ast week, homeowners crowded the Meridian City Council chambers to urge the denial of proposed apartments next to their homes. I’ve heard similar pleas from homeowners a few times in my three years on the Meridian beat. A home is often a person’s largest investment. It’s their haven, the place where they can have some privacy and control. I can see how proposed apartments next door could threaten that environment. But growth is also fueling Meridian’s economy, bringing tax dollars into the city and creating jobs. Apartments, specifically, create more housing options. The debate at the Dec. 1 City Council meeting was about new apartments proposed for the Easy Jet Subdivision. This is an unusual case, Meridian City Council President Charlie Rountree said, because even though the property is zoned R-4 (four dwelling units per acre), the development agreement reached between the city and the developer in 2002 allows the developer to use part of the property for commercial or multi-family development. The city has since developed a unified development code and doesn’t “blanket” zone property like that anymore, Councilman David Zaremba said.

But the council has to, in all these cases, weigh, ‘Well, is the new development consistent with the development that’s there?’” Rountree pointed to a recent 24/7 Wall Street study that ranked Meridian as the No. 1 city in the United States to reside. “That speaks well to what we’ve done and how we’ve gone about it,” he said.

“So unfortunately this is a leftover ghost from the past,” he said. But the homeowners buying a house in an R-4 zone didn’t realize there were caveats. I can see why this surprise would be upsetting. Rountree said one way to avoid that surprise would be to contact the city government — regardless of the city — to ask if there are any conditions on the zoning before buying a home. I heard the argument at last week’s public hearing that Meridian doesn’t need any more apartments. Rountree said it’s not City Council’s job to decide that. “We can’t say, ‘We have enough of this.’ That’s at the risk of the owner, the developers and the proprietor of whoever’s going to be doing that business,” Rountree said. “They wouldn’t be building apartments and spending that kind of money if they didn’t anticipate the need. And the City Council is not in that business.” With Easy Jet, the City Council can put conditions on the development, but multi-family use is consistent with the city’s 2002 agreement with the property owner. “That condition can be based on density, it can be based on architecture. It cannot be based on ‘We don’t want apartments,’” Rountree said. Like any growth spurt, Meridian’s rapid

he Boys & Girls Clubs of Ada County recently named Meridian High School junior Kayli McConkey as the 2016 Ada County Youth of the Year. “Youth of the Year recognizes the recipient’s outstanding contributions to the club, their family, school and community,” Colleen Braga, the clubs’ executive director, said in a statement Dec. 3. “Kayli enjoys giving back to her community, and models the club’s values of respect, reby Meridian Press staff news@mymeridianpress.com sponsibility and integrity.” McConkey has been an active member of Girl Scouts, drama and choir programs, FFA and the Keystone Club, a program that promotes community service and develops leadership qualities in youth. She also participates in Teens against Tobacco and took part in Drug Free Idaho’s Reality Party for Parents. “Because of the club, I have had many opportunities and great experiences,” McConkey said in a statement. “I have made good friends at the club, have had wonderful leadership experiences, and am on track to graduate from high school and attend college. Because of the club, I have people in my life I know I can count on.” McConkey is aiming to have a career as an equine veterinarian. She plans to earn a bachelor’s degree in animal science at the University of Idaho and continue on to veterinary school at the University of Colorado. For the award, McConkey receives a $1,000 scholarship from the Micron Foundation and an additional $1,000 from Fred Meyer. In February, she will compete with five youth from clubs throughout the state for the honor of becoming the 2016 Idaho State Youth of the Year.

Homeowners denounce proposed Easy Jet apartments Residents say they invested in neighborhood because of low-density zoning

M

eridian’s growing pains were evident when hundreds of residents packed the City Council chambers Dec. 1 to protest proposed apartments next to their homes. Jannette Mascorro, a mother of three, was almost in tears. “It took us 10 years to be able to buy our dream home, and that is what we thought we had,” she said. “We moved in Dec. 29, 2014. About three weeks after, we received our notice of the proposed development. Since then we’ve tried to make the home our own, but knowing that this is a possibility has definitely deterred us from continuing to make this our forever home.” Property owner Reginald Jones, represented Dec. 1 by by Holly Beech J-U-B Engineers, is proposing to build three apartment hbeech@mymeridianpress.com buildings adjacent to the homes of Mascorro and her © 2015 MERIDIAN PRESS neighbors, near the southeast corner of South Eagle Road and East Easy Jet Drive. The developer revised the apartments from three stories to two stories and limited the number of units to a total of 48 after neighbors voiced concerns. “As this project keeps furthering, I feel this box coming around our ... total life investment, where we thought we would spend the rest of our lives,” Mascorro said. Homeowners called on City Council members to set a precedent and protect existing homeowners’ quality of life. Many said they researched before buying their home, and the low-density residential zoning of their neighborhood attracted them. “Imagine going shopping for a home with your life savings or a 30-year investment,” homeowner Pam Judy said. “Would you personally choose a home adjacent to these apartment projects?” Though the zoning is currently R-4 (four dwelling units per acre), it was approved in 2002 at a time when Meridian handled zoning differently, Councilman David Zaremba explained. The area was given a blanket zoning with the understanding that the developer could come back and ask for use exceptions, he said. Associate City Planner Sonya Watters said the agreement in 2002 was that 20 percent of the property could be developed with different land uses. There were 11 lots on the original preliminary plat approved for office and multi-family use. The Homeowner Planning and Zoning Commission’s recommendation was that City Council approve the request. Traffic was a major concern for residents and council members.

Julie Palmer Fry

May 4, 1973 – October 20, 2015 Julie Fry, 42, of Meridian, Idaho passed away October 20th, 2015 after a courageous, hope-filled battle with breast cancer. Her husband was by her side when she drifted off to be with the Lord. She was born in Orange, Ca to Ron and Kathy Palmer on May 4th, 1973. She is survived by her husband, Eli Fry; children, Elijah and Heidi; mother Kathy Palmer, her sister Jennifer and niece Emma of Roseville, Ca; and her brother John of San Diego, Ca. She is also survived by several loving aunts, uncles, cousins and a countless host of friends. Julie was an amazing person, and she had the ability to touch everyone she met with a depth that is not commonly found. She had an amazing spirit and zest for life. She was a strong believer in Jesus, and she left a trail of love, joy, kindness, encouragement, inspiration, and strength everywhere she went. Julie had an extremely positive outlook on life, despite all her health strug-

gles these past four years. Besides passionately loving her family and savoring deep friendships with those around her, she had a love for adventures, traveling, and photography.. The passion behind the pageants Miss Treasure Valley’s Outstanding Teen dedicated to helping youth

ountain View sophomore Michaela George said 2015 has been amazing, inspiring and the “craziest year of my life.” In March, the 16-year-old was named Miss Treasure Valley’s Outstanding Teen. Next year, when she’s old enough, George hopes to compete for the Miss Idaho title and eventually to move all by Holly Beech hbeech@mymeridianpress.com the way up to the Miss America stage. © 2015 MERIDIAN PRESS George has used her platform to raise almost $1,000 for the Children’s Miracle Network Hospitals. “Once you learn how much it helps, it becomes just a part of you,” she said of supporting the network. “You want to help these kids, you want to see them happy, and you want to be able to help their families.” But this side of pageantry sometimes gets lost in the public eye and buried under stereotypes, George said. “I know that when you think of the pageant girl, you think of someone who is all about the makeup and the hair and the glitz and the glam. What people don’t understand is there is so much behind the scenes,” George said. “What they don’t see is she’s not out there just to show off that she has a crown and she has a sash. She’s out there to promote what she wants to see happen in the community.” George’s community efforts include being a part of the Meridian Mayor’s Youth Advisory Council, which has partnered with the local nonprofit Buckle Up for Bobby to advocate for a tighter seatbelt law for youth in Idaho. She has also coordinated a STEM clinic for girls at the Boys & Girls Club in Meridian, bringing in local female engineers to speak with students. Part of George’s inspiration for the clinic was an experience she had in middle school. “Growing up I was a part of a team called Future City,” she said.

‘The Establishment Strikes Back’ sums up the goings- on in West Ada Concerned Citizens of West Ada School District for Trustee Recall has begun an initiative to recall four school board members. The group which includes Christine Donnell and Reid Olsen, West Ada former superintendent and former board member respectively, and current board member Mike Vuittonet has targeted trustees Tina Dean, Carol Sayles, Julie Madsen and Russell Joki. Why? Recalls are generally associated with: anti-corruption campaigns, citizen grass-roots movements fighting a particular issue and old political battles that are being rehashed. Recalls are often used by groups who saw their preferred candidate lose in a general election and hope that a do-over will have a different result. In the case of West Ada, we may never know all the details, but more information is coming to the surface. The wording of the recall petition, emails and campaign messaging all provide clues. The petition states as reasons for the recall: “Failure to listen and respond to district patrons, unreasonable demands on district employees, disrespectful and disruptive behavior in board meetings and lack of transparency and fiscal responsibility.” Let’s examine the credibility of each claim and ask if the allegations rise to the level that justifies a recall. n “Failure to listen and respond to district patrons”: Since July, the board has posted patron questionnaires and held listening sessions on the busing situation, the levy and the superintendent’s search. Board members have made public statements inviting patron participation. n “Unreasonable demands on district employees”: To the contrary, the board has expressed concern over the time demands on administrators and teachers necessitated by the new teacher evaluation form. n “Disrespectful and disruptive behavior in board meetings”: Patrons attending meetings have reported no disruptive behavior except for the public interruptions made by a state senator and a Meridian city councilman during the Sept. 29 meeting. Patrons report that more questions are being asked and that the dialogue is productive. n “Lack of transparency and fiscal responsibility”: The board moved to correct an open meeting law violation and has received additional training on Idaho’s open meeting laws. As for fiscal responsibility, the board has complied with transparency requirements and continues to deal with the failure of the previous group to exercise due diligence on the new Hillsdale Elementary site. This resulted in “unanticipated” costs about $1.2 million to build a road, deal with an irrigation ditch and to bring in utilities. The reasons on the petitions do not pass the sniff test for a credible recall. A look at campaign messaging from May and recently uncovered emails leads one to conclude that this recall is about a do-over. A series of emails discovered when a citizen filed a public records request to examine the correspondence of then-superintendent Linda Clark reveals that Clark was engaging in dialogue with incumbent Ritter and elected officials regarding the board races. The files, which are too extensive to describe in this article, are posted on Facebook under “West Ada Files.” Voters made the choice on May 19, 2015. Patrons did not want business as usual where the political class makes the decisions. Many understood the tangle of relationships and cronyism that overtook the district as elected public servants too long in office became career politicians. This recall is about a do-over — an expensive do-over. The decision is up to the voters. Do you want an accessible and responsive board that works for you or a return to business as usual and a board that works for the establishment? n

West Ada board to invite superintendent candidate Mary Ann Ranells to tour district

he West Ada School District board voted unanimously Tuesday to invite superintendent candidate Mary Ann Ranells to tour the district, possibly for a couple days next week. The board is still accepting applications, Trustee Russell Joki said. Ranells’ education and teaching experience stood out to the board. Attorney investigates Trustee Vuittonet’s claim that board violated open meeting law

A

n attorney investigated the West Ada School Board’s Oct. 13 executive session after Trustee Mike Vuittonet claimed the board violated the open meeting law. He raised concerns that trustees had drifted off topic and had inappropriately discussed insurance matters behind by Holly Beech hbeech@mymeridianpress.com closed doors. After interviewing © 2015 MERIDIAN PRESS board members and attorney Susan Buxton, who was present at the meeting, the board’s associate general counsel Elaine Eberharter-Maki determined that no violation had occurred. She presented her findings to trustees at Tuesday’s board meeting. Buxton discussed insurance with trustees to give background about an allegation against the district’s insurance committee, Eberharter-Maki said. The concern, brought forth by Trustee Russell Joki, was that a member or members of the committee had misrepresented the board, causing the board to miss an opportunity to participate in a self-insured health insurance fund and save money. During that discussion, Trustee Carol Sayles brought forward a complaint about a different employee whom she was concerned misrepresented facts during a TV interview. Vuittonet said the board should not discuss insurance privately or shift to issues that weren’t the original purpose of holding the executive session. Idaho’s open meeting law, in code 74-206, section 2, states: “It shall be a violation of this act to change the subject within the executive session to one not identified within the motion to enter the executive session or to any topic for which an executive session is not provided.” After her investigation, which was requested by chairwoman Tina Dean, Eberharter-Maki said because the meeting agenda did include discussion about complaints against staff, bringing up an issue within those bounds was not a violation. The board’s discussion about either

personnel complaint did not lead to a vote or action after the meeting, she noted. Boards are required to identify which subsections of the open meeting law they are using to go into executive session — such as to discuss litigation or to discuss hiring an employee — but they are not required to break down the meeting agenda beyond those subsections, Eberharter-Maki said. Discussing insurance was OK because it was background information about a time-sensitive personnel matter, she said. Vuittonet stood his ground. “I believe that the noticing needs to be more specific, more defined,” he said. “Just by virtually reading the whole statement about an open meeting does not allow for boards to go in and all of a sudden pick this particular employee … or this particular situation (to discuss).” Eberharter-Maki encouraged board members to speak up if they ever have concerns. The board’s general counsel, William “Breck” Seiniger, said the investigation into Vuittonet’s allegation “cost the taxpayers of your district a lot of money.” “And the conclusion,” he continued, “was there’s no merit to this allegation that the open meeting law was validated.” On Wednesday, Seiniger told Meridian Press he would waive his fees to investigate Vuittonet’s claim because “to me, it’s like someone crying wolf,” he said. Seiniger estimated that he spent 10 hours working on the investigation, which would have come to $1,900 in fees. He offers the school district a reduced rate of $190 per hour rather than his normal rate of $300 an hour. The investigation fees charged by Eberharter-Maki were not available before print time. Vuittonet said he still believes a violation occurred. Dean said she trusts Eberharter-Maki’s “legal aptitude.” “I still feel like just choosing whatever topic you want or whatever employee you want and ad libbing and deciding you want to talk about a certain situation is a violation,” Vuittonet said.

“You’re opening up a traffic bottleneck, yet another bottleneck in Meridian,” homeowner Paul Hosford told the City Council. “This is the time to stop this, this is the place. Be bold. Make the call here.” The apartments would create fewer than 1,000 new daily vehicle trips to the area — below the threshold that would require a traffic study, J-U-B Engineers representative Lisa Bachman said. Responding to residents’ concerns, Bachman said roads and landscaping will serve as buffers between the apartments and houses. The apartments, with only two stories and wood and stone accents, won’t clash with the neighborhood she said. A variety of housing options adds livability to a community, she said. “There actually isn’t any evidence to support any reduction to property values as a result of being next to multi-family,” Bachman said. The public hearing and discussion about the project stretched for more than three hours. With so many concerns from homeowners, the City Council unanimously voted to send the Easy Jet Subdivision request back to Planning and Zoning. The council instructed the applicant to review the housing density of the project, the design compatibility of the apartments with the existing homes, the level of buffering between single-family homes and apartments and the potential need to create another street for future access to the south.

Adrian and Jannette Mascorro are among dozens of residents in the Sutherland Farm and Sutherland Downs neighborhoods who oppose the construction of apartments along East Easy Jet Drive, just east of South Eagle Road. The city’s 2002 agreement with the developer allows multifamily and commercial uses. The developer has modified the project, such as bringing the apartments down to two stories instead of three, to compromise with homeowners. After planning staff and the applicant review these details, the request will again need to come before the City Council.

IMPACT ON SCHOOLS The city asks for input from the West Ada School District before approving housing development requests. The school board in recent months has said the district needs to be more upfront about the overcrowding issue and the burden that rapid residential growth is putting on schools. The district’s letter about the Easy Jet Subdivision did just that. “Nearly every high school, middle school, and elementary school throughout the district is operating at or over capacity,” thenAssistant Superintendent Barb Leeds wrote to the city clerk’s office Sept. 23. “Approval of the Easy Jet Subdivision will have a significant impact on school enrollments.” Based on census data, the district estimates the new homes would add 52 new students to the district. “The approval of Easy Jet

Such a site would need water and sewer service available, and prior to the commencement of construction, the district will need to pass a bond issue for the construction of schools.” Bachman said a letter like this from a school district is unique. Meridian Mayor Tammy de Weerd said the district raises important issues, but the state hasn’t provided a way for new development to fund schools. The school board has advocated for a school capacity fee that would require developers to pay an impact fee for schools, like they do with parks and public safety. “They’re asking for what looks like a donation, because they cannot ask for an impact fee because the state doesn’t allow that,” De Weerd said. “That is something that we hope the Legislature will start addressing.”
