Best Of 2012 THE BIGGEST ASS I wrote this column a while ago. It seems to be everyone’s favorite. I include it in the “Best Of” section because although many years have gone by, the giant ass of my seatmate still remains a vivid frightening memory. I flew to Chicago Monday on business. An associate met me at LaGuardia airport. We both commented at how old and dingy the American Airline terminal looked. Then he reminded me that this was the fifth anniversary of The Trip from Hell. We both remembered and we both can finally laugh about it. It started in East Hampton. I was going to make a presentation for the advertising account of the British Virgin Islands on the island of Tortola. I had to catch a plane for San Juan and connect to a flight to Tortola. I missed that flight and every other flight on that trip because the airline business is so totally screwed up. IndependentAd_July12_Vert.pdf 1 Since the flight to San Juan was

at noon, I decided to leave East Hampton at 7 AM, giving myself plenty of time to catch my plane, or so I foolishly thought. I arrived at the airport two and a half hours before my flight. I still had to run to get on my plane in time. The airport was filled with thousands of people trying to get their boarding passes all at the same time. Only five or six clerks were there to service thousands of passengers. Since most of the flights were overseas, one woman from American Airlines was just screaming, “You must have your passport ready.” She screamed at a young man standing in front of me, “Do you have your passport ready?” “But I’m going to San Francisco,” was his confused answer. It took me one hour and 15 minutes to get a boarding pass, another 45 minutes at security, and then a dead run to my gate. So I was out of breath as I stumbled on board 7/27/12 4:33 PM with my carry-on bags and I worked my way down the aisle looking for 24A, my window seat. That’s when I spotted her. She was a woman in her early 30s. She was big. Very, very big. But it wasn’t her shoulders and breasts and waist that amazed me. It was her ass. Three quarters of her ass occupied seat 24B, but the other one quarter of her ass was on my seat, 24A. She got out into the aisle so I could get into my seat. I couldn’t take my eyes off of her ass. Then she sat down and her ass was on my leg, my lap and hip. You

must understand, I was trapped in my seat. Then I started to think, should I introduce myself? Should I comment on it? Should I say, “Miss, that’s one amazing big ass you have there. We’re going to be flying for three hours and 55 minutes and it’s clear I am going to be in constant contact with your ass, so let me tell you it is an amazing ass. It is the Godzilla of asses.” My mind was racing. Should I ignore it? Should I try to synchronize my breathing with hers for maximum comfort? There was no way to bring down the armrest because her ass was in the way. I fidgeted for five minutes under her ass and finally found my seat belt. Now we were about to take off when the pilot announced that the plane had a mechanical problem and we would have to wait for another plane to be brought out to take us to San Juan. Just enough time to miss our connection to Tortola. An hour and a half later I was on another plane with the same seatmate and the same ass. The flight was a nightmare. The woman, perfectly comfortable with the seating arrangement, spent the entire flight reaching into a

Starbucks bag and eating cakes and buns. I was fearful that if her ass got any bigger I would be pushed out of the window and sucked out of the plane. When we were a few minutes out of San Juan I realized that I had been married to the beautiful Judy Licht for 23 years and in all those years I hadn’t touched Judy’s cute butt for the sum total of time I was spending touching this stranger’s ass. The thought made me giggle uncontrollably and the woman stopped munching on cake to give me a dirty look. When I got off the plane I realized that I had my Blackberry in my right-hand pocket, which her ass was perched on. I said a thankful prayer that I hadn’t received a message during the flight. My Blackberry vibrates when I get a message and if it had gone off and vibrated under her ass at any time during the flight I might be rotting in some San Juan jail. Or, if she liked it, my seatmate would have picked me up and carried me off in the same way King Kong carried off Fay Wray. SoFo Honors Christie By Kitty Merrill

For most people, childhood memories involve carnival trips, birthday parties or that first shiny new two-wheeler. Christie Brinkley’s not most people. The supermodel, Broadway star, author, illustrator, designer and entrepreneur recalls marching to protest the construction of a nuclear power plant on a fault line in California, “when I was very, very young.” . . . and an activist was born. Given her lifelong love of and urge to protect the natural world, it’s no surprise that Brinkley was chosen to be the special honoree at this Saturday night’s SoFo goes SoHo benefit for the South Fork Natural History Museum. “I love the museum,” she enthused this week, “Because I think their mission statement is the same as mine, to get people to understand that nature is so important.” Back home in the Hamptons after touring in the musical Chicago, she said, “I’ve been in the garden ever since I got back.” She described her acclaimed turn as Roxie -- which involved performances on Broad-

way, in London and out on the road, not to mention making her debut on the stage for the first time since she was a 13-year-old in the chorus in Annie Get Your Gun -- as invigorating, and “a dream come true.” She used the same word -- “invigorating” -- to express the feeling she gets from reveling in the beauty of the natural world and provide insight into her lifelong drive towards advocacy. Like lots of East Enders, she draws a sort of spiritual sustenance from the landscape. “I am never without a camera,” she said. “I’m so enamored by the beauty here. It’s wonderful.” Brinkley spoke of favorite “little vantage points” -- the sand spit in Three Mile Harbor, Long Beach in Noyac, an area by the train tracks in Bridgehampton and other locales that boast “that infinite sky.” “When you have a deep appreciation of everything nature offers, you are more prone to want to protect it. You appreciate how it provides for us, from the air we breathe and the water we drink to the gardens that inspire us . . . Mother Nature definitely needs allies,” she said. Brinkley credits her first child, Alexa

Ray, now in her 20s, for ramping up the drive towards activism. “When I was pregnant with Alexa . . . you start looking at the world with the eyes of a parent and you want everything to be great for your child. She has also been honored by many distinguished organizations including the “Albert Einstein Spirit of Achievement Award.” “Make-AWish Foundation,” “The March of Dimes,” “American Heart Association” and the “USO” for her work with forward deployed troops. “I’m an Aquarian,” she revealed. “So I have a very strong streak. We feel we can do anything if we all join together. I believe in the ability of one person to make a difference. I also believe in gathering everyone together to make ourselves heard . . . if you can rally people, you can make a difference and make the world a better place. I’m so honored [to be recognized by SoFo] because what they do there is rally people.” When her modeling career took off in the 70s, Brinkley was quoted calling herself “a surfer girl from California.” She picked up the sport again recently to share with her son, Jack. You might find the ardent outdoorswoman catching a wave at Ditch Plains this summer, or sailing in Three Mile Harbor, or fishing with her “guru” Kenny from Sag Harbor. After hectic months living her dream on the stage, she said, “I’m not the kind of person who likes to hold still, but right now it really feels good to just sit and gaze at the little cardinals and leaves blowing in the trees.” So, this summer Brinkley might also be found “lying in the grass, staring at the clouds.” kmerrill@indyeastend.com

Legs May Have Legal Leg To Stand On By Emily Toy

Seated among village residents, community members and fellow art enthusiasts, the property owners of the old Baptist Church at the corner of Madison and Henry Streets in Sag Harbor’s historic district watched and listened while their Larry Rivers’ “Legs” underwent review. Sag Harbor residents and East Hampton gallery owners Janet Lehr and Vered sat quietly amongst the standing room only crowd during a spirited Sag Harbor Village Zoning Board of Appeals meeting on Main Street on February 21. “I have the pleasure of walking by those legs each day,” said Washington Street resident Tara Newman. “This is art, no question,” she said. “Larry Rivers was not just some local guy, and this is not just some sculpture, but the work of a world renowned artist. This should not be before this board. It would be a huge detriment if these were lost in the community.” Newman was in good company at the hearing, where the majority of the 70 plus people present were in support of Lehr and Vered legalizing the 16.1-foot tall “Legs.” The matter of proper zoning for the sculpture has been under review for the past two years and has since evolved not only into a highly publicized issue, but a discussion of whether it’s a work of art or what the board has deemed it: an accessory structure. The ladies’ attorney, Montaukbased Richard A. Hammer, asked the board to consider their rights to freedom of expression, adding that if the “Legs” were to be considered a “structure” then the board could still say that it does not violate the basic principles in zoning -- meaning that it doesn’t benefit Lehr and Vered while at the same time providing a detriment to the health, safety and welfare of the Sag Harbor community. “This is an intellectually vibrant issue,” Hammer said, charging, “Art speaks for itself and it clearly has a place in our community.” The ZBA, sans Gayle Pickering, its chair, and member Michael Bromberg, who recused himself from the application, ultimately decided to table the issue until its next meeting on March 20, where Pickering will have time to review it. “We are looking at this as a structure,” said acting chair Brendan Skislock. “We don’t want to get into the focus of art or emotion. That has no place on the Zoning Board of Appeals. We have to concentrate

on this as a structure.” Under the village code, as a “structure,” Lehr and Vered’s “Legs” would need three variances to be in the clear. The “Legs” are located one foot from the property line where 35 feet are required and stretch 16.1 feet high where 15 feet is the maximum. The sculpture also protrudes through the sky plane 16.7 cubic feet more than permitted under the code. Hammer presented the board with a petition in support of the “Legs” signed with 430 names as well as supporting letters. Included in those were Larry Rivers Foundation Director David Joel, David Levy of the Sotheby’s Institute of Art and Helen Harrison of the Pollack Krasner Foundation. “This shouldn’t be before this board,” said Joel. “Maybe you should recognize this should not come before you and you should not be in the uncomfortable position of having to decide this,” he added. “This is the first time this work of art has not been called a work of art,” Joel continued. “The precedent you’re setting here is a scary one.” Skislock, along with board members Anthony Hagen and Benedetta Deubel, said that the main concern for the board was the precedent being set with the “Legs.” “I can imagine cases like this coming up in the future,” Hagen said. “I can’t ignore the precedence being set up here.” Hagen said he thinks the “Legs” have a “commercial nature” to them, adding, “The applicant has a business in East Hampton where they have a commercial opportunity to advertise their business. It looks like a billboard.” Hagen was promptly muffled by a booing, and at some points, hissing, crowd. “The thing is this needs a variance,” Deubel said. “I’m worried about what will go on from this point.” Although the “Legs” staying put was highly supported at the meeting, the board members were not the only ones that had reservations on the issue. Local businesswoman and Sag Harbor resident Jennifer Hauser, who owns the two properties facing the “Legs,” was not in support of them staying. “We have the opportunity to put into place a long term stand, instead of a precedent we may regret later,” she said. “This is about living in a

Published 2/29/2012

Independent/Emily Toy

historic district in Sag Harbor and clarifying the codes that have been put in place,” Hauser added. “This is not about art, but the precedent it sets.” Hauser charged she too thought the “Legs” were part of a business promotion. “And they’re illuminated all night, by the way,” she said. Charles McCarron, a Noyac resident also would like to see the “Legs” go. McCarron owns a residence located directly behind Vered and Lehr on Henry Street. “I don’t know if it’s art or not, but I don’t like them and I’m a neighbor,” he said. “Jennifer doesn’t like them and she’s a neighbor. When you have neighbors complaining then that’s a problem,” he added. “As a neighbor, I’m totally against it.” Hammer assured the board that they do in fact have the ability to say whether or not the “Legs” are a structure. Sag Harbor Village Attorney Fred Thiele urged Hammer to look at the

“Legs” as a structure because there is case law that backs the village up on such a charge. “The last thing people want is for government to determine what is art and what isn’t art,” Thiele said. “This is a case of first impressions,” he added. “Ultimately what this board has to address and look at is if the benefit to the applicant is outweighing the detriment, if any, to the community.” If it were said that it is not a structure, but a work of art instead, according to Hammer, then the “Legs” could be “kicked back to the board of trustees.” “It was amazing,” Vered said of the meeting in an interview this week. “We had great support, wonderful attendance. It was very positive,” she said, adding, “Every case has its own merit. We wouldn’t have these committees if it were a matter of precedents. This case certainly has its own merit and it would be horrendous if they voted no.” emily@indyeastend.com

Arrests And Conviction Could Be Overturned By Rick Murphy

A Southampton Town Police officer who worked “several years” on the police force’s Street Crime Unit was allegedly addicted to prescription drugs and was repeatedly high on duty. As a result, some of the cases he worked on may be “tainted,” Supervisor Anna Throne-Holst and others acknowledged. In other words, the specter is raised that convicted drug users and dealers could seek to have their cases overturned as more facts emerge about the shocking scandal involving the Southampton Town Police. “That’s why the D.A. is up in arms about this,” Throne-Holst said.

“There were some big busts while this stuff was going on. Some of these are compromised – there is no doubt about it.” The officer under investigation is Eric Sickles, two sources close to the case told The Independent. Sickles has not been charged with any wrongdoing -- yet. Sources said he was whisked off to a rehab facility and has not returned to work. Throne-Holst did not identify Sickles but said the suspected cop was named “Officer Of The Year” by a local organization. Sickles was so designated by the Southampton Kiwanis Club in 2011. His direct supervisor, Lt. James Kiernan, has been suspended. The allegation is that Kiernan let Sickles continue on the job despite the fact he was allegedly hooked on drugs. That meant carrying a weapon, making undercover buys and making arrests. One local defense attorney said she suspected the Street Crime Unit had “made arrests without cause. I know for a fact they searched people illegally,” the source said. The source also said the Street Crime Unit has been accused of “abusing minorities.” The saga began last year when Throne-Holst said she received “alarming reports from officers on duty of out-of the ordinary behavior,” specifically “records were being shredded and files leaving the building.” She ordered the town clerk to take files from the police department headquarters, box them up, and lock them up in town hall. The D.A. seized those and other police records in a raid last week. The investigation widened when William Wilson Jr. took over as chief. He was told a police officer on the undercover squad was a user and asked the County Internal Affairs Unit to investigate further. It was an open secret the officer had become addicted, a source said. Throne-Holst concurred. “One of the issues going on is that some people knew about this but didn’t say anything.” Last week the town settled a civil suit filed by the family of Tony Bradshaw against the town and a half-dozen members of the police force including Kiernan and Sickles. According to court papers “the defendants violated Bradway’s constitutional rights under the Fourteenth Amendment due to their deliberate indifference to a serious medical need, namely Bradway’s need for medical attention after swallowing a large quantity of coCONTINUED ON PAGE 40.

Happy Birthday To Us By James J. Mackin & Kitty Merrill

Labor Day 1993. Vol. 1 #1: A salesman, a photographer, a culture writer and an athlete make a newspaper. Lee Minetree, James J. Mackin, Bridget LeRoy and Jodi Della Femina partnered up to launch The Independent, the second newspaper in East Hampton’s history, giving competition to the century old East Hampton Star. Today’s edition marks the beginning of our twentieth year. Back in ‘93, the mission was to produce a worthy weekly newspaper a day earlier than the East Hampton Star and The Southampton Press in the tabloid size format as was Newsday, The Daily News and The Post. James J. Mackin, having been raised in a three-newspaper town, suggested there was always room for another quality newspaper, especially since the East End had such an abundance of writing and photography talent that just couldn’t find enough outlets. The concept for a new newspaper was conceived at the Evan Frankel estate, which was being rented for the summer by Warner LeRoy, whose daughter Bridget yearned to write about the East End’s cultural world. The one remaining item was what to title the newspaper. The name “The Independent” was suggested by Bridget who called from London saying, “I have the name” after seeing a copy of London’s Independent. The vote was unanimous. We launched on Labor Day to show the local community we were dedicated to publishing a wellrounded, fair newspaper for the year round population. We predicted a strong advertising base, since so many mom and pops were shut out of other publications because rates were so prohibitively high. We haven’t looked back since. Mackin remembers, “The late Nick Monte from Gurney’s visited our office in The Red Horse complex the second week we printed and told us he’d buy an ad in every issue we printed . . . beginning our 20th year, Nick’s word was his honor. Gurney’s has literally been in every issue since.” Hildreths, Buzz Chew, Bridgehampton National Bank, CE King, Village Hardware, The Palm, Vered Gallery, Uihlein’s Marina East End Hospice, Guild Hall and Gosman’s are just several examples of advertisers who started with us and continue to share our mission. Over the years The Independent has been benefactor to Softball Teams, The Little League, The Retreat, The Clamshell Foundation,

Food Pantries, South Fork Natural History Museum, Southampton Historical Museum, Make A Wish, Coast Guard Auxiliary, RSVP Pet Rescue, Hoops for Hope, Ellen’s Run and many many more. Most recently we sponsored Girls Night Out at Gurney’s to benefit breast cancer research. In collaboration with BNB, our annual “Boo!” Halloween supplement provides local CONTINUED ON PAGE 29.

Judith Hope, First Woman Supervisor Published 3/7/2012

Independent/Kitty Mreeill

By Kitty Merrill

Across the room you see a figure that’s tiny, delicate even. But one look into Judith Hope’s arresting teal blue eyes and you know she’s anything but dainty on the inside. Hope was elected East Hampton Town Supervisor for the first time in 1973. She was the first woman on Long Island elected to the office. She was the first woman Appointments Officer to a New York Governor,

serving Governor Hugh Carey, and during her tenure the number of women serving in high level and cabinet positions tripled. Hope was twice more elected town supervisor and in 1995 she was the first woman elected to helm the New York State Democratic Committee. Hillary Clinton credits Hope as the first person to suggest she run for U.S. Senate. And now, as founder of the Elea-

nor Roosevelt Legacy Committee, an organization that helps recruit and guide women to run for office, her decades of advocating for women have come full circle. The Committee offers guidance Hope didn’t have back in the 70s, when the young housewife and mother decided to run for town supervisor. “When I was growing up in the south, there were three professions women could enter -- teacher, nurse, or airline stewardess. They’re great professions, but I would have been terrible at any of them. Nothing in my education or cultural experience told me I could run a town.” In fact, Hope related an incident that happened the day after she was elected. Sitting at the counter at Eddie’s Luncheonette on Newtown Lane she overheard two men chatting about the ballot results. “One said, ‘Well, that woman won the election.’ And the other one said, ‘East Hampton’s been around over 200 years. We’ve survived a lot of things. We’ll survive her, too.’” The Arkansas native grins as she tells the tale. The town did more than merely survive with Hope at the helm. As supervisor, she was recognized by the New York Times and the Nature Conservancy for innovative policies on open space and environmental conservation. The burgeoning environmental movement and the women’s movement of the early seventies sparked Hope’s interest in public service. “Those two movements changed my life,” she declared in a voice still spiced with a Southern flavor. It was

an exciting time across the nation, she observed. “A lot of people were asking questions and raising issues that hadn’t been raised before . . . the country was open to new ideas, which was thrilling.” Hope left East Hampton’s public eye after her first term as supervisor when Governor Hugh Carey invited her to become his appointments officer. “We tripled the number of women on boards in the state,” Hope said, attributing part of her success to the times and the burgeoning national realization that half the human race had been eliminated from the political equation. According to Hope’s husband, Tom Twoomey (“my best press agent”) when Carey left office, the New York Times cited the quality of his appointments among his most important accomplishments. When Hope returned to East Hampton, Carey asked her to serve as his Long Island representative. She was the first woman and first person to be a regional ambassador to Albany. Hope looks back on those years as exciting times for women, but she feels there’s still a long way to go. Despite its progressive reputation, New York State is actually 34th in the nation when it comes to electing women to state offices. Locally, however, Hope noted “a lot of wonderful women role models on the East End in both political parties and civic organizations.” She’s a big fan of former Republican East Hampton Town Supervisor Mary Fallon and sees Southampton Town Supervisor Anna Throne-Holst and Councilwoman Bridget Fleming as unusually gifted and talented women. “They’re both stars,” she said. Another Lawsuit Alleges Police Corruption By Rick Murphy

A convicted drug user has accused the now-disbanded Southampton Town Police Street Crimes Unit of setting him up in court papers filed last week. Craig Chillemi alleges cocaine was planted on him by an undercover police officer, and that he was wrongfully imprisoned as a result of their actions. It was yet another hit on the unit, which is under siege on several fronts, including an active investigation by the Suffolk County District Attorney and the town police’s Internal Affairs division. The court papers specifically name Lieutenant James Kiernan and Police Officer Eric Sickles, both of whom are under suspension ordered by the Southampton Town Board. Sickles is at the epicenter of a scandal that not only could result in scores of convictions being overturned, but also in huge civil court judgments the town is ill equipped to pay for. Kiernan faces a slew of interdepartmental charges; Sickles has not been officially charged with wrongdoing beyond unspecified interdepartmental charges. The allegations are that Sickles functioned as a member of the Street Crimes Unit, making undercover buys, making arrests, and carrying a concealed weapon, while he was addicted to drugs and that Kiernan was aware the officer had a problem but allowed him to continue working. Sickles spent a considerable time in a drug rehabilitation clinic. After his release from the clinic, he was suspended before he could return to active duty. Two convicted felons, Mohammed H. Proctor, 36, of Riverside, and Bernard T. Cooks, 31, of Southampton, were recently released from prison by order of Suffolk County District Attorney Tom Spota, who said evidence used to convict them was tainted – the Street Crimes Unit and Sickles were involved in the arrests and prosecutions of the two men. Proctor subsequently sued Southampton Town for $50 million, claiming among other things that police threatened his son to coerce him to sign a false statement implicating himself. On Thursday Chillemi filed a $1 Million suit, naming Kiernam, Sickles, and a third member of the street crimes unit, Detective Thomas Tully. The accuser, though, has a checkered past to be sure, according to Kiernan’s attorney, Ray Pirini.

“This is a desperate man saying ridiculous things,” the attorney said. Chillemi is currently in jail, the result of a federal indictment, charged with conspiracy involving “manufacturing scripts [counterfeit prescriptions] and selling oxycodone,” Pirini said. Thomas A. Telesca of the Uniondale-based law firm Ruskin Moscou Faltischek, is representing Chillemi. He charged that Sickles had it in for his client because Chillemi was dating Tara Tully – Detective Tully’s daughter – and that Sickles had a romantic interest in the woman. In fact, the Street Crimes Unit arrested Chillemi twice. On the second occasion, Telesca said Sickles set his client up.

“Sickles pulled up in an unmarked car in a driveway in Hampton Bays and said [to Chillemi] ‘You can’t drive a car.’ Craig said ‘I wasn’t driving.’” Tara Tully was driving, the attorney maintained, but Sickles handcuffed Chillemi nonetheless, according to court papers. Sickles then produced a packet of cocaine that he said he found on Chillemi, Perini said, “even though he never put his hand in Craig’s pocket.” Chillemi pleaded guilty to a reduced charge, believing it wouldn’t affect his probation status. Instead, “He ended up going back upstate for 14 months as a direct result of Sickles wanting to date Tara,” Telesca said.

Sickles has not been charged with any criminal wrongdoing and the town board did not state specific reasons why he was suspended without pay. Spota said 100 cases involving the Street Crimes Unit are under review, and he expects additional prisoners will be released because evidence used to convict them was tainted. Most are likely to sue the town, itself a potentially catastrophic event – as reported exclusively in The Independent, Southampton Town has virtually no liability insurance and has set aside very little for legal fees. The exposure for taxpayers is enormous. Already, the DA has subpoenaed hundreds of police department CONTINUED ON PAGE 31.

Dominus Vobiscum, You Hunk I’m not one for talking in the morning. My ideal morning would be spent reading the sports pages and drinking coffee, oblivious to the world around me. Of course, that only holds for the weekend. On weekdays I have to trek off to work. I allow myself the pleasure of a quick cup of coffee on the way but the same rules apply – I don’t want to chitchat with anyone. I know nothing about what happened in the world while I was sleeping. I just want my coffee. Yesterday I was jolted awake when I arrived at Citarella and found it closed for repairs. I have to come to like the “Joe” there, and at $1.50 it’s reasonable enough. Plus it had become part of my routine, only because Hampton Market burned down last fall. Such was my dismay that I drove there every morning for days afterwards, as if on autopilot. Yesterday I was forced to go to Starbucks. I have nothing against the store, the people were very nice and there were some luscious goodies in the pastry cases. That was a problem. Being I’m trying to lose weight, I realized there was nothing

to eat that was good for me. It was all eggs and butter and sugar. After a pretty long wait, mercifully, it was time for me to get my coffee. Now let me go on record right now as stating I will never use words like “grande” and “venti” when ordering my coffee. The way I figure it, I spent three years in Catholic High School studying Latin, and I hated it then and I still hate it. The ongoing joke was Latin was a worthless language because we would never be able to use it in real life. I’ll be dammed if 40 years later all of a sudden Starbucks proves us wrong. I should also point out I cheated my way through all three years of Latin, elaborate schemes that involved hand signals, coded messages, and well-timed coughs. My mother once remarked that if I spent as much time studying for my Latin exams as I did on cheating, I wouldn’t need to cheat. How bad was I? I thought an aqueduct was a racetrack in Queens. What did I know, right? “Large coffee, half regular half decaf, skim milk.” I mumbled. “And how are you sir? How’s

your day going?” The woman was beaming. “It’s turning bad very quickly now,” I mumbled. “Did you want a grande or a venti?” Those dreaded words. “A large coffee,” I stipulated. “What’s your name?” Oh oh. Now I’m in trouble. What, am I about to get reported to the Coffee Police? Have I committed the fatal faux pas of speaking English in a Latin establishment? Now, who did I offend? “Your name?” she asked again. “Hunk . . . Hunk of Steamin’ Funk,” I finally answered. She then wrote the word “Hunk” on an empty cup and wordlessly passed it on to another lady. Her face was expressionless. “That’s $2.65,” she said. “mater dei! “ I exclaimed before forking over the money. I waited around for another woman and the second lady came to the counter with a cup. “Hunk!” I didn’t move a muscle. “Hunk!” she shouted louder. Still nothing. She went to the first lady and whispered, then they both looked at me together.” “You’re Hunk, right?” the woman with the coffee asked. “No, I’m Hunk Of Burning Funk,” I replied calmly. “One grande, half decaf,” she said, offering the cup to me. “NO,” I said, “I wanted a large.” Finally, she glared. My morning brightened considerably. I went out

For lots of folks, New Year’s Day is all about sleeping in, taking care of your head, and watching the Rose Bowl. But for an increasingly larger number of East Enders, the day includes a jump in the chilly ocean. The two most popular Polar Bear Plunges planned this year will be held in Amagansett and Montauk. Plungers at Gurney’s Inn in Montauk can benefit from before and after spa treatments to get them ready for the Atlantic. This year’s plunge, held at 10:30 AM, benefits Paddlers for Humanity and East End Cares. They’re asking for a $10 cash donation and non-perishable food items. In Amagansett, get freezin’ for a reason, with the annual plunge to benefit the East Hampton Food Pantry. This year, due to Super Storm Sandy-related damage at Main Beach, the plunge moves to Atlantic Avenue Beach. Courageous dippers hit the surf at 1 PM. A costume contest precedes the dip at 12:30 PM. A minimal donation of $25 gets you into the water and earns you bragging rights for a lifetime. The event is sponsored by East Hampton Volunteer Ocean Rescue, The Hurricanes swim team and the YMCA-RECenter. Registration begins at 11:30 AM. K.M.

school children with a venue to demonstrate their scary story writing skills. As we leave our teenage years, founding partner James J. Mackin is most proud of providing the communities of the East End with nearly 15 million copies of The Independent for their reading enjoyment. Web readers enjoy the entire newspaper at www.indyeastend. com. We were the first local paper to publish online, and continue to do so for free, no lockouts with The Independent. We were the first to offer all content in color. Veteran local journalist Debbie Tuma served as managing editor for our first edition, but we soon saw her forte was reporting from the field. Tom Clavin, a colleague from the East Hampton Star was recruited to take the reins. He served as editor-in-chief until Rick Murphy assumed the mantle in 2003. Murphy worked 15 years at the Star, often alongside Mackin, Minetree and Clavin. Described as a natural storyteller, relentless investigator and a cheap date, he regaled the office this week with stories of his defection to The Independent. Whenever he wanted a raise, he said, “I’d get dressed up in a suit and come in a couple of hours late.” Colleagues at the Star were led to believe he was job hunting, and taking an interview with The Independent. The ploy worked with Star editor Helen Rattray. “Then next day Helen would give me a raise.” Murphy left the news biz in 2002 and worked for a short time as a recruiter of high-end stockbrokers. He recalled meeting with Mackin and Della Femina about becoming editor, “I walked away from a ton of money, but it only took me about 10 seconds to decide to get back in the action.” In 1994 news editor Kitty Merrill joined the Indy family. As member of the Springs School PTA, she submitted school news columns and was tapped by Clavin to work as a stringer in 1995. Her first profile, of a local would be aviator, won an award from the Long Island Press Club in the highly competitive feature category. The same year, Ben Sneed joined the staff as an ad executive. He’s currently the manager of our sales team. Another 1994 milestone? Jerry Della Femina became a minority share partner of The Independent. He published his first Jerry’s Ink column. It went on to win awards for best humor column on multiple occasions. In 2003, he became the majority shareholder. It’s been said the goal of a community journalist -- and by asso-

ciation a community paper – is to “comfort the afflicted and afflict the comfortable.” Certainly the 9/11 tragedy was the single most heartbreaking event of our time. Everyone on the East End and across the country felt afflicted, and gripped with grief. The Independent was there to cover myriad memorials, fundraising drives, and efforts to assist New Yorkers in mourning and shock. We were the only paper to meet our own police when they returned from the city in the middle of the night and the first to publish their firsthand account of providing assistance at Ground Zero. Afflicting the comfortable has been a strength at Indy. We were the only publication to investigate town finances during the scandalridden administration of East Hampton Town Supervisor Bill McGintee. No other paper touched the story we spent months report-

ing, prompting probes by the New York State Comptroller and the Suffolk County District Attorney. Those probes led to the arrest of the town budget officer and McGintee’s resignation. The unseating of the Democrat paved the way for the Republican majority of Supervisor Bill Wilkinson’s administration. Always independent, we’ve spent some time afflicting Wilky, too. With a longevity that spans decades, Assemblyman Fred Thiele’s name has appeared in this paper more times than any other elected official. He had this to say about our birthday, “For twenty years The Independent has covered life on the East End. Often controversial and provocative, always informative, but never dull, The Independent has been a must-read for anyone seriously interested not just in what’s happening in our community but why. The best of luck

for many more years of success to Jerry, Rick and the whole gang at The Independent. Congratulations and thanks!” The Independent purchased The Traveler Watchman newspaper in 2005. The Traveler was launched in Sag Harbor in 1826 and moved to the North Fork where it was based until our purchase. It is one of the oldest newspapers on Long Island and was edited for a time by Walt Whitman. The Independent has an advertising sales alliance with the Long Island Press allowing for full island exposure. Covering the entire East End of Long Island The Independent is currently delivered to over 400 locations with circulation ranging from highs of 20,000 copies on peak summer weeks to 15,000 in off season. Nearly 15 million copies, and almost as many gallons of coffee and slices of pizza behind us as we begin our third decade. Time sure flew; we were having fun.

Christopher McPartland, who is handling the case for the DAs office, also handled the McGintee-Hults case; McGintee ended up resigning but avoided arrest, and Hults ended up pleading guilty to two misdemeanors including securities fraud but avoided jail time. The Town of East Hampton wasn’t as fortunate – taxpayers had to make up a nearly $30 million shortfall, the accumulated deficit McGintee rang up during his almost three terms in office. Neil Checkman, Chillemi’s criminal attorney, said he has contacted McPartland. Checkman acknowledged his client’s current plight,

“has nothing to do with Southampton Town but it doesn’t alter the fact that Sickles rousted him on a bogus drug charge,” If Chillemi is convicted in district court, “His prison time [because of the local arrest] will have a direct effect on sentencing guidelines. If his [Southampton] bust were vacated he’d be subject to doing less time.” Chillemi was originally busted in August of 2007 along with five others after police raided a house he was living in along with Tara Tully. He said in court papers that Tully was let go after Kiernan intervened. “Kiernan took the handcuffs off Tara and put her in his car,” Telesca alleged. The other five men were all charged with assorted drug charges, but only Chillemi did time. The court papers state that “Tara Tully is . . . the goddaughter of Lieutenant Kiernan.” “Jim Kiernan is not Tara Tully’s godfather. He didn’t meet her until she was a grown up,” countered Perini. He said he is pressing the town to move up a scheduled hearing date. “We will absolutely prevail. [Kiernan] has a great reputation and a 15-year unblemished record,” Pirini said. Councilwoman Christine Scalera, in an earlier interview, said the negative publicity surrounding the police force affects morale. “The great majority are excellent police officers who do wonderful work for the community. It’s a shame they have to be dragged through this.” Southampton Town is underinsured, meaning taxpayers could be on the line should the lawsuits prove successful.

Method Begin by washing your fluke fillet and carefully slicing into 12 thin pieces. Place in the refrigerator until you are ready to assemble the dishes. In a small sauce pot add the coconut milk, apple juice and curry powder. Bring to a simmer and reduce over medium heat for about 10 minutes or until you have achieved a sauce consistency. Allow the sauce to cool in the refrigerator. Slice the apple into thin strips (juilliene). To prepare the chilies, scrape the seeds and membrane from the inside and slice the chilies into thin rings. To plate, mix the chilies and apple in some of the sauce. Lay down a bed of sauce on each plate. Place three slices of fluke per plate with picked cilantro. Finish with a bit more sauce.

Plaintiff also asserts the claims of negligence and wrongful death only against the Town of Southampton based upon the alleged conduct of the individual police officers.” The plaintiffs settled the suit for $70,000. Thomas Telesca, an attorney who represented the Bradway family, said yesterday, “There is a

strict confidentiality agreement in place,” and declined to comment further. Kiernan was a Republican committeeman when Councilwoman Christine Scalera and Councilman Chris Nuzzi were chosen to run, leading Wilson to request an Ethics Board hearing on whether either -and Councilman Jim Malone, a Conservative on the Republican ticket -- should participate in discussions about Kiernan’s suspension. There has also been an allegation made by Wilson that he was

Nuzzi said the opposite scenario occurred. “He made that up,” Nuzzi countered. “He approached us.” Nuzzi said there was no correlation between the Kiernan case and the call for Wilson to retire. “There have been any number of disagreements between Wilson and the board,” Nuzzi said. “His management style, overtime costs, and understanding of the issues

With the DA just ramping up the investigation, all parties concerned realize scrutiny of the town police force is going to intensify. “We’ve asked them to speed this up. They realize this is out of the ordinary,” the supervisor said. “This should have happened years ago. It’s time to get to the bottom of it.” Throne-Holst also revealed former town supervisor Skip Heaney, tried to get [former police chief James] Overton fired “a long time ago.”
