When you get a ticket, you have 3 options. And you must decide within 30 days of getting the ticket which option you are going to choose. Your 3 options are the following:
1. Pay it and take the points 2. Pay it and elect to attend traffic school 3. Fight the ticket

Here's an explanation of those options. 1. Pay it and get points - This is always a bad option. You are giving up and admitting to the violation. By taking points you are risking an increase in your insurance by 30%-40% for up to 3 years. 2. Pay it and attend traffic school - By electing traffic school, you are basically admitting to the offense, and will end up paying the full price of the ticket AND pay for traffic school AND waste 4, 8, or 12 hours of your life. Additionally, you are creating a record by doing this which can be seen by your insurance company. 3. Fight the ticket - Fighting a ticket is the ONLY way to give yourself a shot at getting the ticket dismissed and keeping your driving record clean. If your case does not get dismissed, you will probably wind up having to pay court costs, but you will not have to pay for the ticket AND pay court costs. You will just have to pay court costs.

Court costs are one of the most frustrating things for people to understand. There are basically 4 factors that determine the amount of your court costs.
1.
Your driving history
2.
They type of ticket
3.
Your attitude towards the officer who pulled you over
4.
The judge hearing your case

Your driving history is one of the biggest things that can determine the amount of your court costs.
THE BETTER YOUR DRIVING RECORD, THE LESS YOU WILL PAY IN COURT COSTS. Helpful Hint- Your driving record only comes into play once it's established that the judge isn't going to dismiss your case. You can have a terrible driving record, but if you fight your ticket and the proper legal motion is made and granted, the case will be dismissed and no one will see your disastrous driving history. (That’s another reason to fight all your tickets)

The type of traffic ticket you received can greatly influence the amount you pay Certain violations like speeding in a school zone are much worse than making a right turn on red.
Even speeding tickets vary in severity. Going nine miles over is clearly not as bad as going 39 over.
(This is common sense and should be no surprise to anyone) Š2011 All Rights Reserved * Unger and Kowitt * Cannot be copied or reproduced without written permission from Barry D. Kowitt or Kevin M. Unger * www.ungerandkowitt.com * 954-370-9999
Your attitude towards the police officer who wrote you the ticket makes a HUGE DIFFERENCE. The judge will absolutely punish you more severely if you say anything inappropriate to the police officer Please bite your tongue and fight the urge to tell the officer how you really feel It will save you money in the long run. The judge or magistrate that hears your case has the final say when it comes to your court costs.
The judge is given great discretion on an appropriate punishment. This is why two people with identical violations, and identical records can wind up with two completely different results.

Why would you want to fight a ticket in the first place? (hint: your job may depend on it) An overhaul of Florida’s unemployment laws now gives employers the ability to challenge jobless benefits for former employees for their conduct outside the workplace. This new law will allow employers to deny benefits to former employees based on their personal driving history, not just their work-related driving history. In other words, a company can now deny benefits for receiving a traffic ticket in your personal time.
This makes fighting a traffic ticket more important than ever

We hope you now understand the benefits of fighting your ticket, as opposed to your other options. If you choose to fight your ticket, you can either fight it yourself or hire an attorney. If you want to try and fight it yourself, please know that it's not as easy as it looks.
But here’s some helpful tips for you. Š2011 All Rights Reserved * Unger and Kowitt * Cannot be copied or reproduced without written permission from Barry D. Kowitt or Kevin M. Unger * www.ungerandkowitt.com * 954-370-9999
Here are 3 HUGE mistakes people make in traffic court. • Failing to Prepare • Failing to Listen • Talking too Much ©2011 All Rights Reserved * Unger and Kowitt * Cannot be copied or reproduced without written permission from Barry D. Kowitt or Kevin M. Unger * www.ungerandkowitt.com * 954-370-9999
WITHOUT QUESTION the single biggest mistake people make when they try and beat a traffic ticket in court, is
FAILING TO PREPARE for their trial. Š2011 All Rights Reserved * Unger and Kowitt * Cannot be copied or reproduced without written permission from Barry D. Kowitt or Kevin M. Unger * www.ungerandkowitt.com * 954-370-9999
To be prepared, the first thing you must know is that in Florida, the state has the burden of proving the case against you. If they can't do that, the matter will be DISMISSED. Make sure you read the statute before your trial. Š2011 All Rights Reserved * Unger and Kowitt * Cannot be copied or reproduced without written permission from Barry D. Kowitt or Kevin M. When someone else’s case is being discussed. . .LISTEN! If an attorney is talking, the chances are pretty high that he or she is talking about the exact same type of case you have. What a great opportunity to pick up some "free legal advice" about your case. Listen, listen, listen, and when it's finally your turn to speak. . . whatever you do, DON'T TALK TOO MUCH. Do not waste time by telling the judge anything that is not 100% relevant to your case. More often than not, people who keep talking, end up convincing the judge to find them guilty.

If all this seems too intimidating, or if you feel like you want to hire an attorney, please note, that not all attorneys are alike. You must ask questions BEFORE you hire an attorney. Don't wait until after the money changes hands before you think of things to ask. Here's 5 questions you must ask BEFORE you hire an attorney for your traffic ticket. (with some bonus material thrown in)
1. How long have you been fighting traffic tickets? 2. How many traffic tickets have you done? 3. What's this going to cost? 4. Do you guarantee anything? 5. Who will actually appear in court on my behalf and what does that person know about my case? How long a person has been practicing law in a specific area is very important But length of time is only part of the equation Experience comes not only from the number of years practiced, but more importantly, in the number of citations defended. In many ways, that is the more important number. Don't be fooled by only asking one question about experience. BOTH ARE IMPORTANT!!!

How much is it going to cost? Is the price you are being asked to pay the same that was quoted on the phone or from the advertisement you saw? Here's a tip, many attorneys use bait and switch to get you to call them.
They advertise one fee on the brochure they mail you, and when you call to inquire about hiring them, they quote you another fee. (Consider yourself warned) Š2011 All Rights Reserved * Unger and Kowitt * Cannot be copied or reproduced without written permission from Barry D. Kowitt or Kevin M. Unger * www.ungerandkowitt.com * 954-370-9999
In addition to the cost, you should find out if there will be a money back guarantee.
Many attorneys make a guarantee of no points or your money back, but not all guarantees are equal. Make sure you ask what the guarantee is before you spend your money. Finally, make sure it is written in a way that you understand what it is you are signing. (that should go for anything you sign)

Lastly, you should ask who will actually appear on your behalf in court AND how much that attorney will know about your case.
Here's another tip There are 4 courthouses that handle traffic tickets in Broward County (and many more in Dade and Palm Beach County). It is impossible for one attorney to cover all of them at the same time. Almost all attorneys hire other attorneys to cover the cases they can't attend. Make sure you are satisfied with whoever will be defending you. Don’t be afraid to ask before hiring anyone, “Who will handle the case if the attorney I’m hiring can not appear in court?” Make sure you are satisfied with the answer ©2011 All Rights Reserved * Unger and Kowitt * Cannot be copied or reproduced without written permission from Barry D.
