California Supreme Court Upholds Legislature’s Decision to Abolish Redevelopment Agencies SANTA CLARA COUNTY, CALIF.

The California Supreme Court unanimously upheld the Legislature’s power to abolish redevelopment agencies (“RDAs”) statewide. This decision adopted arguments made by the County of Santa Clara (“County”), a party to the case. The result is that scarce public dollars will return to schools, counties, fire districts and other local agencies to perform vital public services.

The County joined as a respondent in the case, California Redevelopment Association et al. v. Matosantos et al. (California Supreme Court Case No. S194861), shortly after it was filed. The controversy centered on the validity of two legislative bills that were passed as part of the state’s FY 2012 budget. The first, ABX1 26, abolished all redevelopment agencies in the state through an orderly wind-down process. The second, ABX1 27, cre-

ated a new voluntary redevelopment program. The Court unanimously upheld ABX1 26; and, by a 6-1 vote, it struck down ABX1 27 as a violation of Proposition 22. The end result is that redevelopment agencies throughout the state will be required to wind-down operations and public dollars will be returned to local governments as redevelopment debts are fulfilled.

ity to provide basic public services,” said Miguel Márquez, Santa Clara County Counsel. “Prior to yesterday’s ruling, redevelopment agencies received 12 percent of all property tax revenue in the state. The Court affirmed that the Legislature may abolish redevelopment agencies to better serve the needs of all Californians during these difficult economic times.”

“Redevelopment has had a huge negative effect on local governments’ abil-

In Santa Clara County alone, this decision will eventually mean a return of $90 million annually that can be used for critical health

and safety services and vital infrastructure provided by the County, and over $150 million annually for schools within the County. “This decision does not mean an end to economic development or redevelopment activities, just an end to the diversion of money to redevelopment agencies,” said Jeffrey V. Smith, Santa Clara County Executive. “In fact, the County – which does not have its own redevelopment agency – already plays a large role in job creation, public safety and economic development. The

Court’s decision will help the County address the enormous needs in public safety, health care, and transportation infrastructure such as roads and expressways.” “We look forward to implementing the careful wind down of redevelopment that the Legislature directed,” said Vinod Sharma, Santa Clara County Director of Finance. “We are pleased that the County’s participation in this case has led to the correct outcome, which will benefit schools and local governments for years to come.”

The Future of 401k Retirement Plans

Ruben Garcia LUTCF, Employee Benefit Specialist

The 401k retirement plan, which was made available to small businesses in the early 1980’s, is about to take a bigger role in the retirement planning for Americans. There are about 72 milliion people with about three trilliion dollars invested in their 401k retirement plans. With the abandonment of many traditional plans that were based on salary and years of service (for example, defined benefit plans), self directed plans like 401k plans, IRA’s and annuities are growing rapidly. Government policy has encouraged the use of 401k plans by granting ‘saver’s credits’ to participants thus paving the way to direct people to save for them-

selves and thereby mitigating the reliance on the existing social security system. A recent study by the U.S. Government Accountability Office reveals that many 401k plans have hidden fees that employer sponsors and employees have not been fully informed about. 401k plan legislation that will take effect in Apil 2012 now requires that there be Fee Transparency Disclosure moving forward. While many providers of 401k services were not disclosing fees properly, some providers do a good job of doing that. What does this mean for the consumer-client? Honesty and full disclosure should be the only policy. If the employer or the participant is paying for a service they should be informed about all features and fees (costs). Diversification

is

the

other issue. Many fund companies address diversification by providing funds by different families and different sectors. This is no longer sufficient. We are in an international and global economy so we need funds outside the U.S.A. We are now more sensitive to green industries and lifestyle funds that invest in companies that don’t violate human rights. To quote an old saying “We are not in Kansas anymore.” The 401k retirement plan of the future will provide more transparency, education, fund selection and more post-retirement planning. For further inquiry and information on 401k’s or for a review of your personal 401k retiremant plan contact Ruben Garcia, Phone: 408-903-6104 or by Email: rg4benef its@yahoo.com.

Tips For Seniors Living On A Fixed Income Budget Online

StatePoint

With retirement accounts and real estate values still recovering from the recession, and living costs on the rise, many retired seniors are struggling to pay their bills. According to the National Council on Aging, 20 million Americans, 60 years of age or older, are economically insecure. But experts say that with the right tools and planning, you can avoid money woes. “The first step is to get a handle on your finances,” advises Aaron Forth, Vice President and General Manager of Intuit Personal Finance Group. “Knowing more about your current financial situation means you can more effectively stick to a budget.” Luckily, new tools are helping seniors on a fixed income to do just that. There are many things you can do to help make ends meet in an uncertain economy:

If you’re still squinting over your checkbook ledger, it’s time to try something new. “Let software do the heavy lifting for you,” advises Aaron Forth, Vice President of Intuit Personal Finance Group. Yuri Arcurs - Fotolia.com Work From Home If inflation is causing your living expenses to rise, but you’re on a fixed-income, you may want to consider taking on some part-time work to supplement your funds. Working from home is becoming an increasingly easy option for seniors who may be less mobile than during their younger days. Many companies hire part-time freelancers to complete work remotely. From tutoring to transcription services, you can earn extra dollars without getting off the couch.

Take advantage of free services on the Internet like Mint.com. For those who prefer managing money on the desktop, purchase financial software like Quicken to help you manage your finances, create a budget, and meet financial goals. Cut Expenses Trim back on unnecessary expenditures. For example, many television programs are available for free online, making your cable bill a redundant expense. Likewise, if you use a mobile phone, consider eliminating your landline. Even if you’re living on a fixed income there’s no need to go into debt.

Somos privilegiados Luisa Fernanda Montero Para La Red Hispana

¿o no?

LET’S ACCOMPLISH SOMETHING THIS 2012 YEAR Hilbert Morales EL OBSERVADOR

Let’s accomplish something this 2012 New Year. What shall that be? There is no shortage of important matters which need to be addressed at any jurisdictional level. At the global level, a stable monetary environment needs to be established in order to have the global economy become stabilized. At the national level, the domestic economy must become focused on recreation of manufacturing which provides the working class with jobs. In additon, the middle class needs to understand that their jobs will not come back. However, new technologies will present many opportunities for those who are prepared and ready. This requires an effective educational system at all levels. At the local level, the educational systems need to become more effective in their efforts to teach students the basics needed to survive in the coming global society and its technology. With respect to educating the poor minority child, the current education system needs to improve its ability to prepare a child for a future which requires an ability to adapt to new career opportunities which require the use of one’s logic, rhetoric, and mathematics with creative applications. Something to be accomplished is comprehensive income tax reform which today permits too many corporations and the wealthy to end up paying no income taxes at all. The income tax disparity must be corrected. The many forms of corporate welfare must be ended,

5

especially those that exist in agribusiness. Administratively, certain crops, such as corn, should not be used to produce more alcohol which is added to gasoline. This is especially so when such diversions create a food shortage with resulting increased cost of food which the impoverished have no money to purchase.

Another accomplishment is that unions must not lose their colletive bargaining rights. In additon, the unions representatives must understand that any retirement pension proposal must be subjected to actuarial analysis to determine if the jurisdiction and its taxpayers can afford to agree thereto.

Another accomplishment to be undertaken is to establish a comprehensive immigration reform act which puts an end to the inappropriate legislative activities at the state level. At the minimum, the proposed American Dream Act needs to be enacted by the U.S. Congress.

Let’s not forget that this is an election year where we either elect a new president or re-elect the current president. An accomplishment is to reconstitute the make-up of Congress to eliminate the current ‘do-nothing for the people’ climate. The electorate will have a choice: Elect senators and representatives who will deal with the establishment of checks and balances which permit the fair distribution of wealth. The middle class and working class sectors of American society are suffering today from excessive unemployment and lack of health care insurance benefits because health care insurance is coupled with employment.

Then there is the need to accomplish something with respect to the escalation of health care costs and prescription medications. Big pharmaceutical companies need to explain why certain medicaitons cost so much in America while being sold at lower prices beyond our borders. Health care costs must be contained in the near future because, at present, any serious illness ends up costing the family its retirement fortune, especially for the underinsured or uninsured. Health care insurance and aid to our impoverished and disabled must be accomplished. There are too many more individuals who have become poor under the economic practices which enable corporations to move manufacturing and information technology jobs beyond our domestic borders. A national housing policy needs to be developed because the current real estate market does not protect the home buyer at all especially when the wage earner’s job is outsourced. Mortgage adjustments must become a priority for the Office of Consumer Affairs.

None of the above will happen if the makeup of the U.S. Congress, as well as that of many state legislatures, is not changed through the election process. The coming election of November 2012 is going to determine if any of the above gets accomplished by the next Obama administration (if President Obama is elected to a second term) and if the partisan makeup of the U.S. Congress is changed to favor the passage of legislation which fairly deals with disparities of all kinds which currently afflict our American society. One thing is certain: the voter, especially the Hispanic voter, needs to decide to accomplish something during this New Year 2012.

Did you know a single portobello mushroom has more potassium than a banana or a glass of orange juice? Or that brown rice has four times as much fiber as white rice? Nutrition secrets like these are your golden ticket to HYPERLINK “http://www. riceselect.com/”healthy living. Here’s another -- brown rice and mushrooms form a formidable health combination. Brown rice has more magnesium, selenium and fiber than its white counterpart. Magnesium is important for bone, nerve and muscle health, while fiber boosts each meal by making you feel fuller, longer. A good dose of fiber also helps keep blood sugar steady. To maximize the health properties of brown rice, dietitians recommend pairing it with other vitamin-stacked ingredients, such as mushrooms. From studies at Penn State University to findings backed by the American Society for Nutrition, the extensive body of research agrees -- mushrooms are overflowing with essential vitamins, nutrients and minerals. White button mushrooms promote immune support by upping the production of antiviral proteins and immune system cells while crimini and shiitake mushrooms have nearly half the recommended daily intake of selenium, a vital antioxidant. Fungi of all kinds are loaded with the following other

nutrients: vitamin D, iron, potassium, B vitamins and copper. The effects of vitamin-packed mushrooms are just as plentiful -- they increase your metabolism, lower blood pressure and promote bladder health.

Joyful Noise The small town of Pacashau, Georgia, has fallen on hard times, but the people are counting on the Divinity Church Choir to lift their spirits by winning the National Joyful Noise Competition. The choir has always known how to sing in harmony, but the discord between its two leading ladies now threatens to tear them apart. Their newly appointed director, Vi Rose Hill (Latifah), stubbornly wants to stick with their tried-andtrue traditional style, while the fiery G.G. Sparrow (Parton) thinks tried-and-true translates to tired-and-old. Shaking things up even more is the arrival of G.G.’s rebellious grandson, Randy (Jeremy Jordan). Randy has an ear for music, but he also has an eye for Vi Rose’s beautiful and talented daughter, Olivia (Keke Palmer), and the sparks between the two teenagers are causing even more friction between G.G. and Vi Rose. If these two strong-willed women can put aside their differences for the good of the people in their town, they--and their choir--may make the most joyful noise of all. This film has been rated PG-13 for some language including a sexual reference.
