l fallo en la Corte de Apelaciones del Noveno Circuito no pudo ser más inoportuno. En momentos que Estados Unidos celebra el Mes de la Herencia Hispana, un panel del tribunal determinó que la administración del presidente Donald Trump puede poner en marcha los procesos de deportación contra 300,000 inmigrantes procedentes de El Salvador, Nicaragua, Haití y Sudán beneficiarios del Programa de Protección Temporal (TPS). En una decisión dividida 2-1, los magistrados encontraron que si bien el presidente Trump expresó “ánimo racial” contra inmigrantes no-blancos y no-europeos, y que la Casa Blanca influyó en las decisiones para terminar el programa, no existe evidencia de que el ánimo presidencial haya motivado la terminación del TPS o que los funcionarios involucrados en el proceso de toma de decisiones hayan estado prejuiciados por ánimo racial. “Aun cuando no condonamos la naturaleza ofensiva y despectiva de las declaraciones del presidente, determinamos que estas declaraciones ocurrieron principalmente en contextos que no estaban relacionados con la política o las decisiones sobre el TPS”, de acuerdo con el dictamen final suscrito por la magistrada Consuelo Callahan, designada por George W. Iniciado en la década de 1990, el programa TPS fue establecido por el congreso para ofrecer protección temporal a inmigrantes de países latinoamericanos y africanos que corrían el riesgo de regresar a sus países debido primordialmente a desastres naturales o conflictos armados. Bajo el TPS, los inmigrantes procedentes de El Salvador, Honduras, Nicaragua, Haití, Liberia, Nepal, Somalia, Siria, Sudán y Yemen pueden obtener permisos laborales legales en los Estados Unidos y aislarse de las deportaciones, pero el programa no ofrece una ruta especial para la legalización de sus beneficiarios. he ruling in the Ninth Circuit Court of Appeals could not have been more inopportune. As the United States celebrates Hispanic Heritage Month, a court panel determined that the administration of President Donald Trump can launch deportation proceedings against 300,000 immigrants from El Salvador, Nicaragua, Haiti and Sudan who are beneficiaries of the Temporary Protection (TPS). In a 2-1 split decision, justices found that while President Trump did express animus against non-white and non-European immigrants, and that the White House influenced decisions to terminate the program, there is no evidence
In contrast, Justice Morgan Christen considered that the president's "degrading" comments, descriptions of living conditions in those countries, as well as allusions to people rather than places, suggest that racial mood may have affected the decision of his administration starting the termination of the program. Initiated in the 1990s, the TPS program was established by Congress to offer temporary protection to immigrants from Latin American and African countries who were at risk of returning to their countries primarily due to natural disasters or armed conflict. Under TPS, immigrants from El Salvador, Honduras, Nicaragua, Haiti, Liberia, Nepal, Somalia, Syria, Sudan, and Yemen can obtain legal work permits in the United States and be protected from deportations, but the program does not offer a specialized route for the legalization of its beneficiaries. Since its inception, the program had been renewed by successive US governments. The administration of President Donald Trump made the decision to begin the process of terminating the program on the grounds that the conditions that justify the continuation of the program no longer exist in the countries of origin of the beneficiaries. A group of TPS recipients decided to sue the Trump administration alleging that the administrative procedures law was violated and that the president's racial views influenced the decision to terminate the program. Initially, a judge preliminarily stopped the end of the program. But the appellate court panel reactivated the process that opens the door to deportations starting in January. It is foreseeable that the outcome of the case will take place in the Supreme Court of Justice, since the plaintiffs have several legal resources. But there is a faster and more humane solution. Tens of thousands of those “deportable” immigrants are now essential Hispanic workers. What better way for the Trump administration to celebrate Hispanic Heritage Month than by reversing its decision to end TPS and giving those vital immigrants the peace and quiet they deserve. ientras que casi la totalidad de los veteranos en California se opone a la Proposición 21, los impulsores de esa propuesta pagaron a un actor que fingiera ser veterano, con el fin de engañar a los electores. En respuesta, los veteranos pidieron a los fiscales de California, Xavier Becerra, de San Diego, Summer Stephan, y de Los Angeles, Jackie Lacey que investiguen la campaña a favor de la Proposición 21 por violación a la “Ley de Valor Robado”. La violación consiste en que un actor, que no es militar, se hace pasar por un héroe de guerra en un anuncio político para conseguir un beneficio económico. En San Diego presentó la queja el propio autor de la Ley de Valor Robado, el ex asambleísta Rocky Chávez, veterano del Cuerpo de Marines de los Estados Unidos y ex subsecretario del Departamento de Asuntos de Veteranos de California. En su denuncia, Chávez advierte que “los miembros de las organizaciones de veteranos que se oponen a la Proposición 21 son verdaderos veteranos del ejército de los Estados Unidos, que sirvieron a nuestro país con gran sacrificio”, no son actores pagados. Dijo que al mentir con un veterano falso, la campaña de Sí a la Proposición 21 “insulta a quienes realmente sirvieron al país y comete fraude contra los votantes”. he COVID-19 pandemic has largely decimated the arts scene in California, wiping out local theater companies, many of which offer a cultural lifeline to their communities. “Theater is a place where people see themselves, hearing words they can relate to. We can talk about their issues, talk about their dreams, and give them some sort of cultural relationship to the world,” said Jose Luis Valenzuela, artistic director of the Los Angeles Theater Center, at a Sept. 11 briefing organized by Ethnic Media Services. Even before shelter-in-place orders were mandated across the state, many live performance venues had already curtailed their calendar of events, mindful of community spread in enclosed spaces which did not allow for social distancing. Museums have also been shuttered since early March and speaking and literary engagements have also been canceled. Nationwide, the arts sector lost about 12 billion in revenue. Los Angeles County — home to the most vibrant arts scene in the country with more than 200 museums and art galleries, 300 theaters, and hundreds of live music venues — has suffered a $20 million loss in arts revenue over the past six months, said Kristin Sakoda, director of the Los Angeles County Department of Arts and Culture, at the EMS briefing. 50 percent of arts organizations in the county are worried they will not survive the pandemic, she said, noting that many have had to furlough or lay off staff. Even before the pandemic, most arts organizations were under-capitalized, said Sakoda. “A lot of community-based organizations or smaller budget organizations that really reflect and serve communities of color often don't have the same access to donors or to large amounts of capital.” “We can't turn away from art. We need the Arts to be part of recovery efforts,” said Sakoda, pointing to studies that showed correlations between cultural resources in communities and better public safety, education, and health outcomes. The Los Angeles County Department of Arts and Culture is using $10 million of CARES Act funds to distribute as grants to small and mid-size arts
Wong has adapted, in the manner of many arts venues, moving her show online from her home. “You know I could have had today's rally on tour in Hawaii or New England where I was supposed to actually be this week, but I was like, you know what? No, thanks. Give me an audience that’s curled up in bed, or sitting upright at their desk at home, putting their kids in the other room during a global pandemic, because they are the audience now,” she joked. Being able to monetize the show has been difficult: Wong is facing the challenges many arts venues are struggling with as they move their content to a digital format. Some have had success with virtual donation buckets, while others are offering a series subscription, with added perks for subscribers. The comedian received a small Paycheck Protection Program loan via the Small Business Administration, which has allowed her to stay afloat, and amass an army of volunteer seamstresses who sew face masks for low-income communities. Valenzuela of the Los Angeles Theater Company, said PPP loans and other small, emergency grants, will not allow him to keep his theater company afloat. “I’ve got a $10,000 a month lighting bill at LATC,” he said, noting that he has received only one grant worth $22,000. Valenzuela has 14 staff members. “We will have to let them go,” he said, noting the current lack of work and the uncertainty of when the company will be able to perform again. “Many of the small theater companies will not survive this crisis,” said Valenzuela. The LATC has been performing for 35 years. It is one of four Latinx theater companies in a region where more than half the population is Hispanic. When the pandemic began, Valenzuela was working on a play about immigration. Graphic designer Roberto Pozos is working with the newly-formed Equity and Justice Coalition to highlight the impact of the pandemic in Calexico, which is in Imperial County, one of the hardest hit regions in California. At the height of the pandemic, 23 percent of residents — almost one in four — had tested positive for COVID. Pozos is organizing a virtual show featuring the work of volunteer artists which will run from Sept. 28 to Oct. 2. Works of all sorts, including posters and poetry can be submitted via a website. Pozos said he is encouraging anyone with a connection to the Imperial Valley to submit their work. The exhibit will kick off with a poetry night on Sept. 24. “Here is an opportunity for us as artists to say Imperial Valley is resilient. We've been through a lot. We all have disparities. But we will prevail, we will come out of this, and we want to give people that hope,” said Pozos. Spanish story on page 10.

ASHVILLE, Tenn. -- The federal government has quietly changed a policy that could make it easier for some residents to sign up for health insurance. Previously, workers had only 60 days after losing their job-based health coverage to sign up for marketplace plans on healthcare.gov. Cheryl Fish-Parcham, director of access initiatives at Families USA, said now, anyone who lost coverage this year can check to see if they qualify for special enrollment. She added the Trump administration hasn't given an explanation for the change, but it's most likely related to the pandemic. "I think at this point we are, more than anything, just grateful that it has finally opened," Fish-Parcham said. "Because between February and May, 5.4 million Americans lost their job-based coverage and became uninsured."

ACIFICA, Calif. -- Despite partyline disagreements, Congress is expected to take up a new stimulus bill to rescue the COVID-battered economy, and groups fighting climate change say environmental policy should be part of it. They're urging lawmakers to support job creation by funding projects to cut pollution, protect the ocean, and move the nation away from fossil fuels. Jean Flemma, director of the Ocean Defense Initiative, said the pandemic response can serve as an opening for progress. "This is an opportunity to begin the transition to a clean energy economy that will provide jobs, protect communities and tackle the climate crisis, while correcting inequities linked to environmental injustices and health disparities," Flemma said. The goal is get to net-zero emissions by 2050 in order to keep global warming under 1.5 degrees Fahrenheit.

Groups that fight climate change say the extreme drought, heat and wildfires are symptoms of a bigger problem. Kathy Dervin, co-chair of the state legislative committee with the nonprofit 350 Bay Area, said global warming is a public health emergency that demands rapid and transformative solutions.

ACRAMENTO, Calif. -- The child-care crunch in California is real, and advocates for families are pressing the state to make quality a priority, in addition to quantity.
There are huge waiting lists for state-subsidized child care. Statistics show fewer than 15% of income-eligible families actually find a slot. And fewer than half of all three-yearolds in the state have access to a quality preschool. Lempert said the master plan needs to provide a road map to achieve equity, because families of color are particularly hard hit by the lack of affordable child care.
This fall, Gov. Gavin Newsom is set to release a long-awaited master plan for quality early care and education.
"Some kids are getting that kind of highquality care and early education," Lempert said. "Most kids aren't. That plan really needs to address not just the availability, but also the quality of child care and preschool."
Ted Lempert, president of Children Now, said a poll commissioned by the nonprofit advocacy group confirms parents are having hard time finding and paying for adequate care.
The poll found parents are most concerned with finding a child-care option that has a low child-to-adult ratio and skilled caregivers who are trained to foster children's emotional well-being.

“Julie and the Phantoms” is a new Netflix show which asks the question, “Could I start a band with some basement ghosts?”
¿Y cómo fue trabajar con el elenco, pero específicamente con Kenny Ortega, que es conocido por muchos proyectos de baile y películas con música?
The show focuses on Julie (Played by Madison Reyes), a 15-year-old who has lost her love for music after her mother Rose has passed away. Julie’s father, Ray (Carlos Ponce) is a professional photographer who is also grieving the loss of Rose and is tasked with guiding his family through life without their loving mother and wife. Queue the moment when Julie is cleaning out some items from her mother’s old recording studio and she awakens three spirits who were teen boys in a rock band in the 1990’s. The phantoms are less frightening and more dreamier to Julie, and they help her bring back that passion for music and songwriting by forming a band: Julie and the Phantoms.

Recently I was able to chat about the show with the Julie’s show-father, Carlos Ponce, the famed Puerto Rican actor, composer and singer, who gave a firsthand look at “Julie and the Phantoms” backstory and what it was like creating a musical television series with legendary filmmaker and choreographer Kenny Ortega.
we figured it out, and I said, "Maybe he will choose me!"
Thank you very much Carlos. To begin, I wanted to know if you could tell me a little about the story of this series?
He knows what the audience thinks and the need we have for love. But those projects do not [always] work because they are so difficult to create. He has an exceptional ability to know how to do them, so that they have a good impact on the part of the public.
It's a story about a girl, Julie. She is my daughter, I am a widower - Ray Molina - and they are trying to cope with the loss of my wife, of the girl's mother. He has a younger brother. Music moved that family a lot and the musician in that house was the mother, who is no longer with us. Then the girl, it’s as if she loses her charm, loses her light, she even loses her taste for music, as if she almost blames music for the [passing of her mother]. And at some point, when they are working, when they are selling the house to start a new life from scratch, three ghosts appear in the garage of the house when the girl is picking up or moving the things of the mother. Well, the [ghosts] were in that garage 25 years ago to rehearse with their band. But hey, they never auditioned for 25 years. They died 25 years ago and immediately woke up 25 years later with the girl. This story is very [beautiful] because they are the ones who give her back her spark and her life and help her from that deep hole that she is falling into. Can you tell me a little about what is the inspiration for your character of Ray and what he is like in the series? Well, Ray Molina is dad who is [still] learning. He shared responsibility with the mother, and he is learning skills which his wife oversaw, such as in the kitchen, the children and school, things at home. So now he has to juggle his life as a photographer and his work with these tasks a bit and obviously he stumbles because at the beginning he still doesn't really know how things are and he has a sister-inlaw who arrives and it helps him sometimes, especially with the youngest of his children. And what was it like working with the cast, specifically with Kenny Ortega who is known for many music and movie projects? Thank God I have had a friendship with Kenny for many years. I met him when he hired a group of music producers, including myself, of Emilio Estefan, of whom we composed songs for his label. And [Kenny] flew us to Las Vegas to pitch for a musical he was designing or restructuring – a pirate ship hotel and all that stuff. We have kept in communication for many years and encountered each other, and we have always played around with the idea that one day we would work with each other. But when I auditioned for this series, neither I knew who I was auditioning for, nor he knew that I was auditioning for the series. It was not the second, as I understand it, or the third callback as they call it, that
So, it was a good reunion for you two? Yes, it was a nice, a nice meeting and apart from the guy being a great guy, he is a discoverer of stars, he has shown it time and time again.
With that in mind, since you also come from the world of music, what would you say about the music in “Julie and the Phantoms”? The music is great. One of the most impressive things that has happened, aside from the show debuting on Netflix in the top 10, the nation's mostwatched show to debut, is that eight tracks from the show debuted in the US top 40 on iTunes and that’s including second and third place. First place was Lady Gaga, and [Julie and the Phantoms] took second and third place. And they even knocked down Hamilton from its position. So, we are incredibly happy with that musical achievement. What were some memorable moments during filming this that you remember? Look, when you are doing dramas there is a different kind of energy on set. There, as an actor, one has to put in certain characters and enter some places in your head that are not very comfortable. When one is doing dance, guitar, percussion, or piano musicals. obviously, the personal environment and energy is completely different. So, every day we were on a set listening to good music, being creative, writing. The muse in you is triggered. When I would leave the set, I would put myself in the camper and instead of starting to do other things, like I would do during any other project, I wrote. It's a good atmosphere, good music. I wanted to know why you would recommend “Julie and the Phantoms”? Especially since it is a family show and many of us are at home? Well, imagine that you are at home, locked up with all your children, your grandfather, and picture this image where there is a child on the phone in some corner. The other on his iPad, the other on the TV, one in a room. And here is a program where, thank God, the whole family, the baby, the tween, the teen, the grandfather, the father, the mother, can sit and watch a series together. A series that is fun for all ages, that is going to entertain everyone. And although it touches on issues that are important, generational issues and today's issues, they are touched on in a subtle but conscious way. And it is very pleasant to be able to watch a program with the whole family. “Julie and the Phantoms” is streaming now on Netflix.

Ahí uno tiene como actor que meter en ciertos personajes y entrar dentro de unos sitios en tu cabeza que no son muy cómodos. Cuando uno está haciendo musicales de baile, de guitarra, percusión o piano. Obviamente el ambiente personal y la energía es completamente diferente. Entonces todos los días estábamos en un set escuchando buena música, siendo creativos, escribiendo. La musa se dispara porque ya cuando uno salía de ahí me metía yo en el campero y en vez de ponerme a hacer otras cosas, mejor lo haría en cualquier otro proyecto, escribía. Es un buen ambiente, buena música. Quería saber ahora que porque amos estado en estos tiempos de cuarentena, ¿por qué podía recomendar “Julie and the Phantoms”? Bueno, pues imagínate que estás en tu casa, encerrado con todos tus hijos, el abuelo y el escenario es casi donde hay un niño, en el teléfono en una esquina. El otro en su iPad, el otro en el televisor, uno en un cuarto. Y aquí tienes un programa donde gracias a dios se puede sentar la familia entera, el bebé, el tween, el teen, el abuelo, el papá, la mamá, y ver una serie juntos. Una serie que está divertida para todas las edades, que todo el mundo se va a entretener. Y aunque toca temas que son importantes, temas de generacionales y temas de hoy del día, se tocan de una manera sutil pero consciente. La Medida H promulgaría una ordenanza que enmendaría el Código Municipal de San José para aumentar la tasa del actual impuesto sobre las mesas de naipes, añadir un nuevo impuesto sobre los ingresos brutos de las Fuentes de Financiación que se define para incluir a los terceros proveedores de servicios de jugadores de proposición (“TPPPS”), y aumentar el número de mesas de naipes en la Ciudad. Un TPPPS, bajo contrato con una sala de juego de naipes, banquea los juegos ofrecidos y puede cubrir el pago de las apuestas, ya que las salas de juego de naipes están prohibidas por la ley de California de banquear los juegos. El aumento del impuesto a las salas de juego de naipes y el nuevo impuesto sobre los ingresos brutos de las fuentes de financiación son impuestos generales, lo que significa que los ingresos fiscales pueden utilizarse para cualquier propósito general del gobierno. La ordenanza propuesta modifica el capítulo 4.77 para aumentar la tasa del impuesto sobre los ingresos brutos de las salas de juego de naipes del 15 % al 16.5 %. El impuesto sobre las mesas de naipes no se aplica a los ingresos brutos anuales totales iguales o inferiores a $10,000. También añade un nuevo impuesto sobre los ingresos brutos de las fuentes de financiación a una de las siguientes tasas: Ingresos brutos anuales totales hasta la tasa de $25,000,000—5 %; Ingresos brutos anuales totales $25,000,001-$30,000,000—7.5 %; Ingresos brutos anuales totales por encima de la tasa de $30,000,000—10 %. Por ejemplo, los ingresos brutos anuales totales de una Fuente de Financiación de $35,000,000 serían gravados a una tasa del 10 % sobre la totalidad de los $35,000,000. El impuesto adeudado sería de $3,500,000. El 1 de julio de 2021 o antes, una Fuente de Financiación presentará al Director una declaración escrita en la que expondrá el total de ingresos brutos anuales estimados para el año fiscal. Los ingresos brutos anuales totales estimados para el cálculo del impuesto de propiedad para cada año fiscal subsiguiente, serán los ingresos brutos anuales totales reales para el año fiscal anterior. Sin embargo, si el importe del impuesto en propiedad basado en los ingresos brutos anuales totales reales durante el ejercicio fiscal aplicable supera el importe del impuesto pagado, la fuente de financiación pagará la diferencia al Director. Si el impuesto poseído es menor que la cantidad del impuesto pagado, la fuente de financiación será acreditada por la Ciudad una suma igual a la diferencia aplicada al impuesto adeudado para el siguiente año fiscal. Las nuevas fuentes de financiación presentarán una estimación de los ingresos brutos dentro de los 30 días siguientes al comienzo de los negocios en la Ciudad. Los juegos de azar en la Ciudad están sujetos a la ley del Estado y al Código Municipal de la Ciudad. Bajo el Capítulo 16.04 del Código, la expansión de los juegos de azar en la Ciudad, como se define, requiere la aprobación de los votantes. La ordenanza propuesta enmienda el Título 16 para aumentar el número total de mesas permitidas en la Ciudad de 98 a 128, con el número total de mesas permitidas en cada sala de juego de naipes para aumentar de 49 a 64. Si el aumento en el límite de mesas en cada sala de naipes es aprobado por los votantes, entonces cada sala de naipes podría solicitar la aprobación de la Ciudad para aumentar el número de mesas de 49 a 64. Actualmente, bajo el Capítulo 4.77 y el Título 16, la Ciudad tiene el derecho de auditar las salas de juego de naipes y bajo el Título 16, las salas de juego de naipes y las fuentes de financiación están sujetas a la supervisión de la Ciudad. La ordenanza propuesta no hace ningún cambio a estas disposiciones de auditoría y supervisión. El ayuntamiento retiene la autoridad para enmendar o para abrogar las provisiones en el Título 16 para revisar las regulaciones del control del juego de la Ciudad. Si aprobado, el aumento de la tasa del impuesto de la sala de juego y el nuevo impuesto sobre las fuentes de financiación sería efectivo el 1 de enero de 2021 y continuaría hasta que revocado por los votantes o suspendido en su totalidad o en parte por el ayuntamiento. Esta medida propone enmendar la Carta de la Ciudad ampliando la autoridad del Auditor Independiente de la Policía (“IPA”), cambiando el tamaño y la composición de la Comisión de Planificación y permitiendo al Consejo establecer diferentes plazos para la redistribución de distritos si los resultados del censo se retrasan. La medida G modificará las obligaciones del IPA en virtud de la Carta para añadir la autoridad de examinar las investigaciones administrativas revisar las investigaciones administrativas iniciadas por el Departamento de Policía contra los agentes de policía; permitir que el IPA revise los registros policiales no redactados relacionados con los tiroteos en que hayan participado agentes y los incidentes de uso de la fuerza que hayan provocado la muerte o grandes lesiones corporales, incluso sin denuncia, y revisar los registros policiales redactados si se cumplen determinados criterios, a fin de formular recomendaciones al Departamento de Policía sobre políticas y procedimientos; y concertar contratos coherentes con la Carta y la autorización del Consejo. Además, la Medida G permitiría al Consejo de la Ciudad asignar otras tareas al IPA consistentes con el Estatuto, sujetas a cualquier requisito para cumplir y conferir con la organización de empleados reconocida para oficiales de policía incluyendo cualquier procedimiento de estancamiento. La Medida G también enmendará el Estatuto para aumentar la Comisión de Planificación a 11 miembros con un miembro designado por el Consejo de cada distrito del Consejo y un miembro en general.
