WITHOUT COMMUNICATION OF A ‘VISIONARY FUTURE’ THE PEOPLE WILL LANGUISH Hilbert Morales EL OBSERVADOR

S

omeone shared with me a quote by Simon Sinek, “Leadership is a way of thinking, a way of acting and, most importantly, a way of communicating.” The King James Bible states that, “Without (leaders communicating) a vison (of their future) the people will perish.” The featured speakers of last Friday’s La Raza Roundtable monthly meeting were Congresswoman Zoe Lofgren (Democrat; Congressional District 19) and San Jose City Council member Raul Peralez (SJ-District 3). After 26 years of service as an elected official, I projected that at this meeting Congress member Zoe Lofgren was going to endorse Raul Peralez as an appropriate 'replacement elected official' for Congressional District 19. Not so! Zoe is campaigning to be Congressional District 19's continuing re-elected official (first elected 1992). The D-19 constituents need to seriously consider the selection of her successor. Zoe Lofgren was able to communicate many actions undertaken which served D-19's constituency and the nation. The most important Congressional legislation needed by the Latinx community did not occur. While many individuals who were undocumented were assisted, the reality remains that the very essential “Comprehensive Immigration Reform Act 2019” was not debated nor enacted. Zoe's previous profession involved working in immigration law.

The Congressional District 19 constituents, especially its Latinx cohort, needs to understand that too many American employers are benefitting from the 11.5 million undocumented (of which an estimated 5.5 million are Latinx) will never be given some form of legal status. That will never be enacted because that skilled labor pool can be employed at substandard wage levels which provides low labor costs for those who employ (and exploit) those undocumented individuals. Keep in mind that undocumented skilled labor has no legal status anywhere in America. Their skills may be exploited at salary/wage levels which do not conform with the usual and customary wage/ salary levels. Nor does this undocumented cohort have any way to benefit from union collective bargaining authority and powers. This cohort does not possess that union authority at all. Those who benefit are in a position to continue to fund Congressional lobbyists at just the right levels to thwart any U.S. Congressional enactment of legislation which, at the minimum, would establish some level of legal status. That will not happen during the current Republican Trump Administration. Is this an opportunity for someone, preferably, a Latinx to challenge the re-election of Zoe Lofgren? Yes, it does exist. And understand that every elected member of the U.S. Congress somehow becomes a millionaire as an outcome of the lobbyists who represent their special interests. Meanwhile, this Latinx community continues to be 'kept in its place, on its knees'. It was Emiliano Zapata who declared that It is better

to die standing on one's feet and putting up a righteous struggle for equity and prosperity, than to live a life groveling on one's knees compliantly and subserviently. The times call for change because the Latinx millennial youth's future best interests are not being promoted by the current status quo. And, understand that the Latinx registered voters exist in sufficient numbers to support this 'change in leadership'. First, they must decide to register to vote, learn about public policy issues which impact their lives; and then vote in their own best interests. Furthermore, understand that several qualified Latinx elected officials already exist. The collective vote of local Latinx individuals coupled with supportive Anglo-liberals would suffice to elect a new replacement member of the U.S. Congress representing District 19. I project that individual will become the next millionaire member of the U.S. Congress within his/her first 2 years of service as an elected official. It would be good to have this new U.S. Congress person come from the local Latinx community. One behavioral habit of Latinx individuals must be set to one side, that is to not focus on the deficiencies of nominated Latinx’s; but rather focus on the many points of supportive agreements, values, and principals. Just think of the advantages of being represented by 'one of our own' rather than a liberal progressive Anglo-Saxon. A prepared candidate is probably already a youthful millennial Latinx. Your

vote may change the current status quo which has existed unchanged during the past 33 years I have monitored local political issues. I project that the youthful Latinx registered voter is more likely to vote in his/her best interests and not be swayed by local unions and established stakeholders. But this transition of authority, power, and influence will not happen without some effort (which will not require a huge political budget because of available capability to communicate using Facebook, YouTube, and other social media networks. The Democratic process (one person: one vote) permits peaceful transition of power, authority and influence. To be successful, grassroots efforts are required and are best organized now. Phone the Registrar of Voters office for consultation regarding schedules and deadlines (first examine the Registrar of Voters, County of Sana Clara website). Count on EO's supportive actions but be willing to ask your supporters to donate $20 per person to El Observador Foundation, Inc. (used to train reporters, investigative reporters, writers, and journalists). All funds received since 1986 have been re-invested in our community in a variety of ways and for a variety of purposes. Raul Peralez, San Jose City Council member, District 3, reported that he had watched the City of San Jose annual budget process now for two cycles and realized that the Mayor and City Manager negotiated the majority of adjustments. The City Council only dealt with a 'few million dollars' of budgetary decisions while the entire budget of the City of San Jose totaled some $6.7 billion per year. Peralez is concerned about equity. Are available tax revenues

ACRAMENTO, Calif. – Uber and Lyft drivers and their allies in the labor movement are urging Gov. Gavin Newsom to sign a bill – AB 5 – passed Wednesday September 11, that reclassifies tens of thousands of contract workers as employees. The measure could give the employees access to minimum wage guarantees, unemployment insurance and worker's compensation. Edan Alva, a Lyft driver and activist with the group Gig Workers Rising, says right now the multi-billion dollar companies' business model depends on the constant availability of drivers, but workers make nothing while they're waiting for a gig. "That is just Lyft and Uber directly benefiting from non-paid labor of drivers,” he stresses. “In order to resolve it, they need to pay for the time when people are waiting for the rides." The law sets up a test whereby companies will

Uber's CEO said Wednesday he will press that claim and refuses to reclassify contract workers as employees. Companies also are planning a ballot measure next year that would gut AB 5. Alva says the next step would be to form a driver's union to argue for things such as better coverage in case of a traffic accident on the job. "I suspect that Lyft and Uber will do everything they can to prevent fair conditions from drivers still,” he states. “And therefore, we are adamant in our pursuit of the ability to organize to negotiate with Lyft and Uber and prevent them continuing to step all over us." Right now gig workers are still considered contractors under federal employment rules. So in order to have the right to form a union, the California State Legislature would need to pass a bill next year giving the workers explicit permission to do so.

Burns, 34, led the Sharks in scoring last season with 83 points (16 goals, 67 assists), marking the first time a Sharks defenseman has reached the 80-point threshold and the most points by a defenseman since Brian Leetch's 85-point season in 1995-96. He led NHL defensemen in assists and points last year and ranked sixth in goals. Burns achieved his 1,000th career NHL game on Dec. 27, 2018 vs. Anaheim and set a franchise-best nine-game point streak by a blueliner. Burns is entering his 16th NHL season and ninth with the Sharks.

AN JOSE, CA - San Jose Sharks Head Coach Peter DeBoer announced September 12 that Logan Couture has been named the tenth captain in Sharks franchise history. Along with Couture, Brent Burns, Tomas Hertl, Erik Karlsson and Joe Thornton will each serve as alternate captains. "Since I arrived in San Jose four seasons ago, we have been blessed with a tremendous amount of leadership on our roster," said DeBoer. "Logan has grown up within that environment and evolved into someone who not only plays his best hockey when it matters the most, but who also leads by example off the ice. He knows what it takes to win and his performance in our recent playoff runs reflects that. Most importantly, Logan has the respect of his teammates and we're extremely proud to name him as the tenth captain of the San Jose Sharks." Couture, 30, enters his 11th season as a member of the Sharks after being selected in the first round (9th overall) by San Jose in the 2007 NHL Draft. The centerman registered a career-best 70 points (27 goals, 43 assists) last season, finishing second on the team in assists and third in points. In the 2019 Stanley Cup Playoffs, Couture led all skaters in goals with 14, despite playing six fewer games than the second and third place finishers. He also completed the playoff run with 20 points, compiling 101 career playoff points over the first ten years of his career, which ranks fourth among skaters since the 2010 postseason. His 48 goals in that span are second-most among NHL skaters, two behind Alex Ovechkin of the Washington Capitals.

FARM ’ T E K E R S MA R Couture has skated in 663 career games for San Jose, compiling 507 points (240 goals, 267 assists) and ranks fourth in goals and points, fifth in assists, and sixth in games played on the franchise's all-time list. Over the course of his career, the six-foot-one, 200-pound center was named to the NHL All-Rookie Team in 2010-11 after scoring 32 goals and finished second in the Calder Trophy ballot. He also represented San Jose in the 2012 All-Star game and is a two-time Sharks Player of the Year (2011-12; 2017-18). Couture served as captain of the Ottawa 67's in his final season in the Ontario Hockey League (2008-09). "We have a great blend of talent and experience among these four players who will support Logan as alternate captains," said DeBoer. "Two of these players are previous captains themselves and we feel this group is a reflection of our team's identity and their leadership will be counted on both on the ice and in the community."

Hertl, 25, set career highs in goals (35), assists (39) and points (74) in 2018-19 and finished second among Sharks skaters in goals and points. Hertl reached the 30goal threshold for the first time in his career, being one of four Sharks to register at least 30 goals last season. He also became the second Shark in franchise history to collect two hat-tricks in a single calendar month, scoring three goals on Jan. 15, 2019 vs. Pittsburgh and Jan. 22, 2019 against the Washington Capitals in a come-frombehind 7-6 overtime win.

Karlsson, 29, enters his second season with San Jose. He appeared in 53 games, recording 45 points (three goals, 45 assists) and ranked second among Sharks skaters in assists and was ninth (tied) in assists among NHL blueliners. Karlsson became the fifth defenseman in NHL history to record at least one assist in 14 consecutive appearances and his eight-game assist streak from Dec. 7-22, 2018 was one shy of the Sharks franchise record. Thornton, 40, enters his 22nd season in the National Hockey League and 15th as a member of the Sharks. After missing nine of the first 11 games in 2018-19, Thornton skated in the final 71 contests and compiled 51 points (16 goals, 35 assists) with a pluseight rating. Thornton climbed the NHL record books through the campaign, and completed the season eighth on the NHL's all-time assist list, 12th on the all-time games played list and 14th on the all-time points list, passing several Hall-of-Famers including Nicklas Lidstrom, Gordie Howe, Mario Lemieux, Steve Yzerman, Marcel Dionne, Teemu Selanne and Stan Mikita. Thornton also became the seventh player in NHL history to score 400 goals, collect 1,000 assists and skate in 1,500 NHL games after scoring the game-winning goal on Nov. 13, 2018 vs. Nashville. More than 100 Americans die every day from overdoses involving opioids, and millions are addicted to opioids. The Remove the Risk campaign from the U.S. Food and Drug Administration (FDA) provides easy-to-follow steps that any adult can take to immediately remove unused prescription opioids from their homes and help save lives. What is a prescription opioid? Prescription opioids are powerful pain-reducing medicines; they include oxycodone, hydrocodone, morphine, and others. Doctors prescribe opioids after surgeries and for injuries; however, these medicines can have serious risks if they are accidentally or intentionally misused. Why is opioid disposal important for you and your family? Many people who misuse prescription opioids say that they got them from a friend or relative. Your friends or casual visitors may seek opioids and find your unused medicines in your cabinets or drawers. Curious kids and teens may explore medicines in your home and accidentally or intentionally take them. Research shows that even child-resistant containers cannot prevent a child from taking medicines not meant for them. Prevent potential misuse by removing unused opioids from your home, especially if children or teens live with or visit you.

Medicine take-back options are the preferred way to dispose of most types of unneeded medicines safely, including opioids. Authorized locations may be in retail pharmacies, hospital or clinic pharmacies, and law enforcement facilities. Some authorized collection sites may also offer mail-back programs or "drop-boxes" to help people safely dispose of their unused medicines. 2. If not, is the medicine on the FDA "flush list"? The FDA flush list tells you which medicines you should flush when they are no longer needed. Medicines on this flush list may be especially harmful and, in some cases, fatal with just one dose if they are used by someone other than the person for whom they were prescribed. 3. Can you throw it away in household trash? would be replacing old buses with new, more efficient all-electric models. But few school districts can justify the $300,000 price tag to replace perfectly functional older diesel buses. That didn’t stop the school district in White Plains, New York, though, which purchased five electric buses last year with financial help from the local utility, Consolidated Edison, and a grant from the state.

N

ow that school is back in session, those big yellow diesel-fueled school buses are all over the roads again. While they’re relatively safe—and definitely old school—they’re also big polluters, chugging along at 4-6 miles to the gallon while creating a cloud of harmful airborne pollutants. According to the non-profit Clean Air Trust (CAT), some 25 million American kids travelling on half a million school buses every day are exposed to five to 15 times more air toxins than the rest of us. “Those buses travel more than four billion miles each year and these kids spend three billion hours on [them],” reports the group. “About 90 percent of these buses run on diesel fuel, annually emitting 3,000 tons of cancer-causing soot and 95,000 tons of smog-causing compounds.” If you don’t think all that pollution is having a negative effect, think again. A March 2019 study from researchers at Georgia State University found that students did significantly better on standardized English tests and marginally better in math when they spent their commutes riding in school buses retrofitted to reduce emissions by 95 percent as compared to students riding in non-upgraded buses. The

researchers conclude that “engine retrofits can have meaningful and cost-effective impacts on health and cognitive functioning.” Luckily the retrofits are easy to come by and relatively inexpensive, especially when you factor in the costs of health care to treat sick kids, not to mention the price tag for raising kids’ test scores in other ways. Retrofitting 10 percent of the average school district’s bus fleet in Georgia, for instance, would cost less than $100,000, a drop in the bucket of the state’s

$10.6 billion K-12 public schools budget. And beginning in October 2018, the U.S. Environmental Protection Agency (EPA) set aside $9 million to help pay for upgrading older diesel school buses nationwide. School districts and other public agencies charged with transporting school kids can apply for rebates of up to $20,000 per bus to help cover the retrofits on up to 10 individual buses. Retrofitting is a great start, but even better

These outside contributions helped bring the final cost to the school district down to something along the lines of buying new diesel buses. While ConEd gets the benefit of good public relations and good karma, it also gets to use the buses during the summer as excess electricity storage that can be moved around to where it’s needed most (when the air conditioners are blazing). White Plains is hoping other school districts across the country will follow a similar model to clean up their acts. NEW UCLA STUDY – STATE MAKES PROGRESS ON GOAL TO GUARANTEE WATER AS A HUMAN RIGHT

2012, California became the first state in the country to declare that “Every human being has the right to safe, clean, affordable and accessible water” when the state legislature inserted that statement into its state water code. Now, a new UCLA study (https://tinyuri.com/UCLAProp1study) finds, the state may be making progress on turning that goal into a reality. “From the start, the challenge was to meet the needs of some one million Californians who lacked access to clean, safe, reliable drinking water,” says Jon Christensen, the author of the study. “Their tap water was -- and largely remains -- contaminated by nitrates from agricultural pollution, perchlorate from industrial pollution and other toxics such as arsenic. “Small, rural community water systems reliant on groundwater and lacking a connection to a water treatment plant are particularly at risk,” he adds. But then came Prop. 1 in 2014. As drought conditions ravaged the state, voters surpassed the required two-thirds majority threshold to approve a $7.1 billion water bond measure, which included special provisions to earmark funds for the

most water-challenged communities. The measure did not arrive without criticisms, such as that it was fiscally irresponsible and favored interests such as corporate farmers over communities that most needed help. But in August of 2014, when the state legislature voted to include Prop. 1 on the Nov. 4 ballot, only two members of the state Assembly opposed it, and it was unanimously approved by the state Senate. A new study by the UCLA Institute of the Environment and Sustainability on Prop. 1 concludes the state “is meeting or exceeding the explicit goals for funding improvements in disadvantaged communities.” Those are defined as ones where the annual median household income is less than $49,181, which is 80% of the statewide median household income of $61,488. Forty-two percent of California families fit that description, and a third of the state’s population lives in communities where more than half of the households are in that lower economic bracket. “When you prioritize equity, funding does go to the disadvantaged communities that most need it,” Christensen says. Many of these areas, he added,

that funding lacks specific guidelines about who it is intended to help.

By way of example, the study notes, 31% of the $2.5 billion allocated assigned to projects so far -- $793 million – has gone to projects serving disadvantaged communities.

The state needs to be more cognizant of the fact that not all communities are the same in their ability to access state funding procedures, the report states.

Where the mandate of prioritizing the most waterchallenged communities was not included in the state’s spending choices, it is often unclear how much disadvantaged communities and households benefited, the study found. Of $395 million for flood management, for example, less than 1% was addressed to communities in need. Nor have they benefited from the allocation of $2.7 billion for water storage projects. But those projects do serve some 23 million Californians, including many disadvantaged households, and 750,000 acres of agriculture. The report recommends better clarity in the future about whom any state project is intended to benefit. And it encourages more emphasis on “technical assistance” – training, guidance and hands-on help in preparing plans and grant applications. Larger cities and communities can support staff specifically skilled in environmental planning, compiling grant proposals and the like, and thus can arrive sooner and better prepared when spending decisions are being made.
