Wasson.”, history inscribed on verso stretcher and frame Note: “Polly”, built in 1804 at Amesbury, MA, was the oldest coaster afloat at the time of her running ashore in 1891 at Fort McClary, Kittery Point, ME. This estate has a long and varied family tree incorporating families of Decatur, Mayo, Deyo, and more. Many of these items have been acquired through the world travels of various family members. 1406. YELLOW JADE SNUFF BOTTLE. China, 19th century. The stone of a pale yellow color having scattered white inclusions hand carved in flattened form while standing on a raised foot. Bottle is well hollowed and comes with a replacement stopper. SIZE: 2-1/4” h without stopper. The bottle carved in four sided form with recessed panels on each side, containing characters in shallow relief, the sides accented with mask and ring handles and stands on a raised foot rim. The lot made up of three wood examples including two with lacquered surface together with a pottery example finished in a Langyao glaze. SIZE: Pottery: 8” h, wood examples between 5-3/4” and 6-1/4” h. CARVED WOOD BEAD NECKLACE. China, 20th century. The beads of uniform size, each carved with a shou character and displays a wood pendant with openwork scrolling. SIZE: Approximately 33” l. Included is a cast iron footed censer in flattened form with archaistic design, a bronze statue of a standing figure mounted on a wood base, a bronze seal paste box with relief dragons, and a ovoid form polished bronze censer with four character Xuande mark. PEKING ENAMEL COVERED BOX. China, Qing Dynasty. The round box made in flattened form and hand painted on the cover with a woman on horseback along with two attendants. The underside with a six character Qianlong mark. SIZE: 4-1/4” dia. Lot 1416 1417. CELADON GLAZED COVERED BOX. Korea, Choson Dynasty. The box in a round flattened form, decorated on the cover with a pair of birds in a sunburst pattern surrounded by scrolling. SILK EMBROIDERED ROBE. China, early 20th century. On a blue silk ground, the robe is decorated with roundels of various figures within a landscape. The collar and seams accented with ruyi and fastened with gilded buttons. SIZE: 42” h x 54” across sleeves. 1419. LOT OF ASIAN PORCELAIN. 20th century and earlier. The lot consisting of a matched pair of Chinese blanc de chine libation cups decorated around the exterior with a scene of animals in a landscape and dragon above, all done in relief under a lightly applied glaze. Two similar porcelain bottle vases decorated with underglaze blue highlighted with Famille Rose enamels and gilt accents. Together with a Japanese Kutani covered koro with bracketed handles and painted with a dragon and phoenix. SIZE: Libation 6-1/2” l. Bottle vases 6-1/2’ h. Kutani 4-3/4” h. PROVENANCE: A most historical and important collection from the estate of Maria Decatur Mayo Deyo (Lila) Garnett of Kittery Point, Maine. The lot consisting of four porcelain lamps including a Ku form example with archaistic design, a rouleau form example with mask handles, and a pair in cylindrical form vases with applied white enamel. The lot consisting of two teapots including one with fitted basket, two creamers, Lot 1420 a covered sugar, and various cups and saucers. SIZE: Teapots 6-1/2” and 6” tall. CONDITION: Teapot with fitted basket very good, second teapot missing handle. One creamer with loss to spout, second creamer with staple repair to handle. Covered sugar very good. PAIR OF CARVED AGATE PHOENIXES. China, early 20th century. Each bird shown in standing pose with tail wrapped around feet and heads raised. Both come with fitted openwork stands accented with lingzhi. SIZE: 7-1/2” t with stands. 1424. SEATED BRONZE FIGURE. China, Ming Dynasty. The bronze depicting a woman seated with arm propped upon a raised knee. Traces of lacquer finish in areas along with spots of gilt highlights. Feathers are touched with blue and green pigment and a single line of script along right margin. SIZE: Sight: 41-1/2” x 22”. Bowl with small chips and hairline to rim. Platter with glaze loss around rim. Reticulated platters very good. Chestnut basket and underplate very good. TWO FRENCH CARRIAGE CLOCKS TOGETHER WITH A CRYSTAL REGULATOR SHELF CLOCK. Second half 19th century, France. The first brass carriage clock with repeater, the white enamel dial with Roman numeral chapter ring above a subsidiary dial with Arabic numerals. The dial additionally marked “TIFFANY & CO. FRANCE”. The eight day brass movement with time and strike winders striking on a gong. The case with beveled glass panels on all four sides and additionally a beveled window on top, the case raised on a molded plinth. Clock is accompanied by original leather traveling case, front protective door absent. The second a small brass carriage clock with turned brass carrying handle and rectangular brass corner brackets joined to a thin platform base raised on ball feet. Lot 1458 The four sides and glass panel on top all with beveled edge. The rear of the case with hinged door. Unsigned eight day brass movement, spring driven and time only. The enameled dial with Arabic numeral chapter ring, paint-decorated with floral garlands draped between the numbers and marked “BAILEY BANKS & BIDDLE CO. PHILADELPHIA” and additionally marked “FRANCE” beneath the numeral “6”. The third an oval French Crystal Regulator shelf clock, the embossed brass dial unmarked and back plate of movement with the maker’s mark of “S MARTI MADE IN FRANCE” and additionally stamped with the retailer’s mark “CALDWELL & CO PHILADELPHIA” and with the serial number “648539”. The spring driven eight day movement striking on a gong. The brass dial with Roman numeral chapter ring, time and strike apertures, and blued steel hands. The oval case with four curved glass plates with beveled edge. The clock is offered with original twin cylinder pendulum with one cylinder broken, the second cylinder empty. SIZE: First carriage clock: 5” h. Second carriage clock: 3-3/4” h. Regulator: 10-1/2” h x 7” w x 6-1/4” d. PROVENANCE: A most historical and important collection from the estate of Maria Decatur Mayo Deyo (Lila) Garnett of Kittery Point, Maine. CONDITION: First carriage clock having repeater mechanism is frozen and currently inoperable. Carrying handle with significant corrosion at juncture to case. The brass case also with areas of significant corrosion. Coil gong with corrosion. Upon inspection, movement appears to be cleaned and free of corrosion, although we do not believe it is operable. The second carriage clock’s beveled front plate with major diagonal fracture and loss of enamel upper right corner facing dial. Significant corrosion to case. Lesser corrosion present on movement. Movement needs cleaning and adjustment, currently inoperable. Crystal Regulator with incomplete pendulum as noted. The Roman numeral chapter ring with significant abrasion from over-cleaning; the numerals “IV” and “V” absent, others partially obliterated. Rarely does the opportunity come twice in a decade to represent a long and storied family in the sale of some of America’s historical treasures. The first cache of historical goods was sold in our February 4 & 5, 2010 auction and it represented the Armsden side of the Decatur family connection of Kittery Point, Maine. The collection included important books from George Washington’s library, letters written by George Washington, Thomas Jefferson, James Madison, Tobias Leer, and more; log books, and flags connected to the Storer/Decatur families, important silver, photographs, weapons, and hundreds of correspondence between family members. The star of the collection was the extraordinary and historically important Battle of Yorktown map which brought $1,150,000.

Century Tobias’s only son was Benjamin Lincoln Lear; President George Washington was Benjamin’s godfather. Another descendant represented in this family line is George Washington Storer; nephew of Colonel Tobias Lear. George Washington visited Portsmouth, New Hampshire twice, and on one of his visits he held the infant Storer and blessed him and his name became George Washington Storer in tribute. Washington only did this to two people, the aforementioned and Washington Irving. George Washington Storer was a career naval officer who was, in his final years, superintendent of the naval asylum and retired as a Commodore. A most important historical naval figure in this family is of course Stephen Decatur. Commodore Stephen Decatur, Jr. born January 1779, died March 1820. He was known for his heroism and great successes in both the War of 1812 and the Barbary Wars. He was the youngest man to reach the rank of Captain in the history of the US Navy. Commodore Stephen Decatur and his young wife Susan never produced children. Many of Stephen Decatur the future offspring from his siblings down through the generations would be named in honor of their illustrious ancestor. One of the future Stephen Decaturs, born in December 1814, was a lifelong career naval officer and attained the rank of Commodore on retirement after the Civil War.

Battle of Yorktown map Sold for $1,150,000 It is with great pleasure that we have been selected to sell important items from the Maria Decatur Mayo Deyo (Lila) Garnett estate. She was one of the original benefactors of the division of the original estate which produced this historic offering. The Garnett estate has roots in several important families, equally as significant, a lineage as the Armsden branch.

Vice Admiral Morton Lyndholm Deyo ( July 1, 1887–November 1, 1973). Deyo had a storied 38-year naval career starting with his graduation from the United States Naval Academy in 1911, and proceeding through to the Second World War and beyond.

A historical figure related to this family is that of Captain Tobias Lear (father of Colonel Tobias Lear). Captain Tobias Lear from Portsmouth, New Hampshire was, for several years during the American Revolution, superintendent of the Continental Yard at Langdon’s (now Badgers) Island in the Piscataqua River opposite Portsmouth, New Hampshire. He was responsible for the construction of the historic John Paul Jones Continental ship the “Ranger.” Captain Lear fathered two children; Mary Lear and Colonel Tobias Lear. Colonel Tobias Lear was born in 1762 in Portsmouth, New Hampshire and expired on October 11, 1816 in Washington, DC. He was personal secretary to President George Washington and also one of Washington’s best friends. rank of Lieutenant-Colonel, although he finished the War of 1812 as a Major. Decatur continued his career in the Navy, serving as Naval Store Keeper in the Brooklyn and Portsmouth Navy Yards. On April 8, 1829 President Andrew Jackson (an intimate friend of Decatur’s) appointed him Collector of the Customs for the District of Portsmouth, New Hampshire. Decatur was appointed Sutler to the Army at Fort Gibson, Arkansas in April of 1831 and died of typhoid fever on November 12, 1832.

After the landings at Normandy and assisting in the successful landings of the First U.S. Army in the Madeleine area as well as commanding a group of warships that blasted enemy strong points in the vicinity of Cherbourg, France he commanded task groups in the Pacific.

It was through this family connection that many of the items descended as John was Stephen’s brother and Stephen had no children. The family tree of this noted historical family is far more diverse than outlined above. The offering in this sale is represented by some of the above-mentioned individuals. A treasure trove and much more was rediscovered in the mid 20th Century when the family as a whole decided to sell an early barn on Kittery Point to one of its members. At the time the barn had served as a storage building for a vast amount of historical material that has been passed down through the generations. In cleaning out the barn, a significant archive of Tobias Lear papers and memorabilia was discovered and much, much more. The items were essentially divided up amongst the various existing branches of the family at that time; however, a copy of the exceedingly rare Dunlop version of the Declaration of Independence, also discovered in the same barn, had to be sold at the time because of its considerable value and to effect an equitable distribution.

Deyo was named to command Task Force 54, the bombardment group for the Okinawa invasion. Considered his crowning achievement in the Pacific was his command of gunfire and covering force for the assault on Iwo Jima and the occupation at the battle of Okinawa. For this service he was awarded the “Distinguished Service” medal. It was during this time his Flagship the “Tuscaloosa” was targeted by two Japanese kamikaze but was able to continue with the action after “splashing” them in their wake before harm could befall them. During the battle of Okinawa he was the last naval commander to form a battle line with battleships as they prepared to intercept the Japanese battleship “Yamato.” At the war’s end, he accepted the surrender of Japanese forces in the Pacific at Sasebo, Kyushu. He received his second Legion of Merit award in the form of a gold star in lieu of a second award of the Legion of Merit. After his death in 1973 his namesake lived on with the launching of the USS Deyo (DD 989) on March 31, 1979. It was the 27th Spruance class destroyer. It saw action in both the Persian Gulf wars and supported Desert Storm. The destroyer was decommissioned on November 6, 2003.

Stephen and Anne (Pine) Decatur had seven children. The most prominent being John Pine Decatur who was born on September 14, 1786. Siblings include Ann Pine (Decatur) McKnight Hurst (1776–1819), Commodore Stephen (1779–1820), John Pine (1781–1781), James Bruce (1782–1804), Elizabeth Josiah (1784– 1785), and Joseph Hill (ca. 1790–1802).

At the beginning of the Garnett estate we will sell important naval log books which come from the same source but from another branch of the Decatur family. (Lots 2055-2066)

John Pine Decatur was appointed a Master in the U.S. Navy on August 4, 1807 and married Maria Susanna Ten Ecyk on April 6, 1809. He resigned his commission at his wife’s behest on March 26, 1810.

Down through the years some of the artifacts had been identified by various generations of the Decatur family through small notes or word of mouth and in the presentation of the goods some of the items offered carry “family history.” We are extremely pleased to have the opportunity to present this exciting historical lot. In WWII in the early 1940s he was commander of Destroyer Squadron II and in 1944 he commanded the Western Operation Neptune Force “U” supporting the landing of the American First Army at Utah and Omaha beaches. It was for this navel gunfire support at Utah Beach in the Normandy invasion that he was awarded his first “Legion of Merit” medal from the President. It was on the ship “Tuscaloosa” (CA-37) that he coordinated the bombardment.

ICONIC AND EXCEEDINGLY RARE GOLD FREEDOM BOX, COMMODORE STEPHEN DECATUR FROM THE CITY OF NEW YORK, 1812. This important and historic American icon had been on display at the US Naval Academy Museum from 1940 until 2011. Gold Freedom boxes were used to confer honorary privileges on distinguished individuals which date from the mid-18th century. Freedom boxes in America presented by the City of New York were given to other notables such as General George Washington (1732-1799), Marquis de Lafayette (1757-1834), Baron von Steuben (1730-1794), Governor George Clinton (1739-1812) and Chief Justice John Jay (1745-1829). The box given to Commodore Decatur weights 100 grams, measures 3-1/2” x 1-7/8” x 3/4” with clipped corners, top engraved with leaf motif, bordered by hatching round edges and center scored with an arc pattern; same motif and pattern on bottom and sides. Inscribed inside the top cover: “THE CORPORATION OF THE CITY OF NEW YORK / TO COMR. STEPHEN DECATUR IN /TESTIMONY OF THE HIGH SENSE THEY ENTERTAIN / OF HIS VALOR & SKILL IN THE CAPTURE OF THE / BRITISH FRIGATE MACEDONIAN BY / THE U.S. FRIGATE UNITED STATES. OCTR. 25. 1812”. 1” x 4” x 2-3/8” red leather case, lined with white satin cloth, small silver unmarked medallion with clipped corners on top and paper and ink label glued on bottom reading “PROPERTY OF MRS. Freedom box is made and hallmarked by goldsmith JeanBaptiste Lizon (1757-1811), Paris. Box also has French proofs for 18k gold. Commodore Stephen Decatur (1779-1820) was a great naval leader and hero of the Barbary Wars and War of 1812. During his command of USS United States he captured HMS Macedonian, in the Atlantic west of the Canary Islands on October 25, 1812, in one of the major ship-to-ship actions of the War of 1812 against Great Britain. On December 4, 1812, he towed the captured ship into New York harbor amid tumultuous national jubilation over the spectacular victory. Decatur and his crew were lionized and received special praise from the President and Congress and many honors from Congress, states and cities. On December 17, 1812, the municipal authorities in New York City voted him “freedom of the city” recognized by a gold box and commissioned a life size portrait for city hall. On December 29, New York City gave a banquet in his honor. This box is pictured in a February 1982 article in Antiques Magazine titled “Gold and Silver Owned by Stephen Decatur, Jr” by J. S. Brown, pg 401 “The City of New York resolved on December 17, 1812 that the freedom of the city should be presented to Stephen Decatur in a gold box. The key to the city has since been lost, but the octagonal box that contained it, made in Paris in 1798. Both were given to Decatur at an elaborate dinner in his honor on December 29, 1812.” The inscription on the inside of the lid of the box acknowledges Decatur’s “valor and skill in the capture of the British Frigate Macedonian by the U.S. Frigate United States October 25, 1812.”

This is an extremely rare opportunity to own an American gold Freedom Box. We note only one previous sale of another and that was the John Jay box sold by Sotheby’s, June 26, 1991. A photocopy of Stephen Decatur’s hand written will dated 1874 and a photocopy of a typed version of Maria Decatur’s will dated 1892 accompanies this lot. CONDITION: Very fine. RONZE EGYPTIAN REVIVAL CANDLESTICK B FROM STEPHEN DECATUR FAMILY DESCENT, CAPTURED FROM HMS MACEDONIAN. Family legend states this early French bronze Egyptian Revival candlestick was taken as a souvenir after Decatur’s famous battle while in command of United States over HMS Macedonian during War of 1812. Elegant 7-1/2” bronze cylindrical candlestick is decorated with three Egyptian lionfaced figures of very similar design noted on ancient Egyptian art. Egyptian Revival architecture and decorative art began in earnest in France in the first quarter of the 19th century after Napoleon’s Egyptian campaigns, 1798-1801. SIZE: 7-1/2” x 3”. Of typical form, the swan’s neck pediment centering a cast brass displayed eagle finial flanked by brass ball and spire finials above the hinged door with églomisé panel depicting the battle between the frigate USS United States and the HMS Macedonian. The paint decorated wood dial with Roman numeral chapter ring within floral spandrels. The dial with time and strike apertures. GOLD SIGNET RING GIVEN TO COMMODORE STEPHEN DECATUR IN 1805 FROM THE BEY OF TUNIS UPON HIS SURRENDER OF TRIPOLI. Stephen Decatur became an international hero after his significant victory over the Barbary pirates in Tripoli, ending with the June 4, 1805 surrender to the United States. This signet ring is made of high karat gold with about a 3/4” Carnelian engraved with the seal of Hammuda Ibn Ali, ruler of Tunis from 1782 until his death September 15, 1814. In Alexander McKenzie’s text Life of Stephen Decatur..., 1846, pg 122 “At Naples, Decatur was praised and dubbed ‘Terror of the Foe’ by the local media. Upon hearing the news of their victory in Tripoli, Pope Pius the VII publicly declared that the United States, though in their Lot 2072 infancy, had done more to humble and humiliate the anti-Christian barbarians on the African coast in one night than all the European states had done for a long period of time.” It would be interesting to compare any of the official documents of surrender to see if they were sealed with this particular signet. This signet ring was such a prized possession of the Decatur family that a copy was made by Lila Mayo for and always worn by Admiral Morton L. Deyo. TWO 19th CENTURY ENGRAVINGS OF STEPHEN DECATUR INCLUDING RARE ENGRAVED PORTRAIT BY SAINT-MEMIN. 1) Charles Balthazar Julien Fevert de Saint-Memin (1770-1852) was a well known portrait engraver of prominent Americans including George Washington, Benjamin Franklin, Paul Revere and Thomas Jefferson which are done in identical style to the Stephen Decatur portrait profile. Saint-Memin fled France during the French Revolution and lived in the United States and produced his art between 1793-1814. His work is quite distinctive and after he returned to France he was the Director of the Musee des Beaux-Arts de Dijon until his death. This is a fine portrait in an old frame with ink inscription on reverse which notes “The property of Lila Mayo Garnett after my death signed Lila Deyo”. Housed in a 9-1/2” wooden frame, the double matted vignetted round image is 2-1/4”. 2) Housed in a 9” x 7” wooden frame, printed portrait of full standing Commodore Decatur on board ship holding telescope. GROUP OF STEPHEN DECATUR’S ENGRAVED CALLING CARDS ALONG WITH EARLY WAX SEALS AND CAMEO STICK PIN. There are forty original calling cards measuring about 3-1/4” x 2” engraved on vellum in extremely fine condition with a finely detailed vignette of “United States and Macedonian” after the battle with the Macedonian showing broken mast and United States with full sails and large American flag. Above the vignette is a ribbon with “DECATUR” and American flags on either side and an eagle above. There are also two cards printed on cardstock, one inscribed on reverse, “Tripoli’s Stephen Decatur’s book plate-die-owned by Aunt Decatur Wright”. Included in this lot are three wax seals of various detail, one stating it was “Garnett Crest”. There is a tiny about 1/2” silver mounted relief carved red stone cameo mounted on mourning card of Miss Decatur with inscription “For baby Mayo from his Aunt Maria. The pin brought by his grandfather after his first cruise...”. SIZE: All housed in a 3-1/2” x 2-1/2” x 1” box. 2076. RARE CIRCA 1820 ENGRAVING OF STEPHEN DECATUR, FRAME MADE FROM DECKING OF HIS FRIGATE “UNITED STATES”. Framed steel plate engraving “Commodore Stephen Decatur / Engraved by Henry Meyer from an original picture by John W. Jarvis”. Wood backing of frame is inscribed: “This picture was given to my mother by General Page of Norfolk, VA. The frame is made of the hatch (live oak) of the Frigate United States”. Signed “Maria Susannah Decatur Mayo”. The frame has beautiful grain taken from the deck of the ship that made Stephen Decatur famous when he captured HMS Macedonian in the War of 1812. Wood in frame is quite dense with beautiful grain, weighing over 13lbs. SIZE: 12” x 15”, exposed paper image. Overall:19-1/2” x 231/2”. “BARBARY PIRATE” FLINTLOCK PISTOL FROM STEPHEN DECATUR ESTATE. This gun is as classic a real “pirate pistol” you will find. Family legend holds this was a souvenir from the Barbary Coast wars and this gun is of that vintage (1790-1820). The gun overall measures 15-1/2” with 9-1/2” 54 caliber tapered barrel. The barrel has Turkish proofs with incised engraving with gold decoration. Gun is brass mounted. Lock, hammer and brass mounts are all engraved with arabesque design. Stock has relief carved moldings and gun has overall elegant lines. PROVENANCE: A most historical and important collection from the estate of Maria Decatur Mayo Deyo (Lila) Garnett of Kittery Point, Maine. CONDITION: Gun appears original, complete and “as found” with dark mixed patinas to brass and iron. PAIR OF FRENCH EMPIRE BRONZE DOLPHIN CANDELABRUM TAKEN BY CAPTAIN STEPHEN DECATUR AS PRIZE FROM THE FRENCH PRIVATEER “CROYABLE” WHEN CAPTURED BY CAPT DECATUR JULY 7, 1798 IN COMMAND OF US WARSHIP DELAWARE. Beautiful pair of 16” cast bronze candelabrum with detailed bases of dolphins with curled tails holding florally decorated, detachable double candleholders. Beautiful patina. This is among the prized Decatur family heirlooms, though there is no inscription, only family provenance. During the Quasi War, Captain Stephen Decatur was commanding US warship Delaware and captured a French privateer Croyable off Great Egg Harbor, New Jersey, July 7, 1798. The Croyable was the first American capture of this undeclared war. The Croyable had previously captured a Philadelphia merchant ship, Liberty and also had boarded the merchant ship Alexander Hamilton, whose captain had informed Captain Decatur of Croyable’s position. GOLD MEMORIAL PIN OF JULIET UPSHUR, 1800. Unusually large mourning pin with large area of braided hair on verso under glass bezel. The front has blue cobalt colored outer bezel with a central 1-1/2” tall oval on opalescent white material mounted with a large curl shaped like the letter “J”, with tiny brass wire decoration holding it in place with numerous small pearl-like white beads with an inset cobalt blue and pearl decorated monogram “LU”. The inner gold bezel is engraved “JULIET UPSHUR, AD 1800”. Pin is retained in a hinged red veneered casing. The Mayo line of this family is descended from Littleton Ushur (1758-1811). This is a well known Virginia family. Juliet Upshur (1784-1854) was born at “Vaucluse”, Northampton County, Virginia and died in Norfolk where she is buried. SIZE: 2-3/4” x 2-1/4”. PROVENANCE: A most historical and important collection from the estate of Maria Decatur Mayo Deyo (Lila) Garnett of Kittery Point, Maine. CONDITION: Fair to good overall. Gold bezel and mountings are fine, including T-bar pin. There are several breaks in the blue cobalt front bezel glass and one break in back bezel which is now retained by very old scotch tape. The white opal-colored central backing and bezel is Lot 2081 very good as its cover glass. One of the tiny wire loops that holds the hair in place has moved, as have a couple of the tiny pearl-like beads. Casing is intact with padded silk pillows, hinge is loose with worn, warped covers. 2082. RARE 1812 DATED NEW JERSEY STATE MILITARY APPOINTMENT TO LT. COLONEL JOHN PINE DECATUR, BROTHER OF COMMODORE STEPHEN DECATUR. Archivally mounted, measuring 15-1/2” x 11-3/4” fancy calligraphy document dated December 4, 1812 and signed by Aaron Ogden, Governor of New Jersey. John Pine Decatur (1786-1832). After the War of 1812, John stayed in the US military with the rank of Captain and worked as a sutler on the Western frontier until his death in 1832. Commodore Decatur had no children and all of his personal artifacts disseminated through his brother’s estate. GOLD MOURNING RING OF JOHN PINE DECATUR, SURVIVING BROTHER OF COMMODORE STEPHEN DECATUR. John Pine Decatur (1786-1832) like his brother served in the Navy, but died as an Army sutler at Ft. Gibson, Indian Territory, November 12, 1832. This small, well made gold ring has miniature cut-out gold logo/monogram “JPD” inserted over a section of Decatur’s hair mounted under bezeled glass or crystal dome. This was probably made for his widow Maria Susanna Ten Eyck Decatur (1789-1850). Since Stephen Decatur had no children, all of Commodore Decatur’s memorabilia and artifacts are from descent of his brother’s lineage. IMPORTANT JOHN PINE DECATUR INLAID MAHOGANY FEDERAL HUNT BOARD / BUTLER’S DESK. Circa 1810, Mid-Atlantic region. Rectangular top above the conforming case fitted with two simulated long drawers with hinged fronts opening to an interior fitted with an arrangement of valenced, blocked cubby holes, each with conforming drawer above centering a prospect door with inlaid oval fan patera opening to a bank of three blocked document drawers. To the right of the prospect door, the interior has been altered due to the later addition of a cupboard door on the proper left side of the case, which opens to a storage area. Beneath the butler’s desk section, are fitted three aligned short drawers with cockbeaded edges. The hunt board raised on four square tapered legs, each headed by an oval fan patera above string inlaid panels terminating in brass capped Marlborough feet. Accompanying the desk is a John P. Decatur calling card which was found in the desk. SIZE: 41” h x 54-1/2” w x 24-1/2” d. FINE TRAVELING CASED DECANTER SET. First half 19th century. The top hinged lid opens to reveal a compartmentalized sectioned interior holding six 9” h x 4” w x 2-1/2” d clear hand blown decanters with stoppers and two 7-1/2” h x 2-1/2” w x 2” d similar decanters. Also having two 4-1/2” h stemmed wines that fit sideways at the bottom underneath a compartment that holds two 3-1/2” tumblers. The case having its original key and has two brass bale handles for carrying. The top presentation plaque missing but a copy of John P. Decatur Lieutenant US Navy calling card is folded and included with the box. Family history notes that this tantalus was the property of John Pine Decatur 1786-1382, third generation Decatur. The second of John Holme, (1722-1808) a Scottish clergyman, dramatist and author. Portrait rendered with greying wavy hair dressed in an olive frock coat. Identification label affixed to back of frame. The third of “Bonny Prince Charlie”, grandson of James II, King of England (1720-1788), proper name of Charles Edward Louis Philip Casimir Stuart. Rendered with curled long brown hair, a tartan sash over right shoulder and with a tied linen scarf. Identification label affixed to back of frame. The fourth a bust portrait of Scottish poet Robert Burns (1759-1796). Rendered with wavy brown hair and dressed in what appears to be green tartan cape or sash around his shoulders. DEYO ARCHIVE INCLUDING HIS WWII ERA VISOR CAP, TWO-STAR ADMIRAL’S PENNANT, TWO 48-STAR FLAGS THOUGHT TO HAVE BEEN WITH DEYO WHEN COMMANDING THE U.S.S TUSCALOOSA DURING THE BOMBARDMENT OF NORMANDY ON D-DAY. The two American flags are both commercial. 1) Cotton, printed canton with 6 rows of 8 stars, 34” on hoist, 62” on fly. 2) Wool bunting, 55” on hoist with Sterling maker’s label, about 90” on fly, double appliqué machine sewn cotton stars. 3) Dress visor hat is labeled Vice Admiral internally which would date 1947 but construction is in style of WWII with wicker body. Interestingly there is an earlier visor with fewer acorns & oak leaves which may have been from WWII accompanying this lot. His pair of Vice Admiral 3-star shoulder boards are also included along with two lightweight midshipman’s caps in white and a blue one with Annapolis label, probably upon his graduation at Annapolis in 1911. 4) Rear Admiral’s pennant with two stars, 40” on hoist, 60” on fly. This would be flown from any vessel when the Admiral was on board such as Tuscaloosa during coordination of D-Day naval bombardment, of German positions on Omaha Beach ahead of Troops Landing. This may be the only identified Admiral’s flag with D-Day history. HISTORIC LOT OF FOUR MASSIVE HAND DRAWN AND PAINTED PLANNING MAPS USED BY ADMIRAL MORTON L. DEYO ABOARD THE USS TUSCALOOSA WHO WAS IN CHARGE OF THE NAVAL BOMBARDMENT ON D-DAY JUNE 6, 1944. Four maps in this archive include: 1) an overview of the British and French coast in one map, 2) view of the French beach with Utah Beachhead squared off 3) large map showing that section with pasted label “UTAH BEACH 6 JUNE 1944”. Details of mines, buoys and ship positions as they approach the beach are noted. 4) The most highly detailed map shows position of beach “Tare Green” and beach “Uncle Red” code names for two entry points on Utah Beach with exit positions shown going inland. What an important group of maps used on D-Day by the Admiral in charge of bombardment of German positions as British and American troops would start their invasion of France. WONDERFUL, HISTORIC WWII, MASSIVE SHIP’S LOG/SCRAPBOOK OF REAR ADMIRAL MORTON L. DEYO. This massive album measures 25” x 17-1/2” is mostly dis-bound between two boards with rope hinges. There are over 70 pages with many inserted photographs, maps, notes and miscellaneous ephemera. Pages consist of reused various US & German WWII military naval charts with hundreds of photographs tipped in, many with captions, some loose. Photographs of Deyo and other officers and men are part of archive. There is a list inset on two long pieces of paper listing of over 60 photographs obviously taken during battle. A few samples of list are as follows: Bombardment of Wake Island, October 5 & 6, Direct hit on Bougainville, November 8 & 9, Splash One Zeke during air attack off Philippines, September 21 & 22, 1944, Lot 2092 Bombardment of Iwo Jima, July 4 & 5, 1944, Aerial view of Okinawa, October 10, 1944, Houston survivors on USS Mobile October 14, 1944, Bombardment and seizure of Iwo Jima, February 18-22, 1945, Naval bombardment of invasion beaches, 0900-H-Hour, The first wave lands Iwo Jima, Shellholes and trenches on high ground overlooking the landing beaches. Military photographs are almost exclusively 8” x 10” and 5” x 7”’s and smallest format photographs are 4-1/2” x 3-1/2”. This is an interesting and unique album showing Deyo’s time upon the Santa Fe, 1944-1945 including photos of him at the surrender table at Sasebo. 2093. REAR ADMIRAL MORTON L. DEYO PRESIDENTIAL COMMISSIONS AND NAVAL ACADEMY DIPLOMA. Morton L. Deyo (1887-1973) was a lifelong naval officer and from a family of military men, his wife being a direct descent of John Pine Decatur, Commodore Stephen Decatur’s brother. This grouping of 8 large vellum documents starts with the United States Naval Academy Midshipman appointment signed by USNA Superintendent and 12 professors, showing completion of studies June 2, 1911. Document has beautiful naval vignettes and gold embossed seal. Seven Presidential Commissions chronicle his promotions starting with Ensign (William Taft, March 28, 1912), Lieutenant JG (Woodrow Wilson, January 25, 1916), Lieutenant (Woodrow Wilson, July 20, 1918), Lieutenant Commander (Warren G. Harding, December 21, 1922), Commander (Herbert Hoover, June 21, 1932), Captain (Franklin Roosevelt, July 21, 1939), and ending with Rear Admiral (Harry S. Truman, December 9, 1947). ARCHIVE OF ITEMS FROM VICEADMIRAL MORTON L. DEYO. This small archive of items were from the office and desk of Vice-Admiral Morton L. Deyo (1887-1973). They include desk nameplate “Vice- Admiral/Morton L Deyo, a 1948 presentation metal submarine model from the Portsmouth Naval Yard employees, a wooden cannon model measuring 15” overall on carriage with his name painted which appears to date probably at the time of his graduation from the U S Naval Academy in 1911. There Lot 2095 is also a framed 9” x 6” photograph of Deyo in uniform at the Academy, presentation silver and crystal mounted ashtray inscribed with his retirement date “May 7, 1953”, a sterling silver napkin ring inscribed “to Deyo” with the names of the 22 naval vessels he was assigned up to WWII, starting with his first service on the battleship “USS Virgina” and ending with the “USS Tuscaloosa” from where Deyo commanded troops during landing operations on D-Day. Also included in archive is a naval signal flag, and a couple of calling cards. Also included is a King George VI signed Distinguished Service Order to Rear Admiral Deyo, signed November 20, 1944, framed photograph of Eisenhower and Deyo, and several items concerning the commissioning of the destroyers “USS Decatur” and the “USS Deyo”. Presentation Sheffield box containing about 40 bronze tokens commemorating the christening of the “USS Deyo” at Pascagoula, Mississippi in 1979 and three souvenir hats from the christening. A 50” x 60” banner “USS Deyo DD-989”. A destroyer tie clip marked 59 and a small round pin “USS Deyo DD-989”. Presentation box (6” h x 17” l x 7” d) with christening bottle for the christening of Deyo (DD-989) March 31, 1979. 2096. PAIR OF CASED JAPANESE NIGHT VISION BINOCULARS WITH STAND. The fitted wooden case with front plaque in Japanese. During WWII the Japanese had technology better than the US and that their night vision binoculars were far superior so whenever a ship was captured or a chance to acquire these they were always taken. JAPANESE OFFICER’S SWORD GIVEN BY JAPANESE ADMIRAL SUGIYAMA TO REAR ADMIRAL MORTON L. DEYO, USN. Accompanying Japanese army officer mounted Katana (Samurai sword) along with vintage photograph of Admiral Deyo with Vice Admiral Sugiyama sitting at Lot 2096 table with other officers during the formal surrender of the Sasebo Naval Station while aboard the USS Santa Fe. There are several accompanying letters from Japanese sword experts translating the signature on tang “Province-Owari; Maker-MASATAKA”. There is no other provenance other than family history that the sword was obtained by Admiral Deyo at the Sasebo Surrender, September 21, 1945. 2098. IMPERIAL JAPANESE NAVAL DIRK. This was a souvenir from WWII of Vice-Admiral Morton L. Deyo. This is a traditional Japanese naval dirk with simulated ray skin grip, gilded brass mounts with traditional Sakura blossoms and thin tanto-style blade with fuller. 16” overall with 9” blade. PROVENANCE: A most historical and important collection from the estate of Maria Decatur Mayo Deyo (Lila) Garnett of Kittery Point, Maine. CONDITION: Good to very good overall. Exhibited: Corcoran Gallery of Art, “Works of Art from Collections in the Washington Area” Washington, D.C., 1952 Note: Colonel Cabell (1797-1869) was born at Union Hill, Virginia and attended William and Mary College. He inherited a large estate in Amherst County from his father. He married Mary Rice Garland in 1823 and was a member of the House of Delegates from 1837-1840. He was appointed to a federal position in the General Land Office in 1841 by President Tyler and chief clerk by President Fillmore. In this role, he became close to then senator Abraham Lincoln. Edward and Mary Cabell had seven children: William, David, Patrick, Edward, Jane, Mayo (died as Lot 2102 infant) and Paul. The portrait is listed in the Smithsonian American Art Museum Art Inventories Catalogue as IAP82400064 with attribution to George Cooke. In 1970, Judith E. Wise / painted by Chapman”. Note: Ann Elizabeth Jennings Wise (1808-1837) was the first wife of Virginia Governor Henry R. Wise, and daughter of the Reverend Obadiah Jennings. Tragically, in 1837, Anne and one of their children died in a fire, leaving Henry with four children: two sons and two daughters. The portrait of the two children was painted in 1833 and depicts their oldest daughter Mary, age 4 years and her brother Obadiah, age 2 ½ years. The portrait is listed in the Smithsonian American Art Museum Art Inventories Catalogue as IAP82400045 with no attribution. In 1970, Judith E. During the American Civil War, he was a general in the Confederate States Army. 2141. EXCAVATED STONE EGYPTIAN HEAD OF A KING. Characteristic of the Ptolemaic Period, late in pharaonic history. The classic head in weathered stone with a Nemes style headdress. It appears that there may have been something at the top front portion of the headdress, probably a uraeus cobra at the front with its two small coils over his forehead. A black wood plinth has been fashioned to receive the head for display purposes. Accompanying the piece are eight early photographs, many of which show Charles Dalton (husband of Ruth Deyo) holding the piece. There is an inventory number on the side “B9476 / 500”. It comes in its original carrying crate stamped “Property of Ruth and Charles Dalton.” Note: Ruth Lynda Deyo (1884-1960) was a successful concert pianist and traveled extensively during her career. We have tried to apply this same principle in preparing this ­particular sale. So that you might know what the limitations are for this sale, we have tried to clearly outline the conditions below, which will specifically ­indicate how various circumstances will be handled.

1. Guarantee We have attempted to make a consistent effort in cataloging and correctly describing the property to be sold. The catalog descriptions carry a limited guarantee. Please be sure that you know that. It is a guarantee to protect you against major discrepancies that would have a major effect upon the value of the item. Under no circumstances do we guarantee against anything less than a major discrepancy that would have less than a major effect upon value. This limited guarantee covers authenticity. It also covers any major restoration or repair not described. Also we guarantee against fakes, reproductions or major fabrications. As outlined above, our guarantee is limited, however, it is almost unique in a business that operates “Caveat Emptor”. This is not a perfect system, however, and it is important to be aware of that. Our i­ntention is to be as fair as possible in our catalog descriptions but it is virtually impossible to adequately describe an antique or collectible item that has been used and shows signs of wear. Imperfections, slight damages, handling marks, natural imperfections that are inherent with the manufacturing of the objects are the types of things that we absolutely do not guarantee against. Limit of Restitution Under no circumstances will the auctioneer be responsible for lost profits or other financial damages. Refunds requested on the grounds of authenticity must be accompanied by at least a supporting written statement from an authority ­recognized by the auctioneers. Auctioneer will not be responsible for shipping costs, after auction appraisal fees, testing or any other post auction costs. If it is agreed that an item may be 76

returned, it is the buyer’s responsibility to return it in the same condition as received. C. Type of Restitution An item that qualifies for an adjustment is limited to one of the following options: 1) Major problems, (i.e. fakes, significant alteration, major unannounced restoration, etc.) will result in a refund in sale price, adjustment in sale price or repair by the auctioneer. The auctioneer shall be the judge as to the final resolve. 2) Less than major problems or discrepancies are not part of the guarantee and no refund or adjustment will be considered for less than major problems. 2. Receipt of Goods All goods sold will be tagged and can be claimed upon presentation of paid receipts ONLY. All items to be wrapped will be wrapped by the purchaser, unless the items are to be shipped. 3. Protested Bids In case of a disputed bid, the Auctioneer is the sole determinant as to who is the successful bidder and at his d ­ iscretion may re-offer and resell the article in dispute. 4. Tax State of Maine sales tax is 5.5% and will be collected at time of payment unless a current sales tax certificate is on file or if shipped anywhere except Maine and Massachusetts. If purchases are shipped to a Maine address, sales tax of 5.5% shall be collected unless a current sales tax certificate is on file. If purchases are shipped or delivered to a Massachusetts address, sales tax of 6.25% shall be collected unless a current sales tax certificate is on file. 5. Nominal Bids The Auctioneer may reject nominal bids, small opening bids or very nominal advances made with purpose of ­disparaging an item. If a lot fails to open for 25% to 30% of the low estimate, the item may be passed from the block by the Auctioneer and may not be re-offered until a later sale. 6. Absentee Bids Phone, fax or mail bids will be accepted with a 20% deposit, late bids or last minute bids can be confirmed with a Visa, MasterCard, Discover or American Express number, in many cases. In such case, the bookkeeper will execute such bids competitively. It is entirely possible to buy items by absentee bid for less than your top bid price. Please Note: Absentee bids are a service provided


to our customers free of charge. Every effort is made to execute all absentee bids; however, you must know that this is not a perfect system neither here nor at any other auction house. In the event of an error of omission or failure to properly execute absentee bids, the auctioneer shall not be held liable. 7. Terms All items are to be paid for in American funds at the day of the auction. Non-residents who have not established an account with us and wish to pay by check, must do so prior to the beginning of the auction by presenting a current letter of reference from their bank or by providing references which are suitable to the auctioneer. Absentee Bidders - Directly after the auction a bill will be sent to you for the items you purchased and a total amount due. This bill is due upon presentation and must be paid immediately. The auctioneer reserves the right to hold merchandise purchased by personal check until the check has cleared the bank, if the auctioneer deems such action necessary to protect his interest. For bidders located outside of the United States we only accept payment by checks drawn on U.S. banks or wire transfer. 8. Interest and Default Payment is due upon receipt. If the buyer’s invoice is not paid in full within 15 days of the auction, James D. Julia, Inc. has the right and will charge the buyer’s credit card of record on file for the total invoice amount. Interest will be charged on all balances not paid at the rate of 1-1/2% monthly (18% APR) effective 15 days from the date of purchase/auction. All goods not retrieved by Buyer within 120 days after the last day of the auction, shall be subject to a storage fee of $50 per item per month. Buyer authorizes auctioneer to sell any goods not retrieved after the 120 day period in any manner deemed appropriate by the auctioneer and the proceeds will be applied to all sums owed by the buyer to the auctioneer under this or any other agreement between the parties. If the sale is conducted by the auctioneer, in addition to all sums due hereunder, buyer shall pay the auctioneer’s standard commission fees and 1% insurance fee. Buyer specifically authorizes any such sale to be held without reserve. Buyer shall be responsible for any deficiencies between the sale price and all sums due hereunder. 9. Reserves Some items in this auction may carry a conservative reserve. Therefore, the auctioneer may bid on behalf of the owner or for the auction house. The purchaser will be the highest bidder acknowledged by the auctioneer. Please note that when a lot carries a reserve, the reserve is usually somewhere below the low estimate in the catalog. Actual reserve figures cannot be divulged, but we will tell you if an item carries a reserve should you ask.

10. Withdrawal We reserve the right to withdraw any property before sale and shall have no liability whatsoever for such withdrawal. 11. Title A title passes upon the fall of the Auctioneer’s hammer. It will then be the responsibility of the buyer to make full payment prior to removing the goods from the premises. It is both the buyer’s risk and expense for removal and must be made at the conclusion of the sale unless other arrangements are made with the Julia’s Operations Manager. Please note any lots we might make arrangements for moving or storing are solely at the risk of the owner and any damage or loss occurring after the fall of the hammer becomes that of the buyer. 12. Phone Bids At the discretion of the auctioneer, phone bidding may be arranged on more expensive items, (i.e. $500 or more). In order to make arrangements to bid on the telephone at the time a lot is being sold, you must contact our office in advance of the auction. We will make arrangements to call you just prior to the lot being sold so that you may bid over the telephone. There are usually a limited number of phone lines available into the room, so if you wish to bid over the telephone, it is important for you to make your arrangements early. “Cover-me Bids”: if you wish to bid by telephone, you might also want to consider a “cover-me bid” at the time you make arrangements for phone ­bidding. A “cover-me bid” allows your phone contact here at Julia’s to still execute a predetermined bid amount for you in the case that they cannot get through to you on the telephone. Your phone agent is the only person who will have this bid and will only use it to bid in the event that he/she cannot reach you. Legal Dispute Any legal disputes arising from this auction shall be settled in the court system in the State of Maine. 17. We use a proven method of packaging your items which includes each item being individually wrapped in bubble wrap surrounded by packaging peanuts (in most cases) and double boxing. We use Federal Express as our preferred ­shipper however we are happy to a­ ccommodate just about any requests you may have. Payment and Forms Please allow 14-21 days from the time your payment is received for shipping. You will find our shipping forms on our website. If you are a successful absentee, phone or internet bidder, our shipping forms will be mailed to you along with your purchase invoice. These forms must be completed and returned to our offices along with your payment if you request that we ship your purchases. Purchases paid for by credit card or other secure methods will expedite the shipping of your purchases. Items paid for by personal or business check will be held for 10 days before processing by the shipping department. Cost Domestic Buyers We do charge for this service. You will be billed for labor at an hourly rate of $38.00 ($9.50 per 15 minutes). The material used in packaging your items includes bubble wrap, peanuts and

corrugated boxes. Insurance costs will be $.75 per $100.00 in value (based on the hammer price + the buyer’s premium). You may of course elect not to insure your items; in this case we will require you to sign a release absolving James D. Julia, Inc. of any liability. Sales Tax Information The State of Maine charges a 5.5% sales tax which must be collected unless the following conditions apply. A. State of Maine Dealers: must furnish a copy of their current year’s resale certificate in order to be exempt from sales tax. The business type must pertain to the items being purchased. B. State of Massachusetts Buyers: 1. If you have a Massachusetts state resale certificate that pertains to the types of items you have purchased you are exempt from Sales Tax. 2. Frequently Asked Questions Concerning Bidding It’s always best to attend the auction in person to bid on the items you wish, but if for some reason you can’t attend, there is no reason that you can’t obtain some of the items that you would like to purchase. At Julia’s, absentee bidding is always a convenient, easy and safe means of acquiring items that you want. As you can see, our specialty catalogs illustrate all lots to be sold, and as well give a complete description which includes condition. These descriptions, as per the conditions of our sale in the front of your catalog, are guaranteed against major discrepancies with a major impact on the value. If there are some items here that you think you would like to own but can’t attend the auction, we have many options to help you bid without being in the audience. If you are the winning bidder, after the auction you will receive an invoice via email and then in the mail from us. Typically the email invoices are sent out within 24 hours after the auction, and the paper invoice is sent out 2 business days after the auction.. 1. Bidding Options a. Leave a Bid Send in the form in your catalog or download a bid form from our website http://jamesdjulia. com/absentee-bidding/. You can bid by mail by simply filling out the form in the back of the catalog and sending along a 20% deposit check or credit card information. You can fax the form to us, email it to us, or call us with your absentee bid. A valid credit card is required. Your account is charged only if you are delinquent in making your payment. If you provide us with your email address, we will send you a confirmation email to verify the lot numbers, description and amount of your bid. As the auctioneer receives that bid and then asks for a higher bid a new amount will flash in that window. If you have registered to bid you may bid in the auction by simply clicking the bid button on your screen. Regardless of where you are in this country or where you are in the world it will automatically register on a computer at our auction site where a technician will see your bid and bid on your behalf. This innovation allows you to bid live-time during the auction. Online bidding allows the bids to be almost instantaneously transferred to you and to us, so subsequently you can bid within the confines of that time. There are some people who like to bid

How Much Time Do I Have to Bid on a Lot? If the asking bid is something you are willing to pay, do not hesitate. For the most part, the auctioneer does not stop or slow down, he simply moves along at a very brisk pace. It is always assumed by the auctioneer that the bidder knows what they want to bid and if they do not bid or hesitate to bid, it means they are not interested. The auction process moves very rapidly whether you are live at the auction, online or on the phone. For anyone wanting to be successful, it is important that you know or make up your mind before the lot is sold just how high you will bid on that particular lot. Those who wish to think about it while the auction is in process and bid on impulse, will find themselves not being as successful, being frustrated and sometimes even paying more than they normally intended to. 6. How Much Do I Bid? Bid whatever you wish, our online and printed catalogs as well as online listings offer item descriptions which include estimated low to high value range. These estimates are in no way an indication of what the items will definitely bring. If you will check our past catalogs, you will find some items bring less than low estimates, some items bring far more than the high estimate. So it’s totally dependent upon how badly people want the items. 7. Who Bids? There are generally two categories of absentee bidders. a. The collector type, who seriously wishes to purchase a given lot or lots. To that buyer we encourage you to bid as high as you feel comfortable bidding. If you seriously want the lot you should not hesitate to consider going above the high estimate to ensure that you get it. b. The next type of absentee bidder is the person who is a dealer buying for stock or a collector willing to buy items only if they are at a real bargain. This type of bidder will often bid on a large number of items knowing full well that not everything will bring a strong price, there are bound to be some things that will fall well below our estimate and that bidder knows that if they leave a large number of bids that they have a chance of picking up a few things at a very Visit www.jamesdjulia.com for more information

reasonable price. Some bidders will leave 3, 4, 5 or 6 pages of bids with us, based with that theory in mind. And usually they are successful with a few items and the items they are successful with tend to be very good buys. 8. What Is a “Plus 1” Bid? Some bidders not wishing to lose a lot for the same price or just slightly above what their top bid was elect to use our “Plus 1” policy. What this does is empower our staff to go one more bid for you in the event someone in the audience has bid the exact same amount of your top bid or just slightly above it. The bookkeeper will then bid one more bid which sometimes is all it takes to get the lot. Typically the auctioneer raises the increments by 10%. If you submit a “Plus 1” Bid, we will increase your bid by 10% over your bid amount. A “Plus 2” bid will increase your bid by 20%. 9. What is a “Cover” Bid? The phone bidding system is not a perfect one. You may be out mowing the lawn and forget about your bid. Or somehow, the phone number got transposed and the phone agent is desperately trying to reach you but unbeknownst to them, they are calling the incorrect number. Or the phone system could break down. Any myriad of other issues can arise. If you seriously want a particular item, your best strategy is to leave a cover bid. A cover bid is a bid which you leave along with your phone bid instructions. If for any reason at all, your phone agent is not able to get in contact with you, they are authorized to bid up to that amount. Please note, your agent does not use the cover bid if they have you on the telephone. You are in control when you are on the telephone. The cover bid is only an insurance policy in the unlikely event that your phone agent is unable to make a connection with you. Subsequently, the only way your cover bid is utilized is if your phone agent cannot get through to you. They will bid up to your cover bid and no more. Again, please remember, the cover bid means nothing if your phone agent gets ahold of you. 80

Even though you left a $10,000, when your phone agent has you on the phone, you might decide not to go any higher than $4,000. That is your prerogative. On the other hand, you might change your mind and decide to go to $15,000. That is still your prerogative and the benefit of being on the telephone. If you choose to not leave a cover bid and if we do not reach you on the phone, there is nothing we can do at that point. 10. Will Julia’s Tell Me What the Top Bid is on a Lot? Absolutely not. At Julia’s we never ever divulge how much an absentee bid is or who has left bids. Under no circumstances do we ever divulge that information. We can advise you and assist you with your bids. For instance, if you only have $3,000 to spend but are interested in three separate lots all in the general value range of $3,000 and don’t know which one you should pursue, you may call our office and if two of the lots you are interested in seem to have a great deal of interest in them and the third lot has no interest whatsoever, we will gladly advise you of that. Remember, under no circumstances would we ever divulge who has bid or how much any of our absentee bids are. 11. Can I Leave an Unlimited Bid? Absolutely not. We cannot honor bids which do not have a set top amount. If you want a lot very badly, then we suggest you bid well above the estimate and pick a figure that you would feel comfortable owning it at should it go that high. 12. Does Absentee Bidding Work? Absolutely. At our specialty auctions from anywhere to 25% to 45% of all merchandise is purchased by absentee bidders. And some items are acquired for well less than their top absentee bid. 13. Does the Auctioneer Reopen Bidding? The James D. Julia Auctioneers must conduct their auctions in accordance with UCC statutes which specifically state that when the hammer


falls, the bidding is concluded and the winning bidder announced is the new owner. Because of this law, the auctioneer cannot and will not reopen the bidding because you decided too late to bid. This is a law and the auctioneer must abide by this. The only exception is “where a bid is made while the hammer is falling in acceptance of a prior bid. The auctioneer may in his discretion reopen the bidding or declare the good sold under the bid on which the hammer was falling.” This is the only exception. Therefore, if you seriously want a lot, do not hesitate to bid because once the hammer falls it is sold and there is nothing the auctioneer can do about it. 14. How Do I Know if I Won? After the auction is over with, our staff will send out bills to all the successful bidders on the next business day. Please do not attempt to call the auction facilities the day of the auction. Our lines are frequently busy with phone bidders and we cannot tie up the lines and the office staff when not on the phone with absentee bidders. They are extremely busy cashing out customers and very rarely have time to check the records for bids at that time. If you must call, we would advise you to call the afternoon of the first business day following the auction. 15. What is a Late Bid? We frequently process thousands of bids for an auction. Please make sure your absentee bid form is received by Julia’s no later than 4:00 pm EST the date before the auction. If you are an international bidder, or first time bidder, please allow two additional days to establish your account with Julia’s If you are mailing or faxing bids we encourage you to phone our office before the auction to confirm that we received your bids. A while ago, we sent a group of eight letters out to people in various parts of the country and for some reason, the entire packet of eight letters took 14 to 16 days to get to their destination. Please be sure to call and confirm that we’ve received your bids if they’ve been sent out seven to ten days prior to the auction.

16. How Much Does it Cost? a. Absentee Bids processed by Julia’s are a service provided to our customers totally free of charge, there is no cost to you. b. Phone Bids processed by Julia’s are a service provided to our customers totally free of charge, there is no cost to you. c. the speaker system broadcasting everything the auctioneer is saying and in front of the phone bidders sits a myriad of auction participants, many of which may be speaking with one another. Bottom-line is that an auction is an incredible arena of activity and noise and very difficult for your phone agent. The best way for success is to be prepared and do not try to converse with your agent in the process; simply say a “Yes” bid or “No” bid. If you are silent your agent may think the call has been lost and so it is always best to let them know when you are “Out” and would like to stop bidding.

17. How Does the Phone Bidding Process Work the Day of the Auction? What Should I Expect? Your phone agent will call usually a few lots early to be sure to get you on the telephone on time to bid for the lot. Your phone agent will remind you of a few important instructions on how to successfully bid.

18. What Can I Do When I am Phone Bidding to Better My Chances of being the Winning Bidder? a. Know what you want to bid in advance.

The most successful bidders are the ones that are prepared. To maximize success, you should study the lots and make a decision as to what your ultimate bid should be before you even get on the telephone. If you know you are willing to go to $10,000 and no more and the phone agent tells you that the auctioneer is looking for $5,500, you do not need to think about anything, you simply say “Yes.”Your agent will tell you and repeat one of two messages; either “We have it,” which means there is no need to bid at this moment or “The auctioneer is looking for $5,500, do you want to bid? The auctioneer is looking for $5,500, do you want to bid?” If you want to bid, do not hesitate, do not try to invoke a strategy, do not try to measure the “pulse” of the auction bidding; simply say “Yes, bid,” but say it loudly so there can be no question that your phone agent hears you and perhaps repeat yourself. You need to understand the auction environment for your phone bid agent. The phone bidder is at a table, sometimes there are as many as 10 or 20 other phone bidders on either side of your phone bidder speaking to their bidders. In the background and overhead is

d. Do not hesitate. The auctioneer will not wait for you anymore than he would for someone in the audience. It is a fact that at every single auction, there are one or two phone bidders who complain and feel the auctioneer should have waited to give them more time to make their decision. Absentee Bid Conditions

Please read if you are submitting absentee bids. 1. Important Note: Absentee bids are a service provided to our customers free of charge. Every effort is made to execute all absentee bids. However because of the thousands of bids that must be processed just prior to an auction, it is inevitable that a few mistakes will occur. Your best protection is to attend in person, but if you cannot, please understand that this is not a perfect system at any auction house. To better serve our absentee bidders, we have what’s referred to as a Plus One and on phone bids a Cover Bid. You should definitely read about both of these in below sections and consider using them to help ensure your participation. We will do everything in our power to execute your bids properly, however, in the event of an error of omission, or failure to properly execute absentee bids, the Auctioneer shall not be held liable. 2. All absentee bids must be accompanied by a 20% deposit, which will be refunded immediately after the auction if your bid is unsuccessful. If your bid is successful, your 20% deposit will be applied to the purchase price and the balance due upon presentation of our bill. If time does not permit a 20% deposit, you may confirm your bid by your Visa, MasterCard, Discover or American Express. If you provide a credit card number, we would use your credit card number if you don’t pay by 15 days after the auction for the balance due. 3. To execute an absentee bid, fill out the absentee bid form that can be found in the auction catalog, call us at 207-453-7125, or you can also click the BID NOW button on our website that appears on every lot in the auction and use our online absentee bid form. All of these forms require your contact information, item information including lot number and description, as well as the top bid price (not including the buyer’s premium) and/or cover bid (phone bidders only) and Plus 1 bid (if desired) for each lot you would like to bid on. We encourage you to submit your absentee bids as soon as possible. If two absentee bids are received with the exact same amount, the first one received will take precedence. Your absentee bid must be received by Julia’s no later than 4:00 p.m. EST the day before the auction. If you are an international bidder or first time bidder, please allow two additional business days to establish your account with Julia’s. 4. Bids are handled in a competitive manner by our staff who bids on your behalf in an attempt to buy the object for less than your top bid. If two or more bids are received on the same item from different people, the bidding will open at the next increment above the second highest bid. 5. All bids must be in even dollar amounts. Bids in fractions of dollars or odd amounts will be rounded up to the next bid increment. Therefore, if someone leaves a bid of $ 2,350 we will automatically round it off to $ 2,500. The auctioneer reserves the right to change any bid increment from the podium at their discretion. 6. Open bids or bids with no set top amount or orders to just simply buy the lot cannot be accepted by us. You must have a definite top limit before we can execute your bid. Some bidders concerned that their lot might just go for one bid above their top limit, leave a top bid Plus One bid. This works as follows: The top bid submitted might be $1,000, but not wishing to lose the lot for simply one more bid, the Plus One bid allows our staff to bid one more time on your behalf. So if you left a $1,000 bid plus 1 it would allow us to go $1,000 plus $100. If you said $1,000 plus 2 bids that would mean $1,000 plus $200. Pursuant to the above table, if you left a “Plus 1” bid for a $2,000 item, the next bid would be $2,250. If you left a “Plus 2” bid, it would be $2,500. (NOTE: One possible problem that occasionally arises with absentee bids is when someone in the audience bids exactly the amount which you specify is your limit. In such a case, we would not go one extra bid unless your bid sheet indicates Plus One bid.) 7. If you wish to bid by telephone, you might also want to consider a Cover Bid at the time you make arrangements for phone bidding. A Cover Bid allows your phone contact here at Julia’s to still execute a predetermined bid amount for you in the case that they cannot get through to you 82

on the telephone. Your phone agent is the only person who will have this bid and will only use it to bid in the event that he/she cannot reach you. Assuming you are reached via telephone, they would not use your bid, but rely on your verbal instructions. Cover Bids are not mandatory, you can place one at your discretion, and they are simply a safety device in the event you cannot be reached by telephone in time. 8. Notification of Success: Only successful bidders are contacted. Winning bidders will receive a bill via email within one business day of the last day of the auction. A written bill is usually sent within three (3) working days after the auction. The bill will be accompanied by shipping information. Unsuccessful bidders are not contacted. Phone inquiries regarding your success cannot be answered until the afternoon of the first business day after the auction. 9. Shipping: If you are a successful bidder, a bill will be sent shortly after the auction. This bill is due upon receipt. Enclosed with the bill is a shipping form. If you wish to have us assist you with shipping, please complete this form. A charge for this service includes labor, packing materials, shipping and insurance. We require that all shipping be paid for at the time of shipment, so we will need payment in full, or your credit card information to process the charges. The Auctioneer reserves the right to hold merchandise purchased by personal or business check until the check has cleared the bank, if the Auctioneer deems such action necessary to protect his interest. Use of certified funds, wire transfers or other form of guaranteed funds will expedite shipping. Payment by credit card is 3% higher than using wire transfers, certified funds or checks. Shipping typically takes 14 to 21 days after payment has cleared (depending on shipping department workload). The Shipping Department may decline to execute instructions to ship items which are too large or too fragile to be shipped by common carrier. In such cases, the only way we can ship these special items is by way of a letter from the buyer releasing us from the responsibility of any damage that might occur in shipping 10. Confirmation of Bids: Typically within one business day of submitting an absentee bid, you will receive an email from Julia’s confirming the lot(s) and the bid information you provided. If there is an error, please contact us immediately. 11. Bidding on any article(s) indicates your acceptance of these terms above and the Conditions of Sale. Terms. In addition to the terms contained in this Absentee Bid Form, the Conditions of Sale and the Absentee Bid Conditions set forth in the catalog for this auction (online and printed versions) are incorporated by reference, just as though fully set forth herein. Payment. Payment for all items purchased is due upon the earlier of (a) 15 days from the date of auction or (b) upon receipt of invoice. If payment is not made within 15 days of the date of the auction, James D. Julia, Inc. is hereby authorized to charge my credit card for the total purchase price together with the applicable Buyer’s Premium and any accrued interest.
