Association Presidents Informed of LMA Policy Change By Irwin Starr

The November meeting of Landings Association Presidents was extremely well attended, with all but a couple association presidents or representatives at the meeting. The presidents first learned of a revised LMA policy which impacts all association boards and many individual residents of The Landings. Very specific rules are detailed in the Green Book regarding both delivery and service vehicles entry to The Landings during off hours and weekends. Until a recent LMA action it was necessary to get specific guidance, for an exception to those rules, from a designated member of the LMA board. The LMA has modified that policy. The decision on exceptions now rests with the Association president or designee in which the person seeking the exception lives. For individual residents, this means that any request for a delivery, or nonemergency services, not within the designated hours should contact their Association president or designee.

Attendees heard a presentation by Laurel Schiller, an advocate for the planting of Florida native plants wherever possible. She co-owns Florida Native Plants Nursery, and an educated wildlife biologist and ecologist. She stressed the advantages of using native plants which generally require less care, and irrigation than many decorative plants customarily used. Schiller advocates use in areas not requiring a “manicured look.” She brought along a number of good-sized examples of the attractive, and blooming plants representing native species. Interested residents can reach Ms. Schiller at 941-322-1915. The nursery is located at 730 Myakka Rd. in Sarasota. There were several other reports provided to Association president attendees: Safety and security: approximately 69% of automobile entry stickers have been verified. Residents who have not sought re-verification should check with the main gate. Continued on page 4

Decal Verification Letters have gone out to owners of properties in Landings South III and IV and Bayview notifying them that the decals registered to them will be suspended on November 1st unless they take action before that date to re-validate them. Owners can avoid suspension by revalidating their decals before November

1, 2014. Owners who will be gone for the month their decals are scheduled to be deactivated may go to the Main Gate before they leave to complete the verification process. The form will be available on The Landings website, www.thelandingsofsarasota.com, or from the Main Gate

LMA Meeting Notes LMA Pres. Henry Rhodes began this month’s meeting by announcing Dick Bayles agreed to be co-chair of the Safety and Security committee. He also reported the scheduling of a special meeting to consider the legal issues surrounding the intersection congestion issue at Kestral Parkway and US 41. Rhodes regretfully announced the immediate resignation of Truman McAfee from the Aesthetics Committee and all duties related to the website. McAfee will be moving to Texas to be near his family. “He has performed his board responsibilities very well and with great humor. He demonstrated how better results can be achieved when committees work together. We will miss his counsel and wish him well in his new home.”

FINANCE REPORT

Finance committee chair, Don McMurray reported a surplus of $60,352 year-todate. He added that two or three major expenses before the end of the year would greatly reduce that amount. McMurray thanked committee chairs for providing budget information for the proposed fiscal year 2015 budget. He also reported the finance committee is going to review a request to establish a line of credit to allow The Landings Management Association

to meet the financial impact of a potential disaster. A recommendation will be prepared for the LMA Board’s consideration.

YEARLY ASSESSMENTS

Four Landings residents still owe dues from last year. They have been contacted by The Landings attorney and supplied with notices of appropriate liens and late charges.

AESTHETICS

Lakes chair, Larry Lawrence believes a recent meeting between LMA representatives and County staff regarding issues associated with Lake-1, North Lake, appeared to be productive. Lawrence apologized for the delay in repairing the Lake-9 fountain. The fountain has its own unique components and as such has taken longer than expected to repair. He’s hopeful it will be operating soon. Finally he announced the shoreline erosion restoration of Lake-6 should begin any day and will take about a week to complete.

The currently most acceptable plan is called “trap/neuter/release.” It means setting up a plan within your neighborhood or Association to trap the cats, get them neutered (there are organizations which do so at no charge), then release them back to the wild. It is then suggested neutered cats be fed, but un-neutered cats trapped, and entered into the neutering process. One way to determine a feral cat from a “domestic” cat is by the position of the tail. It is generally believed domesticated cats will carry their tail high when approached by humans, and feral cats will tuck their tail low, perhaps between their legs. You can recognize a neutered feral cat from non-neutered because in the process take a V-shaped clip is made in the tip of the ear. Those are the cats that need feeding.

President’s Column

The board met with owners of properties with respect to drainage problems on Peregrine Point Way and Kestral Park Place and options as to the correction of those problems were discussed. Further action on these issues will be taken. Another member queried the board on the lack of progress on landscaping and other violation issues on a neighboring Pine Harrier Circle property. Preliminary plans for the replacement of an existing residence on Peregrine Point Drive with new constructions were presented and approved by the Board subject to approval of final plans, finishes and colors. The Board will retain an architect to review the construction drawings when available. The board approved two requests for the expansion of existing driveway and entrance pavers on Kestral Park Place and approved the removal of two failing trees on Kestral Park Way S. The board adopted a budget for the year 2015 that called for no change from the 2014 assessment of $65.00 per property.

By Henry Rhodes The year-end is here and so are many of our Snow Birds. It is great to visit with a community full of people. Friday, November 14, residents and friends gathered to celebrate the selection of Dick Bayles as the recipient of The Landings Community Greenfield Distinguished Service Award. The LMA Board was unanimous in choosing Dick for this well deserved recognition. Again---congratulations Dick-- Presidents meeting – January Note on your calendars that the LMA Annual Meeting will take place on February 7th in the Lakeside Room after the usual monthly meeting of

the board. Presidents of Associations will cast their ballots for a number of board seats on that date. The new Gazebo is now open; take time to walk down to the totally new structure. In addition to replacing the Gazebo the bridge leading to it was significantly repaired. The board is planning an official ribbon cutting in January; the date will appear in the January issue of The Eagle. As the year draws to a close, it

is a time to remember how fortunate we are to have so many good friends and neighbors here in The Landings. We remember those who are no longer in our community and reflect on how lucky we were to have had them for a period of time. We hope everyone had a wonderful Thanksgiving and wish a celebration of Hanukkah/Christmas that is full of family, food and fun!!

Landings Nominees for LMA Board of Directors Presidents of association will be invited to a “Meet and Greet” the candidates at a special meeting of the Presidents Council to be scheduled in late January. Presidents will receive instructions including ballots about a month prior to the annual meeting. • Frank Douglas Day (Doug) is a citrus grower with his brother in Myakka City, FL. Doug has been a resident of Sarasota since 1995. Prior to moving into The Landings he lived in downtown Sarasota and served on his condo building’s HOA Board of Directors (1999,2000,2012,2013). Doug, his wife Veronica (Roni) and 4-year old daughter Katherine (Katty) moved into The Landings in March 2014. Prior to his Florida residency, Doug grew up in Clarks Summit, PA and graduated from Ohio Wesleyan University with a Bachelor of Arts. • Joan Lowery holds a Master’s Degree in Education and has more than 30 years of experience working as a professional communicator both domestically and

internationally. Her work spans the fields of training; instructional design; broadcast and print journalism; acting and counseling. For the last eight years she has been teaching The Listening Clinic and Make Your Point skills training classes around the globe for Intel Corporation. She also teaches media training intensives for top tier technology, healthcare and leisure industry companies around the U.S. Currently Joan is designing a year-long communications skills training initiative for medical residents at Jamaica Hospital, NYC. She also serves as faculty for the Telluride Patient Safety Education Round Table, a series of five-day retreats for medical students and residents held each summer. Additionally, Joan serves as faculty for the Ringling College

Locally, Joan has been on the Embracing Our Differences Steering Committee since its inception. In 2013 – 2014 she helped to design and co-facilitate sessions for the Ringling College of Art and Design’s Imagination Conversation series. She served as a member of Community Youth Development’s (CYD) Strategic Planning Team and was selected as CYD CoVolunteer of the Year in 2012 for her work in training teens to produce and host CYD-TV on Sarasota’s Education Channel. • Neil Goldman was born and raised in Chicago. A Chicago Public School graduate, he then graduated from the University of Illinois at Champaign-Urbana, and then received a law degree from the University of Illinois College of Law in 1977. He has been an attorney for over 37 years

at a small but successful firm in Chicago that concentrated in personal injury and workers compensation. He ran the office almost from day one due to his strong organizational and troubleshooting skills. He has been married to his lovely wife Sharon for 35 years and they have two sons and three grandchildren. His hobbies include tennis, golf, boating, going to the beach, and all fantasy sports. In 2004, after comparing many areas in Florida, and even more in Sarasota, they purchased a condominium in The Landings. As Neil slaved away in Chicago and spent some time traveling back and forth from Chicago to Sarasota, his wife spent her winters playing tennis and drinking with The Landings Ladies. Around The Landings Phillippi Estate Park December schedule

December brings the return of the everpopular Holiday Arts and Crafts Show and Sale at Phillippi Estate Park. This arts and crafts show and sale will be in the front field bordering U.S. 41. On Wednesday, December 10, after the Edson Keith Mansion historic tour, there will be an archeologicsl tour of the park at 11:30 a.m. Please meet Ryan Murphy, Sarasota County archeologist, at the Keith Farmhouse next door to the Edson Keith Mansion. This tour will be walking the grounds of Phillippi Estate Park. Ryan will explain the fascinating pre-history and archeology of the 60-acre park, which dates back to 5,000 B.C. You will learn about the Phillippi Flake Scatter and the ProdieMidden (400 B.C. to 800 A.D.) as well as the Manasota Indians who hunted, fished and gathered along Phillippi Creek. Part III - Landings at 25 – Encore This series was first run in the 2005-6 Landings Eagle. It has been moderately updated. By Irwin Starr The Ramar Group, after laying out the plans for the Treehouses, Carriage Houses and individual home sites began marketing The Landings to the potential buyers. It was Style & Class all the way. In 1980 The Landings west of Heron Way was called “future development,” but did include specific plans for a club. What follows is a reprint from Sarasota Scene Magazine, June 1980. It provides a strong sense of what The Landings was intended to be. It does have a slight ring of a good PR writer and was possibly “sponsored” content!

The Landings Exclusive Elegance

The long awaited grand opening was held recently for The Landings, a posh community of single family homes and condominium residences designed and developed by the Ramar Group Companies.

The Landings’ central location and elegant homes have already attracted many of Sarasota’s elite. In fact, nearly $15 million worth of property was sold to an exclusive waiting list prior to any advertising effort. Located on U.S. 41 between South Gate and Gulf Gate, The Landings is the latest and most luxurious of the Ramar Group’s eight Sarasota County projects. (The others include Pelican Cove, Bird Bay Village, The Plantation Golf & Country Club, Sandpiper Key, Siesta Dunes, Village Brooke and Castel Del Mare.) The Ramar Group is generally recognized as one of the leading developers in Florida and each of their communities is known for its special élan. Yet, The Landings eclipses even the spectacular settings and elegance of Pelican Cove and Siesta Dunes, two of the Ramar Group’s previous luxury communities, and promises to be

the most sought after address in Sarasota for years to come. “The Landings is not for every-one,” stated Ramar Group president and founder Robert A. The site of The Landings has a rich and varied history. Nearly 4,000 years ago tribes of Caloosa and Timucan Indians made their home amid the land’s primal richness. The majority of Sarasota’s, however, identify The Landings’ site most closely with Mrs. Potter Palmer. As most know, Mrs. Palmer was wealthy socialite from Chicago who “discovered” Sarasota in 1911, and played a prominent role in developing it as a prosperous resort agricultural community. The Landings acreage was included among her extensive real estate holdings locally.

He said this will not only ensure the highest standards

of building materials and design, but will also see that while every residence is compatible and complementary with its neighbors and The Landings as a whole, abroad range of variety and individuality will be maintained, as well. The Landings, will retain its exclusivity once the Ramar Group’s active participation in its development has reached an end, according to Mr. Morris. Unlike communities such as Bird Key, all roads within The Landings are private and will remain so. The Landings is a totally private and secure development, and only residents and visitors will be admitted past the guard house. “With The Landings,” Mr. Morris added, “we have created a lifestyle which will match the spectacular environment offered by the site itself, and one whose special mystique will endure.” Certainly, Morris and his associates have created Sarasota’s most exclusive community of luxurious style and gracious living.

Barnaby Wolfson Hi everyone. I’m Barnaby Wolfson. I am a nine year old miniature schnauzer. I live with Dale and Jim Wolfson in The Landings Treehouses. For those of you who know my grandma, Betty Wolfson, I can report that

she is now almost 96 years old and living in a wonderful assisted living home and that I visit her almost every day. I moved to the Treehouses from Chambersburg, PA, where I had a very big yard to enjoy. Now I love all of the new

smells of the flowers and bushes when I take my daily walks with my mom. I meet lots of new dogs and new people here. I stay healthy by eating carrots instead of dog biscuits every day.

Q: 1. My cat is losing his hair. He has bald spots all over his body. What could be the reason? A: Bald spots in a cat are common. Most likely your cat is licking his fur off. Sometimes this happens out of boredom, but other times it can be an indicator of stress. Additionally, cats with pain or hyperthyroidism can adopt odd behaviors. Of course we cannot ignore skin problems; so my advice to you is to have your vet check him out to make sure there are no serious reasons to your cat’s new

“look”. Q: 2. I’m a jogger and would like to adopt a jogging-buddy dog. Which breed will withstand Florida’s hot climate? A: The best dog breed for jogging is one with a good heart, strong legs and practice. Greyhounds certainly qualify, but you may not keep up. In Florida, however,heat stroke is a constant concern for all joggers, bipeds or quadrupeds. Regardless the breed, it’s best to jog early in the morning or late at night. Make sure to bring water for your pup and try to keep the distance short. Dogs don’t sweat; they only cool down through panting, so allow for frequent stops. If you lived in the north, Labradors,

Golden Retrievers, Huskies and more dog breeds would make for an awesome running companion. Steer clear from short-nosed breeds as these have the least predispositions for strenuous exercise. Q: 3. What are the main benefits of Omega3 oils for pets? A: Omega3 is an essential fatty acid and an antioxidant, and has amazing effects on preserving and stabilizing cell membranes integrity. The nervous system, the skin and the immune system,not to mention joints, love it. The only time I do not recommend it is during chemotherapy, as it has been shown that fish oil supplementation can interfere to some degree with chemotherapy effects.

Dr. Chauvet earned her Doctor of Veterinary Medicine from the University of Saskatchewan in Saskatoon, Canada, completed a small animal medicine/surgery internship at the University of Illinois in Urbana and finished her residency in neurology/neurosurgery at the University of California, Davis. Before coming here, Berry worked in security at an apartment complex in downtown Sarasota. Born and raised in Sarasota, he graduated from Riverview High School in 2005. He soon became a Multimedia Graphic Designer and worked for the county as a Thermal Imaging Technician and also designed websites. When he finds spare time, Berry enjoys some of the more sophisticated video games and started playing banjo about a year and a half ago. Recently he was hired to be part of an editing team for a book publisher. Berry’s younger brother is a Marine who just finished Basic training and is now attending a training school to become a communications specialist in intelligence. His younger sister is a police officer in North Port. When asked what he enjoys most about his job, Berry said, “the people, these are good people. With all the bad eggs in the world, there are many more good eggs.”

Magic Cookie Bars: Ingredients::

1 Tsp. grated orange rind 1/2 cup butter or margarine 1 1/2 cups graham cracker crumbs 1 14 oz. can condensed milk 1. 6 oz. pkg. semi sweet chocolate morsels 1 1/3 cup flaked coconut 1 cup chopped nuts Preheat oven to 350* (325 for glass pan). In a 9 x 13 pan, melt butter in the oven. Sprinkle graham cracker crumbs over melted butter, mix together and press into pan. Pour sweetened milk evenly over crumbs. Top evenly with chocolate morsels, coconut, and nuts. Then press firmly. Bake 25 - 30 minutes or until lightly browned. Cool thoroughly before cutting. Serves 24. Store loosely covered at room temperature.

Landings Greenfield Distinguished Service Award On November 14, nearly 100 Landins celebrated Dick Bayles being honored as the fourth recipient of The Landings Greenfield Distinguished Service Award. Our prime season has begun. Familiar faces, missing for the past few months, have returned. The courts and other activities have become more populated, especially our tennis cardio and team clinics. Women’s and men’s team tennis has begun and I’ve been pleased to see spectators at their matches. We’ve completed the 2014 enhancements to our physical plan with the replacement of the walkway lighting with LED fixtures that not only give us daytime level lighting, but have an expected life of 40 years and consume far less electricity while doing so. Having replaced virtually all of the spa equipment, the last piece went in recently, and I hope that it finally results in predictable performance. At the request of several members, we have upgraded the lap lane separators to reduce wave interference for our lap swimmers. In November, we hosted the Lessons for Life charity event and the national clay court Father/Son championships. While the former had rain impacting some of their activities for the first time in the participants’ memory, the evening was a fund-raising success. If you haven’t signed up for our Holiday Dinner/Dance and wish to attend, available capacity is going fast, so hurry. At our November meeting, the Board of Directors adopted our 2015 budget. The assessment remains unchanged at $1,244, payable on or before January 1, 2015. Annual Assessment notices went out prior to Thanksgiving. I mentioned in an earlier letter that we were planning to install a new member and court management system. We did so in late October, have tested its settings for our environment in November, and will run in parallel for the month of December. I expect that it will be in full operation beginning on January 1st. I wish all of our members and their families a safe and enjoyable holiday season and Happy New Year.

I would really like to thank all the members that participated as host families during this year’s Father/Son tournaments and especially Ralph and Dee Ricapito for organizing the entire group. Every year the hosts do an outstanding job catering the player lunch. As usual, the food brought in by the members was outstanding. Thanks again for your help in making this a special tournament for all the players. I know they really appreciate it. Our Annual “Lessons for Life” charity benefit was held November 8th. This was the 9th consecutive year that The Landings Racquet Club has been the host facility. Unfortunately, for the first time in the 14-year history of the event, the weather didn’t cooperate. The rain started falling shortly before the clinics started. Even though the tennis was rained out, roughly a third of the people still came for the silent auction and the delicious food provided by our new neighbor PDQ.

When it was all said and done, the event raised just over $7,000 for the Center for Building Hope. We will keep our fingers crossed for better weather next year. The Annual Holiday Dinner Dance is Saturday, December 13th in the Lakeside Clubhouse with cocktails at 6:00 and dinner at 6:30 PM. Sammy J and the Saxman will be the live entertainers this year. James Riegel from Black Tie Catering is back again to provide the food. The menu is posted in the Tennis Pro Shop and the cost is $28 per person. Please register in the Pro Shop by December 10th if you would like to attend the party. Tennis playing members please note: Now that season is here and daylight savings time has ended, I would like to stress the importance of making afternoon or evening court reservations. You are rolling the dice by just showing up and expecting to find an open court to play on. In the afternoon, if the court isn’t being played on it’s getting watered. And at night, the four courts with lights can fill up quickly. To ensure court availability, please call the Pro Shop in advance at 923-3886 before coming over.

National Tennis Tournament Hosted by the Landings The 2014 USTA National Senior Super/Senior Father/ Son Clay Court Championships were hosted by The Landings again this year. Thirty Eight teams from 20 states across the

country participated this year, truly making this a national tournament. Several of those teams were highly ranked in each division. Organizers were pleased to welcome a few new

teams and sad to see a few teams who come every year, unable to play due to injury. Again this year, player after player noted this tournament is their favorite of the year.

He died Sunday, November 23, 2014, in his home at the age of 91 and is survived by his wife of 68 years, Betty; son Jim, his wife Lisa and their daughters, Shelby and Nikki; son-in-law Gordon and grandsons

Is There Honor And Justice Among Us? YOU BETCHA! Sarasota honors Judge Lynn Silvertooth, a lifelong Florida and Landings resident, by naming the County Judicial Center after him. Here comes the judge are words you will hear around Eagles Point Circle and Landings Blvd., on his way to a bridge game or walking for exercise. He always has a smile and a good story to tell. Betty, his wife, says, “He was always on the move.” Lynn started his Legal career in 1949 when there

were only two judges and a few dozen attorneys in all of Sarasota County. In 1964 he was appointed a circuit court judge, and his wheels would take him throughout the county on any given day Judge Silvertooth retired from a low-profile to a high-profile career on the bench in 1989. He tried a sensational case in Miami involving payoffs to the Mayor, two circuit court judges and other city officials, as well as the mob! He even presided over a headline making murder trial where F.Lee Baily began his career notoriety by defending a Sarasota physician accused of poisoning his wife.

Yet, Julie Parks quips, “Garfield the cat rules the roost.” She enjoys the banter between Betty and Lynn at the bridge table and laughingly says, “He’s mean as sin when they play bridge together. But, a real southern gentleman walking the ladies to their car for safety at the end of the evening.” Ralph Ricapito remarks, “Many times when talking with people, and mentioning that you live in the Landings; they usually ask you if you know Judge Lynn Silvertooth and there’s always an admirable discussion about him. He is a loving family man and we are proud to be his neighbors.

In the absence of submissions by other Landings photographers for the December issue, I have decided to post some of my own “bird” shots, all taken this past year in and around the Landings community. Once An Engineer, Always An Engineer By Karl Maggard Jeff Crotty has been heard singing many great tunes over the past few years with The Landoliers. Lately, he has been heard singing a different tune: “I’ve Been Workin’ on the Railroad.” As shown in this photo, Jeff and MaryKay Crotty recently had some great new landscaping work done in their yard on Pintail Way. This gave Jeff an opportunity to expand his garden railroad. Jeff takes advantage of both his education and career as an engineer; only this time, as a different kind of “engineer.” For years, Jeff had a beautiful garden railway layout on his Barrington, Illinois estate. When he and MaryKay moved to The

Landings a few years ago, he modified his layout, but now can enjoy his hobby even more with this expansion. Jeff has his railroad working whenever he and MaryKay have guests or visitors. There is no doubt that he would be

delighted to bring out one or more of his many engines and railcars, if any of his neighbors asked. In fact, he doesn’t need much encouragement! Thanks, Jeff, for this marvelous addition to The Landings.

Our Star Is Acting Up

By Albert L. Weeks (Former staffer on the Newsweek Science Desk) Lately, mainstream media and our local H-T have been noting the Sun’s unusual sunspot activity. Last month one such group of spots on the solar face was as large as several Earths, the biggest such group seen in a quarter of a century. It had the power of several billion thermonuclear weapons. Fortunately, these huge storms did not cause the havoc some past ones have by fouling up our navigation and communications. This time the stream of charged solar particles was largely directed away from Earth. Yet the current “maximum” phase of the Sun’s 11-year cycle is only about half-way through. It is due to end in 2019. Can any of us here in The Landings view these sunspots safely? Yes. It’s very easy. Everyone knows you never should look directly at the Sun. Yet you can project the Sun’s image into binoculars that are

held away from your eyes. This is known as camera obscura. Simply place the binoculars in a cardboard box, making holes for the eye-piece lens to poke through into the box. You can catch the Sun’s image projected onto a piece of white paper held at the eyepiece end of the binocs inside the box. The paper acts as a screen. Since all this is done at a remote distance from your eyes and face--as, say, on a table or on the ground--there is no direct contact between your eyes and the Sun. Some people prefer to view solar images as projected via a pinhole cut into a piece of cardboard held up towards the Sun. This, too, produces the Sun’s image. But it is not as good as the box + binoculars. The latter permits you to magnify the Sun and thus clearly see sunspots, even flares. (See photos here of the box set-up.) Much controversy swirls

around the issue of whether these solar storms produce certain types of weather on our planet. Some astronomers, like William Herschel of yore or Dr. Guy Ottewell of Australia today, claim that climatic changes on Earth stem from solar activity. Since this idea, known as “cosmic meteorology,” runs counter to the consensus on global warming, sunspot causation is not generally accepted. But the jury is still out. Climate science is not a cut-anddried discipline. There is room for disagreement as there is in all the sciences, from physics and medicine to meteorology. Ask Albert Einstein and Dr. Louis Pasteur, for instance. Their peers did not accept their theories at first.

Finally, in December of 2013, he was able to retire and is currently a happy snowbird, spending summers in New Buffalo in southwest lower Michigan and winters in The Landings. For the last two years he has served on his Association Board, and is currently the President of Landings South II, better known as the Portside Villas. |The Man Who Saved Batman Michael Uslan is a producer of all the modern Batman films to date, starting with Tim Burton’s 1989 film. He is also a Sarasota Snowbird. He and his wife, Nancy, have been coming here since 1979, originally to visit her parents, and later to escape the cold and chaos of bi-coastal urban life in New Jersey and Los Angeles. Under the auspices of Jeanne Corcoran and the Sarasota County Film & Entertainment Office, Michael recently addressed a group of students and film fans at Ringling College of Art and Design. The talk was motivational. To the young people in the audience, he had this to say: “Lucky you that you are in school right now. We are in an industry that is undergoing revolution. All kinds of opportunities are opening up. It’s an exciting, exciting time! If you have an opportunity to discover your passion and your dream, get up

off the couch! Only 10-15% of kids will do that, so if you do, your odds of success will shoot through the roof.” Michael Uslan was younger than 4 when he started reading comic books: Casper the Ghost, Archie & Veronica, and Superman. He was very comfortable with Superman because it wasn’t scary. As an older and more sophisticated 8 year old, it was Batman who became his idol. He was drawn to the character because Batman had no superpowers, which made young Michael feel that a nerdy fellow like himself might actually become a powerful force in the world. His Mom said: “Keep your comic books. I’ve read them and they’re fine. The deal is that you must also read other things like newspapers and magazines.” One cold night in January of 1966, Batman premiered on TV. To Michal’s horror, he found

the whole world laughing at Batman. They were making a joke out of his beloved idol! At that very moment he made a vow that he would work to restore Batman to the original character that had first been created in 1939 by Bob Kane and Bill Finger. Of this pivotal moment, Michael says: “It was the ultimate point of my career, and pretty much set the direction of my entire life.” He became determined to erase those words “POW”, “ZAP”, and WHAM” from world culture, and reveal to the world what a dark and serious character Batman really was. Born in 1952, Michael Uslan was in his late teens when he began teaching the world’s first accredited college course on comic books. He taught it at the school where he was still a student: Indiana University. This unique class caught the eye of news media, which in turn attracted the attention of

DC Comics in NY. Michael was brought to New York to write some of the scripts for The Shadow. Ultimately he even began writing Batman comic strips. Move to the late 1970’s. Michael was in his 20’s when he and Ben Melniker obtained the rights to Batman. Truth was, nobody else on the planet earth wanted those rights because no one believed in Batman any

more. Nonetheless, with those rights in his pocket, Michael proceeded with his vision of developing Batman in a dark and serious way. He quit his job, went out to Hollywood, and soon found every door slamming in his face. Stubborn and obsessed, Michael now entered a ten-year human endurance contest, which he describes in his memoir, The Boy Who Loved Batman.

”Every single studio told me that I was crazy, that it was the worse idea they’d ever heard… (it) was a rough, tough ten years of everybody telling you how lousy you are and how bad your ideas are. It really tests your mettle as a human.” Along the way, he went to law school, taking every course he could find on communication, and beginning his “Plan B” career as a motion picture attorney. One of the film projects on his docket was Apocalypse Now. Michael came to realize that when a movie is produced, much of the process involves financing and contracts. The screenplay serves as the blueprint, of course—but it’s the “bean counters” and the “pencil pushers” who make decisions on where and when the film will actually be shot, and for how much. In 1986, Tim Burton walked into his life. (Tim had just completed the fine cut of Pee Wee’s Big Adventure, created by

Sarasota’s own Paul Rubens.) When Burton’s Batman came out – in 1989 – it had huge cultural impact. It was a “Lost Horizon” journey of selfdiscovery. “You have to take Batman and The Joker side by side,” says Michael. “The Joker is pure evil in the guise of a clown. Batman is pure good the guise of a Monster. Batman is the only superhero with no superpowers. What is his superpower? It’s his humanity. The Batman fable is based on the life journey of a traumatized young man.” Michael Uslan has more than one string on his Stradivarius. Most recently he served as Executive Producer of the Lego Movie (2014); Batman Vs. Superman (2015); The Dark Knight Trilogy, which included two of history’s top grossing movies: The Dark Knight Rises (2012), and The Dark Night (2008). The latter received 8 Oscar nominations. Michael Uslan was also the executive producer of The

Swamp Thing TV series, 2004’s Catwoman, and 2008’s Spirit film. He produced PBS’s Three Sovereigns for Sarah starring Vanessa Redgrave, as well as the children’s geography teaching TV show called: Where on Earth is Carmen Sandiego. His list of credits goes on and on, for Michael is a man of energy and action. When asked how he sees the evolution of Media, Michael predicts that the paradigm of TV is changing. It will be “goodbye” to the 300 TV stations, which will be replaced by 3,000 internet stations. It’s a new world and a global one: Amazon, Netflix and Google will rule. Content is king, and the awakening “sleeping giant” is China. They have the money, the resources and enormous audiences. Opulent state-ofthe-art movie theatres are being built in China at an incredible rate. In Michael’s optimistic words: “It’s exciting! Dealing with China will require a lot of out-of-box thinking. The

recession is ending. There are lots of new opportunities. Cinema is global. Computer skills and animation skills have become very marketable.” Michael Uslan is one of Hollywood’s most accomplished movie

producers. In 2001 he donated 30,000 comic books from his lifetime collection to Indiana University. They are housed in the Lilly Library along with other rare books and manuscripts.

Big Pass Update Independent review of Army Corps’ Lido project to take in big picture An anticipated, independent “peer review” of the Lido Renourishment Project could start as early as this month. Sarasota County expects to hire a coastal engineering consultant this month to conduct the review examining possible impacts from the U.S. Army Corps of Engineers’ proposal to buffer 1.6 miles of Lido Key Beach using sand dredged from Big Pass. The peer-review study should be completed this spring, when it will be presented to county commissioners, said Laird Wreford, coastal initiatives manager for the county. Depending on its results, the study may well become a deal breaker or deal maker for the Corps’ ambitious project. The peer review is expected to weigh heavily in whether local advocates get behind the Army Corps’ $19 million Lido Beach project and whether county commissioners approve key aspects of the Corps’ plan. County Commissioners hold influential sway because they would have to sign off on the Corps’ plan to place at least one groin on county-owned South Lido Park. In total, the Army Corps wants to put three groins on Lido to help retain newly nourished sand. “What we are trying to do is get the best possible information as to what are the possible effects of the project,” Wreford said. “So when the Corps officially requests an easement, commissioners will be able to respond to that request, or seek additional information.” The county will choose one consultant from its library of seven approved consultants to conduct the review. The independent study should provide some further insight about how the three groins will work on Lido— including the groin planned for South Lido County Park. But the review will have a wider scope. Overall, it will look into ways the Corps project

could impact the shoreline, marine ecosystems and waterways from Lido to Siesta. “We’re looking at any down drift impacts, sediment wise,” Wreford told Siesta Sand. “That would be immediate adjacent shore as well as any of the beaches that would be impacted by sand flowing down drift or sand not flowing down drift.” Shoreline impacts would include any potential beach erosion on Siesta, and Wreford says the county is committed to making sure the project will not have detrimental effects on Siesta beaches or the North Siesta shoreline. “The county has stewardship concerns to make sure no harm is done to any coastal environment,” Wreford said. Over the past few weeks, Wreford has been meeting with residents on Lido and Siesta to talk about the review, and make sure local concerns are addressed by the consultant. The goal is to address all concerns so there will be“some level of community buy-in to the work that will be done.” One of those residents Wreford spoke with was Peter van Roekens, a boating advocate and current Chair of Save our Siesta Sand 2 and The Boaters Coalition. Van Roekens is just one of the Siesta Key residents who has expressed concerns about the possible impacts of the U.S. Army Corps proposal to dredge sand from Big Pass and pump it onto Lido Beach. Any potential down drift impacts, he worries, could be irreversible. “This dredge is not parking meters,” van Roekens told Siesta Sand. Both dredging Big Pass and installing groins are complex coastal projects that can’t be undone, van Roekens said. The Siesta resident says the county likely wouldn’t have had to conduct such a broad independent review, if the Army Corps listened to local advocates’ requests to conduct an in-depth environmental analysis, called an Environmental Impact Statement (EIS). Corps officials

have publically stated that so far they are only required to conduct a less-in-depth environmental study, which has not been released. Changes to Big Pass worry van Roekens. The Corps released a study concluded that dredging 1.3 million cubic yards of sand from the pass shoal would not negatively change the shoal, alter wave action or “sediment transport pathways that deliver sediment to down drift beaches (Siesta Key.” Members of Save our Siesta Sand 2 (SOSS2) however do not agree with the Army Corps’ conclusions. Removing more than 1 million cubic yards of sand from Big Pass, which has never been dredged, will have a detrimental impact on navigation and the natural down drift of sand on Florida’s west coast. Dredging passes elsewhere in Florida has not happened without some negative impacts, and van Roekens wants to see proof that dredging 1.3 million cubic yards of sand from Big Pass won’t cause negative impacts to the surrounding marine environment: “What evidence is there that their (Corps) dredging here will not have the same effect it has had elsewhere, mainly negative effect on beaches or navigational ability? Why won’t that happen?” Recent projects to dredge in Red Fish Pass and Longboat Pass have had negative down drift impacts, pointed out van Roekens. Dredging the shoal of Redfish Pass caused beach erosion problems, according to a study conducted by coastal firm Humiston & Moore Engineers. And van Roekens has a pledge. “Legal action will happen unless they satisfactorily answer these questions,” he said. Save our Siesta Sand 2 has retained legal counsel, as well as the Florida Wildlife Federation, which sent a July, 2014 letter to the Army Corps requested that the agency conduct an EIS study. Last month I wrote about the use of fines as a means of obtaining compliance with the declaration, bylaws, and rules. Two other methods of enforcement that also do not require filing a lawsuit are: (1) suspending the right of an owner, tenant, or guest to use the common facilities; and (2) suspending the right of an owner to vote. These methods of enforcement apply to both condominium and homeowners associations. If a member is more than 90 days delinquent in the payment of any monetary obligation due to the association, the association may suspend the right of those related to the unit to use the common facilities. That means, for example, that the owners, tenants, or their guests may no longer be allowed to use the pool, beach access, or club house. The right to use the roadways and sidewalks to access the unit, and the right to park, cannot be limited;

however, if there is gated access, the right to use the most convenient access gate could be suspended. Requiring the owner or tenant to stand in line to use the visitor access gate may encourage payment of the delinquent account.(Note, the association may not use this provision to cut off utility services to the unit, though.) When the association wishes to suspend use rights because of a delinquent account, no hearing is required. The board may simply approve the suspension at a properly noticed board meeting and notify those affected by mail or hand delivery. When the board wishes to suspend the use rights for a non-monetary violation of the declaration, bylaws, or rules, then the same procedure required to levy a fine must be followed. The alleged offender must be given 14 days’ notice and the right to appear before an independent “compliance committee” to plead his or her case. In that case, the

suspension may only be imposed if the committee approves. A “nonmonetary violation” could be anything from allowing a dog in the pool to speeding. Voting rights associated with a parcel can also be suspended if the account is more than 90 days delinquent. No hearing is required but the board must vote at a properly noticed meeting and notify the persons who would otherwise be entitled to vote. While the suspension is in effect, that voting interest may not be counted for any purpose. If an association does chose to suspend certain rights in an effort to obtain compliance it should have a plan for enforcing the suspension. Who will ensure the vote is not counted? Who will be responsible for approaching the person who no longer has a right to be in the pool? These are matters that should be considered prior to taking action. (See Florida Statutes Sections 718.303 and 720.305.)

do.” Like van Roekens, Luckner is concerned about changes to Big Pass. “Big Pass is an incredible waterway and one of the last natural passes in Florida. There is no bridge and no declared navigational waterway.” What options does she want to see put in place? Whichever is “the least likely to cause harm.” The review comes at good timing, because Luckner believes the Army Corps is going to be under the gun to try to get the Lido Beach project started soon. In addition to changes to Big Pass, Luckner worries that three groins could lead to potential negative impacts impairing Lido Beach’s ecosystem in the

future. She hopes the peer review study takes a close look at South Lido Park, which was formed as part of a pact to taxpayers in the 1970s. Luckner has researched the creation of the park and wrote about the topic for Siesta Sand in August. At the time, the park was purchased, voters approved an extra half mill property tax to help fund the purchase of South Lido County Park and Caspersen Park. “The taxpayers paid for [part of] it, and they did it understanding that property would be left as public space in its natural state.” South Lido County Park was established to be “forever maintained in its natural state for public use and recreation.”
