Die ersten Fohlen des Jahrgangs 2015 Ihnen wird ganz besondere Aufmerksamkeit geschenkt - den Kleinsten und Jüngsten dieser Kollektion! Mit der MärzKollektion offerieren wir Ihnen, neben ausgesuchten Reitpferden, eine Auswahl qualitativ hochwertiger Fohlen, die im Zeitraum vom 1. November 2014 bis 28. Februar 2015 geboren sind. Namhafte Abstammungen lassen die Herzen höher Schlagen und Großartiges erwarten! Verschiedendste Blutlinien und interessante Vererber bieten eine abwechslungsreiche und vielschichtige Fohlenkollektion. Altbewährte Vererber und Junghengste mit ihrem ersten Fohlenjahrgang komplettieren diese Kollektion. Die Kollektion der Fohlen ist ab Dienstag, 17. März mit Pedigrees, Fotos und Videos online. Unter www.hannoveraner.com finden Sie alles Wissenswerte zu den Fohlen. Am Samstag, 28. März, haben die Fohlen ab 10.30 Uhr ihren ersten Auftritt in der Auktionshalle. Ab 15 Uhr beginnt die Versteigerung. Die Fohlen werden in der Reihenfolge der Kopfnummern im Anschluss an die Reitpferde versteigert. The first foals born in 2015 They attract particular attention – the smallest and the youngest ones of this collection! Besides carefully chosen riding horse, we have the pleasure to offer a selection of high-quality foals, born from November 1 to February 28 with this March-collection. Wellknown and popular pedigrees will set hearts racing with outstanding performances to be expected for the future! Different bloodline combinations and interesting stallions are the most important features of this varied foal collection. The collection of foals including pedigrees, photos and videos will be available online as of March 17. Please click on www.hannoveraner.com to find all you need to know about the foals. The foals will be presented the first time in the Niedersachsenhalle on Saturday, March 28, as of 10.30 am. The auction will start at 3.00 pm with the foals being put up for auction in the order of their catalogue numbers after the auction of riding horses.

Auktionsbedingungen Verdener Auktion 2015 - Fohlen 1. Allgemeines Der Hannoveraner Verband e.V., Lindhooper Straße 92,27283 Verden, lässt für Pferde seiner Mitglieder durch einen öffentlich bestellten und vereidigten Auktionator öffentliche Auktionen veranstalten, die dieser verantwortlich leitet. 2. Versteigerung 2.1 Bei der Versteigerung werden die in der Auktionsbroschüre aufgeführten Pferde im Namen und für Rechnung der Aussteller (Einlieferer) öffentlich versteigert im Sinne der §§ 383 Abs. 1, 474 Abs. 1 BGB. Eintrittskarten sind für jedermann (solange der Vorrat reicht) käuflich zu erwerben. 2.2 Die zur Versteigerung kommenden Fohlen werden in der Auktionshalle mit Mutterstute an der Hand vorgestellt. Das Ausbieten der Fohlen erfolgte in Euro. Die Fohlen werden mit 3.000,00 € angeboten. Es werden nur Mehrgebote von mindestens 300,00 € angenommen. 2.3 Falls Zweifel über die Gültigkeit des Zuschlages entstehen, die sofort geltend zu machen sind, kann das Angebot wieder aufgenommen und fortgesetzt werden. Die Anmeldung von Zweifeln über die Gültigkeit des Zuschlags ist auch dann zulässig, wenn der Kaufzettel bereits unterschrieben ist, muss jedoch spätestens bis zum endgültigen Zuschlag des letzten Fohlens der Auktion erfolgen. Zweifel über die Gültigkeit des Zuschlages können nur Bieter des betreffenden Fohlens, der Auktionator oder der Veranstalter anmelden. Über die Zweifel entscheidet eine Kommission, bestehend aus dem Geschäftsführer des Verbandes, dem Auktionsleiter und dem Auktionator. Die Entscheidung über die Aufhebung des Zuschlags bedarf der Einstimmigkeit. 2.4 Unterzeichnetet der Käufer den Kaufzettel nicht oder gibt er während der Auktion zu erkennen, dass er das Fohlen nicht abnimmt, kann das Fohlen nach Ermessen des Auktionators noch einmal versteigert werden. Der erste Käufer haftet dem Verband und dem Aussteller für einen etwaigen Mindererlös. 3.

Abrechnung und Bezahlung

3.1 Die Zuschlagpreise sind Nettopreise. Der Käufer schuldet als Kaufpreis das zugeschlagene Gebot zuzüglich der Umsatzsteuer. Die Umsatzsteuer wird vom Zuschlagpreis erhoben und kann je nach Veranlagung des Verkäufers variieren zwischen. Im Auktionskatalog ist bei dem jeweils betroffenen Fohlen hinter dem Namen des Ausstellers der jeweilige Mehrwertsteuersatz ausgewiesen. Die Angabe der Umsatzsteuer erfolgt durch den Verkäufer. Der Verband übernimmt keine Haftung für diese Angabe. Der Hannoveraner Verband erhebt für seine Tätigkeit als Verkaufsagent des Verkäufers eine Gebühr, die sich nach dem Zuschlagpreis richtet sowie Kosten und Steuern. Der Verband versichert in einer Gruppenversicherung sämtliche Fohlen und erhebt dafür 1,25% vom Bruttopreis zuzüglich Versicherungssteuer.

3.2 Der Abrechnungsbetrag wird wie folgt berechnet: Zuschlagpreis plus Mehrwertsteuersatz des Verkäufers = Zwischensumme 1 + Auktionsgebühr i.H.v. 6% des Zuschlagspreises plus 19% Umsatzsteuer auf diese (gemäß §§ 12,2 UStG) + 6 0,00 Euro tierärztliche Untersuchung bei der Abnahme plus 19% Umsatzsteuer auf diese (gemäß §§ 12,2 UStG) = Zwischensumme 2 Zwischensumme 1 und 2 = Bruttopreis + 1,25% Versicherung plus 19% Versicherungssteuer = Abrechnungsbetrag. 3.3 Der Abrechnungsbetrag ist vom Verkäufer an den Hannoveraner Verband unwiderruflich zur Einziehung abgetreten. Die Bezahlung ist sofort nach Zuschlag fällig. Bei der im Auktionsbüro eingerichteten Kasse ist der Rechnungsbetrag in bar oder durch bankbestätigten Scheck zu bezahlen. Nur soweit ausdrücklich Rechnungsstellung vereinbart ist, ist die Rechnung innerhalb von 7 Tagen zu überweisen. Kosten und Zinsen, die durch die Einlösung der Schecks oder durch Überweisung entstehen, trägt der Käufer. Vom Käufer aus dem Ausland wird die anfallende Gebühr für die Serviceleistung des Amtstierarztes zusätzlich erhoben. 3.4 Alle Fohlen sind vom Hannoveraner Verband versichert. Der jeweilige Vertrag geht auf den Käufer mit Zustand als Rechtsnachfolger über. Die Abrechnung der Versicherungsprämie erfolgt mit der Auktionsabrechnung. 3.5 Die Beschicker behalten sich das Eigentum am jeweiligen Fohlen gemäß § 449 BGB bis zur vollständigen Zahlung des Abrechnungsbetrages und etwaiger Nebenkosten vor. 3.6 Der Verkäufer hat an den Hannoveraner Verband das Recht auf Klageerhebung zur Geltendmachung des Abrechnungspreises und etwaiger Nebenkosten unwiderruflich abgetreten. 4. Beschaffenheit der Fohlen 4.1 Die nachfolgend aufgeführten Eigenschaften der Fohlen sind diejenigen Beschaffenheitsmerkmale im Sinne des Gesetzes, die ausschließlich Gegenstand des Erfüllungsanspruches des Käufers sind: Abstammung, Geschlecht, Alter, Farbe, ggf. Stutenprüfungsergebnisse der Mutter. Soweit die Auktionsbroschüre ein Bild und/oder einen Kurzkommentar darstellt, sind dies Eindrücke des Fohlens bei Drucklegung der Broschüre, ohne dass Verkäufer oder Verband eine Zusicherung hinsichtlich besonderer Fähigkeiten des Fohlens abgeben wollen. Diese Kommentare sind keine Beschaffenheitsvereinbarung. 4.2 Aktuelle gesundheitliche Beeinträchtigungen und wesentliche Änderungen der Beschreibung eines Fohlens werden durch das Schlussprotokoll, genannte „Letzte Meldungen“, und/oder durch den Auktionator bekannt gegeben. 4.3 Weitere Beschaffenheitsmerkmale sind nicht Vertragsgegenstand. 5.

Haftung des Ausstellers

5.1 Der Aussteller haftet für Sachmängel für die unter Abschnitt 4 angegebenen Beschaffenheitsmerkmale nach den gesetzlichen Vorschriften mit folgenden Einschränkungen:

5.2 Die Nachlieferung als Nacherfüllungsanspruch wird ausgeschlossen. Die Nachbesserung wird insoweit beschränkt, als nach einem für beide Parteien verbindlichen Gutachten eines Gutachters von der tierärztlichen Hochschule Hannover die Heilung einer Erkrankung nicht binnen sechs monatiger Behandlungsdauer zu erwarten ist.

Diese Atteste stehen allen Kaufinteressenten, deren Bevollmächtigten und den sie beratenden Tierärzten zur eigenverantwortlichen Kenntnisnahme, Auswertung und Überprüfung zur Verfügung, bei dem Tierarzt Dr. Frank Reimann, Lindhooper Straße 92, 27283 Verden.

5.3 Der Anspruch auf Minderung wird ausgeschlossen.

6.2 Die Ergebnisse der Untersuchung der Tierärzte, deren Befunderhebung und Bewertungen sind eigenständige Leistungen dieser Tierärzte. Sie sind nicht Beschaffenheitsmerkmale oder Vertragszusage des Hannoveraner Verbandes oder des Ausstellers. Die Tierärzte sind nicht Erfüllungsgehilfen des Verbandes oder des Ausstellers, sondern selbständig beratend tätig.

5.4 Rücktritt vom Vertrage: Bei sehr erheblichen Abweichungen von der vertraglich vereinbarten Beschaffenheit des Fohlens zum Zeitpunkt des Gefahrüberganges haftet der Aussteller auf Rücknahme des Fohlens und Rückzahlung des Kaufpreises. 5.5 Ansprüche auf Schadensersatz werden begrenzt auf die nachfolgend abschließend aufgeführten Ansprüche: Transportkosten vom Auktionsstall zum Käuferstall innerhalb Deutschlands, übliche Stallund Futterkosten, die Kosten der tierärztlichen Untersuchung und Schmiedekosten sowie notwendige Kosten für die tierärztliche Versorgung. 5.6 Sämtliche Ansprüche des Käufers aus dem Auktionskauf sind an den Hannoveraner Verband e.V., Lindhooper Straße 92, 27283 Verden, zu richten. Der Verkäufer hat insofern eine schuldbefreiende Schuldübernahme im Sinne des § 415 BGB mit dem Verband vereinbart, die auch für Ansprüche des Käufers aus Delikts- und Bereicherungsrecht gilt. Der Käufer erklärt sich mit Gebot mit der Schuldübernahme einverstanden. 5.7 Sämtliche Ansprüche aus Mängelhaftung verjähren bei den Käufern, die Verbraucher im Sinne von § 13 BGB sind, innerhalb von zwei Jahren nach Gefahrübergang, wenn sie von Unternehmern im Sinne von § 14 BGB das Pferd erwerben. Bei Verkäufen an Käufer, die nicht Verbraucher im Sinne des Gesetzes sind, und von Käufern, die Verbraucher sind, verjähren sämtliche Ansprüche auf Sachmängelhaftung acht Wochen nach Gefahrübergang. 5.8 Außerhalb der vereinbarten Beschaffenheitsmerkmale haftet der Aussteller und in dessen Vertretung der Verband nicht. Insofern werden die Fohlen verkauft wie besichtigt unter Ausschluss jeglicher Sachmängelhaftung. Insbesondere wird keine Haftung übernommen für den Gesundheitszustand der Fohlen. Der Verband haftet nicht für die Richtigkeit der Befunderhebung und Bewertung aus diesen Befunderhebungen durch die selbständigen Tierärzte. 5.9 Von allen Haftungsbeschränkungen der Ziff. 5 sind ausgenommen: Schadenersatzansprüche aus der Verletzung des Lebens, des Körpers oder der Gesundheit, die auf einer fahrlässigen Pflichtverletzung des Verkäufers oder des Verbandes oder einer vorsätzlichen oder fahrlässigen Pflichtverletzung eines gesetzlichen Vertreters oder Erfüllungsgehilfen des Verkäufers oder des Verbandes beruhen. Weiter sind von allen Haftungsbeschränkungen sonstige Schäden ausgenommen, die auf einer grob fahrlässigen Pflichtverletzung des Verkäufers oder des Verbandes oder eines gesetzlichen Vertreters oder Erfüllungsgehilfen dieser beruhen. 6. Gesundheitsstatus – keine zugesagte Beschaffenheit 6.1 Außerhalb der Beschaffenheitsvereinbarung werden alle zum Verkauf gestellten Fohlen bereits bei den Ausstellern durch dortige selbständige Tierärzte klinisch untersucht. Der Umfang der Untersuchungen und die erhobenen Befunde werden durch ein Gesundheitsattest dokumentiert.

Abnahme und Gefahrenübergang

7.1 Mit dem Zuschlag ist der Kaufvertrag über das jeweilige Fohlen abgeschlossen. Die Abnahme des Fohlens hat spätestens bis zum 15. Oktober desselben Jahres bei dem Aussteller zu erfolgen. Eine frühere Abnahme durch den Käufer ist im gegenseitigen Einvernehmen möglich. Der Übergabetermin wird durch den Hannoveraner Verband koordiniert. Der Aussteller wird unmittelbar vor der Abnahme oder zu der Abnahme einen Tierarzt bitten, der eine klinische Untersuchung des Fohlens mit Standard einer üblichen Ankaufsuntersuchung vornimmt und darüber ein Attest ausstellt. Der Aussteller hat dafür Sorge zu tragen, dass das Abnahmeprotokoll dem Verband e.V. zugestellt wird. Die Kosten der Untersuchung trägt der Käufer. 7.2 Eine röntgenologische Untersuchung erfolgt nicht. 7.3 Bis zur Abnahme trägt der Aussteller das Risiko der zufälligen Verschlechterung oder des Unterganges. Ebenso trägt der Aussteller bis zu diesem Zeitpunkt alle Unterhaltskosten, einschließlich Schmied und Tierarzt. 7.4 Mit der Abnahme des Fohlens, spätestens jedoch mit dem 15. Oktober, trägt der Käufer alle Unterhaltskosten, inklusive Tierarzt- und Schmiedekosten des Fohlens. Mit dem 15. Oktober geht die Gefahr einer zufälligen Verschlechterung oder des Untergangs des Fohlens auf den Käufer über. 8. Änderungen, anwendbares Recht, Gerichtsstand und Salvatorische Klausel 8.1 Der Auktionator und Verband behalten sich Änderungen des Ablaufs der Veranstaltung vor. 8.2 Für die Auktion gilt deutsches Recht in Form der Spezialnormen dieser Auktionsbedingungen. 8.3 Erfüllungsort und Gerichtsstand ist Verden. Für den Fall, dass der Käufer kein Kaufmann ist, gilt die Gerichtsstandsvereinbarung gem. 38 Abs. 3 Nr. 2 ZPO nur dann, wenn der Käufer nach Vertragsschluss seinen Wohnsitz aus Deutschland in ein anderes Land verlegt oder der Wohnsitz oder gewöhnliche Aufenthalt zum Zeitpunkt der Klageerhebung nicht bekannt ist. 8.4 Sollten einzelne Regelungen oder Teile derselben unwirksam sein oder werden, so wird dadurch die Wirksamkeit der übrigen Regelungen nicht berührt. Anstelle der unwirksamen Regelung soll eine Regelung gelten, die dem wirtschaftlichen Zweck der unwirksamen Regelung am nächsten kommt.

Conditions of Sale Verden AuCtion 2015 - foals 1.

General Information

The Hannoveraner Verband e.V., Lindhooper Straße 92,D-27283 Verden, organizes public auctions to sell the horses of its members by an officially appointed and sworn auctioneer. 2. The Auction 2.1 The horses described in the catalogue are sold during the public auction in the name and for the account of the exhibitor (supplier) as laid down in §§ 383, paragraph 1, 474, paragraph 1, German Civil Code. Tickets are available for everybody (as long as stocks last). 2.2 During the auction, the foals put up for auction will be presented with their dams. They will be offered for sale in Euro. Minimum auction sales prices for foals will be Euro 3,000. Bids of at least Euro 300 will be accepted only. 2.3 Should any doubts arise as to the validity of the knock-down price, they have to be claimed at once and the offer for sale can be taken up gain. This is also permitted if the purchase note has already been signed, however, latest until the last foal of the auction was knocked-down. Only the bidders of the corresponding foal, the auctioneer or the Organizer are allowed to raise an objection as to the validity of the knock-down price. A commission, consisting of the Manager of the Hannoveraner Verband, the Auction Management and the auctioneer will decide on all objections. An accepted bid shall only be cancelled if the commission decides unanimously. 2.4 Provided the buyer does not sign the purchase note or if he makes known during the auction that he will not take the foal, the auctioneer shall be entitled to decide to put up the foal for auction again. The first buyer shall be held liable for possible reductions in price. 3. Settlement and Payment 3.1 Knock-down prices are net prices. The buyer owes the purchase price which is made up of the knockdown price plus VAT. The VAT shall be added to the knock-down price and may vary – depending on the assessment of the vendor. The individual VAT-rates are indicated behind the exhibitors’ names of each foal in the auction brochure. The vendor is responsible for the correctness of the VAT-rate. The Hannoveraner Verband assumes no liability for this information and raises a commission fee for its work as commission agent with the amount to be paid depending on the knock-down price. Additional handling fees and taxes will also be charged. All foals are collectively insured by the Hannoveraner Verband who raises an insurance tax of 1,25% on the gross price. 3.2 The account will be rendered as follows: Knock-down price plus vendor’s VAT-rate = Subtotal no. 1 + auction fee in the amount of 6% of the knock-down price plus 19% VAT on this amount (as is laid down in §§ 12,2 German VAT Act)

+ 60 Euro vet check at time of transfer plus19% VAT on this amount (as is laid down in §§ 12,2 German VAT Act) = Subtotal no. 2 Subtotal no. 1 and no. 2 = gross price + 1,25% insurance plus 19% insurance tax = final balance amount. 3.3 The vendor shall assign all claims to collect the final balance amount to the Hannoveraner Verband. Payment shall become due immediately upon acceptance of the bid. Payment has to be effected in the auctioneer’s office in cash. Unless payment by invoice has been accepted and confirmed before, the amount has to be transfered within seven days. Check collection fees or interests resulting out of the cashing of the check have to be paid by the purchaser. Foreign customers have to pay the fee for the services of the official vet. 3.4 All foals are insured by the Hannoveraner Verband. The new owner shall be the legal successor of each insurance contract. The insurance premium shall be settled with the auction statement. 3.5 According to § 449 German Civil Code, the foals shall remain property of the vendors unless the final balance amount and possible additional expenses have been completely settled. 3.6 The vendor has irrevocably assigned the right to launch, in case of non-payment, legal action against the purchaser for the settlement of the final balance amount and possible additional fees to the Hannoveraner Verband. 4.

Characteristics of the Foals

4.1 The following features describe the necessary characteristics legally required for all foals, and they are exclusively subject to buyer’s legal rights: pedigree, sex, age, colour and – if available – mare performance test results of the dam. Photos and/or short statements published in the auction catalogue are only based on first impressions of the foal at the date of brochure print. Both, nor the vendor nor the Hannoveraner Verband, make any assurance or evaluation in the sense of a guarantee of special qualities. These comments are no statements about the foals’ characteristics. 4.2 Current health problems or considerable changes of catalogue descriptions will be published in a final report called „Latest News“ and/or be announced by the auctioneer. 4.3 Additional features are not subject of this contract. 5. Liability of the Exhibitor 5.1 The exhibitor will assume liability for material defects relating to the characteristics mentioned under section 4, in accordance with the legal regulations, however, with the following restrictions: 5.2 Claims for later fulfilment shall be prohibited. Claims for replacement shall be restricted to the report of an expert of the Veterinarian University in Hanover, stating that healing of a disease is not to be expected within a period of six months of treatment. 5.3. The claim for reduction shall be prohibited.

5.4 Cancellation of contract: If – at the time of transition of liability – the foal’s constitution differs considerably from the one mentioned in the contract, the vendor of the foal shall be held liable and has to accept a return of the foal and a repayment of the auction sales price. 5.5 All claims for refunds shall be restricted to the following rights: refunding the costs for the transport of the foal from the auction premises to the buyer’s stable (within Germany), regular costs for boarding and food, costs for the farrier, for necessary veterinary inspections and treatments. 5.6 Buyer’s claims for faults have to be directed to the Hannoveraner Verband e.V., Lindhooper Straße 92, D-27283 Verden. The vendor and the Hannoveraner Verband have agreed on a debt relieving assumption of debts as is laid down in § 415 German Civil Code which also applies for buyer’s claims based on tart and enrichment law. Upon acceptance of the bid, the buyer agrees to accept the assumption of debts. 5.7 All claims resulting out of liability for defects shall become statutebarred within two years after transition of liability for customers who are consumers as laid down in § 13 German Civil Code if they purchase a horse from contractors as laid down in § 14 German Civil Code. All claims for material defects become statute-barred within eight weeks after transition of liability for transactions between purchasers who are no consumer within the meaning of Law and for purchasers who are consumers. 5.8 The exhibitor and its representative, the Hannoveraner Verband, do not assume any liability for other characteristics than the ones stipulates in the contract. The foals are sold as inspected, excluding any liability for material defects. No liability will be assumed for the foal’s health status. Apart from that, the Hannoveraner Verband shall not be held liable for the accuracy of the veterinarian inspections and the corresponding evaluations of the independent veterinarians. 5.9 Limitation of liability as stipulated under no. 5 does not include: Claims for damages, resulting out of an impairment of life, body or health, based on grossly negligent violation of duty by the vendor or the Hannoveraner Verband or based on intention and gross negligence of a legal representative or vicarious agent of the vendor or the Hannoveraner Verband. Besides, limitation of liability does not include damages resulting out of a grossly negligent violation of duty by the vendor or the Hannoveraner Verband or a legal representative or vicarious agent. 6. State of Health – No Guaranteed Constitution 6.1 Apart from the characteristics as stated in the contract, all foals put up for auction shall be examined by vendors’ independent veterinarians before the auction. A health certificate shall be issued to state extend and result of the examination. All health certificates shall be available for potential customers, their representatives and advising veterinarians in the office of Dr. Frank Reimann, Lindhooper Straße 92, D-27283 Verden.

6.2 The results of the veterinarian reports, their statements and evaluations, are independent service offers of these veterinarians. They are no characteristics or contractual promise of the Hannoveraner Verband or the exhibitor. The veterinarians are not the servants of the Hannoveraner Verband or the exhibitor, but independently working experts. 7.

Removal and Transition of Liability

7.1 The sales contract for the individual foal shall be concluded with the acceptance of the bid. The foal has to be collected by the buyer latest until October 15 in the year of birth at the premises of the exhibitor. An earlier collection shall be possible upon prior mutual agreement. The Hannoveraner Verband will arrange the transfer date. Immediately before or at the date of transfer, the exhibitor shall ask a vet to do a clinical health examination and to issue a corresponding certificate. The exhibitor undertakes to ensure that this certificate will be handed over the Hannoveraner Verband e. v. The purchaser shall bear the costs for this examination. 7.2 No X-ray examination is required. 7.3 The exhibitor bears the risk of a deterioration of the foal’s health resp. an accidental decline until the buyer takes the foal. The exhibitor shall also bear all upkeep expenses including costs for the farrier and veterinarian. 7.4 With the collection of the foal, latest as of October 15, buyer shall bear all currently arising maintenance costs including vet and farrier costs. The risk of an accidental deterioration of the foal’s health resp. decline shall pass on to the buyer as of October 15. 8. Alterations, Governing Law, Place of Jurisdiction and Severability Clause 8.1 The auctioneer and the Hannoveraner Verband reserve the right to change the auction schedule. 8.2 German Civil Law in the form of these special Conditions of Sale shall apply for this auction. 8.3 Place of fulfilment and place of jurisdiction shall be Verden. Provided the purchaser is no entrepreneur, the jurisdiction clause as laid down in § 38, paragraph 3 no. 2 German Civil Process Order, shall only apply if the purchaser changes his residence from Germany to another country or if his place of residence is unknown by the time the complaint is filed. 8.4 Should one of the afore mentioned arrangements or part of an arrangement be void or become void, all other clauses shall not be effected at all. The void arrangements shall be replaced by a valid condition that aims to match the commercial requirements of the void arrangement. Effective as of March 5, 2015 In case of doubt, the German version of these conditions of sale shall apply.

Der Rechnungsbetrag setzt sich wie folgt zusammen: Zuschlagpreis + Umsatzsteuersatz des Ausstellers = Zwischensumme 1 + Auktionsgebühr i.H. v. 6% des Zuschlagspreises plus 19% Umsatzsteuer auf diese (gemäß §§ 12,2 UStG) = Zwischensumme 2 Zwischensumme 1 und 2 = Bruttopreis + 1,25% Versicherung plus 19% Versicherungssteuer = Abrechnungsbetrag

Was ändert sich durch die Umstellung für Kunden aus dem Ausland? Die wesentliche Änderung für Auslandskunden besteht darin, dass die in Rechnung gestellte Umsatzsteuer von pauschalierenden Landwirten (10,7%) in Deutschland nicht erstattet werden kann, da diese vom Aussteller nicht an die Finanzbehörde abzuführen ist. Innerhalb der Europäischen Union (EU) erfolgt eine Erstattung für gewerbliche Käufer im jeweiligen Heimatland. Mögliche Erstattungen außerhalb der EU klären Sie bitte mit Ihren zuständigen Landesbehörden ab. Für die Auktionsgebühr kann die Umsatzsteuerbefreiung nach Vorlage der notwendigen Unterlagen erfolgen. Ist der Aussteller gewerblich oder optierender Landwirt (19%), ändert sich an der Umsatzsteuerbefreiung nichts. The Auction Billing System

The Hannoveraner Verband has changed the auction billing system from a commission based to an agency based business transaction. These are the changes for you as a customer: The most significant change is that the exhibitor’s sales tax rate gets added to the knock-down price. This individual sales tax rate: c ommercial or farmer opting to tax = 19% f lat tax farmer = 10.7% h obby breeder/private = 0% Commercial seller from the European Union = individual tax rate of the corresponding country

will be published in the catalogue with the pedigree of each horse. The commission fee and the associated VAT of 19% as well as calculation of the insurance amount remain unchanged.

The purchaser’s settlement will be issued as follows: Knock-down price + exhibitor’s sales tax rate = subtotal 1 + auction fee in the amount of 6% of the knock-down price plus 19% VAT on this (as is laid down in §§ 12,2 German VAT Act) = subtotal 2 Subtotal 1 and 2 = gross price + 1,25% insurance plus 19% insurance tax = final balance amount

What will be different with the changes for clients from other countries? The essential change for foreign clients is that the billed sales tax rate from farmers using a flat tax (10.7%) cannot be refunded in Germany, as the tax from the exhibitor does not get paid to the tax authorities. Within the European Union (EU), commercial buyers may claim refunds in their respective home countries. Please clarify possible claims for refunds outside the European Union with your local authorities. Upon presentation of the required documents, exemption from sales tax may be granted to calculate the auction fee. There will be no changes with exemption from sales tax if the exhibitor is a commercial farmer or opting to tax (19%). Furthermore, you have to arrange export details and make transport decisions as soon as possible after the purchase. 19. Freispringen Den Sprung in den internationalen Sport hat St.Pr.A. Comtessa v. Contendro/Acord II (Z.: Erich Mohrfeld, Espelkamp) geschafft. Wer die besten Springpferde Hannovers sucht, wird im Programm Hannoveraner Springpferdezucht fündig. Seit über 20 Jahre ist es Garant für beste Hannoveraner Gene. Von ihrer besten Seite präsentieren sich die Drei- und Vierjährigen aus dem Förderprogramm beim Freispringwettbewerb in Verden. Im Februar gingen bereits die Vierjährigen in der Niedersachsenhalle an den Start. Die Richter Carsten-Otto Nagel und Dieter Smitz kürten den Carrico/Drosselklang II-Sohn Carl (Z.: Hermann Rink, Seulingen) zum Sieger. „Ein Hengst, der mit Leichtigkeit und Eleganz springt“, kommentierten die erfolgreichen Springreiter. Am Mittwoch, 8. April, versammeln sich die Dreijährigen, um ihren Jahrgangschampion zu ermitteln. Folgende Fohlen stammen aus dem Programm Hannoveraner Springpferdezucht: 110, 114, 119, 123, 127, 131 und 133

It has been a guarantee for the best Hanoverian show jumping genes for over 20 years now. The three- and four-year olds out of this support program present all their qualities at the Free Jumping Competitions in Verden. The four-year-olds competed in the Niedersachsenhalle in February. The judges Carsten-Otto Nagel and Dieter Smitz selected Carl by Carrico/Drosselklang II (b.: Hermann Rink, Seulingen) as winner. „An elegant and lightfooted champion“, the jumping riders commented. On Wednesday, April 8, the three-year-olds will gather to determine the best of their age-group.
