OBVIOUS REPRINTS

Forgeries, fake cancels, and badly defective stamps are normally not included in catalog totals unless noted. However, as with any large group of stamps, some stamps may prove to be bogus, misidenti ed, or defective. Descriptions of quality are meant to apply to the overall condition of the lot. Lots described as being "mixed” quality or condition should be expected to contain some faulty material.

OWNER’S CATALOG VALUE

In some cases an "owner’s catalog value” is given. Such a gure is just that. An owner’s value may be useful as a guide but H.R. Harmer does not guarantee the accuracy of such a gure.

GUM

Stamps described as "mint” can be expected to have original gum (OG), but should be expected to be hinged unless speci cally noted as never hinged (NH).

EXPERTIZING MARKS

We sometimes mention an expert’s signature or guarantee mark on a stamp. However, while we believe that the vast majority of stamps so described are genuine, H.R. Harmer implies no warranty to that e ect.

Having now spent the last several months handling their collections, it is unfortunate that I never had the opportunity to meet either James Crumpacker or Paul Ammons. It is interesting to me that two men who endeavored to collect the same area could take such radically different approaches: the former opting to collect anything and everything listed in the catalogue, the latter instead specializing in a few small and self-contained niches.

As an auctioneer, this is a dream come true; I don’t think it would be possible to nd two more impressive Canal Zone collections with so little overlap. With the exception of one major error (the 6c airmail of cial inverted overprint, CO14a) there is essentially no duplication. The resulting catalogue is, I hope, one which will become a useful reference work for future generations of Canal Zone collectors.

I rst found out about the James Crumpacker collection from postal history dealer Jim Forte several years ago. He told me that it might be a while before the collection came to market, but that it would be worth the wait. Having spent considerable time with the collection, I can tell you con dently that Jim was right.

Upon rst encountering the collection I did a spot check of the most notable rarities: the First Series on cover, the missing bridge error, and so on. But it wasn’t until I really dove into the varieties— many of which Jim Crumpacker discovered himself—that I realized what a remarkable holding this was. I have done my best to make as many individual lots as possible out of his collection, because I believe that these rarities, no matter how obscure, deserve to stand on their own.

It was during the nal stages of catalogue production that I was contacted about the Paul Ammons collection. The serendipity of offering the material of these two men in one catalogue—both proud members of the Canal Zone Study Group and proli c authors and researchers—seems perfect.

I also want to mention what a positive experience it has been to work with members of the Canal Zone Study Group in the preparation and marketing of this sale. We were fortunate enough to meet with many members of the group at both Westpex and Philatelic Show, and I hope that H.R. Harmer and the CZSG are able to work together more in the future. I believe the CZSG serves as a model for other specialized societies, and I encourage anyone who is not already a member to join at once.

I’d like to close by thanking the Kam family, the Ammons family, Jim Forte, and all of the members of the Canal Zone Study Group whose encouragement and advice made this catalogue possible.

Introduction

The James W. Crumpacker Collection of Canal Zone Stamps and Postal History

October 15, 1944 - January 11,

James William Crumpacker was born on October 25th, 1944 in Monterey California. His father Daniel Lucien Crumpacker was a captain in the U.S. military and a member of the Knights Templar in Elizabethtown Kentucky. His mother’s maiden name was Regina Mattingly and both parents were of German descent. James spent most of his childhood in a state of transition traveling between his fathers posts all over the world. His early childhood was spent in the surrounding area of Panama so it stands to reason that he took a special interest in the Canal Zone stamp collection. James was a member of Mensa and a student of GeorgeTown University where he studied history and numerology. It is my belief that James was a savant. Even in his last days James could recite every historical event that has occurred from the 1700’s on.

All of the proceeds of his extraordinary and unusual collection will go to a division of GeorgeTown University cancer centers.

First Series Stamps

The First Series was placed on sale in select post of ces on June 24, 1904 and was available throughout the Canal Zone the following day. The underlying stamps were of the 189296 Map design of Panama, overprinted for the Republic, and subsequently overprinted again with a violet “Canal Zone” straightline handstamp. Stamps were produced in sheets of 100; there were 26 sheets of the 2c Rose, 85 sheets of the 5c Blue (700 of which were destroyed), and 26 sheets of the 10c Yellow (304 destroyed). The stamps were demonetized on July 17 after just 24 days.

On one sheet of the 2c and 5c and two sheets of the 10c, the “Canal Zone” overprint was inverted. Additionally, one sheet of the 5c received the “Canal Zone” overprint at an angle. Other varieties occur with regard to the “Panama” overprint, which was applied in settings of 50 (so that each position occurs in both the top and bottom halves of the sheet). Multiples of any size are rare, as are errors and varieties on cover. As the “Canal Zone” overprint has been forged extensively, it is recommended that all stamps and covers either be certi ed by a recognized authority or inspected by an expert in the Canal Zone before purchase.

Second Series Stamps and Covers

The Second Series, consisting of United States stamps of the then-current 1902 series, arrived in Panama on July 13, 1904. 10 million stamps with a face value of $390,000 should have lasted the Canal Zone many years; however, the stamps were demonetized on December 11, 1904, at which point less than $4,300 (1.1%) had been sold. The remainders were burned.

The reason for the short life of the Second Series has to do with a controversy between the United States and the Republic of Panama. Letters from the Canal Zone to the United States were charged the 2c United States domestic rate, while letters from Panama were charged the 5c UPU rate. There was no reason to mail a letter from a Panamanian post of ce when 60% could be saved simply by crossing the street and using a Zone post of ce. President Roosevelt sent William Howard Taft to work out an agreement between the two nations, which resulted in an executive order on December 3 that stated that stamps from the Republic of Panama would be purchased at 40% of face value and overprinted for use in the Zone, and mail from Panama to the United States would be charged the 2c domestic rate.

The Third Series of Canal Zone stamps went on sale December 12, 1904. Although not consecutive, Scott numbers 9-15 and 18-20 are grouped together as they were produced at the same time from the same plate. As with the First Series, stamps from the Republic of Panama were overprinted with the words “Canal Zone,” this time with a single plate of 100 subjects. There are six distinct stages of the overprint, which collectors have documented in great detail.

The various stages of the overprint create a great number of different varieties for collectors: certain letters or words were replaced with a different typeface (the “antique” varieties), the “A L” of “Canal” is spaced wider at one position, the „ON“ of „Zone“ dropped vertically, and, most dramatically, on a small number of stamps the “L” of “Canal” was turned 90 degrees clockwise.

In order to pay registration fees, the Canal Zone requested 8c stamps. As the Republic of Panama did not have an 8c stamp in production, they instead surcharged 50c stamps with the new value. Varieties in these 8c stamps—which had now been overprinted three separate times—are numerous, and provide a wonderful (yet daunting) challenge to the serious collector.

Fourth Series Stamps

In early 1906, stocks of the 1c and 2c stamps from the Third Series were exhausted. It was determined that Colombian 20c and 1p stamps would not rst be overprinted by the Republic of Panama, as was the case with the Third Series, but would instead be overprinted entirely in the Canal Zone. The obliteration of the word “Colombia”, the two “Panamas”, the words “Canal Zone”, and the surcharge (“1 ct.” or “2 cts.”) were applied in one fell swoop. For each denomination, the Scott Catalogue lists three different types. Confusingly, these types are given minor letter listings (16, 16a, and 16b, for example), despite the fact that they are not errors or varieties but instead separate printings and should be given equal weight. The number of varieties is not nearly as great as with the Third Series, due to the simpli cation of the overprinting process.

The Third and Fourth Series were in use until 1906, when the Republic of Panama adopted the gold standard (with 1 Balboa equivalent to 1 U.S. Dollar). The Third and Fourth Series were also the last Canal Zone stamps to be overprinted onto stamps of Colombia; the following issues would be overprints of stamps issued speci cally for the Republic of Panama.

Fifth Series Stamps

The Fifth Series stamps bear “Canal Zone” overprints on stamps produced by the Hamilton Bank Note Company. The rst printing of 2c stamps in October 1906 featured an overprint reading up; all subsequent printings would have the overprint instead reading down. The stamps were printed on both hard and soft paper, and two different settings of the overprint have the words spaced 7¼mm and 6¾mm apart.

Various shades can be found for many of the values in the set; most striking is the 5c value, which comes in a range of shades of blue and ultramarine. Additionally, a large number of errors occur on the Fifth Series, ranging from double overprints, omitted overprints, imperforate between pairs, and more. The shades and errors, combined with the relatively long period of production, make this an ideal issue to specialize in along with its successors.

Sixth Series Stamps and Covers

In 1909, the Hamilton Bank Note Company stamps were replaced by a new series produced in a markedly similar style by the American Bank Note Company. Using the same overprint as the Fifth Series, these were to be the last stamps overprinted in the Canal Zone itself (not counting later emergency overprints). The only signi cant variety in the whole series occurred in position 50, where the „C“ and „A“ of „Canal“ are widely spaced. The omitted overprints on the 2c value (in both horizontal and vertical pairs) rank among the rarest errors in the entirety of Canal Zone philately.

Seventh Series Stamps

The Seven Series consists of ve different varieties of overprint used between 1909 and 1921: Type I (1909-10), Type II (1912-16), Type III (1915-21), Type IV (1918-20), and Type V (192021). All except for the Type III overprint were applied by the American Bank Note Company on that company’s then-current stamps for the Republic of Panama.

The Type III overprint, also known as the “Mount Hope” overprint, was applied by the Panama Canal Press in Mount Hope in order to prevent a shortage of stamps should new stocks not arrive from New York City in time. Only the 1c, 2c, and 5c received this overprint. When New York printings were available, the Mount Hope overprints were withheld, and they were only ever released in quantities to cover the shortfall (leading to their scarcity today).

Eighth Series Stamps and Covers

The Eighth Series consists of just two stamps, both “Canal Zone” overprints on the map issue of the Republic of Panama. The rst, a 10c surcharge on a 13c stamp, has an interesting story: the 13c map stamp was originally created by Panama when the registry fee from the Canal Zone was 8c. 13c would therefore pay the 5c international postage plus registry. By the time the stamps were produced, however, the registry fee was increased to 10c and the 13c stamps were no longer needed. They were later surcharged 10c and issued in January 1911. Panama later produced a 10c stamp in the map type, which was likewise overprinted (but not surcharged) for use in the Canal Zone. These two stamps, the 13c and 10c map design, are the only two basic Panama stamps that were never issued in Panama but only overprinted for use in the Canal Zone.

Ninth Series Stamps and Covers

The Ninth Series, issued over the course of 1915 to 1920, are larger than any other stamps issued for the Canal Zone until that time. The four low values, initially issued in 1915, were produced to celebrate the 1915 Panama National Exposition. Although the subsequent designs were issued at later dates, they are nevertheless generally considered to be part of the same series.

The high production value of these stamps by the American Bank Note Company means that errors are essentially nonexistent, save for minor spacing varieties in the overprint.

Tenth Series Stamps and Covers

In 1921, the Republic of Panama planned a set of commemorative stamps to celebrate the centenary of independence of Panama from Spain. The Canal Zone was invited to participate through the production of overprinted stamps for use in the Zone. Booklets, postal cards, and stationery envelopes were also produced as part of this series. Instructions from the Director of Posts ordered postmasters to exhaust stocks of the Centenary Issue stamps before any previous issues were again sold to customers.

The 2c, 5c, and 10c values all exist with the overprint inverted, while other errors include the word „Canal“ doubled on the 1c and 2c and the entire overprint doubled on the 2c.

By early 1924 stocks of the 1c were depleted, and since it was not known when the new Coat of Arms series would be ready a small supply of 1c stamps were locally overprinted at Mount Hope in the Canal Zone. This overprint can easily be identi ed by its larger type.

Eleventh Series Stamps and Covers

In 1923, the Republic of Panama ordered a new set of de nitive stamps from the American Bank Note Company depicting the Coat of Arms of Panama. All designs from 1c to 1 Balboa were overprinted for use in the Canal Zone, although the decision to use United States stamps overprinted for the Canal Zone on July 1, 1924 meant that only the 1c and 2c were ever actually issued to the public.

600 sets of the 5c to 1b were sent to Panama for distribution to the UPU in Switzerland; shortly thereafter, these sets began to make their way onto the philatelic market. These essays are not just attractive, but also quite rare and desirable. The only major variety on the issue is a dropped “E” in the word “Zone”, which appears on all values.

Overprints on United States Stamps

Although the abrogation of the Taft Agreement in 1924 is much too complex a topic to explore in depth here, the fundamental outcome was that the Canal Zone began using overprinted United States stamps in the Zone for the rst time since 1904. At the time the de nitive stamps of the United States were the Fourth Bureau Issues, which had been introduced in 1922. Values ranging from ½c to $1 were overprinted for the Canal Zone.

There are two distinct varieties of the overprint: the initial Type I (the so-called “Flat A”), and beginning in 1925 the Type II (the so-called “Sharp A”). Beginning in late 1926 the basic United States stamps used were printed on a rotary press, although the overprint remained Type II.

Given the relatively long lifespan of these stamps and the large quantities produced, a number of errors were produced. These include completely inverted “Canal Zone” overprints, just the word “Zone” inverted, shifted overprints resulting in a “Zone Canal” overprint, and many other interesting varieties.

Permanent Series Stamps and Covers

In 1928, the Canal Zone Postal Service issued its rst two postage stamps of distinctive Canal Zone design: a 1c stamp depicting William C. Gorgas (head of the Panama Canal Zone Sanitation Commission) and a 2c stamp depicting General George Washington Goethals (engineer and rst Governor of Panama Canal Zone). Over the following decades, the Canal Zone would continue to release both de nitive and commemorative stamps until the Canal Zone Postal Service ceased operations on September 30, 1979.

The Canal Zone’s de nitive and commemorative stamps were produced by the Bureau of Engraving and Printing in Washington, DC, giving them a similar aesthetic to many stamps being produced for the United States and Philippines during this same period. The large printing gures to satisfy the demands of collectors, combined with the relative lack of major errors, means that nearly all stamps produced during this period are easily attainable.

However, this period also gave rise to the most recognizable error in all of Canal Zone philately. A 4c stamp was produced to celebrate the opening of the Thatcher Ferry bridge and was designed with a silver bridge printed onto the underlying stamp. Only a single pane of 50 with the bridge omitted reached the public’s hands.

The Paul Ammons Collection of Canal Zone Airmail Stamps and Postal History

December 16, 1948 - May 2, 2022

Paul Ammons was an avid stamp collector, exhibitor, and researcher. Although he began collecting stamps in earnest during the early 1970s, he quickly narrowed his focus to the Canal Zone. Between 1988 and 2019 he exhibited parts of his growing collection and won numerous medals and specialty honors at international, national, and regional venues, including the Canal Zone Silver Medal at APS 2019; Gold at APS 2015, Westpex 2014, Nojex 2011, APS 2008, Westpex 2008, and Westpex 2000; Vermeil at Paci ca ’97; APS Award of Excellence for a 19001940 exhibit, APS Award of Excellence for a 1940-1980 exhibit, and Best Air Mail Exhibit at a national show by the American Air Mail Society. Paul was particularly proud of his Canal Zone Second (First De nitive) Air Mail Series, focusing on stamps rst issued in 1929.

In addition to collecting and exhibiting, Paul was a researcher and proli c writer. He published over 50 articles in the Canal Zone Philatelist on topics spanning from overprints to types of mail. In recognition of his 2016 scholarship, he was recognized with the 2017 Dick Salz Award for his continuing series on WWII censorship in the Canal Zone.

The Paul Ammons Collection re ects his fty years of dedication to Canal Zone stamps and includes his expansive reference material as well as his extensive collection.

Airmail Including the Paul F. Ammons Collection

The rst Canal Zone airmail stamps were prepared by overprinting regular issues in 1929; it would not be until 1931 that the rst permanent series of airmail stamps made its way to the public. Depicting a ship in the Gaillard Cut with an airplane overhead, this is certainly one of the most attractive stamps of the Canal Zone and was issued in a number of colors and denominations. This issue was also overprinted for of cial use, leading to further avenues of specialization.

The Paul F. Ammons Collection of the rst permanent airmail series is almost certainly the nest collection of this issue ever assembled. From preproduction sketches by Meade Bolton, the architect of the Panama Canal, to uses of both the regular and of cial stamps, Mr. Ammons was able to tell the story of this issue in an exceptionally thorough and comprehensive manner.

In addition to the obvious highlights (the sketches and essays), we encourage collectors to take a close look at the postal history group lots (all of which are imaged on our website), as they represent a remarkable array of destinations that would prove nearly impossible to replicate. It is evident how much Mr. Ammons valued and enjoyed his collection, and we look forward to providing a new group of collectors that same opportunity.

Airmail O cial Stamps

and Covers

Between 1915 and 1941 the Canal Zone did not produce of cial stamps, but instead perforated regularly-issued stamps with the initial “P”. These were to be used on all of cial mail that did not qualify for penalty envelopes. Beginning in 1929 airmail stamps were likewise perforated for use on of cial airmail. These per ns can be found in a variety of different orientations, and all are rare on cover.

Beginning in 1941, the Canal Zone determined that the perforation was too dif cult to detect and instead endeavored to produce overprinted stamps for of cial use. Two different three-line overprints were used on 1c through 50c stamps (the 5c stamp had a longer, twoline overprint). The 50c stamp with type IA overprint holds the distinction of being the rarest non-error Canal Zone stamp of the post-1924 period.

Postage Due Stamps and Covers

Although the Canal Zone did not formally issue postage due stamps until 1914, prior to this date several postmasters precancelled regular postage stamps for use on short-paid mail. Most notable of these was Pedro Miguel’s postmaster Gerald D. Bliss, who used distinctive handstamps to create his provisional stamps.

Following these early forerunners, Canal Zone postage due stamps were overprinted on (in order): United States postage dues (1914), Panama postage dues (1915-22), United States postage dues (again in 1925)), United States regular issues overprinted for use in the Canal Zone (1925), United States postage dues (a third time, also in 1925), and the 5c 1929 Canal Zone issue (1929-30). Finally in 1932 the Canal Zone received their rst permanent postage due stamps, produced by the Bureau of Engraving and Printing in Washington, DC.

Although the Canal Zone did not formally issue postage due stamps until 1914, prior to this date several postmasters precancelled regular postage stamps for use on short-paid mail. Most notable of these was Pedro Miguel’s postmaster Gerald D. Bliss, who used distinctive handstamps to create his provisional stamps.

Following these early forerunners, Canal Zone postage due stamps were overprinted on (in order): United States postage dues (1914), Panama postage dues (1915-22), United States postage dues (again in 1925)), United States regular issues overprinted for use in the Canal Zone (1925), United States postage dues (a third time, also in 1925), and the 5c 1929 Canal Zone issue (1929-30). Finally in 1932 the Canal Zone received their rst permanent postage due stamps, produced by the Bureau of Engraving and Printing in Washington, DC.

Postal Stationery Envelopes

The rst postal stationery envelopes created for the Canal Zone were bicolor designs of the Republic of Panama with the words “Canal Zone” added to the vignette die. Various other Panamanian designs were used until 1924, when the Taft Agreement expired and United States envelopes were overprinted for use in the Canal Zone. Later in 1924, envelopes were produced with a distinctive Canal Zone design. Beginning in 1928, Canal Zone stationery envelopes were overprinted with red and blue bars for air mail use.

In 1918, six years before the rst regular Canal Zone stationery envelopes, registry envelopes from the Republic of Panama were overprinted locally for use within the Canal Zone. This short-lived experiment came to a close by 1921, at which point Panama obliterated the “Canal Zone” overprint on unused envelopes and used them within the Republic.

Postal Cards

The rst postal cards issued for use in the Canal Zone (1907) were overprinted cards from the Republic of Panama which bear the common “map” design type of contemporary adhesives. These 2c cards were revalued to 1c. The following year, new cards were prepared with the 1c Balboa design type from the Hamilton Bank Note Company. Postal card designs would mirror stationery envelope designs until 1924, when United States postal cards were overprinted for use in the Canal Zone.

1958 saw the release of the rst airmail postal cards, along with a new series of regular postal cards with designs produced especially for the Canal Zone. Between 1913 and 1923 the Panama Canal Press at Mount Hope produced special Christmas postal cards at the request of the Canal Zone Commission. All of these Christmas cards are very rare.

Terms and conditions

TITLE; DEFAULT

1. Unless announced otherwise by the auctioneer, all bids are per lot, as numbered in the printed Catalog. H.R. Harmer, as agent for the consignor or vendor, shall regulate the bidding and shall determine the manner in which the bidding shall be conducted. Harmer reserves the right to withdraw any lot prior to sale (without liability to any potential purchaser or agent), to re-offer any withdrawn lot, to divide a lot or to group two or more lots belonging to the same consignor or vendor, and to refuse any bid believed not made in good faith.

2. The highest bid acknowledged by the auctioneer shall prevail. Should a dispute arise between bidders (including a dispute between a floor bidder and the auctioneer acting on behalf of a mail bidder, consignor or vendor), the auctioneer alone shall determine who is the successful bidder and whether to reoffer the lot in dispute. Should a dispute arise after the sale, the auctioneer’s sale records shall be conclusive. On all lots sold, a commission of 18% on the hammer price is payable by the buyer.

3. (a) The auctioneer reserves the right to bid on behalf of clients (and consignors or vendors) but shall not be liable for errors and omissions in executing instructions to bid, however received, and whether such errors or omissions be those of the bidder or agent or those of the auctioneer.

(b) All lots are offered subject to a reserve price. The auctioneer may implement such reserve price. The auctioneer may implement such reserve price by bidding on behalf of the consignor vendor.

(c) It may also be assumed that all consignors have been advanced monies against the sale of their stamps and Harmers therefore has a security interest over and above the normal auction commission.

(d) Purchases made by a consignor or vendor or his agent on his own lots shall be considered as a sale subject to commissions and sales tax as applicable.

(e) Agents are responsible for all purchases made on behalf of their clients, unless other arrangements have been confirmed in writing prior to the auction.

(f) HRHarmer further reserves the right to ban any bidder from participation in its’ sales for any reason deemed appropriate in its’ sole discretion.

(g) HRHarmer retains the right to demand a cash deposit from anyone prior to bidder registration and/or to demand payment at the time the lot is Hammered down to the highest bidder, for any reason whatsoever. In the event that any buyer refuses or fails to make payment in cash for any lot at the time it is knocked down to him, the auctioneer reserves the right to reoffer the lot for sale to the highest bidder.

PAYMENT FOR PURCHASES

4.

(a) Subject to any extension of credit (which shall be made in accordance with Harmers’ credit policies and requested prior to the commencement of the auction), payment for lots shall be as follows:

(i) Floor Bidders. All floor bidders must register prior to the beginning of sale. All invoices to Floor Bidders shall be due on theday of the auction.

(ii) Mail Bidders. A successful mail bidder will be notified of lots purchased. Payment is due within ten (10) business days of auction. Mailed delivery will be to the address on the bid sheet and proof by Harmers of receipt of a sending at the advised address shall constitute delivery. All charges for handling and delivery shall be added to your invoice. All shipments sent by Harmers are fully insured against loss in transit unless otherwise requested.

(iii) Where an opinion of a generally recognized authority is desired, payment is still due within ten (10) business days of auction. We will hold the funds while we send the items to the recognized authorities.

(b) Payment is accepted in the form of

(i) Check in U.S. dollars drawn on a U.S. bank. If payment is made by check, Harmer’s reserves the right to hold shipment/delivery for up to ten (10) business days while it clears.

(ii) By wire transfer. Harmers will credit your account with the actual USD s credited to our account net of any fees.

(iii) By credit card (MasterCard, Discover or Visa). Payment by credit card is accepted as payment but will be subject to a 3% Convenience fee. This fee will be added to the total of the invoice including hammer price, buyer’s premium, shipping and other applicable taxes and fees.

5. (a) Subject to the fulfillment of all of the conditions set forth herein, on the fall of the auctioneer’s hammer, title to the offered lot will pass to the highest bidder acknowledged by the auctioneer, and such bidder the reupon (a) assumes full risk and responsibility therefore, and (b) will pay the purchase price as set forth in Conditions of Sale 4.

(b) In addition to other remedies available to us by law, we reserve the right to impose from the date of sale a late charge of 2% per month if payment is not made in accordance with the conditions set forth herein. Unless otherwise agreed by Harmers, all property must be removed from our premises by the purchaser at his expense not later than 10 business days following its sale.

(c) If any applicable conditions herein are not complied with by the purchaser, the purchaser will be in default and in addition to any and all other remedies available to us and the Consignor by law, including, without limitation, the right to hold the purchaser liable for the total purchase price, including all fees, charges and expenses more fully set forth herein, we, at our option, may (x) cancel the sale of that, or any other lot or lots sold to the defaulting purchaser at the same or any other auction, retaining as liquidated damages all payments made by the purchaser, or (y) resell the purchased property, whether at public auction or by private sale, or (z) effect any combination thereof. In any case, the purchaser will be liable for any deficiency, any and all costs, handling charges, late charges, expenses of both sales, our commissions on both sales at our regular rates, legal fees and expenses, collection fees and incidental damages. We may, in our sole discretion, apply any proceeds of sale then due or thereafter becoming due to the purchaser from us or any affiliated company, or any payment made by the purchaser to us or any affiliated company, whether or not intended to reduce the purchaser’s obligations with respect to the unpaid lot or lots, to the deficiency and any other amounts due to us or any affiliated companies. In addition, a defaulting purchaser will be deemed to have granted and assigned to us and our affiliated companies, a continuing security interest of first priority in any property or money of or owing to such purchaser in our possession or in the possession of any of our affiliated companies, and we may retain and apply such property or money as collateral security for the obligations due to us or to any affiliated company of ours. We shall have all of the rights accorded a secured party under the New York Uniform Commercial Code (UCC ).

(d) Payment will not be deemed to have been made in full until we have collected good funds. Any claims relating to any purchase, including any claims under the Conditions of Sale, must be presented directly to Harmer. In the event the purchaser fails to pay any or all of the total purchase price for any lot and Harmer nonetheless elects to pay the Consignor any portion of the sale proceeds, the purchaser acknowledges that Harmers shall have all of the rights of the Consignor to pursue the purchaser for any amounts paid to the Consignor, whether at law, in equity, or under these Conditions of Sale.

EXHIBITION AND INSPECTION OF LOTS; QUALITY AND AUTHENTICITY

7. (a) On Premises Inspection and Postal Viewing. Ample opportunity is given for on premises inspection prior to the auction date, and, upon written request and at Harmers discretion, for inspection by postal viewing (all as detailed elsewhere in this Catalog).

(b) Each lot is sold as genuine and correctly described, based on individual description as modified by any specific notations in this Catalog, including but not restricted to the section entitled "Key to Cataloguing”.

(c) Quality. Any lot which a purchaser considers to be incorrectly described may be returned to Harmers within two weeks of its receipt by such purchaser ("Returning Purchaser”), provided, however, that the same is received by Harmers within four weeks of the date of the auction; however, Harmers may, in its discretion, refuse acceptance of such returned lot. If an opinion of a generally recognized authority is desired, the period of time within which a lot must be received by Harmers will be extended in accordance with Condition of Sale 8. In the event that a dispute cannot be resolved by reference to a generally recognized authority, and Harmers thereupon undertakes to re-offer the lot with a description identical to the description disputed, the Returning Purchaser shall be liable for the deficiency, if any, between the proceeds of the sale to the Returning Purchaser and the proceeds of a sale to a subsequent purchaser, as well as for all costs and expenses of the re-sale, including commission, and all incidental damages. Any lot, the description of which is disputed, must be returned intact in the condition received by the purchaser. The following lots are not returnable except at the discretion of Harmers:

(i) lots from purchasers who attended the exhibition of the lots;

(ii) lots examined by postal viewers; (iii)lots on account of their appearance, if they are

illustrated in this Catalog; (iv) lots described as having repairs, defects or faults— for any reason; (v) U.S. stamps (through 1918) for reasons of paper inclusions, (vi) no encapsulated stamps unless originally offered in this condition. (vii) Multiple stamp/item lots including sets of 15 or more stamps, collections, large lots and group lots, whether certified or not, as sold "As Is” and are not returnable for any reason.

(d) Authenticity. Any lot which is declared otherwise than genuine by a generally recognized authority is returnable, provided such lot is received by Harmers within four weeks of the date of the auction. Proof that a generally recognized authority declines to express an opinion is not grounds for the return of a lot.

(e) Expenses incurred in the submission and the return of a lot under Conditions of Sale 7-9 are not refunded.

EXTENSION OF TIME

8. All lots to be sent out on extension must be paid in advance and submitted by H.R. Harmer.

(a) If a lot is certified by a generally recognized authority to be other than as described:

(i) the sale (and the invoice with respect thereto, if outstanding) will be cancelled; an

(ii) to the extent set forth in Condition of Sale 9, payment of the expense of certification will be made to the purchaser.

(iii) in the event any item "not as described”, the buyer will be refunded the purchase price and certification fee up to $500 unless otherwise agreed.

(b) Any lot with a P.F. or PSE certificate issued in the last six years is not eligible for extension.

EXPENSES OF CERTIFICATION

9. Expenses of certification shall be borne by the purchaser except where a lot is certified other than as described and is returned to Harmers in accordance with Condition of Sale 8.

SALES TAX

10. All lots sold are subject to any applicable sales tax (or customs duty for non-U.S. buyers) unless a valid resale permit is presented.

SHIPPING OF PURCHASED LOTS TO ADDRESSES OUTSIDE THE UNITED STATES

11. Lots will be shipped by Federal Express (street addresses) or by USPSExpress Mail (PO boxes) with a minimum fee of US$50 per shipment. If you wish to have your purchases delivered by another method, you must make your request in writing before the sale. You will need to prepay your invoice in full and guarantee that once the package is accepted by the postal service or other courier that HR Harmer, GPN Inc. is not liable for any loss or damage to the package, and that should any loss or damage take place, HR Harmer, GPN Inc. is not obligated to make refund or restitution.

JURISDICTION, VENUE, CHOICE OF LAW:

12. (a) Dispute resolution shall occur in New York County, New York, USA. The provisions of the Conditions of Sale will be construed and disputes determined by application of New York Law.

(b) Notice, Service of Process: Buyers agree to accept all notices and service of process relating to dispute resolution at the address provided by Buyer on any registration forms required to be executed as a condition of bidding in our auction.

(c) Dispute Resolution: All disputes and claims arising out of or relating to events and actions covered herein, brought by or against us, shall be resolved by mediation or binding arbitration in accord with the procedures set forth below. This provision does not apply to claims brought by the Buyer directly against the Consignor, including, but not limited to any action brought pursuant to the rescission provisions noted above.

MEDIATION AND ARBITRATION PROCEDURES

13. (a) Within 30 days of written notice that there is a dispute, the parties or their representatives may meet at a time and place mutually agreed upon, to mediate their differences. If the parties agree, a mediator acceptable to the parties shall be selected. The mediator shall be an attorney, trained in mediation techniques and familiar with commercial law and the UCC. The mediator’s fees shall be shared equally and paid by all parties. At the mediation, all parties shall have actual authority to settle the dispute. Any statements made during, and all aspects of, the mediation process shall be kept confidential and shall not be admissible in any subsequent arbitration or judicial proceeding. Any resolution shall be confidential.

(b) If the parties cannot agree to mediation, or if mediation does not resolve the dispute, or in any event no longer than 60 days after receipt of written notice referred to above, the parties shall submit the dispute for binding arbitration before a single neutral arbitrator jointly selected, or absent agreement, selected from the panel of Arbitrators provided by the American Arbitration Association (AAA ). If, within 15 days, the parties cannot agree on an arbitrator, then AAA shall select one (1) person as arbitrator in accord with AAA rules. The arbitrator shall be an attorney, experienced in commercial law and with the UCC. The arbitrator shall be required to follow the law in making his award, and the award shall be in writing and shall set forth findings of fact and legal conclusions.

(c) The arbitration shall occur within 60 days of the selection of the arbitrator, in New York County, New York, unless the parties agree to another location. Discovery and the procedure for the Arbitration shall, unless otherwise agreed to by the parties, follow the procedures and policies of AAA governing commercial arbitration, subject however to the following modifications:

All arbitration proceedings shall be confidential. None of the parties nor the arbitrator may disclose the existence, content or results of the arbitration without the written consent of all parties.

The parties shall attempt to agree on the issues to be arbitrated, or identify the disputed issues in writing no later than 45 days prior to arbitration.

Unless otherwise agreed by the parties, discovery, if any, shall be limited as follows:

(a) Requests for no more than 10 clearly identified categories of documents, to be provided to the requesting party within 14 days of written request therefore;

(b) Depositions: No more than two (2) per party, provided however, the deposition(s) are to be completed within one (1) day; (c) Compliance with the above shall be enforced by the arbitrator in accord with New York law.

Each party shall have no longer than eight (8) hours to present its position. The entire hearing before the arbitrator shall not take longer than three (3) consecutive days, unless all parties agree otherwise in writing.

(d) The award shall be made in writing no more than 30 days following the end of the proceeding. Judgment upon the award rendered by the arbitrator may be entered by any court having jurisdiction thereof. Each party shall bear its own attorney’s fees and costs in connection with the proceedings and shall share equally the fees and expenses of the arbitrator.
