Pakistan successfully test-fired two short-range, nuclear-capable missiles today as part of efforts to boost defence capabilities, the military said. Prime Minister Yusuf Raza Gilani and senior military officials watched the test-firing of the Ghaznavi ballistic missile, which can travel up to 185 miles, and the Shaheen-I, with a range of 400 miles. “Both missiles successfully hit the target areas,” the military said in a statement. It did not identify the location of the tests.

8 CRPF jawans killed in Naxal attack PTI RAIPUR, MAY 8

Eight CRPF jawans were today killed when Naxals blew up a bullet-proof vehicle in Bijapur district of Chhhattisgarh, the first major attack after the Dantewada ambush which left 76 security men dead a month ago. The naxalites triggered the IED blast near Pedakodepal village on National Highway 16 in Bijapur, 284 km from here, and fired at the security personnel, Director General of Police Vishwaranjan said. Eight CRPF personnel of 168 Battalion, including a driver, who were travelling in a TATA 407 bulletproof vehicle from their company headquarters in Murkinal to nearby battalion headquarter, were killed, he said. One jawan was injured and another was missing in the attack, the DGP said. “It appears that the security personnel ignored the instruction not to travel in any kind of vehicle in the naxal-infested areas,” State Home Minister Nankiram Kanwar said. The injured have been admitted to a hospital in Jagdalpur.

The All Goa Private Bus Owners’ Association in a meeting held in a city hall on Saturday decided to give 15 days notice to the Government for a hike in bus fares by 0.20 paise, a demand which has been pending for the last one-and-half-month. General Secretary AGPBOA Sudip Tamankar said even after 15 days time if the government fails to hike the bus fare then they would go on a day’s token strike. “Even after the token strike nothing happens then we will take another meeting to decide on the future course of action,” he said. US warns Pak over NY car bomb plot PTI WASHINGTON, MAY 8

As a team of FBI officials landed in Islamabad to probe any possible Pakistani links to the failed Times Square bombing case, the US today warned Pakistan that it will face “very severe consequences” if any terror plot was traced to that country. “We’ve made it very clear that if, heaven-forbid, an attack like this that we can trace back to Pakistan were to have been successful, there would be very severe consequences,” Secretary of State Hillary Clinton told the CBS news channel in an interview that is scheduled to be aired tomorrow. Clinton said that US expects more cooperation in fighting terror from the Pakistan government and warned there could be repercussion if any future successful terror attacks in America were linked to Pakistan. The Secretary of State said Pakistan’s attitude toward fighting Islamic terrorists has changed remarkably. “We’ve gotten more cooperation and it’s been a real sea change in the commitment we’ve seen from the Pakistan

Government. (But) We want more. We expect more,” she said. Assistant Secretary of State for South and Central Asia Robert Blake told PTI that Pakistan needs to expand its operation against Punjab-based terrorist outfits including Lashkar-e-Taiba and Jaish-eMuhammed. Liberal Democrats leader Nick Clegg, who has emerged as the kingmaker in the UK polls, today held consultations with his MPs to discuss a power-sharing offer from the Conservatives on the eve of a crucial meeting with Tories. The Conservatives, who won 306 seats in the 650-member House of Commons, had reached out to Liberal Democrats asking them to support in forming a government. The State Home Ministry has asked the police to submit a detailed report whether Naxalites have used Goa as a place to lie low. Speaking to reporters here Chief Secretary Sanjay Srivastava said that he has asked the police to check whether the State has been used to lie low by the nefarious minds. Home Ministry’s action has come in wake of recent arrest of a Naxalite leader Sambu Beck. Beck was a leader of Maobadi Trushul Manch from Orissa. He was wanted by Orissa police for murders, kidnapping and extortion cases in Sundargarh district of that State. “ The Home Ministr y has asked for report whether there are any other similar groups working here and what action they are taking to identif y them,” Srivastava said adding “Goa may be a place to lie low for nefarious minds. BJP to head new coalition government in Jharkand PTI NEW DELHI/RANCHI, MAY 8

The BJP will head a new coalition government in Jharkand with ruling alliance partners JMM and AJSU announcing their support today ending the crisis but questions remained over rotating chief ministership. BJP General Secretary Ananth Kumar while announcing the decision taken at a meeting with the partners in New Delhi said the BJP will head the government for the remaining fourand-a-half year term of the state Assembly. BJP Parliamentary Board will meet on Monday to decide its Chief Ministerial candidate, he said. But within hours after Kumar made the announcement that brought to an end the 11-day stalemate, Chief Minister Shibu Soren replied in the affirmative when asked whether the formula involved the post of chief ministership being rotated between the BJP and the JMM.

“Yes,” Soren told reporters at the Ranchi airport on his arrival from Delhi in response to a question in this regard. The JMM had earlier too made a proposal for rotating chief ministership but it was shot down by BJP. BJP spokesperson Nirmala Sitharam when asked to comment on the JMM supremo’s latest position said the party was not aware of this but made it clear the understanding arrived at the meeting was that only the saffron party would be heading the new coalition government. BJP sources indicated there could be rethink to form a government if JMM insisted on rotating chief ministership. The crisis in the mineral-rich state was triggered after an angry BJP decided to withdraw support to the JMM on April 28, a day after Shibu Soren, also an MP, voted against the BJP-sponsored cut-motions in the Lok Sabha. The decision was however kept on hold.

Former union minister Yashwant Sinha, ex-chief minister and General Secretary Arjun Munda, Deputy Chief Minister Raghubar Das and Transport Minister Neelkant Singh Munda are being mentioned as probable candidates to be the eighth chief minister of the mineralrich state in nine-and-a-half years. “We had fruitful discussions with senior BJP leaders. We will support a government in Jharkhand under BJP leadership. The decision has been taken to save the state from President’s Rule,” Shibu’s son Hemant Soren said after the meeting. Anant Kumar said, “A BJP-led NDA government will be formed in Jharkhand. We want to save the state from Congress misrule. A stable government which stands for development will be formed,” he said. Kumar insisted that the talks ended on a happy note. This will be the third BJPled government in Jharkhand.

Kamat further said that growth has to take care of the poorest man in the society and the benefits of growth have to go more to the common man. On development, Kamat said compared to the many other states, Goa is far better in terms of road network, drinking water facility, power and other amenities. However, he said, there is tremendous scope for improvement. MARCEL (HC): Ponda police have recovered 10 motorcycles and seven mobile handsets from the gang arrested in connection with robberies along the highway. The fourth accused, Ronald Rathos, from Betalbatim was arrested on Friday night. It may be recalled that Ponda police had arrested Derrick Rathos, Clinton Fernandes and Felton D’Costa at Farmagudi in the wee hours of Friday. Ronald had fled from the scene and was later arrested at Betalbatim. “The accused had threatened a truck driver at Dharbandora and had decamped with cash of Rs 1,500 and the mobile handset of the driver. Our night patrol staff was alerted of the incident. The car was spotted and after a chase of over 40 minutes, three of the accused were nabbed at Farmagudi. One succeeded in fleeing from the site, but was later arrested at night,” said Ponda PI C L Patil. “The accused even dashed a police vehicle but could not succeed to go beyond Farmagudi as our night patrol staff used a truck as a barricade.” “During interrogation, the accused confessed to the crime and said they had looted truck drivers in different locations in the State. They also revealed their involvement in motorcycle thefts and we have recovered ten stolen motorcycles. More vehicles are also likely to be recovered from the accused,” said PI Patil. Police have so far recovered seven mobile handsets, cash of rs 8,500, ten stolen motorcycle and also the car used in the offence. All four accused have been remanded to four days police custody.

State Home Ministry had recently conceded that drugs seized in various drugs were still pending in malkhana awaiting their disposal since last decade. Mentioning about his meeting with an Israeli national during his visit to Africa, Rane said that Israeli national identified Goa with drug trade. "That Israeli immediately spoke about drugs in places like Anjuna and Palolem," he said. The Speaker said that Goa should strictly implement the drug related laws alike some Gulf countries so that the menace can be eradicated from the State.

Activists from Benaulim on Saturday intercepted a goods carrier which was used to transport and dump waste along the roadside at Tolleabandh-Benaulim. Youngsters from Benaulim intercepted the van after the vehicle laden with waste came to the spot to off load the garbage. The locals immediately caught hold of the occupants of the vehicle and intimated the matter

The already battered water supply in Canacona was further hit after a pipeline burst and cut off Chapoli dam’s water supply to the taluka’s main water treatment plant at Shrishthal, disrupting water supply to the entire taluka on Saturday. According to PWD sources, the 20-year-old 14 km pipeline from the sump at Chapoli dam got ruptured at about 2 am on Friday near the Canacona police station, disrupting supply to the treatment plant. Since there was no supply from the main source to the treatment plant, supply to the several areas was disrupted throughout the day, informed sources. PWD workers were seen manually digging out the pipe from across the highway road in a bid to resume water supply to the taluka. “We expect to replace the damaged pipe by 10 pm on Saturday and restore supply of Chapoli dam water to the treatment plant by midnight,” said Canacona PWD (water-supply) Assistant Engineer Krishnanand Velingkar. Water pumping from Mudkud River remains suspended for third day HERALD CORRESPONDENT CANACONA, MAY 8

Pumping of water from the Mudkud River to supply it to residents of Agonda and Khola villages remains suspended for the third day, as the reported poisoning of the river continues to baffle authorities. It may be recalled that a suspected overdose of chlorine in the Mudkud River reportedly to kill fish for consumption has left the entire marine life dead, and the foul smell of the dead marine life has been unbearable in the area. “Water samples collected from three different places have been forwarded to the Pollution Control Board and our own water-testing PHE lab at ToncaPanjim,” informed an officer from PWD (water-supply), Canacona. “The pollution control board, however, declined to undertake the tests, claiming they were not competent to do so. We again collected water samples on Saturday and submitted it to the Tonca lab. The tests are awaited in three days time,” the officer added. However, given the allegations of some officials adding chlorine to the Mudkud River

But there has been no response from them even today, as we are making every effort to pump out the contaminated water, besides securing the fresh water,” a

source at PWD informed Herald. After a delay, the taluka’s health officials from Canacona Community Health Centre on Friday evening collected water samples from the Mudkud River. Sources informed that the Health Officer Dr Murlidharan and a medical officer visited the site at Mudkud River to collect water samples. When contacted, Dr Murlidharan said: “We collected the water samples on Friday evening and sent them for tests at the analyzing unit of Director of Health Services. It may take a few days before the report is available.” Meanwhile, outgoing Agonda sarpanch Jovi Fernandes visited the areas at Mudkud River along with panch Milagrina and also assisted PWD officials in the operations. “The PWD should undertake a proper investigation of the water, before it is again pumped for supply,” said Fernandes. He also called on authorities to augment resources at its disposal for the betterment of public. “Water tankers should be provided to the residential areas, till normal water supply is regularised’, demanded Fernandes.

A 61-year-old man from Sasmollem in BainaVasco was seriously hurt in an accident, when his scooter was knocked down by an oil tanker near the Vasco vegetable market along the F L Gomes road on Saturday morning. According to Vasco police, Shaikh Mohammed Ashif was coming out from the Vasco vegetable market, when his scooter was hit by the oil tanker. “Ashif sustained grievous injuries after he was dragged to some distance,” said Sayed Jamadar, a fruit vender who witnessed the mishap.

“The tanker driver stopped only after people shouted and alerted him of the mishap,” he added. It is learnt that Ashif ’s family was busy preparing for a wedding ceremony of a relative and the accident has come as a big shock to the family. The victim has been admitted to the GMC hospital and Vasco police has registered a case and has detained the oil tanker in the connection. The F L Gomes road has become a death trap for motorists and pedestrians due to the traffic congestion along the road. “It’s obvious that such mishaps will occur and who is to be blamed for this? The park-

ing place near the vegetable market has been occupied by fruit handcarts,” said Vasco traffic police PI Dharmesh Angle. “Where is the proper infrastructure for parking in port town of Vasco,” asked PI Angle. “People who visit the vegetable market want to park their vehicles as close to the market as possible and this has led to frequent traffic congestion.” “We have proposed a four-wheeler and two-wheeler parking lots on either side of the F L Gomes road. Migration: towards meeting disturbing situation to Goan topography and identity BY JUINO DE SOUZA

Goa is the most beautiful State in the whole planet and for hundreds of years migration has been taking place. Earlier, during the Portuguese regime because of poor economic development, there was outward migration where sons and daughters of Goa were moving outside mainly and venturing to all places in the world. Today Goans can be found almost everywhere contributing in countless ways to the societies of which they are now an integral part. Meanwhile, back home currently a reverse inward migration is taking place mainly because of the economic success and peaceful environment as well as the beauty of Goa which has been transformed into a magnet attracting migrants. All types of people from India and abroad including the rich, middle class, business class, labour class and others are flocking to Goa in large numbers and are becoming an essential part of our State. All theories of migration concede that migration occurs when the region of origin lacks the opportunities which the destination promises. It is inherently a combination of pull and push factors. Variation in economic development, better facilities and environment is a primary motive and reason for migration to greener pastures.

Immigration is a complex psychosocial phenomenon; it mobilises a multifaceted process of destabilisation/restabilisation, besides increase in migrant population also causes pressure on land and inequality of infrastructure. The question is: How do we address the issue of migration with respect to limited carrying capacity of a small state such as Goa? What if hordes of outside population keep converging in our small State of Goa with a view to settle down permanently? Can our limited resources and inadequate infrastructure hold such huge influx? How can such kind of population growth be sustained over the long term unless government programs a priority on instituting reforms? We don’t have a proper garbage disposal system nor do we have any worthwhile sewerage system, our public transport is in shambles and housing cost is unaffordable. Although many towns have been declared urban as per past census, yet vested interests do not allow urbanisation and which is why most of Goa falls under panchayat administration. Can we afford to convert Goa into another Mumbai where migrants are found sleeping, defecating and reproducing on the road? Can we allow Goa to switch into another slum such as Dharavi? It is five decades since Goa became free

from Portuguese rule and achieved independence but how is this State of ours progressing sociologically? No doubt the economic rise has led to opening businesses from hardware to diamond shops which are all owned and operated by migrants, but what is the solution to the growing resentment of insiders against outsiders? How do we deal with the concern of Goan identity? What happens when non Goans who know nothing about Goan ethos and may end up winning elections and become rulers of this small state of Goa in future? It is definitely a worrying situation. Migration brings along with it many challenges and cannot be addressed unilaterally. We cannot take shelter of our constitution by saying that any Indian is free to travel and settle anywhere in India? Settling does not mean using the side of the road and footpath and encroaching private and public property and setting up slums and causing nuisance to taxpaying citizens? This our founding fathers had never imagined. There is a growing need for us to understand the opportunities and also the challenges posed by migration. We should not be fuelled by prejudice and instead our goal should be to harness the power of migration to help more people share in Goa’s prosperity. We

must therefore have a stake in managing migration well and we must work together, united in purpose and united in action to expand that development potential. Migration can no longer be casually viewed by economists as the only beneficent process necessary to solve problems of growing labour demand. I would like to highlight three challenges that add to the urgency for action. One is the need to regulate migration. Take the case of labourers who migrate to Goa in search of jobs which they are denied in their native region. We make use of them to clean our gardens, build our houses, for carpentry, for odd jobs. When they don’t get jobs then for survival they take the easy route and indulge in thefts, burglary and even murders and which is why the crime graph in Goa is rising. There may be terrorist and naxalites entering Goa and which can pose a danger to the people of the state and in the absence of any control and regulations over them we don’t even know who they are? Therefore the state machinery must have a regulation in place and rules should be framed for compulsory screening and registration of all migrants entering Goa. Second we must strive to bring in some measures to control the excessive migrant influx as it is needed to ensure the welfare of

Goan residents. We could even consider having a permit system. How many can we permit? Can it be done by restricting the number of industries from coming to Goa? Should the migrant be asked to go back once he has finished with his job? To obviate the fear that migrants may become future rulers can we consider disallowing migrants from voting in Goa? What if every employer is asked to take a sworn affidavit voluntarily from every migrant employee recruited that they will not enrol themselves as voters in the state of Goa? Such workers may be sanctioned leave so as to allow them to vote in their state of origin? All such measures may seem to be against the constitution yet we must find some practical remedies. Third, there are rich migrants who anyhow want to own a piece of land and are willing to pay any price for it. Almost all rich Indians and foreigners be they film stars, industrialists, traders and merchants own a second home in Goa and this is one of the reason why property prices in Goa are soaring and out of bounds for Goans. So can we stop such outsiders from buying properties through obtaining special status for Goa is what all should ponder. The Margao Municipal Council has served a two-day deadline on the migrants inhabiting the illegally erected shanties at Colmorod or face the wrath of the authorities early next week. Margao Municipal Council Chairperson Savio Coutinho along with municipal engineers visited the shanties Saturday morning and found to his utter surprise the proliferation of illegal structures right under the nose of the authorities and the powers that be. The Chairperson paid the visit after residents of Colmorod ward, which is being represented by Coutinho in the Civic body, lodged a complaint with the Municipality highlighting the mushrooming shanties in the low-lying area owned by Communidade. The Chairperson made it quite clear to the hutment dwellers to dismantle the sheds and take away their belongings within two days before the Civic authorities confiscate all the material dumped at the site. The resignation submitted by Agonda sarpanch Jovi Fernandes came into effect on Saturday on expiry of the ten-day waiting period. According to sources in Canacona BDO, Deputy Sarpanch Gulshan Guru Bandekar will hold the charge of Agonda panchayat till a new sarpanch is appointed to the post. It may be recalled that Jovi Fernandes citing personal reasons had submitted his resignation papers to the Director of Panchayats on April 28. Under the law, if the resignation submitted is not withdrawn or returned for any reasons within the 10-day period, it is automatically bound to be accepted and the charge voluntarily goes to deputy sarpanch till a new person is elected to post. Sources informed that since the decision to resign is taken in accordance with the ruling group’s agreement, persuasion from various quarters to recall the resignation failed to impress Fernandes in the last ten days.

The garbage menace is haunting not only cities but also villages and Santa Cruz is no different, as waste continues to pile up in many corners of the village, which has been giving a headache to panchayat authorities. And to add to its misery, the panchayat has been unable to find a dumping site, which could get an okay from the Goa State Pollution Control Board. Moreover, the tender floated by the panchayat for collection of garbage has no takers as no contractor is willing to bid in the absence of a dump site. However, the stumbling blocks have not deterred the panchayat authorities from shying away from its responsibilities and after much thought, the panchayat has come out with a solution, which will help in solving the garbage woes in the village to a large extent, if not entirely. As a first step, the panchayat has issued notices to housing societies to construct composting units in its own backyard to dispose off its garbage and has

given these societies a period of seven days to comply with the same. Speaking to Herald, Sarpanch Rosy Fernandes said it is only the first part of its drive, in which notices will be issued to all the housing societies that do not have composting units. “The drive then will be extended to all houses in the village,” she informed and added that those who fail to comply with the directives would attract penalty. Rosy, however, said that before penalizing anyone, the panchayat would form a squad comprising of the village youth, which will go around the village and announce over the sound system asking all defaulters to comply with the directives within a given time frame. “Even then, if the housing societies or individuals fail to build composting units, the squad will collect fines on behalf of the panchayat,” Rosy said and added that housing societies will attract a fine of Rs 500 while individual dwellings will attract a fine of Rs 100 per day, which will then be distributed between the

Colva police when contacted informed that the police has arrested the contractor Santosh, a native of Maharashtra under Section 336 and 337 of the IPC for failing to take precautionary measures at the site and to display warning signals on the road about the on going, thereby endangering human lives. Bye-elections for the Navelim Zilla Panchayat constituency will be held on Sunday, even as election and police officials have geared up their machinery for tomorrow’s polling. Elections to the Navelim ZP seat were countermanded due to the death of a candidate Hermino Fernandes in a road accident midway through the campaign. Five candidates are in the fray for the electoral battle, including Succorro Fernandes, Edwin Cardozo, Agnelo Da Costa, Casmiro Vierra and Wilson Viegas. Campaigning for the bye-poll was lacklustre and dull with the contestants resorting to doorto-door campaign to reach out to the voters spread in the villages of Navelim, Telaulim and Sirlim-Dramapur. The election campaign had lost its charm and enthusiasm after former Navelim Sarpanch Bishuth Themudo withdrew from the fray after talks initiated by Navelim MLA and PWD Minister Churchill Alemao and Urban Development Minister Joaquim Alemao failed to evolve a consensus between Themudo and Edwin Cardozo. Both Themudo and Cardozo were in the fray before the elections are countermanded, but Themudo decided to finally withdraw after Edwin told the Alemao brothers about his inability to withdraw from the fray. Salcete Mamlatdar Paresh Faldesai told Herald that all arrangements have been made to conduct tomorrow’s poll. He said poll officials have fanned out to various polling stations in Navelim constituency with the poll material. Godown, house gutted at Bicholim BICHOLIM (HC): A godown and an adjacent house were guttered in fire at Van Maulinguem, Bicholim on Saturday, causing a loss of property worth Rs 8 lakh. According to reports, the incident occurred in the wee hours on Saturday, when the godown belonging to Gurdas Kerikar caught fire due to a short

circuit. Five freezers, other electrical items and the entire godown including the adjacent room were destroyed in the fire. Locals tried to extinguish the fire and when they were unable to do so, the fire brigade was summoned and the fire was extinguished after about two hours.

PYS, BS to embark on DSYA puts off plan to develop Nuvem school playground ‘Adarsh Gram Nirman Yojana’ HERALD REPORTER PANJIM, MAY 8

At least, currently, the Directorate of Sports and Youth Affairs has been compelled to put off its plan to develop a village school playground in Nuvem village. The Bombay High Court at Goa has set aside the notification issued by the government under section 6 of the Land Acquisition Land on February 5, 2009 to acquire land admeasuring 50675 sq mts in the village. The Division Bench comprising Justice S J Vazifdar and Justice U D Salvi held that report submitted by Land Acquisition officer (LAO) under section 5 (A) on December 29, 2009 which influenced the government’s decision to issue declaration under section 6 of the Act, cannot be sustained as petitioners contentions were not considered. The petition was thus allowed, however the LAO will be free hold a fresh enquiry under section 5 A of the Act, the Court said. Through notification issued on September 5, 2009 under section 4 of the Act, the government declared its intend to acquire land under survey no 95/11 of Nuvem Village which was objected by the petitioners –Ibaldo Gomes, Jacqueline Gomes and Bernadita Gomes, legal heirs of the agricultural

tenants of the subject land. The petitioners raised objection saying the LAO did not consider their detailed objections raised in terms of 5 (A) of the Act, and after conducting farce of the enquiry submitted report to the government, and thereafter, the government thoughtlessly proceeded to issue the notification under section 6 of the Act. The main objections of the petitioners was that there was no public purpose involved in the acquisition, also proposed acquisition exceeded 50000 sq mts. The notified land is a fertile and well cultivated, and would require filling up with mud to height of at least two meters involving huge expense. Also, acquisition would deprive them of their livelihood. They further pointed out that alternate site was available on the east of National Highway which was better suited but was not considered by the government. Adv Mahesh Sonak who represented the petitioners told the Court that the report under section 5 (A) made by the LAO was without application of mind however Advocate General Subodh Kantak argued that the objections, particularly with regards to availability of alternate lands were vague and LAO had considered the objections

After conducting a four-day free yoga camp in the State, the Patanjali Yog Samiti (PYS) and Bharat Swabhiman (BS) are all set for an ambitious programme ‘Adarsh Gram Nirman Yojana’ to transform 680 villages in the State into model villages. Addressing a press conference on Thursday at Lions Club, Sancoale, BS National Chief Co-coordinator of Dr Jaideep Arya along with BS Goa Chief Dr Suraj Kanekar and others explained the task before them to transform the villages. “As part of the ‘Adarsh Gram Nirman Yojana’ (Model Village Development Scheme) campaign, the 11-point agenda includes making the village disease-free with help of regular yoga classes, setting up of a medical herbal garden in every village, afforestation, water management, moral and value-aided education system, village court and sanitation of the village,” said Dr Arya. “During the first phase, around 100 villages have been shortlisted for the ‘Adarsh Gram Nirman Yojana’. Minister for Women and Child Development Ravi Naik said that efforts will be made to enhance the budgetary provision under Kanyadhan Scheme and also to hike income limit to enable more people avail the benefit of this unique scheme of the State government. Naik was speaking after disbursing cheques of financial assistance amounting to Rs 3 lakhs under Kanyadhan Scheme to 200 beneficiaries from Ponda at a function held at Rajiv Gandhi Kala Mandir, Ponda. Naik further said that an amount of Rs 3 crores has been earmarked to disburse financial assistance to about 2000 beneficiaries under ‘Kanyadhan Scheme’ during the current year. Deal with mounting arrears in court cases, says PM PTI NEW DELHI, MAY 8

Prime Minister Manmohan Singh today said the government, judiciary and the Bar Association should make concerted efforts to deal with mounting arrears in court cases and the growing cost of litigation. “It is important that concerted cooperative efforts are made by the government, judiciary and the Bar Association to deal with the mounting arrears in our courts and the growing cost of litigation,” he said at the national conference on ‘Law and Governance’ to mark the Golden Jubilee of the Bar Association of India (BAI). Noting that equality before law would not be a living reality if citizens were not able to access justice at affordable cost, Singh said, “The plight of the large number of undertrial prisoners in our jails should move the machinery of justice to speedy corrective measures as part of the process of reforming and improving the quality of governance in our country.” He expressed the hope that the conference would deal with the practice of law over the years and the interplay of political, social and economic developments, the socio-legal processes that deterred providing access to justice and the necessary legal pre-requisites of good governance. Pointing out that the judiciary, legislature and executive should not exceed their respective powers as enshrined in the Constitution, Singh said the three organs of the state should work in harmony to max-

imise public good. “It is assumed that none of the organs of the state, whether it is the judiciary or the executive or the legislature, would exceed its powers as laid down in the Constitution,” he said. “Even though their jurisdiction may be separated and demarcated, it is expected that all institutions would work in harmony and in tandem to maximise the public good,” he said. Referring to one of the topics to be debated at the meet, Singh said the doctrine of ‘separation of powers’ was acknowledged as one of the basic features of the Constitution. “It is also commonly agreed that all the three organs of the state, namely the Legislature, the Judiciary and the Executive, are bound by and subject to provisions of the Constitution, which demarcates their respective powers, jurisdictions, responsibilities and relationship with one another,” he said. Singh said lawyers were an integral part of the system of administration of justice and had a role not confined only to courts and advising clients. “The role of lawyers is not confined to courts alone or advising clients in business deals. It extends to being an integral part of our system of administration of justice – and justice is not just in the legal sense, but justice - social, economic and political - as set out in the preamble of our Constitution,” he said. Bangladesh today celebrated the 149th birth anniversary of Nobel laureate and poet Rabindranath Tagore, with Prime Minister Sheikh Hasina describing him as a source of inspiration for all movements in the country. Hasina opening the main official programme at a city hall recalled his contribution towards reshaping the Bengali literature and the nation’s cultural life and values. Hasina in another statement called Tagore a “lighthouse” for the Bengalis as he wandered in their hearts and said “he was a source of inspiration in all movements, struggles, revolutions, thoughts and creativity of the Bengali nation.” Cultural groups including the apex Sammilita Sangskritik Jote organized colour ful street marches and concerts in open air and inside auditoriums across Bangladesh as leading artistes rendered Rabindra Sangit, which the poet himself expected him to keep alive to the posterity, though he earned the credit of being Asia’s first Nobel Laureate for his poetry in 1913. Nearly after two decades of Babri Masjid demolition, senior leaders of Vishwa Hindu Parishad (VHP) will assemble in Ayodhya to chalk out a plan for stepping up Ram Mandir movement. “A four-day meeting of the central management committee of VHP is scheduled to be held in Ayodhya from July 12,” VHP media incharge Sharad Sharma told PTI. This would be first meeting of VHP central committee in Ayodhya after December 6, 1992. “Last time the meeting was held a couple of months before December 1992 at Janki Mahal Trust,” they said. The meeting is expected to be attended by VHP International President Ashok Singhal and General Secretary Praveen Togadia among other leaders. The meeting is being held in the light of decisions taken by “sants” at a gathering in Haridwar. During the meeting an action plan would be chalked out and distributed to state officerbearers, Sharma said. The VHP has planned to kickstart a nation-wide awareness campaign led by religious leaders from August 16.

Though it supported Congress in nailing the BJD government in Orissa over the multi-crore mining scam, BJP would like to maintain equidistance from both the ruling party and the main opposition in the ensuing Rajya Sabha elections likely to be held next month. “We will like to keep distance from the BJD as well as Congress,” BJP state president Jual Oram told PTI while airing his views on possible united opposition candidate for the Rajya Sabha polls. Sensing that the ruling BJD could capture all the three seats in Rajya Sabha which are falling vacant, leader of opposition from Congress, Bhupinder Singh had floated an idea of giving a united candidate at least to get one opposition member elected to the Upper House. Though Oram said “no to BJD and the Congress”, he added that the state leadership

would like to consult the central BJP in this regard. Election to three Rajya Sabha seats was required as the three sitting MPs, one each from BJD, Congress and BJP, were completing their terms on July 1. Puducherry airport, under expansion, would become operational in the next two months, Union Minister of State for Planning and Parliamentary Affairs V Narayanasamy said today. Kingfisher Airlines had agreed to operate flights from Bangalore and Kochi to Puducherry, a former French colony visited by foreign tourists in large numbers, he told reporters here. The airport project was conceived by the Union Territory Government as part of its initiatives to promote Puducherry as a major tourist destination. The existing airport set up on a minimal scale some years ago was used essentially for VIP visits barring a brief period when a private airlines operated flights to Chennai. Narayanasamy, who represents Puducherry in Lok Sabha, said he along with Chief Minister V Vaithilingam and Tourism Minister Malladi Krishna Rao recently held discussions with Civil Aviation Minister Praful Patel for speedy completion of the expansion of the runway and installation of facilities in the airport so that it could be activated and made fully operational. “The airport would be thrown open for traffic in the next two months,” he said. The territorial government had sought Rs 200 crores for full development of the facilities.

Chief Justice of India K G Balakrishnan today praised the judiciary for playing an important role in bringing in some of the landmark legislations passed by Parliament in recent years. Balakrishnan, who is going to demit office next week, said that it is because of courts’ intervention that the government has enacted legislation for free and compulsory education and the Right to Information Act. “In recent years, the enactment of the Right to Information Act, the Right of Children to Free and Compulsory Education Act are some prominent examples of far-reaching legislations whose origin can be attributed to judicial interventions in some part,” said Justice Balakrishnan at a national seminar on ‘Law and Governance’. “The Executive has also been responsive towards directions and guidelines given in judicial decisions that have acted as precursors for progressive legislations,” he said and asked the government to make the Food Security Bill into a law. On good governance, the outgoing Chief Justice said that the executive has to follow the rule of law to ensure better living standards for citizens and formulate strategies to make the state apparatus work for betterment of all sections of the society. He also said media plays an important role in ensuring good governance in a democracy. Justice H S Kapadia, the Chief Justice-Designate who was also present at the function, said that the fundamental rights of the citizens and the responsibility of the government became meaningful only when they became justiciable and at this juncture the superior courts should understand the consequences of their judgements. “Time has come for courts to reframe welfare rights under the Constitution as rights to minimum provision rather than a right to equal access,” Justice Kapadia said.

A Pakistani court conducting the trial of LeT’s operations chief Zakiur Rehman Lakhvi and six other suspects in the Mumbai attack case adjourned proceedings till May 22 after the prosecution sought more time to gain access to Ajmal Kasab, sentenced to death by an Indian court. Judge Malik Muhammad Akram Awan of the Rawalpindibased anti-terrorism court put off the case for two weeks after the prosecution filed an application asking him not to proceed till Pakistani authorities gained access to Kasab and Fahim Ansari, an Indian national who was accused of involvement in the attacks but acquitted by the Indian court. The prosecution said in its application that the Pakistan government had requested India to grant access to Kasab and Ansari. It also said the arrest warrants issued for Kasab and Ansari by the anti-terrorism court had been provided to Indian authorities. The prosecution also asked the court to take action against Kasab and Ansari under Article

87 of the Code of Criminal Procedure. The article states that if a person against whom a warrant has been issued is absconding, the court can publish a written proclamation requiring him to appear at a specified place and time within 30 days. Lawyers defending the seven suspects, including Lakhvi, filed an application in which they claimed the government was resorting to various tactics to delay the trial. Among these tactics is seeking access to Kasab, the application contended. The application filed by the defence lawyers also noted that Kasab had been convicted and sentenced by a “competent court” in India and could not be tried for the same offence under Pakistani laws. Khwaja Sultan, the lawyer for Lakhvi, told PTI that Article 403 of the Code of Criminal Procedure and Article 13 of the Pakistani Constitution clearly stated that a person could not be tried twice for the same offence. He said these provisions would apply to Kasab, who is a Pakistani national. Article 403 of the CrPC states

The elite 1 ‘Strike’ Corps participated in the exercise named ‘Yodha Shakti’ that exhibited the resolve and the capability of the Indian Army to operate in most hostile weather conditions to achieve decisive victory for the nation, an Army spokesperson said in a press statement. The final phase of the exercise was witnessed by Army Chief General V K Singh along with South Western Army Commander Lt Gen C K S Sabu, and a large number of senior officers of the Army and Air Force. Army’s Southern and Western Commanders and Western Air Command and South Western Air Command chiefs too were present on the occasion. Iran hanged six convicted drug traffickers in a prison west of Tehran today, the semi-official Fars News Agency reported. Murder, adultery, rape, armed robbery, drug trafficking and apostasy are all punishable by death under Iranian Sharia law practised since the 1979 Islamic revolution. Amnesty International says Iran had the second highest number of executions in 2009 after China, adding that about a third of its 388 executions took place in eight weeks of turmoil following a disputed June presidential election. Those put to death on Saturday in the city of Karaj were sentenced for carrying and trafficking drugs including heroin and opium, Fars reported, citing the judiciary. One of the men, Abbas Gravand, was found guilty of possessing 386 grams of heroin. Another, Saeed Mikaeli, was sentenced for possessing and selling 422 grams of crack.

Forrmer military ruler Pervez Musharraf has unveiled his plans to return to active politics, saying he would contest the next general election in Pakistan whenever it is held. Musharraf, who has been living abroad for over a year, announced his future plans while addressing a gathering of his supporters in the Pakistani capital by teleconference. "I have decided to take part in Pakistan's politics and I will come forward in the next elections, irrespective of whether they are mid-term elections or end term elections.” "I will participate in them," he said in the brief address. The former President resigned in August 2008 to avoid impeachment by the Pakistan People's Party-led government. A raft of civil and criminal cases were filed against him in courts across the country after the Supreme Court declared the emergency imposed by Musharraf in 2007 as unconstitutional and illegal. A confident-looking Musharraf said he was determined to return to Pakistan as he had received a lot of support from Pakistanis living abroad during his recent travels to various countries. "The Pakistanis I have met abroad have told me I should return to the country," he said. However, he was guarded about his plans for the future, saying: "My views on taking Pakistan towards progress will be revealed at an appropriate time.

Kasab verdict won’t derail talks with India: Qureshi PTI ISLAMABAD, MAY 8

The death sentence handed down to Pakistani national Ajmal Kasab by an Indian court for his role in the Mumbai terror attacks will not affect the proposed talks between the Foreign Ministers of the two countries. Pakistan's Foreign Minister Shah Mahmood Qureshi made this remarks yesterday while talking to state-run PTV. Pakistan will give its response on the sentencing of Kasab after experts review the detailed judgement, he said. The Indian court's decision will not affect forthcoming talks between the two Foreign Ministers, he said. Qureshi added that he would soon fix the date for a meeting with his Indian counterpart S M Krishna. He described the Mumbai attacks as a "very tragic incident" that should not have happened. Pakistan too is a victim of terrorism and those who lost their loved ones in terrorist assaults in the country can "feel the pain of people who suffered in the Mumbai attacks," he said. A total of 166 people, includ-

ing Indians and other nationals, were killed in the Mumbai carnage and that was why the whole world concentrated its attention on this incident, he said. Qureshi acknowledged that there has been mistrust between Pakistan and India for the past six decades but said there is now a need to go forward to resolve outstanding issues. Pakistan Prime Minister Yousuf Raza Gilani and his Indian counterpart Manmohan Singh agreed to resume the stalled peace process between their countries during a meeting on the sidelines of the SAARC summit in Bhutan. The premiers directed the Foreign Ministers to draw up measures to bridge the trust deficit between the two countries and to work out modalities for the resumption of dialogue. Referring to the proposed resumption of dialogue with India, Qureshi said both countries have agreed to talk and he will contact his Indian counterpart for a meeting in this regard as soon as possible. Sri Lanka's detained former army chief and MP Sarath Fonseka has said that he would move a breach of privilege motion against army officers, who barred him from attending parliament session earlier this week. "I was to participate as a Parliamentarian for the emergency regulation's debate. According to the article 67 of the constitution and under the Parliamentary privileges act, I am entitled to this right," Fonseka told Parliament yesterday. "However, some army officers obstructed me from attending Parliament on May 5. Therefore, I request you to take steps to bring the those officers before the committee on Parliamentary privileges and to take remedial action against the injustice done to me as a Parliamentarian," he said. Earlier, despite questions raised by the ruling bench, Deputy speaker Priyankara Jayaratne permitted Gen Fonseka to go ahead with his statement saying that it had been agreed upon at the party leaders' meeting. Raising a question of privilege, Fonseka told the House that he could not participate even in the vote on the extension of the state of emergency as a result. Nepal's former Maoist rebels have suspended a general strike that had choked daily life in the impoverished Himalayan nation for the past week, but are maintaining pressure on the prime minister to resign. The Maoists were under enormous public pressure to call off the strike that hit ordinary Nepalis badly and halted the supply of essential goods, including fuel and medicines, for six days without breaking the deadlock with the government. Experts say the Maoists, who control 40 per cent of seats in the 601-seat parliament, had been trying to apply pressure tactics to return to power a year after quitting in a row with the president. Transport, businesses and schools had come to a standstill as the Maoists demanded Prime Minister Madhav Kumar Nepal quit to clear the way for a unity government headed by the Maoists. Today in pictures, we only look at her traditional beauty as she sits amidst her adorable sons tending to them while simultaneously involved in numerous chores. How many of us even spare a thought to the immense hardships and loneliness she must have endured in a forest as she fulfilled the toughest job on earth – motherhood? For Sita, it went further as she was both mom and dad to her kids. All this after being banished for no fault of hers! Yet, what excellent men her sons turned out to be. Take a look at our virgin Mother Mary. Madonna with child is probably the one picture that tugs at any heart. The love and protection that radiates from the beautiful Mother Mary is an epitome of motherhood. She reared Lord Jesus into the incomparable persona that he turned out to be. And during days, when women were looked down even more than today! And this loving mother had to live through every parent’s nightmare – death of one’s child. Move on to prophet Muhammad and your eyes get moist when you learn that he lost his father even before birth and his mother soon after. So the prophet was brought up by his grandfather and later on by his uncle. This incidence in history way back then, is evidence to the fact that to mother someone, you don’t have to be only woman. Men can nurture as well if not better than women. In fact, the unfortunate trend today is that women are losing this nurturing quality that they are blessed with. We have more maids looking after children than the mothers themselves. While urban women are engrossed in carving out a status for themselves as they go about their socialising and partying, children are left to the maids. Obviously, children start trusting the maids more and develop the mother-child bond with them. Even breastfeeding is virtually disappearing from our so called urban independent women. Yes, it is a personal prerogative but women need to first think of the needs of a helpless baby in arms. Ironically, these very women to pop a bottle into a baby’s mouth, would cry hoarse that the female genitalia is naturally created in a manner to ensure that women get as much pleasure as a man while in the act. Yes, no arguments! But then, even breast milk in naturally produced to feed a baby. Women like Mother Mary and Sita, nurtured and cared for their children beyond what words can describe. They possessed virtues that we crave to see in women today. Psychologists opine that there are many factors that lead present day women to detour from the nurturing and caring that they are blessed with. Perhaps it is the very system itself that condemns a woman. From movie flicks to advertisements to books, India is one country that glorifies motherhood. Yet, it is in this very country that a woman is ‘doomed’ once she embarks on the journey of motherhood. Let’s dwell on one job: that of an air hostess. Mothers are employed in all foreign airlines. Another notorious condition is, ‘No stretch marks!’ Excuse me gentlemen, you couldn’t have been sitting in your chairs, if your mothers cared about stretch marks or being reed thin. Yes, it takes two to pleasurably make a baby, but it definitely takes only one to painfully deliver that baby into this world. A mother forgets herself in constantly, selflessly and patiently catering to the needs of the children, family and workplace, and yet radiates from within, something that most countries abroad have capitalised on, but unfortunately something that all the airlines and many more professional streams in our country are missing.

BY RUSSEL D’COSTA HERALD FEATURES he Chicalim Panchayat Ground came alive as ‘Sobit Amchem Goem’ - the Festival of Goan Music, Dance and Drama commenced this Thursday. Organised by the Chicalim Youth Club and held to encourage creativity amongst the youth, the Festival was a huge success. It not only witnessed the participation of the young but also members of the older generation and both participants and audience were having a joyous time. May 8 saw the participants battle for the inter-ward dance competition title. This was followed by a series of entertainment including a ‘fugdi’ performance and a tabla-harmonium recital. There was also a Konkani musical show presented by Merceline de Betim and his troupe and a Khell ‘tiatr’ as well. Today, the last day of the event should not be missed as the festival has special programmes lined up. These include a one-act play, Goan folk dance performances, vegetable carving and a series of talent contests like dancing, elocution, Konkani singing, etc. A fire show by Damodar Phadte and live music by bands, India and Heaven Touch will precede the much loved game of housie, snowball and wholesome Goan snacks and sweets. Plenty of stalls selling jewellery, handicrafts, toys, etc, dot the ground.

Organised by the recently elected Managing Committee, the camp was held in association with Goa Medical College. 50 donors made their way to the camp in order to donate blood, which is required in case of emergency. Gaurish Dhond, a member of the committee, said, “This is the first blood donation camp held by the newly elected managing committee. We have also given towels and sweets to Provadia, an old age home in Chimbel. The next major blood donation camp will be held on July 24, 2010. o one can forget the days of yore; every Hollywood movie watched… The music was absolutely marvellous. The tunes became part of our lives ever since. The songs from the movies really had great melody. There was something in them that really made them enjoyable. Unfortunately, as time passed by, not much was heard of these songs. ‘Unforgettable Movie Selections’ has those unforgettable collections put into four CDs. The songs are all instrumental and performed by an orchestra. The orchestra 101 Strings has now become a brand name. They produce theme albums like maybe about a singer or song-writer or some relevant theme dug out from the past. What is most impressive in albums by the 101 Strings is the sound quality. The string section always holds a prominent part in the orchestration of the music. The album has the most popular ‘I Love Paris’ from the movie Can-Can. There is also ‘Breakfast at Tiffany’s’ from the movie Moonriver, ‘Theme from James Bond (Dr No)’, ‘Theme from the Third Man’, ‘As Time Goes By’ from the movie Casablanca, ‘Love is a Many-Splendored Thing’ from the movie of the same name and ‘Someday My Prince will Come’ from Disney’s first

fully animated film Snow White and the Seven Dwarfs. There are also tracks from Wizard of Oz, Gone with the Wind, Girl Crazy (Embraceable You), Les Portes de La Nuit (Autumn Leaves) and others. There is definitely a different charm to listen to the tracks in this album. Though the album is completely instrumental, the choice of songs and the arrangements of the music keep you always interested in the music. It does bring in a sense of nostalgia and being instrumental, it has a relaxing effect on the musical soul. It is surely a good buy and has all the ingredients of making for some incredible listening moments. The attractive packing is also full of promise and makes you look up to it as one album that can make your day tranquil and delightful.

Oil India rally to hold Sesa FA AGENCIES BANGALORE, MAY 8

Oil India came from a goal down to hold Sesa Football Academy 2-2 in an ONGC 2nd I-Division League final round match at KSFA stadium, here on Saturday. It was Sesa Football Academy who took the lead on both the occasions but squandered a great opportunity to register their first win in the final round. After two back-to-back defeats, a win was on top of the cards for Sesa to be in the hunt for the qualifying but once again it was inconsistency that let them down.

Israil Gurung drew first blood in the 24th minute as Sesa went for the breather with a 1-0 precarious lead. After the changeover, the pendulum swung in favour of the Oilmen who levelled the terms through Manas Manjit Chetia in the 69th minute. Sesa once again struck in the 80th minute through Inacio Colaco, but there joy was shortlived as Manas scored the all-important equaliser six minutes later. Handed a sound thrashing by Australia in their opening Super Eight match, India will have to quickly sort out their batting woes as they take on the West Indies in a do-or-die contest in the Twenty20 World Cup at the Kensington Oval here tomorrow. Like the Indians, West Indies are also faced with a must-win situation, as another defeat would virtually put them out of contention for a place in the semi-finals. Fortunately for Mahendra Singh Dhoni's men, the islanders do not have a lethal pace battery like the Australians. So the element of pace and bounce will not impact the Indian batsmen who had surrendered meekly to the Aussies' pace quartet. Modi hands over IPL documents to BCCI PTI MUMBAI, MAY 8

Suspended IPL Commissioner Lalit Modi today handed over to the BCCI all the relevant documents relating to the T20 League demanded by Cricket Board, sources close to him said. The documents, both original as well as notarised copies, included all franchisee agreements, global media rights agreements, global media rights packages, all bid documents, media rights licensee agreements, eligibility letters of all bidders with details and all sponsorship agreements entered into by IPL, the sources said. The documents were handed over to BCCI CAO Professor Ratnakar Shetty by Modi's lawyer Mehmood M Abdi, the sources added.
