CHRISTMAS EVE IN BROOKLYN

For me it’s the best day of the year. It’s about food and family. I cook until I’m ready to drop. But at one point of the evening I stop and think of what it was like when I was a kid. I reprint this column every year because I will never forget . . . It wasn’t about Christmas Day for us. Christmas Day was about turkeys and hams and cranberry sauce. That wasn’t our food. The holiday ads of the time showed illustrations of waspy-looking, Norman Rockwell types bowing their blond heads in prayer before they chowed down the traditional Christmas Day fare. This wasn’t us. It’s not that we had anything against this. It’s just that our parents and grandparents were still desperately holding on to Italy and the Italian customs they brought to this country. We knew we had little in common with the people who owned this country, but Christmas was the one holiday equalizer. It was something we all shared. We just chose to celebrate the birth of Christ the nightIndependentAd_July12_Vert.pdf before Christmas instead 1of on the day itself.

So my memories are Christmas Eve reminiscences, and they’re sweet and pleasant to recall. I remember my grandmother starting to prepare the Christmas Eve dinner in early October by pickling cauliflower and onions and peppers and anchovies . . . The sweet smell of chestnuts as they burned until they were inedible (we forgot them in the oven every year) . . . My mom haggling with the man who sold Christmas trees on Avenue U . . . She would buy the tree on the night of December 24. She always wanted to pay 50 cents. He would always hold out for a dollar. “You won’t be able to sell it in a few hours,” she would taunt. “I’d rather burn them,” he would reply. Every year they would settle at 75 cents . . . I remember eels being cut up in little pieces, dipped in egg, and dredged in flour. Then after they were tossed into a skillet in hot oil, the pieces would start to wiggle. It was right out 7/27/12 4:33 of PM a horror movie. It made me wonder about life after death . . . I remember how I would sneak into our tiny kitchen and sweet-talk Your Home is Your my grandmother into giving me a Most Valuable Asset taste of the mountain of food she So trust a company that’s always here for you. had cooked for our family. The meal started with pinkie-sized, crisp little nameless fish that were fried and were to be eaten whole. Then came

the polpo (octopus), which was cooked in a garlicky tomato broth. There was a rich, briny, clam sauce waiting to be tossed with linguini; shrimps baked, fried, breaded; baccala (cod), which had been bought dry and soaked for days, now rested in a platter, smothered with fried onions and capers. A fish salad with every delicious fish in the sea, swimming in garlic and lemon and olive oil. Today, so many, many years later, I marvel that the memory can still make my mouth water . . . All of our Christmas Eve meals started at 7 PM, when my father came home from work. At 11 PM – four hours of solid eating later – it was time for dessert. There was fresh fruit for the faint of heart, but the diehards would dive into the white cardboard boxes that were filled with dozens of Italian pastries with wonderful names like cannoli, pasticciotto, sfogliatella. We wouldn’t stop eating until the boxes were empty. Each morsel, every crumb, was a way of holding on to the holiday for a few minutes more . . . I remember one year my grandfather, perhaps a little tipsy from the combination of food and drink, helped me to set aside a glass of red wine for Santa. It was empty when I woke up the next day . . . We were pretty broke, but somehow Santa managed to bring me everything I ever wanted. The best present I ever got was a new Schwinn bicycle. It shows you what a trip to Beneficial Finance could do to make the spirits bright . . . I took a chilly subway train ride with my dad one Christmas Eve in search of phonograph needles so we could play an old-fashioned phonograph and listen to some ancient Italian records. We found the needles in a little shop near Coney Island. When we rushed home and tried to play the records, we discovered that the phonograph motor was worn down and Enrico Caruso sounded like he was on Quaaludes. Not that anyone ever heard of Quaaludes in those days. The only drugs we knew were called

Luckys and Camels and Chesterfields ... When I was 16, my parents bought me a 45 rpm record player and gave it to me on Christmas Eve. That night, I had just one 45 record (Doris Day singing “Secret Love”). I listened to the same song over and over and over and fell in love with the blond, freckled singer. I still can’t hear that song without thinking of that night . . . Then there was the Christmas Eve night that Manlio “Junior” Fossatti (age 11) decided to tell me (age nine) that there wasn’t any Santa Claus. He told me while we waited in the 86th Street station of the Sea Beach line for our fathers to come home from work. While he was at it, he also told me about sex. You lose one, you win one, I always say . . . The Christmas tree ornaments were mostly handmade and had been around since the 1920s. My favorite was a little porcelain Betty Boop character. I realize now it was as close to a family heirloom as we got . . . Every Christmas Eve at midnight, Mrs. Calabrese from across the street (I was born on the secondfloor apartment of her house – she was the midwife) would bring us a platter filled with hot zeppoli, which was simply fried puffs of dough covered with honey. My brother Joe and I would burn our fingers and tongues racing to be sure to get the last piece . . . The night before Christmas on West 7th Street in Brooklyn was always the best night of the year. The food was so delicious, it will always exist in our memories. It was a time when the language spoken was Italian with just enough English thrown in to remind us where we lived. It was a time when young couples walked past our windows as they went to midnight Mass at St. Simon and Jude Church or Our Lady of Grace Church. It was a time when life was easy . . . The night before Christmas on West 7th Street in Brooklyn. It’s with me at this time every year. If you wish to comment on “Jerry’s Ink” please send your message to jerry@dfjp.com.

Area Schools Cope With Newtown, CT. Tragedy By Kitty Merrill

There are no words. Over and over last weekend, the sentence was repeated -- by community members in Newtown, Connecticut, by parents whose children escaped Sandy Hook Elementary School where the massacre took place last Friday, by newscasters themselves as they covered the tragedy, by President Barack Obama, as he tried to comfort a shattered citizenry. But this week, educators at schools across the nation had to find the words, and try to help students grappling with the unspeakable news. On Monday morning, officials from several area schools described how they’re helping kids and parents cope with a horror that defies comprehension. Springs School Superintendent Dominick Mucci noted the morning meeting, held with parents and children before the school day starts, was attended by double the usual number of parents of the youngest students. Throughout the day, he said, staff planned to meet with upper grade levels in the K to 8 district. Over the weekend Mucci

Bias In A Bias Free Zone?

By Rick Murphy

Southampton Town officials made a big show of declaring town hall a “Bias Free” zone a few years back. But for a group of local-churchgoers, it proved to be anything but. Now a suit has been filed by a group of churchgoers charging Southampton Town and Village, and their respective police departments of violating their personal rights. Pastor Donald Havrilla and a small group of his parishioners from the Southampton Full Gospel

Church oppose gay marriage, and wanted to demonstrate peacefully on the first day marriage licenses could be issued, July 26, 2011. “ We w e r e m e e t i n g o n t h e sidewalk,” near town hall on Hampton Road, Pastor Havrilla recalled. “Our destination was the steps of town hall, which was perfectly logical. That’s where the PBA (the local police union) held a rally, so we fully expected we could.” There have been numerous rallies held on the steps – in fact, the town’s Anti-Bias Task Force members also

there. But in this case police intervened and refused to allow the seven would-be demonstrators on the steps or into town hall. “One detective said, ‘you can’t go there.’ He said it was some kind of biasfree zone. Things deteriorated from there,” Pastor Havrilla related. Patrick Impelli, another plaintiff, said an unnamed village police officer “physically blocked” the front door of town hall and barred him from entering “under threat of arrest.” Impelli had wanted to ask the town clerk for a phone number. Stephen Dunn, a Washington DC based attorney who is representing the plaintiffs, scoffed at the notion of an anti-bias zone. “It’s an absurd notion, it’s self refuting. It’s a farce. The town made it up,” he said. If anything, the designation could be construed to mean, “it’s a free speech zone,” Dunn opined, meaning his clients should have been able to speak their peace. Instead they were hustled away by police. “It’s outrageous,” Dunn said. Southampton Town Supervisor Anna Throne-Holst said the bias free zone was, “initiated by the town’s anti-bias task force. It is there to remind people we value and espouse non-bias for anyone who conducts business in town hall.” Southampton Town Attorney Tiffany Scarlato said the anti-bias

designation is “more a symbolic gesture.” Throne-Holst said she understands the plaintiffs felt they were victims of bias by the police. “I can’t comment because of the litigation, but we will address this as necessary,” Throne-Holst said. The double standard in place is paramount to the suit, Dunn said. When the PBA members crowded the steps a much more volatile situation potentially existed, yet they were free to do as they wished. According to court papers Pastor Havrilla was “threatened with unconstitutional arrest for publicly expressing his religious beliefs.” At one point a town officer identified in court papers as Detective Mazzeo, “demanded the group relocate to . . . the ‘free speech zone’ further away from the building flanked by tall, thick bushes.” The court filing has pictures of the so-called ‘free speech’ zone, which isn’t marked as such or designated in any way. “There’s nothing unusual about it,” Throne Holst countered. “Our job is protect people who do business in town hall.” The members of the church have been subject to a double standard many times because of their religious beliefs, the plaintiffs said. At one “town hall” meeting hosted by Congressman Tim Bishop Continued on Page 36.

rent-paying tenants, is much more cynical: the county is racing to get the state to designate the Hidden Cove Motel as a Tier II Homeless Shelter, a legal maneuver that will keep Southampton Town from enforcing local zoning laws. “It’s no secret the Tier II application is out there,” said Southampton Town Supervisor Anna Throne-Holst. The supervisor met with the Suffolk County Executive Steve Bellone about the motel last week. She is on record as opposing the conversion to a homeless shelter and indicated the town is prepared to sue to stop it. The Hidden Cove was once a summer, short stay destination for sun lovers. Over the years it has transitioned more and more to affordable year-round housing for locals. The two women, who asked not to be identified, have lived there for about four years, and were paying $700 a month rent – until last spring, when the management company running the motel for the Suffolk County Department of Social Services (DSS) jacked up their rent to $1140, “They are trying to throw us out. Here we are, disabled, unable

to make enough money,” the mother remarked. The two women were served with an eviction notice on Halloween, while the lights were out because of Hurricane Sandy. “They want us out because this place has quite a bit more value since they converted it to a homeless shelter,” the mother said. In fact, when all 32 units are filled with the county’s homeless, the owner, identified as LAML Realty, will receive about $33,000 a month in taxpayers’ money. The county has hired Community Housing Innovations Inc., to “manage’ the facility, and pays the not-for-profit, which grosses almost $17 million a year, a healthy stipend above and beyond what each resident receives in public aid. The two women are desperate to find another place before they are forced out. “At first they said they would help us. Social Services gave us a list of other rentals in the area,” the mother related. But when the pair started calling, none were in their price range. “The rental situation in this area is going up and up, not down. If I had the money I’d leave tomorrow,” the mother said. The management company provides security but is sometimes slow responding the concerns of the residents, the women said. Someone “tried to break in the unit when the Continued on Page 37.

Crafty For Christmas . . . With Clams By Kitty Merrill

Her kids think it’s a little goofy . . . until the Christmas noose begins to tighten and they need a few for last minute gifts. “I’m always doing stuff like this,” said Patty Collins Sales, sitting elbow deep in jars of paint and clam shells, at the table in the cozy kitchen in the house where she grew up on Cove Hollow Road in East Hampton. “I’m always doing stuff like this,” she said, dabbing white paint on The Grinch’s red cap. Her mother and aunts were crafty, and took their knitting with them everywhere they went. “It was totally normal to me; we’d go somewhere and they’d pull out their knitting.” Several years ago, Sales travelled to Syracuse to visit a friend who liked to paint Santas on bowling pins. During the trip the buddies browsed “a quirky little gift shop” upstate and saw Santa painted on a buoy. “I told her, ‘You should do that.’ She grew up in Michigan and didn’t even know what a buoy was for. We did one that year. Then I did a bunch more every year.” Sales sold the Santa buoys at Gone Local in Amagansett, branching out to do different college team versions on request. She even painted a couple of Yankees buoys “under duress,” the Red Sox fan confessed. Eventually, Sales hit upon the idea of painting shells. “I walk the beach almost every day and collect them,” she explained, admitting that on vacations to Florida, “I come home with half a suitcase filled with just shells.” In her kitchen last Friday, Sales had a basket brimming with shell iterations of The Grinch and the Abominable Snowman character from the classic TV show, “Rudolph the Red Nosed Reindeer.” This year she’s added Stewie Griffin from the popular adult cartoon show “Family Guy,” and she might be working on a Hello Kitty (we hope). At other times of the year, she’s made “Clamerican” flags. Sales uses acrylic paint, and draws the characters free hand. Some years she’s gotten lots of requests for the shells, which can be in sizes big enough to make candy dishes or ornaments, and small enough to make pendants or an earring for husband Tony. “I make him wear it,” she said. In all, said Sales, making the somewhat wacky craft is fun. “It’s kind of like therapy. It keeps me off the streets.” Want your own Grinch or Stewie clam? Rudolph: I quit drinking, ok? Indy: What are you doing in East Hampton? Rudolph: I retired here. Indy: Dude, you only work one day a year. Rudolph: Yeah, but we unionized. Between sick days, vacation, early

EDITORIAL

The True Spirit Of The Holidays The recent debate in East Hampton over the burgeoning deer population is one we’ve opined about many, many times. Until all our local municipalities embrace a long term plan that is centered around contraception and sterilization this debate will rage. Briefly and for the record one more time, we oppose hunting as the sole solution, either by expanding the hunting season or by adding more places where hunting is allowed. And we abhor bow and arrow hunting altogether – it is inhumane and ineffective. The time approaches when we can’t have armed people walking around in our wooded areas discharging weapons – civilization, for better or worse, has encroached on most of the land once deemed acceptable for hunting. We are not against hunting, and we acknowledge its place in our history and culture. More specifically, people hunted for food more often than not in times’ past. We don’t believe many people do that anymore, and we reject the notion of “sport” hunting – there is nothing honorable in taking down an innocent animal. Like so many things we took for granted, it may be time to let it go, just as we can no longer let the dog out the back door, park at the beach without a permit, or leave the keys in the car at night. It’s lamentable, but a sad fact. There is one thing all of us can do. SLOW DOWN. All of us on the roads observe the

Independent VOICES

Snide Remarks To the Editor, The Independent did an appalling hatchet job on the homeless shelter at the Hidden Cove Motel. You bought into the disgruntled, holdover tenant’s fake story hook, line and sinker. His eviction is the result of his disgraceful, disruptive behavior. He will also not be homeless when evicted, and he knows it. Speaking of children, you can count on one hand the number of children attending school in HB SD. Most children at the shelter are pre-school age, and the families’ average stay at Hidden Cove is less than 6 months. Nor is there any septic system problem. Contrary to the snide remarks of the town supervisor, there is nothing wrong with the septic system, which was fully approved when the original motel received its CO for a 32-room, YEAR-ROUND motel, and which has passed inspection

consistently by the County Health Services Department ever since. Before the Hidden Cove became a shelter, it was for a period of time quite the center for police calls for all manner of criminal conduct, and overrun with vermin. The supervisor’s silence then was resounding, and speaks volumes. How pathetic for a public official to falsify the situation at a homeless shelter that is staffed with caseworkers and security 24/7, with rules that include a strict curfew, succeeding in placement of these families in permanent housing all over Suffolk County. Is it really heroic, Ms. Holst, to make political hay over the homeless just to ingratiate yourself with a misinformed civic association? Why not speak to the many residents of the area who have volunteered generously to help the Hidden Cove residents? This is the only homeless family shelter this Department runs in the entire town of Southampton, and you lead the charge as though it were an invasion, when it is primarily temporarily housed, single-parent families whose children are

same thing every day – too many drivers going too fast. If a deer does cross in their path, the odds of a catastrophic accident occurring increase proportionately with the speed of the vehicle. It’s a no brainer. We understand that deer carry with them danger, be it from Lyme disease or from traffic accidents. We also understand, at this time of year especially so, that embracing some kind of extermination policy is, if nothing else, bad karma. Let’s solve the problem sensibly and humanely, with an understanding that no living creature should be made to suffer because of man’s follies. The Best Of The Best On another note, loyal readers know next week we will publish our coveted “Best Of” issue with some of the highlights of 2012, culled from our editorial, arts, and photography departments, as well as a New Year’s Eve round up. All of us at The Independent would like to wish you and yours the best, and we hope you make the most of the holiday season. Our offices will reopen on January 4. Once again, thanks to all of our readers and advertisers for your support. Here’s hoping 2013 will be a banner year for all of us. under the age of five. Ms. Supervisor, if you want to indulge yet again with threats, scare tactics, and prejudice, do so with me all you want, but leave these unfortunate people alone. Try to fit your thoughts into the time of the Season, and reflect on this, if you will: “Whatever you do to the least of mine, you do to me.” GREGORY J. BLASS EDITOR’S NOTE: Gregory Blass is the Commissioner of the Suffolk County Department of Social Services. He did not respond for a request to comment on the article in question. This week we interviewed an 87-year old woman Blass is trying to evict from the same motel so he can give her unit to social services recipients – and taxpayers will pay the rent plus a hefty rent increase.

Lives At Stake Dear Editor, What does it take? If Super Storm Sandy wasn’t a wake-up call I don’t know what is. We on the East End, in the Peconic

region, just missed the big bullet. Next time, it could be us. Are we prepared? Now more than ever, for the sake of the people out east, the two airport runways and their supporting infrastructure at EPCAL in Riverhead must be preserved and maintained. The reality is natural and manmade disasters are an ever-growing serious concern. We must be prepared -- our lives are on the line. BTW I am a retired NYC police officer. JACK MCGREEVY

Diane Mehrhoff My favorite thing at the holidays are all the decorations. They’re so festive and they bring such joy just looking at them! I have an 8 foot cut tree with 2000 lights on it and I surround it with my collection of 72 wooden Santas. I’ve had some of them since I was a child. Joan Burkert What I love most of all is just getting together with everyone in the family and celebrating together. There are about 10 of us. And I also like going to church on Christmas Day and thinking about what this holiday is really about.

Wake Up Call Dear Mr. Murphy, In an article entitled “Evicted Man Cries Foul” (12/5/12), The Independent highlighted the way the Hampton Bays community has addressed a problem with a great deal of restraint and professionalism, the problem being Suffolk County’s use of a motel for temporary housing. A while ago I referred to an in-depth investigation into an architectural firm that allegedly constructed buildings which deviated from planning documents (The Supersizer of Brooklyn, NYT 3/18/11). This practice was uncovered by a fellow architect who believed it to be unfair and bad for the profession. In Southampton, however, the business community rarely calls out another business and in truth some businesses argue that calling attention to an unfortunate practice might reflect badly on the community. The unfortunate by-product of this belief, however, is that an entire community can easily become tainted by a single operator and property owners are penalized by a zoning change they didn’t buy into. So, in the absence of an in-depth investigation, the Concerned Citizens of Hampton Bays organized to send the message that a motel used by the County doesn’t reflect the mom-and-pop business culture of Hampton Bays. Although one can question whether it’s humane for the County to relocate families from familiar neighborhoods and schools to strange motels, the social component of this business is not really at issue. Rather the issue is whether the County is using taxpayer dollars to provide an unfair

I believe this problem could serve as a wake-up call for Southampton. Is it really in the best interests of the business community at large to allow a single operation to risk the success of the whole. SUSAN CERWINSKI

Paranoia Dear Rick, A devastatingly but all too familiar horror took place at the Sandy Hook Elementary School in an idyllic Connecticut town, Newtown, on Friday December 14. Twenty six were killed; 20 children six to 10 years of age and six adults. The Perpetrator was 20-year-old Adam Lanza. On another Friday five months and six days prior, July 20, 2012, another mass shooting occurred inside of a Century movie theater in Aurora, Colorado, during a midnight screening of the film The Dark Knight Rises. A gunman, dressed in tactical clothing, set off tear gas grenades and shot into the audience with multiple firearms, killing 12 people and injuring 58 others. The shooter was 24-year-old James Eagan Holmes, who was arrested outside the cinema minutes later. The names of the killers and locations of the carnage differ but their weapon of choice does not. It’s that same old reliable

semi-automatic “hunting” (read: Assault) rifle, sister to the military version minus the “Semi.” The following letter I wrote back in July seems eerily appropriate right now in December: Since I am not a gun enthusiast my opinions on the subject of guns are personal. Studies have shown that the number of homicides in a country is directly in proportion to the number of guns. The United States has the dubious honor of being fourth in the world in the number of gun related deaths per year only behind such distinguished company as South Africa, Colombia and Thailand. Conversely, all other advanced industrialized countries fare enviably better such as: Germany, Canada, Japan and England. Hunting is a passion for some. They enjoy trekking through the woods and they kill using their legally licensed rifle to shoot at birds and animals. The same applies to pistols and those wanting to be prepared to ward off home invasions. These rights are guaranteed by the Second Amendment and therefore perfectly legal. But what in the world is the need for military style Assault Weapons with huge repetitive rounds with the mere flick of a finger. If it takes that Continued on Page 23.

Continued from page 22. much firepower to kill a deer or quail or whatever needs killing, that hunter is a danger even to himself. The AR-15 Semi-automatic assault rifle is a converted version of the military’s fully automatic weapon. It utilizes highcapacity magazines with clips holding as much as a 100 rounds which could be fired off in a minute without reloading. One does not need an assault weapon to shoot a deer or protect one’s family. No one should own an assault rifle except our soldiers in the military and the law enforcement officers who protect us. In 1994 Congress passed a 10-year ban on assault weapons and President Bill Clinton signed it. Unfortunately, it was allowed to abate. During his 2008 campaign, Obama promised to reinstate the ban, and Romney signed an assault weapon ban as Governor of Massachusetts. It is time to reinstate the ban. Not quite that easy. One enormous hurdle of course is the omnipresent NRA. They are as much of a danger to the safety of our citizens as are the assault rifles themselves. They will do whatever is necessary to defeat such a common sense ban; they will distort, lobby and spend as much as is necessary as they always have. Their paranoia that the government is going to steal their weapons is idiotic but has rubbed off on a large portion of our citizenry who actually believe it. Let us hope that facts conquer fears. NICHOLAS ZILZELIS

It’s Time Dear Editor, It is time for the House to work with the President. John Andrew Boehner, Speaker of the House of Representatives, should understand that half of America does not belong to the wealthy and half of this great country does not belong to the middle class and the poor; we are all united for the common good and purpose to make this great nation work for all. In this modern world in which we all live, paying our fair share of taxes should not divide us. In my opinion, it is an insult to the intelligence of all Americans when John A. Boehner made the claim that half of the people in America making over $250,000 are small business owners; and therefore should not pay more taxes. This claim does not hold water; many of the small business owners, Republicans and Democrats, voted to re-elect President Obama. It is time for Speaker Boehner to stand

up to the right wing elements in the House of Representatives. The voters that gave President Obama a second term are very much aware of the stonewalling that existed in President Obama’s first term; the right wing elements wanted Obama to fail to prevent a second term. Obama won; and it’s time for the House of Representatives to restore some trust by working for the people to avert the “Fiscal Cliff.” ALFRED WADDELL

Mayor Paul Rickenbach greenlighted the idea right away. “We called [Village Administrator] Larry Cantwell and he called the mayor who got back to us and said it was a wonderful idea,” Byrnes related. The next task was finding the materials. “We went to Chris Diamond’s over on Gingerbread Lane. He told us we could have a tree for $25. I said, ‘We want 26 of them’ and he said, ‘Take them.’” Friends assisted with placing the trees. Staff at Sign Language promised to make plaques with the names of each victim inscribed, and Wittendale’s Florist on Newtown Lane offered ribbons and bows for each tree. Donated lights were strung on Tuesday morning. Within hours of the idea’s birth, Facebook lit up with expressions of gratitude and praise. Someone came up with the idea of buying 26 identical ornaments, one for

each tree, a notion Byrnes hopes catches on. “I just want to honor them. I don’t want it to be forgotten,” Byrnes said Monday night. “It was such a horrible tragedy. I felt, the more it’s in our faces, the more we’ll be thoughtful . . . I just thought it was the right thing to do.” The goal of the memorial, Byrnes feels, is to comfort the Sandy Hook Elementary School and Newtown community, and connect with them. It could be a “good On The Cover: Kathy Byrnes conceived a Christmas tree memorial on the Hook Mill green in East Hampton place” for parents to come together to show support for the families of Newtown, Byrnes believes. Over the course of just one day, the memorial idea took root and blossomed. “It just grew this morning, that’s the best way,” said Byrnes Monday night. Asked to comment on the nearly-instant outpouring of donations, Byrnes, who is the chairperson of the Board of Directors of the East Hampton Food Pantry wasn’t surprised. “It felt great and it was exactly what I expected,” she said. “I wasn’t worried about how I’d get the trees.” kmerrill@indyeastend.com

grandparents. They are concerned about the erosion of the American way of life and wanted to protest peacefully,” Dunn said. In no way was he implying the PBA did anything untoward, he added. “We fully support them and we respect their desire to stand publicly. It makes it more egregious my clients weren’t allowed to.” The plaintiffs are not seeking monetary damages. They want to affirm their freedom “to exercise constitutional rights” as well as injuncting the town and village from, “Violating plaintiff’s rights to free exercise of religion, equal access, equal protection, and Due Process . . . ” according to court papers. A spokeswoman for Southampton Town said it has hired the Smithtown-based law firm of Devitt, Spellman, Barrett LLP to handle the case. The lawsuit targets both the town and village because Pastor Havrilla contends both had police officers on the scene on the day in question. For Southampton Town, it is yet another bothersome lawsuit. Two convicted drug dealers are suing the town, charging the police department’s street crimes unit, in essence, set them up. The Suffolk County District Attorney is investigating the unit, which has been disbanded. The papers were filed in U.S. Eastern District Court on December 11. It names the town, the village, Throne-Holst, Southampton Village Mayor Mark Epley, and the police chiefs from both the village and the town.

New Fund May Fix Blight

By Emily Toy

Newly formulated plans for a blight mitigation fund in Southampton Town could solve lots of problems for its more modest hamlets. Southampton Town Supervisor Anna Throne-Holst is planning to create a blight mitigation fund that would be used to pay for clean ups of town-owned properties, particularly areas in Flanders, Riverside and Northampton, where garbage dumping plagues the region. For the past two weeks, it’s been a topic of discussion at Southampton Town work sessions. The three hamlets have been suffering from large amounts of dumping on town property in recent months. Abundant code enforcement issues including repeat code violators have also been problematic for the areas. According to Vince Taldone, vice president of the Flanders, Riverside and Northampton Civic Association, the fund would be used to collect a portion of revenue from justice court fines for code enforcement and other violations. The town is now in the process of setting up the fund to use when jurisdiction and budget issues get in the way of resolving local dumping and related problems, he added. Taldone has been vocal in addressing the issues plaguing the hamlets, saying garbage sits month after month on town property, citing great difficulty in resolving the issue. Last week, Throne-Holst said she proposed the blight mitigation fund as a pro-active step to address the chronic blight in areas of Southampton that need it most.

“While the highway department tries to alleviate most of those needs, the town is currently not equipped to deal with ongoing clean up and unsightly debris management at all times and when needed,” the supervisor said. Throne-Holst added the expectation is the fund will prove to be an important step toward effectively addressing quality of life complaints. The effort will get some funding assistance from justice court fees (up to 1 percent) as well as freshly devised civil fines and penalties to be levied, mostly on repeat code violators. The fund would give the town board the tools and the funding to directly address complaints, while also providing the incentive for the court to levy fines and penalties, Throne-Holst mentioned. “I am so happy to see this administration taking such positive steps toward revitalizing the Flanders, Riverside and Northampton communities,” Taldone said on Thursday. “The blight mitigation fund is a creative, new way to address the issue without burdening taxpayers with new costs.” Emily@indyeastend.com

CONTINUED FROM PAGE 14. power was out and they didn’t do anything, so we called the police,” the mother related. “They did come in and replace the sink, because it was about to fall through the floor.” Throne-Holst said the facility was never meant to house so many people, and that the septic system is inadequate. Gregory Blass, the commissioner of the DSS, did not respond to requests for comments but wrote a letter to the editor that is in this issue. “There is nothing wrong with the septic system, which was fully approved when the original motel received its CO for a 32-room yearround motel, and which has passed inspection consistently by the County Health Services Department ever since,” he wrote. Throne-Holst said Bellone reiterated her belief that the number of homeless sheltered in any one area is limited to 12 units. “He assured me there are plans soon to be implemented for an alternate program here,” Throne-Holst said.

December 19, 2012

“I shared with him that we would be forced into litigation otherwise. He assured me it wouldn’t come to that.” Hidden Cove, she said, “is way out of compliance.” Another resident who is being evicted, Nick Saradakis, said CHI compounds the problem. “They crave the tenancies of single mothers with children,” he charged, “because they get $5000 a month for each family.” The DSS pays the landlord $40 per day for each unit and gives a small stipend to each resident – Saradakis guessed about $400. The rest goes to CHI. “They’ve filled this place with healthy 20 and 30 year olds running around all hours who don’t work. It’s not fair,” the daughter said. “They don’t give a shit about us. It’s okay to displace a local low income person and replace us with people who are getting assistance but don’t work,” Saradakis said. Blass said in his letter Saradakis is being evicted as a “result of his disgraceful, disruptive behavior.” His office did not provide The Independent documentation to support the allegation.

District Helps Pantry

Independent / Merle Froschl

All I want for Christmas: A hopeful Claire Dorn mails her letter to Santa in a special post box located on Newtown Lane in East Hampton.

Last Friday morning Claude Beudert, a Special Ed instructor at East Hampton Middle School, and Gabrielle Scarpaci, the executive director of the East Hampton Food Pantry, modeled scarves made and donated by Anne Marie Tetrault’s middle school family and consumer science classes. The students made over 100 scarves for Scarpaci’s organization. Beudert also collected money from teachers in the East Hampton Union Free School District, and was able to give $500 to the East Hampton Food Pantry and another $500 to the Springs Food Pantry. “We were also able to pay some LIPA and fuel bills,” he said, along with donating food. A group of teachers has volunteered to deliver holiday suppers for Meals on Wheels on Christmas Day. Middle school art teacher Brian D’Andrea encouraged seventh and eighth graders, and a few sixth graders to make holidaythemed placemats to accompany those delivered dishes. The students also made over 40 dinner cards, “folded notes for nametags,” D’Andrea explained. “We created nice little holiday borders and wrote positive messages inside the fold.” All the students participating were “so happy to do something nice for such a great organization,” D’Andrea said. So far this year, the food pantry has assisted over 30,000 local residents.
