More than $3 million was awarded to four Blanco County landowners involved in condemnation proceedings with Kinder Morgan and its Permian Highway Pipeline (PHP) over the past two weeks. Those decisions, made by a court-appointed panel, is leading officials with the Texas Real Estate Advocacy and Defense (TREAD) coalition to double-down on allegations Kinder Morgan is “lowballing” landowners for use of their land. According to a TREAD press release, the panel awarded settlements to

Fire destroys portable at Camino Real elementary BY MOSES LEOS III An electrical issue is the suspected cause of a fire that destroyed a portable classroom at Camino Real Elementary late Monday, which officials have ruled was accidental. Kyle Taylor, Kyle Fire Department chief,

HISTORY

Founded April 10, 1903, by Thomas Fletcher Harwell as The Kyle News, with offices on the corner of Burleson and Miller streets in the town’s oldest remaining building. It merged into The Hays County Citizen in 1956. The paper consolidated with The Free Press in October, 1978. During its more than 100-year history the newspaper has maintained offices at more than a dozen locations in Kyle and Buda.

In Kyle, Place 3 incumbent at-large city council member Robert Rizo, who has campaigned for the dais two times in a year’s span, will take on Amanda Stark Nov. 3. Rizo, a property management supervisor, was elected in May as part of special election to fill the Place 3 seat vacated by former city leader Shane Arabie. Before his election, Rizo unsuccessfully ran against Rick Koch in the November 2017 race for the Place 5 city council seat. Stark, an operations manager who has lived in Kyle for four years, will make her first run for political office. Meanwhile, incumbent Kyle City Council member

and Mayor Pro Tem Dex Ellison will face opposition after Yvonne Flores-Cale submitted her filing roughly 40 minutes prior to the 5 p.m. deadline Monday. Flores-Cale, an office manager and paralegal in the Austin area, has lived in Kyle for the past seven years and is making her first run at political office. Flores-Cale will go up against Ellison who was elected to the dais in November 2017. Think First

Do you really know what your five freedoms are? Do you really know the First Amendment? Adopted by the Texas Press Association and other media groups across the country, we are working this month to make sure that Americans know exactly what their freedoms are. Do you know them? Do you know the freedoms included in the First Amendment? Freedom of Religion Freedom of Speech Freedom of Press Freedom of Assembly Freedom of Petition It’s important for every single American to know these freedoms and to make sure no one trounces them. You have the right to your faith, as part of the freedom of religion. It also means that you don’t try to squelch another religion. Go to church, go to the synagogue, go to the mosque. Or go outside and think about greater things. Everyone has that right in the U.S. You have the right to free speech. No matter what the analytics of Facebook and Twitter show, you can say what you want. You can’t yell “Fire” in a crowded theater or slander or libel someone, but you have the right – and all others have the right – to talk about whatever they want. You might not like it; you might abhor the other person’s position. But that freedom is guaranteed. Speak your mind and use the First. We all have the right to freedom of the press. Right here in your hometown, we print letters to the editor. Unless a letter is libelous, it gets printed. Your message can be distributed to thousands. No one can shut down the newspaper just because they do not like a story or they do not like a letter. No governmental entity can shut us – or you – down. That’s guaranteed. That’s a rare freedom in this world today. Even as some people are saying “fake news”, we all have the right to print our opinions. You have the right to a peaceable assembly. You can gather in tens, twenties ... or the hundreds. You can use your freedom of speech and gather together to protest, to support, to petition... And that brings up another freedom. We all have the right to peition our government. Go ahead, attend a council meeting or the commissioners court. You have every right to speak, to request information (remember the freedom of information act?), to contact your elected officials, to send letters to the council or senator or president. Write away, make the calls. We all have those rights – to let them know what we think and what we want. This is the month to celebrate our freedoms. While it might be hot outside, it would be a lot hotter if we were being held in a prison for speaking out, for calling on our reps, for printing our feelings and being arrested for our views. Don’t let these freedoms be taken away. Think First. That’s what makes all of us Americans.

In praise of clear words Man, I have to agree with Wynette about butchering the English language. When I hear “me” used in the place of “I” it’s like the screech of chalk on the chalkboard; it’s like sciatica in the brain. To add to her essay rather than contradict it is my pleasure. Diagramming sentences, I also learned at that little Catholic school next to St Mary’s U. in San Antonio. My talents in diagramming fell short of adroitness and I’m not sure they had value. We could have just memorized the parts of speech and moved on, maybe. Actually English is not a mere language, it’s a way of thinking. It helps to define our culture, and as language changes the culture follows, even though we may not approve of those changes. End Act I. If my reaction seems extreme, consider this: Words are the tools of thinking, and for thinking to be anywhere close to clear, it’s not enough to spit out disjointed words, caveman style. Even U.S. presidents can’t get away with that, or once they couldn’t. Murdering language is a chaotic practice that alarms those interested in a relatively civilized life.

Then again, creating chaos is quite useful if your job is over your head. Bamboozle everyone with word salad. No one will be able to figure out what’s wrong. Chaos is hard enough for sane people, but forget the sane. Those with a shakier grip on reality might grab a gun and start shooting. Good grammar won’t stop mass murder, but order might help, and it will have to be a new kind of order, not the kind that tamed wilderness and created farms and cities. Our mettle is being tested, and we have to show up for the test. Now we get to see how ingenious American ingenuity really is.

Consider “My Fair Lady”, the movie in

Well chosen aforethought words can propel us to situations which complement our speech. In contrast, a lady was telling radio talk show hosts a story of a sad situation and how she overcame it. At the end I would have clapped as they did except for the, “ahs”, the “you knows”, the “I means”… words that fill in gaps when the brain gasps for words. For goodness sakes, if you are going to tell a million people a story, please practice it a few times first.

But some city leaders expressed concern regarding the ordinance and how it could impact the city’s practice of using its own drones at city events. Per the rules, Kyle officials must talk to police to get permission to fly drones during city-sponsored mass gatherings. Barnett said the ordinance effectively bans drone use at mass gatherings unless otherwise determined by him. The ordinance only applied to mass gatherings however and does not

regulate drone use in its entirety during other situations. The Federal Aviation Administration (FAA) requires drone operators to obtain a permit if they plan to fly their device more than 400 feet in the air. “The city tends to utilize drones at our mass gatherings,” said council member Tracy Scheel. “Often times it is to promote them.” However, Barnett said he plans to deny all drone usage during the Pie in the Sky balloon festival as he considers them a flight risk. “That’s a flight area where you have hot air balloon,” Barnett said. “In general, I’m not saying every drone, but we do not want citizens bringing their drones.”

Gloore ranches comes after a three-party panel awarded Blanco County landowner Matt Walsh $233,500 in damages for Kinder Morgan’s use of his land. The panel’s award was 11-times higher than Kinder Morgan’s $16,000 initial appraisal. According to TREAD, a condemner can petition a court to appoint a three-member panel of real estate professionals if a landowner and a pipeline company cannot agree on eminent domain negotiations. The panel considers the case and delivers an award, based on information from both parties. However, TREAD officials said Kinder Morgan’s appraiser was not present at two of the four hearings to defend the company’s assessment.

Patrick Reznick, an attorney representing Walsh, alleges Kinder Morgan only wants to compensate landowners for part of the land impacted by the 120-foot easement, but does not account for a possible “20-40 percent devaluation (of property) caused by the pipeline. “Their appraisal formula is inherently flawed,” Reznick said. Elyse Yates, spokesperson for TREAD, said landowners have been “trying for months” to help Kinder Morgan “understand the unique challenges” of the PHP in the Hill Country and defending their rights as property owners. “They won’t be intimidated by this company’s tactics,” Yates said. “TREAD will be there every step of the way.”

Precinct 1, which includes just south of Kyle and a large portion of San Marcos has the lowest numbers – 30,593 voters. Precinct 3, which includes western San Marcos and the college and west to Wimberley has 32,849 voters. However, even with those numbers, finding the right voting location is difficult. Sandra Dinarello, a member of the county election committee, explained the difficulties of finding a polling place on the east side of Kyle that meets the voting location requirements. “I personally drove through the east side of Kyle and Buda looking for locations that meet the requirements. We had brainstormed ideas, but it is difficult to find places with storage, strong Wi-Fi, parking and ADA. Whoever tells me ‘Well, you ought to check out the east side,’ I am going to challenge you to give me some places,” Dinarello said. A number of concerned citizens felt that there were too many polling locations in Wimberley and not enough in Kyle, based on

the population growth of each town. However, Election Administrator Jenifer Anderson assured citizens that the current list is not final. “I know we are going to add to Kyle. I want to emphasize is that this is just a recommendation process. People are saying ‘Why do we have six locations in Wimberley?’ Well, we have six recommendations in Wimberley,” Anderson said. There was also a bit of discussion about what to do about voting at Texas State University. A University of Texas student Zachary Price said he helped convince Travis County Commissioners to add a two polling locations to the University of Texas campus. Price said the statistics used for the University of Texas apply to Texas State. “Based on the number of voters coming out in the university area, there should be seven to eleven

polling locations on campus. Those numbers back up every large university in the state and if Texas State does not have a polling location it is likely to be the only large university in the state without an on-campus polling location,” Price said. Members of the court said they had discussions with Texas State officials about opening a voting location on campus. Texas State is prepared to offer free parking and utilize a newly constructed portion of the LBJ Student Center to meet voting poll requirements. However, that location is the only spot easily accessible to the public. The list of polling locations will be finalized when the court votes on the list. The list of locations under consideration include 16 places in San Marcos, six in Kyle, five in Buda, five in Wimberley, two in Dripping Springs and three with Austin addresses, but within Hays County.

OBITUARIES EVANS Jerry Lee Evans of Buda passed away on August 18, 2019 at the age of 75. He was born on Dec. 13,1943, in San Marcos, to Clyde and Elsie Evans. Evans graduated from Buda High School in 1962 and liked to tell people that he graduated in the top 10 in his class (out of 11.) Evans is preceded in death by his mother and father, his brothers and sisters, Jane, Billy, Dannette, Mike and Jimmy, and son-in-law Chris. He is survived by his wife of 53 years, Ruth Ann, his sister Shirley, brother Dave and his wife Minerva, and brother Terry and his wife Thia, his son Jay, his daughter Tammy and her husband Steve, his daughter Tracy, his granddaughters Ashley and soon-to-be husband Brandon, Kirsten and her husband Jonathon, and Kayla and Kacy, and the newest pride and joy of the family, great-granddaughter Kaytee Lee, as well as many nieces and nephews. Evans was a proud member of the United States Marine Corps from 1962-65, and was stationed in both California and Okinawa. Evans married the love of his life Ruth Ann on June 3,1966 and they had three kids, Jay, Tammy and Tracy. Evans was a member of the UA Plumbers and Pipefitters Local Union 286 for 51 years. He cared deeply about this organization and held an officer position for many years, including apprentice coordinator, president and business manager, but his passion was teaching the apprentices. He taught for many years. Even after he retired as business manager in 1998, he continued teaching classes. As an officer, Evans and Ruth Ann had to opportunity to go on many trips to conferences and meetings and made lifelong friends through them. Evans cherished spending time with his family and friends. He loved hunting at the deer lease, taking trips to Rockport, spending time at the lake at the Capital Rod and Gun Club, going on fam-

ily vacations, but his most favorite is the coveted Sunday lunches with his family. On most days you could find him watching HGTV with his wife and snuggling with their little dog Abby in his recliner. Evans loved telling stories, laughing and picking on his favorite people. Spending time with Evans would almost guarantee you would leave him having had some great belly laughs. A Memorial Service will be held at 10 a.m. Aug. 23 at the First Baptist Church of Buda. In lieu of flowers, memorial contributions may be made to the First Baptist Church of Buda.

GOODSON Heaven has a new Soprano. Barbara Mann Goodson passed away on Tuesday, August 13, 2019 in Buda, TX at the age of 85. Goodson is survived by her three children: her daughter Liz Goodson Russell of Los Angeles, California and her son Kirby, her son John Goodson of Sewanee, Tennessee, along with his wife Melissa and their children Slater and Mason, and her son Steve Goodson of Buda, along with his wife Paula and their children Ian and Eli. She is also survived by her sister Mary Ann Armstrong of Baton Rouge, Louisiana and numerous nieces and nephews. Goodson is preceded in death by her husband, Rev Mercer-Logan Goodson, as well as her parents, Jack and Mary Mann, and her brother, Jack Mann, all of Marshall and Longview. She spent her childhood in Marshall. She made lifelong friends and graduated from Marshall High School. She attended Hollins College and transferred to the University of Texas. There she met Mercer, a student at the Episcopal Seminary of the Southwest. After graduation, they married in 1954, and she began her role as the wife of an Episcopal priest. Together they served at Holy Trinity in Carrizo Springs, St. Nicholas in Ft. Worth, St. Matthews in Bogalusa, Louisiana, and

She and Mercer retired and moved to Austin in 1992. Goodson was a dedicated member of St. Elizabeth Episcopal Church in Buda, joining her voice with their choir. When traveling to Sewanee, Tennessee, she was lovingly welcomed by Otey Parish. She was an avid tennis player, playing both in Austin and Sewanee. She participated in leagues including the Volvo Tennis League and Onion Creek Country Club. She was an accomplished knitter, providing for her family, but also for those in need with Prayer Shawls. Goodson loved to play Mahjong, dominoes and card games of all kinds. She had a unique combination of skill and luck, often winning. Lastly, she was especially proud of passing the CPA exam after her children left the nest. Alvin Delouche Welch, a remarkable man of faith and humility who found opportunities in adversity, overcame obstacles, bettered mankind through outreach, mentoring and innovation, served his country, raised a wonderful family and loved a devoted wife, passed away in Kyle, Texas on Aug. 10, 2019, at the age of 88. Welch was born in Orlando, Florida on Sept. 29, 1930. He served his country honorably in the US Army initially rising to the rank of Tech Sergeant. Knowing that certain opportunities did not exist for Welch, the General facilitated Welch’s separation from the Army as a non-commissioned officer and re-enlistment and training as an officer and pilot. Welch went on to serve in Korea as a Fire Spotter for Artillery units flying slow-moving, small airplanes over enemy lines while taking enemy fire, navigating, calling in target locations and adjusting firing solutions from the air. He returned to base twice with a burning plane. While training in San Marcos to become an aviator, Welch met his loving wife, Mattie, while watching the flooded Blanco River at a bridge crossing in San Marcos. Following his second honorable discharge from the Army, Welch found his way to Western Electric where he invented a component that aided in the conversion of rotary dial telephones to the touch-tone system of pulses and tones. His work received national recognition when he was featured in Ebony magazine. A picture of his family taken at that time was even utilized in an economics textbook at the high school attended by

Buda Library awards outstanding young writers Earlier this month, the Friends of the Buda Library announced the winners of its annual Youth Writers Contest. In the 8-12 age group, Thaddeus Chancellor won first prize with his story of “The Race to Mars,” a tale of adventure starring a rather unlikely crew of space travelers. In the 13-17 age group, Gabi Rivas won with her piece entitled “Fading Away,” a story about a person’s dream and its meaning. All told, more than a dozen young writers in both age brackets submitted stories, which were judged by the Hays Free Press. Writers were tasked with creating an original story based on a writing prompt. The prompt for the 8-12 age bracket was “The astronaut looked out of the window of his spaceship to see nothing,” while the 13-17 group’s prompt was “Gazing up to the moon one cold, dark night, I thought to

I was strolling on the shoreline, hand in hand with the love of my life. The only noises that could be heard were the waves crashing on the beach and her radiant laugh. The moon was high in the sky, as were the stars, but Lucy's smile was more dazzling than any star. The chilly breeze and that smile whisked away every stress in my mind. I would have stayed there forever if I could. Lucy started to fade, and so did the beach we were standing on. I started panicking although it wouldn't have helped. This was a common situation, but the pang in my gut persisted anyways. Everything was fading except for the moon and the thousands of twinkling stars. I was strolling on the streets of a crowded town, hand in hand with the love of my life. There were dozens of people and shops. The crowd was talking over each other, lost in conversation with friends and family, but I couldn't interpret anything that was being

Texas’ future chief justice fought a duel An angry John Hemphill demanded satisfaction in an Aug. 27, 1832 letter to the editor of his hometown newspaper. Dueling was a rite of passage for male South Carolinians, and at age 28 the future chief justice of justice of Texas qualified as a late bloomer. His quarrel with the local newspaperman grew out of the violent debate over “nullification,” the eyeball-to-eyeball confrontation between the Palmetto State and the national government. European trade was the lifeblood of the South Carolina economy, which had been hemorrhaging badly under the commercial restraints of the federal tariff of 1828. The passage of a second and more restrictive tariff four years later provoked unprecedented defiance. In a dress rehearsal for secession, the South Carolina assembly adopted an ordinance declaring both acts “null and void.” Andrew Jackson responded with a presidential threat to send in the army to enforce the law of the land. As an enthusiastic supporter of the nullification movement, Hemphill took personal offense at the pro-Jackson views expressed by editor M.M. Levy. The adversaries met two days later on the field of honor, and the journalist proved the better marksman by winging the challenger in the traditional exchange. Less than two years after moving to Texas in the summer of 1838, Hemphill was appointed chief justice of the new nation’s highest court. He served the Republic and the Lone Star State in that important capacity for the next 14 years. While widely respected for the impartial way he presided over the supreme court, Hemphill did have his detractors. One critic claimed that when the court was not in session the chief justice would “lie about the places appropriated for loafers in a perfect state of torpor like a lizard in the winter.” Hemphill was a judicial activist in the truest sense of the modern-day term. He participated in the famous Council House Fight with the Comanches in 1840 and stabbed a chief to death in the wild melee. The following year, he left the bench to join the Somervell Expedition in pursuit of Mexican invaders, who temporarily terrorized San Antonio. Legislators met on Nov. 9, 1857 to pick two new senators. James Pinckney Henderson, Texas’ first governor, was the nearly unanimous

choice to succeed Thomas Rusk, who had committed suicide the previous July. But the selection of a replacement for Sam Houston took ten hours of rancorous wrangling and behind-the-scenes bargaining until Chief Justice Hemphill finally won out over William Scurry on the twenty-second ballot. The sorest loser in the chamber was the past president of the Republic, who had prematurely booked passage for Washington, D.C. Anson Jones could not believe lawmakers gave his senate seat to Hemphill, a man he accused of having “the practices of a gamester, the habits of a drunkard with a life of licentiousness and incest and a 17-year pensionship upon Texas.” In the United States Senate, Hemphill was an adamant and articulate advocate of southern sovereignty and the right to part company with the Union. In late 1860, he made such a persuasive case for secession that proponents of the pullout distributed 200,000 copies of the spellbinding senate speech in fence-straddling Virginia. Hemphill and 13 southern colleagues issued a dramatic call for “immediate session” on Jan. 6, 1861. The next month he traveled to Montgomery, Alabama to witness the birth of the Confederacy as the first six states – South Carolina, Mississippi, Florida, Alabama, Georgia and Louisiana – to withdraw formed a separate government. Even after Texas seceded in March and war began in April, Hemphill stubbornly refused to give up his seat in what had become the northern senate. He remained in the enemy capital until his inevitable expulsion that July. John Hemphill did not live to see the tragic conclusion of the conflict and the punitive post-war occupation of his beloved Texas and South Carolina. After a four-day bout with pneumonia, he died at Richmond, Virginia in January 1862. The former chief justice had company on his sad journey home. Col. Hugh McLeod succumbed to the same sickness the day before Hemphill, and their remains were transported together back to Austin for burial. The whole town turned out in

a cold drizzle to pay their last respects to the fallen heroes. During his 23-year absence from South Carolina, Hemphill visited his birthplace only once. He had hardly walked in the door, when a particularly pious sister asked if he believed God had forgiven him for fighting the long forgotten duel. Hemphill would have

On Aug. 13, members of the media got a sneak peek of Baylor Scott and White’s new Buda medical facility before it officially opens Sept. 28. Buda’s new medical facility, located on White Wing Trail near FM 2001, calls for a full-service 70,000 square foot facility that includes an emergency department, medical office space, operating rooms and imaging facility. Baylor Scott & White officials said a clinic on the grounds of the new medical facility is now open.

Kyle, along with Hays County and neighboring cities, is signing on to support the San Marcos Greenbelt Alliance (SMGA) and other park development agencies to further a massive trail project. On Aug. 6, Kyle City Council voted 6-0 in favor of a resolution main-

taining support for the proposed Emerald Crown Trail project. The trail would serve as the “backbone” for a series of trails connecting Hays County. Organizer Mark Taylor, president of the SMGA, said the trail will be a natural, preserved system meant to benefit the environment and support nonmotorized transit. The trails are intended to be

walker, hiker and biker friendly. “It’s a way to get from San Marcos to Buda and in-between those communities by walking, hiking, cycling ... but not in a motor vehicle,” Taylor said. “We want to work with landowners who see this as an advantage and not use eminent domain.” Project organizers began seeking support

in 2017 and the project is still in its early stages. However, the project is now overseen by a large working group which has created a trail master plan, held public forums and conducted planning with city and county officials. Taylor said the trail received a grant of community assistance, which
