Supervisor Joe Simitian (District 5) was the host of a timely forum entitled “Privacy, Security, and Public Safety in the 21st Century” held at the Lucie Stern Community Center, Palo Alto, on October 27, 2013. The panel members were Congresswoman Anna G. Eshoo (Former member, House Permanent Committee on Intelligence and current member, House Committee on Energy and Commerce), Nicole A. Ozer, Technology and Civil Liberties Policy Director, ACLU of CA, and Deirdre Mulligan, Assistant Professor, U.C. Berkeley School of Information. An estimated 250 individuals attended. After the presentations, a lively question & answer period occurred.

“IS BIG BROTHER WATCHING?” Should we care? Do we care? The recent unauthorized release of classified NSA documents

by Edward Snowden, who is still in Moscow, Russia, surprised many- that American intelligence agencies were collecting that much communications raw data. In addition to collecting intelligence, NSA (National Security Agency), the Central Intelligence Agency (CIA), and 14 additional agencies are performing surveillance and eavesdropping operations all over the world. There must be overlaps and duplications.

The cost of these 16 agencies exceeds $10 billion per year.

And much of the information is not critically analyzed until a specific need arises.

Many of these special intelligence operations were established by the George W. Bush Administration as ‘Anti-ter-

rorism” efforts prior to 2008.

When President Obama assumed office, a broad-brush orientation was provided which left out many of the details. As usual, the devil is, and was, in the details.

Now American’s foreign relationships are impacted by these eavesdropping and surveillance revelations. The German Chancellor Angela Merkel was quite upset that her cell phone conversations were captured by NSA’s surveillance. The information technology being used enables these agencies to monitor the cell phones of 35 national leaders who are all outraged! It recently came to light that this has been going on for some years without informing the Obama Administration! This is outrageous and totally unacceptable! Even a “secret federal court” had been set up to review surveillance proposals and issue ‘search warrants’.

There soon must be an assessment and evaluation of all these surveillance efforts to establish current needs.

And, more importantly, to establish required monitoring and transparency standards. Conservative and liberal members of the U.S. Congress must act in a bipartisan manner to establish appropriate limits to what is now going on without being monitored or guided by national security requirements.

According to Nicole A. Ozer, ACLU, there is an erosion of privacy which is enabled by information technology and its recent innovations.

Both government agencies and corporations are able to collect ‘profile information’ which is useful in marketing and promotional efforts. The surveillance capabilities have out distanced the standards of lawful conduct. There is a great need to update all privacy regulations and laws pertaining thereto. All of these issues fall under the “Bill of Rights” 4th Amend-

ment’s ‘Search and Seizure’ codes.

The 4th Amendment text is recorded as follows: “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

Congresswoman Eshoo opined, “If we do not follow the law, what is the difference between ‘us’ and ‘them’?”

Corporations are able to collect scary amounts of personal data today from use of credit cards and phones. The Electronics Privacy Act of 1986 has become ineffective in its application to today’s IT sophistication. Privacy is protected by government’s inefficiency today. However, individuals such as former VP Dick Cheney, FBI’s J. Edgar Hoover, and General Patreus were experts in accessing available information.

Information and its use end up giving a person a powerful advantage. It helps one understand how a person would respond to situations.

Nicole A. Ozer, ACLU, asked, “What kind of society do Americans want to have?”

It is possible that all sorts of activity and location data generated by one person is being captured automatically by sensors, transponders, and cameras, and is being stored in perpetuity. How far can we trust government to treat that personal information with appropriate consideration and respect? Up to now, we see that the ‘checks and balances’ are not being applied to the collection of information, much of which is private. The LAW, as it exists today, is our privacy policy. It must be updated soon!

David Gonzales SPECIAL TO EL OBSERVADOR As of October 17, the government shutdown is over and America will not default on its debts. So, everything is back to normal, right? The Democrats and Republicans can live happily ever after, and get things done for the country. And the Republicans now realize that the Affordable Care Act, aka ObamaCare, which they fought so hard to defund, is the law of the land.

Unfortunately, not so fast.

Although the agreement reached between the Democrats and the Republicans, in the late hours of October 16, authorizes current spending levels until January 15 of 2014 and the debt limit is raised until February 7.

There is nothing that says the Republicans won’t threaten another shutdown, and we’ll go through this turmoil once again.

Judging by what the ringleader of the Republican rebellion, Senator Ted Cruz of Texas, says, the fight to defund the Affordable Care Act is not yet over , and he has vowed to do whatever it takes to defund and derail it. In

fact, Cruz blames his fellow Republicans in the Senate for not showing more fortitude and, instead, “surrendering” to the President.

Let’s remember something that Cruz and the others seem to forget: ObamaCare was passed by Congress on March 21, 2010; was signed into law by President Obama two days later; was upheld to be constitutional by the Supreme Court on June 28 of 2012, and the President won re-election in November, 2012, running on ObamaCare as much as anything else.

While to most people, this would indicate that the Affordable Care Act is here to stay, the Tea Party wing of the Republican Party refuses to accept this. Since they can’t defund ObamaCare by winning enough elections in order to overturn the law, including the Presidency and a majority of Senate races, the Tea Party now resorts to holding the government hostage to get what it wants.

Although the Tea Partiers pretend to honor the Constitution, nowhere does the Constitution say that if you want to repeal a bill you don’t like, but you can’t win elec-

tions and the Supreme Court upholds the bill you don’t like to be Constitutional, then you have the right to hold the government for ransom— this is not how democracy works in America.

If the Tea Party wants to repeal ObamaCare, they’ll have to win elections and all the rest. This ‘government by crisis’ does not solve anything and just makes matters worse. Besides, what did the Republicans gain by all this? Their popularity is at an all-time low because of the shutdown and, most likely, voters will let their feelings be known at the ballot box in 2014.

Though a number of top Republicans, including Senators John McCain and Mitch McConnell, say the next budget negotiations won’t involve the threat of a government shutdown or a debt default, someone should tell Ted Cruz this.

In my opinion, in order to prevent something like this from ever happening again, there should be a Constitutional amendment or a law forbidding these type of tactics, as there is too much at stake—the future of democracy in America.

SACRAMENTO The California Department of Motor Vehicles (DMV) has introduced a new dynamic and interactive version of the Driver Handbook for the Apple iPad tablet to help new drivers prepare for DMV’s written exam.

“We transformed our traditional driver handbook into a dynamic and interactive experience,” said DMV Chief Deputy Director Jean Shiomoto. “This new iPad version of the DMV handbook offers customers innovative educational materials to help improve driver safety on California’s roadways and highways.”

The Handbook is primarily designed to help prepare new drivers for the DMV’s written test of traffic laws and

road signs. New and experienced drivers will also find this handbook a valuable resource for information about safe driving.

the iPad was created using DMV’s in–house information technology and website services team, which was instrumental in selecting the template, customizing the program, and designing a layout.

The handbook’s other useful features include text highlighting, content search, a detailed glossary and the ability to take electronic notes and share information on Facebook or Twitter. The Handbook includes sample tests, DMV driving videos and list of local DMV field offices.

Santa Ana CALIFORNIA California school kids made slight gains this year in two of the most important indicators of health and physical fitness, and held relatively steady overall, State Superintendent of Public Instruction Tom Torlakson announced today.

About 1.34 million fifth, seventh, and ninth graders took the FITNESSGRAM® this year, nearly 94 percent of students enrolled in those grades in public schools statewide. Students in grades five and seven improved in aerobic capacity and body

The primary goal of FITNESSGRAM® is to assist students in establishing lifetime habits of regular physical activity. The FITNESSGRAM® is composed of the following six fitness areas, with a number of test options provided for most areas: aerobic capacity, body composition, abdominal strength, trunk

extensor strength, upper body strength, and flexibility.

Jason Alderman PRACTICAL MONEY En vistas de la proximidad del Día de los Veteranos, es buen momento para recordarles tanto a nuestros miembros militares activos como a los veteranos los numerosos beneficios de asistencia educativa que les ofrece la Ley G.I. y otros programas gubernamentales.

Este es un resumen de algunos de los programas más utilizados: La Ley GI Post 9/11 es más flexible y ofrece más beneficios que las leyes GI anteriores. Ofrece hasta 36 meses de ayuda para educación y vivienda a personas que hayan tenido, como mínimo, 90 días de servicio militar activo después del 11 de septiembre de 2001, o una discapacidad relacionada con su servicio después de 30 días. La persona debe haber sido dada de baja en forma honrosa.

Los estudios aprobados incluyen las carreras de pregrado y de grado, y las carreras vocacionales/técnicas/ prácticas, entre otras. Se puede acceder a los beneficios por un plazo de 15 años desde el último período de servicio activo de 90 días consecutivos como mínimo.

Este programa cubre el 100 por ciento del costo de la matrícula y cargos para los estudiantes del estado que concurran a instituciones públicas, y se pagan directamente a la institución. Para los que concurren a instituciones privadas o extranjeras, el programa paga hasta $19.198,31 por año académico (en algunos estados puede ser más).

Si usted concurre a una institución educativa privada más cara –o a una pública

pero como no residente – también podrá ser elegible para acceder al Programa “Yellow Ribbon”, en el que las instituciones pagan voluntariamente los gastos de matriculación que exceden el valor de la matrícula más cara que se cobra en el estado por una carrera de pre-grado. La institución puede contribuir con hasta el 50 por ciento de dichos gastos y el Departamento de Veteranos aportará otro tanto.

La ley GI 9/11 también paga un estipendio por libros e insumos de hasta $1.000 por año y un subsidio mensual para vivienda comparable al Subsidio Básico de Vivienda para un sueldo militar de grado E-5 con dependientes, en base al código postal de la institución educativa.

Otra de las ventajas de esta nueva Ley GI es que los miembros de las fuerzas militares con seis años de servicio como mínimo pueden transferir la totalidad o parte de sus beneficios a sus cónyuges y/o hijos. Las reglas básicas son las siguientes: »El miembro debe aceptar cumplir con cuatro años más de servicio. (Se aplican reglas especiales si la política estándar le impide al miembro cumplir cuatro años más de servicio o si es elegible para retirarse). »Como el tiempo empieza a contar desde el día en que usted elige participar –y una vez que deja el servicio militar ya no puede inscribir a otros beneficiarios –lo mejor es inscribir a todos los miembros de la familia de entrada.

Siempre se puede volver a atrás y modificar los porcentajes de asignación o quitar a algún beneficiario en cualquier momento hasta que se utilicen los beneficios.

»Los cónyuges pueden comenzar a utilizar los beneficios transferidos de inmediato, pero los hijos deben esperar hasta que usted haya cumplido los 10 años de servicio. »Usted y su cónyuge deben usar los beneficios dentro de los 15 años de haber dejado el servicio militar; sus hijos deben usarlos antes de cumplir los 26 años de edad.

La tarifa de “mezclados” reconocía que los consumidores revolvían envases no elegibles para CRV como; botes de leche, vino y licor, al igual que envases de comida en las cargas de material de CRV. Por lo tanto, los consumidores que traían “cargas mezcladas” a los centros de reciclaje, recibían una tarifa reducida por libra. Además de dar un pago neto reducido al consumidor por su reciclaje, la tarifa para cargas “mezcladas” arriesgaba que se reembolsara por cargas que tuvieran un mínimo de material elegible para el reembolso de CRV.

AMERICAN COUNSELING ASSOCIATION Yes, TV is a great way to keep the kids quiet and out of the way for a few minutes. But are we doing our children any favors when we allow, or even encourage, unlimited TV time?

Researchers estimate that children ages 2 to 5 spend an average of 32 hours each week in front of the TV. For kids 6 to 11, the average is about 28 hours per week.

Add in the time for video games and the number of hours in front of a glowing screen grows even greater.

And no, this isn’t a good thing. Studies have linked excessive TV viewing to childhood obesity, aggressive behavior, lower reading skills and poorer academic performance.

The answer is not to ban TV, an almost impossible solution guaranteed to bring family fights and little success. Instead, try to make the TV experience a positive and beneficial one.

Start by being selective about the programs your children can watch. There’s a great deal of educational programming, not only on

PBS, but also on the Discovery, Learning and History channels. Also visit your local library for educational DVDs. Experts advise limiting the amount of TV allowed, and setting appropriate times for watching. Homework, household chores and family conversations should take priority and be the means for earning the right to watch TV. If you set certain hours for getting homework done, then TV is simply not an option during those hours.

Another important change to make is simply watching TV with your children. It’s a chance both to relax and to talk with your kids about their activities and interests.

Make that TV time interactive by discussing the shows you’re watching together.

Let your kids explain what’s good or bad about a show, and share your own opinions with them.

Your own example will also affect how your kids view TV. If your behavior is simply to plop in front of the TV and channel surf, the message to your children is that TV is just a way to kill time, rather than being a means for finding information or entertainment.

Setting controls and being actively in charge of TV watching does take time and effort, but the result can have significant benefits for your children. It can help them see TV as an educational and entertaining experience, and not just a place to waste countless hours.

La Asociación Americana de la Diabetes promueve su iniciativa “Un Día en la Vida con Diabetes” entre millones de estadounidenses afectados por esta enfermedad Durante el Mes Americano de la Diabetes(R) este noviembre, la Asociación Americana de la Diabetes le pedirá a las personas que suban su foto personal en el mural de fotos de la página de Facebook en donde expresen lo que es Un Día en la Vida con Diabetes. El objetivo es mostrar los esfuerzos extraordinarios que hacen estas personas al vivir con diabetes.

La imagen puede ser una foto de ellos o de un ser querido o puede ser una imagen que represente cómo esta enfermedad impacta sus vidas.

La imagen será parte de un gran mural que simbolizará el mensaje de Un Día en la Vida con Diabetes.

Para que el mural de fotos sea aun más impactante, este año la Asociación rotará las fotos varias veces durante el mes de noviembre para mostrar la gran cantidad de imágenes que representan Un Día en la Vida con Diabetes. Estas fotos capturarán la esencia del Mes Americano de la Diabetes y la campaña Alto a la Diabetes(R).

Natalie Rodriguez SPECIAL TO EL OBSERVADOR BERKLEY - The Alameda County Healthy Homes Department in collaboration with Dignicraft hosted a screening of the documentary “Brilliant Soil” at La Peña Cultural Center on Tuesday, October 29, 2013.

The event was held in order to raise awareness about lead-free alternative glazes in Mexican pottery. Along with the film screening there was food, a lead-free pottery sale, and a Q-and-A session with Co-Director Jose Luis Figueroa Lewis and Producer Omar Foglio Almada. The Alameda County

Healthy Homes Department was previously known as the Lead Poisoning Prevention Department. Julie Twichell, Outreach and Communications Manager explains the importance and relationship to their work with the families of lead poisoned children and working to find the sources of lead. She says, “We’re really happy to have the movie ‘Brilliant Soil’ here tonight at La Peña, because it points out one of the important sources of lead, which is some pottery from Mexico.”

In the first act, the audience gets to know how Adam and Luke became an item. You also get to know the other characters a little better, and get a better understanding of where they’re coming from.

At first it seems a little unclear that the play will take on the topics of religion and sexual orientation. It turns out to be a very interesting way of trying to understand how a Christian deals with being gay and how his partner does too.

In the second act, Luke and Adam, who have been dating for a couple years now, have a huge fight. Adam admits that he can no longer be in the relationship. Luke still hasn’t come out to his parents and he’s still a Christian. The couple has this argument before Luke gets into the accident.

Adam turns out to be very upset. The whole situation gets him thinking of whether or not he meant what he said.

Near-death experiences always bring out the best in people, put things in a different perspective and gives way to religion. Luke’s par-

Su seguridad, es la prioridad número uno para PG&E. Respuesta más rápida, mejores inspecciones de fugas y reparaciones PG&E ha hecho un progreso significativo en la rapidez con que responde a las llamadas de clientes que sospechan tener una fuga de gas, por el fuerte olor a gas.

Actualmente, cuando un cliente llama a PG&E a través del servicio de emergencia 24 horas o al centro de servicio al cliente al (800) 743-5000; en promedio, un representante de la compañía del servicio de gas (GSR) se presenta en la escena a los 30 minutos, el 83 por ciento de los casos.

Este es sólo un ejemplo de cómo PG&E ha ido mejorando la totalidad de sus operaciones de gas - tanto en sus grandes tuberías de transmisión, donde se mueven inmensas cantidades de gas, a través de muchos millas; como en sus pequeñas líneas de distribución que llevan gas directamente a los hogares y negocios de los clientes.

Otro ejemplo de progreso, es el plan gestión de distribución integral de PG&E. Como debes saber, el gas natural es inodoro e incoloro, y como medida de seguridad, PG&E agrega un olor parecido al azufre al gas natural para ayudar a las personas a identificar fugas de gas. Aún así, no se debe confiar únicamente en su sentido del olfato para determinar si el gas natural está presente.

Hay una serie de razones por las que solo su sentido del olfato no es suficiente para alertarle de la presencia de gas natural. Algunas personas pueden no ser capaces de detectar el olor porque tienen un sentido del olfato disminuido; han estado en presencia del mismo olor durante demasiado tiempo, o que el olor se está enmascarado por otros olores en la zona.

También, existen ciertas condiciones que pueden causar que el olor “desaparezca”; de manera que no sea de fácil detección. El desvanecimiento del olor, o la pérdida de odorante, se produce cuando el odorante en el gas se disminuye debido a procesos físicos y químicos.

Costa Mesa CALIFORNIA The AVP (Association of Volleyball Professionals) Tour congratulates Kerri Walsh Jennings on setting the all-time record for tournament victories by a female beach volleyball player.

Walsh Jennings and teammate April Ross beat Taiana Lima and Talita Da Rocha Antunes of Brazil, 21-14, 1721 and 15-12, in the women’s final of the FIVB (Federation International de Volleyball) Xiamen Grand Slam on October 27 for their third tournament title in five events since forming their partnership.More notably, the win in China was the 113th tournament victory of Walsh

Jennings’ career, moving her past long-time partner Misty May-Treanor for the all-time mark.

A three-time Olympic gold medalist, Walsh Jennings has put together a remarkable run since her first victory, which came in May, 2001 in Oceanside, Calif. playing with May-Treanor in an event on the now-defunct Beach Volleyball America (BVA) tour. She has won 66 times on the AVP tour, 46 times on the FIVB Tour and once on the BVA tour.

Her victories have come on five different continents, in 18 countries and in 15 U.S. states, with the most (29) coming in California. Walsh Jennings has won 60 per-

cent of the tournaments she has entered (113 of 189), and when she has reached a tournament final, she has won a remarkable 79 percent of the time (113 of 143).

“Holding the all-time wins record in the women’s game is a very special record to hold for many reasons,” Walsh Jennings said. “Primarily, it holds special significance to me because it honors my cherished partnership with Misty. A vast majority of the wins came by her side, and I will forever be grateful for the love, friendship and success we have shared together both on and off the court. I have been blessed in my career as a professional beach volleyball player, and I am so grateful to all those who have helped

me to chase my dreams with such success. I’m proud, I’m humbled and I’m inspired to keep fighting for my dreams and for this great sport.”

Walsh Jennings won Olympic gold medals playing with May-Treanor at the 2004 (Athens), 2008 (Beijing) and 2012 (London) Games. Of her 113 career victories, 104 came playing with the nowretired May-Treanor.

Walsh Jennings and Ross recently formed a partnership and will work toward competing in the 2016 Olympics in Rio.
