In recent years, Italy’s pharmaceutical industry has benefited from excellent academic and industrial research, on top of the actual technologies and products developed. “Italy’s success is due to the increase in exports, which nowadays are estimated to be around €25bn,” explains Alessio Brunello, a healthcare analyst at GlobalData. “The significant growth of the market in the past ten years has been determined completely by exports, which grew fifteen fold between 1991 and 2017.” ICHAM is proud of the outcome and wishes that Pharmacy made in Italy could keep backing pharmaceutical importers and exporters.

Vietnam Labor Code 2019: What’s new? Since it was first promulgated in 1995, The Labor Code of the Socialist Republic of Vietnam has undergone amendments and addition for four times, the last one in 2012 was considered the most fundamental and comprehensive revision. However, in the process of trade integration and law application, the code shows many limitations. In addition, with the enactment of the 2013 Constitution, the Labor Code needs to be adjusted to comply with the Constitution and ensure the balance of interests between employees and employers. Regarding international integration, Vietnam has signed 25 new generation Free Trade Agreements including CTPPP and EVFTA, which require member states to comply with the international labor standards of the International Labour Organization (ILO). Therefore, it is paramount important to apply and supplement ILO regulations into the amended Labor code. On November 20th, 2019, the new Labor Code is voted and approved by Vietnam National Assembly (NA). The amended content will focus on the key aspects as follow: First of all, in terms of application scope, the code is extended its scope to the group of freelance workers, those doesn’t participate in an official employee-employer relationship. Currently, the number of freelance workers in Vietnam accounts for a significant proportion, therefore the labor code also needs to protect their legitimate rights. Working-hour matter is also attracting many opinions. NA acknowledges the comments which are focused on requesting to raise 1 more day as national holiday, increase overtime limit, as well as debating whether it is acceptable to increase retirement age, and has made some changes accordingly.

Accordingly, the increase in retirement age will follow a specific schedule. Eventhough some suggested that raising the retirement age will reduce labor quality and specifically employee’s health, the NA believes that the raise of retirement age is necessary for the labor shortage situation in the future. The retirement age for employees under normal working conditions is adjusted to 62 years old for male by 2028 and 60 years old for female by 2035. Regarding overtime limit, previously in a business briefing with European companies in Vietnam, Mr. Bui Sy Loi, Vice Chairman at National Assembly’s Committee for Social Issues stated that even though the demand to raise overtime limit comes from both employers and employees, it is also necessary to consider the attrition and long-term impact on employees’ health. Following the spirit, the amended Labor Code set the limit for overtime at 50% of normal-working hour per day, 40 hour per month and 200 hour per year. In special cases such as production of textiles, garments, electronics, processing of agricultural, forestry, and aquatic products for export, the maximum overtime hour is 300 hours per year, despite some previous suggestions to raise maximum overtime limitation to 400-500 hours per year. Furthermore, another important matter was added in the amended Labor Code are the right to establish a representative organization of employees in the enterprise other than the labor union. The representative organization shall be registered with competence authority, as well as operate according to its Article of Association. The probation period the probationary period under the current law – set from 6 to 60 days, depending on the qualifications of the recruited position- is considered to be quite short, not enough time for employers to train and evaluate the suitability of employees to the company standard. Therefore, the new code

determines a probation period of maximum 180 days to manager positions. The code also considers a more flexible mechanism regarding the termination of probation contract, in which employees have the right to

terminate the labor contract without a reason, and only need to notice employers within a specific period. The revised Labor Code will be effective since January 1st, 2021.

Manufacturing in Vietnam: How to get Vietnam Origin verification for your product? In the recent years, there is no secret that Vietnam has become a potential investment destination for foreign manufacturing enterprises, especially from Japan, Hong Kong, South Korea and China. Also thanks to the effect of the upcoming EVFTA (EU-Vietnam Free Trade Agreement), a raising number of enterprises from European countries also show great interest in moving their production to Vietnam. Therefore, a question has been raised: how could manufacturing companies obtain the “Vietnam Certificate of Origin” to their goods, in order to enjoy preference treatments on the goods manufacturing in Vietnam, as well as the reputation of Vietnam products? Generally speaking, the Vietnam Certificate of Origin (C/O) is a written document issued by the competent authority, to verify that certain goods are qualified as Vietnamese products under the regulated laws. In this article, we will provide to readers an overview of this certificate, as well as the qualification to obtain it. Competent authority to issue the Certificate of Origin is the Ministry of Industry and Trade. Depending on the provinces, form of C/O applied, the Ministry authorized the issuance power either to the Vietnam Chamber of Commerce and Industry, Export – Import Management Office, or Management Board of Industrial Zone. Upon the receipt of a complete and legitimate dossier, the C/O will be granted within 7 working days. Not all goods “produced” in Vietnam can obtain such certificate, but only those which meet

all the requirements. The criteria for issuing C/O also vary based on the type of exported goods, the importing countries, and the preference policies between Vietnam and importing countries from time to time. Therefore, when applying for preferential form of C/O, it’s necessary to first study carefully the applied GSP (Generalized System of Preferences), the FTA (Free Trade Agreements) of Vietnam and the importing country, or any unilateral preference such country may grant to Vietnam products. Currently, Vietnam is a party of many effective FTAs, including those with ASEAN, Japan, South Korea, China, Australia, New Zealand, India, Chile, etc, as well as receives GSP preference from many other countries include 27 countries of European Union. In other situations when the importing country doesn’t apply any preference for a certain type of Vietnamese goods, enterprises shall follow the regulations on Decree 31/2018/ND-CP on Guidelines for the Law on Foreign Trade Management in terms of Origin Of Goods in such cases. The Decree provides a list of goods considered as wholly produced in Vietnam, and no further requirements needed to obtain C/O Vietnam. The list includes most of natural products, such as: plants, farm animals, mineral and their products, etc. However, practically speaking, most of industrial products do not qualify as wholly obtained in Vietnam, and therefore they have to

MARKET INFO 48 meet requirements set on the Decree, which are both: (1) last transformation manufacturing stage happened in Vietnam, and; (2) meet the specific requirements for each type of products on the List of Product Specific Rules, which refer to the CTC (Change in Tariff Classification) or LVC (Local Value Content). By setting two specific ways CTC and LVC, Vietnamese laws show its openness and welcome to manufacture enterprises. Accordingly, foreign enterprises may still partly produce, assemble their products oversea, as well as import materials from oversea suppliers. More specifically, in case of using CTC method, enterprises may import any part or component to create the product, as long as such component underwent the conversion of HS code to be-

49 MARKET INFO come the final product in accordance with statutory regulations. In case of using LVC method, they need to guarantee that Vietnamese materials occupy a certain percentage of the product value. In most cases, the Certificate of Origin is the compulsory document in the export dossier. In term of preference treatment, C/O is also an important reference document to evaluate whether a certain product may receive tariff exemption from a partner country. Completing the legal framework of origin is an essential step of Vietnam strategy in building the global prestige for Vietnam products. Therefore, it is paramount important that competence authorities maintain the legal compliance, as well as raise awareness of businesses to develop and protect this reputation.
