Of course, owners wish to maximize their time on board, but there are often weeks or months in the year where it may not be possible to enjoy the yacht themselves. For those who wish to keep the yacht (and its crew) active, as well as offset some of the operational costs, chartering out the vessel is an excellent option. There is significant potential for owners when investing in a charter vessel, as the global market continues to grow each year. There are currently 1800 yachts above 20m available to charter around the world and the demand for a vacation on board continues to grow. Charters are attractive to individuals seeking a relaxing escape, an adventure-filled trip, or quality time with loved ones, all in the most stunning environment. By their very nature, yachts can travel all over the world, but the most popular charter locations are the summers in the Mediterranean and the winters in The Bahamas or the Caribbean. These regions are bursting with destinations to explore and IYC can create a bespoke itinerary for yachts of any size. In the summer of 2020, 32% of booked charters took place in France, closely followed by Greece; these picturesque yachting hubs continue to draw visitors for the culture, warm climate and beautiful sailing. In recent years, there have also been more and more clients seeking out off-thebeaten-track locations such as Southeast Asia, the Islands of Tahiti and Fiji. These areas are attracting adventure-seekers and diving enthusiasts and are well-worth considering as an option of where your yacht could be based. One of the main reasons that owners charter their yacht is to generate income that will offset a portion of the operational costs of the vessel. Additionally, while on the charter, the client will cover numerous expenses including the fuel, dockage, and utilities for the length of their stay. For US residents, there are also several tax incentives and deductions for owners who charter out their yachts, as you can classify the vessel as a business asset or as a second home. The benefit of owning a charter yacht

US TAX LAW INCENTIVES FOR YACHT OWNERS In 2017, the US passed the Tax Cuts and Jobs Act (TCJA), which was a beneficial tax reform for yacht owners and the yachting industry as a whole. The changes to the TCJA are in effect until 2022, therefore it’s vital for yacht owners (and potential owners) to take advantage of these benefits while they can. The potential change in the US Government means expected higher income tax rates for both ordinary income and capital gains, plus a potential increase in corporate tax rates.

DEDUCTIONS

There are three areas where the TCJA can be most

from the purchase of a vessel, as opposed to income

beneficial to yacht owners. If the owner of the yacht uses the vessel for “legitimate business purposes” and is registered as an entity (e.g. a corporation, a partnership or an LLC), the IRS considers the yacht as “listed property” and a business asset. The changes can provide prospective owners with more disposable income through reduced marginal rates, and are well worth considering when entering the charter market. Some of these benefits may also apply to foreign-flagged vessels. Please speak to your tax advisor to find out more.

BONUS DEPRECIATION The Act increased the bonus depreciation from 50% to 100%, with no dollar limit, for both new and used yachts operating in the charter business. This means that all applicable property and assets could potentially be written off in the year of purchase.

The nature of the US taxation systems means that you may be able to deduct state (or local) sales tax tax. This varies as a result of the owner’s place of residence. If owners classed their yachts as a second home (to qualify it must have a sleeping berth, a galley and a head), it may be possible to deduct the interest on the loan. The portion of the code allows homeowners to deduct interest on loans for their first and second homes. This deduction has a maximum of $750,000.

EXPENSES If you charter out your yacht for more than 50% of its usage (so that it qualifies as business-related), you are able to deduct 50% of the expenses associated with the vessel, including fuel, maintenance, mooring fees, insurance, storage and repairs. In addition to the personal safety assurances that cybersecurity can bring, the International Maritime Organisation (IMO) has introduced a resolution that came into force on 1 January, 2021, whereby yachts that adhere to the ISM Code – including commercial operations, vessels with more than 12 passengers, and yachts over 500GT – must now formally incorporate “an appropriate level of awareness of cyber risks” into their onboard safety and security. Further IMO guidance states that an ongoing training and awareness program is a crucial element of onboard and shoreside cyber risk management. Simultaneously, the United States Coast Guard has announced that from January 1, 2021, it will begin enforcing the universal requirement for a cybersecurity plan for all commercial yachts and ships over 500GT visiting US ports, regardless of flag. In the modern age, it is important to assess the yacht’s system and equipment to determine whether a yacht is vulnerable to cyber threats. The IYC management team works closely with cybersecurity experts and can advise both owners and crew on how to ensure their vessel is as secure as possible. From providing a Ship Security Assessment (including evaluation of onboard remote accessible equipment, key shipboard operations, current security measures and the identification of possible security threats) to implementing a comprehensive cybersecurity plan in the yacht’s safety management system, there are many efficient steps that IYC can help yachts to take to prevent malicious cyberattacks on board and enable owners and guests to relax and enjoy the finer pleasures of life aboard a superyacht.

WHAT ARE THE EFFECTIVE STRATEGIES FOR STRONG CYBERSECURITY? Noah Rubin, Manager at Stroz Friedberg, offers his advice. There are several steps you can take to improve your cybersecurity systems and mitigate the risk of cyber attacks: • Use good judgment and critical thinking when interacting online. Don’t click on links in emails or texts from unknown senders. Don’t accept friend requests or follow requests from users you don’t know. Don’t disclose personal information, including your whereabouts, on social media, or other public forums. • Use strong, complex passwords or passphrases and rotate them every 60 or 90 days. Consider using a password manager to generate strong, unique passwords for each website or app, especially financial accounts. • Always change default passwords for devices or systems on a yacht, including Wi-Fi networks. Refrain from logging in to any sensitive or financial accounts when using public Wi-Fi – for example at the marina. • Use multi-factor authentication (MFA) where available. MFA is a combination of something you have or are and something you know. For example, you would know your password, but you would also receive a text message or use an authenticator app for a secondary code to enter before you can access an account. • Practise a ‘need to know’ philosophy for disclosing sensitive or personal information, such as social security numbers and financial accounts. • Minimize the number of people who have the credentials to any systems that control the yacht’s operations and know how to reset them when the crew changes. • Be selective in websites or apps you grant permission to track your location or interact with your accounts on other sites. • Update software when it becomes available. This not only applies to personal devices like cell phones, tablets, and computers, but also to the software used to control yacht systems.
