Fertility clinic offers 2 for 1 deal! By Dr Vince Chapple (Medical Director) at Fertility North, Fertility Specialist at Fertility Great Southern his is an example of the kind of advertisement that you will not see from an Australian Fertility Clinic. Infertility care is very heavily regulated in Australia under the auspices of the Reproductive Technology Accreditation Committee (RTAC) and the Reproductive Technology Council (RTC), the latter reporting to the Western Australian Government.

T

Clinics are obliged to have policies in place to “minimise the incidence of multiple pregnancy”. This is one reason why your fertility specialist may refuse to allow you to transfer two embryos instead of one as part of an IVF treatment. Interestingly, prospective parents often see twins as something like the title of this article suggests, a very favourable outcome, with 25% still preferring a twin pregnancy despite active education highlighting the risks. Even with this patient preference, Australia has pioneered the worldwide movement towards single embryo transfer (SET), with more than 65% of embryo transfers being single, leading to the lowest IVF-related twin birth rate in the world (8.8%). This is comparable only with Sweden, and contrasts starkly with that of the USA (2.8% SET and 30% twin rate) and UK

(10% SET and 20% twin rate). The SET policy was introduced to avoid the situation that is seen in these countries where fertility treatment is less regulated, and three or four embryos may be transferred as part of IVF treatments. This is partly driven by a desire to maximise the chance of pregnancy for a single treatment, as an entire family might be contributing to its cost, and can only afford one treatment cycle. In Australia this scenario is less common, as treatment is generously co-funded through the Medicare safety-net, making it affordable for many more. Multiple pregnancy takes a high toll on mothers, babies and the community. It increases the risk of all pregnancy related complications, operative deliveries and premature births, with associated health problems for surviving children and increased obstetric costs. So although a joy once safely delivered, from a medical perspective multiple pregnancy is regarded as the most common adverse outcome of IVF rather than a good deal. Separation – Property and Children: How Best to Manage It f you separate from your partner, and you have children together, you both have a continuing responsibility for the care of your children. So, what are the options when it comes to working out the care arrangements for the children?

I

Initially, you will both be encouraged to attend mediation to discuss your options. The arrangements may include who the children live with, when they see the other parent, other contact (such as phone calls), arrangements for special events, schooling, religion and medical care. If you are able to reach agreement on the arrangements at mediation, you may be encouraged by the mediator to draft and sign a Parenting Plan. However, a parenting plan by itself is not enforceable if one party chooses to ignore it. As solicitors dealing with such matters, Kott Gunning Lawyers encourages parties to reach agreement but they strongly

recommend formalising any agreement by filing an “Application for Consent Orders” with the Family Court of Western Australia. This does not require you or your lawyer to attend court. It simply needs to be filed at the Family Court and, assuming it is in the best interests of the children, the court will make your agreement legally binding and enforceable. Similarly, if you and your partner reach agreement on the division of your property, you can also include this in your application. Where you are negotiating your own settlement, it is recommended that you both seek legal advice on your rights and entitlements to ensure that the agreement is fair, taking into account all of the circumstances and relevant factors.
