(hereinafte r " Harmers"); License #s 672829 , 780870 , as agent for the consignor or vendor , shall regulate the bidding and shall determine the manner in which the bidding shall be conducted . Harmers reserves the right to withdraw any lot prior to sale (without liability to any potential purchaser or agent ), to re-offer any withdrawn lot, to divide a lot or to group two or more lots belonging to the same consignor or vendor, and to refuse any bid believed not made in good faith . The highest bid acknowledged by the auctioneer shal l prevail. Should a dispute arise between bidders (including a dispute between a floor bidder and the auctioneer acting on behalf of a mail bidder, consignor or vendor) , the auctioneer alone shall d.etermine who is the successful bidder and whether to reoffer the lot in dispute . Should a dispute arise after the sale, the auctioneer 's sale records shall be conclusive . On all lots sold, a commission of 10% on the hammer price is payable by the buyer. (a) The auctioneer reserves the right to bid on behaif of clients (and consignors or vendors ) but shall not be liable for errors and omissions in executing instructions to bid, however received , and whether such errors or omissions be those of the bidder or agent or those of the auctioneer . (b) All lots are offered subject to a reserve price. The auctioneer may implement such reserve price by bidding on behalf of the consignor or vendor. (c) It may also be assumed that all consignors have been advanced monies against the sale of their stamps and Harmers therefo re has a security interest over and above the normal auction commission. (d) Purchases made by a consignor or vendor or his agent on his own lots shall be considered as a sale subject to commissions and sales tax as applicable . (e) Agents are responsible for all purchases made on behalf of their clients, unless other arrangements have been confirmed in writing prior to the auction . PAYMENT FOR PURCHASES Payment for lots, including those on which opinions are desired (Condition of Sale 8), shall be as follows : (a) Floor Bidders. Payment of the purchase price, or such part thereof as Harmers shall require , shall be made by the purchaser in such manner as Harmers may determine . The name and address of the purchaser of each lot shall be given to the auctioneer immediately lollowing the sale of such lot. (b) Mail Bidders. A successful mail bidder will be notified of lots purchased . Before Harmers will send such lots, payment in full must be received by Harmers within three (3) business days of receipt of the aforesaid notification by the mail bidder . However , a purchaser known to Harmers , or who furnishes satisfactory references , may, at Harmers option, have purchases delivered or forwarded for immediate payment (by a dollar draft on a U.S. bank in the case of ov13rseas purchasers ). Mailed delivery will be to the address on the bid sheet and proof by Har ers of receipt of a sending at the advised address shall constitute delivery . All charges for handling, delivery and insurance (obtained by Harmers on behalf of the purchaser ) shall be added to the purchase price ; a minimum charge of $ 1.00 will be made. Risk of loss in transi t shal l be on the purchaser . (c) Where an opinion of a genera lly recognized authority* is desired, the time for pay ment may be extended in accord with and subject to Condition of Sale 8. Title shall not pass to the purchaser until full payment has been received by Harmers as agents for the consignor or vendor . (a) Purchasers agree to pay for lots as specified in Condition of Sale 4 (or as the same may be modified by Condition of Sale 8), and no credit is extended ; a late payment charge of 2% for the first month and 2½% for each succeeding month shall be added if payment is not made in accordance with the aforesa id conditions. (b) In the event that a bidder shall fail to comply with these Conditions of Sale (" Non-Compl ying Bidder"), then, as to any lot with respect to which such failure to comply occurs , Harmers may, at its option , re-offer such lot immediately or at auction at a later time and shall hold the NonComplying Bidder liable for the defic iency, if any, between the hammer price and the proceeds of a sale to a subsequent purchaser , as well as for all costs and expenses of both sales , all other charges due thereunder , including commiss ions with respect to both sales, and all incidental damages . In no event shall any surplus arising from the sale of a re-offered lot be payable to a Non-Complying Bidder . (c) A default_ing purchaser shall _be deemed to have granted Harmers a security interest in any property 1n Harmers possession owned by such purchase r. Harmers shall have all of the rights afforded a secured party under the New York Uniform Commercial Code with respect to such property and may apply against such obligations all monies held or received by it for the account of, or due from Harmers to such purchaser . (d) If Harmers takes any legal steps to secure payment of a delinquent account , the defaulting purchaser shall be liable for all legal and other expenses incurred by Harmers to secure such payment , including but not limited to a reasonable allowance for attorneys ' -fees . For purpm;es of this paragr_aph, the term le~al steps shall be deemed to include any and all consultation by Harmers with its attorneys with respect to all matters arising out of a delinquent account.

THE DALE/ LICHTENSTEIN CAPES What can one say about this wonderful collection? It is unquestionably the finest group of Cape of Good Hope and is considered by many to be one of the greatest single countr y collections ever assembled in the world. It includes the pick of many years of buying by tw o top philatelists, Alfred F. Lichtenstein in the beginning, later jointly with his daughter Louise Boyd Dale and lastly by Mrs. Dale on her ow n. What is grand in other Cape collections is conv entional in this one. Therefore, the rarities defy description-the magnificent singles with gum; the largest or near-largest blocks kno w n; cov ers representing virtually all values, many about which collectors have only dreamed . And what can be said of the tw o greatest rarities of this intensel y collected country-the " Cape Error Cover", the rival of the Post Office Mauritius cover for w orld- w ide philatelic excellence and rarity , and the "Tete-Beche Pair " of the 4d blue, merely (if we may be forgiven ) unique. Harmers has particular affinity for this tete-beche variety, for it was on October 13, 1930 that it was first auctioned by H .R . Harmer at the London Galleries. There is always regret for an auctioneer who becomes the instrument in overseeing the final dissolution of a collection of such magnitude. It is also difficult to express the excitement one feels when looking at a single album page and seeing on it, this one page only , not one but a number of priceless pieces. Thus, it is with some sadness that we removed the Cape items from their original exhibition sheets in order to prepare this collection for auction. Now the opportunity is presented herein to philatelists throughout the w orld to obtain this exceptional material after so many years. And w e hope that the enthusiasm, the passion and the joy that Alfred F. Lichtenstein and Louise Boyd Dale had for this grand Cape of Good Hope Collection is reflected in this catalogue .

1853 DEEPLY BLUED PAPER Due to the number of printings of the blued paper, color variations abound from those designated in Stanley Gibbons. Therefore, we have utilized this impeccable collection as the source of reference for our classifications. In addition, the majority of the blued papers are with "ivory heads" and we have therefore not distinguished them from the normal.

4 PENCE BLUE TRIANGULAR PAIR FORMING THE UNIQUE TETE -BE.CHE PAIR. ROYAL CERT. (1930) "ge nuine ' tete -b eche ' pair". FROM THE BAINBRIDGE AND RIESCO COLLECTIONS ..... ............................ (9)
For hi storical purpo ses we reproduce below H ar mers' original descr iption from the October 13, 1930 auction of the " Bainbridge " Collection -l ot #544 . "A REMARKABLE PAIR SHOWING ERROR OF SETTING, DUE TO TWO STEREOS BEING MISPLACED , FORMING A 'SIDEWAYS' PAIR. THE PIECE HAS ONLY RECENTLY BEEN DISCOVERED AND IS, WE BELIEVE , THE ONLY KNOWN PAIR OF THIS ERROR OF SETTING. BOTH ST AMPS ARE WHAT IS KNOWN AS TYPE 1b AND MUST THEREFORE HA VE COME FROM THE LIMITED FIRST PRINTING IN SHEET OF 24; THE VARIETY PROBABLY OCCURRED IN A SMALL PORTION OF THE PRINTING OWING TO TWO CLICHES FALLING OUT AND BEING WRONGLY REPLACED. THE PIECE IS OF FINE COLOUR, LIGHTLY CANCELLED BUT SLIGHTLY THINNED; THE RIGHT HAND STAMP IS TOUCHED AT PLACES. " Our Annual R esume from the 7930-37 Season notes: " H ere w e ha v e a remarkable instance of a philat elic v ariety of the first importance passing unrecognised through sev eral hand s until it came under the expert eye of Mr. H.R . H armer. I ts discov ery pro v ided one of the philatelic sensations of 1930-3 1. The pair, w hich no w adorn s the greatest specialised collection of T riangular 'Cape s' in the w orld, has been de scribed by the leading authority on these issues as 'unique and w ithout riva l '." I n addition, an article on the find occurs in " Stamp Collecting ", Au g ust 23rd, 1930.
