At the conclusion of the April 6 district game, both teams joined together for a quick photo to show support for Johnson High Athletic Trainer Amber Jones, who earlier this year was diagnosed with breast cancer and is currently combatting the disease. KYLE – Residents can expect to see even more development in Kyle. Just a few miles south of Austin, the city of Kyle is booming with more foot traffic than ever seen before. City council agendas have been filled with zoning ordinances and development proposals for approval. On April 6, Kyle City Council approved three rezonings on first reading that could lead to potential developments. A second reading is still needed for full approval on the following projects. Sixty-two acres of land, known as the Coleman Tract, will be converted from agriculture to a warehouse district. This property is located at 24801 Interstate 35.

With a 5-0 vote, Hays County commissioners agreed to submit a letter of intent to the Texas Indigent Defense Commission (TDIC) regarding public defender opportunities, pretrial service opportunities and managed assigned counsel. DRIPPING SPRINGS — After several months of deliberation, the Dripping Springs ISD Board of Trustees unanimously approved new attendance zones on Tuesday for the 2021-2022 school year. The board approved Elementary Option E-1 and Middle School Option 1-A, which are modifications of previously presented options. Adjustments include unit 33 to remain at Walnut Springs Elementary and unit 35 to remain at Dripping Springs Elementary (DSE), along with planning unit 20A to be zoned to
Sycamore Springs Middle School (SSE). These are reflected on the map provided by DSISD. Spring has sprung Crow’s Nest by Clint Younts
Bluebonnets are thick as ticks on a hound’s belly, and other wildflowers have begun popping up in my pasture. My pecan tree and those devilish mesquite trees have just sprouted leaves. So, after our horrific week of winter, I officially declare it’s springtime in Texas. Most native Texans are aware that spring weather in the Lone Star state is unpredictable and fluctuates from hot to cold at the drop of a hat, making me think Mother Nature is menopausal. Unlike the other seasons, you just can’t predict the weather in spring. In summer, we know it’s gonna be hot as Satan’s belt buckle and dry as a camel’s turd. In the fall, it start’s out blazing hot, then turns bitterly cold on the one Friday night you decide to attend a high school football game. As for winter, normally we get a week or two of frigid weather (for us Texans, that’s when the temperature drops below 58 degrees), but the rest of the time, it’s right pleasant. I’m a bit curious what first-year residents in Texas, possibly immigrants from California or some gawd-awful place north of the Red River, think of our spring so far. I reckon those folks of northern descent are liking our warm springtime weather. They might have a different opinion once their outdoor thermometer explodes after the mercury shoots up like an Elon Musk rocket. We can wake up to a chilly April morning and have our coffee out on the deck, but by 10 o’clock, the heat and humidity will have your pajamas clinging to your skin like barnacles on a shrimp boat. What do y’all imported Texas residents (I’m sorry, but you aren’t a Texan just because you live here) think of our spring flora? Sure, the wildflowers are beautiful, but what do you think of the yellow tint on your white Mercedes now? How many times a day do y’all go through a car wash? Native Texans accept the fact
that we’ll all drive yellow vehicles for a month, then grab a chisel and the garden hose and wash off all the pollen. Speakin’ of pollen, who else has a sinus cavity full of snot and their head feels like an over-inflated Michelin? Luckily, I have good allergy pills and absorbent shirt sleeves. If you newcomers are also suffering, don’t worry. It’ll only last 3-4 months. Pass the Flonase. I’m also curious if y’all like the little green caterpillars that dangle from elm trees better than the big fuzzy ones that crawl all over the oak trees. They both like to plop down on your neck. These caterpillars are kinda like snowbirds. Once a year, they drop down from above us, hang around and become a nuisance. Then, once the days get hotter than the engine block of a stolen Chevy, they just disappear. Spring also is when snakes and stinging insects reappear. Are y’all acceptant of these Texas residents, too? I suppose these nasty critters also live in other states, but I’ve only gotten intimately close to them here in Texas. Speaking of insects, of all the millions of species on earth, I suspect half of them reside in Texas. Heck, I found about a hundred of them crawlin’ up my leg yesterday. Have y’all noticed Mayflies and June bugs always appear in March or April? I guess they don’t look at the calendar. This morning, well before dawn, I thought a meteor had exploded and was pelting our house with space debris. Turned out it was a swarm of myopic June bugs. Yep, spring in Texas can be beautiful and bothersome, all at the same time. Crazy weather, irritating pollen and annoying insects might drive some folks away, but most native Texans love springtime. If y’all newcomers aren’t liking our spring, just wait until summer gets here. Don’t throw your moving boxes away just yet.

According to Gallup, the number of Americans who belong to a church, synagogue or mosque continued to decline last year, dropping below 50 percent for the first time in Gallup's eight-decade trend. And thanks to the COVID pandemic, ABC News says enrollment in Catholic schools has seen the largest single-year decline in at least five decades. I'm not sure what this rapid secularization of America means for our future. But I do admit I wish more of today's children could experience the memorable upbringing I enjoyed growing up in a Catholic family. Growing up Catholic in the 1970s meant going to a Catholic school. Unlike too many schools today, in which some teachers fear their students, it was a time when we students of St. Germaine Catholic School feared the sisters. The estimated maximum interest rate provided herein is not a limitation on the interest rate at which the bonds, or any series thereof, may be submitted to the Texas Commission on Environmental Quality for purposes of approval of issuance of the bonds or the interest rate at which the bonds, or any series thereof, may be sold. Tigers lose to Greyhounds in late innings
On Saturday the Dripping Springs Tigers baseball team (18-8-1) lost 6-2 to Boerne-Champion High School (12-4). With a tied 2-2 score going into the 7th inning, Boerne-Champion scored four runs in the last inning of the game. Dripping Springs was unable to convert in the bottom of the 7th inning. Buck graduated from Fairmont High School in Dayton High School in 1960. He attended DePauw University in Greencastle, Indiana from 1960-1962 and was a proud member of the Sigma Chi Fraternity. Buck attended Washington State University from 1962-1965 in Pullman, Washington graduating in 1965 with a B.A. in Business and a B.S. in Electrical Engineering in 1965. While in attendance at WSU, he was member of the Washington State University Track Team and Captain. A highlight of his track and field career with a 5th place at the 1964 Olympic Trials in the Javelin and he still holds the indoor record. He started his 35-year career with IBM after college where he met his surviving wife Linda Ann Lewis Kipe in Seattle, Washington. They celebrated 54 years of marriage in May of 2020. Vaccination times will be from 8 a.m. to 11:30 a.m. and from 1 p.m. to 4 p.m. Residents ages 16 and up are welcome, but anyone under 18 years old must be accompanied by a parent or guardian. There will be 2,900 available doses across the five vaccination days. Patients must be able to come back after three weeks to get their second dose. Curbside shots are available; arrangements can be made with the onsite staff members. This vaccine clinic will be open while supplies last. So far, 106,000 Hays County residents have received at least one COVID-19 vaccine dose, according to Mike Jones, director of Hays County Emergency Services. Within Hays County, 38% of people ages 16 and older have received at least one vaccine dose, and 24% of that demographic are fully vaccinated. About 78% of county residents who are 65 and older have gotten at least one shot of the vaccine, and 59% of that demographic has been fully vaccinated.
blood clots. The Hays County Local Health Department (HCLHD) had been waiting to receive the J&J vaccine since FDA approval in early March, but HCLHD has not received any of these vaccines to date. This will not affect the county’s vaccination effort because the county has not been using J&J, said Mike Jones, director of the Emergency Services Office. “I think it’s kind of a blessing that [Hays County did not get J&J doses] based on the issues with it,” said Jones. The exact correlation is unknown, he added, but it is best that the county steps away from that vaccine until more information is available. While the county has not given this vaccine to residents, some private medical offices in Hays County began receiving the J&J vaccine since the week of March 8, with the most recent shipment on Monday. Throughout this time
period, 18,100 J&J vaccines were received by private medical providers, according to data from the Texas Department of Health and Safety. The Centers for Disease Control (CDC) will convene a meeting of the Advisory Committee on Immunization Practices (ACIP) this week to further review these cases and assess their potential significance, according to a CDC and FDA press release. The health agencies recommend the pause on use of the vaccine until the process is complete.

The six women who suffered from the blood clots developed the illness within one to three weeks after receiving the vaccine, according to the New York Times. All six women were between the ages of 18 and 48; one woman died and another was hospitalized in critical condition. “People who have received the J&J vaccine who develop severe headache, abdominal pain, leg pain, or shortness of breath
within three weeks after vaccination should contact their health care provider,” the FDA and CDC press release said. “Health care provid-
ers are asked to report adverse events to the Vaccine Adverse Event Reporting System at https://vaers.hhs.gov/ reportevent.html.”

Judge Thompson files lawsuit against other county judges BY SAHAR CHMAIS HAYS COUNTY – County Court at Law (CCL) #3 Judge Millie Thompson filed a lawsuit against the other CCL judges, Chris Johnson and Robert Updegrove. The petition for declaratory judgement was filed late Thursday morning, April 8 at the Hays County District Court. Thompson, the plaintiff, seeks a declaratory judgement to allow her sole discretion to appoint a court coordinator for her court who serves at her pleasure. In the Hays County Courts at Law, the court coordinator hiring and firing process is handled by the administrative judge, who is Judge Johnson. Hays County has set up a court coordinator system where the coordinators serve multiple judges, not just one. Additionally, Thompson’s case seeks that Johnson and Updegrove shall vote on a reasonable salary for the court coordinator position and move those funds from Johnson’s control to Hays CCL #3. In the lawsuit, it is argued that court coordinators are appointees “for his court” and “serves at the pleasure of the judge who appointed him.” This is cited under

Texas Government Code 74.101. The code, under compensation section 74.104, also states that judges determine reasonable compensation for court coordinators, subject to approval by commissioners court. According to the lawsuit, Thompson had tried to keep the same court personnel, but after a series of problems with the coordinators, Thompson wanted to appoint her own court coordinator. Thompson went through the Human Resources (HR) department, which advised her that only Johnson could authorize the new hire, according to the lawsuit. After the retirement of the court administrator, a court coordinator was promoted to that empty position, so Thompson asked that the court coordinator position be reassigned to her court authority. The case goes on to state
that Thompson went to Commissioners Court and made the same request, but once again she was denied. Commissioners Court asked that judges work the issue out amongst themselves. On March 29, Johnson indicated there would be a CCL judges meeting, but Thompson never received the call. The following day, Johnson sent an email that he and Updegrove convened without teleconferencing Thompson. Her request for the court coordinator was denied, according to the law suit. “Judge Thompson has tried everything she can to avoid official legal process,” the lawsuit reads, “but she requires a court coordinator who answers solely to Hays County Court at Law #3, the Texas Legislature has granted her the discretion to make that decision for her court, and she is at an impasse with Judges Johnson and Updegrove.”

“It’s not only providing legal representation to individuals which is extremely important,” Ingalsbe said. “But it’s also providing the resources and making those resources available to those individuals to ensure they have the greatest opportunity to succeed.” Several speakers urged county leaders that there needs to be at least a 50% caseload in the new PDO. The caseload refers to the percentage of either misdemeanors or felonies that a PDO would handle; this is directly related to the attorneys and staff needed.
“I have to assume that the reason the PDO keeps coming up is because we all know at some level, it is the right thing to do,” said Christine Terrell, Hays County resident. “There is no question. We have far too many people sitting in our county jail for far too long.” Shannon Fitzpatrick, former county prosecutor, was the second to speak up. “Let’s see how the 50% goes and be prepared to move quickly upward from there,” Fitzpatrick said. “That is the most cost-effective approach and it will begin to
provide the county with the greatest quality for its money.” The case types and percentages for a potential PDO in Hays County have not been finalized. Fitzpatrick added that even with its best intention, private attorneys can be difficult for the courts to manage. For that reason, she concluded that a PDO is critical for the county. “It is supported by the [District Attorney’s] Office and it’s supported by the neighboring cities who have found it transformative in their communities,” Fitzpatrick said.

Chris is an asset to our department.” While Perez has generally kept to himself, he did not stand by to being fired. Perez told Thompson that she does not have the authority to fire him because in Hays County courts at law, only the administrative judge, Chris Johnson, can fire the court coordinators. After this, Perez was told to work from home for a couple of weeks and then he was placed into Johnson’s service, no longer interacting with Thompson. But the state code on hiring and firing court coordinators has caused some issue; Lobb is arguing against the way Hays County chooses to enact it. According to Lobb, elected judges should have the right to hire and fire their court coordinator. Counties do not get to amend that; it is a problem of “‘this is how we do it in Hays County,’ they got so used to it no one ever challenged it,” Lobb explained. Thompson has been trying to appoint a court coordinator who works directly for her and no other judge, but because she does not have the authority in Hays County, she has taken this matter to court. Late morning on Thursday, April 8, Thompson filed a petition for declaratory judgement in the Hays County District Court against CCL judges Johnson and Robert Updegrove, requesting that she be given authority over employees who would work directly in her office. Thompson appealed to the Hays County Commissioners Court in late March to hire her own employees and was denied.

“I said ‘no, I will not sit, I prefer to stand, what’s going on,” Perez recalled the event as he fiddled with his fingers. “She says ‘you’ve lied to me twice by omission. Spill.’” Thompson asked Perez to “spill” several times without telling him why she believed he was lying. The last time she asked, she slammed her hand on the desk. Perez, unknowing of these allegations, said he could not elaborate if he did not know what he was accused of. “She snaps her fingers and says get out, and she starts yelling at me at that time and begins to charge at me and she’s like ‘get out, get out! I’m stunned but I ask her to show me the proof,” Perez said. “She came at me wagging her finger telling me ‘you’re fired, you’re fired.’ I kind of just stand there because I’m in shock – I don’t know what she’s going to do.” According to Perez, people were out of their offices in the hallway watching to see what happened. “They were all shocked, surprised it happened with me because I am one of the nicest people in that office and I’m very quiet,” Perez said. “All I do is mind my business and just do my work. So for that to happen and then to attempt to fire me was appalling to all of them.” Perez’s employee reviews also reirriterate what his coworkers think of him. He was evaluated by two different judges and Perez had a near-perfect history in the CCL. In his latest review, which was done for 2019, he received a total of 128 points, the highest possible score. Former Judge Tacie Zelhart, who was the CCL #3 judge before Thompson, wrote in her evaluation, “Chris is an amazing em-

County Court Conflict hearing was also listed on the calendar the judges use to check their schedule, Perez explained. Thompson missed the hearing because she was unaware of it. Her lawyer, George Lobb, who Thompson asked to speak on her behalf, said that it did not show up on her calendar. According to Lobb, Perez “set her up.” Thompson’s work email is at work, and Perez sent the email after she had left the office, Lobb said. According to Lobb, Thompson had been having issues with accessing her work email from home. Communicating with Thompson seems to be the heart of the conflict – one side states that there is an issue with access, but the other side states that Thompson chose email to be her main communication line. “I tried to communicate with her prior to her first day taking office to see how she wanted dockets done and what not,” Perez told the Hays Free Press/ News-Dispatch. “She wasn’t very responsive; she doesn’t respond via text although she has a phone from the county that is for her use. Everything is via email, she wants everything written, so it’s very hard for me to communicate with her.” Still, Lobb wonders why Perez did not talk to Thompson the next morning when he saw her unloading items into her office. That morning, her probate was set at 8:30 a.m. Perez said he did not see Thompson unloading these items and did not see her until 9:15 a.m. Thompson tried to fire Perez after this scheduling and communication incident, according to Lobb. Thompson called Perez into her office; when he walked in, he left the door cracked open, unsure of how she would react because he had heard her yelling at the maintenance guy the day prior. The slim 5’4” Perez wanted to keep his distance from Thompson. In his recollection, Thompson demanded that he reset the probate, then shoving the folder into his hands.
