video conferencing or other means. The court’s orders have also given guid ance to judges with respect to how to accept evidence and conduct proceedings remotely.
Remote proceedings have the advantage of allowing parties to avoid traffic and be able to attend court from their office or home. It also could have the effect of minimizing court time and attorneys’ fees. Although these orders will expire at some point, the idea of remote proceedings may very well be part of our “new normal.”
Believe it or not, Texas Law has a rule of civil procedure which requires that eviction trials must be held not less than 10 days nor more than 21 days after the petition is filed. While the rules also provide that a resident must be served at least six days before trial is held, the rules recognize that the eviction process should be a speedy one. Although the process has been somewhat elongated
The Texas Apartment Association lease of fers a lot. The lease contains numerous pro visions needed to hold a resident accountable for bad behavior. The new TAA lease form, section 11, has a number of pro visions that would allow you to declare a de fault of the lease if residents act in a manner that is loud, obnoxious or dangerous, dis turbing or threatening or disruptive.
Aside from the conduct provisions, the lease will answer most questions either you or the residents have regarding your respec tive rights and responsibilities. If you have not already done so, you should become fa miliar with the provisions of the lease which should allow you to minimize problems down the road.
Many owners and residents have taken ad vantage of the robust rental assistance pro grams that were offered by the state and local jurisdictions. Although court involvement in the rental assistance programs has not been ideal (that’s where the 60-day abatement procedure comes from), the programs have allowed owners to get paid much needed delinquencies and kept residents housed during the COVID-heavy months.
What? Why would I be thankful for legal aid? Well, look at it this way. Although legal aid tends to focus on issues independent of the actual delinquency, when a resident is repre sented by counsel, you need to make sure that you have dotted your “i’s” and crossed your “t’s.” This requires us to be better prepared for what might come our way in court. This gives you incentive to be better, smarter and more diligent with respect to such things as delivery of notices, preparing your petition and bring ing evidence before the judge.
The CARES Act has taught us that 30 days is a really long time to wait before an eviction is filed. We should be thankful for section 24.005(a) of the Texas Property Code which provides that the landlord must give a resi dent who defaults or holds over at least 3days’ notice to vacate before the owner can file an eviction. Although the CARES Act does not have an expiration date and still must be followed for those properties that are subject to the CARES Act, if you are not subject to the CARES Act, you can be thankful for Texas Law that requires a 3-day notice to vacate.
In 2015, the Texas Legislature adopted sec tion 250.007 of the Local Government Code. Section 250.007(a) provides that a municipal ity or county may not adopt or enforce an or dinance or regulation that prohibits an owner from refusing to rent to a person be cause the person’s lawful source of income includes funding from a federal housing as sistance program. In other words, owners cannot be required to participate in the fed eral Section 8 program.
The Section 8 program has allowed opera tors to provide much needed affordable housing to a substantial number of residents. However, there are complicated regulations which must be followed by program partici pants. Operating housing that participates in the Section 8 program is vastly different than operating a conventional property. Conven tional operators are not equipped or trained to navigate the Section 8 regulations. While jurisdictions can adopt rules requiring an owner to participate in certain veteran assis tance programs (such as the VASH program), no city or county in Texas is able to legally re quire that owners and operators participate in a Section 8 program.
Every judge has had to deal with a variety of new COVID-related regulations over the past few years, which has led to different in terpretations, court room operations and ju dicial policies. Nonetheless, we remain fortunate to have some of the finest judges in the state serving our area. For the most part, the JPs in Brazoria, Fort Bend, Harris and Montgomery counties are well qualified, well-educated and well prepared to handle the issues that come before them.
If you are a member of HAA, you are a member of the largest local apartment asso ciation in the country and one that has some of the finest training programs available. I like to brag that we have the best educated members in the state. No matter what you want to learn, HAA probably has a program that fits your needs.
We can all be thankful for something. You may want to use this time of year to think about what you are thankful for, whether legally relevant or not! Happy Thanksgiving!
A resident disputes charges after management keeps their security deposit after failure to move in.
A RESIDENT FILED a complaint with HAA to dispute charges he received from an apartment property.
The resident went to view his unit before moving in, after management made several repairs when the previous tenant moved out. Upon reviewing his future unit, the resident noticed several changes from the model unit he toured weeks before. After checking to see if the changes would be made, and manage ment letting him know they would not be able to match the model unit he previously toured, the resident decided to not proceed with moving in. Management charged the resident his security deposit fee of $1,748 due to failure to move in.
Management responded to HAA, and that response was then forwarded to the resident. Enclosed were copies of the lease, application, statement of deposit and documentation of the events that occurred. Upon review, the commit tee found that management had neglected to sign the lease.
After reviewing the case, the committee decided in favor of the resident. The lease provided by management was not valid. Man agement failed to submit a signed lease. The security deposit was refunded to the resident.
The HAA Resident Relations Committees pro vide an impartial review of resident complaints
using the documentation provided by both the resident and management. When the committee finds in favor of the resident, we appreciate a di rect response from the property to the resident within two weeks and a copy of the payment sent to HAA for our records. When the committee finds in favor of the resident, management may file an appeal. When the committee finds in favor of the property owner, the decision is final.

NAA worked alongside industry partners to secure introduction of the “Respect State Housing Laws Act,” which would help restore normalcy and balance to rental housing operations.

On September 30, 2022, Rep. Barry Loud ermilk (R-GA) introduced the “Respect State Housing Laws Act" (H.R.9062), federal legis lation that would end the CARES Act notice to vacate requirement. The National Apart ment Association (NAA), working alongside the National Association of Residential Prop erty Managers (NARPM), collaborated with Rep. Loudermilk to secure the introduction of this important bill.
In immediate response, NAA and the Na tional Multifamily Housing Council (NMHC) released a statement applauding the intro duction of legislation that would help restore normalcy and balance to rental housing op erations.
In March 2020, Congress passed the CARES Act, legislation that included a tem porary 120-day moratorium on evictions and late fees for federally-backed and federallyassisted housing. The moratorium featured what should have been a temporary notice to vacate requirement. Due to a drafting error in the legislation, however, this provision –which intrudes state and local notice periods – has remained in place long past the mora torium’s expiration, and remains a disputed issue in courts today. For more than three years, rental housing providers have navigated immense opera tional hurdles and financial challenges, only exacerbated by federal interference into state
and local law. The introduction of this bill is a critical step in the right direction, and NAA will steadfastly advocate to ensure it crosses the finish line.

Two new laws in California seek to address housing affordability. Here’s the latest.

On September 28, 2022, Governor Gavin Newsom (D-CA) signed two new bills into law, both aimed at addressing housing af fordability.
The Affordable Housing and High Roads Jobs Act of 2022 will simplify processes and reduce barriers to multifamily development in areas zoned for commercial, retail or park ing use, and make development a use by right. A project hoping to utilize the stream lined review processes contained within this law must dedicate 100 percent of the units as affordable to lower-income households as defined in the state code, excluding man agers’ units.
Notably, the law prohibits a local govern ment from imposing additional require ments or fees on the project should it follow the specified, streamlined review process. The law also includes labor and wage stan dards, clarifies which areas are eligible for relevant development, and sets certain other development criteria.
Similarly, the Middle Class Housing Act of 2022 makes housing development an allow able use on a parcel zoned for office, retail or
parking. This law, however, does not include an affordability requirement but specifies ad ditional requirements for the project to pro ceed, including some relating to density, wages, and sustainability.
Gov. Newsom also signed into law a bill that would prohibit minimum parking re quirements for certain types of residential development.
“Not in my backyard” (NIMBY) attitudes have been ever-present in many local com munities that torpedo multifamily develop ment in their towns, often while acknowledging that more housing is needed regionally. Multifamily developers can face insurmountable opposition, regulation and fees from local governments which increase the cost of housing or otherwise, make the project infeasible. In fact, it’s estimated that government regulation accounts for 40 per cent of the cost of developing multifamily housing.
These recent California laws appear to have sprung from the corresponding “Yes in my backyard” (YIMBY) movement, which hopes to ensure that all local jurisdictions participate fairly in the effort to create more desperately needed homes. By reducing fees and regulations, streamlining the permitting process and providing more potential lots for residential use, the laws may be a step in the right direction. Ben Harrold

This month, we interview Amanda Kelly, CAS, Brandt Electrical A/C and Heating Services; Karen Nelsen, CAM, CAS, ALN Apartment Data; and Blaise Spitaleri, CAS, Gemstar Construction Development, about the importance of networking.
Amanda Kelly: I am the Next Supplier-Chair, on the Product Service Council, I have been an Ambassadors Team Captain for four years, I recently added official Go-Getter to my industry resume, I am also on the Expo Committee, Outreach Committee, the Chili Committee and I am a voting PAC Member.
Karen Nelsen: This year I am a part of the Product Service Council as the VP at Large, Ambassador ONE Society holding the ACE position, Education Committee, Career and Community Development Committee, the Charity Task Force, the PAC, Community Outreach, and I help teach NAA Certificate classes along with Leasing 101.
Blaise Spitaleri: Currently I am one of two VPAL’s for the PSC. I also co-chair The Ambassador One Society, which are supplier partner networking meetings the first Wednesday of the month. I volunteer with Community Outreach, the Supplier Education Programs and serve on the Expo Committee.
Amanda: I completely owe my success in the multifamily industry to the networking opportunities that HAA provides.
Obviously, many of the events have put me in front of prospective clients, but what I have found to be the most valuable is networking with my supplier peers. I have had the privilege to create long lasting partnerships with other suppli er members through HAA. They are the first people I call when I am investigating a new prospect. Our supplier mem bers are unique in that way, they are always ready and willing to share connections, directions, or advice with other mem bers. For example, I have gotten more direct referrals from supplier partners than I have amongst clients. My biggest advice to new members is to utilize all the networking oppor tunities the Houston Apartment Association has to offer, and not just those that management members are a part of.
Karen: Networking within HAA has helped me both profes sionally and personally. HAA is such a large organization, but once you get to know a few people, it feels so much smaller. Being able to introduce myself at meetings and events has helped traction in networking with new companies for my business. It has also allowed me brainstorm with other mem bers, which is a great resource. In addition, I have met some of my closest friends through HAA.
Blaise: Networking within the HAA has provided opportuni ties to foster both personal and professional relationships that I can see lasting lifetimes. Our industry is uniquely charming with the range and consistency of our events.
Amanda: Some of my favorite networking events include the NEXT Mixers and the Professional Development
Breakfasts. I think it’s really cool that we have such a diverse group of young professionals in our association. Even though NEXT is geared towards the 40 and under group in the indus try, that room is filled with young decision makers at all levels in their career. We have VPs, owners, regionals, managers, sales man agers, leasing agents and regional mainte nance managers that attend. So, trust me, no matter who your client is, there is a good chance you will make a helpful connection at one of the NEXT events. Additionally, the Professional Development breakfasts are always engaging and rich in education. There are always fun games and competitions at the networking mixers that encourage connection on a deeper level.
Karen: One of my favorite events is the Chili Fest that HAF puts on. The whole industry is very supporting of HAA and gives back to the community. The event is family friendly – and I still have a framed photo on the wall of my son at Chili Fest when he was about three, rid ing a pony at the event (taken by Kimberly Scott – That Kimberly!). Most management companies partner with supplier partners, and it’s a great day for seeing and meeting
each other’s families. Over the years I’ve par ticipated as management, and a judge for the chili contest and the booth contest. It’s always a great time!
Blaise: This is a tough question because I truly enjoy all of the events. The Business Exchange and the Education Expo provide a stronger setting for networking, Chili Fest is the most fun, and Sports Challenge and Volleyball bring out the competitors. All the events bring value when utilized appropriately.
Have you sponsored any HAA events and in what ways have you marketed your business using that sponsorship?
Amanda: I have sponsored many events
over the years, and I most definitely have some favorites. The great part about sponsor ing is that the HAA members know the value in our sponsors, and the board members are always encouraging their teams to show favoritism to our supplier partners that make events happen. The opportunity to get your company’s name ‘front and center’ at an event is priceless. That’s why our sponsorship auc tion is so well attended, our supplier partners know the value. Some of my favorites are any thing PAC related, Board Meetings and the NEXT events.
Karen: I tend to focus on the education events for sponsorship because my previous life was in training and education.

HAA hit the road again to hear from local Justice of the Peace Trey Spikes and HAA General Counsel Howard Bookstaff on the status of evictions. We had an information-packed luncheon focusing on court operations and what the “new normal” will be going forward. Sponsoring the CAM and CAS classes allows me to share updated data that affects how managers and supervisors make good deci sions for their properties. It is also a good opportunity to have “face time” with decision makers.
Blaise: Sponsoring is a great way to get in front of our industry peers to represent your organization. We recently sponsored a NEXT Game Night that was trivia based. I asked the attendees questions for my ‘company intro duction’ and awarded them gift cards if answered correctly, we also presented the win ner with a trivia game. I enjoy tying a theme, and purpose, to marketing because it resonates longer and captivates an audience.
Amanda: My advice would be to get involved. You can do as much or as little as you choose, but, get involved somewhere because there is something for everyone. I can’t tell you how many times a client has asked me if I knew someone that did a certain trade that I have met through HAA. I have also had clients call saying that “so in so told me to call you and that you can help.” Also, go to as many events as you can bring your smile and a friendly handshake to. Focus on the relation ship, not the sell at first, the sell will come. Find a mentor, our PSC is a great place to start, and have fun, we are a fun-loving group. We love what we do, and we truly enjoy the people we do it with, I feel like it’s what separates us from other associations.
Karen: Find a mentor and a buddy. A mentor is someone who has been in the multifamily industry for several years and can help guide you to good decisions in growing your career and business. A buddy can be any supplier that can meet you at events, so you have someone to walk around with. Then as both of your net works grow – you can share with each other. I like mentoring new people in the industry because it can be overwhelming for them at first. I feel fortunate that I had several people “take me under their wings” and help me when I traded sides and became a supplier. Shoutout to Kristin McLaughlin, Michelle Bridges, Debbie Brueckner and Arrie Colca!
Blaise: Read the room, say hi, ask questions and be cognitive. Most importantly, be authen tic, be yourself, show up, volunteer and get involved. If you’re genuine, you will find your definition of success.

Bear Creek Crossing is a 200 unit, two-story, garden style apartment community, located in Northwest Houston, right off highway 6. The community is surrounded by several local business and other multifamily communities. Beer Creek Crossing offers classic renovated interiors, twotoned paint, faux wood flooring, washer and dryer connections, and black appliance packages in select apartments. The communities’ amenities include a business center, swimming pool, BBQ area and a community playground for entertainment.
The Beer Creek Crossing team loves to engage with residents by hosting various events throughout the year. These include after school meal programs partnered with Children Like Loni, which help feed residents and neighboring residents with over 8,800 meals served month ly. Beer Creek Crossing also hosts pizza nights, Halloween costume contests, Valentine’s Day cel ebrations that include fresh flowers and baked goods, an Easter Egg Hunt with egg painting, and photos with the Easter Bunny and Santa during Christmas. They also host a Back-To-School supply drive with backpacks and other school supplies. Beer Creek Crossing also participates in HAA’s annual Food Drive, Turkey for Residents, and toy drives.

The Bear Creek Crossing team doesn’t just focus on community service, but also customer service. They had over 1,000 received and completed service requests in 2021. The team contin ues to work diligently to provide excellent customer service to its prospective and current resi dents. Customer service and attention to details have been key to the team’s success at Bear Creek Crossing.

THE FIRST TABLE ABOVE GIVES A SNAPSHOT of the current market conditions. The graph displays the overall occupancy and effective rental rates over the past 24 months. These statistics are derived from a continuous survey of all apartment communities in the Houston region. The effective rental rates are the calculated net of concessions and utility adjustments. The second table lists the five hottest submarkets in the Greater Houston area. There are a total of 42 submarkets, and the ranking is based on the best combination of rental rate growth and absorption over the past three months. The third table distributes and analyzes concessions (specials) by classification. Concessions generally are represented by three types of specials: move-in, months free or floor plans. The effect of these specials is captured and prorated over a lease term to arrive at a percentage reduction in market or street rents.
