ARCHITECTURAL CONTROL & SECURITY Winter Season Suggestions

The TKPOA Architectural Control and Security Departments would like to remind you of a few tips for keeping your home and family protected now that the cold weather has arrived.

• When you are not at your home, keep your thermostat on 55 degrees. Broken pipes are quite common this time of year.

• Sprinklers and any landscape irrigation should be shut off for the season once the nightly temperature consistently dips below 30 degrees.

• Carefully check all windows and doors before leaving your home, even if you’re just running errands. High winds can cause a window to blow open.

• Be sure your crawl space is sealed off and secure. Bears are looking for a cozy spot under your house to hibernate. Pine Sol is the best deterrent.

• Please keep your friends, family, and pets off the ice in the lagoons. It may seem thick enough to walk on, but with fluctuating temperatures it is not.

• If you are leaving a boat in the water all winter, please winterize and adequately secure your boat to the dock. Sinking and/or drifting boats are not uncommon this time of year. Also, only white shrink-wrap is allowed if the boats are to remain docked.

2023 IS LOOKING UP!

As we move through 2023, there are positive signs for both buyers and sellers. For sellers, overall market activity is strengthening. Both buyers and sellers benefit as mortgage rates descend and inflation eases. For buyers, home value appreciation is declining from the recent frenzy. All of that’s great news for the housing market this year!

In South Lake Tahoe, inventory is still very low, maintaining home values. Interest rates have decreased, in some cases by a quarter percent.

As we approach the end of winter and enter the busy buying season for the Lake Tahoe real estate market, consider scheduling your annual real estate review.

SLEEP SOUNDLY FOR A HEALTHIER HEART

Sleep is a naturally recurring and essential function that allows your body and mind to rest and restore between periods of activity, stress, and other stimulative experiences. While it’s most often associated with mood and mental function, sleep also fights off diseases and can contribute to overall body and organ health. Lack of sleep has been linked to a higher risk for certain diseases and medical conditions such as high blood pressure and heart disease, along with risk of stroke, heart attack, and congestive heart failure. Given its impact on your health, it’s important to devote time to improving your sleep, especially for those at greater risk of heart disease.

Here are some ways you can promote better sleep habits:

• Fuel for Sleep. Try chamomile tea for calming properties that may improve sleep quality. Avoid stimulants like caffeine and nicotine four to six hours from bedtime.

• Control your Environment. Keep your bedroom dark, quiet, and cool to minimize disruptions to sleep. Avoid screen time one to two hours prior to bedtime and turn your cellphone off at night if feasible.

• Set the Mood. Establish a relaxing routine that begins an hour before bedtime.

• Try not to force it. If you aren't asleep within about 20 minutes, get up and do something relaxing for a bit until you feel sleepy.

• Avoid going to bed full. Eat dinner several hours before bedtime, avoid alcohol two to three hours before sleep, and avoid foods that can upset your stomach.

• Exercise earlier when possible. Work out at least three hours before bed to allow your heart rate to settle.

Lastly, a sleep journal is a great way to track your sleep quality and duration on a daily basis. By recording consistently, you can identify patterns and triggers that may contribute to poor sleep.

Taking a proactive approach to your sleep may make a huge difference in your life. Discuss risk factors and additional tips to sleep better and promote better heart health with a care provider.

PRESIDENT'S MESSAGE

Happy New Year! Here is a summary of hot topics that the association is dealing with:

Winter. Remember “snowmageddon” in December 2021? Well, this year is even bigger and lengthier. Snow and rain have hit big time. But you won’t hear me complaining! The lake is already up 1.8’ from its end of November low point, and there is about 3’ of snow-water equivalent in the basin snowpack. So the lake will be coming up a bunch this spring. And the skiing is outstanding, now that the holidays are over and the crowds have subsided a little!

However… there is a lot of heavy snow, which has brought down powerlines, limbs, and trees, and buried about everything else. Our crews have been working pretty hard to keep snow cleared from townhome driveways and walkways and other key common facilities. We haven’t cleared sidewalks and paths, and we haven’t cleaned up all of the downed branches in the common areas because it’s just too much. Some of these things will just have to wait for the thaw, I’m afraid.

The City of SLT plows the streets, and they’ve done a pretty good job this year. It’s a love/hate relationship; we love to have the streets plowed, but we hate the berms! And plows just make the streets narrower and narrower with each new storm. The City only has limited numbers of jumbo

snowblowers, which is the only way to restore the width of the streets. And all of the limbs, car fenders, and other debris hidden in the snowbanks keeps knocking the snowblowers out of service. So please be patient.

Roofs can also be a problem with this much wet, heavy snow. We’ve been dealing with a number of townhome roof leaks, and I imagine there are more to come. For you single family homeowners, you might want to consider hiring someone to clear your roof. The ice dams are building on the eves, and sometimes that causes leakage into the house. And it’s possible that the weight could be a problem. Clearing a roof is dangerous business though, so please hire somebody to do the work. The cost will be far less than the hospital bill!

Professional Management. The transition to FirstService Residential is going very well. Their full start date is February 1st. Although they are recruiting for a General Manager, Mark Madison will be staying on until at least March to smooth the transition. There are a lot of complexities to this HOA, and we’re happy that Mark and the rest of our staff are sticking with us!

As always, I’d like to close with a giant thank you to all of our member volunteers! The new year will bring us new challenges and continued challenges. But we are making progress; the ball is moving forward, thanks to all of our volunteers and outstanding staff.

Hot Tubs Require Architectural Control Committee (ACC) Approval

If you are considering the placement of a hot tub on your property, several issues need to be addressed prior to installation. First, you must submit a Form 12, Spa/Sauna/Hot Tub application to the Architectural Control Committee (ACC) for review. This form can be found on our website www.TKPOA.com or at the front desk of the TKPOA pavilion. We will also be happy to email you the application.

All Saunas, Jacuzzis, Spas, Portable Spas, and Hot Tubs must be approved by ACC prior to installation or construction. Failure to do so will result in a fine.

Requirements are outlined in Section 12 of the Architectural Control Rules Brochure.

12.01 All accessory structures or equipment must be approved by the ACC prior to installation.

12.02 No lot accessory may be placed in any set-back area nor can they be placed anywhere on the streetside of the lot (side set-back -5 feet, rear set-back -15 feet from high water line (HWL).

12.03 Motorized or noise emitting installations (like pumps, filters or other equipment) will require soundproofing or a decibel rating low enough so as not to disturb neighbors.

12.04 All Saunas, Jacuzzis and Hot Tubs must be

outfitted with a locked, secure childproof cover.

12.05 City of South Lake Tahoe requires permits for some lot accessories. Any required permits must be obtained from the CSLT prior to installation.

12.06 No lot accessories may be installed upon Over Water Platforms (OWPs), landings or any other overwater structure.

Be mindful of TRPA coverage considerations when planning the placement of the Sauna, Jacuzzi, Spa or Hot Tub. General land use requirements and building codes are established and enforced by CSLT and other agencies.

When applying for a hot tub, keep these things in mind:

• A backflow preventative device must be installed, if appropriate for the unit.

• Hot Tubs must never be placed within the property’s 5’ side setback or 15’ rear setback.

• Preferably, the unit should be centered within the property to avoid disturbing neighbors. Sounds of pumps kicking on and off all night can be a nuisance to your neighbors. This is especially true if the property is being used as a vacation rental.

TKPOA’S MEMBER ID CARD AND RECREATIONAL PASS POLICY

As a reminder to our members, their renters, and guests, the following are provisions of TKPOA’s Member ID Card and Recreational Pass Policy for access to the Associations amenities and facilities as revised by the Board of Directors on May 22nd, 2015:

• Owners & Long Term Renters (LTR) must have a current valid Member ID card with a valid photograph of the member and/or LTR in their possession when using any of the Association’s facilities. This includes, but is not limited to, swimming pools, spas, tennis courts, parks, playground, beaches and volleyball court.

• Up to three guests per Member ID Card and Long-Term Renter ID Card can get access to the association facilities when accompanied by the ID cardholder.

• The fee for replacing lost, stolen, or damaged ID Cards will be twenty dollars ($20.00). The TKPOA will take current digital photographs with the issuance of ID Cards.

• Property owners or their rental management company should direct their rental guests to the TKPOA Pavilion office to purchase Short Term Recreational Passes for use of Association amenities. Vacation Renters need to provide a copy of their lease to the front desk – either hard copy or digital copy (for 2020 there is a daily per person fee of $10. Weekly passes are also available).

The complete text of the Member ID Card and Recreational Pass Policy can be found on the TKPOA website, www.tkpoa.com or a copy can be requested from the Office.

TKPOA Staff is tasked with enforcing TKPOA’s Operating Rules for Association amenities which includes enforcement of the Member I.D. Card and Recreational Pass Policy in order to correct violations.

WATER QUALITY SPECIAL ASSESSMENT TKPOA MEMBERSHIP APPROVED CONTROL METHODS TEST YEAR 2 (2023)

The Control Methods Test (CMT) is a multiyear effort to find a lasting solution to manage invasive aquatic weeds in our lagoons. Year 1 of the test has shown promising results in the effectiveness of herbicide treatments. Year 2 is designed to test methods for maintaining control in areas where herbicides were applied to help determine what would be the most viable option moving forward if taken large scale.

By way of background, in January of 2022, the LRWQCB and the TRPA governing boards unanimously approved the Tahoe Keys Control Methods Test project. Starting May 2022, 27 testing sites were established for various treatment methods including the 16.9-acres of herbicide application. These treatment sites and the entire West Lagoon were heavily monitored for compliance and viability throughout the summer season. With the overall success of Year 1, on December 14th, 2022, the Tahoe Keys membership voted to continue funding the Control Methods Test Project for it’s second year (2023) through a special assessment.

The CMT project Year 2 was allowed for:

• Program management and technical support to implement Group B methods across the test sites.

• Continue the work in finding the long-term solution and assessing the circulation system

• TKPOA Water Quality Department support staffing to provide technical and logistical support of the CMT.

• Equipment and supplies required to conduct the CMT, and to become part of the Water Quality Department operations as needed.

• Developing and implementing the Group B treatment methods of Bottom Barriers and Diver Assisted Hand Pulling.

• Continuation of Program Management to include technical support for Ultraviolet Light (UV-C) application.

• Continuation of Harmful Algae Bloom (HAB) management as required by the CMT.

• Continuation and improvement of nutrient management in the Tahoe Keys Lagoons

through analysis and testing of Laminar Flow Aeration (LFA).

• Project contingency for any additional required costs

• Efforts will continue to seek to obtain grant funds to reduce costs.

• Continue outreach efforts to non-member stakeholders and public education efforts.

All of these Special Assessment payments can be characterized as an investment in the future of the Tahoe Keys, finding methods to greatly reduce or eliminate the aquatic weeds from the Lagoons. It is anticipated to improve the quality of boating, recreation, and aesthetics thereby improving property values throughout our community. That TKPOA Board of Directors, Water Quality Committee, TKPOA Staff all appreciate your efforts to support these programs and important test.

CMT YEAR 2 SPECIAL ASSESSMENT BILLING

The special assessment is $442 per Waterfront Property Owner ($221 for landlocked owners without a Beach and Harbor dock). This will generate approximately $650,000 for costs to be incurred during the 2023 fiscal year to support the Year 2 efforts of the Control Methods Test.

Invoices for this special assessment were mailed out on January 18th, 2023, with a due date for payment of February 1st, 2023. Late charges will not apply until March 2nd, 2023.

On February 1st, 2023, FirstService Residential was excited to officially begin professional management services for the Tahoe Keys Owners Association (TKPOA)! Our company takes great pride in and appreciates the opportunity we have been given to serve you, your neighbors, and your Board of Directors.

The TKPOA will have full benefits and support of this infrastructure through a direct connection to our local Northern CA team. benefit from improvement.

in development or underway, there are financial reporting deliverables due, and an ongoing transition from the current tools and programs to the FirstService systems.

We are also looking to fill certain critical roles, including the General Manager and Facility Director positions. In partnership with your Board of Directors, we are conducting interviews for the General Manager position, which we aim to have filled by the end of February. Your interim GM, Mark Madison, will continue through March 17, 2023. We are incredibly grateful to Mark for being a great partner to my team and me as we familiarize ourselves with the day-to-day business of running the community.

What happens now? Each resident will receive a Welcome Letter from FirstService Residential. This letter contains information on how to pay your assessments and register for the Resident

Connect Portal. Once registered, you will be able to view account balances, submit maintenance requests, and update your communication preferences. Our training team has been working onsite with the Tahoe Keys associates to familiarize them with our tools and processes to better assist you.

If you weren’t able to attend our welcome event on February 9th, we will hold additional events in February and March, both in-person and virtually, to introduce our team and provide step-by-step instructions on how to use the Resident Connect portal and pay your assessments.

ICE SAFETY

Now that winter has arrived and the Tahoe Keys lagoons and waterways are covered with ice and snow, it is important to think about ice safety.

TKPOA Water Quality and Security Departments along with the South Lake Tahoe Fire and Rescue recommend you don’t venture out on our frozen lagoons and waterways, as they are considered unsafe. Please keep in mind:

Never allow children or pets to venture onto the ice

In the event they fall through the ice, there is a high probability of injury or death. TKPOA rules pertaining to pets and City of South Lake Tahoe Animal Control Codes do not allow an unleased pet to run or play on the ice.

Recognize that ice will never be completely safe

Conditions, and unseen or unknown factors, can render seemingly safe ice suddenly dangerous. Take all care and precautions to avoid mishaps and make sure you have a rescue plan in place, i.e.; throw able floatation device with an attached rope, for those who live on the water. Having a safety plan in place, should you see an ice incident, can save lives.

Understand that ice strength is not the same everywhere, not even on the same body of water

It is difficult to judge the strength of ice based on appearance alone. Other factors including snow cover, currents, bubblers to prevent ice around boats, distribution of the load on the ice, schools of fish, and other factors affect the thickness and safety.

Find an alternative to playing on the lagoons

Skaters can go to Heavenly Village Ice Rink (530- 5424230) or the South Tahoe Ice Arena (530-544-7465).

There are many interesting trails in and near the Tahoe Keys for walking and snowshoeing. All people who venture out during winter should carry emergency supplies no matter how long they plan to be out or where they plan to go. Always make sure that someone knows where you are going and when you are expected to return.

Long Term Rental Properties

Please inform your renters that the ice within our community is unsafe. Renters and their families should refrain from walking on it for their own safety. Refrain from throwing rocks, trash and other items on the ice.

Laminar Flow Aeration (LFA) Project Area

In the spring to 2019, the Water Quality Department introduced a new project in the TKPOA waterways. This project consists of 10 diffuser and over 8,000 feet of high pressure hose which covers approximately six acres of waterways operates nonstop throughout the year. One of the project goals is to have a continuous circulation of the water column. This will reduce the water’s ability to freeze and if it does freeze the ice will be thin and ununiform which makes this area extremely dangerous. The LFA project is located in the waterways that are north of Venice Drive and between Christie Drive and Lucerne Way (refer to picture to the right).

The TKPOA WQ Staff has placed ice caution signs around the TKPOA Waterways to remind the members, renters and visitors about the threat that ice pose (refer to pictures below).

TOWN HALL FORUMS

The TKPOA Board of Directors holds Town Hall Forums, to provide additional communication to the TKPOA Property Owners as well as solicit additional input on important topic and issues. Town Hall Forums are not required Association meetings and are optional.

The purpose of the Town Hall Forum is to conduct an open exchange of information and ideas, and to inform TKPOA members of the latest information in person on the important projects and issues that are taking place. The TKPOA Board of Directors will be represented by less than a majority of the Board and do not conduct any Board business during Town Hall Forums. Minutes are not required or recorded for these meetings.

The Board of Directors have only scheduled Forums when they feel there are important topics for discussion or a TKPOA Committee has an important topic to present. The schedule for these Town Hall Forums, the topics and the dates can be found via: the Keys Breeze, flyers posted at the Pavilion, on our website, and through our Email E-blast list so it is important that you have a current email listed in our

data base to receive these messages.

These Town Hall Forums are open to all Property Owners and are held at the TKPOA Pavilion and on the web hosted Zoom meeting link.

The TKPOA Board of Directors will continue to hold the Town Hall Forums as a webhosted meetings using the Zoom application. For Town Hall Forum the meeting Agenda/Information and the web hosted meeting link and instructions are posted on the TKPOA Website at www.tkpoa. com, seven days or more prior to the meeting. You can find this by using the website calendar which is located in the “EVENTS” drop down menu, you can find the meeting date click on it and it will bring up the link the agenda and web hosted meeting instructions. The Town Hall Forum announcements are also posted on the TKPOA Pavilion bulletin board prior to the meeting as well.

On the TKPOA Website the TKPOA Staff has been posting the following items for each Regular Open Board Meeting:

• The Agenda – Board Meeting Agenda is available, and you will need to use your member login and password to access it in the Documents/Board Meetings/2023/ Agendas folder.

• Regular Open Board Packet – Board of Directors Meeting Packet is available and is located in the Documents/Board Meetings/2023/Board Packets folder. This is in a PDF Format with bookmarks for each agenda item.

• Supplemental Information – Board of Directors Meeting Supplemental Packet is available and is located in the Documents/Board Meetings/2023/Board Packets folder.

• Late Information – Board of Directors Meeting Late Information is also available based on the timing it has been issued and is located in the Documents/Board Meetings/2023/Board Packets folder.

Board Meeting are for TKPOA Members Only. California's community associations are not part of the public sector; they are private membership organizations. As a result, the general public does not have a right to attend board or membership meetings. (Civ. Code §4925.)

UNTANGLING A LANDLOCKED MYSTERY

In the beginning there were (almost) no tangles The Tahoe Keys was created with the idea that every property would have a boat slip and access to Lake Tahoe. Landlocked properties without direct access to the Lake were provided a boat slip in the docks in the back-bay of the East Channel. Those docks became the Tahoe Keys Beach & Harbor Association (TKBHA) for Tahoe Keys landlocked property owners. Everyone benefited from and shared the cost of water quality services equally.

Tangles really began in 1991, when a major restructuring of the then 30-year-old and very complicated Tahoe Keys Property Owners Association took place. One result was a major revision to the CC&Rs, which have remained unchanged to this day (and hopefully will be updated by a membership vote, which is currently underway – please vote!)

Also, in 1991 a legal agreement was established between the Marina, TKBHA, and TKPOA, which stipulates how water quality costs, and other costs to maintain the east channel, are shared. (“1991 Stipulated Agreement”) This agreement defines how costs are to be determined and that costs are to be billed on a delayed basis. This agreement, however, caused a double charging to TKPOA property owners who also

pay for water quality costs as part of their general quarterly assessments.

To untangle the double charge, the TKPOA simply issues a credit to the accounts of all landlocked property owners that are also members of TKBHA. The credit is equal to the amounts billed to TKBHA on a per boat slip basis. This year, the TKBHA was billed $368 per boat slip for water quality costs in June and each TKPOA member also received a “boat slip credit” for $368 in their account statement.

Just one more thing to untangle – In October 2020, the Board approved a 50% discount on the water quality dues for landlocked homeowners that are not on a body of water (east/west channels or Lake Tallac) and are not a member of Tahoe Keys Beach and Harbor Association. The basis for this is that it is felt that those properties do not receive as much benefit from water quality services. The discount went into effect January 1, 2021.

A more detailed explanation of how water quality costs are determined, and included in quarterly assessments for different groups of property owners, is contained in the Annual Disclosure.
