Two Familiar Faces Facing Off? Published 1/16/2013

Both have a history of public service and served on the town board dais in the past.

This week Larry Cantwell, a Democrat, and Jay Schneiderman, an Independence Party member, affirmed they are seriously considering runs for the town’s top spot.

Last fall Cantwell announced plans to retire from his position as East Hampton Village Administrator.

He held the post for some 30 years, with stints on both the town board and the town planning board, not to mention a failed bid for supervisor in 1981, along the way.

in October, Cantwell told local media that he wasn’t retiring for the purpose of running for office.

At the time he expressed doubts about a desire to enter the local political fray.

But this week local Democratic Pa r t y l e a d e r J e a n n e F r a n k l admitted party members have been “absolutely” pushing to recruit Cantwell. The one-time lawmaker said Monday that community members had consistently approached him with an eye toward persuading him to run.

Will he?

“On any given day, I can answer that question in different ways,” he said. “I’m seriously considering it.

I’ve talked to a lot of different people about it, and a lot of people have been coming up to me asking me to run, but at this point I’m certainly not making a final decision.”

Asked why he’d contemplate a run, Cantwell replied, “This is going to sound real corny, but I love this place. It’s been my life and I feel I have a lot more to give.”

The “giving” for Cantwell began decades ago when he was the first Democrat in over 40 years elected bay constable. At the tender age of 25, he was, in 1975, the town’s youngest-ever elected official.

Cantwell went on to win a seat on the town board, serving from 1977 to 1982. In ‘81 he ran unsuccessfully for supervisor against Republican Mary Fallon. The following year, Cantwell resigned from the town board to take the post with the village.

During the late 90s Cantwell was appointed to the planning board by then-supervisor Cathy Lester.

Interestingly, his reappointment was blocked, amidst criticism, by the Republican majority on the town board helmed by thensupervisor Jay Schneiderman.

For more than a year Schneiderman, now a county legislator serving in his fifth, twoyear term has been an unofficial town supervisor designee. On Sunday, he confirmed plans to screen for the position in the coming weeks . . . with all three local parties, the Democrats, the Republicans and the Independence Party.

Pick a major party and Schneiderman’s been alternately endorsed or opposed by it. He ran for supervisor in 1999 and re-election in 2001 on the Republican ticket. In 2003, he unseated Democrat George Guldi for a spot on the county legislature, again running on the Republican line.

From there, political lines began to blur. He registered as a member of the Independence Party, following Continued on Page 30.

Gregory Blass, DSS Commish, Resigns Under Pressure

A raging controversy over a Hampton Bays motel being used as a homeless shelter took a new turn this week when the County Commissioner of Social Service abruptly resigned.

Gregory Blass, who had made a personal visit to The Independent office last week to make his case for the shelter, was at odds with Southampton Town Supervisor Anna Throne-Holst, who in the end had the ear of County Executive Steve Bellone.

lier this month to complain about the Hidden Cove Motel on West Tiana Drive; about 30 units had been filled with social services recipients, though a county law limits the number of homeless units in any one location to 12.

“I would resign,” Blass told The Independent, if Bellone intervened on Throne-Holst’s behalf. It proved to be a prophetic statement.

Three rent paying tenants complained they were being forced out of their dwellings because the county was willing to pay the landlord, LAML Realty, considerably more in

rent. The tenants who received eviction notices included an 88 year-old woman and her disabled daughter.

Their monthly rent had abruptly been raised from about $700 to $1150 when the county began moving SS recipients in. The county reportedly pays an additional fee to the Community Housing Initiative (CHI) to manage the facility, provide transportation to residents, and staff the facility with security personnel.

“thanked me” for making it safer.

Neighbors who live on the block told a different tale however, claiming among other things that residents stole their mail and that managers at the motel harassed those neighbors who complained.

Police had to be called to quell disruptions several times.

Throne-Holst complained that the change of use from a transient motel to a homeless shelter was illegal under the town code. Blass said he believed state law took precedence over the county and town codes.

Not so, said Tiffany Scarlato, a Southampton Town Attorney, “if the local law is more stringent than the state law it takes precedence,” she said.

Scarlato sent Blass a letter on January 3 warning that if Hidden Cove didn’t address the zoning issues the town would sue.

Bellone “assured me it wouldn’t come to that,” Throne-Holst reported after her meeting with the county executive. “He said plans were being implemented for an alternate program.”

No one is publicly linking Blass’s resignation with the Hidden Cove controversy. In fact, Bellone went out of his way to praise Blass.

“It is with profound respect for his distinguished career in public service that I accept the resignation of Gregory Blass as Commissioner of the Department of Social Services,” he wrote in a press release.

“Commissioner Blass has been involved in public service for more than 35 years in positions ranging from Presiding Officer of the Suffolk County Legislature, New York State Family Court Judge, Commissioner of the Department of Social Services and as a JAG Officer in the United States Navy. Given Commissioner Blass’ unique resume, it will be impossible to fill his shoes with someone of equivalent experience.”

The resignation didn’t help the plight of Nick Saridakis, another resident and vocal critic of Blass and CHI who is being evicted from Hidden Cove. The sheriff’s office sent an officer to his dwelling the day before Blass resigned and ordered him to vacate the premises within 72 hours. As of this writing it has not been rescinded, though ThroneHolst alerted Bellone on Friday and asked the town attorney to look into the matter.

Kabot, I’ll Run A Primary To Prevent ‘Horse Trading’

Former Southampton Town Supervisor Linda Kabot will be running for office, and she doesn’t intend to be a write-in candidate this time around. “Absolutely not,” she said emphatically. “The voters deserve a real choice.”

Two years ago Kabot garnered almost 3900 votes as a write-in after the Republican Party failed to nominate a candidate for the supervisor’s seat.

Kabot wants to screen with both the Republican and Conservative parties. But given the nature of local politics, Kabot said she has lingering concerns that voters could ultimately be disenfranchised in the event the Republican and/or Conservative Committees “nominate someone who is not a serious and viable candidate for Supervisor.”

Kabot doesn’t intend to go quietly should that occur. “They’re not getting away with running a placeholder, that’s for sure,” she said. Instead, she intends to run a primary should she not be chosen.

It wouldn’t be the first time Kabot took on the GOP establishment. In 2007 she ran a primary against incumbent Supervisor Pat

“Skip” Heaney and ultimately took his seat in town hall.

Though Kabot would love another shot at the incumbent supervisor, Anna Throne-Holst, some party insiders think she should run for the town board instead. Jim Malone and Chris Nuzzi, both Republicans, are up for reelection. Nuzzi is facing term limitations and hasn’t announced his plans.

“A number of well-respected individuals have urged me to run [for town board],” Kabot said. “I’m looking at supervisor right now but I haven’t ruled it out.”

Theresa Kiernan, the town’s receiver of taxes, said she intends to run for supervisor. “I am planning to screen. I feel like I can contribute a lot more.” Kiernan has two years remaining in her current position, and said she would retain her job should she not be chosen or should she run and be defeated.

Malone, who is also the head of the town’s Conservative Party, hasn’t tipped his hand either. Two town hall insiders said there is growing dissatisfaction with Malone and that it is unlikely he will get a GOP nod even if he runs. He has been missing in action for most

Published 3/27/2013 of his term in office – often skipping meetings – and is viewed as unelectable by some pundits from both parties.

Kabot sent letters to both the Southampton Town Republican Committee Chairman Bill Wright and Malone to formally state her interest in being screened for potential nomination as a supervisor candidate for both the Republican and Conservative Parties.

On March 14, Kabot met with Southampton Town Republican Chairman Bill Wright and ViceChairman David Gilmartin to discuss her exploratory campaign, the

positive feedback she has received from prior supporters, and her desire to screen for the Republican nomination. According to Kabot, the party leaders firmly stated that their intention is to screen registered Republican candidates for supervisor for the nomination for this year’s election, and welcomed her to send formal letters of interest to the committee members.

Throne-Holst is expected to run on the Democratic and Independence Party lines, as she did two years ago.

A good friend of The Independent and a former account executive at this newspaper died on December 11 at IU Methodist Hospital, Indianapolis, IN. Robert Aldridge (Robbie) Landrum was well known locally – before coming to The Independent he worked at The East Hampton Star where he was lovingly referred to as “The Voice” because of his silky, baritone telephone manner.

The Landrum family kept a summerhouse in Sag Harbor and Rob grew to love the area. He moved to Sag Harbor fulltime after college while working as an advertising sales representative for The Star. He later lived in Bridgehampton.

Born in Chicago, Rob attended Mt. Carmel High School as a member of its swimming team and North Park College. According to his sister, Dr. Gail Victoria Landrum, Rob was an avid fan of the Indy 500 and was a gentle, easygoing friend to many in Sag Harbor, East Hampton and the East End. A funeral Mass was held Saturday at St. Thomas the Apostle Catholic

Cahill Rests Her Case

After 20 years of service on the bench, East Hampton Town Justice Catherine Cahill is getting ready to hang up her gavel. She won’t be running for re-election, setting the stage for the first serious contest for the position in a long time.

“It has been an honor and a pleasure to preside over one of New York’s 10 busiest justice courts,” Cahill, who was out of town and not immediately available, wrote in an essay in advance of a recent re-election bid. “I am proud of the level of service and professionalism that the residents of our town receive when dealing with the justice court.”

“I learned the criminal justice system from top to bottom, and that experience has served me well in my time on the bench,” she wrote.

She learned a bit about construction, too. The town’s justice court building – at times a source of controversy -- was crafted during her tenure. She pursued grants to include some security measures once the town’s finances began to deteriorate.

“Cathy’s respect for the justice system and those involved in it are just a few of the reasons why she was elected over and over again,” Councilwoman Sylvia Overby praised this week. “Her knowledge and leadership will be missed.”

This year, three contenders will vie for Cahill’s empty seat. Carl Irace, a former attorney for the town specializing in land use, will run on the Republican ticket.

Although their slate has yet to be solidified, local attorney and volunteer firefighter Steve Tekulsky is the likely Democratic candidate.

V-Day Dance: Rising For Women

Just like moons and like suns, With the certainty of tides, Just like hopes springing high, Still I’ll rise . . .

Maya Angelou’s words rang out in Bay Street Theatre in Sag Harbor Sunday evening as the Neo-Political Cowgirls dance troupe, along with V-Day founding committee member Lynn Blumenfeld, hosted a community V-Day “rising.”

V-Day is a global movement designed to draw public awareness to the fight to stop violence against women. The V stands for Victory, Valentine and Vagina. This year for the first time since its inception, V-Day celebrations included a worldwide dance.

Blumenfeld recalled the birth of the movement, born 15 years ago “in Eve Ensler’s living room.” A Tony Award winning playwright, Ensler authored The Vagina Monologues.

Her experience with the play inspired the creation of V-Day. Fifteen years ago, Blumenfeld recalled, the New York Times wouldn’t print their ad because it included the word “vagina.”

“They had a problem with the word “vagina,” Blumenfeld related.

“I had a problem with [the fact that] one in five women is raped.”

On Sunday, she marveled that from those beginnings a global movement arose. Two hundred and five countries participated in V-Day this year, with public performances in places where such expression as dance is dangerous, and could mean prison or even execution.

As this year’s event approached, Blumenfeld contacted Kate Mueth of the Neo-Political Cowgirls dance theater company. “Lynn called me and said ‘I think you should spearhead this with the Neo-Political Cowgirls,” Mueth reported. “It plays right in with the mission of our company . . . I felt, “If it fits like a glove, there’s no excuse not to do it.’”

NPC is a not-for-profit company operating under the auspices of the New York Foundation for the Arts.

It works with girls and women to portray their stories through dance.

The movement this year was titled, “One Billion Rising.”

Blumenfeld explained: one in three women will be raped or beaten in her lifetime. Across the globe, one in three equates to one billion women. “That’s a big number,” she said, noting that the strategies used by politicians and leaders haven’t changed the harrowing fact . . . perhaps a global awareness action

Bay Street Theatre donated the space and proceeds from admission offerings were to be split between the V-Day organization and The Retreat.

H o p e K r a m e r, d i r e c t o r o f philanthropy from The Retreat was on hand Sunday. She said she was thrilled to witness the performance.

The Retreat mission, she said, blends with the Cowgirls’ goal of “giving women a voice.”

According to the V-Day website, last year over 5800 benefit events were produced by volunteer activists in the United States and around the world, “educating millions of people

We used to have fish sticks or fried clam strips which was weird, since we lived in Sag Harbor and could have easily walked down the block and caught real fish. *** And then there's Limbo. Limbo is a place kind of like heaven except God doesn't live there. The way it

works is when you die St. Joseph and John the Baptist hold a pole up and you have to pass underneath by dancing to Caribbean music. They keep lowering the bar, one inch for every time you had an impure thought. If at any point you can't pass under it – boom! You're in limbo. Hell, I'd have to be a snake to make it under.

OK, I made that story up. The only good explanation I've ever heard about limbo came from my first grade nun, Sister Mother Superior. She said if a newborn baby, too young to have committed a sin but not yet baptized, were to suddenly die, the child would go not to heaven but to limbo.

I thought about that for a long time. Basically, what sins can a newborn baby commit? I mean, they can't commit adultery; I suppose they could covet their neighbor's crib or something like that. No matter how you slice it though, there must be a lot of dirty diapers in limbo, which is probably why God never visits there. *** Growing up in Sag Harbor, Memorial Day meant the parade and barbecues. Everyone was either in the parade or went to Main Street to watch it.

The line-up was the same: boy scouts and girl scouts, a few local dignitaries like the mayor who sat in the front seat of someone's convertible, the ladies auxiliary, and of course the annual highlight, the North Sea Fire Department. The guys would dress up as bums and act really crazy and shoot water all over the crowd. Somehow, that passed for funny in those days.

The Sag Harbor Community Band was a staple in the parade. The musical director when I was a kid was "Pop" Mazzeo. The musical director when my mom was a kid was "Pop"

Mazzeo. My grandfather played in the band – “Pop” was the director. If you do the math you realize Mazzeo became the musical director when he was still a fetus. *** The Ruskies were our bitter rivals in the 60s. The Cold War reached a crescendo when we discovered Russia was setting up shop in Cuba – obviously, the plan was to steal all the good baseball players. They also ostensibly beat us into space, although most historians now believe there was no such think as a sputnik and we never landed on the moon, either. It was all smoke, mirrors, and movie cameras.

It went like this: America: we sent a monkey into space Russia: we put the first man in space America: we orbited the earth Russia: we orbited the earth 100 times America: we put a man on the moon Russia: we flew through the Milky Way America: we ate a Three Musketeers *** When I was growing up we didn't have any vegetarians in New York.

There were a few, I imagine, in California, but to me it was probably just an excuse to keep from getting drafted into the army.

During the late sixties, of course, when freakazoids abounded, there were plenty of vegetarians. The weird thing is most of the guys I knew who were vegetarians were like, six-foot, four-inches tall. There is nothing sadder than seeing an emaciated lanky guy with a pony tail and size 16 sandals walking around hunched over, looking like he weighs 85 pounds. In fact, I could never tell the difference between the vegetarians and the speed freaks, except the speed freaks talked a lot more.

"Vegans" didn't exist back then.

In fact, I never heard the term until I started teaching at Friends World College in the late nineties. Everyone, it seems, was a vegan. I thought it was a religion – a student would say, "Oh I'm a vegan," and I'd reply, "I'm a Buddhist."

Search For Hit And Run Suspect Continues

An international manhunt is continuing with both local and federal authorities searching for the driver police say is responsible for a hitand-run crash that killed a nun in Water Mill last July.

The alleged fugitive, Carlos Armando Ixpec-Chitay, reported as a 30-year-old Guatemala native, was behind the wheel of the SUV that struck and killed Sister Jacqueline Walsh, 59, of Syosset, as she was walking along Rose Hill Road on July 9 of last year, according to police.

Officials say the car belonged to Ixpec-Chitay’s employer. Police say it was found abandoned later that night with front-end damage about a half-mile from Walsh’s body. Ixpecchitay was identified as the driver of the vehicle about 10 days after the incident.

Walsh was a Bronx native and a cherished pastoral associate at St. Edward the Confessor in Syosset.

She was staying at a retreat house with fellow members of the Sisters of Mercy at the time of her death.

ered by a passerby at 8:30 PM the night of the accident.

The 30-year-old suspect was reported to frequent Riverhead and Water Mill, the former of which his younger brother, Miguel, resides in.

Police were successful in prosecuting the suspect’s younger brother, convicting him in federal court last month on a felony count of making a materially false statement. He was scheduled to be sentenced yesterday in U.S. District Court in Central Islip and faces up to a year in prison.

In an effort to pressure the older Ixpec-Chitay to turn himself in, authorities have also branched out to other members of the suspect’s family. Two relatives were detained on violation of immigration laws.

U.S. Marshals and Southampton Town Police have been working together to learn the suspect’s whereabouts, but have so far been unsuccessful. Suffolk County Crime Stoppers has put up a $5000 reward for information leading to the arrest and conviction of Ixpec-Chitay.

the lead of State Assemblyman Fred Thiele, and garnering no small measure of ire from the GOP, especially locally.

But all was soon forgiven and Schneiderman ended up receiving a three-way cross endorsement for a subsequent re-election bid.

Most recently, he ran for another term on the Democratic ticket, with the Independence Party line secured once again. (The Indies have endorsed Schneiderman every time he’s run for office.)

The Democrats plan to hold their screenings in Februar y, Frankl reported. To the idea of Schneiderman seeking her party’s nomination, she said, “Everybody’s welcome to screen, it’s a democratic process.”

While Schneiderman maintains positive working relationships with county Dems -- he caucuses with them in Hauppauge -- locally it seems Democratic loyalists have never forgiven him for unseating Cathy Lester and wresting away the town board majority in 1999.

“I see myself as somewhere in the center, and that suits me well,” he said, speaking of political

allegiances. “I agree sometimes with the Democrats, sometimes with the Republicans and sometimes with neither of them. I’m more about the issues than a party agenda.”

County legislators serve under term limit mandates, Schneiderman could run one last time this fall, but said this week, “I feel like I’ve accomplished a lot of what I set out to accomplish as a legislator. I feel like I may be more needed here in East Hampton. This is where my heart is.”

Like Cantwell, Schneiderman reported overwhelming support from a diverse array of community members. “It’s been very flattering,

If successful, Schneiderman wouldn’t be the first town supervisor to leave, then come back. Judith Hope, who was elected in 1973, left in 1976 to work with Governor Hugh Carey. She returned in’83 and won a re-election bid in 1985. At certain points Cantwell served alongside her on the town board dais.

Town GOP Committee chair Kurt Kappel did not immediately return a call for comment. Although he has declined to comment definitively, insiders say Supervisor Bill Wilkinson won’t seek re-election.

Susan Rockefeller, Mermaid Extraordinaire

Susan Rockefeller wears many hats. A true Renaissance woman, Rockefeller is a documentar y filmmaker, author, jewelry designer, mother, wife, environmental activist, and philanthropist.

She serves on the Board of OCEANA, The Alaska Conservation Fund and the David Rockefeller Fund. She has launched her jewelry collection with Honora pearl jewelry.

She also put out a documentary film this year called Mission Of Mermaids.

O n J u n e 15 , R o c k e f e l l e r will be honored as “Mermaid Extraordinaire” at the South Fork Natural History Museum’s (SoFo) 24th annual summer fundraising party, “SoFo Rocks.” SoFo’s mission is to provide nature education for children and adults and to foster an interest, knowledge and appreciation for the natural world. The event will also celebrate “Honorary Mermaid,” Christie Brinkley.

“I love SoFo. I think it’s one of the best kept secrets on the East End,” said Rockefeller, “giving people an opportunity to see the diversity of wildlife on the East End, I don’t think there’s anything else quite like it.”

She continues to explain how SoFo, “reawakens a lot of curiosity for both young and old people. All ages can really enjoy and have their senses awakened.”

When asked how she felt about being honored at the upcoming event, which takes place at the museum grounds, she said, “I love the sensibility of the event. I like that it’s down-home and low key, but very cool in terms of the design, the tents, and the music. You

get people that really do love the nature of the East End.” Rockefeller continues, “Andy Sabin [president of SoFo] is a great conservationist and visionary . . . I’m thrilled to be on that stage with Christie Brinkley and Andy.” She also stated how she was “looking forward to dancing.”

The music this year will be provided by one of the hottest DJ’s around, DJ Phresh, thanks to Adam Alpert and his company 4AM DJ’s.

Rockefeller has had ties to the Hamptons since she was young.

“I’ve been going to the Hamptons since I was a small child and much of my wonder and awe comes from the beach, and the sand, and diving into the ocean waves.”

Mission of Mermaids raises awareness about the ocean’s dwindling resources, while using beautiful imagery of mermaids and childhood memories to educate viewers. Over the past year the film has been featured at the Hamptons International Film Festival as well as film festivals worldwide. It will be available for download this fall.

Rockefeller calls the film “my love letter to the ocean.”

Her fall 2013 jewelry collection also carries an ocean theme. With the collection she wanted to “create something that is beautiful and wearable and also make a statement . . . I wanted to find a way to talk about things that are meaningful through something that’s also artful . . . The idea is to have something beautiful that reminds you of the connection to the ocean . . . Art is the highest form of human expression.”

Hampton Bays Homeless Shelter To Close

Hidden Cove, the Hampton Bays motel converted into a Suffolk County homeless shelter despite complaints from neighborhood residents, will weed itself of all county-welfare recipients by the end of September and probably sooner.

The Independent, in a series of articles last year, detailed the plight of three rent paying residents the county tried to evict from the motel, on West Tiana Drive, and replace them with county homeless at a significant cost to taxpayers and the Hampton Bays school district.

An elderly woman and her disabled daughter were two of the victims – they were paying $700 a month to live year-round in the building. But as the County Department of Social Services (DSS) moved more and more homeless people in, it put pressure on the women to leave. First, their

rent was raised to $1140 a month, and when they balked at the higher number, the county – through a management company it hired to run the facility, Community Housing Innovations Inc. – eventually sued to evict the pair.

The larger issue was that the residents brought in by the county weren't from the area – in fact, the county had to transport school-age children living in Hampton Bays back to their original school districts every day.

"This is a sensitive issue," said County Legislator Jay Schneiderman, who worked with Southampton Town Supervisor Anna ThroneHolst lobbying the county to close the facility to homeless residents.

"We have a responsibility to help these people, but these weren't our homeless families."

facilities upisland which will allow the homeless families to stay closer to where they originally lived, and for the children involved to be closer to their original school districts, Schneiderman added.

Gregory Blass who was the Commissioner of the Suffolk County Department of Social Services until January, knocked heads with Throne-Holst over the facility. Blass, in an exclusive interview with The Independent last November, said housing at Hidden Cove Motel was designed to be temporary, and that no more than six students were enrolled in the Hampton Bays School District at any given time.

Throne-Holst said in fact 40 children from Hidden Cove are on the books at Hampton Bays School District. "Once they are [moved to Hidden Cove] Hampton Bays becomes the sending district and pays the cost to educate them in perpetuity," she said, meaning local taxpayers foot the bill, even if the students are transported back to their sending districts.

"Blass saw his mission as putting the homeless in Southampton," Schneiderman opined. But after a meeting with County Executive Steve Bellone last Friday it was decided to move the DSS residents

from Hidden Cove.

"Last Friday Supervisor Throne-Holst and I met with officials from the Bellone administration and the Department of Social Services and made the case for the discontinuance of the Hidden Cove shelter in Hampton Bays." Schneiderman said. "It was agreed that the county would stop placing new families at Hidden Cove and would place the remaining families in permanent housing over the next few months. The facility may be closed as early as July, but no later than by September 30 of this year. I appreciate the cooperation we have received from County Executive Bellone in addressing this issue."

The decision comes too late to help Nick Saradakis, a former tenant who went public with his complaints about the facility and CHI. He said the county spent as much as $5000 per family per month of taxpayers' money for residents – Saradakis paid his own rent, yet he was evicted after a protracted battle with CHI and the DSS.

Country Willie Wows ‘Em

The Montauk Playhouse Community Center Foundation got the money, and Willie had the time.

Country music icon Willie Nelson performed at the Surf Lodge in Montauk on Sunday night, drawing an estimated crowd of 500 to the venue proper as pedestrians lined the surrounding streets, and hundreds more fans formed a flotilla of kayaks, rowboats and surfboards in Fort Pond.

Maureen Rutkowski can’t help it if she was still in love with Nelson, the folks at Surf Lodge and the community on Monday morning. At one point on Sunday, as she snapped panoramic pictures with her iPhone, Rutkowski took in the sight – the sun setting, Nelson playing, the people on boats and a catamaran – “I was getting emotional, saying,’ This is what this community is all about.’”

Project manager for the foundation, Rutkowski estimated the event will bring in over $20,000 when the final tally is completed.

Originally touted as a free concert, within days of the announcement on the Surf Lodge website, the event morphed into a de facto playhouse fundraiser. For a $100 donation concertgoers were guaranteed access. Within 24 hours, however, the Surf Lodge announced the donation option was sold out. “It blew me away, how quickly it went,” Rutkowski enthused.

By Saturday morning, the Surf Lodge website reported there were no more general admission spots available either, with organizers asking those who didn’t already have tickets to stay away. “Due to our overwhelming capacity for the Willie Nelson performance, we cannot honor general admittance on Sunday, June 9th,” the Lodge’s website said. “In respect of our community, we ask that you do not try to get access to the Surf Lodge on Sunday, June 9th.” . . . and so it was “Cryin’ Time” for those who hadn’t acted with haste.

But not for savvy locals who found their way to see, or hear, Nelson and buddy Jimmy Buffet.

Music lovers simply stood along Edgemere Road, set up lawn chairs in the grass on Industrial Road, or paddled across Fort Pond for front row floating.

Surf Lodge has had its bumpy times with town code enforcement and locals who complain of the nightspot’s popularity. For East Hampton Town Police Chief Ed Ecker, when it comes to the Surf

Lodge, he might say traffic safety is “always on my mind.”

“Everything went so smooth,” Chief Ecker reflected Monday morning. There were no arrests, no noise complaints, and no road closures, though some feared the event would precipitate traffic travail. The Lodge emptied its parking lot to allow concertgoers to line up there, rather than along Edgemere Road, as can happen on busy Saturday nights at the club.

Nelson, his hair in signature braids wore a T-shirt, plus a red, white, and blue mesh scarf, and jeans. He threw red bandanas to women in the crowd. They weren’t all the girls he’s loved before.

A guest at Gurney’s Inn, the aged singer performed two Hank Williams song, as well as Patsy Cline’s hit “Crazy,” (which he wrote) during a set that lasted just over an hour.

Local legend Jimmy Buffet was on hand and sang “Happy Birthday” to Nelson, who turned 80 this year.

New Rules For Southampton Cemeteries

No more Frisbee. No more Halloween walks. Even no more grave rubbing.

Southampton Town’s cemeteries will be getting stricter preservation methods in an attempt to protect the historic grounds.

The town expects to clean up the designation for its cemeteries and historic burial grounds, which currently lists final resting places in the same town code as parks, recreation space, and ballfields.

The new legislation was introduced last week and is expected to be considered at an upcoming town board meeting.

“I look at these sites as outdoor museums,” said town historian Zach Studenroth.

He added the cemeteries had been included in the village’s code section to “basically keep the grass mowed.” Studenroth also noted the need to prevent any human contact, something he deemed damaging for carved stone artifacts that have

Between 8 PM and 6 AM, people would be prohibited from being on the grounds. The proposed legislation would create that stipulation as well as a completely new section in the town code for town-owned historic burial grounds and abandoned cemeteries.

“This is part of momentum that’s been happening for a few years now to really protect our historic resources,” said Councilwoman Bridget Fleming.

Monument Conservator Jonathan Appell will lead two workshops for local residents interested in the preservation, restoration and care of the town’s historic burying grounds on Friday and Saturday. Everything from cleaning methods and resetting tilted headstones to reattaching fragments of headstones already fallen off will be discussed at the

workshops.

“Gravestone conservation and historic stone preservation is the art and science of preserving all we can of our heritage carved in stone,” Appell said.

The workshops are being offered

by Southampton Town Clerk Sundy Schermeyer. Friday’s workshop will be at the North Sea Burial Ground, with Saturday’s session at the East Quogue Methodist Cemetery. Meeting On Sagaponack Police Set For August

Tiny Sagaponack Village is considering breaking away from the Southampton Town Police Department.

The village of about 700, the majority of which are second homeowners, gets a seasonal officer between May and September on the beat, with the larger area patrolled by a car. The village pays about $2.3 million a year to the town for police protection, with some officials and residents believing they haven’t received enough protection for what they pay.

An informational meeting with the village board on the future of police service in Sagaponack is

scheduled for August 10 at 9 AM. Inquiries will be laid out, options will be discussed, and solutions will be proposed.

According to village Mayor Donald Louchheim, the village can save money by doing its own policing, noting that police protection is the largest part of Sagaponack’s budget.

“In the worst-case scenario, we could save a half million dollars a year,” he said. “We pay $2.3 million per year to Southampton Town for a police force,” he said.

Village officials said forming a small police department of their own, and contracting with the town or another municipality for other

law enforcement services, could save the village residents thousands, and potentially millions, according to the proposal supporters.

Former Southampton Town Police Chief William Wilson has expressed interest in being Sagaponack’s police chief, should the village get its own force and the position is offered to him. Wilson has also prepared cost estimates for a new village police department with village officials. State law requires village departments have a chief and at least two officers.

7/24/2013 Southampton Super visor Anna Throne-Holst said she scheduled a meeting with Police Chief Robert Pearce (who was invited to next month’s informational meeting) and Louchheim to discuss details on the conditions of the village forming its own police force.

“They need to look at a full analysis of what the costs for them are going to be over time,” she said.

The issue comes at a time when the neighboring village of Sag Harbor is dealing with its own police problems. In the Harbor, the police staffing was a major issue with regard to a struggling budget.

FBI, Investigating Bishop, Came To Southampton

The Independent learned this week that an FBI agent grilled Southampton Trustees about Congressman Tim Bishop’s role in the so-called “Plover-Gate” incident.

On another occasion last spring, two lawyers from the House Ethics Committee also came to town, investigating the same matter.

Specifically, the agents wanted to know the extent of the Congressman’s role in securing a permit for a fireworks display near an active Piping Plover nest in May 2012.

The Bishop camp ignored several requests for comment about the FBI investigation, and whether there is a State Department probe underway.

The House Ethics Committee was scheduled to make a statement about the investigation today.

A Sagaponack homeowner, Eric Semler, asked Bishop for help securing a fireworks permit just five days before his son’s Bar Mitzvah.

Bishop’s office helped cut through a myriad of red tape, dealing with several different local, state, and federal agencies – but not before his daughter Molly, a fundraiser for the Congressman, petitioned Semler for a $10,000 contribution.

“We had a discussion about the

permit process,” said Eric Shultz, the President of the Trustees. “He asked about the procedure and whether it was directly followed.”

Shultz turned the agent over to Fred Havemeyer, who was the board’s point man in the matter.

“An FBI agent came in last winter,” related Havemeyer, a Trustee in charge of the permit process in that area of town. “He wanted details about what the office did to aid [Eric] Semler and Bishop’s office finding a way to make [the fireworks] happen.” The thrust of the questioning was “There was a tremendous amount of activity” in the days before the fireworks, Havemeyer said.

Semler a wealthy hedge fund manager with a house on the ocean, planned the fireworks as part of a Bar Mitzvah celebration for his son.

Havermeyer categorized the interaction between the Trustees, the DEC, the US Fish and Wildlife Service and Bishop’s office as “intense.”

“I’ve tried to help people and worked with the Fish and Wildlife people in the past,” Havemeyer related. “But it’s usually for someone who wants to have a [beach] party” near a Plover nesting site.

As of last year the movement raised over $90 million. Writing for The Guardian, Ensler articulated this year’s effort. While V-Day has had successes over the last decade and a half, she said, “We expected to be out of business by now.”

Over the years, she said, “We have broken taboos, spoken the word “vagina” in 50 languages in 140 countries, called up stories and truths about violence against women, breaking the silence, supported amazing activists across the planet who have created and changed laws . . . But we have not fulfilled our mission to end violence against women and girls. In fact the UN says that one out of three women on the planet will be beaten or raped in her lifetime. That is one billion women plus. That is simply insane and unacceptable.”

The Rising’s reach has been staggering. According to Ensler, “It is happening in all 7000 islands of the Philippines and in over 50 cities in Turkey. There are 100 risings in Italy, 135 risings in the UK and thousands in North America. We are expecting 25 million to rise in Bangladesh, and it’s hard to

imagine the numbers in India but they will be massive.”

She continued, “The diversity of the risings is beyond anything we could have imagined: the carnival queen in Rio de Janeiro, the queen mother of Bhutan, prime ministers of Australia and Croatia, members of the European parliament, lamas, nuns, unions leaders, avatars in Second Life, zumba dancers, classical dancers in Karachi, cast members of Wicked and The Lion King on Broadway, women in the Andes, 200 women in a parking lots in Kamloops, British Columbia, Iranian teenagers in their bedrooms, thousands of Afghani women dressed in OBR scarves, Filipino domestic workers in Saudi Arabia, people on bridges, in buses, prisons, squares, in stadiums, in churches, theatres.” ... And that includes Bay Street, where about three dozen dancers – women, teens, children and even a couple of men – ventured out on a frigid afternoon to spend two hours learning the routine shared by participants across the globe, to quietly whisper why they chose to rise, and then, when the song began, answer Ensler’s call to “Dance with your body, for your body, for the bodies of women and the earth.”

Kabot said that although she has not spoken with Malone, she did receive a reply to an email she had sent to him last week inquiring about the protocols he envisioned for the Conservative Party screening of local candidates.

Kabot said that Malone indicated that he has not finalized any decision with regard to his 2013 plans for re-election to the town board or some other post and that candidates should not contact him directly or the County Chairman Ed Walsh.

One town hall insider said Malone is angling for a judgeship but did not know the specifics.

He has not returned phone calls and thus could not be reached for comment.

The rather convoluted process for a would-be candidate is cause for concern. “You are screened by invitation only,” Kabot said. “There is

no guarantee. I’m asking for clarity.”

Kabot is concerned that insider dealing may hinder her bid for office. “Unless the contender is extraordinary and truly would be a person whom the rank and file voters would prefer to have at the top of the ticket for the Republican Supervisor candidate, then concerns remain in my mind about whether or not such person is really in it to win it or just stepping in as a placeholder.”

Kabot said the GOP must avoid the fiasco of two years ago and must refrain from nominating a candidate who is “taking one for the team.” Running someone with no chance to win, she said, amounts to “a defacto cross-endorsement deal for Throne-Holst.”

One fear is a candidate will be named who will subsequently withdraw after the filing deadline.

“I have articulated these concerns to Republican Party leaders,” Kabot said. “The supervisor’s seat should not be the subject of horse-trading.

I believe that whoever is nominated as the supervisor candidate on the Republican line should clearly state their reasons for running and their unwavering intention to remain on the ballot all the way through Election Day.”

Semler and his wife ended up giving the Bishop campaign a total of $5000 a month later, but not before complaining – he called the solicitation from Bishop’s camp “really gross” in an email to Grucci just days after he called Bishop asking for help. In one email Semler complained that Bishop, “didn’t hesitate to solicit me in the heat of the battle.”

The Independent revealed last year that Semler is a business associate of Robert F.X. Sillerman, Bishop’s long time friend and a huge campaign contributor.

ler’s firm, TCS Global Equity Master Fund, was involved in an offering by a new company Sillerman controls, Viggle Inc. TCS, according to the document, held or holds one million warrants to purchase shares of Viggle, and Semler has “voting power and investment power” over the securities held by TCS Global.

Viggle recently donated $5400 to Bishop, who has spent close to $40,000 in campaign funds on legal fees since the investigation began.

“It was quite an effort, a tremendous amount of work,” Havemeyer said about procuring the necessary permits for Semler. “Usually you get a thank you note or something.

There was nothing. That has rankled me ever since.”

Bishop spent the days before Memorial Day weekend working frantically to grease the skids for Semler.

Bishop thrust himself into the permitting process even as his daughter was hitting up Semler for a donation. On May 24 a Grucci higher-up sent out a group e-mail to some employees: “Wow . . . Congressman Bishop is meeting with the DEC regional director this morning. Be prepared to move forward.”

It is not known what transpired at that meeting or even if it took place, but the next day, Papa said, a USFWS superior wrote to Bishop, “you’re

good to go” – a direct reversal of the USFWS position from a day earlier.

In the interim the scope of the fireworks display was pared down and the location was switched to the roof of the house.

Despite the clutch of plover eggs near the fireworks site – one of only 18 in the entire town of Southampton – Semler delivered his Bar Mitzvah present to his son, and 200 people gathered a few hundred yards from the plover eggs.

Semler sent a note to the Congressman on May 28th: “I want to thank you again for going out of your way to help us . . . I can’t really believe we pulled it off. Your relentless focus on this task was so impressive.” Three weeks later he and his wife each contributed $2500 each to Bishop’s campaign, the maximum allowable.

It is illegal for a sitting congressman to solicit a contribution for performing an official function.

Bishop donated the money to charity after the story broke but insisted there was no wrongdoing on his part.

Semler initially complained bitterly about Bishop’s camp asking for money. After reportedly receiving a call from Bishop he changed his story – Semler told Newsday the request for a donation came only after the permit for the fireworks was obtained. However a string of e-mails and other documents obtained by this newspaper clearly contradict his statement.
