THE INTERNATIONAL RENAISSANCE FOUNDATION EXPRESSES SINCERE GRATITUDE TO ALL OUR PARTNERS IN BUILDING AN OPEN SOCIETY IN UKRAINE


ВСТУП

The International Renaissance Foundation (IRF) is publishing the 2013 report in a completely new environment for civil society in Ukraine. The great events of the Maidan gave civil society an opportunity to transform the corrupt and autocratic system into a European model of democracy. The protests that began in late 2013 as a movement for European integration upon the initiative of non-government organizations and concerned citizens. The resistance movement has quickly transformed into a popular uprising against a fully discredited system of power. Self-organized citizens on hundreds of squares throughout the country created their own institutions from scratch, not trusting the old rotten systems of the police, healthcare and media. For example, in just a few days the People’s Hospital set up a full-fledged medical assistance center for those on the Maidan, with all the necessary medical equipment and services of qualified volunteer medical experts. EuroMaidan SOS became an active coordinating center of mutual assistance and documentation of human rights violations by the government. Many civic journalism initiatives, samizdat and online streaming provided the real-time news to protest participants and the broad public. These independent initiatives have emerged because the state failed to fulfill its functions. Yanukovych regime has overtly passed legislation against the interests of citizens, sanctioned the torture and killing of participants of peaceful demonstrations.

At the same time, the system of free legal aid, work of certain employees of the office of the Ombudsperson and the volunteer assistance of certain medical institutions are a few of the exceptions. These are examples how human rights protection were successfully institutionalized. These achievements should not be foregone. Ukraine urgently needs civic action and support to the reforms. Formation of a new country is impossible without transforming the spirit of Maidan into the creation of an open society institutions through direct dialogue between all branches of central and regional power, NGOS and civic activists. Only strong institutions of civic control over the ruling authorities and daily participation of citizens will render the process of democratic transformation irreversible. IRF has been working in this direction starting from the first days of Maidan protests. We assisted the civil society in consolidating its efforts for the victory of peaceful protests. With the participation of prominent civic activists in Ukraine we actively assisted and continue to assist in the medical treatment of those who injured during the protests. With the IRF support, the Ukrainian Anti-Crisis Media Center was created to provide the international community with unbiased information on Ukraine developments. The foundation supported the Reform Support Center. We expect it to become an effective form of dialogue between the independent experts and the government. Thanks to the joint support of the Foundation and leaders of the new government, in the nearest days the activity of government-public working groups will be launched in order to implement economic reforms that will modernize the country, territorial reforms and electronic governance and administrative services. The Foundation helped finance the national debate program of candidates running for the office of president of Ukraine. This is only some of the response initiatives to urgent challenges. In 2014, we will also support the civil society efforts aimed at promoting the system of transparent registries of ownership, combating corruption, advancing public health, development investigative journalism, human rights monitoring, free legal aid promotion and grassroots-level civic activism. In 2014 the Foundation has changed its structure for a more effective response to the new needs and challenges. Our programs are now organized into five initiatives — Democratic Practice, Rule of Law, European Integration, Public Health and Roma of Ukraine. Regional representative offices of the Foundation will soon open in Lviv, Odesa and Kharkiv. As never before, we are dedicated to our mission — fostering the open, democratic society in Ukraine. FIGHTING CORRUPTION Experts of the coalition coordinated by Transparency International Ukraine (ti-ukraine.org) monitored the implementation of the State Program on Preventing and Fighting Corruption in 2011-2015. It was revealed that government agencies are not effectively fulfilling the program, which requires major revamping. Monitoring experts believe the program requires changes to its priorities and realistic financing of the planned measures. The Foundation supported the activity of the Public Expert Council of the Verkhovna Rada Organized Crime Control and Anti-Corruption Committee, which conducts anti-corruption monitoring of bills. The council conducted a review of more than 80 bills and revealed risks of corruption in 30 of them. The Center of Political Studies and Analysis (cpsa.org.ua) together with Forbes Ukraine (forbes.ua) prepared the Tender Transparency Rating of Regions of Ukraine (forbes.ua/nation/1346825-rejting-tendernoj-prozrachnosti-regionovukrainy), which illustrated the openness of information on public procurement by local government.

THINK TANKS DEVELOPMENT In 2013 the Foundation began implementing a new model of work with think tanks. Initially, these think tanks gave assessments and an overview based on their own analytical capacity, which were then assessed by independent experts. A number of trainings on issues such as team building, website development, external communication, cooperation with government bodies, fundraising, management and marketing, methodology of policy analysis were organized. Internews-Ukraine (internews.ua) has launched “Policy Analysis for Democracy” (policy-analysis.org) website, which will present generalized and systemized achievements in policy analysis. In March 2013, an international conference on policy analysis in Ukraine was held in Kyiv. A report “Assessment of Policy Research in Ukraine’ was released. Policy analysis in Ukraine and its main achievements were reviewed in the document and the problems of Ukrainian analytical institutions were highlighted. To improve the governance and quality standards of Ukrianian think tanks, The IRF has launcheed a new Think tank development initiative with support of the SIDA (Swedish International Development Agency).

PHILANTHROPY PROMOTION With IRF support, the members of the Donors and Foundations Networks in Europe (DAFNE) held their first ever meeting in Ukraine. DAFNE unites 24 associations that together represent the interests of more than 6,000 organizations. In Kyiv experts from 14 countries discussed the contemporary standards of philanthropy and the development of this sphere in Ukraine and Europe. The Ukrainian Philanthropists Forum (ufb.org.ua) drafted the publication “Philanthropy According to Rules: Fundamental Principles and Practical Application”. It clarifies Ukraine’s experience in philanthropy and offers recommendations on implementing European principles of philanthropy in Ukraine. The Foundation joined the campaign aimed against amendments to the law on charitable activity. Bill No. 3100 envisaged the creation of serious obstacles to the activity of charitable organizations. Thanks to an advocacy campaign conducted by leading charitable organizations of Ukraine, the Verkhovna Rada Committee on Culture recommended the parliament to reject the bill.

INVESTIGATIVE JOURNALISM The Foundation plays an active role in advancing investigative journalistm in Ukraine. In 2013, Slidstvo.Info investigative journalism agency was distinguished for a number of resonant publications about heated social topics (i.e. non-transparent schemes of mobile payments, employment schemes, abuse of tenders by the state enterprise UkrGazVydobuvannya, etc.). The IRF has also we supported a research work Journalist Serhiy Leshchenko published a research work titled “The American Saga of Pavlo Lazarenko” about the corruption case of the former prime minister of Ukraine. Journalist investigations into the problems in the Donetsk oblast were published by Donetska Pravda (pravda.dn.ua) (collapse of Euro 2012 infrastructure, paid for articles in local mass media, non-transparent purchases by the Voda Donbasu company, etc.). The Postup Human Rights Center (postup.lg.ua) issued two manuals — “Investigative Journalism” and “Advocacy Journalism.”

CIVIC JOURNALISM The Foundation supported the creation of the first Ukrainian public Internetmedia Public Television (hromadske.tv). This is a joint project of renowned Ukrainian journalists, whose task is to provide objective and unbiased information on important sociopolitical processes with transparent financing and reporting. Hromadske.TV operates through voluntary donations from individuals and institutions, and revenues from advertising and is independent from the government, political parties and business circles. In December 2013, the viewing audience of the channel was close to 7% and 7.5 million people visited the website. A record-breaking 200,000 individuals visited the online site of Hromadske.TV, and their YouTube channel currently has more than 150,000 subscribers.

FREE LEGAL AID

The Foundation supports the work of 42 Legal Information and Consultation Centers in 20 regions of Ukraine that provide free legal aid to vulnerable people. In 2013 these centers provided nearly 10,000 consultations, completed the creation of the networks and signed a memorandum of cooperation. In addition, the web portal Legal Space (legalspace.org), which provides information about free legal aid in Ukraine, was redesigned. Information about institutions and organizations that provide primary and secondary legal aid and online consultation can be found on the site. The coordinators of the site and the Chuhuyiv Human Rights Group put together information booklets with advice on common legal issues the centers deal with.

COMBATING DISCRIMINATION In 2012 the law “On the principles of preventing and counteracting discrimination in Ukraine� was adopted. Experts of the Coalition for Combating Discrimination in Ukraine (antidi.org.ua) say the law is not effective and are proposing that it be fundamentally revised, arguing that there is no mechanism of protection from discrimination and a procedure for appeal against acts of discrimination in the law. Human rights advocates of the coalition conferred the most malicious violators of human rights with the Discriminator of the Year Award. The recipients of the award were Yalta Mayor Serhiy Ilash, who compared the Roma with animals, Bishop Pavlo of the Kyiv-Pechersk Lavra and President of the National Academy of Medical Sciences Andriy Serdyuk, who evicted an HIV clinic from the territory of the Lavra, and Party of Regions MP Vadym Kolesnichenko, who submitted the discriminatory bills. Experts of the coalition also filed strategic legal suits to combat discrimination. One of them was the case of Yuriy Chereda, who was denied a bank loan because he is disabled. The judges deemed the actions of the bank illegal according to the UN Convention on the Rights of Persons with Disabilities.

NATIONAL PREVENTIVE MECHANISM In Ukraine there are nearly 6,000 institutions of non-freedom (penitentiaries, temporary detention centers, psychiatric wards, orphanages-boarding schools, homes for senior citizens and the disabled, temporary accommodation for refugees, social rehabilitation centers, military units, etc.). Within the confines of the National Preventive Mechanism against Torture, representatives of the Human Rights Ombudsman and human rights advocates were granted the right to visit these institutions without advance notice and conduct a monitoring of compliance with human rights. More than 400 such visits were made. The main problems revealed in such institutions were violations of sanitary regulations, lack of access to fresh air and potable water, improper nourishment and medication, and psychological and physical violence. The coalition Children’s Rights in Ukraine, which is coordinated by the Women’s Consortium of Ukraine (wcu-network.org.ua), conducted monitoring of compliance with children’s rights in reception centers for minors. The results showed that these institutions are closed to society and have very strict rules. Children that are confined in them cannot file complaints to anybody or defend their rights. For this reason, human rights advocates are lobbying for the liquidation of these institutions.

The Maidan Monitoring Information Center (maidanua.org/aboutmaidan/ mmic) analyzed the illegal rulings of the local authorities aimed at limiting or prohibiting peaceful gatherings and filed suits with the prosecutor’s office. According to the summary of appeals, bodies of the prosecutor’s office filed documents to repeal or amend normative legal acts in more than 60 settlements of Ukraine. Today, 36 documents have been nullified. The partnership “For Freedom of Peaceful Rallies” (piket.helsinki.org.ua), that unites 24 NGOs, has been created with the support of the Foundation. Participants of the partnership appealed to MPs calling for the approval of the law “On freedom of peaceful gatherings”. They note that the document should ensure concise and exhaustive grounds for limitation of freedom of peaceful gatherings, allow simultaneous gatherings, including counter demonstrations, protect the organizers and participants of such gatherings from administrative and criminal liability, define positive obligations of the state, allow spontaneous peaceful gatherings and include a concise list of places where the holding of peaceful gatherings is prohibited.

HUMAN RIGHTS PROMOTION Films about human rights, tolerance and interethnic understanding were shown at the Molodist (molodist.com) and Docudays UA (docudays.org.ua) international film festivals. In addition, in different regions of Ukraine the Student Brotherhood organized the showing of films from the Docudays UA festival for students. Films on legal and civic education were shown in more than 30 counties and cities in the Odesa, Lviv and Kyiv oblasts. To popularize human rights and draw attention to their violation in Ukraine, the Association of Caricaturists (cartoon.org.ua) and the Ukrainian Helsinki Human Rights Union (helsinki.org.ua) held a contest titled “The Right to Choose� (314 works were submitted).

ACCESS TO INFORMATION The Fund for the Protection of the Right to Access to Information (medialaw. kiev.ua) submitted several appeals to the European Court of Human Rights concerning cases where journalists and activists were not provided with public information. This included the ruling of the Constitutional Court of Ukraine on the parliamentary coalition in 2010, the sale of the presidential residency in Mezhyhirya and the access to city plans. Experts also filed legal cases with Ukrainian courts regarding declarations of incomes of people’s deputies, collection of information about individuals by the State Security Service (SBU), constitutional appeals regarding the language law, etc. As a result of the advocacy campaign on access to city plans, coordinated by the Eastern Ukrainian Center of Civic Initiatives (totalaction.org.ua), the Ministry of Defense and the Ministry of Regional Development declassified maps that are a key element of the city plans and the State Institute Dipromisto allowed the declassifying of the text of these plans. In November 2013. Vice Premier Oleksandr Vilkul instructed the central bodies of executive power to guarantee access to city plans.

MONITORING OF EURO-INTEGRATION REFORMS The expert consortium made up of Valeriy Chalyy, Oleksandr Sushko, Ihor Zhdanov, Ihor Burakovsky, Ihor Kohut, Dmytro Kotlyar and Ihor Koliyushko (eu-ua.blogspot.com) monitored Ukraine’s fulfillment of the requirements for signing of the Association Agreement with the European Union. Long before the Ukrainian leadership officially refused to sign the agreement, analysts warned that Ukraine faces a number of threats that may prevent the signing of the agreement. In particular, not one of the 11 criteria defined by the European Union was fulfilled completely.

EUROPEAN INTEGRATION INDEX The foundation has launched European Integration Index for Eastern Partnership Countries (eap-index.eu) project in 2011. In 2013, according to the survey, Ukraine took third place in many indicators (after Moldova and Georgia). According to experts, over the period 2012-2013 the indicators of democracy in Ukraine, the level of freedom of the press, and the right to peaceful assembly fell sharply and there was no guarantee of independence of the judiciary. It is worth noting that the monitoring was conducted prior to the start of the mass protests, which had a significant impact on the assessment of the situation in Ukraine.

PROMOTING EUROPEAN STANDARDS IN UKRAINE Even before the official signing of the Association Agreement between Ukraine and the EU, the IRF has supported the introduction of European standards in different sectors. Expert groups prepared proposals on air quality, recycling (including electronic waste), pedestrian safety and energy-saving in buildings that were submitted to relevant government agencies. The Institute of World Policy (iwp.org.ua) conducted the “Street Universities� action in 18 cities in 13 regions of Ukraine during which representatives of EU countries spoke about the advantages of European integration. There was also an exhibit of caricatures on the realities of life in Ukraine and the EU. Nearly 35,000 people attended the events.

EUROPE WITHOUT BARRIERS In an effort to facilitate the EU-Ukraine visa liberalization process, the IRF provides its support to the civil society initiative Europe without Barriers (www. novisa.com.ua). The advocacy efforts resulted in the amendments to the EU-Ukraine Visa Facilitation Agreement expanding the list of valid reasons for requesting multiple-entry visas as well as categories of citizens eligible for EU visas under a simplified procedure. The Europe without Barriers initiative in partnership with the Visa-Free Europe (visa-free-europe.eu) international coalition has carried out a series of activities in the capitals of the EU member states to advocate the visa-free regime between Ukraine and EU. The activities targeted experts, politicians, government officials, public activists, and journalists of those countries.

VISAS? WHAT’S THE REASON? Every year hundred of thousands of Europeans, among which ten of thousands citizens of Ukraine are deprived of the chance to travel freely and make visits to their European friends, relatives and colleagues because of the «Visa Wall». Most of them are law-complying citizens. The burdensome barriers preventing freedoms of movement in Europe must be removed!

INTEGRATION OF ROMA INTO UKRAINIAN SOCIETY In 2013 the Strategy for the Protection and Integration of the Roma National Minority into Ukrainian Society was adopted. The Foundation supported the working group that drafted proposals to the document. The Foundation coordinated negotiations on Ukraine joining the international initiative Decade of Roma Inclusion. Leaders of Roma organizations sent an appeal to the Ukrainian government and the Ukrainian delegation participated in the meeting of the Decade International Steering Committee.

ROMA RIGHTS MONITORING The Association of Ukrainian Human Rights Monitors on Law Enforcement (umdpl.info), the Kharkiv Institute of Social Researches (khisr.kharkov.ua), the Alliance of Roma in the Cherkasy Oblast (cnucd.com.ua), the Myrhorod Roma and the Odesa Oblast Roma Congress conducted monitoring of the “Compliance with the Rights of the Roma Population in the Activity of the Internal Affairs departments of Ukraine�. The results showed that while the level of crime among Roma is 2.5 times lower than the average in Ukraine, the police are unjustifiably strict with Roma, constantly checking documents, inspecting their homes and car, detaining them, etc.

In cooperation with Roma Education Fund, we continued to support scholarships for young Romani students, creating an opportunity to study for more than 100 young people. The academic society Humanitarian Collegium initiated the Roma Studies program at the Kyiv-Mohyla Academy. It includes specialized courses on the history of Roma in Ukraine, culture, religion and social psychology of the Roma people, the activity of Roma NGOs in Ukraine. Nearly 80 students attended the courses.

PALLIATIVE CARE Thanks to the advocacy campaigns conducted by NGOs and patient organizations, the Ministry of Health of Ukraine issued decree No. 77 on February 1, 2013 officially registering morphine tablets, an effective painkiller. This gave patients living with an incurable disease a chance to alleviate their suffering and not wait for injections administrated by a nurse. Also, thanks to the efforts of the public, the Cabinet of Ministers approved a new procedure for access to pain relief (Decree No. 333 of May 13, 2013). The document envisages that the terminally ill can keep a reserve of opioid analgesics for pain relief. Experts of the Ukrainian Palliative and Hospice Care League consider this a significant step towards civilized standards of pain relief that exist in developed countries. With our assistance, the first Center for Children’s Palliative Care in Ukraine was established in Prykarpattia and in Kharkiv the first training center was opened where medical professionals learn how to administer palliative care.

The Advisory Council on Access to Treatment in Ukraine (ucab.org.ua) has for many years been advocating for the allocation of money to fight terminal diseases (cancer, hepatitis, tuberculosis, HIV/AIDS). A number of actions were held outside the Cabinet of Ministers and Ministry of Health to encourage officials to seriously tackle these diseases. The Cabinet of Ministers approved the first State Program for the Fight against Hepatitis and allocated UAH 33.2 million. Activists are now demanding the allocation of more funds to finance the program. The Ukrainian Community Advisory Board prepared a brochure titled “State Purchase of Medications: Patient Control” and “Diagnosis: Oncology. History of One Country”. The “We Will Conquer C” actions organized for World Hepatitis Day were held in 30 cities in Ukraine upon the initiative of the International HIV/AIDS Alliance in Ukraine (aidsalliance.org.ua).

BALANCED DRUG POLICY The International Renaissance Foundation and the Polish journal “Krytyka Polityczna” (krytykapolityczna.pl) held an international conference on drug policy in Kyiv in which former president of Poland Aleksander Kwasniewski participated. The participants appealed to the Ministry of Health to set limits to the amount of drugs that is subject to criminal liability on the basis of international standards. The experts reminded that individuals that possess 0.005 g of acetylated opium or heroin are subject to criminal punishment, while in Russia this figure is 0.5 g and in most countries of the EU – 1-3 g. This means that nearly one in ten individuals convicted in Ukraine were punished for something that is not even considered a crime in most civilized countries. Participants of the conference said such an approach is a gross violation of human rights and creates a serious threat of the spread of viral infections. According to the results of an advocacy campaign supported by the Foundation aimed at devising a balanced drug policy, the Strategy of the State Drug Policy was adopted. The document envisages the prevention and treatment of drug use, combating discrimination against them and defending their rights, expanding access to the medical usage of narcotics.
