WHY VOTE FOR HILLARY? Hilbert Morales EL OBSERVADOR Some 94 days remain before General Election Day, November8, 2016. Given the large number of issues facing this nation, it would be prudent to not wait to begin to prepare to make decisions. Who will it be: Hillary or Donald?

First, let me tell you why I will not vote for Donald J. Trump: Simply stated, Trump is not presidential material.

His mouth is a loose cannon, he is a verbal bully who has never served his country as an elected official or in any of its several military forces. His IRS income tax information is not disclosed (allegedly it is being audited by the IRS).

Trump has gone bankrupt several times leaving small businesses & contractors unpaid. Trump is easily baited.

Who would want him to be Commander In Chief (CIC) with any decision authority over American military capability, especially its nuclear ballistic missiles! In addition, too many of his statements need 'explanations' or 'reversal apologies' afterwards. Trump has no control over his mouth.

That tells us all that his brain is hardwired to that of 'salesmen come-backs'. He inherited his wealth which gives him a huge advantage in his real estate deals. Finally, Trump has no prior public service as an elected official, no foreign affairs experience.

And the Republicans were the obstructionists which prevented any negotiations leading to compromises resulting in any legislation which could be signed into becoming the 'law of the land' by the President. Republicans offered no programs which addressed any pressing need of the American people

except for three: 1) The conservatives kept supporting the Pentagon, 2) kept finding ways for the ultra-wealthy to avoid paying their fair share of taxes resulting in having the burden of supporting the federal government fall upon the middle class, and 3) kept neglecting the use of the legislative process required to do the 'greatest good for the greatest number'.

Trump's acceptance speech, delivered at the close of the Republican National Convention, was a downer.

“I can provide the solutions which will make America great again.” I project that a future Trump Administration would create 'Global Dark Ages' because all decisions would be based upon 'the bottom line', or 'profits before community stewardship'.

On the other hand, Hillary Clinton has 25 years of public service during which she has addressed the issues being faced by ordinary citizens today. At this point the only negatives about Hillary is the attitude of “I do not trust her” by many Americans. This is an attitude based upon propaganda initiated some two years ago by Republican strategists. Both the 'email issue' and that 'Benghazi' incident have not provided evidence of criminal neglect.

The outcome is always the same: Hillary admits having a private server was a mistake and she will not do that again, and the U.S. Congress directly interviewed her for 10 hours without uncovering anything already 'in the record'. So Hillary Clinton has a public service record 25 years long with nothing that can be exploited by her Republican adversaries.

Unlike Trump, Hillary has served as an elected official:

She was elected to the U.S. Senate replacing the distinguished N.Y. Senator Patrick Moynihan.

During the recent Primary election process which ended June 7th, her competitor was Senator Bernie Sanders, an independent socialist. Bernie, the Socialist, focused upon several public policies which any socialist would address: Those matters which are of great impact to the lives of the Millennials (ages 1835): Access to opportunity, education, student loans/debt, affordable housing, a living wage, etc.

Bernie and Hillary both were concerned about the following public policy issues: The domestic economy... jobs, Equal pay for equal work performance, Access to education without ending up with student loan debt burdens, being able to renegotiate student loan debt to lower interest rates just like current home mortgage refinancing (did you know that student loan debt cannot use bankruptcy for relief?), the wealth discrepancy: The top 0.1% own as much as the bottom 90%, Access to affordable housing and comprehensive health care insurance (retaining the best parts of 2010 Affordable Health Care Act), addressing the neglected infrastructure (surface transportation, waterways & harbors, airports), Global Climate Changes, mitigating Wall Street financial abuses and power, foreign affair matters, Women's right to choose, LGBTQ matters, Community safety (violence, guns, etc), addressing terrorism, both domestic and jihadist, confirming judicial appointments to Supreme, Circuit, and District Courts.

The Democratic Party has a

history of being progressive, of taking care of all the residents of America.

The Democratic National Convention transparently displayed the democratic decision making process.

When the delegate vote count eliminated him, Bernie, as a gracious loser, made an evidence based decision to support Hillary. He asked 'Bernie's Troops' to do the same. There is no doubt that Bernie and Hillary met, conferred, negotiated and agreed to an approach which would enhance the possibility of having the Democrats retaining the White House (3rd term). Bernie's revolution had succeeded in some respects. The Democratic Party platform now included every public policy programs advocated for by “Bernie's troops”. Millions of concerned voters had contributed an average of $27 each to underwrite Bernie's campaign with no 'Dark Money' being accepted/included.

But the election of Hillary as America's first woman President is not enough, though historic. In order to have no gridlocked U.S. Congress, both Senate and House must have a Democratic super-majority.

A filibuster-proof majority ensures a productive legislative process having open debates, negotiations, compromises and evidence based decisions.

With Democratic Party control of the White House, Senate and House, much 'stonewalled' legislation may be addressed immediately. All the deferred legislation may now be addressed: IRS Tax Reform, Comprehensive Immigration, budget allocations, especially for deferred infrastructure programs, education, health care, affordable housing, monitoring of Wall Street, and establishment of 'sunset

schedules' for all corporate welfare entitlements as a start.

Hillary R. Clinton who brings experience, capability, and the right 'can-do' temperament will effectively be the Democratic Party standard bearer. Hillary asked all citizens concerned about “global climate change” to vote for her. If you are concerned about the impact of 'Dark Money' upon our democratic governance process, then together let's add an amendment to the U.S. Constitution which repeals that onerous “Citizens United Decision” of the U.S. Supreme Court. If you want to limit the influence of Wall Street and 'special interests', Hillary asks you to join her because together all of these issues may be resolved in a manner that does the greatest good for the greatest number.

The Democratic National Convention was adjourned on an uplifting challenge to all of us who will ensure that Democracy, supported by 'We the People' will prevail. So all registered voters, especially the Latino millennial youth, may participate by registering to vote and voting for the first woman elected President of the United States. You will become a stakeholder with the influence and responsibility to hold all elected official accountable and responsible based upon the facts and evidence, not the propagandized falsehoods.

SJSU REINSTATES MEN’S TRACK AND FIELD PROGRAM AND ANNOUNCES PLANS FOR NEW STADIUM San Jose State track and field was synonymous with Speed City & more

SAN JOSE, CA – San Jose State University announced on Tuesday August 2nd, that it will restore its men’s track and field program in 2018. The program is historically renowned for producing record-setting athletes devoted to the advancement of human rights.

In addition, SJSU will seek private funding for a new venue to house its men’s and women’s track and field programs.

President Mary Papazian and Athletics Director Gene Bleymaier delivered the news to a crowd of several hundred track and field alumni and families who returned to campus for the special occasion.

“In bringing back a once-storied athletics program known the world over and building a new track and field venue, we are welcoming home and reuniting with a group of Spartan legends who have left their mark in sports and society,” President Papazian said, “as well as providing needed support for our current and future student athletes.”

“This is an enormously proud day for all of us, a day to celebrate a storied past and look ahead to a bright future.”

Among those in attendance at the announcement ceremony were SJSU alumni Tommie Smith and John Carlos, who raised global consciousness for the struggle for racial and social equality in the United States when

they took a stand for human rights at the 1968 Olympics. Smith and Carlos—each of whom earned medals that year in the 200-meter dash—were heavily criticized for their courageous actions.

Also at the ceremony Monday were fellow alumni and track and field Olympians Lee Evans, John Powell and Ed Burke, as well as alumnus, former faculty member and world renowned sports sociologist Harry Edwards.

The men’s track and field program at SJSU officially will return 50 years after that landmark action by Smith and Carlos, which is memorialized by a sculpture commissioned by student leaders in 2005 and placed in the heart of the downtown San Jose campus.

Stadium Planned for Bud Winter Field Smith, Carlos and Evans were just three of many track and field athletes who trained at San Jose State and went on to earn so many Olympic medals and set so many NCAA and world records that San Jose State became known as “Speed City.” Their coach was the legendary Lloyd “Bud” Winter, who headed the SJSU men’s track and field program from 1941 to 1970.

Winter put his athletes through innovative drills on a portion of San Jose State’s athletics complex that came to bear his name. On Monday Papazian and Bleymaier announced

plans to build a $5 million track and field facility at Bud Winter Field. The project will be funded by the SJSU Student Union and private gifts specifically made for this purpose.

The stadium will be home to the men’s and women’s track and field programs (the women’s program began in 2014). In addition, the new track and field facility will serve the campus and the broader community.

Between 1941 and 1970, under the guidance of Coach Winter, 91 Spartans were ranked in the top 10 worldwide by Track and Field News, 27 were Olympians, and men’s track and field won the NCAA team title in 1969. Details are provided below.

Taking a Stand for Human Rights

“We began a women’s indoor and outdoor track and field program in 2014. We believe that 2018 is the right time to reinstate men’s track and field so we can commemorate and celebrate the achievements of San Jose State student athletes at the 1968 Olympics in Mexico City,” Athletics Director Gene Bleymaier said.

In the late 1960s, San Jose State became ground zero for the Olympic Project for Human Rights, a movement that called upon black athletes to boycott the 1968 Olympics in Mexico City. With school record-setting discus thrower Harry Edwards as its chief spokesperson, the project attracted international attention at a time when the civil rights movement was in full swing.

“San Jose State was renowned around the world for its track and field program. We want to build on that rich tradition and bring back the pride, visibility and prestige track and field garnered for SJSU. This is a golden opportunity to celebrate the historic 1968 Olympics and the 1969 NCAA Track and Field Championship that was won by San Jose State,” Bleymaier continued.

In the end, all nine SJSU track and field team members who qualified chose to compete in the 1968 Olympics. Three found other meaningful ways to express their views on equity and civil rights. Smith and Carlos left an indelible mark in the memories of many with their stand.

Evans struck a similar note by wearing a black beret on the awards podium after his gold medal performance in the 400-meter relay race.

Visionary in the Sport Perhaps less known is the fact that San Jose State’s Olympic track and field history began with a woman. While enrolled at what was then known as San Jose Teachers College, Margaret Jenkins participated in baseball, basketball, hockey, volleyball and tennis and was introduced to the javelin. After graduating in 1925, she trained for the Olympics and subsequently competed in the discus and shot put at the 1928 and 1932 games.

The Speed City era began with the arrival of Coach Bud Winter in 1941. Not only did he bring to San Jose State a host of innovative coaching techniques, but he also welcomed to his program the very best athletes―race, ethnicity and national origin notwithstanding.

As word of his success spread, Americans came from as close as Overfelt High School (Lee Evans) and as far as Harlem, N.Y., by way of East Texas State University (John Carlos). Others came to SJSU from abroad, and then went on to represent their countries in the Olympics, including Jimmy Omagbemi (Nigeria), Lloyd Murad (Venezuela) and Dennis Johnson (Jamaica).

All team members of the Speed City era came to SJSU to engage in the most rigorous and technical program of their time and trained hard to reach their full potential. Many returned home to become teachers, coaches and mentors, dedicating their lives to sharing what they learned at San Jose State.

For example, Dennis Johnson returned to Jamaica to found a coaching college. Today, he is known as “a godfather of Jamaican track.”

Due to the opportunities he and others have provided young athletes, the tiny island nation has produced a steady stream of top sprinters, including Usain Bolt, the fastest man in the world today.

Men’s track and field, wrestling, men’s cross country and women’s field hockey were discontinued in spring 1988. In a reallocation of resources, the university initiated a strength and conditioning program and a studentathlete support services unit based on surveys conducted with the student-athlete population.

Now, the 50,000 square foot store is ready to serve healthy and organic options to those who live and work around the area, as well as support local vendors in selling their products on their shelves.

Whole Foods is heartily invested in informing their customers on the products they are buying, and what can be found along their walls are simple to read rating systems that help consumers understand to what level a product is considered organic and sustainable. But not only does the store wish to inform and educate their consumers, they also work closely with their local vendors in obtaining these high level labels.

According to representatives, by working with the vendors and supporting them, Whole Foods has created a caring community between consumer and provider. Local products from business owners around the Bay Area are being sold along the aisles, providing in depth information about the products. This local outreach impacts homegrown infrastructure in a positive manner.

But what makes this location different from other locations? If you are in a hurry on your lunch break from cranking out some codes, the store provides you with a variety of options. The store provides two large salad bars along with self serve pizza slices. There is also the option of walking up to a kiosk to build your own burrito, pay and wait for your name to be called, hassle free. But if salads and burritos are not what you are craving, some sushi or a warm bowl of ramen perhaps can help you power through the rest of your day.

The greatest feature is their taproom, ready to serve up to 100 guests inside and out with their furniture constructed from trees directly cut down by the construction where the market now sits. With its high ceilings and brightness from the top to bottom windows, the tap room is ready to serve up to 16 different beers from local breweries and pub snacks to munch on. Clean Power Plan Saves CA Commercial Buildings $1.3 Billion Suzanne Potter California News Service LOS ANGELES - According to a recent study, commercial buildings in California could save $1.3 billion on electric bills by the year 2030 if they implement efficiency measures recommended in President Obama's Clean Power Plan.

The report from Georgia Tech's School of Public Policy said power bills in the Golden State could come down almost eight percent compared to costs if nothing is done. The findings were released one year after the president finalized the Clean Power Plan which the U.S. Supreme Court has placed on hold pending litigation.

A new study shows California buildings could save $1.3 billion in 2030 on power bills by helping the state comply with the Clean Power Plan.

Study author Dr. Marilyn Brown said that commercial buildings could save $11.3 billion nationally.

"By the year 2030, we estimate that bills for electricity could be reduced by 6.7 percent if states were to include energy efficiency

as a strong component of their compliance approach," Brown said.

And according to the study, California buildings could save $150 million - almost five percent - by 2030, by switching to more efficient technologies like air-source heat pumps.

Hilary Firestone with the City of Los Angeles said the city is working on a series of proposals to measure energy use in the commercial and residential sectors.

"Our plan is looking at all large, existing buildings in the city, both commercial and multifamily, to make sure they're monitoring their energy use by regular annual benchmarking," Firestone said, "and then performing energy audits and retrocommissioning to make sure that their systems are performing optimally."

LA MASA CRUDA ES PELIGROSA Y PODRÍA ENFERMARLO FDA

¿Le resulta difícil resistirse a devorar un trozo de masa cruda al hacer galletas? o ¿deja que sus hijos limpien con una cuchara el tazón donde ha preparado la masa? ¿Sus hijos usan masa cruda para hacer decoraciones o jugar a hacer “cerámica”? ¿Come en restaurantes familiares que les den masa cruda a sus hijos para que jueguen mientras esperan que les sirvan la comida?

Si ha respondido afirmativamente a alguna de estas preguntas, eso podría ser un problema.

Comer cualquier tipo de masa o pasta cruda — ya sea de pan, galletas, pizza o tortilla— podría hacer que usted y sus hijos enfermen, señala Jenny Scott, una asesora experta del Centro para la Seguridad Alimentaria y la Nutrición Aplicada de la FDA. Miguel Márquez Appointed COO For The County of Santa Clara

SANTA CLARA COUNTY

County Executive Jeffrey V. Smith , M.D., J.D., announced Monday the appointment of Miguel Márquez as Chief Operating Officer for the County of Santa Clara. Márquez brings more than 20 years of legal experience to the position, including service as an Associate Justice for the California Court of Appeal and as County Counsel for the County of Santa Clara. His appointment became effective immediately.

“Miguel is a true public servant who has dedicated most of his career to serving the community. His legal and financial experience have prepared him well for his new role as Chief Operating Officer,” Smith said. “I have no doubt that Miguel will provide guidance that is informed, trustworthy and dedicated to public service in our community.”

Before his appointment to judicial office in 2012 by Governor Edmund G. Brown, Márquez served as County Counsel for the County of Santa Clara. During his tenure as County Counsel, he oversaw a staff of 124 employees, including 61 attorneys and a budget of approximately $30 million.

As the County of Santa Clara’s chief legal advisor, Márquez partnered with the County Executive, all elected officials and County departments, as well as several school districts and other special districts to find creative legal solutions to implement Board of Supervisors policies and assist the County in fulfilling its mission.

“I am incredibly excited to begin this next chapter in my public service journey,” said Chief Operating Officer Miguel Márquez. “I am grateful for the opportunity I had to serve on the Court of Appeal and as County Counsel.

These positions, and others, have prepared me to take on the important challenges facing the County. I look forward to working closely with County Executive Jeff Smith in service to the residents of Santa Clara County.”

Prior to joining the County of Santa Clara, Márquez was the General Counsel for the San Francisco Unified School District, where he managed a multi-million dollar budget and was responsible for all legal matters, including the District’s child development centers and schools and programs run by the County Office of Education. In that role, he also worked extensively on many issues that face local government entities, including labor negotiations, employment, civil rights, land use, Brown Act, Public Records Act, First Amendment issues, facilities and construction, and general government and litigation. Márquez also has served as a Deputy

City Attorney for the City and County of San Francisco, where he provided legal services to the City’s Department of Elections and the Ethics Commission, and as a Deputy County Counsel in San Mateo County for nearly five years. He also worked in two private law firms – Cooley LLP and Remcho, Johansen & Purcell; and at KPMG Peat Marwick as a management consultant.

“Miguel’s 20 years of legal experience has demonstrated that he is a defender of legal quality and ensuring accountability in practice, which will serve him well in assisting with day-to-day operations of the County,” Smith continued.

Márquez earned a Juris Doctor degree from University of California, Berkeley, Boalt Hall School of Law, where he received the AmJur Award as the top student in Accounting and Finance. He also holds a Master’s in Public Policy from Harvard University, and a bachelor’s degree in Public Policy from Stanford University. He lives in the City of San José.

LEAGUE OF WOMEN VOTERS ENDORSES AFFORDABLE HOUSING

SANTA CLARA COUNTY The Leagues of Women Voters of Santa Clara County announced Monday August 1st that they are endorsing the County's Affordable Housing Bond measure that will appear before voters on the upcoming November ballot. The Council of the Leagues of Women Voters of Santa Clara County represents the Leagues of Cupertino/Sunnyvale, Los Altos/Mountain View, Palo Alto, San Jose/Santa Clara, and Southwest Santa Clara Valley.

"This measure is a significant step in addressing the most pressing issue facing thousands of residents across our County -- the lack of affordable housing options," said Roberta Hollimon, Chair of the County Council of the Leagues of Women Voters. "The League supports the affordable housing bond for its ability to drive immediate and long-term positive outcomes and benefits for many individuals and families of Santa Clara County, from our homeless communities to our working families."

Members of the League noted that the affordable housing measure supports a number of League positions. The League identified the bond as an important mechanism in addressing the homeless crisis in Santa Clara County, where the region is estimated to have the fourth largest homeless population of all major metropolitan areas in the nation.

"The affordable housing bond measure aligns with fundamental League positions, first and foremost supporting the basic human need that everyone should have access to a safe and affordable home," said Hollimon. "The

measure is consistent with our strong positions about clean air and climate change. By ensuring more affordable homes near job centers and transit, we will reduce traffic congestion and reduce polluting greenhouse gases."

The League commended the measure language for its inclusion of strict financial accounting and public review provisions: Annual audits are required and will be reviewed by an independent Citizens' Oversight Committee. Santa Clara County will work with private and non-profit housing construction companies to build the housing. They will also use portions of the funds for land acquisition to build the needed housing.

"We were pleased to see that the measure included unprecedented oversight and accountability mechanisms, as the League remains deeply committed to transparency and oversight in fiscal policy," said Hollimon.

The $950 million affordable housing bond measure will create safe, affordable homes for the county's community members, including homeless individuals, seniors, veterans, people with disabilities, and low-income and working families. If approved by 2/3 voters this November, the bond will provide $700 million for the creation of affordable housing for our most vulnerable communities, including supportive housing for the homeless; $100 million to create affordable housing for low-income families; and $150 million for affordable housing and programs for working families.

SACRAMENTO, Calif. - California has almost 400,000 miles of roads and a ton of truck traffic that together may soon become a source of renewable energy.

Gatto explains the sensors have small wires that connect to a battery on the side of the road that then can generate power for streetlights, or even a nearby factory.

When a truck rumbles down the road, it sends out powerful vibrations, and the state is set to test something called piezoelectric (PEA-zoe-electric) technology, that can convert that pressure into electricity.

Gatto sponsored a bill a few years ago to fund a piezoelectric project, but Gov. Jerry Brown vetoed it, saying it needed to go to the California Energy Commission first.

The California Energy Commission has been studying this idea for five years now, and just announced it is spending $7 million on a pilot project on Golden State roads.

Assemblyman Mike Gatto, a booster of the idea, says tiny sensors are embedded in the pavement that work like sonar, but in reverse.

"You shoot an electrical pulse into sonar, it can generate waves," he explains. "This is really the opposite. The cars and trucks drive over a road, there's a certain amount of

The sensors were first invented by an Israeli company and already are in use there, as well as in Japan and Italy.

OAKLAND, Calif. - On August 2nd 16,000 communities across the country took part in the 33rd annual National Night Out (https://natw. org), a program designed to foster relationships and understanding between police and the communities they serve. Organizers say the mission is particularly relevant in a year when high-profile police killings have been followed by targeted attacks on officers.

Matt Peskin is the national project coordinator with the National Association of Town Watch, which sponsors the events.

"Getting local law enforcement meeting with people under positive circumstances: no medical emergency, no fire, to traffic citation," he said.

"Just hanging out for a few hours, getting to know one another a little bit better and that goes a long way in terms of crime prevention and safety in neighborhoods."

There are hundreds of events planned in communities across California every year. San Jose saw a local chapter at Emma Prusch park on the Tuesday night.

A second, rival event called the Night Out for Safety and Liberation also took place in Oakland, Los Angeles, San Diego and Sacramento, plus 2 dozen other cities across the country. These gettogethers emphasize social issues rather than better policing. Azadeh Zohrabi, with the Ella Baker Center for Human Rights in Oakland, says cities spend too much on police and not enough on programs to combat things such as homelessness, drug abuse and mental health problems.

Roddy Scheer & Doug Moss EARTHTALK Traditionally, conservation biologists have relied on field observation and sample and statistical analysis to help them understand the dynamics behind species loss, but today genetics is taking on an increasingly important role in helping quantify the biodiversity around us and even save some threatened species.

According to researchers at King Saud University who reviewed various DNA analysis technologies used in wildlife conservation for the Saudi Journal of Biological Sciences, the newly emerging discipline of conservation genetics has proven instrumental in creating better management plans for so-called “genetically deteriorated” wildlife populations. “Accurate classification of these threatened species allows understanding of the species biology and identification of distinct populations that should be managed with utmost care.” They add that DNA analysis can be instrumental in preventing illegal hunting and poaching and “for more effective implementation of the laws for protection of the endangered species.”

Conservation genetics is particularly useful for clarifying whether a particular wildlife population needs special protection as a genetically distinct sub-species. According to Susan Haig of the U.S. Forest Service, conservationists are using DNA analysis to determine kinship lineage in selecting which individuals to reintroduce to a population for recovery. “DNA sequencing procedures ... allow for identification of parentage, more distant relatives, founders to new populations, unidentified individuals, population structure, effective population size, population-specific markers, etc.” reports Haig, adding that the result is more sophisticated information crucial to setting species recovery priorities.

One way genetics is being used is to help endangered African cheetahs. “The 10,000 that are left share 99 percent of their DNA between individuals,” reports biologist and blogger Christina Smyth, adding that the low genetic

diversity makes the cheetah population highly susceptible to disease and extinction. “By using genetic analysis to look at how closely related individual cheetahs are, cheetah breeding projects are able to breed selectively as an attempt to reintroduce genetic variation back into the population.”

Another favorite example of Smyth’s is how geneticists are helping estimate past population sizes of whales to help manage and conserve current populations. “They are using current levels of genetic diversity along with known mutation rates to look at what the whale population was like before whaling. So far their numbers have increased previous estimates by up to ten times! These numbers could completely change our thoughts and approaches to whale related conservation and management.”

The non-profit Revive and Restore is best known for its advocacy of so-called “de-extinction”— that is, bringing back extinct wildlife species and reintroducing them to the landscapes they used to call home—but also aims to provide “genetic assistance” to existing threatened wildlife species.

“Endangered species that have lost their crucial genetic diversity may be restored to reproductive health,” reports the group. “Those threatened by invasive diseases may be able to acquire genetic disease-resistance.” The group is hoping to apply what it learns from a pilot project restoring genetic diversity to an endangered population of black-footed ferrets to other species’ recovery efforts.

SPOUSE OR PARENT OF PERMANENT RESIDENTS CAN APPLY FOR PROVISIONAL WAIVER USCIS TO ALLOW APPLICANTS WHO ARE THE SPOUSE OR PARENT OF LAWFUL PERMANENT RESIDENTS TO APPLY FOR THE I-601A WAIVER

An undocumented immigrant who has been in the USA unlawfully, and who wants to apply for an immigrant visa in Mexico and a visa is currently available, may need a waiver to overcome any potential bar to admission due to unlawful presence. A waiver is essentially asking the US government for forgiveness for committing an immigration violation such as being unlawfully present in the USA for a certain period of time.

The Illegal Immigration and Reform and Immigrant Responsibility Act (IIRIRA) enacted in September 1996 provides that undocumented aliens who reside unlawfully in the United States for 180 days or more but less than a year after April 1, 1997, will be ineligible for an immigrant visa or adjustment of status for 3 years if they subsequently leave the USA and reenter legally or attempt to reenter legally. Undocumented aliens who have resided unlawfully in the United States for one year or longer after April 1, 1997, will be ineligible for an immigrant visa or adjustment of status for 10 years if they subsequently leave the USA and reenter legally or attempt to reenter legally.

Prior to March 4, 2013, undocumented aliens applying for an immigrant visa at the US consulate in Ciudad Juarez and who were subject to the 3- or 10-year bar because of their previous unlawful presence in the USA had to apply for a waiver known as the I-601 waiver to overcome the bar to admission. To make matters worse, the applicant could only apply for the waiver while in Mexico and not from the USA. Typically it would take about 6-12 months or longer for USCIS to render

a decision on the I-601 waiver application.

During this time the applicant had to remain outside the USA until the immigrant visa process, including the decision on the waiver, was completed which caused families severe hardship due to the long separation.

However, as of March 4, 2013, USCIS recognizing the need to maintain family unity, created a new rule allowing certain immigrant visa applicants, subject to the 3 or 10 year bar to apply for a waiver in the USA rather than in their home country to overcome the unlawful presence bar.

The waiver called the I-601A provisional unlawful presence waiver was a savior for those who wanted to apply for an immigrant visa in Mexico but didn’t want to deal with trying to get an I-601 waiver approved while having to wait outside the USA for several months especially not knowing whether the waiver would even be approved by USCIS. To be eligible to apply for the I-601A provisional waiver in the USA, the applicant had to show that (1) they are the spouse , adult child or parent of a U.S. citizen who can petition for the applicant and (2) the applicant has a U.S. citizen spouse or parent that would experience “extreme hardship” if the applicant is not allowed to remain in the United States.

On July 29, 2016, USCIS announced another new rule expanding the existing provisional waiver process to include individuals who are family members of either U.S. citizens or lawful permanent residents. This means that now applicants can apply for the I-601A waiver from here in the United States rather than in Mexico regardless of whether the

family petitioner is a US citizen or permanent resident and regardless of whether the family member who will suffer extreme hardship if the applicant is not allowed to remain in the USA is a US citizen or permanent resident. The new rule will become effective on August 29th, 2016.

The final rule also makes changes to current Form I-601A, Application for Provisional Unlawful Presence Waiver and which will also go into effect on August 29, 2016. Applicants should not submit a request for a provisional waiver under the expanded guidelines until the final rule takes effect on Aug. 29, 2016. If you do so before that date, USCIS may deny the application.

The I-601A provisional waiver only applies to unlawful presence issues. If an applicant needs a waiver for any other reason for example, a criminal conviction, then then I-601A provisional waiver will not apply.

Un artista Español que encontró las vibras de Jamaica Arturo Hilario El Observador

El Reggae y el Dancehall cruzaron de Jamaica y la diáspora alrededor de los 1960's, convirtiendo a generaciones a fans de el estilo de música mas conocido por artistas como Bob Marley.

Siguiendo los pasos de la legado de reggae y dancehall esta Elán Swan Fernández, un artista Español conocido por su nombre artístico, Swan Fyahbwoy o "El chico de fuego". Recientemente hablo sobre sus inicios y como con el poder de el internet y su pasión para triunfar en su carera en la música a podido lograr a capturar una gran mezcla de fans por todo el mundo. A partir del 29 de julio Fyahbwoy lanzó su álbum Tanto Por Ti, en todas las plataformas digitales y se prepara para su primer tour en los estado unidos.

Hola Swan. Puedes hablar un poco de donde vienes, un poco de tu historia?

Yo vengo de Madrid y empecé en la música escuchando música cuando era joven. Porque no existía internet, la única manera era los tapes, las cintas que la gente grababa. Escuchaba todo tipo de música y de joven toque la batería por bastantes años y ya desde muy chiquitillo me gustaba el reggae. Unos años después cuando era adolescente me prestaron unos CD’s de Clifton Capleton y allí es donde descubrí el dancehall y toda la música moderna jamaicana. Y desde entonces es lo que más he escuchado en mi vida, y (es) la cultura que sigo.

Porque el Reggae? Que fue la iniciación a este tipo de música?

No sabría decirte, simplemente el sonido del reggae me transmitió más, me llevó más allá y me llevó más adentro que otras música. Tanto el sonido como el mensaje, la vibra de la música reggae es algo que desde muy chiquito me dejó enganchado. Yo era adolescente cuando en España echaron un comercial de los jeans Levi’s que llevaba una canción de Shaggy, “Boombastic”, como el tema del comercial. Y yo en ese momento no sabía ni quién era Shaggy, (pero) quedé enganchado con ese sonido, esta era la música que yo quería escuchar. Y ya cuando consigue un CD de Capleton fue el momento en que realmente dije, ‘este es el sonido que yo llevaba tanto tiempo buscando’. Es la sensación que me provocaba esta música.

Que es lo que te gusta mas de crear música? Y algo que quizás es difícil de ser músico?

la canción. Toda esa magia que se forma en el estudio. Lo que menos me gusto siempre es el show. A mi, el live show siempre ha provocado muchos nervios. Pero de noche a mañana me tenia que subir a los escenarios entonces eso fue una presión para mi, y he tardado bastante tiempo en aprender a disfrutarlo. Hoy en día he aprendido a disfrutarlo, cuando hago shows para miles de personas todo el mundo canta las canciones, y la gente te da un apoyo tan grande que disfrutas cada una de esos momentos.

Como fue que encontraste tu base de fans? Como usaste el método de recaudación de fondos por internet de crowdfunding para cubrir costos de gira's y producir álbumes?

Efectivamente el internet fue realmente, yo siempre lo he dicho, mi discografía, mi label. Siempre fue por internet. Hice un perfil en los social networks de ese momento que era myspace y me cree un website. Eso fue lo que a mi me hizo ser un artista. Todos mis álbumes lanzados en Europa y lanzando en España los he hecho de crowdfunding. O sea yo soy artista totalmente independiente, todo el trabajo lo hice yo mismo con el apoyo de mis fans y bueno hasta hoy, gracias a National Records he podido dar un paso más allá y trabajar con una gente que son muy profesionales, y estoy muy contento. Hasta entonces el trabajo a sido muy duro, apoyado con el crowdfunding por el apoyo de todos mis fans, y bueno en España no hay apoyo mediático para el reggae o el hip hop, no hay apoyo en prensa, en radio ni en TV. Al final es gracias a las redes sociales y al website por lo que un artista de España puede llegar a ser (reconocido) por buena música reggae.

Habla de tu proyecto mas reciente, Todo Por Ti Esto es una compilación de los grandes éxitos de mi carrera, tanto de mis álbumes como singles y es una trayectoria por mi carrera creo que la gente que le da una chance a escuchar el álbum van a encontrar muchos estilos en las canciones y estilos diferentes. Es enfocado para disfrutar y pasarla bien. Pueden escuchar temas de dancehall, temas de reggae roots, temas sobre hip hop y pueden escuchar estilos muy diferentes. Gente me pregunta si en una canción cantan 2 o 3 diferentes personas y les digo que no, so yo únicamente.

Dale a los lectores una razón para escuchar tu música eclectica.

Yo creo que por un lado si tienen ganas de despertarse con música feliz y con una vibra positiva si tienes ganas de ir a fiesta si tienen ganas de mover la cabeza yo creo que pueden encontrar canciones para cualquier momento para cualquier estado de ánimo para cualquier mood, toda la gente que le quiera dar una chance ya está disponible tanto como en CD y en toda las plataformas digitales.

Pues a mi lo que más me gusta es, como dijiste, crear música. Lo que más me gusta de mi carrera es cerrarme en el estudio con el productor, escuchar el ritmo de que se está trabajando y escribir

Ishtar que se sintió humillada juró vengarse de él. A los pocos días Gilgamesh tuvo una <<pesadilla>> que le inquietaba, soñó que del cielo caía un monstruo con garras de león que le acechaba y le llenaba de miedo y también con dos estrellas que le caían encima, soñó el mundo subterráneo, un tesoro que desaparecía de entre sus manos y con el sol que al final iluminaba el horizonte.

Gilgamesh mandó a reunir a los magos más afamados y ofreció recompensa y fortunas enteras pero nadie pudo descifrar el mensaje de aquel sueño. Pronto supo que en el bosque alejado de la civilización vivía Eabani, un sabio único en su género quien tenía dos cuernos en la cabeza y la parte inferior de toro.

Cuando el héroe y el sabio se conocieron se hicieron los mejores amigos, entonces Eabani se dispuso a interpretar el sueño de Gilgamesh y le advirtió que una bestia terrible le atacaría, trance del cual iba a resultar victorioso pero

Gilgamesh comenzó a temerle a la muerte y sufría en demasía pues ya no inspiraba ningún sentimiento entre las féminas que antes le amaban. Un día decidió ir en busca de su antepasado Utnapishtim que por haberse salvado del diluvio había recibido el don de la inmortalidad. Emprendió entonces su camino pero antes tuvo que atravesar sitios infernales, desiertos totalmente oscuros y un mar en el que

Antes de partir Gilgamesh, Utnapishtim le dijo que en el fondo del mar había una hierba de espinas colosales que contenía el elixir de la eterna juventud. El héroe partió en busca de la planta, se amarró dos enormes piedras a los pies y se hundió en el mar encontrando finalmente aquella maravilla y aunque las espinas de la planta le desangraron las manos y los brazos no le importó; salió del mar e inició su camino nuevamente. Antes de volver a la ciudad Gilgamesh tomó un baño en una fuente, en aquel momento una serpiente llegó hasta la planta atraída por su potente aroma y se la llevó.

Gilgamesh no tuvo otra más que resignarse, perdió al mejor amigo de su vida y a un divino tesoro, mas había recuperado la salud y desde ese día prestó siempre gran atención a las visiones nocturnas y se convirtió él mismo en un acertado intérprete de sueños.sin importancia debido a malos entendidos. Le dedicarás más tiempo a hacer lo que te gusta y las presiones del trabajo serán cuestión del ayer. Juega a la lotería, tendrás chances de ganar.

RUSSIAN EMAIL HACKERS: ARE YOU NEXT? vulnerabilities. After all, they’re “known.” But sadly, not everyone is as diligent with system updates and security patches as they should be.

Then they will take a hard look at your online presence. You publish your life on Facebook, Twitter, Instagram, Tumblr, Snapchat, LinkedIn, blogs, etc. You probably don’t realize how much information you make available for anyone to gather and analyze. In truth, you (the employee) are the biggest security risk to your company, and you are by far the easiest to exploit. We’ll get to this in a minute.

Next, the hackers will use some tools from outside of your system, or get you to install some tools that put them inside your system to get to your information. At that point, it’s over. You’ve been hacked. So here are a few things you need to know.

Passwords Still Matter Shelly Palmer Experts are debating whether the Democratic National Committee’s (DNC) email system was hacked by the Russian military intelligence service (G.R.U.) or Guccifer 2.0, a lone wolf Romanian hacker. While this is a very important question, the answer will not change the results: over 20,000 DNC emails ended up on WikiLeaks. How did this happen? How likely is it to happen to you or your company? What can you do to protect your email system from a similar fate?

Are the Russians Going to Hack Your Email System?

The chances that the G.R.U. or some other Russian-based hackers will target your email system are not huge (unless you work for a big company or are relatively famous, in which case they are trying several times each day). That said, you are going to be hacked by someone, and it could happen at any time.

If you are targeted and attacked by a motivated, organized team of criminals, you will need a better-motivated, betterorganized team of anti-criminals to enable you to emerge from the battle unscathed.

It’s not like the movies where you see a stereotypical geek with a laptop tapping a few keys and accomplishing the task in a few minutes. An organized team of criminals will do a thorough job of reconnaissance. They will find out which operating systems you are running and what ports are open, and they will examine your subsystems and how they interconnect.

Next, the bad guys will check their favorite sources for known vulnerabilities. A quick Google search will result in dozens of sites that contain vulnerability disclosures along with the proof of concept code used to discover the vulnerability. For professionals, this is a fruitful path to travel, as it leads to strategies to exploit computer systems where servers are not properly patched or are sloppily configured. Well-maintained, up-to-date systems are safe from the usual tactics associated with exploiting known

Believe it or not, passwords still matter. It is pretty rare for a hacker to spend time trying to hack your password, but the tools are readily available. I won’t list them here because I’m not promoting the dark side, but just Google “email hacking tools” and you’ll understand. Your best defense against any of these tools is a password that is long, the longer the better; strong, the more cryptic the better; and unique, as in one password per system (never reuse a password). How good are your mobile passwords? iOS allows for six-digit alphanumeric passwords. Are you still using a four digit pin number? If you’re serious about security, long, strong, unique passwords are one of the best defenses you can mount.

Authentication also matters. You’ve heard of two-step authentication. You should use it? Does your login system lock after five attempts to login? How secure is your password recovery or password reset protocol? Does your computer lock after sitting idle for 60 seconds and require a password to regain access? Do you lock your computer every time you step away from your desk? This kind of stuff is inconvenient in the extreme, but all of it should be part of any cybersecurity initiative.

It’s Easier to Hack You than to Hack Your Computer Which brings me to the most common way to get awesome malware onto your computer or into your network: social engineering.

Known as Phishing (pronounced “fishing”), an email technique that tricks email recipients into performing specific behaviors, or Spear Phishing, a highly targeted version of Phishing that is customized for a small group, this type of social engineering exploits the weakest link in your cybersecurity chain – you! You’ve heard it before, but I’ll say it again. Unless you have asked for it or know the person who sent it (although this is no guarantee of safety), never, ever, under any circumstances click on a link in an unsolicited email. Just don’t do it. Phishing is now high art. The best templates are almost indistinguishable from the emails they are pretending to be. When in doubt, don’t click, because that one click would be all it takes to enable a hacker to put you into a world of hurt.

Encryption Remember when Apple CEO Tim Cook adamantly refused to discuss weakening the encryption system on iPhones? He was thinking of you. If you are serious about not seeing your emails on WikiLeaks in the future, then start encrypting them now. Fully encrypted email systems are a pain to use.

They can require an extra password, take extra time to deal with and add a layer of complexity to your life that you may not enjoy. However, when hackers get their hands on encrypted emails, those emails are unreadable and useless.

There are many places to learn about best practices email encryption. Google, Microsoft and almost every tech company that sells enterprise-grade solutions can help you.

If you’re just a normal person or a small business, there are excellent solutions like Virtru and ProtonMail that offer best practices solutions. A quick Internet search will yield products and reviews galore.

Classified Documents Which emails must always be encrypted? Which emails probably should be encrypted? And which emails don’t need to be encrypted? Stratifying communication into classified, semi-classified and unclassified is a common practice. But I’ll leave you with this thought: the hacked email that hit Sony the hardest contained no financial information, legal documents or personal health information – it was executive banter. The same can be said for the email that forced the chairwoman of the DNC to resign. So, I’ll ask you again: which emails should be encrypted?

Time to Rethink Email Communication You or your company may already have excellent cybersecurity measures in place. I hope you do. If you’re in doubt, now would be a great time to start asking about it and getting satisfying answers. After all, when you see your sensitive emails on WikiLeaks, you’re not going to care whether it was the G.R.U. or Guccifer 2.0 or the proverbial Red-Bull-drinking, chocolate-covered-coffee-bean-eating teenager with skills and an attitude who ruined your professional life. So let’s make it as hard for the hackers as we possibly can.

Are your kids ready for school? Don’t forget registration and immunization Believe it or not, another school year is almost here for more than 270,000 students in Santa Clara County’s 31 public school districts. While enrollment may have started as early as January, parents can enroll their child in school throughout the year — the earlier, the better.

School and district boundaries can sometimes be hard to locate. A first step may be to call your neighborhood school and see if they can assist you. Be sure to ask what choice options you have.

Another resource is the Santa Clara County Office of Education website.

On the “Resources for Families” page at www.sccoe.org, you will find links to every school district and to the School District Locator where you can type in a home address to see its school zone information.

Registration forms: Offered in multiple languages at most districts, these ask for basic student and parent/guardian information.

Documents you will need: Property tax bills, mortgage statements, lease or rental agreements, and utility and phone bills are items you can use to prove you reside within the required boundaries. Additional verification items may also be requested, and you will need your child’s identification information such as a birth or baptismal certificate, or passport.
