1006 The magnificent group of orders and medals to Lieutenant Colonel Sir Thomas Bilbe Robinson, K.C.M.G., G.B.E., K.B., comprising: The Most Distinguished Order of St Michael and St George, Knight Commander’s star and neck badge, silvergilt and enamels; The Most Excellent Order of the British Empire, Knight Grand Cross’s star and badge, Britannia type; Knight Batchelor’s Badge, first type, silvergilt and enamels; British War Medal 191420 and Victory Medal (LT. COL. SIR. T.B. ROBINSON.); Coronation Medal 1902; Coronation Medal 1911; France: Legion d’Honneur, Officer’s badge; Italy: Order of the Crown, Companion’s badge; Belgium, Order of the Crown, Companion’s badge; mounted in a glazed case, mainly extremely fine or better. Thomas Bilbe Robinson was a British born Australian soldier, business magnate and public servant who is principally remembered for his outstanding achievements in securing supplies of meat for British and Commonwealth armed forces and civilians during the Great War. His entry in the Australian Dictionary of Biography refers to him as “the greatest export butcher the world has ever seen”, making him an unusual example of an officer to whom the epithet ‘butcher’ was not applied as a term of reproach. Born in Rotherhithe 25th November 1853, Thomas Bilbe Robinson emigrated to Queensland in 1881, becoming a Major in the Queensland Militia. In 1910 he was appointed Agent General for Queensland in London. Agent Generals represented Canadian and Australian state governments in London, being responsible, among other things, for promoting migration. Robinson was knighted at St James’ Palace, 7th July 1910. In 1913 he was appointed Knight Commander of the Order of St Michael and St George. Following the outbreak of war in 1914 the Board of Trade made him Director of Meat Supplies Allied Forces, in which capacity he guaranteed supplies of meat not only for soldiers at the front but for the British and Australian domestic market, of which the importance in time of war can scarcely be overstated. He is credited with securing control of the vital meatworks on the River Plate in South America, using his business acumen to foil the designs of American packers to exploit wartime shortages. On the 12th of July 1917 he received a temporary commission as LieutenantColonel in the Army Service Corps (without pay or allowances), and in the following month he was appointed Knight Commander of the Order of the British Empire. The Allied nations of France, Italy and Belgium recognised his services also, and he received royal authority to wear the distinctions mentioned above during the period 19171919. On the 5th June 1920, he was promoted in the Most Excellent Order of the British Empire, to Knight Grand Cross “[for] Services to [the] Board of Trade in connection with purchase and distribution of frozen meat for Allied Forces”. £2,5004,000

BIRDWOOD.); Delhi Durbar 1911, silver, unnamed as issued; mounted in a silver frame engraved with salient details of the recipient's career, medals all about extremely fine or better. Born 7th September 1879; attended Sandhurst; gazetted 2nd Lieutenant 27th July 1898; joined Indian Staff Corps 3rd November 1899; promoted Lieutenant 14th January 1901; served in the Tibet Expedition 190304; Promoted Captain 27th July 1907; Assistant Political Agent in the Persian Gulf; served with Indian Expeditionary Force 'D' in Mesopotamia and was killed in action at Basra 17th November 1914. The recipient came from a distinguished family of Indian Army officers, including his brother, Field Marshall Lord William Birdwood of Anzac. He served as assistant to the Gulf Resident Percy Cox from 1912, and BBM records only 14 Army recipients of the N.G.S. with this clasp, He was killed during the first phase of action of the Great War in the Gulf, an attack on Turkish forces near Fao at the mouth of the ShatelArab. The I.E.F. 'D' War Diary for this period notes only one action, successful but costly, as having taken place on the 17th November 1914: "….we advanced 9 miles up the right back, enemy was encountered….entrenched…strength about 4,500 with 12 guns, enemy made determined resistance, his left flank was turned and his entrenchments carried…. I much regret our heavy losses, due to our advance being over open level plain, without cover, and to heavy rain which made surface impossible for rapid movement of men or horses." £1,0001,500

A Great War pair to Private Alexander Hunter, Army Service Corps (formerly Black Watch): British War Medal 191420 and Victory Medal (DM2155162 PTE A. HUNTER A.S.C.), in a modern display frame with badges and a photograph, medals extremely fine and good very fine. An examination of the rolls appears to show that this man entered France on the 13th August 1914 as Private 2351 Royal Highlanders (Black Watch), was discharged 15th October 1915 as no longer fit for service, but was able to reenlist in the Army Service Corps.

1028 The historic 'Operation Nimrod' group of medals and memorabilia to Warrant Officer 2nd Class Ian White, Special Air Service and 17th/21st Lancers, who formed part of the team of S.A.S. men who stormed the Iranian Embassy in London on May 5th 1980 in a swift and decisive action that resolved a major hostage crisis. The Medals: General Service 19622007, clasp: Northern Ireland (24215027 TPR I.P. WHITE 17/21L.); South Atlantic, with rosette (24215027 CPL I P WHITE 17/21L (SAS)); Regular Army Long Service and Good Conduct, Elizabeth II (24215027 WO2 I P WHITE 17/21L); court mounted, nearly extremely fine. Accompanied by: Eighteen 19 x 24 mm press photographs, iconic images from the raid including S.A.S. teams abseiling down the rear of the embassy, others moving across the balconies, the staff sergeant leading ‘Team Red’ entangled in his abseil line with flames visible inside the embassy, and the detention of terrorist suspects; plans of the Embassy; a photograph of a recipient on a training exercise, having simulated an assault on a bus; a Daily Express special supplement, ‘Day of the S.A.S.’; a complimentary copy of ‘NOW’ magazine featuring the assault on the cover; a limited edition print depicting the raid, a copy of the recipient’s discharge certificate, and a souvenir Operation Nimrod ‘Joker’ card. The persecution of the Arab population of Iran's Khuzestan region by Ayatollah Khomeini (and his predecessors the Shahs) had inspired an implacable resistance movement which received support from Iraq under Saddam Hussein. The Arabs themselves were concerned with political and social rights. Hussein exploited this fact to manoeuvre against his rival the Ayatollah. Specifically, he believed that an attack staged in the West would draw attention to the plight of Khuzestan, and allow him to garner international approval for his planned invasion of Iran. With Iraqi backing, a six man team, the 'Group of the Martyr', occupied the embassy on the 30th April, taking 26 people hostage. The response was initially led by the police, but the S.A.S. acted immediately by deploying a team to the area in case their intervention was requested by the civil authorities. While they waited, they evolved a plan, and when, on the sixth day, a hostage was shot and his body thrown out of the embassy, the men of the Special Air Service went into action under the gaze of the television media. Within 17 minutes, the siege was at an end. Ian White was part of the team that entered the embassy from the roof. An explosive charge was lowered into a light well in the centre of the building and detonated as a distraction, and White's team abseiled into the lightwell to gain access through a window. During the descent, his secondary weapon, a Browning 9mm pistol, was lost owing to the notoriously poor quality holster with which the men were equipped. Nothing daunted, he continued from room to room, clearing each with 'flashbangs' and techniques perfected through rigorous training. He almost met with disaster while descending to a lower floor, as another team approaching the foot of his staircase directed submachinegun fire along the corridor into which he was about to step. He next encountered the well documented fire that had broken out owing to many of the curtains and carpets having been impregnated with accelerants. By sheer coincidence he had just completed a firefighting course, with the aim of posing undercover as an airport fireman, and this assisted him in temporarily controlling the blaze together with a colleague. The evacuation of the hostages involved forming a human chain to pass each one down the main staircase and out of the building to safety. White stood at the top of the chain, and such was the urgency of the situation that he resorted, effectively, to throwing them down the stairs. One of the terrorists concealed himself among the hostages, and because of the speed at which the S.A.S. were working at he was thrown down along with the rest of them. White saw in his hand a fragmentation grenade, and, unable to shoot down the stairs for fear of hitting a hostage, he and others shouted a warning to their colleagues below, who killed the terrorist before he could use it. All but one of the hostages alive at the start of the operation were rescued, and five of the six terrorists were killed the sixth being captured. The team next had the chance to watch the news footage of their work., They did so in the company of the Prime Minister Margaret Thatcher, for whom the operation had been a considerable publicity coup, foreshadowing her popular aggressive stance over the Falkland Islands (where White was also to be deployed), and demonstrating to the world that Britain was not the soft target that Saddam Hussein had imagined. Their work done, they returned to Hereford at high speed, and the rapidity and decisive efficiency of the S.A.S. action is underscored by the fact that when White arrived home his wife suffered an adverse reaction to the residue from the 'flashbangs' that he had been using, which lingered on his clothing. The embassy siege is well known, and rightly celebrated, as the point at which the S.A.S. became famous. Since its genesis during the Second World War it had maintained a low public profile, consistent with the discrete and sometimes clandestine nature of its methods. In May 1980 it sprang from obscurity onto the television screens and made an indelible impression on the public mind. But these events are important for other reasons. It was a notable tactical success, and in spite of what the modesty of White and others would suggest, this was by no means a foregone conclusion. Counter terrorism was an emerging form of warfare, and the success of Operation Nimrod was in contrast to a certain nearcontemporary actions which had ended very badly. It is revealing to note the various mishaps that occurred, some of which affected White directly; because none of them influenced the outcome of the mission. Problems that might well have resulted in failure were nullified by the professionalism of the S.A.S. It also confirmed, emphatically, the relevance of the S.A.S. in the postwar era. Prior to Operation Nimrod this had been called into doubt, and the regiment was threatened by budget cuts, and possible disbandment. After Nimrod its value was beyond dispute, and its future was secured. The recipient participated in the seminal S.A.S. action of the post war years, a major milestone in the history of the regiment and of special forces more generally making this group a truly historic acquisition for the collector. You know how well deserved." The question of slavery was central to the bitter and devastating conflict that raged between the United and the Confederate States of America between 1861 and 1865. The citizens and leaders of the Union were far from united in opposition to racial prejudice, though a tradition of ethically motivated abolitionism exercised considerable influence. The Union, under President Abraham Lincoln, was reluctant at first to make the emancipation of slaves a military objective, but there was a long standing Northern tradition of sheltering fugitive slaves (often in defiance of Federal law), and Union General Benjamin Butler was the first senior figure to honour this tradition in a military context. In May 1861 three slaves escaped to his lines in Virginia. The slaveholder, a Confederate officer, approached under a flag of truce, expecting Butler to relinquish the men under the terms of the Fugitive Slave Act of 1850 (a major source of contention between North and South). Butler rebuffed this officer and found a pragmatic way of resolving the uncertain status of the former slaves by designating them as 'Contraband of War'. His government gave retrospective sanction to this act, and in the months before the final promulgation of the Emancipation Proclamation in January 1863, many more 'Contrabands' made it across the lines to Union held territory. As the war progressed, and the realisation that a comprehensive defeat of the Confederate forces was the only way to end it, the partpragmatic and part ideological practice of recruiting freed African Americans as soldiers to defeat their former masters became ever more firmly established. This in turn lead to a growing realisation of their courage and fighting abilities. The notion of a link between military service and civil rights had been articulated by former slave and abolitionist leader Frederick Douglass in 1861 when he said “Who would be free must himself strike the blow” The medal’s Latin inscription, which translates as "Freedom will be theirs by the sword", confirms that – in Butler’s view at least – the recipients had been fighting for the rights of African Americans, and not merely for the interests of one white faction against another. The Battle of Chaffin's Farm and Newmarket Heights, September 29th and 30th 1864, was part of a broad strategic effort to overwhelm the extensive fortifications that protected the Confederate Capital of Richmond, Virginia. Like many battles of this war it involved infantrymen assaulting fixed defences and suffering terrible casualties to massed rifle and artillery fire. In the face of this horror the African American battalions under Butler's command acquitted themselves so valiantly that thirteen of their number won the Medal of Honour, and Butler who read the battlefield reports with great care was moved to commission this medal to honour an estimated 197 selected men. Struck at the Philadelphia Mint and mounted by Bigelow & Kennard of Boston, this medal is not only a rarity in absolute terms; it was in its day a radical innovation. Butler's memoirs indicate that he intended his medal to be partly based on the British Crimea Medal, although of course the Butler medal is a hybrid of campaign and gallantry award. ARMSTRONG 1813’; the gilt brass hilt comprising boat shell guard, fluted quillons and slender knuckle bow all with decorative moulding, pommel in the form of a helmet with a plume, wire bound grip with silver Turks heads, scarlet and silver fabric sword knot; gilt brass mounted leather scabbard, hilt c. 1830, blade possibly slightly earlier. Provenance: Lord Astor of Hever. The two men named, John Armstrong Junior and Henry Beekman, were father and son, and served in the American War of Independence and the War of 1812 respectively. Their family was joined by marriage to that of the Astors, and one of the principal Astor residences in the U.S., Rokeby, was originally that of the John Armstrong named on this sword. The hilt at least, however, appears to post date the service of both men. £250350

1244 Henry VIII of England: a rare and historically important gun shield. A convex circular shield, or target, composed of two layers of wooden strips laid at right angles, faced with two concentric tiers of eight ferrous plates each formed with a shallow tetrahedral peak and arranged around a large conical central boss, the joints between the plates covered with iron straps at the junctions of which are set eight smaller conical bosses, the rim covered by a further strap of domed section, straps and bosses fixed with cuprous headed iron nails, the upper plate of the inner tier with an aperture for a match lock pistol (not present), the inner face retaining the stubs of leather straps and with traces of fibrous matter and other residual indications of backing materials and fittings, diameter 52cm, 16th Century. Provenance: The collection of Charles Lees R.S.A. c. 18811; The Alexander MacMillan Welch collection; The Metropolitan Museum of Art Loan Exhibition 1931; through other hands to the current private collection. Shields of this type, fitted with matchlock pistols projecting through the upper half or through a central boss, are a peculiar feature of the armoury of King Henry VIII of England, and may be seen as a reflection of his flair for innovation as well as of his enthusiasm for armed combat. The principal primary evidence for the presence of gun shields in the royal armoury is an inventory taken at the time of the King’s death in 1547, which includes a reference to “targettes steeled wt gonnes XXXV” (targets steeled, with guns, 35)2 . A clue to their origin is found in a letter of 1544 from an Italian painter, Giovanni Batista of Ravenna, to Edmund Harvel (English Ambassador to Venice) in which the author offers to provide the King, among many other things, “round shields and arm pieces with guns inside that fire upon the enemy and pierce any armour”3. Modern scholaship4 has identified two main types of gun shield: those with the pistol projecting through a central boss, heavy, typically provided with a small grill for sighting, and of probably English manufacture; and those of lighter construction, with a gun mounted above the centre, and of probable Italian manufacture. It is in the latter and scarcer category that this shield belongs. The general type seems to have had a short lifespan in Europe. One source5 identifies a ‘latest known example’ produced in Germany 156070 (not a member of this group). Known examples of Henrician gun shields display considerable diversity in the details of their construction and decoration but a comparison of the shield offered here with examples held at the Tower of London, the Royal Collection at Windsor, and the Metropolitan Museum of Art, and elsewhere, confirms that it belongs to same group and may therefore be attributed, as they are, to the armoury of Henry VIII. In particular the arrangement of the wooden strips, the configuration and colouration of the marks left by the fabric backing (now lacking)6, the small holes corresponding to the position of the serpentine (articulated match holder)7, the remains of the leather straps6, the form of the iron strapwork and of the nails that fix it8,5, and the remnants of fabric fringes found below the bases of the bosses9, all correspond perfectly to the attributes of other extant Henrician gun shields. The gun aperture has small peripheral holes for the attachment of an escutcheon (now missing) which are similar in their position to those of an example held at the Tower of London10, and the secondary conical bosses may be compared to those found on a central gun hole type held at the Metropolitan Museum of Art11. The marks left by the upholstery, are as already stated, a match to those on other examples, and in cases where this is found in a more complete state it has a red and yellow colour scheme12 that accords with a change in the livery of the Royal Household that occurred in 15444 It is also interesting to note that the damage to the central boss (perforations caused by a sharp object of square section – possibly a pike or halberd point) is remarkably similar to that seen on other pieces of armour at the Tower of London. These may be evidence of frivolous mishandling by custodians in an era before conservation was taken seriously. The total number of gun shields originally in the possession of the King is impossible to ascertain exactly, but was certainly less than one hundred13. A recent survey4 identified 46 (possibly 47) surviving examples, the overwhelming majority of which are held by museums. The last instances of a gun shield appearing at public auction appear to have occurred in the 1970s14, 15. We are delighted to offer for sale what is either the 47th or the 48th surviving example. It is an object of exceptional rarity in absolute terms, and its significance to arms and armour collectors is dramatically elevated by its direct association with one of the most warlike, extravagant, and charismatic kings in the history of the British Isles. 1) 2) 3) 4)

1327 The extremely rare and historically important Portuguese Marshall General’s uniform tailcoat attributed to General Sir William Carr Beresford, 1st Viscount Beresford, 1st Marquis of Campo Maior, the major original elements of heavy bullion embroidery and gilt brass buttons united by a later body and sleeves, the high collar, facings, cuffs, tail slit and pocket borders, and pocket flaps all profusely embroidered with laurel scrolls, artillery trophies on pockets, each button with five escutcheons forming a cross (a fundamental element of Portuguese royal heraldry) within a wreath, hook and eye fastenings, c.1816. In 1806, against the background of instability caused by the wars of Napoleonic France, the Portuguese army was restructured by a royal decree of 16th May, and a new hierarchy of general officer ranks was created. At its apex was the rank of Marshal General, reserved for the monarch, his heir and by special appointment a general officer selected to represent the throne as supreme commander of the Portuguese armed forces. From July 1809 this delegated royal authority was vested in Sir Arthur Wellesley (later Duke of Wellington), who had recently recommended Beresford for the post of Commander in Chief of the Portuguese army. Beresford carried out a series of far reaching and successful reforms of the Portuguese army and participated in many of the important actions of the Peninsular War. He was in command of the allied army that defeated the French under Marshal Soult at the bloody battle of Albuhera, 16th May 1811. In 1816 he succeeded Wellington in the post of Marshal General, continuing to play a role in Portuguese military and political affairs until he was ousted from his position by the Liberal Revolution of 1820. Although two further appointments to the position of Marshal General were made in the 1830s, the form of the uniform had by this time undergone certain alterations from that established in 18061. The uniforms of King João and his heir Prince Miguel are known not to have conformed to regulation types, often being far more elaborate2. Thus there were only two officers of this rank to whom the 1806 regulations would have applied: Wellington and Beresford. The Duke of Wellington’s coat is currently held at Apsley House, and so the only candidate for original ownership of this coat is Beresford. 1335 Great War Medical Interest: the remarkable journal and scrap books of Professor H. Alexis Thomson, C.M.G., F.R.C.S., M.D., comprising thirteen volumes of manuscript notes, telegrams, M/S correspondence, official forms, press cuttings, maps, and other material, all documenting this eminent Scottish surgeon's experiences in the Field and at home during the war. Already 51 at the outbreak of war, and a highly accomplished surgeon, he joined the R.A.M.C. in August 1914 and was attached to the 2nd Scottish General Hospital at Craigleith. As well as performing in his principal role as a surgeon, he exerted himself in the mobilization of resources on the home front, such as the organisation of Wemys Castle as a Naval hospital, as may be seen in correspondence with Lord and Lady Wemys. Other material relates to a visit to France in 1914 to inspect hospitals, and in June 1915, motivated by the belief that his expertise will be of most benefit if he is able to operate on soldiers as soon as possible after they receive their injuries, he returns to the continent as a Major to take charge of the surgical division at No. 25 General Hospital, B.E.F. The journals now begin to include detailed hand written notes on the cases that he saw, and the difficulties of treating war wounds in field conditions. Another entry describe a visit to the front line, where a enemy sniper is attempting to pierce the parapet of the trench by striking it with a succession of bullets at the same point of impact. He describes the case of a man with a serious leg injury, and his resistance to another surgeon advocating amputation at the hip. He frequently travels to treat the wounded, including a difficult car journey through fog. He is promoted to Senior Consultant to the 3rd Army BEF, with the rank of Colonel. As well as being a surgeon of formidable expertise and remarkably sound judgement in challenging cases, Thomson was the first surgeon to capture operations on film and use them in his teaching, and among the many important documents in this collection is his licence to practise cinematography. TERMS OF CONSIGNMENT FOR SELLERS
1 . Introduction. The following informative notes are intended to assist Buyers, particularly those inexperienced or new to our salerooms. All sales are conducted on our printed Conditions of Sale which are readily available for inspection and normally accompany catalogues. Our staff will be happy to help you if there is anything you do not fully understand.
1. Interpretation. In these Terms the words ‘you’, ‘yours’, etc. refer to the Seller and if the consignment of goods to us is made by an agent we assume that the Seller has authorised the consignment and that the consignor has the Seller’s authority to contract. Similarly the words ‘we’, ‘us’, etc. refer to the Auctioneers.
2. Agency. As auctioneers we usually contract as agents for the seller whose identity, for reasons of confidentiality, is not normally disclosed. Accordingly if you buy your primary contract is with the seller. 3. Estimates. Estimates are designed to help buyers gauge what sort of sum might be involved for the purchase of a particular lot. The lower estimate may represent the reserve price and certainly will not be below it. Estimates do not include the Buyer’s Premium or VAT (where chargeable). Estimates are prepared some time before the sale and may be altered by announcement before the sale. They are in no sense definitive. 4. The purchase price. The Buyer shall pay the hammer price together with a premium thereon of 25% plus VAT @20% (totalling 30% inclusive) on the first £500,000 and 12% plus VAT @20% (14.4% inclusive) thereafter. 5. VAT. (†) indicates that VAT at the current standard rate is payable by the purchaser on the hammer price as well as being an element in the buyer’s premium. This imposition of VAT is likely to be because the seller is registered for VAT within the European Union and is not operating the Dealers Margin Scheme or because VAT is due at 20% on importation into the UK. The omega symbol (Ω) indicates that the lot has been imported from outside the European Union and the present position is that these lots are liable to a reduced rate of VAT (5%) on the gross lot price (i.e. both the hammer price and the buyer’s premium). Lots which appear without either of the above symbols indicate that no VAT is payable on the hammer price. This is because such lots are sold using the Auctioneers’ Margin Scheme and it should be noted that the VAT included within the Premium is not recoverable as input tax. 6. We are, primarily, agents for the seller. We are dependent on information provided by the seller and whilst we may inspect lots and act reasonably in taking a general view about them we are normally unable to carry out a detailed or any examination of lots in order to ascertain their condition in the way in which it would be wise for a buyer to do. Intending buyers have ample opportunity for inspection of goods and, therefore, accept responsibility for inspecting and investigating lots in which they may be interested. Please note carefully the exclusion of liability for the condition of lots contained in the Conditions of Sale. Neither the seller nor we, as the auctioneers, accept any responsibility for their condition. In particular, mechanical objects of any age are not guaranteed to be in working order. However, in so far as we have examined the goods and make a representation about their condition, we shall be liable for any defect which that examination ought to have revealed to the auctioneer but which would not have been revealed to the buyer had the buyer examined the goods. Additionally, in specified circumstances lots misdescribed because they are ‘deliberate forgeries’ may be returned and repayment made. There is a 3 week time limit. (The expression ‘deliberate forgery’ is defined in our Conditions of Sale). 7. Electrical goods. These are sold as ‘antiques’ only and if bought for use must be checked over for compliance with safety regulations by a qualified electrician first. 8. Export of goods. Buyers intending to export goods should ascertain (a) whether an export licence is required for the goods to leave the U.K. and (b) whether there is any specific prohibition on importing the goods in question into the destination country because, e.g. they may contain prohibited materials such as ivory. Charges may be applicable for export licences. Ask us if you need help. The denial of any permit or licence shall not justify cancellation or rescission of the sale contract or any delay in payment. 9. Bidding. Bidders will be required to register before the sale commences and lots will be invoiced to the name and address on the registration form. Some form of identification will be required if you are unknown to us. Please enquire in advance about our arrangements for telephone bidding. 10. Commission bidding. Commission bids may be left with the auctioneers indicating the maximum amount to be bid excluding buyers’ premium. They will be executed as cheaply as possible having regard to the reserve (if any) and competing bids. If two buyers submit identical commission bids the auctioneers may prefer the first bid received. Please enquire in advance about our arrangements for the leaving of commission bids by telephone or fax.
2. Commission is charged to sellers at the following rates: 15% + VAT on each lot sold for up to £999, 10% + VAT on each lot realising £1,000 and above. 3. Removal costs. Items for sale must be consigned to the sale room by any stated deadline and at your expense. We may be able to assist you with this process but any liability incurred to a carrier for haulage charges is solely your responsibility. 4. Loss and damage waiver. We are not regulated by the FSA for the provision of insurance to clients. However, we for our own protection assume liability for property consigned to us at lower presale estimate. To justify accepting liability, we make a charge of 1.5% of the hammer price plus VAT or, if unsold, our mid estimate of the hammer price. If the owner of goods consigned instructs us in writing not to take such action, they then remain at owner’s risk unless and until the property in them passes to the Buyer or they are collected by or on behalf of the owner, and clause 4 is inapplicable. 5. Illustrations. The cost of any illustrations is borne by you. If we consider that the lot should be illustrated your permission will usually be asked first. The copyright in respect of such illustrations shall be the property of us, the auctioneers, as is the text of the catalogue. 6. Minimum bids and our discretion. Goods may be offered subject to a reserve agreed between us before the sale in accordance with clause 7. 7. We may sell lots below the reserve provided we account to you for the same sale proceeds as you would have received had the reserve been the hammer price. If you specifically give us ‘discretion’ we may accept a bid of up to 10% below the formal reserve. Reserves. (a) You are entitled to place prior to the auction a reserve on any lot consigned, being the minimum hammer price at which that lot may be sold. Reserves must be reasonable and we may decline to offer goods which in our opinion would be subject to an unreasonably high reserve (in which case goods carry the storage and insurance charges stipulated in these Terms of Consignment). (b) A reserve once set cannot be changed except with our consent. (c) Where a reserve has been placed only we may bid on your behalf and only up to the reserve (if any) and you may in no circumstances bid personally. 8. Electrical items. These are subject to detailed statutory safety controls. Where such items are accepted for sale you accept responsibility for the cost of testing by external contractors. Goods not certified as safe by an electrician (unless antiques) will not be accepted for sale. They must be removed at your expense on your being notified. We reserve the right to dispose of unsafe goods as refuse, at your expense. 9. Soft furnishings. The sale of soft furnishings is strictly regulated by statute law in the interests of fire safety. Goods found to infringe safety regulations will not be offered and must be removed at your expense. We reserve the right to dispose of unsafe goods as refuse, at your expense. The rights of disposal referred to in clause 8 and 9 are subject to the provisions of The Torts (Interference with Goods) Act 1977, Schedule 1, a copy of which is available for inspection on request. 10. Descriptions. Please assist us with accurate information as to the provenance etc. of goods where this is relevant. There is strict liability for the accuracy of descriptions under modern consumer legislation and in some circumstances responsibility lies with sellers if inaccuracies occur. We will assume that you have approved the catalogue description of your lots unless informed to the contrary. Where we are obliged to return the price to the buyer when the lot is a deliberate forgery under Condition 15 of the Conditions of Sale and we have accounted to you for the proceeds of sale you agree to reimburse us the sale proceeds. The liability to reimburse the sale proceeds shall not arise where you are acting reasonably and honestly and are unaware of the forgery but we are or ought to have been aware of it.
11. Methods of Payment. As a general rule any cheques tendered will need to be cleared before removal of the goods is permitted. Please discuss with our Office in advance of the sale if other methods of payment are envisaged (except cash).
11. Unsold and withdrawn items. If an item is unsold it may with your consent be re offered at a future sale. Where in our opinion an item is unsaleable you must collect such items from the saleroom promptly on being so informed. Otherwise, storage charges may be incurred. We reserve the right to charge for storage in these circumstances at a reasonable daily rate.
12. Collection and storage. Please note what the Conditions of Sale state about collection and storage. It is important that goods are paid for and collected promptly. Any delay may involve the buyer in paying storage charges.
12. Withdrawn and bought in items. These are liable to incur a charge of up to 10% plus VAT of the reserve or low estimate on being bought in or withdrawn after being catalogued.

13. Conditions of Sale. You agree that all goods will be sold on our Conditions of Sale. In particular you undertake that you have the right to sell the goods either as owner or agent for the owner. You undertake to compensate us and any buyer or third party for all losses liabilities and expenses incurred in respect of and as a result of any breach of this undertaking. 14. Authority to deduct commission and expenses and retain premium and interest. (a) You authorise us to deduct commission at the stated rate and all expenses incurred for your account from the hammer price and consent to our right to retain beneficially the premium paid by the buyer in accordance with our Conditions of Sale and any interest earned on the sale proceeds until the date of settlement. (b) You authorise us in our discretion to negotiate a sale by private treaty not later than the close of business on the day of the sale in the case of lots unsold at auction, in which case the same charges will be payable as if such lots had been sold at auction and so far as appropriate these terms apply.
3. INCREMENTS Bidding increments shall be at the auctioneer’s sole discretion. 4. THE PURCHASE PRICE The Buyer shall pay the hammer price together with a premium thereon of 25% plus VAT @20% (totalling 30% inclusive) on the first £500,000 and 12% plus VAT @20% (14.4% inclusive) thereafter. 5. VALUE ADDED TAX Value Added Tax on the hammer price is imposed by law on all items affixed with a † or Ω. Value Added Tax is charged at the appropriate rate prevailing by law at the date of sale and is payable by buyers of relevant lots. (Please refer to ‘Information for Buyers’ for a brief explanation of the VAT position). 6. PAYMENT
15. Warehousing. We disclaim all liability for goods delivered to our saleroom without sufficient sale instructions and reserve the right to make minimum warehousing charge of £2 per lot per day. Unsold lots are subject to the same charges if you do not remove them within a reasonable time of notification. If not removed within three weeks we reserve the right to sell them and defray charges from any net proceeds of sale or at your expense to consign them to the local authority for disposal.
(a) Immediately a lot is sold you will:
16. Settlement. Subject to our normal trading conditions, payment will be made by BACS or cheque 5 weeks after the sale unless the buyer has not paid for the goods. In this case no settlement will then be made but we will take your instructions in the light of our Conditions of Sale. You authorise any sums owed by you to us on other transactions to be deducted from the sale proceeds. You must note the liability to reimburse the proceeds of sale to us as under the circumstances provided for in Condition 10 above. You should therefore bear this potential liability in mind before parting with the proceeds of sale until the expiry of 28 days from the date of sale.
(c) In line with new legislation we reserve the right to investigate and identify the source of any funds received by us. The completion of the sale of a Lot will be postponed or cancelled at our discretion if further time is needed for investigation, or if you are in breach of your warranties as a buyer, or if we consider the sale to be unlawful or in any way cause liabilities or be detrimental to either Woolley and Wallis or the Seller.
CONDITIONS OF SALE
(b) You shall at your own risk and expense collect any lots that you have purchased and paid for from our premises not later than 3 working days following the day of the auction or upon the clearance of any cheque used for payment (if later) after which you shall be responsible for any collection, storage and insurance charges.
Woolley & Wallis Salisbury Salerooms Ltd carries on business with bidders, buyers and all those present in the auction room prior to or in connection with a sale on the following General Conditions and on such other terms, conditions and notices as may be referred to herein. 1. DEFINITIONS In these Conditions: (a) ‘auctioneer’ means Woolley & Wallis Salisbury Salerooms Ltd or its authorised auctioneer, as appropriate; (b) ‘deliberate forgery’ means an imitation made with the intention of deceiving as to authorship, origin, date, age, period, culture or source but which is unequivocally described in the catalogue as being the work of a particular creator and which at the date of the sale had a value materially less than it would have had if it had been in accordance with the description; (c) ‘hammer price’ means the level of bidding reached (at or above any reserve) when the auctioneer brings down the hammer; (d) ‘terms of consignment’ means the stipulated terms and rates of commission on which Woolley & Wallis Salisbury Salerooms Ltd accepts instructions from sellers or their agents; (e) ‘total amount due’ means the hammer price in respect of the lot sold together with any premium, Value Added Tax chargeable and any additional charges payable by a defaulting buyer under these Conditions; (f) ‘sale proceeds’ means the net amount due to the seller, being the hammer price of the lot sold less commission at the stated rate, Value Added Tax chargeable and any other amounts due to us by the seller in whatever capacity and however arising. (g) ‘‘You’, ‘Your’, etc. refer to the buyer as identified in Condition 2. (h) The singular includes the plural and vice versa as appropriate. 2. BIDDING PROCEDURES AND THE BUYER (a) Bidders are required to register their particulars before bidding and to satisfy any security arrangements before entering the auction room to view or bid; (b) the maker of the highest bid accepted by the auctioneer conducting the sale shall be the buyer at the hammer price and any dispute about a bid shall be settled at the auctioneer’s absolute discretion by reoffering the Lot during the course of the auction or otherwise. The auctioneer shall act reasonably in exercising this discretion. (c) Bidders shall be deemed to act as principals. (d) Our right to bid on behalf of the seller is expressly reserved up to the amount of any reserve and the right to refuse any bid is also reserved.
(i) give to us, if requested, proof of identity, and (ii) pay to us the total amount due in pounds sterling (b) Any payments by you to us may be applied by us towards any sums owing from you to us on any account whatever without regard to any directions of you or your agent, whether express or implied.
7. TITLE AND COLLECTION OF PURCHASES (a) The ownership of any Lots purchased shall not pass to you until you have made payment in full to us of the total amount due.
(c) No purchase may be collected and we shall not release any lot to you or your agent until it has been paid for. 8. REMEDIES FOR NONPAYMENT OR FAILURE TO COLLECT PURCHASES (a) If any Lot is not paid for in full and taken away in accordance with these Conditions or if there is any other breach of these Conditions, we, as agent for the seller and on our own behalf, shall at our absolute discretion and without prejudice to any other rights we may have, be entitled to exercise one or more of the following rights and remedies: (i) to proceed against you for damages for breach of contract; (ii) to rescind the sale of that lot and/or any other lots sold by us to you; (iii) to resell the lot (by auction or private treaty) in which case you shall be responsible for any resulting deficiency in the total amount due (after crediting any part payment and adding any resale costs). Any surplus so arising shall belong to the seller; (iv) to remove, store and insure the lot at your expense and, in the case of storage, either at our premises or elsewhere; (v) to charge interest at a rate not exceeding 1.5% per month on the total amount due to the extent it remains unpaid for more than 3 working days after the sale; (vi) to retain that or any other lot sold to you until you pay the total amount due; (vii) to reject or ignore bids from you or your agent at future auctions or to impose conditions before any such bids shall be accepted; (viii) to apply any proceeds of sale of other Lots due or in future becoming due to you towards the settlement of the total amount due and to exercise a lien (that is a right to retain possession of any of your property in our possession for any purpose until the debt due is satisfied. (b) We shall, as agent for the seller and on our own behalf pursue these rights and remedies only so far as is reasonable to make appropriate recovery in respect of breach of these conditions 9. THIRD PARTY LIABILITY All members of the public on our premises are there at their own risk and must note the layout of the accommodation and security arrangements. Accordingly neither the auctioneer nor our employees or agents shall incur liability for death or personal injury (except as required by law by reason of our negligence) or similarly for the safety of the property of persons visiting prior to or at a sale.

10. COMMISSION BIDS Whilst prospective buyers are strongly advised to attend the auction and are always responsible for any decision to bid for a particular lot and shall be assumed to have carefully inspected and satisfied themselves as to its condition, we will if so instructed clearly and in writing execute bids on their behalf. Neither the auctioneer nor our employees or agents shall be responsible for any failure to do so save where such failure is unreasonable. Where two or more commission bids at the same level are recorded we reserve the right in our absolute discretion to prefer the first bid so made. 11. WARRANTY OF TITLE AND AVAILABILITY The seller warrants to the auctioneer and you that the seller is the true owner of the property consigned or is properly authorised by the true owner to consign it for sale and is able to transfer good and marketable title to the property free from any third party claims. 12. AGENCY The auctioneer normally acts as agent only and disclaims any responsibility for default by sellers or buyers. 13. TERMS OF SALE The seller acknowledges that lots are sold subject to the stipulations of these Conditions in their entirety and on the Terms of Consignment as notified to the consignor at the time of the entry of the lot. 14. DESCRIPTIONS AND CONDITION (a) Whilst we seek to describe lots accurately, it may be impractical for us to carry out exhaustive due diligence on each lot. Prospective buyers are given ample opportunities to view and inspect before any sale and they (and any independent experts on their behalf) must satisfy themselves as to the accuracy of any description applied to a lot. Prospective buyers also bid on the understanding that, inevitably, representations or statements by us as to authorship, genuineness, origin, date, age, provenance, condition or estimated selling price involve matters of opinion. We undertake that any such opinion shall be honestly and reasonably held and accept liability for opinions given negligently or fraudulently. Subject to the foregoing neither we the auctioneer nor our employees or agents nor the seller accept liability for the correctness of such opinions and all conditions and warranties, whether relating to description, condition or quality of lots, express, implied or statutory, are hereby excluded. This Condition is subject to the next following Condition concerning deliberate forgeries and applies save as provided for in paragraph 6 ‘information to buyers’.
22. Prior written consent must be sought by the buyer or any other party for the use of any images, illustrations and written materials produced by or for Woolley & Wallis relating to a lot or sale, including the contents of a catalogue. Copyright for any of the aforementioned will remain the property of Woolley & Wallis, subject to the provisions of the Copyright, Designs and Patents Act 1988. Woolley & Wallis and the seller make no representations or warranties that the buyer of a lot will acquire any copyright or other reproduction rights to it. PAINTINGS, DRAWINGS, LITHOGRAPHS, ENGRAVINGS AND PRINTS In accordance with long standing practice in Fine Art Sale Rooms certain terms used in descriptions in the Catalogue have the meanings ascribed to them in the glossary below. GLOSSARY Any statement as to authorship, attribution, origin, date, age, provenance and condition is a statement of opinion and is not to be taken as a statement of fact. The Company reserves the right, in forming their opinion, to consult and rely upon any expect or authority considered by them to be reliable. (a) Edward Lear: In our opinion a work by the artist. (When the artist’s forename(s) is not known, a series of asterisks, followed by the surname of the artist, whether preceded by an initial or not, indicates that in our opinion the work is by the artist named. 15. FORGERIES
(j) Dimensions are given height before width.
Notwithstanding the preceding Condition, any lot which proves to be a deliberate forgery (as defined) may be returned to us by you within 21 days of the auction provided it is in the same condition as when bought, and is accompanied by particulars identifying it from the relevant catalogue description and a written statement of defects. If we are satisfied from the evidence presented that the lot is a deliberate forgery we shall refund the money paid by you for the lot including any buyer’s premium provided that (1) if the catalogue description reflected the accepted view of scholars and experts as at the date of sale or (2) you personally are not able to transfer a good and marketable title to us, you shall have no rights under this condition. The right of return provided by this Condition is additional to any right or remedy provided by law or by these Conditions of Sale.
(k) Pictures are framed unless otherwise stated. BOOK AUCTIONS
GENERAL
If, on collation, any named item in this catalogue proves defective in text or illustration, the lot may be returned within 14 days of the sale with the defects stated in writing. This proviso shall not apply to defects stated in the catalogue or announced at the time of sale; nor to the absence of blanks, half titles, tissue guards or advertisements, damage in respect of bindings, stains, spotting, marginal tears or other defects not affecting completeness of text or illustration; nor to drawings, autographs, letters or manuscripts, signed photographs, music, atlases, maps or periodicals; nor to books not identified by title; nor to books sold not subject to return.
16. We shall have the right at our discretion, to refuse admission to our premises or attendance at our auctions by any person.
ARTIST’S RESALE RIGHT / DROIT DE SUITE
17. (a) Any right to compensation for losses liabilities and expenses incurred in respect of and as a result of any breach of these Conditions and any exclusions provided by them shall be available to the seller and/or the auctioneer as appropriate. (b) Such rights and exclusions shall extend to and be deemed to be for the benefit of employees and agents of the seller and/or the auctioneer who may themselves enforce them.
Droit de Suite is a royalty payable to a qualifying artist or the artist’s heirs each time a work is resold during the artist’s lifetime and up to a period of 70 years after the artist’s death. Royalties are calculated on a sliding percentage scale based on the hammer price excluding the buyer’s premium. The royalty does not apply to lots selling below the sterling equivalent of €1,000 and the maximum royalty payable on any single lot is the sterling equivalent of €10,000.
18. Any notice to any buyer, seller, bidder or viewer may be given by first class mail or Swiftmail in which case it shall be deemed to have been received by the addressee 48 hours after posting.
Droit de Suite, which is not subject to VAT, will be added to the buyer’s purchase price and then passed on to the relevant collecting agency by the auctioneer.
19. Special terms may be used in catalogue descriptions of particular classes of items in which case the descriptions must be interpreted in accordance with any glossary appearing in the catalogue.

Any indulgence extended to bidders buyers or sellers by us notwithstanding the strict terms of these Conditions or of the Terms of Consignment shall affect the position at the relevant time only and in respect of that particular concession only; in all other respects these Conditions shall be construed as having full force and effect. 21. English law applies to the interpretation of these Conditions.
