WELCOME As usual, take place behind your desk and computer (or on your cell phone) and care to join us with this month’s edition of our “new” electronic magazine S incorporating The Uloliwe. SAR S

ISSUU has judged both covers of The Uloliwe and the eNONGQAI of October as the best two covers ever in our range of electronic magazines. Congratulations to Glenn Elsden.

FRONT COVER Our front page photo is by Andre Somers. EDITORIAL We had a vote on our Facebook page and most people voted that we change the name of our magazine to a more descriptive name. So let’s call it the SAS-SAR eMagazine. Our webmaster, Glenn Elsden, says this magazine can be read from a cell phone as well1. Especially the edition he loads onto our website2. So this “good news” is for people on the move. Our website mainly focuses on the history of the South African Police Force, but as I said to Glenn, a ‘young’ retired police ballistics expert, policemen and retired policemen are entitled to have hobbies as well. [Police history is my passion but railways are my hobby and it is part and parcel of our past.] All of us should preserve and conserve. Many days when I pour over old photographs, old maps, old documents and old reports I say a quiet prayer of thanks to the chaps that had the foresight to take photographs or to preserve an old “historical” report or artefact. Yes the magazine may be down loaded if you so wish and you only have to ask to reproduce articles or photographs published here. (See section: Legalise). It is my feeling that we should spread historic information around to make things grow. It is of no use to people if our papers, diagrams or photographs are filed in our libraries. A Zulu-speaking gentleman, judging from his surname, contacted me as he wanted to buy the video that Glenn Elsden made of his trip by train from the Cape to Johannesburg. The more people getting interested in “our” railways the better. It is only when people take an interest and ownership of our cultural heritage, defence, police and railways et al, that we will prosper. Currently if there is unrest about 1

service delivery the nearby Metro station is the “innocent” victim that will be burnt down. We also see from press reports that a few Metro coaches have been burnt in the Western Cape. Poor Metro cannot keep up! It is pleasing to see that ordinary people are standing up and pleading with the authorities to conserve and renovate some historic old stations. Willie Marais of Touws River is doing a great job to publicise his historic railway town and to improve tourism and rail transport. We are also privileged to be “e-mail”-friends with the Wepeners from Welcome. Jacque and John have their own railway museum at their home. They are doing a great job to conserve the “railway” past. Whilst being friend of his circle I am exposed to proper railway fundi’s, like our patron, Les Pivnic - former deputy curator of the SAR Museum and Eugene Armer an eminent railway photographer. When it comes to the subject of railway maps we can’t forget Bruno Martin who now lives in Australia. Other eminent people in my opinion are who do a lot for conservation are Rohan Vos of Rovos Rail with their Edwardian “Pride of Africa”, Wilfred Mole of Sandstone Estates, Atlantic Rail along the False Bay, Friends of the Rail in Pretoria, and Reefsteamers and USR in Natal. Then off course is there Les Pivnic and Charlie Lewis with their SoAR – fantastic nostalgic stuff! Before you take me to task about Rovos Rail, they indeed do a lot for conservation in the sense that they preserve famous old locomotives and carriages and they also have a museum. We as readers also have to support the various railway (history) groups, they are also doing fantastic work! We must support and share with them! Something else on my mind is the Blue Train. I have looked at PRASA’s core business and the Blue Train is run by Transnet and Spoornet. Is an effort going into the Blue Train? I mean where is the prestige of days gone by? (Start with nice clean engines.) We should make the Blue Train our flagship in South Africa as far as passenger trains are concerned! At this moment it would appear that Rovos Rail is our national railway flagship. I have spent some time on YouTube and I have watched the flagship of the Indian Railways! The luxury Indian trains are ages ahead of our Blue Train! Only Rovos Rail can compete with them.

Maharaja Express - The Most Luxurious Train of India The Maharajas Express a Royal & Luxurious Train like The Palace On Wheels, The Golden Chariot Express, The Odyssey Express. Elite Class Train of India is on the run. The first journey of Maharajas Express has begun from Kolkata Station in the evening on 20th March 2010 (Saturday) with the Green Signal of Mamata Banerjee and will reach Delhi on Sunday. In order to run as the best, you have to compete with the best! First we will have to get a few things right! I have been privileged to do quite a few trips on Bosveld Train Safari’s as photographer and barman. I have learnt a lot from discerning passengers – rule number one: The train must never depart late or arrive late as passengers have connecting flights to catch! [Or passengers get on the train along the route? That is a recipe for disaster because old people have to wait on deserted railway stations and the train was always late! The result is they miss their meals or other fun aboard the train.] Rule number two: You have to do what you promise! People pay for the trip and expect to get what they pay for! If you promise steam – so be it! South Africa is such a beautiful country, so much more can be done as far as railtourism is concerned! A little effort can go a long way. We have the know-how in South Africa to run the best tourist trains in the world – we have so much to offer and tours can be arraigned over our borders to Namibia, Zimbabwe, Zambia, Swaziland and Mozambique. The Victoria Falls, the Great Karoo, the Namib, the Lowveld and Kruger National Park... We certainly can offer more than a 26 hr trip between Cape Town and Pretoria by the Blue Train. But for the Blue Train to take POSITION NO 1 in the world would take a serious team effort! I am proud of the railways and I am sure we can do it, if we muster the will!

BTS in Namibia (Photo: HBH) WEPENER’S PERAMBULATIONS  20141003 Hi guys. Between Whites and Hennenman 34 458 was returning light to Kroonstad, no traffic from the section. The 2x 6E's are heading south at Theunissen - the line on the right is the Winburg branch. On arriving in Theunissen, we saw the Algoa standing in the station. Later on several busses arrived and departed. On phoning operating in Bloemfontein we were told "Ja, sy hardloop so bietjie laat !!" She arrived late in BFX and someone clever decided that busses should pick up the passengers at Theunissen, or they would be very late... Well, form the time that the first bus arrived and the last one departed, the train would have been in Kroonstad already... Here is finally departing Theunissen only about 8 hours late, a couple of people stayed on the train, that would have been my choice too. Friendly hoots from the crew. Then we found the pick-up shunting at the silos. 8

 20141010 Hi guys. Not much... Eugene3 gave us a heads up about two special passenger trains heading to Bloemfontein for Macufe4. The first train is a Kroonstad bound load of mielies and empty fuel tankers between Theunissen and Theron. Then, at Theron, a special went past at quite a lick, greetings from the crew. Lastly, between Theron and Welgelee, a southbound load of coal. Now for the "interesting" part, somewhere operating "lost" the Premier Classe !! First we were told she is just behind the normal passenger train, then she had not arrived at Kroonstad yet, then Rooiwal knew nothing about it and finally Koppies said that she past several hours ago - anyway we could not find her and she is still missing... Eugene Armer - HBH I did not know what Macufe is, so I Googled it: “On Sunday October 12, Kaizer Chiefs and Bloemfontein Celtic will meet again in the Macufe Cup 2014 at Free-State Stadium where both teams will get the opportunity to sort-out their unfinished Macufe business. It’s Macufe Cup, so it’s going to be tough for players and exciting for the supporters. This is a great soccer match between two elite teams with great traditions, great supporters and great histories.  20141017 Hi guys. The 4x 6E's are heading towards Kroonstad, just after Holfontein.

Gunhill was quite busy. The coal train is just leaving the yard heading south. These trains are becoming more regular but still no truck cards... The shunt loco was not to be seen but the yard was quite full. Then the petrol shunt and a view from the footplate into the shunting personnel van. To the left of the 34 you can see two blue 35's, they had just arrived from Bethlehem with the pick-up and were on their way back. The pick-up does not normally run all the way into Gunhill. Then out of site behind the petrol tanker the Sasolburg pick-up arrived behind 2x orange 6E's and also in tow, 2x orange 36 classes. Photos are not really possible in the yard area... Then just before Leeudoringstad, this ore train was heading into the loop to cross with the Blue Train. Between Eersteling and Daalder an extra southbound working of the Blue Train (thanks Eugene). Again approaching Makwassie - plenty of hoots from the crew. At Welgelee the pick-up from Kroonstad had just arrived. Lastly, the Winburg branch at Theunissen. Green signals to the north on the main line - but operating knew nothing about any trains?? Cheers. J & J.

Cheers Les Eugene Armer Hi Les The remaining 14E's are still working on freights in the Cape between Belville and Beaufort West, but they no longer work the Blue Train. 18E's now work the train on the DC sections and 7E's on the AC. More recently, the 18E's have been in the TFR livery, such as seen in Jacque's shot at Makwassie.

Blue Train drivers will soon (if they have not already) start training on the new dual voltage 20E's and there are rumours that some of these are being painted blue. Cheers

Hi Eugene, Thanks for your email. My comment about the inexperienced crews causing the 14Es to burn out was made somewhat tongue in cheek BUT not without some foundation. The footplate training in recent years has fallen far short of what the SAR required in the past. A youngster joining the SAR Administration as a cleaner in a Loco Depot would have to work hard and pass all exams and grades as fireman for a minimum period of 9 years before he would be allowed to handle a passenger train5. The current regime doesn't come close. It is also interesting in that at least one of the 14E burn-outs occurred at the voltage change-over point near Beaconsfield. Coincidence or incompetence?

 20141030 (1) Hi guys. The two 34's are at Losdorings with a return working from Wesselsbron, en-route to Kroonstad. The Track master and his gang were busy on the level-crossing. Then at Brandfort, ex-Bloemfontein, heading to Koppies, a maintenance train. Have a look how little clearance some of those machines have under the catenary. Hoots from the crew. Cheers.

 20141030 (2) Hi guys. At Wesselsbron, a block load ‘air-brake’ for Kroonstad being prepared. Kingswood saw this northbound empty load of ore wagons heading into the loop due to track maintenance on the main line. The same train heading through Boskuil. Later a loaded ore train heading south at Makwassie, also on the loop due to more maintenance line side. Near Daalder just before a northbound container train sped past, hoots and greetings from all the crews. Finally at Welkom, the mielies from Wesselsbron got staged due to the crew's time being up. The 3x Genset Grindrod diesels have disappeared to who knows where and it seems some of those Metro coaches are receiving an undercoat. Cheers. J & J.

SAR Marble Hall: Counter Insurgency Training (HBH) From the 1970’s onwards all COIN-training in the South African Police Force took place a Maleoskop. For the purpose of attending the course SAP members from all over South Africa and the then South West Africa had to travel from their stations by rail to Marble Hall. From there were conveyed by truck to Maleoskop outside Groblersdal for training and then after the course; the same way back! To think they even paid us for having fun! Die Oranjesnel van Harrismith na Ladysmith was darem haastig deur daai draaie. Hendrik van Schaik: Jan Crafford trein 72 was eendag laat . Dit was om en by 1977 - so dalk was dit jy wat so wild gedryf het! Tafels was gedek vir ontbyt - en tradisioneel 'n beker koue melk op elke tafel vir die pap en melk! Die drywer het lekker woes om 'n draai gejaag met die gevolg dat al die eetgerei van die tafels afgesktuif het. Melk oral op die vloer. Ons moes toe van voor af weer opruim, skoonmaak en tafles dek vir ontbyt. Japie Terblanche: Dit was Boetie Kriel tot in Transvaal daarvan gehoor, oor die Drakensberge. Die grootse lof wat ek gekry het van mnr Bredenham en Johan Harmse het reeds gekom van Eetwa-bestuurders op die Trans-Natal, Karoo en Drakensberg, wat my diens aan die publiek onder hulle aandag gebring het,gedurende etenstye met n gematigde spoed. Ek was bekend as ‘n BTB-ryer, maar is uitgeskel as ‘n donnnerse tydhanger. Hendrik van Schaik: Japie ek stem saam. Hoekom die veiligheid van passasiers op die spel plaas net om af te wys! Dit was opvallend dat daar baie goeie drywers op die Pietermaritzburg - Durban seksie was. Ek het nooit "benoude" oomblikke daar beleef nie. Ek is deesdae benoud wanneer ek trein tussen Kimberley en Beaufort Wes ry - vertrou nie die vinnige ryery daar nie. In this, he decided to switch pantos and asked the assistant to follow him during the checks and setup. As they started pulling off, he noticed that the overhead wires seem to be under severe strain, so he immediately stopped to check outside... to his shock, the

Daardie jare was die langsbalke met klink werk geheg. Dan word alles weer terug geplaas en daar ry ons weer ! Ek sal by Sid Herbert hoor wat by al die toetse van E1525 teenwoordig was, wat die spoed was (ek weet van 245km/h) maar die beplande Diens was vir 144km/h (pantograwe was ʼn probleem). Ek is geensins beïndruk met die Gautrein nie, op van my ritte het ek op die bogies gesit en die vibrasie (veral tydens regen) is aaklig. Die foto wys van die pantograwe waarmee toetse gedoen is.

Ongelukkig in my mening het ons nie veel gevorder met spoed nie. Die rede is seker omdat TFR hom geskei het van passasiers en op bulkvrag gekonsentreer het. Selfs met die nuwe 1064 loko’s wat kom, sal die maksimum toetsspoed 10% oor 120km/h wees (132km/h). Dit word slegs gedoen om die RSR te verseker dat die loko’s teen maks spoed veilig is. Die nuwe mikroprosessors sal in alle geval die loko in remming plaas en krag verwyder as dit buite perke bedryf word. Die vorige foto’s bevestig maar net oor hoeveel jaar die tipe pantograaf ontwikkel is en dat daar nog nie iets is wat hulle vervang nie. Hy was gebruik op die Sun City Express voordat hy weer herskep is na ‘n gewone 37 klas diesel goeie (merkwaardige ) spoed gehandhaaf tussen JHB en Marikana Johann Badenhorst: Op die Sun City het hulle 37 039 en 37 042 gebruik as ek reg onthou daarna het hulle Komatipoort / Richardsbaai gewerk in hulle Sun Citykleure Gert Niemand: More Phil toe my ouboet Chris Niemand in Bloem begin het as stoker het hy na elektries oorgeskakel in 1980 en toe ek daar in 82 kom het hy my van die toetsritte vertel en dat die hoëspoed maklik bereik is en dat die pantograwe die probleem was en ook dat die draaie uitgetrap word. Blykbaar tot ʼn halfduim en meer op sekere draaie op die trajek tussen Bloem en Kroonstad. Ek onthou nog Petoors en Negrini en Kitaar hoe hulle van die spul gepraat het. Mooi dag Phil. Ore van den Bergh: Dit was 37044 en die toetse was gedoen tussen Rosslyn en De Wildt. Die diesel is later gebruik om die Sun City te werk Deon Gouws: Gepraat van hoëspoed pantograwe. Die Gautrein se pantograwe het klein vlerkies aan wat hulle stabiliseer vir hoe spoed. 5 October at 08:50 · Like · 1 Dolf En Ansie Hamman: Johan die Sun City Express het net een loko gehad. 37 044, ek het hom self gery. Ore van den Bergh: 1525 en 18001 en1600 word gebruik vir panto-toetse glad nie meer op treine Dolf En Ansie Hamman: Ja ore ons het 1525 lekker gelooi. Lekker series regen op 100 kmpu Ore van den Bergh: Ja nou staan die goed net 1600 is heeltemal oorgedoen en dit is sover hulle gekom het. Nou staan hy net op die sandpad in Pyramid-Suid. Ek dink dit was in 82 of 83. Was toe nog asst in die Park. Ore van den Bergh: 1600 is’ n AC loko in ʼn 6e se bakwerk daar is nie ʼn AC/DC-loko nie, behalwe die 19 en 20E Barend Leon: Ja Ore hoe gaan dit? Ons was maar ʼn paar ouens wat die 1600 geken het 75


Ore van den Bergh: Hy is in Rustenburg op die oorlaai gebruik. Hy is bakgat binne en buite reggemaak, hoekom weet ek nie. Al wat aan ons gesê is hy gaan panto’s toets en dit is al 3jaar terug. Ore van den Bergh: Hier kom nou so baie nuwe loko’s. Ek glo nie hulle gaan nog geld op die oues spend nie Ore van den Bergh: Die 21E sal Des in Pyramid wees Johann Badenhorst: Dolf het jy nie foto’s v my van daai 37 klas nie asb? Philmar du Plessis Daai pantograaf toetse op E1525, E1600 en E18001 word gedoen maar nie vir nuwe pantograaf ontwikkeling nie. Die een pantograaf op daai lokos is "meet pantograwe". Die Pantograwe is toegerus met sensors om die buigmoment op verskeie plekke te meet oor die area van die pan. Deur normale spoed te ry word die druk- en trekspannings, asook die lynspanning en videomateriaal opgeneem teenoor die GPS ko-ordinate. Die data word dan agterna verwerk en gee akkurate metings tot +- 2M van waar daar stagger spanning (bobaan te slap of styf), bobaan hoogte vanaf spoor, ens. die video dui aan waar dropper, sparking en ander probleme is. Die lynspanning word gebruik om te bepaal waar bobaan kapasiteit probleme is. Hierdie ontwikkeling het omtrent 15 jaar terug begin en is weereens ʼn 1ste vir SA. Die toetse was eers gedoen onder "panto dood" kondisies, die meet pantograaf was op die 2de loko (loko dood) terwyl dit gesleep was deur ʼn ander loko. Meeste toetse was destyds op die Koollyn gedoen met 7E3's. Lewendige toetse is vir ongeveer die laaste 10 jaar gedoen. Die rede hoekom daai loko’s gebruik word is omdat hulle nie in die aktiewe vloot is nie en dus nie Bedryf se vloot affekteer nie. Dieselfde loko’s was ook gebruik toe ons die aanvanklike toetse gedoen het om van gietyster remblokke oor te skakel na composite-remblokke. Die loko’s word ook vir ander algemene toetse gebruik waar die doel van die toetse nie loko gebonde is nie, maar infra ens. Ek weet E18001 was nadat ons die meeste ontwikkelingstoetse vir die 18E's gedoen het, weer herbou met die nuutste modifikasies. Ek glo met al die modifikasies in die latere jare sal E18001 nie meer kan MU met ander 18E's nie. Die pantograafmeet-tegnologie word nou deur Lennings en ander kontrakteurs gebruik om Transnet se OHTE te onderhou. Die Meganiese Ingenieur (een van die eerste Indiër Ingenieurs in ons R&D afdeling) het die navorsing reg in die begin gedoen van die meet pantograwe en is hy tans ’n Executive Bestuurder by een van die Groot Mynmaatskapye. Lekker om te sien hoe hierdie jong ouens vorder op grond van hulle bekwaamheid, Transnet het die geleentheid gehad om hulle te behou, maar ons laat dit daar. 76

WW1: GSWA: Princess Christian Hospital Train: Ray Ellis: Australia Hi Chen, Many thanks for thinking of me and sending this. Very, very interesting indeed!! It is quite a find as it actually shows some of the coaches of the Boer War Princess Christian Hospital Train in service in German South West Africa in WW1!! Some of the carriages from the Boer War train were retained and included in the WW1 hospital train. Such photos are indeed rare – in fact I have never seen one before!! As a result, I have copied in my good friend and cobber, Hennie Heymans, who is also interested in German SWA and WW1 railways, as I am sure he will be interested in it as well. How do I know it’s WW1 and not the Boer War?? Because the headgear and uniforms are entirely different, which you can see if you compare Boer War and WW1 uniforms. The hats were much bigger in WW1, for by then they had begun to appreciate the hats needed to be more substantial. There is much similarity with what British troops wore in Palestine in WW1 > Post-war > WW2… Cheers Ray

Ons kry baie navrae van pensioenarisse oor wat die volgende stap is noudat Transnet en die twee pensioenfondse se aansoek om verlof tot appel teen die klasaksie hofbevel verwerp is. Ons probeer nog by die regspan vasstel wat te verwagte is. Transnet en die twee pensioenfondse het nog ‘n opsie om verlof tot appel te vra by die Hoogste Hof van Appel in Bloemfontein. Daardie proses bestaan uit die liaseer van stukke by die hof deur al die partye waarop die regters ‘n uitspraak sal maak. Ons is nog nie bewus daarvan dat Transnet en die twee pensioenfondse sodanige planne het nie, maar sal julle op hoogte hou. 2. Indien geen verdere verlof tot appel gevra word nie, sal die regspan advertensies plaas in al die hoofstroom koerante om vir die pensioenarisse wat nie deel van die klasaksie wil wees nie kans te gee om uit te teken. Dit is ‘n voorvereiste om voort te gaan met die eis teen Transnet en die regering. Daarna sal die regspan die eise instel teen Transnet en die regering en ‘n hofdatum vasgestel word. 3. Dit is ook van belang om weer te beaam dat die regspan wat bestaan uit prokureur Wynanda Coetzee, adv Jaap Cilliers SC, en adv Leon Kellerman, ‘n onafhanklike regspan is wat uit goedgunstigheid jeens die pensioenarisse die hofsaak voer. 1. We have received many queries from pensioners regarding the next step now that Transnet and the two pension funds’ application for leave to appeal has been rejected. We are still trying to establish from the legal team what is to be expected. Transnet and the two pension funds do still have an option to ask for leave to appeal at the High Court of Appeal in Bloemfontein. That process consists of the lodging of papers with the court by all the parties upon which the judges will base their decision. We are not aware that Transnet and the two pension funds have any plans in this regard, but we will keep you abreast of any news. 2. In the event that no leave to appeal is requested, the legal team will place advertisements in all of the mainstream newspapers to afford an opportunity for all those pensioners who do not wish to participate in the court action to sign out of the class action. This is a prerequisite before the claim against Transnet and the government can be launched. After publication the legal team will institute the claims against Transnet and the government where after a court date will be set. 3. It also of importance to reiterate that the legal team that consists of attorney Wynanda Coetzee, Adv. Jaap Cilliers SC and Adv. Leon Kellerman, is an independent legal team who are assisting the pensioners in the court case on a basis of goodwill. The legal team is acting on behalf of you, the pensioners, and not the FF Plus. You are thus the clients. Your case is thus driven on a non-political basis. The FF Plus’ role is to promote your case in parliament, to submit important information to the legal team, and to communicate with you regarding the progression of the court case and other matters like bonuses, trustee elections, Transmed and other matters that affect you. Bonus: 1. Our information is that you will again receive a bonus at the end of November equal to your monthly pension. We are aware that this is no solution to your financial challenges, but hopefully this helps you to a degree at least until the court case is won in final or a settlement takes place. CLARITY ABOUT TRANSNET PENSIONERS BONUS PAYMENTS The recent newspaper headline “TRANSNET PENSIONERS TO SHARE HUNDREDS OF MILLONS IN BONUSES” needs to be challenged as it gives the impression that Transnet is paying the bonuses when this is totally incorrect. A master propagandist once stated “If you tell a lie and keep repeating it, people will eventually believe it.” Transnet has been following this edict for some time, but here are the facts. The company has stated in the past that pensioners are happy about the recent bonuses that they have received and that the pensioners prefer a bonus to inflation linked increases. As far as TPAG (The Transnet Pensioners Action Group currently involved in a court action against Transnet) are aware there has been no independent census taken in this regard so the statement was glibly made to make Transnet look good when in fact they have allegedly stripped the pension funds placing a large majority of pensioners in penury. The fact that 40% of the pensioners earn less than the Government pension of R1280 per month is proof that there is something seriously wrong. The bonus is paid out of SURPLUS funds which have arisen due to the 2% per annum increase policy so it is the pensioners OWN money which is being paid back to them and Transnet wants to claim that they are paying this money. The inflation rate has averaged 5, 89% since 2003 when the 2% rule was enforced. Therefore with compound interest working in reverse the pensioners have lost over 50% of their buying power which no amount of bonuses will rectify. The fact that Transnet pensioners including the Transnet Pensioners Action Group (TPAG) are currently in the process of a court “class action” against Transnet is proof that they are extremely dissatisfied with their poor pensions. Currently three Pensioners elected Trustees serve on the TSDBF Investment Committee and ensure that SURPLUS funds are distributed as Bonuses, but these allocations still have to be approved by Transnet, and such approval is NOT a foregone conclusion! Both Defined Benefit funds the TSDBF and the TPF fall under an Act of Parliament (Act 62 of 1990 as amended) which means that Transnet and the Government have complete control on the funds and members cannot appeal to either the Financial Services Board or the Pension Fund Adjudicator, therefore pensioners are at the mercy of Transnet and their only means of recourse is to take the matter to court. Furthermore, if the elected Trustees cast their votes to oppose the Transnet appointed Trustees, the Transnet appointed Chairman uses his casting vote so Transnet maintains control does as it pleases! The TSDBF is “ring-fenced which means that there are no new entrants into the fund and so there is NO new money coming into the fund and what remains ( which it is alleged has been stripped) has to see the pensioners through until the last pensioner dies. The North Gauteng High Court has already heard the case for the approval of the “class action” and ruled in favour of the pensioners with costs payable by Transnet. Transnet appealed this ruling and again lost with costs however despite this, Transnet has now given notice 103


that they are appealing to the Supreme Court! “JUSTICE DELAYED IS JUSTICE DENIED” and this has been tested in the Constitutional Court Pensioners take exception to the fact that Transnet and the Pension Fund Boards are boasting that the pension funds are in a good financial position and claim that pensioners prefer non- vesting bonuses to an annual increase of 75% of the CPI. The question is how can a bonus on a now very low base be preferable to a vesting increase which will INCREASE with compound interest? TPAG disputes this as the present funding does not allow for vesting increases and should vesting increases be given the surplus quickly disappears. Therefore: · Bonuses WILL NOT elevate a pension stuck at an annual increase of 2% per annum. Should the financial markets not perform bonuses will be stopped as Transnet then has to make up the shortfall which they will not want to do. · The value of Bonuses will diminish (in line with inflation) with the passage of time since they are based on a base pension which only increases at 2% per annum. · Bonuses are not guaranteed and are non-vesting and can be stopped at any time, whereas a monthly pension increase, once given, compounds, and cannot be taken away A Bonus can never make up for decent pension increase which grows with inflation. The bonus was introduced by Transnet as a means of avoiding to have to inject capital into the pension funds TO PROTECT THEIR BALANCE SHEET. The first bonus was paid out to the TSDBF pensioners in 2007 and to the TPF pensioners in 2011. As bonuses are being paid out the surplus funds and NOT by Transnet, as is the impression, the surplus will come under increasing pressure because the funds are ring fenced and there are no funds coming in from active members or by Transnet in the case of the TSDBF and in the case of TPF-TSF there are a small number of working members. Transnet are also boasting that they are paying a bonuses, which in fact is a thirteenth cheque, when in most pension funds this is part of the package as well as a contribution to Medical costs. Transnet have pegged their portion for medical costs at R213 for the last 22 years which speaks volumes about caring for the hard working pensioners. The Transnet’s Board of Directors has approved that Transnet make an ex gratia payment totalling R75 million to qualifying beneficiaries and pensioners (poorest of the poor) of the two funds – the TSDBF and TTPF, however it is only a drop in the bucket compared to the pensioners claim of many billions of rands owed to them and is in fact an admission that the pensioners are in penury.. Whilst it is a fillip to get a month’s bonus in a lump sum once in a while it is only a sop as to relieve the financial pain for only a moment but the reality is that the cost of living is outperforming the bonus and that the pensioner is getting poorer by the year and the standard of living ever deteriorating. A bonus on less than a Government pension of R1280 can in actual fact buy very little at today’s prices. TO SUM UP: 104


· TRANSNET has been claiming for years that the bonus plus the 2% increase gives the pensioner an increase above the inflation rate which IS A LIE as their calculation is based on a LOW BASE PENSION. · The BONUS cannot COMPENSATE PENSIONERS for LOSSES they have ALREADY SUFFERED and WILL CONTINUE TO SUFFER. · On the 27th of July 2010 a Transnet representative said that the weighted average increase in pensions over the last three years was13.4%. · A member of the Portfolio Committee stated that this was probably the BIGGEST LIE that had ever been told in Parliament. It seemed that Transnet was comparing “apples with pears”. The facts were that there was only a 2% increase in pensions per annum and there were once off bonuses that were not even guaranteed. · With reference to Transnet Press Release of Wed, 22 Oct 2014. · Transnet stated since 2010, Transnet pensioners have received on average two 13th cheques, supplementing their annual income by 16, 7% over and above the statutory 2% increases. · THIS STATEMENT IS NOT TRUE AND IS VERY MISLEADING as the bonus is based on a LOW BASE PENSION AND GIVES THE IMPRESSION THAT PENSIONERS ARE GETTING A16,97% INCREASE WHICH IS NOT SO. This is using smoke and mirror statistics to fudge the real facts · To equate an annual pension increase of 75% of the inflation since the pensioner retired the BASE PENSIONMUST BE UPLIFTED BY: · Transnet Second Defined Benefit Fund. · A pensioner who retired in 1990 by 44%. · A pensioner who retired in April 1993 by 75% (as increases were pegged at 2% for 5 years as one of the measures to bring the funds debt under control (by passing Transnet’s debt onto pensioners which they could least afford) · Transport Pension Fund – Transnet Sub Fund. · A pensioner who retired in 2000 by 35%. · It is not difficult to understand why the majority of Transnet pensioners are in penury and there is not a pension fund in the country that has treated their employees, many with over 40 years of service, with such disdain. · Pensioners now demand their Constitutional right to have the case heard by an independent Judge in the name of Justice and demand that the appeals be immediately retracted by Transnet and the Pension Funds so that the case may proceed without any further delay to its conclusion. Die bonus word uit die SURPLUS van die pensioenfondse betaal wat bekom is deur die 2% per jaar verhogingsbeleid , dus is dit die pensioenarisse se EIE geld wat gebruik word om vir die bonusse te betaal en Transnet wil voorgee dat hulle hierdie geld betaal. Die inflasiekoers is gemiddeld 5,89% sedert 2003 toe die 2% reël afgedwing is. Met saamgestelde rente terugwerkend bereken het die pensioenarisse dus meer as 50% van hul koopkrag verloor en dit kan nie met enige bonusse reggestel word nie. Die feit dat die Transnetpensioenarisse, insluitend die Transnetpensioenarisaksiegroep (TPAG) tans in ’n hofsaak betrokke is teen Transnet in ’n „groepsgeding” is genoeg bewys dat hulle uiters ontevrede is met hul swak pensioene. Drie Pensioenarisverkose Trustees dien tans op die TTVVF Beleggingskommitee en verseker dat SURPLUSGELDE verdeel word as bonusse, maar hierdie toewysings moet steeds deur Transnet goedgekeur word en dit is nie noodwendig ’n uitgemaakte saak is nie! Beide die Vastevoordeelfondse, die TTVVF en die TPF val onder ’n Wet van die Parlement (Wet 62 van 1992 soos gewysig) wat beteken dat Transnet en die Regering volle beheer het oor die fondse en die pensioenarisse kan nie appѐl aanteken by enige van die Raad op Finansiële Dienste of die Pensioenfondsberegter nie en is dus uitgelewer aan die genade van Transnet en hul enigste uitweg is om die saak na die hof te neem. Indien die verkose Trustees hul stemme gebruik om die Transnet aangestelde Trustees teen te staan gebruik die Transnet aangestelde Voorsitter sy beslissende stem en daardeur handhaaf Transnet beheer en doen wat hulle wil! Die TTVVF is „omhein", wat beteken dat daar geen nuwe toetreders tot die fonds is nie en dus geen nuwe gelde die fonds binne kom nie en dit wat oorbly (wat na bewering gestroop is) moet voldoende wees om die pensioenarisse deur te sien totdat die laaste pensioenaris dood is. Die Noord Gautengse Hooggeregshof het reeds die saak vir die goedkeuring vir ’n „Groepsgeding” aangehoor en ten gunste van die pensioenarisse beslis met kostes betaalbaar deur Transnet. Transnet het hierteen appelleer en weer verloor met kostes en ten spyte hiervan kennis gegee dat hulle ook gaan appelleer na die Hooggeregshof! „OM DIE REG TE VERTRAAG IS OM DIE REG TE WEIER" (JUSTICE DELAYED IS JUSTICE DENIED) en dié beginsel is al in die Konstitusionelehof getoets Pensioenarisse maak beswaar teen die feit dat Transnet en die Pensioenfondsrade spog dat die pensioenfondse in goeie finansiële posisies is en dat die pensioenarisse nie-vasgestelde bonusse verkies bo ’n jaarlikse verhoging van 75% van die PPI. Die vraag is hoe kan ’n bonus met ’n nou baie lae basis verkieslik wees bo ’n vasgestelde verhoging wat verhoog met saamgestelde rente? TPAG betwis dit omdat die huidige befondsing nie toelaat vir enige vasgestelde verhogings nie en sou vasgestelde verhogings toegelaat word sal die surplusgelde vinnig verdwyn. Daarom: 106


· Bonusse SAL NIE ’n pensioen wat met ’n 2% jaarlikse verhoging vasgepen is verhoog nie. Indien die finansiëlemarkte nie goed vertoon nie sal die bonusse gestaak word want dan sal Transnet die tekort moet goed maak wat hulle nie bereid is om te doen nie. · Die waarde van die Bonusse sal verminder met tyd (in lyn met inflasie) omdat die pensioene slegs met 2% per jaar verhoog. · Bonusse word nie gewaarborg nie en is nie vasgestel nie en kan te eniger tyd gestaak word, terwyl ’n maandelikse pensioen verhoging, eenmaal toegestaan, vermenigvuldig en nie gestaak kan word nie. ’n Bonus kan nooit vergoed vir ’n behoorlike verhoging wat met inflasie groei nie. Die bonusse is deur Transnet ingestel om te verhoed dat dit sou nodig wees vir hulle om enige kontantinspuiting in die fondse te maak en sodoende hul BALLANSSTAAT TE BESKERM. Die eerste bonusse is gedurende 2007 aan die TTVVF betaal en in 2011 aan die TPF pensioenarisse. Aangesien die bonusse uit die surplusfondse betaal word en nie deur Transnet nie, soos die indruk wat geskep word, sal die bonusse voortdurend onder druk kom omdat die fondse „omhein" is en daar nie enige fondse inkom van aktiewe lede nie of deur Transnet in die geval van die TTVVF. By die TPF is slegs ’n klein hoeveelheid werkende lede wat bydraes maak. Transnet spog ook dat hulle bonusse betaal, wat in werklikheid ’n dertiende tjek is. Dit terwyl die meeste pensioenfondse dit as deel van die pensioenpakket insluit asook ’n bydrae tot die mediese fonds. Transnet het sy bydrae tot die mediese fonds vasgepen op R213 per maand vir die afgelope 22 jaar, dit spreek boekdele van hulle besorgdheid oor die pensioenarisse wat meestal lewenslank hard gewerk het vir Transnet. Die Transnetraad van Direkteure het ’n „ex gratia” bedrag van R75m goedgekeur vir betaling aan geregtigde afhanklikes en pensioenarisse (die armstes van die armes) van die twee fondse – die TTVVF en die TPF, maar dit is maar ’n druppel in die emmer in vergelyking met die miljarde Rand wat deur die pensioenarisse geëis word wat aan hulle verskuldig is en dit is eintlik ’n erkenning dat die pensioenarisse in armoede leef. Terwyl dit help om so af en toe ’n maand se pensioen, as ’n bonus te kry, is dit slegs ’n troos en sal dit die finansiële pyn net vir 'n klein rukkie verlig. Die werklikheid is dat die lewenskoste se groeikoers dié van die bonusse ver oorskry en dat die pensioenarisse jaarliks armer word en die lewensstandaard altoos versleg. ’n Bonus op minder as ’n Staatspensioen se R1280 kan in der waarheid teen vandag se pryse baie min koop. OM OP TE SOM: 1. TRANSNET beweer vir jare reeds dat die bonus plus die 2% verhoging gee aan die pensioenarisse ’n verhoging wat inflasie klop en DIT IS ’n LEUEN as gevolg van die feit dat hul berekening op ’n LAE BASIS PENSIOEN GESKOEI is 2. Op 27 Julie 2010 het ’n TRANSNET verteenwoordiger gesê dat die geweegde gemiddelde verhoging in pensioene oor die laaste drie jaar 13,4% was. 4. ʼn Portefeuljekomitee lid het gesê dat dit was moontlik die GROOTSTE LEUEN wat ooit in die Parlement vertel is. Dit wou voorkom asof Transnet „appels met pere” vergelyk. Met verwysing na Die Transnet Mediaverklaring van Woensdag, 22 Oktober2014 6. Transnet meld dat die Transnet pensioenarisse sedert 2010 gemiddeld twee 13de tjeks ontvang het wat hul jaarlikse inkomste met 16,7% aangevul het, bo en behalwe die statutere 2% verhogings. 7. HIERDIE STELLING IS NIE WAAR NIE EN BAIE MISLEIDEND aangesien die bonus teen ʼn BAIE LAE BASISPENSIOEN BEREKEN WORD EN DIE INDRUK WEK DAT DIE PENSIOENARISSE ʼn 16,7% VERHOGING ONTVANG EN DIT IS ONWAAR. Hier word rook en spieël statistieke gebruik om die werklike feite te verbloem. 8. Om die jaarlikse pensioene gelyk te stel aan ʼn jaarlikse verhoging van 75% van inflasie sedert die pensioenaris afgetree het moet die BASISPENSIOEN VERHOOG MET: 9. Transnet Tweedevastevoordeelfonds 10. ʼn Pensioenaris wat in 1990 afgetree het met 44%. 11. ʼn Pensioenaris wat in April 1993 afgetree het met 75%.(omdat verhogings vir die eerste 5 jaar op 2% vasgepen was as een van die maatreëls om die fonds se skuld onder beheer te bring en om Transnet se skuld aan die pensioenarisse oor te dra wat hulle beswaarlik kon bekostig) 12. Transport Pensioenfonds – Transnet Subfonds. 13. ʼn Pensioenaris wat in 2000 afgetree het 35%. 14. Dit is nie moeilik om te verstaan waarom die meeste Transnet Pensioenarisse in armoede leef nie. Daar is geen ander pensioenfonds in hierdie land wat hul lede waarvan sommiges met tot 40 jaar diens kan spog, met soveel minagting behandel nie. 15. Costs of our Class Action and Implications of Opting Out/Not Opting Out Fees and Costs: When we embarked on our journey to court one of the items at the top of our list of concerns was “how are we going to pay for legal fees and other costs of bringing a case to court, keeping it going and seeing it through to the end?” Estimates were that the money required would run into millions of rand. The task of collecting this money from struggling pensioners was regarded as virtually impossible. It was, therefore, miraculous when the Legal Team committed to providing their services on a contingency basis. This meant that legal fees would only be payable by the claimants in the event of a successful outcome. These fees will naturally be recovered out of the proceeds of the final settlement which will have no negative financial effect on pensioners (who do not choose to Opt Out) because they will be benefitting by receiving greatly improved monthly pensions which will grow with inflation. It would only be necessary for pensioners to contribute on a completely voluntary basis towards on-going costs (for example, administration, travel and fees payable to experts such as actuaries) required to prepare for the court case. From the start, TPAG has made this clear to pensioners and the drive to collect funds towards on-going costs continues and remains a very important aspect of keeping our case alive. Implications of Opting Out/Not Opting Out: Because our class action is an “Opt Out” Class Action, notices have had to be placed in the press requesting pensioners, who do not wish to participate, to notify our attorneys. Those who opt out will then definitely not benefit from the outcome of a successful court case. Some pensioners are now asking the question “what will I have to pay if pensioners lose the case and should I opt out to avoid this risk?” The simple answer is that, in South Africa, class actions are relatively new and there is no judgment yet as to how the costs of litigation may be shared by members of the class. Regarding the amount, we are not prepared to speculate but, in the event of a lost case (unlikely, in our opinion), the costs would translate into a few hundred rand

per pensioner and we would be very surprised if a court ruled against impoverished pensioners in this way. The way forward: We are on the brink of success. Our Class Action has been certified, Transnet and the Pension Funds’ appeals have been turned down and they have now applied to the Chief Justice for special leave to appeal but we believe it is just a matter of time before our case is heard and settled.

Deelfontein. Die laaste (trein) foto het ek vanaf die klein Britse Oorlog- begraafplaas by Deelfontein afgeneem. Ongelukkig kon ek nie te naby aan die treine kom nie sonder dat ek deur hakiesdraad moes klim nie en my selfoon “zoom” nie te lekker nie. Geniet die foto’s en gebruik hulle met liefde as jy wil.
