Texas Files Multi-State Amicus Brief in Fifth Circuit Defending Court’s Injunction Against Executive Amnesty Texas Governor Greg Abbott has filed an amicus brief in the Fifth Circuit defending the preliminary injunction against President Obama’s executive amnesty issued by the U.S. District Court in Brownsville, Texas. Also signing onto the brief are the Governors of Louisiana, New Jersey and South Dakota, who also joined Texas in a previouslyfiled amicus brief opposing
the Obama Administration’s request for a stay of the district court’s injunction. Governor Abbott issue the following statement: “Following last week’s revelation that the Obama Administration unlawfully issued thousands of extended work visas in direct violation of the District Court’s preliminary injunction, it is now more important than ever
to ensure that the injunction is upheld to prevent the Defendants from taking any further unlawful action as this case works its way through the legal process, which I am confident will ultimately result in the President’s unconstitutional executive action being struck down.” In the brief, the Governors emphasize two interests in defending the preliminary
injunction entered by the district court: to protect the executive branches in the Governors’ states from “irreparable injuries,” and to rebut “the arguments offered by the State of Washington on behalf of 14 other states.” The brief goes on to highlight that, while the State of Washington might prefer the immigration policy embodied in the President’s executive
action, this case is not a debate about immigration policy; instead it is about the Constitution and the President’s most recent attempt to circumvent it. The Governors’ brief emphasizes that Congress passed the federal immigration laws in 1952, and that those laws have been amended numerous times over the ensuing decades. Those efforts
by previous Congresses and previous Presidents mean nothing if they allow the current President to unilaterally dispense with those statutes, unilaterally create a new immigration system, unilaterally create new employment and social welfare programs, and insulate the entire effort from judicial review.
Governor Abbott Receives Briefing On State Of Disaster AUSTIN – Following yesterday’s declaration of a state of disaster in Bosque, Clay, Denton, Eastland, Gaines, Montague and Van Zandt counties, Texas Governor Greg Abbott today visited the Texas State Operations Center (SOC) to receive a briefing on state resources being dispatched to areas impacted by inclement
weather. The Governor’s visit follows an elevated activation of the SOC to enable the rapid deployment of state resources announced on Friday, May 4th and a declared state of disaster by Governor Abbott on Monday, May 11th. “A variety of agencies have come together as a team to ensure our fellow Texans weather this storm, just as we
have in every other challenge we’ve ever faced,” Governor Abbott said. “I’m proud of the first responders across the State of Texas who have protected life as we’ve faced these challenges. We will continue to work collaboratively with local officials to do everything we can to keep the people of Texas, their families and their communities safe.”
During the briefing, Governor Abbott was informed of the latest developments in the state’s coordinated response to this tragic weather event including search and rescue missions, ongoing medical assistance, local cleanup efforts, power/utility issue resolution and providing shelter to those who have lost their homes.
Attendees at the Governor’s briefing included the Department of Public Safety (DPS), DPS Texas Division of Emergency Management, Texas Education Agency, Texas Department of Transportation, Texas Parks and Wildlife, Texas Military Forces, Federal Emergency Management Agency and the National Weather Service.

Governor Abbott Signs SB 835 Into Law Texas Governor Greg Abbott signed Senate Bill 835 (V. Taylor, R-Plano) into law to take effect September 1, 2015. SB 835 increases the penalty for the offense of presenting a
fraudulent or fictitious military record. Governor Abbott issued the following statement: “The United States Military is one of the most revered institutions in the history of
the world. Anyone who would fraudulently claim to have served our nation honorably for their own personal gain should be held fully accountable for their actions,

Governor Abbott Challenges Federal EPA On Proposed Regional Haze Regulations Governor Greg Abbott submitted comment to the federal Environmental Protection Agency (EPA)’s Air Planning Section regarding the agency’s proposed “regional haze” rule and the its unlawful attempt to force a federal implementation plan on Texas in place of an already-developed state implementation plan. “The EPA’s latest attempt to infringe on Texas’ state sovereignty is yet another example of an overreaching federal government run amok,” said Governor Abbott. “The EPA’s proposed action is unlawful on multiple fronts, and perhaps most egregiously it would impose a $2 billion burden in compliance costs and threaten the reliability of Texas’ energy grid – without any discernable benefits.” Governor Abbott’s comment was submitted to the agency in addition to comment from the Texas Commission on Environmental Quality (TCEQ) after the EPA proposed to partially disapprove Texas’ state implementation plan and instead force Texas to adopt a federal implementation plan
carrying a price tag of $2 billion. In his comment, Governor Abbott exposed numerous reasons the EPA’s proposed action is unlawful and unjust, including: The EPA does not have the authority to regulate invisible haze – yet that is what they are attempting to do: “EPA’s proposed decision…would do nothing to improve visibility…The Clean Air Act gives EPA authority only over the ‘impairment of visibility’…The statue obviously does not give EPA the authority to regulate invisible haze.” The EPA oversteps its statutory authority by imposing a $2 billion compliance cost on Texas: “[C]ost alone renders the FIP unlawful. EPA has a statutory obligation to ‘take[] into consideration the costs of compliance.’” The EPA’s proposed action arbitrarily discriminates against the State of Texas by imposing a different standard on Texas than it has on California. “It appears the EPA has devised one set of rules for States it likes and another set for States it dislikes…EPA’s
capricious discrimination violates the ‘fundamental norm of administrative procedure [that] requires an agency to treat like cases alike.’” The EPA’s proposed action violates the Commerce Clause in the U.S. Constitution: “EPA concedes that the majority of ‘regional haze’ in Big Bend and the Guadalupe Mountains comes from nonregulated conduct…EPA cannot then turn around and regulate ‘regional haze’ on the theory that regulated conduct – like carbon emissions from coal-fired power plans – will have some effect on interstate commerce.” The EPA’s proposed action is based on outdated data from 2009. “Because EPA took almost six years to act on Texas’ proposed [state implementation plan], EPA did not have the up-to-date facts…if EPA had bothered to look, it would have discovered that the haziness conditions in Big Bend and the Guadalupe Mountains are much better today than Texas projected way back in 2009.”
