from the di recto rs Make Your Garden Work For Your Home It is often said that spending a lot of money on a garden can over capitalise a home and that money is better spent indoors than out. Is this the case? It is true that many home owners get carried away with garden fever and don’t ask themselves if the money spent on landscaping will be realised down the track when they come to sell. The amount allocated to landscape design and planting must be in proportion to the overall value of the home or it can easily add cost that doesn’t add enough re-sale value. Home owners need to be aware of the percentage cost of the overall value of the home that landscaping represents; obviously there is a big difference in the amount that should be allocated to landscaping in a house worth $300,000 and a house worth $3,000,000! Astute home owners soon work out that a drab and unimaginative garden will detract from the value of a home because it will not give buyers the feeling they want to live there. Even buyers who don’t think they care about gardens and gardening are attracted to the overall picture of a property where house and garden complement each other so that the whole is more harmonious. Driving around any town or city, it’s not hard to come across square front gardens with rectangular lawns, borders and straight driveways leading to a garage. Naturally the houses wrapped by such gardens look equally ordinary and uninteresting. Unimaginative landscaping such as this still costs money but rarely adds that ‘wow’ factor when buyers start coming through. What is often lacking in such gardens is a sense of mystery - one of the main elements of good design that makes even a small garden more appealing to buyers. It’s not a good idea to design the garden yourself – unless you have appropriate skills. A keen gardener with a green thumb is not the same as someone who understands how to use plants in an architectural way to design and furnish a space with a sense of harmony and mystery. If you are already lucky enough to have a beautifully designed garden, the thing to remember when presenting it for sale, is to make it look as if it requires no effort. Paradoxically, this effect is often achieved with a considerable amount of effort. Unkempt and weed-filled gardens draw attention to how much work may be involved in looking after them and therefore look the opposite of low maintenance. After all, if a garden is too hard for the current owner to present well at an important time like when it is being marketed then buyers will concentrate on how much work is involved and perhaps move on to a property that looks easy just because the work has already been done and the seams are not showing. Self Managed Superannuation Funds (SMSF) and the Auditor By Ron Male In support of the sometimes maligned audit profession, I outline for you the Auditors required position in relation to the audit of SMSF’s.

The Facts All SMSF’s are required to be independently audited by a qualified professional. The tax office (ATO) has established, and now enforces regulations governing Trustees behaviour and the expectation that Auditors test and approve these Trustees action. In most instances the accounting and report presentation is prepared by your Accountant and an independent qualified person (who can be from the same firm), will audit those accounts. With the increased use of SMSF’s, the ATO has legislated to enforce the Auditor to test and ensure all functions of the SMSF have been complied with. My own suspicion is that Auditors are required to hold professional indemnity insurance where the Trustees have no (as yet) such requirement. On this basis, the ATO are able to concentrate on Auditors rather than Trustees. The auditor is not only checking the Accountants workings, as generally these are prepared from cashbooks, bank statements, dividend slips etc provided to him by the Trustees. The audit concentrates on the actions of the Trustees to ensure they maintain full fiscal control over the fund. The Trustees are charged with the fiduciary responsibility of safeguarding the funds assets with a business strategy designed to preserve (and maybe growing) the fund.

The Audit Confusion as to audit interpretation often arises if the Trustee (who is a member/beneficiary) confuses their role of Trustee with their entitlement as a member. The Trustee (often husband and wife individually, or a corporate entity with the Directors who are fund members), are required to make investment decisions on sound advice, with due care of prudent business enquiry. The Auditor checks the investment strategy, the decision process and then seeks the market value of that investment. The Auditor is not concerned that the investment value may have dropped – simply that the investment exists; can be authenticated and is stated at correct market value (ie. not cost). The Audit role here is fairly simple when investments are in publically listed shares and trusts, where market values are quoted daily.

The Difficulty The Audit evaluation becomes more difficult where unlisted investments are made including real property and closely held local investments (small property developments.) The Audit in these instances will seek from the Trustees: Their basis of valuing the investment Copies of balance sheets etc for investments in off market assets (eg. typically development land where there is a syndicate of investors waiting upon a return on that investment) Copies of the investment strategy for investing in such property development Copies of the title where land and buildings are owned by a SMSF Copies of rate notices and real estate opinion of such assets Qualified Valuer opinions of such property

The Link All of these requirements by the Auditor should already be held by the Trustees as part of their

satisfaction as to the state of the investments. It has been popular for SMSF to be established primarily to invest in a project as part of a larger group. The Trustees must be warned that such a project is quite acceptable however, it is the Auditors role to check on the value of this investment. Part of this check includes a clear understanding by the Trustees as to the ‘state of play’ of every asset, and insist on year end (at least) financial accounts being made for all assets held.

The Audit Opinion On every annual set of SMSF accounts the Trustees sign to verify that every aspect of their handlin, and, control of the fund is in accord with legislation.

The Audit verifies the Trustees approach and satisfies the members that correct values have been applied. The Audit does not criticize the Trustees handling of fund assets, unless due financial responsibility has not been adopted. Those of you who are SMSF Trustees will be seeing a stronger approach by Auditors in their request for title and value verification, as the ATO are now reviewing the Auditors process in agreeing to sign the report. The Auditor will not be prepared to have his reputation and standards questioned by the ATO, and hence will become more aggressive in seeking Trustee verification and, more often than not, in writing. The Audit has also now established a process of

obtaining written clarification by the Trustees of their actions for the year. The Auditor will also seek statements as to asset held in Trustee names, to the effect these are held under a Declaration of Trust for the Fund. (In the case of funds owning real property, the Title appears in the Trustee names with no reference to the superannuation fund – hence the Declaration of Trust.)

Audit Signature The ATO will take the Auditor to task if the regulations and verification processes are not applied. Your Accountant makes no such signed commitment; hence the Auditor has taken a ‘more regimented stance’ in evaluating your fund.

Breakfast With George Negus By Simon Farrar One of the perks of being part of an active Past Students Association is the occasional invitation to various seminars or social soirees where you can take the opportunity to further your business contacts. The annual business breakfast is one such occasion that is organized by the alma mater of Yarra Valley Grammar that is eagerly marked down on the calendar, and this year’s did not disappoint. George Negus, the acclaimed and much travelled journalist of original “Sixty Minutes” fame was the guest and keynote speaker, and with his trademark dry wit, challenged the audience on a range of topics that were based on “change”. It was a provocative yet entertaining discussion, ably matched by a hearty breakfast and a superb venue at The National Gallery of Victoria.
