his August is the 12th month that I have served as TKPOA Board President. At the end of the month, three Directors will be elected to serve a two year term (September 2019 to the end of August 2021). I am very proud of the current members of the Board of Directors who serve the Tahoe Keys Community. Every Board member dedicates time and effort to understand the issues facing our Community to make policy decisions that benefit Tahoe Keys property owners. “I’m so stressed out!” Likely, someone has said this to you —or you’ve said it yourself. These days the word “stress” has a negative connotation. But what if it isn’t the actual stress that’s harmful, but how it’s perceived? Your Reaction to Stress Matters Research published in Health Psychology has shown that there’s a higher risk for premature death in those who perceive stress as negative, including those with only a minimal amount of stress. However, study participants who experienced a high level of stress, but didn’t perceive it as harmful, had a lower risk for premature death. These findings suggest that having a positive mindset about stress may help develop resilience. Avoiding stress may seem like a rational strategy, but this often leads to feelings of discontent. When you seek a stress-free life, you may develop feelings of inadequacy, loneliness, and depression because being stress-free is an unrealistic goal.

Turn to Your Life Values Generally, daily stressors are conflicts with our life values. Life values give us a foundation and sense of purpose. So in order to rethink your stress mindset, it helps to understand which values matter most to you. Take a look at the blue box at right, then take a few moments to reflect why each of these values is important to you. How do you express this value in your everyday life? How do these values support you in being true to yourself? Recall a past experience in which you overcame a stressful event or task. What value or part of you made that possible? Research illustrates that reflecting on your values in moments of stress can help reframe a negative, reactive mindset to a positive, reflective response. Becoming Mindful of Your Values To develop daily mindfulness around your values, write them down on sticky notes and place them in visible areas, such as your home, car, and workstation. When you notice stressors in your life, looking at your sticky note will help you mindfully reframe your reaction. This can help you “rise to the challenge” and face stressful situations with reason, logic, compassion, and self-control.

he Tahoe Keys Property Owners Association (TKPOA) has recently sent out two voting ballots for TKPOA Property Owners to cast their votes. What’s the “Buzz”, we need your vote! 2019-2021 Annual Board of Directors Election Ballot The first Voting Ballot is for our 2019-2021 Annual Board of Directors Election. There are three board positions up for election, the current Board of Directors whose two year terms that are ending this year are: John Gonzales – President, Sean Ward – Secretary, and Joe Sherry – Director. There are six candidates on the voting ballot: Denise Belisle, John Gonzales, Melvin Meyers, Fabian Moreno, Joe Sherry and Sean Ward. Board Members who still have one year left on their two year term are Robert Meyers – Vice President, Jim Siegfried - Treasurer, Dennis Daniel - Director, and Rick Wood - Director and their terms end in 2020. You have been mailed the Annual Election Letter, Annual Meeting Notice and Agenda, Ballot, and each candidate’s self-nomination form “Statement of Candidacy”, which can also be viewed on the TKPOA website at www.tkpoa.com. The balloting period for this election will close at 9:05 a.m. on Saturday, August 31st, 2019. If you elect to return this Secret Ballot by mail, the ballot must be received no later than 3:00 p.m. on Friday, August 30th, 2019. If you elect to return this ballot in person at the Pavilion Office, the Secret Ballot must be inserted into the ballot box prior to 3:00 p.m. on Friday, August 30th, 2019. If you elect to return this ballot at the Board Meeting, it must be turned into the Inspector of Elections no later than 9:05 a.m. on Saturday, August 31st, 2019. The Annual Election Ballots will be opened and counted at this board meeting by the Inspector of Elections and designated volunteers. The Director Election results will be announced and during this Board meeting, Directors will be seated.

“The Best Use of the Lake Tallac Lagoon Property” - Voting Ballot to Sell the “New Buildable Lot The second Voting Ballot is for the Membership Vote to sell the “New Buildable Lot”. You have been mailed the Ballot Letter, Ballot, Fast Fact Flyer and Lake Tallac Lot Location Map. With the time that has passed since the vote in 2016 to purchase Lake Tallac the current Board of Directors wants to follow through with the information provided in the original voting Ballot to conduct a TKPOA membership vote on this decision. At this time they have chosen to conduct a Vote of the TKPOA members to determine the next steps. All members are strongly encouraged to vote. Passage of the one of the proposed outcomes will be achieved by “YES” or “NO” vote of a majority of voting members as long as a quorum (509) ballots are received. The minimum number of approval votes required is 256. In order to be considered, ballots must be received by TKPOA no later than 4:30 p.m. on August 28th, 2019. Ballots will be opened and counted at the open Board of Directors meeting at the TKPOA Office on August 31st, 2019 starting at 9:00 a.m. The Voting Ballots will be opened and counted at this board meeting by the Inspector of Elections and designated volunteers. The results will be announced during this Board meeting. The Board of Directors or the Inspector of Elections may extend these dates up to two successive periods of thirty (30) days each if needed to obtain a quorum.

RESERVE STUDY Update

AT

the May 11th, 2019 Tahoe Keys Property Owners Association (TKPOA) Board of Directors Regular Meeting, the Board approved Hughes Reserves and Asset Management to perform a “Reserve Study Update including Site Inspection”. TKPOA Staff is pleased to report this “Reserve Study Update and Site Inspection” has been competed on June 7th, 2019, for all of the Association Common Areas and Townhome Cove Subdivisions. The “Reserve Study Update including Site Inspection” with Property Condition Assessment and “Capex Reserve Software” will allow the TKPOA Staff to complete the work toward the development of the 2020 Operating and Reserve Budgets. Since September 2016 the TKPOA Staff has worked with Hughes Reserves and Asset Management and their “Capex Reserve Software” to manage all 30 Year Reserve Funding Plans and 30 Year Component Expenditure Reports for the TKPOA Common Areas, Water Company, Water Quality, Channels & Lagoons, and Subdivisions with Reserve Funds and Townhome Cove Subdivisions. Hughes Reserves and Asset Management performed the “Reserve Study Update including Site Inspection”, to conform to Davis Stirling Civil Code §5550. They met with TKPOA Staff and reviewed available documents, including Reserve databases and other TKPOA records Keys Breeze

to develop a list of common elements/components that are covered by the Reserve budgets. They performed a site inspection to evaluate all listed common elements/ components, and reviewed the cost schedule for their repair/replacement. Hughes applied sound engineering judgment in considering alternative useful life, scheduling and/or construction materials and methods to optimize funding requirements, value and, to the extent possible, incorporated the TKPOA’s specific concerns and desires. The final Reserve Database Component report contains over 900 components for the 20 separate reserve funds each with a projection of the costs and expenses. The reserve study is not actually a "study" of the roofs, boilers, streets, etc. Instead, it is a list of the major common area components with an estimate of their remaining useful life. All Reserve component items come from initial construction or from upgrades and new projects and are added to the Reserve Component database replacement schedule. The Reserve component database is a framework for the accumulation and spending of funds for replacing the components of the Association and Townhome Cove properties. The Reserve funds are put aside over a period of time to ensure that adequate amounts are available to replace components when they need to be replaced either for deterioration or technological improvements. components, cost to replace, and remaining useful lives of the components will determine the Associations reserve expenses for replacement as part of each year’s annual assessment, during the budget development schedule. The funding reports available in “Capex Reserve Software” can provide calculations for the next 30 years. These funding reports allow TKPOA Staff, the Board of Directors and Cove Advisors to perform planning and analysis as well as “what if” scenarios to determine current and future funding. In California and every state except Hawaii there is no requirement to fund reserves at any particular level…….simply stated. The level must be "adequate” that leaves a great deal of latitude. The Board of Directors may dictate any amount they choose, that level may be "Prudent" to some and yet may fall short in other opinions. Hughes Reserves and Asset Management recommendations are simply that... A recommendation... Association Boards are not obligated to accept any reserve study preparers recommendations. Currently the TKPOA Board of Directors has adopted a “Prudent” funding model which means that the current Reserve Balance will cover the scheduled project costs for the next year. This is achieved through reserve assessment increases or special assessments. Per Civil Code §5550(a) it is recommended at least once every three years, that the Board of Directors conduct a reasonably competent and diligent visual inspection of the accessible areas of the major components that the Association is obligated to repair, replace, restore, or maintain. Reserve studies should be done by someone who specializes in reserve studies and in this case that is Hughes Reserves and Asset Management. This “Reserve Study Update including Site Inspection” was performed in conformance with the National Re-

serve Study Standards of the Community Associations Institute, the American Institute of Certified Public Accountants, and any state and local requirements, including California Civil Code Section 5300 and recent changes in, including, but not limited to: §5565, §5300(b) (4), §5300 (b) (8), §5550, §5560, §5300 (b) (3). Deliverables required is the “Disclosure” documentation in the format described in Civil Code §5570 for the 2020 Annual Disclosure to members with the printing deadline of September 25th, 2019. The primary reason for the existence of a Community Association or Common Interest Development (CID) such as the TKPOA is to “…preserve, protect and enhance…” the value and utility of the common areas and separate interests of every member or homeowner. The annual assessment is an investment in the common area facilities, amenities and member services, which contributes significantly to the value of the Members homes, property value, and lifestyle. Maintaining these Reserve Funds meets legal, fiduciary and professional requirements, along with the Davis-Stirling Common Interest Development Act, States Statues, regulations, and the TKPOA Governing Documents. The Reserve Fund Project list for 2019 Fiscal Year is posted on the TKPOA website at www.tkpoa.com. These are the projects that have been slated for the 2019 Fiscal year. or the 2019-2021 Board of Directors Election, there are three board positions up for election. For this election we have six candidates running on the ballot and they are: Joe Sherry, Sean Ward, Fabian Moreno, Melvin Meyers, Denise Belisle, and John Gonzales. Town Hall Forum On July 20th, 2019 the Tahoe Keys Property Owners Association (TKPOA) held a Town Hall Forum at the TKPOA Pavilion from 4:00 p.m. - 6:00 p.m. We are pleased to report that we had over 40 interested Property Owners in attendance. The following candidates attended the Town Hall Forum and answered questions from the TKPOA Property Owners in a rotating panel format: Joe Sherry and John Gonzales. Sean Ward, Melvin Meyers, and Denise Belisle attended via conference call. Board Candidate Fabian Moreno provided an RVSP notification in advance that he could not attend the July 20th, 2019 Town Hall Forum and advised that members with any questions may contact him via his information provided on his Candidate Statement form. The Property Owner audience questions that where asked of all Candidates present are as follows: 1. Explain why you are interested in serving as a TKPOA Board Member and what qualifications

What is your view on continuing to allow Vacation Home Rentals (VHRs) within the Tahoe Keys after Measure T goes into effect? 4. Are you for or against water quality charges for non-member owned boats with one exception per member if they don’t have their own boat? 6. Do you believe there should be any refurbishment or replacement of the Pavilion building? 7. The balloting period for this election will close at 9:05 a.m. on Saturday, August 31st, 2019. The City of South Lake Tahoe does not allow any open burning within the City limits. The exceptions to this are gas fireplaces and BBQ’s that use either LP gas or charcoal. NO BURNING OF WOOD, LEAVES, PINE NEEDLES, YARD WASTE OR BRUSH. The following is taken from the City of South Lake Tahoe (CSLT) Website: South Lake Tahoe Fire Rescue does not currently have a Fire Marshal. The fire prevention duties have been assigned to the Building Department due to budget cuts. All new construction and business inspections are conducted by the City’s Fire Inspector, who works out of 1052 Tata Lane within the Building Department. Tahoe Keys Lagoons Restoration Project

Historical Perspective and Site-Specific Conditions By Andy Kopania, TKPOA Water Quality Committee Chair

T

hrough the diligent efforts on behalf of TKPOA and representatives of the Tahoe Regional Planning Agency (TRPA) and the Lahontan Regional Water Quality Control Board (Lahontan Water Board), our application to treat aquatic weeds is moving forward to the detailed environmental review stage. The Notice of Preparation for the Environmental Impact Statement (EIS) and the Environmental Impact Report (EIR) was publicly released on June 17, 2019 and initiated a 45-day public comment period. Public workshops were held in South Lake Tahoe on June 25, 2019 and in Kings Beach on July 16, 2019. An informational presentation was also given to the TRPA Governing Board at its regular meeting on June 26, 2019. The public comment period ended on August 2, 2019, after which time preparation of the EIS/EIR will begin. While that work is occurring, it might be worthwhile to understand some of the background information related to the weed issue, how we got to this point, and what has been done to date to address the aquatic weeds. There are several key points that will be emphasized throughout this article. First, the presence of aquatic weeds in the Keys lagoons has been known for a long time – at least since the 1970s. Second, the size or scale of the infestation in the Keys is the most important factor in identifying and implementing a range of solutions to this challenge. Third, the TKPOA has been conducting field trials and other studies dating back to the late 1980s. Fourth, based on those studies, the preferred solution to address the aquatic weeds is selective removal of the target, or undesirable, species and not complete die-off of all species. There are native aquatic plant species in the Keys that are important for successful restoration of a healthy ecosystem and it would not be beneficial to remove those along with the invasive and undesirable weeds. To provide a little background on the Tahoe Keys, the development was first approved and permitted in the 1960’s, first by El Dorado County and subsequently by the City of South Lake Tahoe. Construction of the Keys pre-dated the existence of TRPA and many of the environmental regulations that exist today. The Tahoe Keys development consists

of 372 acres, about 170 of which are waterways. The three main waterways are the Main (or West) Lagoon, the Marina (or East) Lagoon, and Lake Tallac. There are currently 1,529 single family homes and townhomes within the Keys, although a development agreement with the City of South Lake Tahoe from 1970 allowed construction of up to 2,500 units. In addition, there is also a commercial marina (Tahoe Keys Marina and Yacht Club), a private series of boat docks (Tahoe Keys Beach and Harbor Association), and a private commercial center (Tahoe Keys Village) which are not affiliated with the TKPOA. The map at right shows the land ownership in and around the Keys. The U.S. Forest Service owns Pope Marsh to the west and some of the land along the south side of Lake Tallac. State of California-owned land in the Upper Truckee marsh to the east of the Marina Lagoon is administered by the California Tahoe Conservancy (CTC). The private marina, docks, and commercial center are present along the east and south sides of the Marina Lagoon. In the Main Lagoon, the Association owns some of the land under the centers of the channels on the east half, but the property owners in much of the Main Lagoon area actually own the land under the lagoons to the center of the waterways. The Association common areas, the land around the townhome developments, and Lake Tallac are owned by TKPOA. The aerial image of the Keys below has been marked with several colored areas to provide some perspective of the size of the Keys lagoons relative to other features around Lake Tahoe. As stated above, the Keys waterways occupy about 170 acres. Around the rest of Lake Tahoe, there are about 30 other enclosed marinas. Those marinas in total occupy about 20 to 30 acres. The area outlined in yellow in the main channel of the Main Lagoon on the aerial image is about 25 acres. Thus, virtually all of the other marinas around Lake Tahoe would fit inside the area outlined in yellow. The second largest marina on Lake Tahoe is the Tahoe City Marina, which covers 6 acres, or about 3% of the area of the Keys waterways. Eighty-five percent of all of the marinas around Lake Tahoe are one-acre or

less. The red rectangle outlining the west channel entrance covers one acre. Thus, 85% of all other marinas at Lake Tahoe would fit inside our west channel entrance. Fifty percent of all of the marinas at Lake Tahoe are one-half acre or smaller. The small green rectangle in the bottom center of the aerial image defines a half-acre area. To provide additional perspective on the size of the Keys waterways, a football field or youth soccer field is roughly one-acre in size. Thus, 85% of all other marinas at Lake Tahoe are the size of or smaller than a football field, while our lagoons have an area equivalent to about 170 football fields. Over the past 50 years, the TKPOA has conducted a substantial number of weed management actions and a great amount of research to address the weed infestation. In the 1970s, a water circulation and treatment system was installed to improve water clarity and April 2018 Hydro-acoustic scan results remove phosphorus, the primary nutrient supporting the growth of aquatic weeds. Our first weed harvester was purchased in the 1970s and replaced in 1983. In 1988 we conducted a field trial of a method called rotovating, which is basically a large underwater rototiller. The first studies of the effectiveness and selectiveness of aquatic herbicides for treating the undesirable aquatic weeds while preserving the desirable aquatic plant species were conducted in the 1990s. These treatment tests are referred to as mesocosm studies and additional iterations were also conducted within the last 5-10 years. In 1995 the TKPOA applied for the first time to the Lahontan Water Board to conduct a smallscale field test of aquatic herbicides in the lagoons, but that application was denied. By the 2000s, the degree of infestation had increased July 2018 Hydro-acoustic scan results appreciably. In this decade, the rapid spread of curlyleaf pondweed has introduced even greater challenges for management of aquatic weeds. The two maps at right provide an understanding of how rapidly and widespread the aquatic weeds grow within the Keys lagoons each year. Our AIS staff conduct surveys

called hydro-acoustic scans approximately monthly throughout the boating season. A hydro-acoustic scan is basically a fish-finder that has been modified to show the presence and density of aquatic weeds. The results of the scans are plotted on “heat maps”, where cool colors like blue and green indicate few if any weeds present while hot colors like yellow, orange, and red indicate dense weed infestations. The first map shows the conditions in April 2018. Most areas of the Main Lagoon are almost completely weed free and the areas of dense infestations are small and localized. However, within just three months, the July 2018 scan shows that dense infestations have popped up and spread throughout much of the Main Lagoon. Such rapid growth provides a real challenge to our current harvesting and fragment collection efforts. From 2013 to the present, we have continued to test new and innovative methods to minimize weed growth, reduce nutrient concentrations, and control the spread of fragments within and out of the Main Lagoon. The chart at right provides a listing of just some of the things that the TKPOA has conducted over the past few years. While the TKPOA has invested a substantial amount of resources in studies, tests, and field research, we are starting to get strong support from other agencies in the region. The League to Save Lake Tahoe was the first outside entity to join with the Keys to work on solutions, providing over $100,000 in direct funding to assist with installation of our bubble curtain and other actions. TRPA has secured up to $3 million in Lake Tahoe Restoration Act federal funding to address aquatic weeds, a large proportion of which will be used for environmental studies and field tests of eradication methods to help define and gain approval for a longterm solution for the Tahoe Keys. The Lahontan Water Board has also initiated necessary studies to address permitting requirements for approval of a long-term solution. The TKPOA Water Quality Committee sincerely appreciates the support and on-going efforts of these agencies.

Annual Homeowners Picnic By Heather Blumenthal, Operations Manager The 2019 TKPOA Annual Homeowners Picnic will take place on Sunday September 1st, 2019 from noon to 4pm. We anticipate 1,000 members to attend. The picnic will be held at the TKPOA Pavilion in the outdoor area next to the outdoor pool and the large park area next to the Office. There will be food, beer, wine, soft drinks, games and music by Sierra Gypsies for the entire family to enjoy. New for 2019, the TKPOA Board of Directors has approved a new ticket charging structure in order to defray some of the costs of planning and holding the annual picnic. Monies collected from the Picnic Entry Charge will be applied to the Common Operating Budget Annual Picnic Admissions Account 51910. Members and their guests will be charged $10 per person for entry to the picnic which includes lunch, unlimited beer, wine, and soda, and entertainment. Tickets for children will be $5 each and children 5 and under are free. Tickets became available for pre-purchase from the TKPOA Pavilion Office beginning July 15th, 2019 with cash, check, or credit card. Tickets may also be purchased when checking in the day of the Picnic with cash, check, credit card, or charged to the Property Owners TKPOA Account. Members are encouraged to take advantage of the pre-purchase option in order to keep the Check-In lines moving efficiently. Volunteers are needed to help in the production of the Annual Homeowners Picnic. The activities include planning and organizing the event with TKPOA staff and caterers, providing service at planned Dessert, Wine, and Beer Stations, and assistance monitoring entrance to the event. As a thank you for our picnic volunteer’s time and effort, those members that volunteer 2 or more hours of their time for the Annual Picnic will receive free entry for themselves. Boat, Jet Ski, and Trailer Parking Restrictions

It is that time of year again! The sun is shining, the lake is calling, and the boats, trailers, and jets skis are about to descend on the Tahoe Keys. In an effort to improve enforcement of TKPOA’s CC&R’s and Operating Rules, this is a reminder that boat, Jet Ski, and/or trailer parking or storage of any kind (street or driveway) is not allowed within the Tahoe Keys. These rules apply to single family and townhome subdivisions. Any boat, Jet Ski, or trailer parked or stored in the Keys is in violation of the TKPOA CC&R’s, Section 12; Vehicle, Boat, Trailer and Parking Restrictions. The following restrictions shall apply to the use, storage or parking of boats, trailers and vehicles within the Properties: (a) House trailers, motor homes, boats, campers recreational vehicles, commercial vehicles, vehicles having a gross weight in excess of one ton, Motorcycles, bicycles, vehicles undergoing repairs and trailers may only be parked or stored within the Properties in an enclosed garage except that such equipment may be parked for periods of short duration for purposes of loading and unloading and the Association shall be entitled to implement a guest or visitor pass system to permit Owners or tenants and the guests and visitors of Owners or tenants to park campers or motor homes within the Properties for periods not to exceed seven days. At this time, the Association does not have a guest or visitor pass system that permits Owners, Renters, or Guests to park or store a boat, Jet Ski, or trailer within the Keys for any length of time. The City of South Lake Tahoe (CSLT) has its own separate code enforcement for parking which is not enforced by TKPOA. COURTESY ENFORCEMENT New for 2019, TKPOA Staff has implemented a ‘48-Hour Courtesy Notice’ that will be placed on boats, Jet Skis, and trailers in violation of TKPOA’s parking restrictions. This ‘Courtesy Notice’ is not a violation against the Property Owner and serves as a reminder of TKPOA’s parking rules and restrictions while allotting the Owner time to move their boat, Jet Ski, or trailer in order to comply and avoid receiving a violation and potential disciplinary action with the Board of Directors. TKPOA Security Officers are tasked with enforcing provisions of TKPOA’s CC&Rs and Operating Rules for the benefit and quiet enjoyment of the Tahoe Keys for all Members, Guests, and Renters. Meetings and Approvals

At the July 20th, 2019 Board of Directors meeting, the TKPOA Board of Directors approved May Financial Statements, appointed members to a Budget Subcommittee, reviewed homeowner delinquent accounts, and approved lien notices for delinquent homeowners. Disciplinary hearings are generally held when a homeowner is delinquent on 2 quarterly assessments. At the July 23rd, 2019 Finance Committee meeting, the June 2019 Financial Statements were reviewed and approved for recommendation to the Board of Directors. Other actions taken by the Finance Committee: Reviewed

all delinquent homeowner accounts and homeowner accounts in collections, reviewed an analysis of the Legal Expenses incurred to date, and directed staff to close the Cove 1 Fire Claim Reserve bank account. LIGHTHOUSE SHORES Pedestrian Gate & Beach Access

e would like to remind all TKPOA Property Owners of the rules associated with the use of the pedestrian gate at Lighthouse Shores (LHS) Lot C and Lot A. Through recent Tahoe Keys Property Owners Association (TKPOA) Security Patrols and reviewed Security Camera footage, there have been violations of the Superior Court Case SV-92-0066 Judgement by TKPOA Property Owners and their guests in violation of the following: • Bringing dogs into LHS on or off leash • Allowing Guests or Vacation Renters to use their TKPOA Member Photo ID card for access to LHS Lot C without the immediate presence of the TKPOA Member • Trespassing on the adjacent LHS Properties NO DOGS No Dogs or other pets allowed in LHS. Please remember dogs must be on leashes throughout the TKPOA per El Dorado County Ordinance Title 6 – Animals, Chapter 6.04. General Provisions, Section 9.46.600. For the safety of your dog, TKPOA members and their guests please keep your dog on a leash. Dogs are welcome on their leash at the Pavilion Beach area. NO TRESPASSING When entering through the LHS pedestrian gate, you are on Lot C which is a narrow lot with Pope Marsh on the left and private residences on the right. TKPOA does not own the properties to the right of Lot C. This is private property and the No Trespassing law per California Penal Code 602PC applies. The City of South Lake Tahoe Police Department will be called for trespassing

on these properties. The TKPOA has clearly marked the property lines on the right of the lot. The left side of the lot has a chain link fence all the way down to the beach on the Pope Marsh side. Lot C can be used to access Pope Marsh on the left, however access to the beach on the right is prohibited as this is private property and to do so is considered trespassing (CA 602PC). Access to the right is also a dead end at the West Channel Bulkhead. During Lake Tahoe high water events there is typically no Public Trust beach access. To access Lot A at the end of the LHS roadway at the West Channel Bulkhead, you should walk down the LHS paved roadway. Pursuant to the Superior Court Case SV-92-0066 Judgement the TKPOA is responsible for the maintenance and security obligations in enforcing this judgement, and at this time the enforcement of these violations including trespassing violations on the adjacent LHS property will be pursued. Based on TKPOA Security Patrols and pedestrian gate Member Card reader identification system, the TKPOA has issued warning notices and in some cases, fines, to those members in violation of the LHS Gate Access as specified in the Superior Court Case Judgement. The TKPOA Board of Directors will continue to utilize the Member Discipline process in accordance with Civil Code Section 5855 and TKPOA Bylaws Article VI, Membership Rights Section 5, Article IX, Duties and Powers of the Board Section 1(r), and TKPOA Declaration of Covenants, Conditions and Restrictions (CC&R’s) Article XII, Breach or Default, Section 6 (a-f), to enforce this Superior Court Case SV-92-0066 Judgement, related governing documents, and rules.

The rules are straightforward. TKPOA Members should observe the following provisions pursuant to Superior Court Case SV-92-0066: TKPOA Members with a valid TKPOA Member Photo ID card and guests in the immediate presence of their sponsoring member will be permitted access. Access is only permitted to TKPOA property owners using their photo Member Access card issued by TKPOA. This card is not transferrable; it is not to be loaned or used by anyone other than the property owner to whom it is issued. If you have lost your card or wish to have another one issued, please visit the Pavilion office. There are no dogs or bicycles allowed, no exceptions. This is clearly posted on the gate and there are bike racks inside the gate. Access through this gate is allowed from 7:00AM-9:00PM except during the summer, during which time the hours will be extend to 10:00PM.

The LHS pedestrian and vehicle gates are under continuous surveillance and all TKPOA Member Photo ID Card access is recorded so it is easy to track any violations. Once the violations are identified with the responsible Property Owners through the Member Discipline Hearing process, TKPOA Property Owners could face their individual and property Member Photo ID card access privileges suspended, Member Photo ID Cards confiscated, and potential fines. The TKPOA is requesting that all property owners please respect these rules so that we can all continue to

enjoy this privilege of accessing Lot C and Lot A. Continued violations and flagrant abuse of these rules could result in legal claims against the TKPOA and potential gate closures.
