Family law mediation – a better approach hanges to the law make it necessary for parties to attempt mediation prior to filing applications in the Family Court after the breakdown of a relationship. These changes have been a long time coming and mark a new and better approach.

Parties benefit from an experienced mediator facilitating them communicating with their former partners in a protected setting and finding new ways of approaching the issues that they are facing. The mediator will conduct confidential sessions with each party, to answer questions and help them prepare for the mediation. Then, on the day of the mediation, the parties will briefly explain what has brought them there, the impact, and what they would like for the future. The mediator will reflect back what the parties have said, then create an agenda of issues to discuss. The parties choose topics and discuss how they affect them. opportunity to express themselves in this way, they are in a better frame of mind to look at ways to settle their disputes. After exploring the issues, the parties break into confidential sessions with the mediator. They then reconvene and discuss options, taking into account both parties’ issues, then reality check them to see where there may be agreement. Where there is an agreement Consent Orders can be drafted which can be filed in the Family Court. Mediation is cost effective, successful and allows parties to have input into what happens to their children and their assets as opposed to spending tens of thousands of dollars and years in litigation and having someone who knows nothing about the parties making decisions which are often unsatisfactory to both parties.
