In this article we will be considering some of the things we need to know and questions we should ask as builders when we are asked to take on a remediation project. As discussed previously, there are increased risks in such projects and it is essential that we as builders Harry Dillon understand these risks and ways to minimise them. And this starts before we even swing a hammer on site.

BUILDING CONSENT The ‘like with like’ provision in Schedule 1 of the Building Act allows repairs and maintenance to be carried out on a building without a building consent, but only where the building has not failed the durability requirements of B2. Due to these requirements any building that has leaked within 15 years will strictly speaking require a building consent for repairs to the envelope.
Assess the building When you are contacted by a designer or client it is crucial to know if an assessment has been carried out on the building. If there is, what are the skills and experience of the assessor and is the report current? If there is no assessment, in most cases it will be appropriate to advise the owner to obtain an inspection and report from a competent person.
Have plans been drawn up and consent applied for? What are the qualifications and experience of the designer and those supervising the repair process, providing ongoing design support and evidence collection? Until the cladding is removed, it is often difficult to determine the extent of the work needed and details required. If a designer has little experience in remediation, will they be able to deliver details in a reasonable time frame? Note that since March 2012 this is restricted work requiring the appropriate design license. Case law has shown that builders can carry significant liability if they design missing or change existing details which then go on to fail.
REMEDIATION Having an understanding of the whole remediation process and what options are available for potential clients has helped me differentiate from others in the market and develop a relationship with those clients. Carrying out a quick assessment of the property in person or over the phone to determine the age, design features, building materials and why they think they may have a problem will be a useful first step in determining the options available. If their home has a CCC, who it was issued by and when, is critical.

to building projects. If a client falls outside these limitation periods their options for holding those to account for their loss through litigation narrow significantly. Due to the complexity of such cases it is probable that a client will need the advice of other professionals for legal and expert advice to determine their most appropriate course of action. THE RISKS If a client is unfortunate enough to own a leaky building they may also need to consider the potential health implications of residing in their home and the length and stress of the whole process. Options could include selling back their home to the defendants, the original builder perhaps, or demolition with consideration for land value and remediation costs. A builder’s most obvious risk is arguably security of payment so understanding how a client is intending to fund the repairs is essential. A client may plan to 100% self fund for a small repair for example - but what if scope and budget significantly increase? They could then be driven to pursue parties using the WHRS or private litigation though the courts. The client may also be using the governments new Financial Assistance Package (FAP), the subject of our next article.
IMPORTANT CHANGES TO LBP SKILLS MAINTENANCE SCHEME THE LBP SKILLS MAINTENANCE SCHEME IS BEING REVIEWED AND IN THE MEANTIME, NEW GUIDELINES HAVE BEEN INTRODUCED REGARDING HOW YOU CAN EARN POINTS TO MAINTAIN YOUR LBP LICENSE Up until now, certain activities (training, attending conferences, workshops etc) and reading industry publications such as Building Business, were “registrar approved” and qualified for a specific number of points. The revised guidelines eliminate the need for activities to be “registrar approved”, and are based on the number of hours you spend on industryrelated learning activities. The rule of thumb is that one hour of learning equals one point.

According to the Ministry of Business, Innovation and Employment, Building and Housing Group, “skills maintenance is generally about LBP’s taking part in self directed learning activities.” This means that virtually any day-to-day activity you undertake that involves acquiring new skills or knowledge in your trade can help you build up your points total. How to record your points Make sure you keep an up-to-date record of your skills maintenance activities in your ITM diary. Record the date, a brief summary of the activity, what you learnt and the amount of time involved. At the end of the year, you can then update your skills maintenance records using the LBP online system or by completing the “record of skills maintenance form”. Remember, all Licensed Building Practitioners need to gain a certain number of skills maintenance points and submit these to the Registrar every two years.

How to survive a complaint to the building practitioners board Since 1st March 2012, a licensed building practitioner has been required for any design, construction or alteration of a house or a small-to-medium apartment building, if the work affects the structural integrity or weathertightness of the building, as well as the design of its fire safety systems. This is all known as “restricted building work”, and A regular column by it includes not only design and Geoff Hardy a carpentry, but also bricklaying Commercial Lawyer and blocklaying, external plastering, foundations, and roofing. Licensing imposes a whole lot of additional restrictions on builders that they did not have previously, and one of them is the complaints system administered by the Building Practitioners Board (“BPB”). Anyone can complain to the BPB about a licensed building practitioner. If the practitioner is an architect, chartered professional engineer, engineering associate, electrical worker, plumber, gasfitter or drainlayer, then the complaint is likely to be referred to his or her own trade association. So the BPB will be mostly handling complaints about builders. The important thing to remember is that if you treat it seriously and get some expert advice at the outset, there is nothing to fear. But if you bury your head in the sand and ignore it, it could seriously affect your ability to earn a living. COMPLAINTS CAN BE USED TO PRESSURE YOU The most common source of a complaint about a builder is likely to be a client who has become disenchanted about the builder’s work during the course of the project. Generally clients are in a very 8
powerful position because not only do they have a wide range of rights and remedies available to them under the law of contract, the law of negligence, the Consumer Guarantees Act and the Building Act, but they also have the ability to withhold payment of the builder’s invoice. But because disputes over residential building contracts tend to be very

emotional, clients will often look for every form of leverage they can find to exert pressure on the builder. And complaints to the BPB are a very easy way to do that. They are easy because they are relatively fast, cheap, and informal. A homeowner can get a ruling from the BPB which will tell him whether his grievances have any substance or not. Although the BPB cannot order the builder to fix any defective workmanship or materials, or pay damages to the homeowner, at least it will tell the homeowner whether it is worthwhile filing a claim against the builder in the Courts or the Disputes Tribunal, or using arbitration under the Arbitration Act or adjudication under the Construction Contracts Act. Plus, the stress that a complaint to the BPB will cause the builder may well cause him to cave in, and concede the argument even though he may well have been in the right.
In reality there is absolutely no reason to cave in. The BPB is made up of intelligent people who are all highly experienced in the building industry. If the homeowner’s complaint has no substance, they will say so. They are bound by the principles of natural justice, which means they have to conduct the hearing fairly, transparently and in good faith, and they have to give you a fair opportunity to state your case and counter any arguments put up against you. You are entitled to have a lawyer do this for you.
with the BPB. The main ones are that you have been negligent or incompetent, or you have not complied with the building consent. There is every chance that the initial complaint can be challenged on technical grounds, so it pays to get expert advice as soon as you receive notice of it. There are some fairly tight deadlines that you have to comply with, such as 20 working days to respond to the complaint, and after that you have to organise your witnesses well in advance of the hearing.

If the complaint against you is upheld, then the BPB has a range of penalties they can impose on you. They can cancel your licence, or suspend it for up to 12 months, or restrict the type of work you can carry out or supervise. They can also order that you undertake training, they can fine you up to $10,000, and they can order you to pay the costs and expenses of the whole enquiry.
NOT EVERY COMPLAINT WILL BE VALID Some complaints will be thrown out before they even get off first base. These are complaints that are clearly groundless, or are frivolous, vexatious, vindictive, or not made in good faith, or are relatively insignificant or trivial. But even the complaints that, on the surface, appear to be more serious will usually involve just a difference of opinion between you and your client. In that case there may be no reason for the BPB to intervene at all, especially if you are taking steps to resolve the dispute through some other recognised method such as adjudication under the Construction Contracts Act. Remember that there are only certain grounds on which someone can file a complaint against you
Those are serious consequences, and they become public knowledge because they are recorded on the Licensed Building Practitioners’ register. Furthermore, if the Building Act Amendment Bill No.4 is passed in its current form, you will have to disclose this to every potential residential client that you are hoping to get work from. The outcome of the complaints process will depend upon the effort you put into it, so take it seriously, get some professional assistance, and rest assured that if you do that, you will get a fair and reasonable result. Cash flow is your businesses' life blood Almost every request received by Business Mentors New Zealand’s 1800 volunteer business mentors will feature to some degree problems with cash flow Cash flow is the lifeblood of any small business. Regardless of how good your product or service might be, if you spend more money than you bring in your business will fail. Knowing what's coming in and what's going out is fundamental to running a successful business. Of the 60,000 plus SME (small to medium-size enterprise) owners in New Zealand who have sought our help in the last 21 years, around a third of them have had serious problems with their cash flow Many New Zealand businesses start up with very little in the bank and almost half will have run out of cash or come very close to it in the first years of operating. Most SMEs have a very narrow margin for error, so keeping an eye on cashflow is essential. These are some of the common cash flow problems our business mentors encounter: Haphazard accounting If your business accounts are disorganised it’s hard to get a clear picture of where you are with your cash flow. Keeping up-to-date and tidy accounts will help you see your company’s financial position at a glance and spot a cash flow problem in time to head it off. Disorganised invoicing It’s no good doing lots of work if you’re not keeping on top of the invoicing. A good approach is to bill as soon as the work is done and get the invoices out. It’s easy to get too busy or be too polite to chase up outstanding invoices. Late payments can be fatal for your cash flow. A good book-keeping programme will help you get invoices out on time and see when they’re late so you can chase them up. Slow sales By keeping track of sales and income monthly and monitoring patterns you can try and head off a drop in cash flow caused by slow sales by rethinking your marketing to boost income. Other cash flow issues a business mentor will help you to look out for are: • Overtrading – taking on more than you can manage can ultimately lead to lost contracts • Too much debt can eat into profits
• Holding too much stock – if you constantly have more than you can sell, consider an ordering rethink • High overheads – running a lean operation, especially in the early days, will help your cash flow.
Business Mentors provides access to a wide variety of volunteer mentors (who provide their experience, skill and knowledge free of charge). The focus of the organisation is on developing capability, profitability, and employment generation. It provides a mentoring service to any businesses that are trading with evidence of accounts. There is no limit on the amount of mentoring sessions. The $150 registration fee allows mentoring for up to two years. The term of the relationship with a mentor depends on the objectives and goals both client and mentor jointly agrees upon. They can also contact their coordinator at any point for further assistance. One of a business mentor’s main roles is to act as both sounding board and brainstorming partner. A mentor can help a business owner take a step back from the company and take a look at the ‘bigger picture’. A mentor can assist in identifying strengths, weaknesses, opportunities and threats that may have been missed. A mentor may also help the business owner refocus on their business goals and offer advice on strategies to better achieve them. Often, simply having somebody to talk through plans and ideas with can help a business owner organise their thoughts and put them on the track towards turning their company around. Should you update your points at the same time? • Yes, it is worth updating last year’s skills maintenance points. • LBP’s can gain an extra point for submitting their points early. • Remember 1 point for every hour you have spent reading ITM’s Building Business magazine or for every hour you have spent at an ITM training course. Why do you need to pay the annual fee? • If you want to undertake Restricted Building Work you need to maintain your license (pay their annual fee) and continue to further your education through skills maintenance training. • The annual fee covers the cost of running the scheme and LBPs receive many personal and business benefits, such as: o Formally recognised as competent and experienced in your chosen field. This is similar to the recognition that plumbers, electrical workers, architects and chartered engineers already have through their registration systems. o Able to use your LBP status as a personal ‘mark of quality’ in your work. o Listed on a public register so clients or employers can see your licence status. o Supported by an active advertising and promotional programme to consumers. o Only LBPs can carry out or supervise restricted building work from March 2012.

are you aware OF ThE new working at height guideline? There are a number of compelling reasons to have an effective health and safety system. The most obvious of these include the desire to keep everyone safe and the need to meet the legal requirements of the Health & Safety in Employment Act The new Ministry of Business, Innovation and Employment (formally the Department of Labour) has recently launched a new Working at Height Guideline that requires significant changes to the way the construction industry works at height. This is in response to upwards of 70% of injuries in construction being caused by falls, most of which are from well under three metres. It is vital for all companies who have staff or contractors who work off the ground to fully understand these new requirements. Significant changes include: • The need to provide fall protection while standing trusses and roofing on single level dwellings. This includes protection against falls through the roof as well as falls from the edge of the roof or frames. Possible solutions include scaffolding, edge protection systems, safety mesh and soft landing systems or netting. • Ladders to be used for access to a working platform or for jobs of short duration only. Platform or podium type ladders with guardrails can be used in certain circumstances. • Mobile work platforms to be used instead of ladders or saw stools. Work platforms to meet AS/NZ standards and have guardrails whenever possible, no matter how high the potential fall.

Aesthetics vs Weathertightness the Ultimate Trade-off? WHY AREN’T GUTTERS DESIGNED TO OVERFLOW TO THE OUTSIDE IN CASE OF A GUTTER BLOCKAGE?

WHY ARE MOST GUTTERS HIGHER AT LEAST EQUAL IN HEIGHT ON THE EXTERIOR FACE? Can we really RISK LEAKY BUILDINGS JUST TO ACHIEVE THE DESIRED LOOK? The questions above illustrate a common misconception regarding the perceived necessary trade-off between aesthetics and weathertightness when it comes to detailing the junction between external gutters and the roof edge and the concern that any overflow will enter the building envelope. HIGHER FRONT FACE Specifying and installing an external gutter with a higher front face will indeed hide untidy rooflines but it does not have to be at the expense of weathertightness. If the chosen system maintains a gap between the fascia and the back of the gutter, water can still safely overflow without entering the building envelope. In addition they are also much safer than internal or hidden gutter systems where any leak or overflow will occur within the building envelope. WEATHERTIGHTNESS IMPROVED In fact, a higher front face can actually help to improve weathertightness as supported by Section 4.0.1 of the BRANZ Bulletin Issue 509 “Sizing Gutters and Downpipes” which states:
“The front face of the gutter should be higher to restrict the potential for water being blown up under the bottom edge of the roofing – see Figure 2.“

Furthermore, Section 4.0.1 of the BRANZ Bulletin specifically recommends that:
“External gutters should be designed to allow water to spill to the exterior (usually between the back of the gutter and the fascia) should they overflow due to high rainfall or should a downpipe become blocked. CHOOSE MARLEY Marley’s spouting systems are one of the few on the market that comply with these recommendations. Firstly, Marley offers systems featuring a higher front face which improves the aesthetics of the detail and reduces the chance of wind-blown rain entering the building envelope. Secondly, all Marley bracket systems maintain a 12mm gap between the back face of the gutter and the fascia board so that water is able to safely overflow over the back face without entering the internal envelope of the building. This is reinforced by the August 2011 amendments to E2/AS1 where Figure 25 outlines the appropriate eaves detail for a timber fascia/masonry tile construction and clearly shows a gutter with a higher front face.
