California Assembly Passes Bill to Set Up Reparations Task Force Tanu Henry | California Black Media

“Its time we took an honest look at our history. This is not about pointing fingers. It’s about getting to the truth.

African Americans have loved this country, and we have served it, and we have contributed to its might as much as every other American,” said Hardy Brown, the founder of California Black Media.

On June 12, the California Assembly voted 61-12 to approve AB 3121.

The “reparations” bill calls for the creation of a task force to study and propose ideas for how African Americans in California can be compensated for slavery and its “after lives,” as the author of the legislation, Dr. Shirley Weber (D-San Diego), describes the Jim Crow laws and other

forms of injustice and state-sanctioned discrimination that have existed in the United States from 1865 until now.

“The bill would require the task force to recommend, among other things, the appropriate mechanism for redress as it pertains to California’s role in the enslavement of Black people,” Weber read in a statement at the bill’s hearing to her colleagues on the California state Assembly floor.

The California state Senate is now reviewing the bill and is expected to vote on it by June 25.

If the bill passes the Senate and Gov. Newsom signs it into law, the state will appoint and commission an eight-member task force comprised of people from different backgrounds. The Continued on page 2

Why Byron Allen’s Comcast Settlement Win Is an “L” for Black America Mark T. Harris | Special to California Black Media Partners

Former comedian and entertainment mogul Byron Allen filed suit against Comcast in 2015 seeking $20 billion in damages. Allen alleged that Comcast refused to offer many of his television programs as part of its cable television offerings because he is African American.

Earlier this year, Allen’s legal challenge reached the United States Supreme Court to determine whether Allen could proceed with his civil action under Section 1981 of the Civil Rights Act of 1866.

Immediately following the Civil War and the ratification of the 13th Amendment to the United States Constitution, Congress enacted the Civil Rights Act of 1866, which provided a wide-ranging ban on race discrimination. Section 1981 of the Civil Rights Act of 1866 is one of the statute’s most critical provisions, ensuring that “[a]ll persons within the jurisdiction of the United States shall have the same right ... to make and enforce contracts ... as is enjoyed by white citizens.”

The goal of this section was to free the contracting process from the burdens of discrimination and ensure that newly freed slaves were guaranteed the same opportunity to contract as Whites.

Passage of the Fourteenth Amendment to the U.S. Constitution, and its “equal protection” clause, soon followed in

June of 1866.

In response to Allen’s lawsuit, Comcast took the position that Allen must prove that his race was the “but for” basis for Comcast refusing to add his Black-owned television stations. In other words, if there were ANY other credible reason for rejecting Allen’s proposal to carry his television stations on Comcast, Allen would lose.

In a unanimous opinion, the U.S. Supreme Court sided with Comcast over Byron Allen. All of the justices ruled that to prevail, “(Allen) must initially plead and ultimately prove that, but for race, (he) would not have suffered the loss of a legally protected right.”

Let’s take a breath here. What Allen placed before our conservative led U.S. Supreme Court, was the potential for raising the evidentiary standard that every subsequent litigant in the United States — that’s any of us filing a discrimination case — would need to prove.

The Supreme Court met Allen’s challenge and rejected his legal arguments. The result is that the next person seeking to argue that racial discrimination was one element leading to their failure to be awarded a contract, would have their case dismissed from any court in he nation because discrimination was not the “but for” reason for their rejection.

Many leaders in the Black community attempted to talk Allen out of taking

his battle with Comcast all the way to the U.S. Supreme Court, but Allen stubbornly persisted with his lawsuit.

After losing on the procedural interpretation of the application of the “but for” standard, Allen has “folded” and has reached a settlement with Comcast! Allen and Comcast have agreed that three of Allen’s television stations will be offered by Comcast.

However, a victory for Allen is an “L” for the Black community.

Thanks to Allen, from this day forward, any African American or ethnic minority, when attempting to enforce Section 1981 of the Civil Rights Act of 1866, will be required to prove that the “but for” reason for their denial of a contract was their ethnicity no matter how egregious the otherwise discriminatory conduct they suffered may have been. In other words, thanks to Allen’s case, in order to receive enforcement under the Civil Rights Act of 1866, the racial discrimination suffered by plaintiff must rise to the level of being virtually the only cause for the denial of a contract or contractual rights, as opposed to one of the causes for the denial.

Many in the civil rights community, too, attempted to convince Allen not to pursue his litigation to the point of the U.S. Supreme Court fearing the very outcome that has now transpired .

team would lead the study that defines what reparations should look like and who would be eligible to receive compensation.

“Until the end of the U.S. Civil War, California city and county law enforcement authorities enforced a contract labor system, allowing slave holders to effectively hold persons in bondage,” Weber said. “In other words, California state, county and city authorities actively supported the institution of Black slavery both within and beyond California.”

In May, the Assembly Judiciary committee voted yes on the bill. Nearly a month later, the Appropriations committee passed it, too, before it moved to the Assembly floor for a full vote last week.

“We are not making this up. The history is all there. City councils, state legislatures and the federal government crafted racist laws and adapted raciallybiased public policies that deliberately excluded African Americans,” Brown continued. “They erected legal barriers that held us back and robbed us of economic opportunities that were afforded others for centuries — both here in California and across this land.”

Council Members Correct Treasurer’s False Assertions Member Franklin Respects IUSD Decision to Close Warren Lane

At the end of this week’s City Council meeting, the mayor and each council member corrected the false assertions made by the City Treasurer during her public comments. Earlier in the meeting the council members addressed the agenda items decisively.

The council authorized the payment of invoices from the General Fund submitted by Thomson Reuters for access to the West Information Services database.

The council approved a Cooperative Purchase Agreement (piggyback), RFP No. 120716-NAF, with National Auto Fleet Group and Sourcewell, formerly National Joint Power Alliance, a public agency, for the purchase of five vehicles for the Housing Protection Department and a Cooperative Purchase Agreement, Contract No. 062916-GPC, with Genuine Parts Company, dba NAPA Auto Parts through Sourcewell, formerly National Joint Powers Alliance.

The council approved an agreement with HF&H Consultants, LLC (HF&H) to assist the City of Inglewood with contract negotiations for Consolidated Disposal Service/Republic Services.

The council adopted resolutions pertaining to the November 3rd General Municipal Election.

The council authorized the utilization of Tax-Exempt Bond funds to fund the remaining payment for work performed

by TL Veterans Constructions, Inc., at Parking Structure No. 2 located at 115 North Locust.

The council approved the reallocation of 500,000 in HOME funds for the Homeless Tenant-Based Rental Assistance Program.

The council set a public hearing for June 30, 2020, to consider the adoption of a resolution establishing Short Term Rental Fees; to reconsider adoption of a Categorical Exemption EA-CE-2020-36 and General Plan Amendment GPA 2020-01 to Adopt an Environmental Justice Element of the General Plan; and to reconsider adoption of a Categorical Exemption EA-CE-2020-37 and General Plan Amendment GPA 2020-02 to amend the Land Use Element of the Inglewood Comprehensive General to clarify existing population density and building intensity allowances for all land use designations.

The council considered Ordinance No. 20-09 amending Chapter 3 of the

Inglewood Municipal Code (IMC) to implement the Citywide Permit Parking Districts Program that was first introduced on June 9, 2020.

The City Treasurer continued with her recent pattern of criticizing the mayor and individual council members while presenting false information about council members’ salaries and $77,000 that was overpaid to a contractor during her public comments.

In an effort to ensure that anyone wishing to address the council on any agenda item had a chance to be heard Mayor Butts announced a second opportunity for citizens to call in. There were not public comments.

Member Dotson commented on his 50 year residency in the City of Inglewood and acknowledged that the council has done many positive things that have never been done before. He commented that ‘fighting among ourselves’ is not productive and later wished everyone a Happy Father’s Day. Member Padilla said that it was unfortunate that the council must spend time correcting false assertions made in a public forum. He assured the community that ‘we do things above board, the way they are supposed to be done. He too

extended Father’s Day Blessings.

Member Franklin echoed the remarks of his colleagues and, acknowledging the protest on the City Hall lawn, indicated that the proposed Warren Lane school closure was made by the State administrator who presides over the Inglewood Unified School District and the council respects their decision. He added Father’s Day wishes to all.

Member Morales said that personal attacks are not productive and acknowledged that the mayor is the focal point for the good and the bad.

He expressed the independence of each council member who speaks up whenever it is necessary. He added Father’s Day wishes.

Mayor Butts appropriately addressed the personal attacks and completely false assertions made by the City Treasurer indicating that the council members disagree privately but ultimately make decisions that are in the best interest of the city and its residents. He corrected three of the treasurer’s false statements related to the city’s finances and earlier the City Clerk refuted her assertion that the current council had attempted to increase their salary.

Black with a Capital “B”: Mainstream Media Join Black Press in Uppercasing Race

Last week, Norman Pearlstine, the editor of the LA Times, sent a memo to staffers announcing that the publication will begin capitalizing “B” in the word Black in its articles when referring to a race of people.

That move puts the publication with the largest circulation in California in line with the way the majority of the Black Press in California and around the country have referred to African Americans for decades since they retired “Negro,” beginning in the 1960s to the early 1970s.

Pearlstine also announced that the LA Times is taking steps to add more diversity to its newsroom by increasing the number of Black and Latino

journalists on its staff.

“Within the next two weeks we shall form a group to work on overhauling our hiring process,” Pearlstine wrote to employees. “The global pandemic and the global financial crisis constrain our ability to make a hiring commitment by a specific date. We can commit, however, that the next hires in Metro will be Black reporters, as we begin to address the underrepresentation.”

In the wake of the brutal murder of George Floyd in Minneapolis and the violent protests that followed it, across America, more and more people have begun to point out, own up to, and apologize for abetting racism and anti-Blackness in all of their forms — explicit, subtle and systemic.

Americans from all backgrounds have begun to publicly acknowledge how discrimination, over the years, have hurt and held back African Americans for centuries.

Last week, other media organizations across the country, including BuzzFeed News, NBC News, MSNBC, Metro Detroit, and others, announced that they have made the decision to begin capitalizing the “B” in Black as well.

The National Association of Black Journalists (NABJ), the country’s largest professional organization of Black media professionals and journalism students, released a

statement that said the organization has been writing Black with a capital “B” in all of its communications for about a year now.

The NABJ is also recommending that “White” and “Brown” be capitalized, too, when referring to race.

“It is equally important that the word is capitalized in news coverage and reporting about Black people, Black communities, Black culture, Black institutions, etc,” the NABJ statement said.

Sarah Glover, past president of the NABJ, wrote a letter to the Associated Press (AP).

“I’m writing today to request the mainstream news media begin capitalizing the “B” in Black when describing people and the community,” wrote Glover.

“I’m also asking the AP to update its Stylebook to reflect this change, effective immediately,” Glover continued. “This book is the bible for working journalists and sets journalistic industry standards. The AP has tremendous impact as a wire service with more than 1,000 subscribers worldwide.”

Larry Lee, the publisher and CEO of the Sacramento Observer, the oldest Black-owned news publication in California’s capital city said whenever he sees a lowercase “B” in Black, it

feels like a “slap in the face.”

I always felt that they were devaluing our community,” said Lee, who is a second-generation publisher of the Observer. He took the helm of the family-owned business from his father William Lee, who founded the newspaper in 1962 and passed last year.

“This is wonderful. Its progress,” Lee continued. “I applaud other media outlets that are doing that. We thought it was important, in a journalistic sense, to recognize Black Americans and African Americans in the same vein that you stylistically recognize Hispanics and any other ethnicity.”

Lee, who’s is 47, says for as long as he can remember, the Observer and other Black-owned newspapers across the country have capitalized the “B” in Black also to affirm the humanity of African Americans, evoke a sense of cultural pride, and to align themselves with the 1970’s “I’m Black and I’m Proud” movement popularized in pop culture by James Brown and others.

Lee says, for a while now, Black publishers have called on general market newspapers to adapt that policy, too.

More than 600 seniors from the 43rd District cities of Los Angeles, Inglewood, Torrance, Gardena, Hawthorne, Lawndale, and Lomita joined AARP’s California Telephone Town Hall with Congresswoman Maxine Waters (CA-43), Chair of the House Committee on Financial Services, to discuss the federal response to COVID-19 on June 9.

During the telephone town hall, Congresswoman Waters answered questions from AARP members on a wide range of issues including the importance of wearing masks, social

Inglewood Mayor James T. Butts, Jr. listened intently to the Morningside Park area residents who gathered on the South Lawn of City Hall to demonstrate their support of Warren Lane.

“I gave them instructions regarding accessing the School Board and County Administrator to make their concerns known,” the Mayor told Inglewood Today.

Butts also stated that he supports the City Council in developing the best outcomes for the children of IUSD. Meanwhile, local educator and Principal at Century Academy For Excellence (CAFÉ) charter school in Inglewood Dr. Lisa Edwards voiced her displeasure with the prospect that Warren Lane would be shuttered.

“Upon learning about the closure of Warren Lane being closed down, my first though was yet again another icon, another community beacon of Black excellence is now being removed,” Edwards explained.

She said that Warren Lane has been

a staple in the community and CAFÉ was a feeder school that accepted many of its students, but CAFÉ is also on the brink of closure.

“It’s really heartbreaking,” Edwards added.

Edwards was vice principal at Inglewood High School before becoming the executive director and principal of CAFE. Her sister Dr. Stephany Glover, the vice principal at CAFÉ, joined her at city hall in protesting the closure.

“First and foremost it would directly impact our enrollment. We are constantly accepting applications from neighboring schools, thus it would make it difficult for us to keep our doors open,” Glover added.

Warren Lane has just 215 students according to the latest records, and like the other schools in the district is under the authority of the state.

The district has been plagued with fiscal responsibility and has been consistently drowning in debt and marred in delinquent management.

Congresswoman Waters also expressed her support for the Quality Care for Nursing Home Residents and Workers During COVID-19 Act (H.R. 6698), a comprehensive bill authored by Rep. Jan Schakowsky (IL-9) that would increase testing, quality of care, worker and resident safety, and infection control in nursing homes.

“I am deeply concerned about the well-being of seniors in my District and across the country who are at great risk of not only contracting the coronavirus, but also being harmed by its devastating impact on the economy,” said Congresswoman Maxine Waters. “I want every senior in

my community to know and understand that my colleagues and I are doing all that we can to provide a safety net for our seniors who are more than deserving of our support. Whether we are talking about providing additional funding for testing and PPE for nursing homes, protecting Social Security and Medicare, or increasing funding for housing assistance and financial relief, seniors are high on our legislative agenda. I thank AARP for organizing such an important discussion on the work I am doing every day in Congress on behalf of our seniors and their families.”

“We have always shared a PanAfricanist worldview, regarding Black as being more encompassing of people of the African Diaspora,” she continued. “I guess our counterparts, in what people call the mainstream media, are finally catching-up with something we’ve been doing all along.”

In her letter, Glover said organizations moving to change their policy on capitalizing Black is a “good first step.”

“This matters. It’s to bring humanity to a group of people who have experienced forms of oppression and discrimination since they first came to the United States 401 years ago as enslaved people. I ask for this change in honor of the Black Press,” she wrote.

The New York Times, which adheres to its own style guide that is different from AP’s, also still uses Black with a lowercase B.

Activist probably was never on Lebron James agenda, but he recognizes how much his culture needs him and he isn’t shying away.

James refuses to shut up and dribble.

In fact, he’s speaking louder than ever on racism and inequality that has proven to be one of the biggest pandemics in the United States.

Racism has been around for nearly four hundred years and the Black community is fed up. So tired, that James is using his voice and platform to bring awareness to the incurable racial issues.

Just about every race around the world erupted two weeks ago due to the death of two Black men Ahmaud Abery and George Floyd who both lost their lives due to blatant racism.

Abery, was enjoying an evening jog on Feb. 23 in Brunswick, Georgia, when two white supremacists chased and gunned him down. Floyd died shortly after being handcuffed and pinned own by a Minnesota white police officer who clearly is racist on May 25th.

Basketball fans view James as one of the best to ever play the game of basketball but people of color look at him as our leader and protector during this tumultuous time.

Only if we had many more likeminded athletes like James that were willing to put everything at stake mainly endorsements the world would be in a better place today.

Instead we had too many athletes in 80’s and 90’s that did not embrace the black community and help fight the battle of social justice.

Why? Did multi-million dollar contracts and endorsements mean more to than racism? Go figure.

Where were the LeBron James when Rodney King nearly lost his life to police brutality? Somewhere building sports brands and staying silent creating more violence.

That’s a question we will have to ask Michael Jordan and Tiger Woods and that question will more than likely remain unanswered.

Since protestors and demonstrators have taken to the streets around the globe in the aftermath of the police killing of George Floyd in Minneapolis, many businesses and organizations have issued statements and taken measures to communicate their stand against racial injustice.

On Wednesday, June 10, NASCAR joined that ever-growing list with the announcement that it’s removing the

Confederate flag from all of its events.

“The presence of the Confederate flag at NASCAR events runs contrary to our commitment to providing a welcoming and inclusive environment for all fans, our competitors and our industry,” NASCAR officials wrote in a statement.

“Bringing people together around a love for racing and the community that it creates is what makes our fans and sport special. The display of the Continued on page 7

Generation Z was born between 1997 and 2012. In just 23 years, this generation has gone through multiple economic crashes, dozens of school shootings and a global pandemic. They are the last generation of The Old World, and the most fearless.

It’s their fearlessness that’s carrying us into The New World.

Their fearlessness is making Millenials like myself and even baby boomers like my dad march the streets and call to action for “BLACK LIVES”. Together, the last 4 generations have put major pressure on this country for change. So many changes have happened in just three weeks and many more will come.

However, it hasn’t been easy, 5 lynchings have taken place in just one week and a few more black men have been shot. But no one is taking their foot off the gas.

The movement is too big, even President Trump today stated that Colin Kaepernick should have his job back. Trump has been the most divisive President since Lincoln, but today he made his first remarks that shows that he too understands that time is up on racism.

So where do we go from here.

The answer has always been to go within. This country needs to realize that our citizens are our greatest assets, all 360 million.

Globalization makes The World a much more competitive place so we as a Nation cannot afford to limit each other. We have to come together as a Nation, and realize we are better as a country UNITED. Everyone has something to offer for the advancement of this Nation, but we will never know if we continue to have institutional racism. For some it seems like the World is going crazy, and for others is seems like God has finally answered their prayers.

The best for both to do is pray because God wins!

For Black Lives Matter co-founder Alicia Garza, the widespread global protests and activism that followed the murder of George Floyd, an unarmed Black man, by Minnesota police have been heartening — and they make her feel hopeful for the future. At the same time, she said, “It’s bittersweet that it takes someone being murdered on camera to get to the point of conversation that we’re in.”

“I was horrified,” Garza said of viewing the video of Floyd’s life being taken by a White police officer with his knee on Floyd’s neck. “Every time a Black person is murdered by police there is something disturbing about it.” She added, in this case, “Just the callousness of it; and him calling for his mother. There’s just so much in there that’s horrifying. It’s just a brutal reminder of how Black lives don’t matter in this country.”

Garza, who lives in Oakland, is Strategy and Partnerships Director for the National Domestic Workers Alliance and Principal at the Black Futures Lab. Seeing Black Lives Matter (BLM) signs held by protestors in all 50 states, including in many small towns with few Black residents, Garza said, “It’s humbling to see it and to have been a small part of it.” She is heartened that people are awakening.

Garza said she is also pleased that many celebrities who have large platforms are using them now to push for change. She said the Black Futures Lab has a strategy for helping celebrities to use their platforms for the movement.

“When they use their platforms to activate people, it’s an important way to save our democracy. It makes us active and engaged participants.”

“I got to take over Selena Gomez’ Instagram last week. It was awesome.”

She said people are really hungry for information. “We’ve been doing a lot of work and talk about what’s going on. When folks like Selena do that, it engages people in issues of our time.

I plan to work with her through this election cycle”.

Garza said she will also be taking over Lady Gaga’s social media in the coming week. “We’re really focused on transferring this energy into political power.”

She said it’s important to change the people who are making the rules and those who aren’t enforcing the rules.

She cited as an example the recent election in Georgia where voters in

predominantly Black areas waited hours to vote. Movement for Black Lives is not just about police violence.

It’s about how Black lives are devalued.

Black Lives Matter is for an opportunity for us to recognize and uphold the right to humanity and dignity for Black people. She said Black people also have to work “to remove the negatives we’ve internalized about ourselves.”

“For people who are not Black, there’s also work to do.” She said it’s not only about changing the rules, but also about a culture shift. “That’s what I think we’re seeing now. It’s going to take all of us staying committed.”

She said the millions joining protests following the murders of George Floyd, Ahmaud Auberry and Breonna Taylor were sparked by “a powder keg waiting to happen.”

“People are mad about a lot of stuff.

We’re all tender right now. It’s an election year. We find ourselves in a global pandemic. The lack of human touch… and being able to gather.

Because of that we also have the expansion of an economic crisis. Not only are people trying to stay healthy, they’re trying to pay their bills.”

“What we can all agree on is that policing is not serving the people that they’re supposed to serve. When we’re afraid of the police that’s not serving.

Whenever I see tanks, rubber bullets, and tear gas being used -we pay for that.

Are we keeping people safe? We’ve been defunding the Black community for a long time.”

slogan that has been held by some protestors. Garza said that slogan comes from the Movement for Black Lives, a coalition that includes BLM. “This work is something many organizations have been doing for many years,” she said.

“It’s really about getting a handle on how we’re spending our money.”

She cited the fact that education funds have been cut, the postal service is near bankrupt, and thousands of homeless are living on the streets.

“We’re using police to deal with homeless. You don’t send a nurse to deal with a drug cartel.”

“We did the largest survey of Black America in 2018 - The Black Census Project. The overwhelming majority said in the past six months they’d had a negative experience with the police.”

She said what she supports is “limiting the size, scope and role police play in our communities. Police also need consequences when harm is enacted.

Police unions are a huge, huge issue.

They block transparency for officers.”

Speaking of another campaign that’s getting national attention Project Zero’s “8 That Can’t Wait,” Garza cautioned, “We have to be wary of things that are a quick fix.”

She said “8 That Can’t Wait,” s campaign that pushes proposals for police reforms, “doesn’t deal with the real issue here: nobody should be above the law.”

“Public safety is not about bloated police budgets. It’s about expanding the safety net for Black people,” she concluded.

While many took to social media to voice their surprise about NASCAR’s decision, one of the sport’s premier drivers and NASCAR’s lone Black competitor joined in to applaud the move.

“I’m just really proud of the efforts of NASCAR for stepping up and wanting to be a part of the change,” Bubba Wallace, who’s No. 43 Chevrolet car has the #BlackLivesMatter hashtag painted over the vehicle, told Good Morning America.

“I know it’s tough, they’re in a tough situation,” Wallace stated. “They’ve been in a tough situation for a long time now, but I think this is the most crucial time and time is of the essence right now in the world that we’re in and the nation that we’re in to create change and create unity and come together and really try to be more inclusive.”
