If we are forced to make significant change, we will pay you compensation on the scale set out in E. above (except where the significant change or cancellation is made as a result of unusual or unforeseeable circumstances beyond our control, the consequences of which we could not have avoided even with all due care which includes, but is not limited to, events listed below under “Force Majeure”). Please note that no compensation is payable regarding a minor change and in all cases we do not accept responsibilities for any cost incurred as a result of any change. Please note that if your Final Balance is not paid by the correct date for any reason you will not be entitled to compensation. 2 “Force Majeure” means circumstances such as war or threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions and all similar events outside our control. In these circumstances, we cannot offer compensation or refund, for any cost incurred by you where the company is forced to cancel, delay, curtail or change your course in any way, or where the performance or prompt performance of our contract with you is prevented or affected. H. Our Liability 1 T he company accepts responsibility for the service which it provides. Many services included in your overall programme provision such as the services provided by the site, coach companies or other transport operators are provided and performed by organisations over whom Travel Class has no direct control. However, the company accepts responsibility for providing all the various parts of your holiday to a reasonable standard and the company has done its best to ensure that the services provided by its various suppliers are efficiently supplied and are of a reasonable standard. The company accepts the responsibility for acts and/or omissions of its employees, agents, subcontractors and suppliers provided they were at the time acting within the scope of or in the programme of their employment agency or contract of supply. This acceptance of liability does not apply where the term and definition of “Force Majeure” as defined in these conditions occurs. In all cases where personal injury, illness or death occurs, the company’s liability is limited to the programme price (excluding insurance premiums and any alteration/amendment charges) of the person(s)

affected in total. 2 T he company also accepts responsibility for the death, injury or illness of any member of the party which occurs as a result of failure to perform or improper performance of any part of our contract with you by any of the company’s employees, agents or subcontractors, provided they were at the time acting within the scope of or in the programme of their employment, agency or contract of supply, with the exception that the failure to perform or improper performance was due to your own acts and/or omissions, or those of any third party not connected with the provision of your trip arrangements and which were unforeseeable and unavoidable, or an event which either ourselves or the suppliers of the service(s) could not have foreseen or forestalled even with all due care. As far as sea carriage is concerned the company’s liability is limited as if we were carriers within the appropriate national convention. Our acceptance of this liability is conditional upon your notifying us in writing within 28 days of your return from your programme, and where any payment is made to you or a member of your party by us or our insurers, we reserve the right to claim against any third party responsible. It is also a condition that the person(s) in receipt of such payment will assign to ourselves or our insurers any rights they may have to claim against any third party. You must also agree to give ourselves or our insurers your full co-operation. 3 Should you or any member of your party suffer illness, injury or death during the period of your programme by misadventure arising from any activity which does not form part of the services we are contracted to provide, we shall do our best at our absolute discretion to give assistance, guidance and financial assistance, where appropriate, up to a limit per booking of £5,000 cost to ourselves. I. Complaints Procedure 1 If there is a problem during the programme, the party leader should speak immediately to the Centre Manager who will probably be able to resolve it. 2 If the problem cannot be resolved in the resort during the course, the Party Leader should write to the company with full details on his/her return within seven days. 3 Disputes arising out of, or in connection with, this contract which cannot be amicably settled may be referred to arbitration, if the customer so wishes, under a special Scheme arranged by the Association of British Travel Agents, and administered independently by the Chartered Institute of Arbitrators. The scheme provides for a simple and inexpensive method of arbitration on documents alone with restricted liability on the customers in respect of costs. Full details will be provided on request or can be obtained from the ABTA website (www.abta.com).

The Scheme does not apply claims for an amount greater than £5,000 per person. There is also a limit of £25,000 per booking form. Neither does it apply to claims, which are solely in respect of physical injury or illness or their consequences. The Scheme can however deal with compensation claims, which include an element of minor injury or illness subject to a limit of £1,000 on the amount the arbitrator can award per person in respect of this element. The application for arbitration and Statement of Claim must be received by the Chartered Institute of Arbitrators within nine months of the date of return. Outside this time limit arbitration under the Scheme may still be available if the company agrees, but the ABTA Code does not require such agreement. J. The Party Leader’s Responsibility 1 T he Party Leader should ensure that all party members observe all laws and customs at all times. 2 T he Party Leader is in loco parentis and should at all times be responsible for the party’s welfare and the good behaviour of the party towards property and other people and to ensure that party members should be acting reasonably at all times. He/she should ensure that any damage caused by any member of his party is paid for immediately at the centre. He/she should ensure adequate supervision of party members at all times. 3 The company reserves the right in its absolute discretion to cancel a course at any time should the representative of the company or member of the senior management of the company or other agent/supplier/carrier/owner or manager of the locations or accommodations or other person in authority consider that the behaviour of the party is unacceptable. The responsibility of the company for the party and its expenses will then end. No compensation payments will be considered. Full cancellation charges will be applied and no refund will be given. Furthermore, we will not be responsible for any cost incurred as a result. K. Brochure Accuracy The company has endeavoured to provide accurate information in our literature at publication. However there may be circumstances out of the Company’s control where certain facilities are unavailable or out of operation. The company cannot foresee such circumstances but will make Party Leaders aware of any changes necessary in arrangements as soon as is possible. This contract is subject to the exclusive jurisdiction of the Courts of England. Please note that all programmes are samples only and some photographs are general activity shots. Class Adventure reserves the right to change any activity at its discretion. Watersports will generally commence mid April; weather permitting. All bookings are subject to these Booking Conditions.
