Separation: What about my child’s wishes?

W

hen parties separate and parents cannot agree on the future arrangements for the child including whom the child lives with and how much time they spend with the parties, who makes those decisions? Parents are often faced with a child expressing a wish of where they prefer to live or how much time they want to spend with the other parent. So how much weight is, or should be, given to those wishes? If parents cannot agree on the future arrangements for the children, the Family Court is required to consider what is in the child’s best interest. Whilst the Family Law Act does not prohibit children from giving evidence, leave of the court must first be obtained and there has only been a few instances of the court allowing a child to give evidence in proceedings. The court generally considers a child should be removed “as far as possible from parental conflict”. In an effort to do so, and ensure that undue pressure is not placed on a child by asking them to participate in the proceedings, the court can allow a child the opportunity to express his or her wishes by

appointing either an Independent Children’s Lawyer, Single Expert and/or Family Consultant to interview a child and ascertain their wishes. This attempts to ensure that the level and kind of participation sought is suitable for the needs and capacities of the individual child. In accessing the capabilities of the child, or how much weight should be attributed to his or her wishes, there is no hard and fast rule. However, the general approach is, the more mature and older the child is, the more weight the court will likely place on their wishes. The court is mindful of the difference between what the child wants and what he or she needs, as often this may not be in the child’s best interest. Therefore decisions regarding future arrangements for a child will not solely rest on any wishes expressed. Located across the road from its existing school, the new facility will feature four training floors so parents can train at the same time as children, and will allow Premier Martial Arts to offer an improved timetable with more than 130 classes per week.

Homework Zone has been established to support families by providing dedicated community homework space under the care of experienced and qualified teachers. Their experience in assisting students mak e the most of their time and the task at hand will benefit children with a variety of learning strengths and challenges. Homework Zone is a group homework club for Primary School students in Year 3 through to Year 6. Open on Monday to Thursday, students are guided through a series of study skills and habits while completing their set homework.

Igniting kids’ imagination

P

yjama Drama is a fun, creative drama programme combining drama, movement, music and imaginative play. Classes are aimed at children up to seven years and are designed to ignite key social skills such as concentration, co-operation, confidence and communication by igniting the imagination. Teachers provide weekly classes, children’s parties, events, visit schools and day care centres, and deliver holiday workshops. Imagination is at the heart of everything they do - they passionately believe that a well-developed imagination is one of the key building blocks for a successful and happy life. Their classes are packed full of song, music, games and of course lots and lots of

pretending! And, as the drama is child led, you can never be quite sure what will happen next. All sessions have been written in line with the Early Years learning framework.
