The Kyle Police Department continues to investigate an officer-involved shooting that occurred after a 21-yearold man fled from a traffic stop in the Steeplechase subdivision. No one was injured in the incident, but charges have been filed

against Javier Hernandez, of Kyle, who was booked into the Hays County Jail Sunday. Kyle Police Chief Jeff Barnett said the incident began around 7:30 p.m. Saturday when police conducted a traffic stop along Brandi Circle. The stop involved a driver who police suspected of Driving Under the Influence (DUI). When police initiated

the stop, Barnett said the suspect, later identified as Hernandez, immediately fled the scene at a high rate of speed. Hernandez drove through neighborhood streets, bypassing stop signs and narrowly avoiding two vehicles before leaving the roadway. Hernandez drove his vehicle into a ditch near the Brandi Circle and Goforth Road inter-

section. As the officer exited his patrol car, Hernandez was alleged to have reversed his vehicle toward the officer, who then fired “multiple” shots with his handgun at Hernandez’s vehicle, according to a release. It’s unknown at this time how many shots the officer fired.

Hays County Commissioners approved a resolution Feb. 21 supporting and requesting the creation of an additional district court and county courtat-law. With the support of

commissioners and county officials, the request is moving to the 85th Texas legislature for possible approval. Precinct 3 Commissioner Will Conley worked with Senator Donna Campbell and Representative Jason Isaac on getting the proposal on the state legislature’s agenda.

As Hays County continues to grow, officials agree there’s a need for additional courts. County district judges and court-at-law judges unanimously supported the proposal, as did the Hays County Bar Association, District Attorney Wes Mau and the San Marcos Police

Officers’ Association. County officials, including judges, the DA, clerks and law enforcement, have worked to manage civil and criminal proceedings as efficiently as possible. However, the county and its volume of court proceedings continue to

Buda man indicted for murder in fatal wreck BY MOSES LEOS III

A Buda man involved in a fatal December 2016 collision on FM 2001 was indicted by a Hays County Grand Jury earlier this month on a charge of murder and intoxication manslaughter. Rogelio Garduno, 36, of Buda, was booked into the Hays County Jail Tues-

day on $200,000 bond as a result of the indictments. An indictment is a formal accusation of a charge, but does not constitute guilt. In addition, Garduno will also be required to have a deep-lung alcohol analysis ignition lock device installed in his vehicle as an order for his bond.

According to the indictment, Garduno is accused of driving while intoxicated and GARDUNO running his vehicle head-on into a vehicle

driven by Frances Campbell, 58. Campbell was killed following the collision, which took place around 9:30 p.m. Dec. 7, 2016 on FM 2001 between Satterwhite Road and Hillside Terrace. The Hays Free Press reported Campbell was transported to a local hospital, but later died of her

injuries. According to the murder indictment, Garduno allegedly committed an “act clearly dangerous to human life” and is accused of having driven while intoxicated with two or more previous convictions. In September 2006, Garduno was arrested by Hays County Sheriff’s

Office for a misdemeanor DWI charge. A murder indictment in a DWI case is the second such instance tried by the Hays County District Attorney’s Office this year. A Hays County jury in March found Buda realtor Jason Tarr guilty of murder and intoxication manslaughter in the death of Nancy Sterling-Dalton.

By comparison, authorities in Kyle responded to 21 traffic-related incidents during the week previous.

Police urge caution after string of car accidents BY MOSES LEOS III A total of 47 traffic incidents, including a fatality collision on Interstate 35, took place on Kyle-area roads from July 24 to July 29, causing Kyle Police to urge caution on the roadway. One of the more

severe accidents took place in the overnight hours July 29 when one person was killed in a collision involving an 18-wheeler on I-35. Jennifer Ortiz, 30, of Austin, was identified as the victim in the fatality wreck, which occurred after midnight on the

northbound side of I-35 near the 213-mile marker. Jeff Barnett, Kyle Police Department chief, said a black Kia Soul, operated by Ortiz, was traveling on I-35 when it collided with a retention wall. The vehicle spun and came to a stop in

the middle of I-35. Barnett said an 18-wheeler, operated by Wayne Tijerina, 29, of Compton, collided into the Soul. It’s believed the driver was unable to see the Soul in the roadway as the car’s lights were rendered inoperable in the collision, Barnett

said. Hays County Pct. 2 Justice of the Peace Beth Smith pronounced Ortiz dead at the scene. Barnett said alcohol is not believed to be a factor. However, a toxicology report will

A recent leukemia diagnosis has forced Hays County’s top elected official to temporarily step off of the dais in order to begin treatment. Hays COBB County Judge Bert Cobb announced at the end of Tuesday’s Commissioner’s Court meeting he had been “diagnosed with a lethal disease,” later identified as Leukemia, and that he would begin treatment as soon as next week. It’s unknown at this time how advanced Cobb’s leukemia diagnosis is. Ten years worth of scuttlebutt could soon come to an end as Kyle city officials Aug. 15 unveiled plans for a privately-funded eastside sports and recreation park. That complex, known as Kyle Vista Park, would encompass 46-acres along Dacy Lane near Chapa Middle School and could harbor a tennis complex, volleyball facility, a recreation center and, potentially, a skate park. Kyle city manager Scott Sellers said the project, which went under the code name “Just Peachy,” has been on the city’s agenda “in some form or fashion” for the past year. San Marcos man charged with drunk driving death BY SAMANTHA SMITH Authorities arrested a San Marcos man Saturday who had been charged with intoxication manslaughter after he allegedly was four times over the legal limit in a fatal June collision in Kyle. Cory Wayne New, 22, was booked into the Hays County Jail on one count of intoxication manslaughter, which is a first degree felony. Jeff Barnett, Kyle police chief, said the accident occurred June 12 around 6 p.m. near

the 211 mile marker on I-35 in Kyle. Barnett said New, who was 21 at the time of the incident, was driving along northbound Interstate 35 in a 2016 Freightliner moving truck when he rear ended an 18-wheeler that was slowing down onto the shoulder.
