A disclosure that could put the entire Corporation of the City of Panjim (CCP) elections in jeopardy, investigations have revealed that the State Election Commissioner was on leave when he signed the order for elections. The SEC Dr M Modassir signed the order dated February 14, when he was actually on leave. Thirty wards of the CCP will go to polls on March 13 and the counting is also scheduled for the same day. The notification was issued on February 14, showing place as Panjim. However, investigations have revealed that Dr M Modassir was on a sanctioned earned leave from the Governor of Goa from February 7 to 18. The sanction order from Governor states that Dr Modassir was permitted to leave the headquarters and travel to Aligarh, Uttar Pradesh. So the question that arises is when the officer is not in town how can he issue an order and even showing place of issue as Panjim when the said officer is

actually thousands of kilometres away in UP? In view of the above one opines whether the elections are constitutionally valid when the notification itself is wrong. In order to throw more light on the matter Herald contacted Chief Secretary Sanjay Srivastava and asked him whether an officer can sign an order or notification when he is on sanctioned leave, his instant answer was “no”. “The officer has no powers to sign any order as he is on leave”, Srivastava told this reporter inquiring in what context the question was asked. When the matter was explained to him, he immediately

backtracked, “No, no…perhaps…you know...he may have signed in advance”. “No I am just saying perhaps…may be…the election notices have to be issued 30 days in advance… and if the officer knows that no one else can sign than he can sign in advance… .this is just my opinion and not a clarification or justification”, Srivastava said adding “the actual explanation can be given only by the officer (SEC)”. The DMK today put on hold the resignation of its six ministers from the UPA Government in a dramatic new turn with the party and Congress engaged in hectic negotiations to sort out their seat-sharing problems in Tamil Nadu. On a day of hectic developments, senior Congress leader Pranab Mukherjee telephoned DMK chief M Karunanidhi twice and urged him not to pull out his ministers from the Cabinet during the Budget Session and sought a day’s time to resolve problems. “Pranab Mukherjee called our President M Karunanidhi twice during the day. The Congress has asked for a day’s time. So, the withdrawal of ministers from the Government has been put on hold till tomorrow,” Deputy Chief Minister and DMK treasurer M K Stalin told reporters at Anna Arivalayam in Chennai. Asked when the issue will be resolved, Stalin said: “they have asked for a day.”

Stringent measures proposed to deal with errant builders HERALD REPORTER PANJIM, MARCH 7

The State Law Commission on Monday recommended a stringent law to deal with real estate developers and builders who dupe consumers. State Law Commission Chairman Ramakant Khalap told reporters that the Commission has recommended enactment of ‘The Goa Real Estate (Promotion, Control and Development) Act, 2011’ proposing imprisonment of upto 2 years to erring builders.

Stating that experiences of consumers wanting to buy flats were ‘harrowing’, Khalap said several issues crop up after the flat or apartment is booked by the consumer including the fact that the promoter or builder has no proper marketable title to the property. There are times when parking areas, open spaces and terraces are sold even to non-flat owners. In many cases, cooperative societies are not formed and flats are sold only on the basis of agreement of sale, he said.

Claiming that builders flout every rule in the book while constructing and allotting flats, Khalap said “in many cases there is not even a proper document of handing over or document of completion and occupation of the building”. The Law Commission also encountered complaints like ‘substandard constructions’. The recommendations placed before the State Government ought to be administered as a deterrent, he said. Shortly before the six ministers, including Maran and M K Alagiri, were to meet Prime Minister Manmohan Singh and handover their resignation in the evening, Chidambaram met Mukherjee for a second time. The Union Finance Minister then called Karunanidhi seeking a day’s time to come back with Congress’ position on the seatsharing issue. Sources said that the DMK made it clear that the offer of 60 seats to Congress was final and that the choice of constituencies could be negotiated. Late last night, Mukherjee called DMK Parliamentary Party leader T R Baalu and asked him to convey to Karunanidhi not to withdraw the ministers from the government. Baalu told reporters during the day that there was no question of reconsidering the withdrawal decision. Notwithstanding the call, the six ministers left Chennai as scheduled in the morning for Delhi to meet the Prime Minister and tender their resignation.

Common test for medical courses PTI NEW DELHI, MARCH 7

The Supreme Court today cleared the deck for the Centre and the Medical Council of India (MCI) to hold a single eligibility-cum-entrance examination for MBBS and post-graduate medical courses in the country from this academic session. A Bench of Justices R V Raveendran and A K Patnaik passed the order which will also be applicable for private medical colleges in the country. The Bench noted that since the decision in this regard has already been notified, the MCI and the Centre can go ahead for holding the CET.
