CONSTITUTIONAL CHECKS & BALANCES DO WORK!

Hilbert Morales EL OBSERVADOR

C

onstitutional checks and balances have been appropriately invoked by Congressmember Nancy Pelosi, (Democrat-S.F., CA) Speaker of the House of Representatives. The news continues to uncover the breadth and scope of Trump and his Administration’s corruption and disdain for the rule of law based upon this nation's U.S. Constitution. Our Constitution includes checks and balances for a reason. Now is the time to uphold those tenets. Our democracy is worth it. That’s why each resident of these United States of America needs to become acquainted with it. Individuals have the right of redress in this nation. Not only may an individual be held accountable and responsible, but each elected official, especially the President, is obligated

to behave in keeping with its ideals. The consequence of those collective actions is that America achieves a very high level of integrity, safety and security. As a people, we need to demand that Trump be held responsible and accountable for the outcomes resulting from the use of inflammatory and pejorative words. Sadly, no matter what new event and decision details emerge, Republicans continue to remain silent and stoic. That complicity is damaging this country. Standing up and fighting corruption is the right thing to do. Whistleblowers have their niche in calling attention to inappropriate actions being implemented. Nonetheless, Republicans are shirking their duties and end up positioned on the wrong side of history. Republicans won’t do the right thing, so each of us must collectively do the right thing which is to support the House of Representatives as its Democrat Speaker, Nancy Pelosi, works to expose the facts and truths which will expose and end Trump’s

corruption once and for all.

The impeachment of any President is a serious matter not to be pursued lightly or frivolously.

Checks and Balances are very important in the practice of democratic governance. Do not let up on your participation and the vigilance required to sustain and maintain our Democratic form of governance.

It is essential that ordinary citizens (and undocumented residents) understand and support what is going on now because this action establishes the security and safety each resident craves and merits. Freedom, as an American ideal requires it. As a people, we must not let up. We must push back to achieve and sustain the ideals embodied in the American Constitution. If we do not push back as one of the checks and balances of this Democracy, Donald J. Trump will become an absolute despotic power. Nothing corrupts a leader as much as absolute power, which ends up corrupting absolutely. The consequences are already established. Just read the history of Nazi Germany, Fascist Italy and Imperial Japan of the WW II era (19381946). And today similar governance power exists in China, Syria, Turkey, and

Here are a few examples of the effectiveness of checks and balances: The CA Attorney General is engaged in 60 lawsuits against the Trump Administration. Each lawsuit has been joined by additional attorney generals of other states. “Our Constitution includes checks and balances for a reason. Now is the time to uphold those tenets. Our democracy is worth it. That’s why I’m personally asking you to speak up when necessary. Join me: Sign your name and demand that Trump be held accountable. Sadly, no matter what new details emerge, Republicans continue to stand by Trump. It’s a disgrace to our Constitution and to our country.

Standing up and fighting corruption is the right thing to do, but Hilbert, Republicans are shirking their duties and standing on the wrong side of history. Republicans won’t do the right thing, so I’m counting on you to do the right thing now. Support House Democrats as they work to expose the truth and end Trump’s corruption once and for all. I wouldn’t be asking for your supportive actions if our Democracy did not need it in order to be sustained and maintained.” 18 Democratic AGs are suing to stop Trump. 18 Democratic AGs are suing to stop Trump from GUTTING the Endangered Species Act, which saved bald eagles and other precious wildlife from extinction.

ACRAMENTO, Calif. - Teachers are speaking out in favor of a bill that would grant them and other classified employees six weeks of paid time off for pregnancy, miscarriage, childbirth and recovery. Many of these educators have to use their sick time because they don't pay into the state disability insurance fund, and thus don't benefit from it. Charity Berg Garcia, a second-grade teacher in Watsonville, says the first few weeks of bonding

with a newborn is crucial. "If we're educating kids to make them productive members of society, we also need to be able to invest in our own children and not neglect them," she states. Opponents of the bill say it could cost the state tens of millions of dollars. Gov. Gavin Newsom has supported extending maternity leave in the private sector as part of his pro-parents agenda, so supporters are hopeful that he will approve this bill before the signing deadline this Sunday. Katie Serbian, a counselor and professor with the San Diego Community College District, says the current policy is part of the reason for the state's teacher shortage. "That affects the quality of people that are going to be attracted to the profession," she states. "The ability to retain quality teachers will be affected by this pretty abysmal maternity leave policy." Natalie Bennetts, a middle school teacher from Morgan Hill, says a lot of women try to time their child's birth for the summer but it's not foolproof. She says many new mothers use up all their paid leave for the baby and then can't afford to stay home if they don't feel well. "Coming back to work absolutely exhausted, you're going to bring home a bunch of illnesses being around a classroom of sick kids," she states. "And your kids are going to get sick. And to have that burden of having to show up for work every day - sick or not - is really, really difficult." This year, Assembly Bill 500 received near unanimous bipartisan support in the state Legislature. Assembly member Lorena Gonzalez, D-San Diego, introduced the bill at the behest of the California Federation of Teachers. Former Gov. Jerry Brown vetoed a similar bill last year, saying the issue should be addressed through collective bargaining.

okyo - Sony plans to launch its next-generation video game console, the PlayStation 5, by the end of 2020, the head of the videogame division of Japanese technology company Jim Ryan announced on October 9. The CEO and president of Sony Interactive Entertainment (SIE) confirmed through his official blog that the new platform will be called PlayStation 5 and will hit the market at Christmas next year, in addition to revealing other technical details of the new device. Among the outstanding attributes of the new console, he pointed out his

aspiration to "deepen the feeling of immersion" in the game, something that will be achieved through the control of the PlayStation 5, according to the head of the Sony subsidiary with Headquarters in California (USA). Ryan said that the successor control of DualShock 4 will have a touch technology that will allow "a much wider range" of sensations for the player, as well as "adaptive triggers" that will offer different degrees of resistance depending on the pressure exerted on them. The CEO of Sony Interactive Entertainment confirmed some of the characteristics of the expected new game console that had

advanced in an interview published Tuesday by the American magazine Wired. Sony announced earlier this year that it was working on the new game console, and last May its president and CEO, Kenichiro Yoshida, said in Tokyo that the platform will offer a "total immersion" and "uninterrupted" gaming experience, based in a "dramatically superior" graphic potential. The company, absent last June from the Electronic Entertainment Expo (E3), had not revealed so far the name of its new generation console or its date of Market release.

ACRAMENTO, Calif. - By 2030, California's over-65 population will grow by four million - and a bill just signed by Gov. Gavin Newsom should help the state plan for this demographic shift. Assembly Bill 1118, from Assembly member Blanca Rubio, instructs the state to sign onto AARP's Network of Age-Friendly States and Communities. Jennifer Berdugo, associate state director of community for AARP California, says it's a framework to help state planners envision a more livable, senior-friendly future. "You know, autonomous vehicles, for example," says Berdugo. "Is infrastructure going to be there to serve older adults, or people who may have a disability?" Being part of this network helps put an age-friendly lens on the planning process so, for example, parks can be designed to appeal both to kids and older people, and downtown areas will be zoned to put transportation, parks, businesses, medical facilities and civic spaces in close proximity, to encourage walkability for those who may not drive. Berdugo says 39 communities across the state are already members of the agefriendly network, and more cities and states are joining. "So, we actually have five states who are enrolled," says Berdugo. "California would be the sixth, and it would be the first to go through this process legislatively. So, we wanted to have buy-in from our elected officials to really support this effort." Gov. Newsom issued an executive order

earlier this year directing the state to create a Master Plan on Aging - so joining the agefriendly network is a step toward supporting that effort.

ACRAMENTO, Calif.

The American Musical and Dramatic Academy. Teníamos 15 años y me decían “¿Oye quien va a cantar?", y dije, "pues mira canta yo, no pasa nada porque yo no tengo vergüenza.

B

Suzanne Potter California News Service

FARMWORKERS, ADVOCATES REJOICE AS CA ENDS SALE OF CHLORPYRIFOS ENGLISH

Suzanne Potter California News Service

B

AKERSFIELD, Calif. - Farmworkers' groups are celebrating the end of at least a decade-long battle to ban a toxic pesticide in California after the state Environmental Protection Agency announced a new deal with manufacturers of chlorpyrifos. The pesticide no longer will be sold to growers in California after Feb. 6. Nayamin Martinez, director of the Central California Environmental Justice Network, said studies have linked chlorpyrifos to serious health effects in kids. "It's a very dangerous chemical that can cause harm, especially in brain development, for unborn children and young children who live in close proximity where this pesticide is applied," she said. Chlorpyrifos is widely used to control pests on a variety of crops, including alfalfa, almonds, citrus, cotton, grapes and walnuts. Farmers still can spray their existing stocks through the end of next year as long as they respect buffer zones. The

state has dedicated $5 million for grant money to search for an environmentally friendly alternative. In 2016 under President Barack Obama, the EPA had decided to ban chlorpyrifos nationwide, but President Donald Trump's first EPA director, Scott Pruitt, reversed the decision against the advice of the agency's scientists. Martinez noted that Dow Chemical, a chlorpyrifos manufacturer, donated $1 million for the Trump inauguration. "Dow was one of the main contributors to Trump's administration fund," she said, "so it's not surprising that at a federal level, this didn't happen, more for a political reason than anything else." Martinez said rural Fresno, Kern and Tulare counties are the top users of chlorpyrifos in the state, with especially high usage near the Central Valley towns of Lindsay, Orange Cove and Tranquility. The CalEPA announcement is online at calepa.ca.gov

HISPANIC HERITAGE MONTH ENDS, BUT THE FEELINGS ENDURE

ispanic Heritage Month is an official celebration of American citizens whose ancestry can be traced back to Spain, Mexico, Central and South America and the Caribbean. Hispanic Heritage Month “pays tribute to the generations of Hispanic Americans who have positively influenced and enriched our nation and society,” according to the official website. “We value family,” said junior forward Jorge Lopez “Being Mexican, you always have your family everywhere, so we go everywhere together, we have these big parties and we are almost all there.” Many Hispanic public figures came to the mind of junior midfielder Danny Sanchez. However, Sanchez thought of Cesar Chavez as the most important public figure. “Cesar Chavez is probably the biggest one because he stood up not just for himself but for all his people.” said Sanchez. The celebration is a month-long starting September 15th and carries until October 15th. However, the celebration hasn’t always been a month long. In September 1968, Congress authorized President Lyndon B. Johnson to proclaim National Hispanic Heritage Week The timing is key. The reason is because the 15th is the independence days of five Latin America countries: Costa Rica, El Salvador, Guatemala, Honduras and Nicaragua. Mexico, Chile, and Belize follow shortly after, on the 16th, 18th and 21st. Almost a fifth of the total U.S. population is Hispanic, according to the Pew Research Center. At a population of 57 million, they are the second-fastest growing racial or ethnic group behind Asians. Hispanics made up just 5% of the population back in 1970. “Both of my parents are immigrants and immigrated here in 1998,” said junior defender Omar Lemus, “We moved a lot. At times, we lived in garages and small apartments.”

Ya no tienes que ir tan lejos para In Fall 2018, SJSU Headcount by Ethnicity was in a similar scale as 42% of the total were Asian and Hispanic came second with 28%, according to their website. “When I went to my orientation, I saw the percentage and I was pretty impressed,” said Lopez “In a way, it makes you feel more comfortable. Everywhere you go you see Hispanics.”

The UndocuSpartan Student Resource Center (USRC) is invested in creating educational opportunities that will further the success of UndocuSpartans at SJSU. “At school, there’s a lot of Hispanic clubs/ organizations,” said Lemus “It represents well the school knowing they’re trying to step up to everybody, not just our community.” The DREAM Act (Development, Relief and Education for Alien Minors Act) was a bill in Congress that have granted legal status to certain undocumented immigrants who were brought to the United States as children and went to school here. “I am a DREAMer on the DREAM Act. It is not easy. I have to represent and show people I can do it.” said Lopez, “I do not have a lot of the stuff that other people have. The most important thing is to show people it is hard but not impossible.” Lemus believes that legal status is one of the major social issues Hispanics face today. “Number one thing right now is immigration,” said Lemus “even if you have your citizenship, you still get discriminated against.” Despite the social issues, Lemus does not let the issues affect him, in fact he embraces them. “Embrace who we are. Embrace our culture and our country.” said Lemus “I am going to be a first-generation graduate so that’s a really big [accomplishment] for me. Lopez was in agreement with Lemus and believes the obstacles are a part of the journey. “People are going to face obstacles and they’re going to want us to give up.” said Lopez “Think about the future. It’ll all be worth it.”

Avila, Sr. AKA Raul Avila No.19PR186868 To all heirs, beneficiaries, creditors, contingent creditors, and persons who may be interested in the will or estate, or both, of RAUL AVILA, AKA RAUL R. AVILA, SR. A Petition for Probate has been filed by Evangeline Avila in the Superior Court of California, County of Santa Clara. court approval. Before taking certain very important actions, however, the personal representative will be required to give notice to interested persons unless they have waived notice or consent to the proposed action.) Your appearance may be in person or by your attorney. If you are a creditor or contingent creditor of the decedent, you must file your claim with the court and mail a copy to the personal representative appointed by the court within the later of either: 1) four months from the date of first issuance of letters to a general personal representative as defined in section 58(b) of the California Probate Code, or 2) 60 days from the date of mailing or personal delivery to you of a notice under section 9052 of the California Probate Code. Other California statutes and legal authority may affect your rights as a creditor. You may want to consult with an attorney knowledgeable in California law. You may examine the file kept by the court. A bond is a form of insurance to replace assets that may be mismanaged or stolen by the executor or administrator (the estate’s personal representative). The cost of the bond is paid from the assets of the estate. B. A bond may not be required if the decedent’s will admitted to probate waives a bond and the court approves. C. If the decedent’s will does not waive bond, or if the decedent died without a will, the law ordinarily requires the personal representative to give a bond approved and ordered by the court. However, all persons eligible to receive a share of the estate may waive the requirement of a bond. If they all waive bond and the court approves, the personal representative will NOT have to give a bond. D. If bond is not ordered by the court, and the estate suffers loss because the personal representative fails to properly perform the duties of the office, the

loss or some part of it may be recoverable from the personal representative. If so, your share of the estate may be party or entirely lost. E. You may waive the requirement of a bon by signing this form and delivering it to the petitioner for appointment of a personal representative or to the petitioner’s attorney. Your waiver cannot be withdrawn after the court appoints the personal representative without requiring a bond. However, if you sign a waiver of bond, you may later petition the court to require a bond. F. A guardian ad litem or other legal representative with specific authority under the law to waiver bond must sign for a minor, an incapacitated person, an unascertained beneficiary, or a designated class of persons who are not ascertained or not yet in being. See Judicial Council forms DE-350 and DE-351 and Probate Code section 1003. G. I have read and understand paragraphs A through G above. 2. I understand that before signing this form, I am free to consult with a lawyer of my choice concerning the possible consequences to me of waiving a bond. 3. I understand that I do not have to waive bond to allow the estate administration to begin or proceed, or to receive my share of the estate. 4. I WAIVE the posting of bond in this estate by: DONALD C.
