Our frameworks are free to access by all public sector organisations and are fully compliant with the Public Contracts Regulations 2015

• User guides can be downloaded from the website and contain all the necessary information about the framework including the awarded suppliers

• Complete the Customer Access Agreement form found within the user guide, and submit to us for approval to receive the relevant framework documents

• Customers can choose to direct award for a quick, easy and compliant route to market, or run a further competition depending on your requirements

• Whichever route you choose, the team are on hand to support throughout the whole process

How does direct award work?

Choosing to direct award is always down to the customer to decide.

To help you know if it’s the best approach for you, look to see if you can say yes to one of the criteria detailed in the user guide. For example:

You have an existing contract with an awarded supplier

Only one of the awarded suppliers can provide what you need

You can identify one of the suppliers offers you best value

Supplier can meet the customers timescales

The supplier achieved the highest total score during the evaluation process

Are any of these applicable? If yes, you may be able to direct award without needing to do a further competition or get three quotes – it’s as simple as that!

How does further competition work?

• Complete the Customer Access Agreement form found within the user guide, ensuring the further competition option is selected. This form should be signed and submitted for approval

• Once approved, the customer will be sent the relevant framework documents including the further competition template

• The customer can use their own further competition documents, or the template can be utilised and adapted to include the customer’s specification and requirements

• A realistic timescale should be set for each step of the further competition. Adequate time will need to be allowed for any clarification questions to be answered, for responses to be submitted, and for evaluation of the responses

• All capable suppliers awarded to the framework must be invited to respond to the further competition, and each response should be evaluated in line with the scoring methodology set out in the further competition response section

• The supplier who achieves the highest total score should be awarded the contract

• The team can offer assistance and advice if required

The customer is strongly advised to carry out their own due diligence before selecting whether they conduct a further competition or direct award with any of the awarded suppliers.

The customer will determine the requirement, specification and award, based on the most advantageous tender. Placing an order with any capable supplier awarded on the framework, without re-opening competition, following the criteria set out below.

Regulation 33(8)(a) of the Public Contracts Regulations 2015 (PCR 2015) sets out the criteria for making a direct award where a framework is concluded with more than one supplier:

• All the terms governing the provision of the works, services and supplies concerned are set out in the framework

• The objective conditions for determining which of the suppliers on the framework shall perform them are set out in the procurement documents

In accordance with the above regulation, direct award orders may be placed under a framework provided the customer can meet any one of the following objective conditions:

• Customer is satisfied that, following their own due diligence, they can identify the supplier that offers best value for their requirement

• The supplier is able to supply the required goods/services within the customer’s timescales

• The supplier achieved the highest total score during the evaluation process

• Goods/services required are unique/exclusive to one supplier

• Continuity of existing goods/services from an awarded supplier

Further Competition

Benefits of choosing further competition

Most of our frameworks offer customers the opportunity to run a further competition among the suppliers listed on the framework

Drives competition and value, particularly for high-value or complex goods and services

Tests the market to find the right solution at the best price

Helps you – the customer – understand the alternatives available

Gives a thorough, fair and open route to find the best price

Creates a compliant audit trail

Re-opening competition with all the capable suppliers awarded on the framework to determine the most appropriate supplier for a defined period of time or project. The customer may choose to implement, amend or provide alternative terms and conditions. Any such amendments or alternative terms and conditions will be contained within the further competition documents and/or the order/individual contract

In order to adhere to ‘The Public Contracts Regulations 2015’ when re-opening competition under this framework the customer should follow the steps below:

1 The customer must invite all suppliers on the framework who are deemed capable of delivering the particular requirement

2 The customer shall be responsible for formulating a specification/product brief containing full details of the work/products required

3 The customer will send the specification/product brief to all suppliers quoting the framework reference number. A reasonable and proportionate time limit should be set for the submission of fully completed tender responses

4 Responses received must be kept in a secure place, unopened, until the designated closing date and time for final submissions has passed. Responses received after the specified date and time should be rejected unopened

5 The submitted response shall be evaluated in accordance with the criteria stated in the original specification/product brief. The headline criteria used must be the same as the headline criteria used for the original framework or part thereof, but the customer may change the weightings and add their own sub-criteria to apply

6 The tenderers must be advised of the result in writing including brief details on where they scored points and where they did not

7 A required ‘standstill period’ does not apply to further competitions held under a framework. However, it is advisable to hold a standstill period in relation to a further competition as it is possible a supplier may challenge the decision and apply to court for a ‘declaration of ineffectiveness’ which could lead to the individual contract being terminated and possibly a fine or compensation claim

8 There is no scope at the further competition stage to select on the basis of general financial and economic standing or technical ability, as these issues have been addressed as part of process to establish the framework. However, this does not mean financial due diligence should not be undertaken if considered appropriate (e.g. obtaining a report on a suppliers financial standing from an appropriate agency) as long as this does not form part of any selection process

What does the framework cover?

The framework will consist of 3 LOTs.

Portable Appliance Testing (PAT)

A portable appliance is an item of electrical equipment which is connected to the power supply with a flex and a plug. This includes computers and their components. Testing engineers will inspect, test and certify all your portable appliances as well as providing advice as to their condition and safety. A written report will be provided as evidence that they have been inspected and tested for electrical safety.

Fixed Installation Testing (FIT)

A fixed electrical installation includes all parts of a distribution system from the main incoming supply point through to wiring accessories such as sockets and light fittings. A thorough visual inspection will be carried out along with electronic tests. Any potentially dangerous defects will be identified. A written inspection report will be provided as evidence that electrical devices have been inspected and tested for electrical safety, the report will also contain information on any defects or deviations from the British Standard that were identified during testing.

Electrical Testing of Street Lighting and Street Furniture

Each street lighting asset, illuminated signs/bollards and similar street furniture that requires electrical testing will need to have as a minimum the following tests carried out and the results recorded in electronic format;

• Visual inspection to establish the condition of all electrical components, fixings, wiring and terminations, and integrity of the column door and surround;

• Verification of correct rating of protective device, continuity of protective conductors and earth bonding;

• Insulation resistance between live/earth and neutral/earth with assembly wiring disconnected;

• Earth fault loop impedance at District Network Operator supply cut-out;

• Capacitance test shall be carried out and the results of measured values recorded against stated values.

Length of an Individual Contract

In accordance with the ‘Public Contracts Regulations 2015’ individual contracts based on a framework are to be awarded before the end of the term of the framework itself. The duration of the individual contract does not need to coincide with the duration of the framework, but might, as appropriate, be shorter or longer. In particular, the customer is allowed to set the length of individual contracts based on a framework taking account of factors such as the time needed for their performance, where maintenance of equipment with an expected useful life of more than four (4) years is included or where extensive training of staff to perform the individual contract is needed.

The individual contract terms and conditions will apply and will remain in force after the expiry of the framework until such time all individual contracts expire or are terminated.

Services will be confidential and suppliers staff must be qualified and competent to carry out any intended services. Advice and support to be carried out is to be ensured that the any employees work performance, health and wellbeing is impacted as little as possible.

What does the framework cover?

Our Flex Electricity framework has been developed through our clear understanding of your needs and challenges when it comes to procuring electricity. It provides a framework agreement under which electricity for half hourly, non-half hourly metered and unmetered supplies could be purchased flexibly.

The frameworks have been procured in accordance with the Public Contracts Regulations of 2015, as amended (PCR2015). Kent County Council remains the Contracting Authority for all LASER contracts. This permits a public body to access LASER’s frameworks and services without the need to run a separate procurement process to do so.

The framework permits direct award to any supplier based on either coming first overall, being your incumbent provider or by winning a particular evaluation section which is of most importance to your organisation. What does the framework cover?

What does the framework cover?

If your organisation is looking for compliant suppliers to support your journey to net zero, our Zero Carbon framework (DPS) will help you find them.

The (DPS) focuses on the consult, design and install elements to help you achieve your aspirations covering a range of zero carbon solutions from surveys, planning and management, to solar PV, heat pump systems, battery storage and more. Our Dynamic Purchasing System (DPS) enables you to procure compliantly with a route to market that is continuously evolving by allowing suppliers to join the (DPS) throughout its lifespan.

The Zero Carbon Framework (DPS) was created to provide you with a procurement route for a very wide range of technical consultancy support to plan and specify activities along with access to expert suppliers and installers of the technology. The framework is arranged into four lots as outlined below:

LOT 1 – SITE SURVEY AND MODELLING

This LOT is designed to help you understand your buildings performance and practical opportunities through surveys and modelling. You will have access to consultants to provide energy and/or carbon related site surveys, audits and assessments.

LOT 2 – ENERGY/SUSTAINABILITY MANAGEMENT CONSULTANCY

If you’re looking for high level feasibility and planning of carbon saving programmes, for example the focus is on large projects such as solar farms or complete fleet vehicle programmes. This LOT will enable you to have access to net zero specialist consultants to support the planning and management of this for your organisation.

LOT 3 – TECHNOLOGICAL SOLUTIONS CONSULTANCY

This LOT specialises in providing consultants for specific technical solution design, specification and capability feasibility.

LOT 4 – TECHNOLOGICAL SOLUTIONS DELIVERY

Designed to allow access to suppliers who are capable of supplying and installing low and zero carbon technological solutions.

What does the framework cover?

We introduced our Water Framework in 2017 to help our non-domestic customers to change their water and wastewater supplier following the opening of the water market to full competition. Our focus is helping our customers to benefit both financially and logistically from this new market.

Our framework focuses on the retailer supply of water and sewerage services and with three different routes to market and a selection of suppliers providing national coverage, it provides everything you need to procure a new water supplier.

Direct award is possible too, as is procurement through mini-competition or competitive dialogue. Plus, access to the additional services of AMR provision and Fix and Find water leakage services are also available.

What does the framework cover?

If you’re wanting to upgrade your lighting system and want to use trustworthy and compliant suppliers to help you not only source your new light fittings but potentially install it too, then our LED Framework is here to provide the pathway to help you achieve this.

This framework covers all major product manufacturers and significant volume discounts with installers capable of delivering a nationwide service.

We have two options available on this framework depending on your requirements, and can help you select the most appropriate route for your requirements.

Managed Access – This is where we can do all the hard work for you by managing the entire process tailored according to your organisation’s needs. From offering free site surveys, production of a project specification with energy saving calculations, to assisting with the business case, procurement of fittings and installers, project managing the installation including health & safety requirements, and acting as Principal Designer on the project on your behalf.

Direct Access – For those customers who wish to develop and manage their own projects directly there is the option to access the framework directly. By taking this option you will have responsibility for managing all the steps such as specifying the products you require, agreeing the pricing and ensuring that your organisation is achieving value for money.

LASER’s Flexible as and Electricity Procurement Frameworks for 2020-2024 provide an OJEU compliant route to arranging procurement and supply of gas and electricity. In addition, through the LOT 2 option there are opportunities to take advantage of a number of additional services relating to energy usage, storage, savings and other innovative industry solutions to help manage your energy category and reduce costs. Participating authorities wishing to access additional services independent of their supply arrangement may source them through the additional services LOT. A mini competition can be run under the framework in order to select a supplier most suited to the customer’s need. LASER can assist in writing and/or running the mini tender process.
