Desmond acquitted Mahanand for consideration other than judicial HERALD REPORTER PANJIM, FEB 17

The unexplained suspension of the South Goa District and Additional Sessions Judge Desmond D’Costa is now revealed officially. The chargesheet accuses him of deciding serial killer Mahanand Naik’s acquittal ‘for consideration other than judicial’. “By showing ugly and haste in acquitting the accused who was known to be a serial killer by not even examining the necessary witnesses in the case, you had shown lack of devotion to duty and acted in a manner unbecoming of a judicial officer,” the report reads.

Judge D’Costa was suspended on February 8 by a single line order which did not specify reasons behind action against him. L awyers in large numbers protested against his suspension and struck work for couple of days. They even marched to the Bombay High Court at Goa Registrar’s office demanding to revoke his suspension. Sources told Herald that the report against the suspended Judge also stated that crucial witnesses in the Mahanand case were not examined while also the accused’s confessional statement was ‘deliberately not considered’. “The confessional statement

was showing that the accused has clearly confessed of having sex with Nirmala Amolkar by taking her at Verna plateau, in the bushes and strangulating her...Considering the fact that you are a senior Judicial Officer…you was supposed to be sensitive while conducting trial of this case”, the report by Principal Judge U V Bakre to Registrar I K Jain further read. “However, you failed to examine witnesses and deliberately kept the confessional statement, panchanama of recovery, etc out of consideration, resulting in acquittal of the accused. Thus you acted negli-

HERALD REPORTER PANJIM, FEB 17

Apprehensive that Bollywood flick ‘Dum Maro Dum’, based on Goa’s underbelly will showcase the State in a bad taste, Goa police has demanded with the filmmakers to show them the promotional and all publicity footages before the release. Reliable police sources confirmed Goa police has sent a letter to the director of the movie Rohan Sippy asking him to show the promotional and publicity materials before releasing the movie or its promotional events officially. It is learnt the letter was apparently sent to the film makers on Tuesday morning. Police spokesperson Superintendent of Police Atmaram Deshpande said that he was not in the know about the letter to Sippy. “No such letter from the police headquarters has been

sent as per my knowledge”, Deshpande told Herald. The movie Dum Maro Dum, starring Abhishek Bachchan, Bipasha Basu and Deepika Padukone revolves around drugs, sex, etc for which Goa has been receiving bed press. Sources said, “After British teen Scarlet Keeling’s mysterious death on Anjuna beach in 2008, the social conflicts between the Russian mafia and Goan locals and the drug nexus, Goa Government was apprehensive about any negative publicity”. They mentioned the police wanted to perform this prior check to see how Goa has been portrayed to ensure that the same in no way affected the State’s tourism image. The entire movie has been shot in Goa. It has Abhishek Bachchan playing a cop from the Goa police. (Continued on page 2)

Milk to cost more Price of high fat milk and standardised milk has been hiked by Rs 3, while toned milk will cost Rs 2 more per litre. HERALD CORRESPONDENT MARCEL, FEB 17

Goa Dairy milk will be costlier by up to Rs 3 from February 21, with the Goa State Cooperative Milk Producers Union agreeing to the hike on Thursday. Shortly after the board of directors meeting, Goa Dairy Chairman Madhav Sahakari informed reporters that the price hike was inevitable with a rise in milk prices in Maharashtra. “Milk prices in Maharashtra were increased by Rs 2.50 to Rs 3 since February 1. Despite this, we did not raise milk prices till now”, said Sahakari. “However due to this hike

Police goofed up on Atala extradition

HERALD REPORTER PANJIM, FEB 17

Israeli drug dealer Yaniv Benaim’s (Atala) extradition process started on February 3, contrary to claims by Goa police they approached Peruvian authorities in early January 2011 seeking his custody. The Israeli fugitive wanted in the infamous drug-nexus case was arrested by Interpol at Lima International Airport on January 8 after they found his name on the red-corner notice issued against him. Ministry of External Affairs

(MEA) authorities told Herald that the State police faulted in their proceedings and asked for deportation instead of extradition, which delayed the process further. Police spokesperson Superintendent of Police Atmaram Deshpande on January 19 had told reporters that diplomatic communication between India and Peru authorities was being used to expedite Atala’s extradition process. But ironically, Goa police had sought Atala’s ‘deportation’ instead of ‘extradition’ which

messed up the process. On January 10, Goa Government moved for Atala’s deportation through the Delhi CBI Interpol. After receiving communication from Goa, the Indian Consulate in Peru referred the matter back to MEA in Delhi to seek further advice as ‘deportation’ would be time-consuming. “Even if his deportation order was issued, Atala would have been taken to the original port of embarkation in Israel. He would have been deported to (Continued on page 2)
