Die Lose werden mit grosster Sorgf alt beschr ieben . HARMERS AUC TIONS S.A . ubernimmt jed och keine Verantwortung fur solche Angaben . Fotographien sind integrierender Bestand teil der Beschreib ung : die Abbildungen fur Rand, Stempel , Zahnung und Zentrierung sind massgebend .

Die Hinterlegung der Lose bei HARMERS AUCTIONS S.A . nach der Frist von 7 Tagen geht zu Lasten des Kaufers . H/\RMERS AUCTIONS S.A . haftet auf keinen Fall fur Verluste oder Schade n die vom Zuschlag der Lose bis zur Besi tznuhmc seitens des Ktiufers cIntrtHen sollen.

17. Falls die Lose innerhalb von 30 Tagen nach dem Verkauf wed er abgeholt noch bezahlt sein sollten , behalt sich HARMERS AUCTIONS S. A .. nach freiem Ermessen, lolgende Rechte und Rechtshandlung en vor : a) den Kaul ohne weitere Benachrichtigung an den Kaufer auflos en; b) die betreffenden Lose verkaufen ; c) Rechtsw ege beschreit en um die Bezahlung ihres Guthabens durchzusetz en ;

4 . Alie im Katalog erwahnte Lose konnen vor oder wiihrend der Verste igerung besicht igt werd en. Bei Auktionsteilnehm ern, sei es dass sie personlich oder als Bevollmachtigte handeln, w ird vorausges etzt, dass sie im vo raus alle Lose besichtigt haben. Die Lose werden somit in dem Zustand , in dem sie sich beim Zuschlag belinden , angenommen und nicht unbedingt wie im Katalog beschrieben.

d) Schadenersatz verlangen, der , unter anderem , jeden mit dem W iederverkauf in Beziehung stehenden Verlust , und die zw e, Verkauf e betref fende Ausgaben und Gebuhren umfasst. e) die Lose bei Dritten Hinterlegen auf Kosten und Verantwortung des Kaufers .

5. Der Meistbietende erhiilt den Zus chlag . HARMERS AUCTIONS S.A . hat das Recht , be, Anfechtungen , den Zuschlag zu annullieren und das oder d ie Lose w ieder zu versteigern .

18. HARMERS AUCT IONS S.A . wird einen Zins von 5 % fur den ersten Monat und von 1% jeden darauffo lgenden Monat verlangen, falls Kaufpreis und Provision innerhalb von 30 Tagen nach Verkauf nicht bezahlt werden sollten ; Punkt 17 dieser Allgemeinen Bedingungen bleibt vorbehalten .

6 . Jedes Gebot muss das vorangehende um 5 % ubenreffen. HARMERS AUCTIONS S.A . behiilt sich das Recht vor , nach ihrer Wahl , andere Prozentsii tze festzulegen . 7 . HARMERS AUCTIONS S.A . kann vor Beginn der Steigerung schriftliche Gebote entgegennehmen . Die von HARMERS AUCTIONS S.A . erhaltene schriftliche Gebote haben jedenfalls Vorrang vor Saalgebot en. gen. HARMERS AUCTIONS S.A . behalt sich das Recht vor , gew issen Personen den Zugang zum Aukt ionsraum zu vcrweige rn.

12. Der Bieter , welcher aur Rechnung Drinen handelt , muss es vor Beginn der Verste igerung mitt eilen : er ist pcrsonli ch haftbar insbesonders im Bezug au! die durch Verst eigerung eingegangenen Verprhchtungen . Diese Hartung erstr eckt s,ch auf die Bes,chtigung und Oualitii tsprufung der gekauften Lose, sowi e auf die Zahlung der den Kaur betreffenden Rechnung und er ist gleich einem Soldarschuldner fur alle aus der Verst eigerung sich ergebene Verpfhchtungen haftbar, insbesonders fur die einige, die die Prufung der Lose und die Zahlung der gekauften Lose betreffe n . 13. Der Kiiuler muss an HARMERS AUCTIONS S.A . den Kaufpreis und eine Provision von 15% des Kaufpreises zahlen fur Waren , die ausserhalb der Schweiz gelielert werd en. Fur War en, die in der Schweiz gelielerte werden , betriigt die Provision 21 ,2% (inbegriffen 6,2 % Wust) . Die Wust wird zuruckerstanet , falls die Ware innerhalb eines Jahres vom Kaul, exportien wird . 14. Beim Zuschlag geht die Gefahr der gekauften Lose dem Kiiufer uber . Die Lose werden dem Kaufer jedoch erst bei voller Begleichung des Kaufpreises und der Provision ausgehand1gt. 15. Der im Saal anwesende Kaufer verpflichtet sich , abgesehen von einer Ver einbarung mI1 HARMERS AUCTIONS S.A ., den Kaufpreis und die Prov ision in Schwe izertranken sofon nach Zuschlag und gegen Au shii ndigung der gekauften Lose, zu zahlen. Kauler, mittels schriftl icher Gebote , verpflichten sich den Kaufpreis und die Provision in Schweizerfranken zu zahlen bei Erhalt der ihnen von HARMERS AUCTIONS S.A . zugestellten Rechnung . In diesem Fall behalt HARMERS AUCTIONS S.A. die zugeschlagenen Lose bis zur vollstandigen Bezahlung des Kaufpreises und der Provision . HARMERS AUCTIONS S.A . wird die betreffenden Lose per Post zustellen , nach Erhalt des Saldobetrages und wenn von Kaufer verlangt . Alie aus dem Postversand entstandenen Kosten gehen zu Lasten des Kaufers . 16. Die wahrend der Versteigerung gekauften und nicht per Post versandten Lose, mussen spatest ens innert 7 Tagen nach der Auktion abgeholt wer den : Gefahr und Spesen ubernimmt der Kaufer.

19. Bis zur vollstiind igen Bezahlung burgt der Kiiuf er gegenuber HARMERS AUCTIONS S.A. mit dem gekauften Materia l. Dieses Pfand garant iert die Zahlung des Preises, der Zinsen , der Kommission und anderer Unkos ten. HARMERS AUCTIONS S.A . ist berechtigt aber nicht verp flicht et die verpfandet e Ware formlos und ohne Vorankund igung zu veraussern, wenn der Kaufer in Zahlungsverzug gerat , oder seinen Verpflichtung en nicht nachkommen sollt e. In diesem Fall ist HARMERS AUCTIONS S.A . nicht verpfli chtet den Vorsch riften des Bundesgesetzes uber Schuldbetreibung und Konkurs zu folgen . 20. Falls die Echtheit eines Loses in Frage geslellt w erdcn sollte , so kann der Kaufer, innerhalb von 30 Tagen seit dem V ersw, gerungsdatu m, ein von einem Fachmann ausgestelltes Gut achten als Rechtfe rt19ung seiner Rekla mation beibringen . Diese Befugnis des Kaurer s 1st ausyeschlossen , falls das Los m it einem Guta chten schon versellen war ; das Guta chten ist in

diesem Fall fur den Kaufer verbindlich . Im Besitz der Reklamation und des Gutacht ens behalt s,ch HARMERS AUCTIONS S.A . das Recht vor , ihrerseits ein oder mehrere Gutachten zu verlangen um die Begrundung der Reklamation zu pruf en. Alie mit dem Gutacht en in Zusammenhang stehenden Unkosten gehen zu Lasten des Verkiiufers, falls das Gutachte n des Kaufers und das einige von HARMERS AUCTIONS S.A .. die Begrundung der Reklamat ion beweisen sollten . Wenn die Reklamation begrundet ist , w ird HARMERS AUCTIONS S.A . das Los zurucknehmen und nur fur Forderungen haften , die der Ruckzahlung des Kaufpreises und der Kommission gleichkommen . HARMERS AUCTIONS S.A . gegenuber konnen keine we iter e Fo rderungen geltend gemacht werd en. ANNIVERSARIES When Harmers auctioned the first portion of the Dale/ Lichtenstein collections in New York in 1968, the sale was held at the same time as the 50th Anniversary of H.R. H armer Ltd . in London, the parent company. Now, some twenty years later , it is wit h great pleasure that we proclaim the 50th anniversary of H armers of New York and the 10th Anniversary of Harm ers of London , along with the formation of a new H armer Gallery in Swi tzerland. Family-o w ned and managed since 1918, spanning three generations on two sides of the Atlantic, each of our offices celebrates its own ve ry significant birthday and, again in conjunction wi th this important occasion in our history, the selling of the second portion of the collections.
