Based on the 2020 Senate Bill 323 (SB 323)
AS OF JANUARY 1ST, 2020, Senate Bill 323 went into effect that
provides an extensive overhaul of Homeowner Association election procedures. Our current voting and election rules that were adopted by the Board of Directors of Tahoe Keys Property Owners Association (TKPOA) on May 22nd, 2015 complied with the requirements of the Civil Code, and a much needed update by Steve Weil – TKPOA Legal Counsel at the time – Berding & Weil, LLP Based on the 2020 Senate Bill 323 (SB 323), there are numerous changes required to our voting and election rules, and updates that our current TKPOA Legal Counsel Matt Ober – Richardson – Ober- DeNichilo LLP has provided a complete update of these rules for Board adoption. SB 323 amends Civil Code Sections 5100, 5105, 5110, 5115, 5125, 5145, and 5200, and adds Section 5910.1 relating to elections, voting and candidate qualifications.
