The county resident who tested positive for this variant was asymptomatic, reported Hays County health officials. This variant of the coronavirus is more contagious and may

HAYS COUNTY — Miscommunication with the public is causing some residents to question how Hays County leaders are enforcing government decisions and distributing funds. Those claims came to light at the Hays County Commissioners Court meeting on Tuesday, Feb. 9. Dan Lyons frequently

BY MEGAN WEHRING With the pandemic still in our midst after almost a year, leaders discussed economic development and how to support local businesses. Hays County Judge Ruben Becerra and Caldwell County Judge Hoppy Haden joined the Greater San Marcos Partnership (GSMP) in a virtual conversation on Feb. 11 to look at the economic future and growth of both counties, as COVID-19 may not fully go away anytime soon. Businesses owners want to stay afloat, but they must remain vigilant in enforcing the necessary precautions such as face masks and social distancing. “The thing that breaks my heart is to see a fellow small business owner with a sign that says masks are not required in your business,” Becerra said. “I got to tell you the facts are out there, whether you choose to believe them or not is not my concern. My hope is that you will take one for the team, take one for the small business community.” Public health is at the forefront of the judges’ priorities. “We have seen a huge blindspot at every level of government when it comes to public health and our healthcare system as a whole,” Becerra said. “There are no better reminders than this pandemic to tell us that we are all in this together. We are all Central Texans. The stronger we are together as communities — the better we will be.” Returning to a good economic standing and helping businesses stay open is vital, Haden said. “Getting this pandemic under control is going to be crucial to getting people back to work and back out there, in doing what we were all used to doing and having the

best economy we have ever seen,” Haden said. “I think we will be right back there as soon as this pandemic is over.” Haden added that Caldwell, Hays, Travis and Bastrop counties are collaborating to develop a mega-vaccination site to have a capacity of 50,000 vaccinations a week if doses become available. Part of the economic stimulus are major transportation projects that include a western county connector for I-35 and I-30 and transforming part of Highway 21 into a ‘Super 2’ highway. This would allow drivers an opportunity to pass in both directions. “Transportation is huge,” Haden said. “I think it’s an enormous quality of life in any community to be able to get around and not spend more time in the car than you do at home.” As of Feb. 10, the U.K COVID-19 variant arrived in Hays County and was detected at Dahlstrom Middle School. With this in mind, Becerra compared what COVID-19 looked like

more than 365 days ago and now. “At the very beginning when the COVID-19 pandemic started here in Hays County, I was being asked to do things that I never imagined I would have to be asked to do or even entertain,” Becerra said. Just like the shortage of testing at the beginning, Becerra said there is a shortage of vaccines now. “The way the [vaccine] rollout is currently unfolding statewide is causing mass movements of people for vaccinations that are very scarcely distributed,” Becerra said. “We had our vaccination portal open, for example, and over 70,000 people tried to log on for 1,950 vaccines. Many people thought our system wasn’t working.” Haden agreed that the vaccine rollout has been a challenge for all parties. “We have been a little bit frustrated by the rollout but I recognize that our partners at the state have an incredibly difficult job just with the way the rollout happens,” Haden said. “We applied for a hub in our county and did not get one.” Becerra explained that while the Hays County pre-registration list will help qualified 1A and 1B individuals get into the system, they may not receive a vaccine immediately. “Getting on a pre-registration list doesn’t guarantee that you are going to get a vaccine this week,” Becerra noted. “But, at least you know you are in queue and the system is going to automatically shift through that.” Both Becerra and Haden concluded that acquiring enough doses would cause individuals to feel more comfortable going out in public and ultimately supporting local businesses.

In pandemic, access to public info at risk Guest Column by Kelley Shannon

historic stand to safeguard the free flow of information for years to come. The Freedom of Information Foundation of Texas and 20 other diverse organizations have formed the Transparent and Accountable Government Coalition to raise awareness about transparency laws and to support reforms in the 2021 legislative session. Some of these issues already existed, but the pandemic magnified them. In addition to Public Information Act updates, the virtual meetings provision of the Texas Open Meetings Act needs lawmakers’ attention. We must ensure fair rules for public participation in online government meetings, including having a phone call-in line for those without Internet access. State law also should clarify that the locations of COVID-19 cases in nursing homes and other long-term care facilities are public information. The TAG Coalition is working on these measures and several other open government bills, such as one calling for posting more government contracts online. On Tuesday, Feb. 9, state Rep. Giovanni Capriglione, R-Southlake, participated in a webinar about government financial transparency and how we can enhance citizens’ ability to obtain information through today’s technology. Lawmakers in both political parties are interested in working together to protect and expand public information access. It’s a continuous job to make sure Texas laws keep pace with modern times and that governments adhere to the letter and the spirit of our transparency laws. This pandemic era presents the opportunity to take yet another step on that honorable path.

Bold steps nearly 50 years ago created a landmark protection for the people’s right to know in Texas. Lawmakers approved the state’s open records law, now known as the Texas Public Information Act. Born out of a political financial scandal, the act’s aim was to allow citizens to hold public officials accountable. For the most part, this Texas transparency law has served us well. It’s essential in many Texans’ routine interactions with their government as they request police reports and school budget documents and so much more. It has been used to expose government action – or inaction – in the wake of hurricanes and floods and turbulent economic times. Now, amid the coronavirus outbreak, the Public Information Act is having another pivotal moment as Texans try to keep a watch on government during a pandemic. Where are COVID-19 clusters occurring? Are elderly loved ones safe? What’s the latest on COVID testing and vaccine distribution? How are taxpayer dollars being spent on pandemic aid in our communities? The Texas Public Information Act is supposed to help us answer these questions of life and death and following the money. But in many cases, governments are using the pandemic itself to ignore them. Some government offices closed their doors to the public to prevent spread of the virus and, citing attorney general guidance, declared this physical office closure doesn’t count as business days for responding to Public Information Act requests. That’s even if government employees are getting paid to work remotely with electronic access to records. This obstruction could go on indefinitely. It’s an outdated approach when much of the work world is operating remotely via email and Zoom meetings. Clearly, there’s a flaw in the interpretation of the law. And it can be repaired. Today’s state legislators, like their predecessors a half century ago, have the chance to take their own

I have a photo of two little Black girls sitting on a porch, with a quote to someone up north asking ‘if you think they had a bath, would they be white?’” Lynchings and people in black face were also documented and sold as souvenirs. Most of the time people transferred postcards of lynchings hand to hand “and with hopefully some shame along with it, like ‘better not show this to everybody,’” Wilson said. Then there were photographs of Native Americans, some staged to show that they were being treated well, but then other photos showed them standing in line, waiting for small rations of food. Throughout different chapters, hosting photos from a variety of topics in the early 1900s, Wilson details the historical impacts. But he was not

He branched out into many artistic fields, such as selling hand-made jewelry. His most recent venture, the collection and documentation of these postcards, took him about five years to finish. “I thought it would take one year to put together,” Wilson said, “but it took five because of amount of research.” Unlike many other books containing the images of postcards, Wilson wanted to make sure the history came through. He felt inspiration through the work of Ken Burns and often speaks of how Burns makes connections to history through people. “This doesn’t live up to his work,” Wilson said of his book, “but it’s the same concept – bringing people back to life.”

Westbrook serves as voice for many groups

After successfully coordinating a Black History Month program as a young teen, Vanessa Westbrook found her voice as a leader for marginalized communities — and she never looked back. “I would never forget it,” Westbrook reminisced about her program decades later. “We would put on this special program for the community to come and partake in. Students would do various skits and activities, just a variety of things. I remember doing that in the 9th grade, being a part of that group and one of the coordinators who actually helped establish what that program was like.” Since then, Westbrook has prioritized countless community outreach ventures in Hays County above anything else. About 12 years ago, Westbrook decided to settle in the city of Kyle after she discovered it was the “slice of heaven” between Austin and San Antonio where she would eventually retire. Westbrook is the proud mother of two daughters in their 30s with a toy chihuahua named Tinkerbell. Prior to coming to Hays County, Westbrook worked in the science, technology, engineering and mathematics (STEM) field for years. While the STEM workforce has started to become more diverse over the years, only 7% of workers are Black, according to data from the Pew Research Center. Women are also underrepresented in some careers including computer jobs and engineering, but they are overrepresented as healthcare professionals. Despite the Gap, Westbrook has held many roles in STEM: science instructor at the Fort

As a member of the Hays County Historical Commission, Westbrook helped recognize the Kyle Family Pioneer Cemetery as a significant part of Texas history by establishing an Official Historic Texas Cemetery Marker in 2019. Her first endeavor as the Chair of the African American Heritage Committee was collaborating with Black woman leaders across Hays County to plan events and proclamations for Black History Month. Westbrook credits this partnership with Sandra Bryant of Buda, Jonnie Wilson of the Hays-Caldwell Women’s Center, Ramika Adams of San Marcos, among others. governments followed suit. “We hope this is one of many events that we will do this year and years to come,” Westbrook said. “Hays is being progressive and proactive in addressing the achievements of African Americans in our county.” Westbrook said celebrating Black History Month has always been a tradition for her. “Being a part of Black History Month has been something I have known since I was a child,” Westbrook said. “You’re doing something special while being a part of programs and things like that.”

One of Westbrook’s many passions is ensuring that every person has a seat at the table. “For a very long time, stories weren’t necessarily told correctly or African Americans were left out,” Westbrook said. “We have very educated African Americans now. We have lots of tools, social media and all kinds of ways to get the story out. So it’s not that the story wasn’t there, it just wasn’t told.” Though she may be retired, Westbrook continues to surprise many with her ambitious personality and contribution to society.

From farm boy to legend in 21 years On Feb. 22, 1878, Sam Bass and his gang pulled the first train robbery in Texas history hitting the Texas Central at Allen Station 24 miles north of Dallas. Fed up with the daily drudgery on his uncle’s Indiana farm, young Sam Bass headed southwest in 1869 to make his cowboy dream come true. Hired by a rancher outside Denton, the likable youth was a steady hand for several years. However, by 1874 Bass had fallen in with a bad crowd. In cahoots with a local character, whose claim to fame was a church burning, he got his first taste of easy money by tricking gullible bettors into wagering against a sluggish mare. The crack of a pistol shot transformed the ringer into a racing demon that could outrun anything on four legs. After the collapse of a cattle scheme six months later, Bass and new buddy Joel Collins were stranded in South Dakota. Flat

broke and thousands of dollars in debt to Texas investors, they resorted to sticking up stagecoaches with three indigenous ne’er-do-wells. On Sep. 18, 1877, Bass and his associates surprised a train stopped for water near Ogallala, Nebraska and carted off $60,000 in freshly minted twenty-dollar gold pieces. The outlaws quickly divvied up the loot and parted company with the two Texans anxious to put the Red River between them and their pursuers. Eight days later, federal cavalry cornered three of the fugitives and killed them when they refused to surrender. Bass and Collins were better at dodging army patrols in the Oklahoma Territory and eventually reached Lone Star sanctuary.

By December, Collins was six feet under and Bass was busted again. He recruited old acquaintances from Denton for a North Texas crime spree which included, for an apparent change of pace, the holdup of the Fort Worth-Weatherford stage. The train robbery went so well at Allen Station in February 1878 Bass decided to try it again two months later at Mesquite. But the botched attempted ended in a wild shootout provoking a public outcry for a crackdown. During the manhunt, Rangers arrested Jim Murphy for harboring the wanted men. In exchange for his freedom, he offered to infiltrate the gang and to arrange their capture. Frustrated by the fruitless search, Major John B. Jones cut the distasteful deal. While passing through Belton on Jul. 13, the undercover informant slipped into the post office and frantically scribbled a note to Ranger headquarters in Austin. “We are on

our way to Round Rock to rob the bank,” Murphy wrote. “For God’s sake be there to prevent it.” Bass had never robbed a bank, especially in broad daylight, and thought it wise to take one last look the day before the caper. Accompanied by Frank Jackson, Seaborn Barnes and the traitorous Murphy, he quietly rode into Round Rock on Jul. 19. Major Jones and three other Texas Rangers were scattered around town and did not immediately catch sight of the quartet. Murphy separated from his unsuspecting comrades, who casually strolled into the general store next to the bank. Ignoring Major Jones’ instructions to give the bandits a wide berth, Deputy Sheriffs Ellis Grimes and Morris Moore foolishly followed the trio inside. Grimes tapped Barnes on the shoulder and inquired if he was carrying a concealed weapon in violation of the community’s gun-control ordinance.

Barnes spun around and took the deputy’s life with a single squeeze of the trigger. A second shot knocked his partner out of commission, but he lived to tell about his near-fatal run-in with the Bass Gang. The state lawmen and a number of public-spirited citizens were armed and ready, when the outlaws came out the door. Ranger Dick Ware, who did not pause to wipe the barber’s lather from his beard, drew a bead on Barnes and killed him instantly with a bullet in the head. Bass and Jackson reached their horses but had to ride through a gauntlet of gunfire to make good their escape. Ranger George Harrell fired as the pair went by, and his slug struck Bass in the back exiting near the navel. He fell out of the saddle a hundred yards down the street, but Jackson risked almost certain death to rescue him. Calmly returning fire with one hand, he helped his broth-

er bandit onto his horse with the other and they disappeared in the dust. Bass knew he was done for and that night persuaded Jackson to go on alone. He reluctantly complied and rode away never to be heard from again. The Rangers found the mortally wounded Bass the next morning and carried him back to Round Rock. He saw one more sunrise before dying on his twenty-first birthday. As gunfighters go, the personable Midwesterner was small potatoes compared to the likes of John Wesley Hardin, Bill Longley and Ben Thompson. In fact, he was never even accused of murder. But years of persistent promotion turned Sam Bass into a frontier legend.
