Have you ever heard the old expression “Time flies when you’re having fun!”? That old adage is spot on when describing my first full year at the BIA! This past year has been a whirlwind of great activities and successes. From an outstanding Homearama ‘16 at Norton Commons and River Crest, with record setting attendance and robust home sales, to a well-attended Tour of Remodeled Homes showcasing the skills and craftsmanship of our remodeling professionals and their teams of experts, the public was treated to the best our industry has to offer in home design, decor and finishes. Thank you to Gail Schell, All Sauer, Margie Brangers and our whole BIA team for pulling this off! We cannot forget the efforts of our advocacy team, led by newly minted Vice President of Government Affairs Annie Dutton and Government Affairs Committee Chairman John Miranda and Co-chair John Hollenbach. We had several advocacy victories during the year, but probably none greater than these two issues: PVC Piping – With a yearlong advocacy campaign, we amended the Kentucky Plumbing Code to allow for the use of PVC pipe in buildings of any height instead of cast iron pipe. This outdated and onerous regulation added significant cost to projects and put Kentucky at a competitive disadvantage since our neighboring states did not have this regulation. Thanks to pro-business Governor Bevin’s Red Tape Reduction initiative and the hard work of many BIA members, we eliminated this regulation, which will save our members millions of dollars on an annual basis. H.B. 72 - The passage of the “appeals bond bill” was a huge win this legislative session. It is designed to stop the frivolous lawsuits that have impacted our industry for decades. As we know, an appeal can be made ad infinitum, needlessly holding up zoning cases at a great expense to the applicant. As Mayor Greg Fischer says, “Time
is money, and delays kill deals.” No one knows this better than our members. These are two important victories we achieved, in addition to the early session wins in Frankfort allowing right to work and repealing the prevailing wage requirements. We are thankful for a business friendly and growthoriented state legislature and governor! We have seen vast improvements in public relations efforts promoting our public events. They have been worth hundreds of thousands of dollars in “free” publicity for the benefit of our membership! Thank you to Vickie Miller and Jason Walton for taking our communications and publications up a notch or two! We have a great staff that hums along despite the change in leadership. We are working hard every day to provide the best service and representation to our Association. It is hard to believe that half of our staff has only been at the BIA for a year and a half and the other half of our staff are decades-old veterans. Thank you to Robin Durham, Jan Andrew, Stephenie Hood, Amy Elliott, Carrie Lyons, and Katharine Shafferman for the great work that they do. Thank you to this Association for being who you are. You are volunteers who have the shared goals and vision of making our industry the best it can be. I firmly believe we represent the best of the best. I see it every day in your efforts. Pat Durham Assesses His First Year at the Helm of BIA Just over a year ago, on June 1, 2016, Pat Durham assumed the role of BIA Executive Vice President. Louisville Builder looks back with him at his first year. By Nancy Miller
In one word, how would you sum up your first year? Eventful. But if I weren’t limited to one word, I’d also say, never a dull moment. What have been the issues on which you have placed the most emphasis? I wanted to get a better handle on staff interaction with me and with each other so that they understood what was happening, for me to understand how I could help them be effective at their jobs and for them to understand I would need their help to be effective in mine. For the big public shows like Homearama and the Home, Garden and Remodeling Show, much of our year’s agenda was set. It was a matter of ensuring they went off as they should and for the entire process to be as least disruptive as possible from the previous administration to the new one. I also looked at the calendar to be sure things were planned and set up accordingly and to be sure whoever was responsible for the events had the support they needed.
Another priority, and it is very fluid, is government affairs and our advocacy efforts on behalf of our members. We always have to be on the look out for issues that could have a negative or positive impact on their business. When you look back at the year, of what are you most proud? That I’m still here! But, seriously, we had a lot of items we wanted our state representatives and senators to support on behalf of our industry during the legislative session that just finished. We had a great outcome for our members and our industry. Something else of which I am proud is that I have taken to heart listening to our membership and paying attention to their needs and wants to ensure, when possible, that we improve our level of service to them. I believe if you’re ever going to make changes, do it while you’re a newbie and you don’t have preconceptions. Now that I’m in the leadership role, I don’t have any preconceptions if I think the change will benefit our membership. I’m not afraid to make those changes. june 2017 7

Have there been disappointments? When you lose a battle, you’re disappointed. I’m a pretty competitive guy but I’m competitive with some reality. If we lose on an issue but we gave our best effort, I’m not disappointed. Even when we fought Metro Council, if we didn’t get our whole win but we got modifications or some alternatives as concessions, I was okay with that. Sometimes you have to look at the battle, not the outcome of the war. We recently did everything we could do to derail a proposal in Metro Council, but we didn’t win. It was a situation where we had very little time to react. In that time we did what we thought was best. All we could do was make our point known to Metro Council and the Mayor. We opposed the proposal but they passed it. We don’t agree with it, but we will continue to work work with Metro Council and the Mayor to advocate for our members. There are so many people involved in BIA, so many programs, so many projects. At times, it must be like herding cats. Do you think of yourself as an exceptional herder? I don’t know about exceptional, but I know I’m a compromiser and I seek counsel and advice. If I can find a way to get some sort of a win out of a situation, I’ll take that instead of going full speed ahead, asking for only one outcome and getting nothing out of it. You have to try to form coalitions. Whether that’s internal with our staff, membership-oriented or external with our public, we have to do what’s right for our members. I’d say I do that very well. 8 louisville builder • bialouisville.com
What do you see as BIA’s greatest challenges in the next couple of years? There are two things I would put on equal footing. One is providing relief from a workforce development standpoint. So many of our members are suffering because they can’t find labor. We’re making a concerted effort to help increase workforce initiatives through an outreach to public high schools, trade schools and organizations that train workers. We’re working with public schools to create career pathways designed for students who want to find a career in the construction trades. Several public schools are going to offer electrical, plumbing, carpentry, welding, and heating and air programs. The students will become proficient in these areas and gain accreditation so that when they graduate, if they elect to go on to a trade school, they will have earned college credit that allows them to be placed in a year two program. If they’re not going for advanced training, they’re immediately more marketable than someone who has had no training. Our second biggest need has to do with available land for our builders ‒ residential or commercial ‒ to create new subdivisions or new properties. We’re running out of properties and lots. Louisville is projected to grow by 65,000 new homes in the next 20 years, and we have to seek out areas where we can impact growth in a significant way. However, this can’t occur without sewers. The BIA has been working very hard with MSD and city officials to bring sewers to areas that are without them. Candid, insightful and humorous, that’s Pat Durham. Positive, energized and focused, that’s the BIA under his leadership.
Tour of New Homes had Strong Showing in Low Inventory Market The Tour of New Homes, held April 29 & 30, featured 60 new homes and 18 developments in Jefferson, Oldham and Bullitt counties. Tour homes ranged in price from the low $200,000’s to over $1 million and conveyed the message that new construction homes are available in nearly every price range and located in desirable areas of town. “This year’s Tour of New Homes was a success as consumers were able to see new home builds available and learn more about the advantages of new construction,” said Jeff LaGrange, Vice President, RE/MAX Kentucky/Tennessee. “With the tightening inventory in Louisville, new home starts will play an important role in the future of home buying in this area.” Visitors were able to download the free ParadeCraze app, view the homes and developments, and plan their own free selfguided tour. Homes featured on the Tour were in various stages of construction, ranging from furnished model homes to substantially complete homes with options for customization. Listings will remain on the ParadeCraze app long after the event is over, giving visitors a resource to reference when deciding where to purchase their new home - weeks or even months after the Tour. It’s a win-win for Tour visitors and participating BIA members. Dave Parks, Owner/Broker of Berkshire Hathaway Home Services Parks & Weisberg and Ball Homes’ broker partner in the Louisville area, was a sponsor of the Tour and explains why participation in the Tour makes sense for his business. “The Tour of New Homes was a huge success for our firm and for our clients, yet again this year. Ball Homes alone had over 100 visitors during the Tour weekend. We even had clients come through and comment that they felt the Tour experience was highly beneficial because they were able to view different Builders’ homes around the city in a range of price points that fit their
budget. Our firm will definitely continue to support the Tour of New Homes in the future.” Carol Weber, Broker with Louisville Realty Group, was impressed with the number of visitors who braved the spotty weather to visit one of the Tour’s featured developments. “We had about 20 families visit us at Rock Springs during the Tour of New Homes interested in seeing the new home trends.” “One of the greatest advantages of the free Tour of New Homes is that the buying public visiting the new homes got a feel for the proximity of schools, restaurants, shopping and parks in neighborhoods throughout the area,” explained Show Director Gail Schell. “The Tour was such a success this year because the low inventory in the existing home market is driving home buyers to new construction at an increased rate compared to recent years. This free event offered visitors the flexibility to tour numerous homes in a variety of price points all in one weekend. Visitors to the 2017 Homearama at Poplar Woods in Oldham County will be able to visit nine homes, each with a distinctive architectural style, interior design, the latest home technology and one of a kind custom details. Poplar Woods, developed by Signature Green Properties, is one of Metropolitan Louisville’s most significant conservation subdivisions. It consists of 203 acres, including 108 acres of open space designed to protect ecologically sensitive areas. Signature Green Properties principal Mike Jones is a trailblazer in such properties. His background primed him for being one of the most respected developers of this type of neighborhood. After he studied landscape architecture at the University of Kentucky, he became a tree farmer and landscape contractor, growing 15,000 to 40,000 trees a year at several tree farm locations. “About 15 years ago, I decided I could have a more positive impact on our environment by developing subdivisions responsibly than I had by simply growing trees as a landscape contractor,” he says. The definition of a conservation subdivision depends on the county in which it is located. At the time Poplar Woods went through Planning and Zoning in Oldham County, a conserva-
tion subdivision was defined by the percentage of open space, and it required that a minimum of forty-percent of open space be preserved in perpetuity and be dedicated to conservation use and measures. Another requirement was that there be a conservation maintenance program in place. The 203-acre Poplar Woods neighborhood exceeded those requirements by calling for trails, tree preservation, farming, active recreational use and water quality. Water quality measures are met by preserving stream areas, planting and maintaining deep-rooted growth through the drainage areas, and the use of created lakes as a water purifying and collection area. “We have planted more than 3,000 trees at Poplar Woods, which contribute to the deep-rooted opportunity to restore rain water and runoff to the water table. The trees also help decrease the heat island effect that results from roads and rooftops,” says Jones. The Poplar Woods mowing program reduces the carbon impact on air quality as it mandates no mowing in some areas, annual mowing in others and weekly mowing during the season in the minority of the area. Jones says there usually are naysayers about any type of project, but the voices of the buyers who have embraced the concept june 2017 13
Homearama Poplar Woods, July 15-30 of a conservation subdivision validated his belief that it is viable, demonstrably successful approach to land development. “We hosted Homearama at Poplar Woods in 2009 and we are very pleased to have it back this year with six builders of nine homes. When we started, only three of the nine were sold. Six are now sold, at an average of $1 million. The Market is back to the point where folks are comfortable with that price range. That became evident two years ago at our Spring Farm Lake Homearama site when all 11 homes, averaging just under $1 million each, were sold,” he says. Thirteen homes were under construction at Poplar Woods when the site of the 2017 Homearama was announced. Today there are 24 homes under construction. According to Jones, Homearama spurs activity in the neighborhood outside of the Homearama section. There are fewer than 20 lots remaining to be sold of the 103 lots at Poplar Woods. “Developing a conservation subdivision isn’t any more difficult than a standard development. There is less infrastructure and fewer roads to build. The lots are slightly smaller, but they feel larger than they would in a standard subdivision, and people will pay more for the this type of lot because of the amount of open space. The word is out among developers about the benefits of a conservation subdivision,” he says. Poplar Woods, located in Goshen, is only the third conservation development in the history of Oldham County.

Louisville Mayor Greg Fischer Meets with the BIA

On April 25th, Louisville Mayor Greg Fischer was the guest speaker at our well-attended Commercial Council meeting. Members of the BIA Board of Directors and Governmental Affairs Committee were also in attendance to hear Mayor Fischer’s update on key issues facing Louisville Metro. He touched on a variety of topics, including the Comprehensive Plan update process and encouraged BIA members to continue to stay active and engaged in this laborious process. During the meeting, BIA members expressed concern for the recently-passed ordinance calling for a temporary moratorium on development on an area along Lexington Road and shared our support for MSD’s efforts to address our community’s critical infrastructure needs. The Association appreciates members taking time to attend this important meeting and to let Mayor Fischer know about our industry’s key priorities.

An Insiders’ Look at Homearama By Nancy Miller
Jason Orthober, of Orthober Custom Homes, brings a unique, historical perspective to Homearama. He worked at the front door of the houses his father, James, built for Homearamas in the mid-1980s. Jason first participated as a builder in 1999 and has taken part in a total of 7 Homearamas. Since that time he has seen Homearama evolve in positive ways. “The guys now are doing a lot more to differentiate themselves from everyone else, such as with the diversity in finishes,” he says. “There’s also a lot more happening in the walkway where more companies display products. I think that’s great to have something outside of the homes themselves.” Homearama has been a major boon to his business over the years. In a previous Homerama he built a spec home and sold it a week before the show and built another house for the same customer a year later. New to Homearama, Infinity Homes is also a new BIA member. “We’re always open to taking on the next biggest thing. With the East End bridge opening up, we felt Homearama was a good fit for Infinity,” says Courtney Hover, discussing the two houses Infinity Homes will feature in Homerama 2017. 7,000 sq. foot, six bedroom, eight bath custom home. Homearama official sponsorship has been a highly successful marketing and public relations tool for both River City Bank and RiverCity Flooring. “We consider it a good partnership with the BIA. It gives us an opportunity to get out in front of thousands of individuals and to be associated with the great builders we are fortunate to have in the Louisville marketplace. And, it’s a well-rounded project that involves many of the subs we work with,” says David Hobbs, of River City Bank. His personal experience established a special bond with Homearama. He and his wife received inspiration from Homearama when they built their home about 16 years ago. Now, he looks forward to attending the preview night where the builders, sponsors and subcontractors gather for a private tour of the homes. Chris Brumley, of RiverCity Flooring, looks back on the five years his company has been a sponsor as he plans for this year’s sponsorship. He, like Hobbs, enjoys touring the homes during the Preview Party. “I go through all of them to see what’s trending. My wife tells me to quit looking at the floors and to look at the colors in the homes,” he laughs.

LG&E is also returning to Homearama as the presenting sponsor. “We have been a sponsor for more than 20 years. It offers a really great venue for consumers to learn more about the latest technology and the latest concepts being proposed in the home construction industry. Also, it’s a really nice way for us to showcase the programs and services we offer our residential customers, particularly around energy efficiency,” says Liz Pratt, of LG&E. A Homearama veteran, Karista Hannah, of Set the Stage, will return as a Homearama designer for the ninth year. She and her
staff are designing the interior for Caliber Homes & Remodeling. “Homearama is a lot of work, but being in this business you have to constantly be in the public eye. You can’t capture the same volume of people with any other marketing avenue or event. Plus, we get fabulous pictures from it. And, I enjoy talking to the visitors while I’m working the house over the twoweek span,” says Hannah. Her biggest challenge is making sure all the furniture she has selected will come in on time. She says every year there is a last minute hiccup about delivery. At Homearama 2017 she will display artwork, pillows, rugs, lamps and mirrors that attendees will be able to order through her recently opened store in Norton Commons. “That new ability to sell is huge for us,” she adds. The BIA remembers Carl Ray, Jr.
Carl K. Ray Jr., a commercial and industrial real estate broker and developer, devoted outdoorsman, avid hunter and ardent environmentalist, passed away on April 25,2017. Always wearing khakis and his signature brimmed hats, Carl was an influential presence in the outdoor and environmental communities of Louisville. A lifelong resident of Louisville, Carl’s professional achievements included the development of Holly Springs and Spring Hill Residential Developments, River Green Industrial Park, Old Henry Crossings and the redevelopment of College Industrial Park for which he won a Cornerstone 2020 award. Additionally, Carl along with others was recognized with the Louisville Historic League award for his preservation work on the Historic Old Male High School, saving it from demolition. He, with Jefferson County Government, assembled the land for the East Pointe Business Center and Third phase of Louisville’s Riverport.
“He was a member of numerous advisory councils, boards and enjoyed sharing his opinions, visions, knowledge and always famous line “Think outside the box” with anyone who would listen.” Carl was member of the BIA and upon his retirement in 2016 he was granted honary lifetime membership status. He helped in the development of the Hurstbourne Plaza (“The Flash Cube Building”), Jefferson Trade Center and Westport Distribution Center. and green building practices to Louisville. He was a member of numerous advisory councils, boards and enjoyed sharing his opinions, visions, knowledge and always famous line “Think outside the box” with anyone who would listen, and as a testament to him, his ideas, legacy, and numerous streets to which he named are located throughout Metro Louisville, Shelby and Oldham County. Carl’s additional business endeavors included productive sod farms, tobacco and soy bean farms. And, of course, as any proud Louisvillian would, he and his wife Ginger raised, bred, and eventually raced Thoroughbred horses. Throughout the years, if you visited Carl at his office, you would encounter his pets being there with him from his Peacocks in Holly Springs to his beloved faithful dogs at his side every day. Words of wisdom to live by from Carl’s Business First article in 1999 included: • Guiding principal: “Whatever you do, do it well” • Personal yard stick for success: “Hard work and luck.” •Biggest challenge: “Keeping up with the ever changing world.” • Most important lesson learned “We learn something new every day.” A special thank you to Carl’s longtime personal assistant, Eileen Nelson-Smith, for her assistance in writing this article.
