Claiming that the crisis facing the BJP government in Karnataka has finally blow over, BJP leader MP Shripad Naik has said the BJP leadership has accepted all the demands put forth by the dissident group of MLAs, including restoration of their Ministerships and an extra Ministerial berth to an Independent. Briefing newsmen after coming out of Taj Exotica, Benaulim at 10.15 pm on Friday night, Naik categorically said the BJP leadership has accepted all demands of the dissident group. “They had demanded that the Chief Minister restore their status as Ministers in the government and an extra berth to one of the Independent MLA. This has been accepted by our Party leadership”, Naik said. Replying to a question, he said the BJP leaders are huddled with the dissident group and a final decision would be announced before the media on Saturday morning. “Right now, they are having discussions on all issues raised by the dissidents. The party leadership has agreed to 99 per cent of their
demands. The talks are continuing with party leaders”, he said. When asked whether the dissident group have put forth the demand for a change in the leadership of the Karnataka Legislature party, Naik replied in the negative, saying that the 14 MLAs have accepted the leadership of the Chief Minister. When his attention was drawn to the statement made by Janata Dal Secular leader Kumaraswamy that the Chief Minster will be defeated on the floor of the House, the North Goa MP said that Kumaraswamy had come to the resort to indulge in horse trading, adding that he had to leave the state after the dissident group agreed to remain with the ruling party. Earlier in the day, Leader of the Opposition Manohar Parrikar told newsmen that a positive solution in favour of the BJP will come by Saturday morning, adding that the BJP MLAs housed at the Taj Exotica resort have shown their inclination to support the BJP in Karnataka. He said the BJP MLAs have been told to take their independent decision and expects (Continued on page 10)
Yeddyurrapa fall imminent: JD(S) HERALD REPORTER MARGAO, OCT 8
Expressing confidence that Karnataka Chief Minister B S Yeddyurrapa would be ousted from office on October 11, Janata Dal Secular and former Karnataka Chief Minister H D Kumaraswamy asserted his party MLAs together with the Congress will vote against the confidence motion against the Chief Minister. He, however, evaded a query from newsmen whether the Janata Dal and the Congress would form the next government, saying all these questions are hypothetical for the moment. When newsmen drew his attention to a statement by the Karnataka Chief Minister stating that the rebellion against him is over, Kumaraswamy said all the MLAs holed up in Taj Exotic are united and together. “You will know the real fact within the next 48 hours.. The decision of these MLAs will be known in the next 2-3 days”, he said, (Continued on page 10)
North Goa District & Sessions Court today sentenced the convicted rapist Mahanand Naik to seven years imprisonment for raping and blackmailing his wife’s friend for three years. The serial killer is also fined Rs 25,000 and the Court directed to pay the entire amount as compensation to the 22-yearold victim ‘who had suffered emotionally and physically… and whose life had taken a turn leaving her with least chances of settling in matrimony.’ The Court has, however, set off his period of imprisonment already undergone from April 21, 2009 till date. In sentencing the Principal District Judge Nutan Sardessai took into account victim’s statement that the accused raped her threatening to circulate her semi-nude pictures in the village. “I have every reason to hold that the victim’s case of forcible sexual intercourse by the accused over a period of time by putting her under threats to defame her, tarnish her image, spoil her marriage prospects
Soon after the District Judge Nutan Sardessai pronounced Mahanand’s sentence, the ‘calculated killer’ handed over a letter requesting not to transfer him to Central Jail at Aguada from Sada sub-jail at Vasco where is currently lodged. Dressed in a full-sleeve skyblue shirt and a pair of jeans, Mahanand seated on the accused-bench quietly heard the sentence order, which was later explained to him in Konkani language. He thereafter handed-over a hand-written letter to the Judge that requested not to
transfer him to Aguada jail in view of other cases pending against him in the Court. The prosecution has been asked to submit a reply to the letter. – (HR)
and create fear also for the future of her sister inspires confidence and when the defense version is found palpably false,” the Judge ordered. The punishment brings a sigh of relief to the prosecution, as Mahanand is already acquitted in three other rape and murder cases. The Judge has also ordered not to destroy the pho-
tographs (used for blackmailing) and mobile phones, as this material could be used in other cases against him. A former rickshaw driver (42) from Ponda emerged as Goa’s notorious serial killer who raped, murdered and looted gullible girls for a period one and half decade from 1994 to 2009. His string of crimes came to
light after the lone surviving victim complained to police that he repeatedly raped and blackmailed her for three years taking advantage that her parents were dead. Following this, he was arrested after which he allegedly confessed of committing 18 crimes. The Court, however, categorically stated that the prosecution failed to prove the age of the victim either by producing her birth certificate or medical findings. This perhaps was the reason that the sentence was not enhanced as asked by the prosecution. “The incident of rape for which he (Mahanand) has been held guilty commenced sometime in or about November 2005 and the complaint came to be lodged by the victim in April 2009…The benefit of lapses would also endure in favour of the accused,” Judge Sardessai observed while pronouncing the sentence order. Speaking to some journalists outside the Court hall, Mahanand said that though he has not made up his mind, he is most likely to contest the order in the High Court.

Liu Xiaobo, a jailed pro-democracy dissident, who has been leading a “non-violent struggle” for ending the Communist Party rule in China today won the 2010 Nobel Peace Prize, angering Beijing, which said the award has been “desecrated” as it honoured a “criminal”. Fifty-four-old Liu, who was also a key leader in the 1989 Tiananmen Square pro-democracy protests, was selected for the prestigious award by the Nobel committee, rejecting China’s demand not to honour him. Liu was honoured with the Nobel Peace Prize for his “long and non-violent struggle” to secure fundamental human rights for his country’s 1.3 billion people. Making the announcement in

Oslo, Nobel Committee President Thorbjoern Jagland said Liu was “the foremost symbol of the wide-ranging struggle for human rights in China”. Jagland, reading the citation, said China’s new status in the world in the wake of its phe-
nomenal economic advances “must entail increased responsibility”. “China is in breach of several international agreements to which it is a signatory, as well as of its own provisions concerning political rights,” he said.
Court issues warrants against German duo HERALD REPORTER PANJIM, OCT 8
Children’s Court today issued warrants against the German mother and daughter, to depose in the Court in connection with the minor’s rape case in which Education Minister Babush Monserrate’s son Rohit stands accused. Public prosecutor Poonam Bharne told the Court that although both – the complainant and victim - who have returned to their home town, are bound to depose for trial, they have been evading summons. President P V Savaikar issued warrant against the German duo
and directed them to remain present in the Court on October 29. Rohit, son of the education minister is chargesheeted for sexually assaulting the minor in 2008. The Government last month sought German Consul’s intervention to record statement of the victim via video-conferencing. Bharne had told the Court that the State is planning to seek German Consulate’s intervention to record statement of the German pair via video-conferencing. The mother who pursued the
case vigorously, in an unexpected move refused to proceed with the case. In an email communication to the Court in August, she expressed unwillingness to depose before the Court. On October 2, 2008, the mother had filed a complaint at Calangute police station accusing Rohit of sexually abusing her daughter and sending her lewd text messages. After the case was registered on October 13, there were many ups and downs as the mother later opted to withdraw the complaint which, however, could not happen.
This is the second time Nobel Prize has been granted to a campaigner for human rights against Chinese government. The exiled Tibetan spiritual leader, the Dalai Lama was given the prize for tenacious struggle for the rights of Tibetans. In Beijing, the Chinese Foreign Ministry condemned the Nobel committee’s decision and said that the coveted prize was granted to a “criminal.” The grant of the Nobel Peace Prize to Liu desecrated the prize and could harm China-Norway t i e s , Fo r e i g n M i n i s t r y spokesman Ma Zhaoxu said. Liu was sentenced to 11 years in jail on December 25, 2009 after a local court in Beijing convicted him of organising an agitation aimed at subverting the government.
