he number of those searching for Country Houses on our website has recently hit a 6 month high. Such interest is now resulting in increased viewings with offers being received for a wide range of property. The significant growth occurring in the prime London residential market has yet to find its way to the East Midlands, however, our close relationship with the Capital and National Press have assisted in some sales. Whilst lenders continue to demand ever tighter criteria when lending we have found our ability to support recently agreed sales, with comparable completed transactions, has resulted in the vast majority of our sales proceeding to a satisfactory completion. The attraction of property with land continues unchecked and we believe this will continue whilst there remains a scarcity of such homes on the market.

New Frontiers Shawish secured the copyright for the all-diamond ring one year ago in Geneva. It took one year to get the copyright and Shawish had to undergo multiple tests with the design to get the precision of the circle right using special laser equipment to cut directly into the diamond. “The most important aspect ispreserving the integrity of the diamond and of course the most difficult phase is precision cutting an entire stone into a ring.” Shawish is now in search of the perfect hand to create the £43million, 150-carat masterpiece.

Red Devil The third edition arising from the committed partnership between Hublot and Manchester United, Steven Hall took a trip to Manchester and the hallowed turf of Old Trafford to see the new Hublot, King Power being unveiled. KINGWEST | 63
Featuring new technical details, and equipped with a new chronograph movement with two centre chrono hands providing better readability, the King Power Red Devil is a fine symbol of fusion and innovation, paying tribute to this most legendary of football clubs. At 6 pm on 7 May 2011, the day before the match against Chelsea, the hallowed turf of Old Trafford - the scene of so many victories, so much excitement and effort - has been chosen by the Manchester United players, Sir Alex Ferguson and Jean-Claude Biver, CEO of Hublot, to host the presentation of the new King Power Red Devil to the international press. In tribute to one of the world’s most famous football clubs, for which it has been Official Timekeeper since 2008, Hublot has developed a King Power equipped for the first time with a chronograph movement distinguished by two centre chrono hands. This makes for better readability - quicker and more efficient. The wearer can keep track of both hands at a glance; the first indicates the seconds, and the other hand, specially developed for football, indicates the time elapsed out of the 45 mins in each half. With a sapphire dial, the movement – here in an Aero Bang version - has also undergone new skeleton working, leaving it more open to reveal even more of the working parts of the watch and its fine mechanics. The topside retains only the material necessary for it to function. This is coated with black ruthenium for a beautiful overall effect of homogeneity, and clearer reading. Predominantly red, the minute track, a time counter at 9 o’clock and a date window at
4 o’clock round off the piece, stamped with the famous, slightly rebellious Red Devils emblem at 3 o’clock. In a nod to Old Trafford’s more than one hundred year-old turf, the focus of all attention, the watch indexes come in a natural grass-green colour, obtained using real blades of grass from Old Trafford, picked and preserved especially by the club’s groundsmen for the making of this limited series. It took Hublot 6 months of development to stabilise the plant material and its original colour, including against UV and temperature differences. The freeze-dried blades of grass were inserted into the indexes through an all-new process, then coated with a special transparent lacquer to secure them permanently. The King Power case – 48 mm in diameter, and here in micro-blasted black ceramic or in 18K King Gold - has been revamped. Its two push-buttons have been redesigned, and are now each protected by a little safety bar, which is completely built in either side of the crown. Moreover, in a final reference to the legendary club and bringing a last aesthetic touch to the piece, the black rubber strap has a red line in the centre, directly inspired by Manchester United’s graphic charter. This limited edition is produced in 500 numbered pieces for the micro-blasted black ceramic version and in 250 pieces for the King Gold 18K version. Every watch is accompanied by a certificate guaranteeing its authenticity, signed personally by Sir Alex Ferguson.

Survey and valuation
The Knotweed Problem Japanese Knotweed (Fallopia Japonica) was introduced into Britain by the Victorians as an ornamental plant. It was actually awarded a gold medal at a prestigious flower show. It was never pretty; however, and hid a sinister secret at that time. The 1907 edition of “The English Flower Garden” by John Murray referred to it as being “easier to plant than to get rid of in the garden”. The plant is now labelled by the International Union for the Conservation and Nature as one of the world’s 100 most invasive species and the Government estimates that it costs more than £150 million to control in the UK each year. It has now spread across the UK, particularly along watercourses, transport routes and waste ground. Japanese Knotweed is a perennial plant tall, vigorous and invasive. It is a member of the dock family with distinctive hollow bamboo like stems covered in purple specks, often reaching 3 metres in height. Leaves have a flattened base and pointed tip lying on arching stems in a zigzag pattern, ie, not directly opposite one another. The plant generally flowers around late August to early November with masses of small white flowers hanging in clusters from the join of the leaf with the stem.
The underground root system is thick and woody, sometimes extending down to almost the height of the plant above ground level and up to abut 7 metres or so from the base of the parent plant. In the winter the leaves eventually die back to orange/brown covered woody stems. During the early spring Knotweed sends up new shoots red/purple in colour with rolled up leaves. The shoots grow with extreme rapidity in many cases and growth rates of around 2½ cm a day are common. Japanese Knotweed also produces significant levels of plant waste, as it decomposes only very slowly indeed. It has a tendency to grow in thick clumps, excluding and shading out native species and to the detriment of native wildlife. Why is it a problem? The plant causes damage to buildings and hard surfaces. Greenhouse trials have shown that as little as 0.7 gm of root material can produce a new plant within 10 days. It has the capacity to penetrate through tarmac and concrete and there have been instances where the plant has even pushed up through ground floors of residential properties. It is very difficult to control and expensive if ignored. It smothers native plants, damages wildlife and spreads rapidly. Because of its regenerative properties and invasive habit, Japanese Knotweed is listed under the Wildlife and Countryside Act 1981 as a plant that is not to be planted or introduced into the wild. The Environmental Protection Act 1990 also lists it as controlled waste to be disposed of properly and not, for instance, deposited at a composting waste site.
Specific problems caused by Japanese Knotweed are damage to paving and tarmac areas, damage to archaeological sites, damage to river banks and flood defence structures, structural damage to buildings and other facilities/amenities, a reduction in biodiversity, obstructing visibility and access on roads and paths, increasing risks of flooding and reducing land values. Banks and Building Societies, already nervous owing to the ongoing financial crisis, are turning down mortgage applications if Japanese Knotweed is deemed to threaten a property. A plant does not even have to be within the boundaries of the residential dwelling for which a mortgage is being applied. Knotweed is a serious problem that can cause significant damage to structures and does not respect boundaries. To a degree the damage that the plant may cause to buildings is perhaps less understood than the effect of its presence upon a potential development site. The development site situation may in fact be less problematic in the long run if the plant can actually be removed, though this is by no means straightforward. There is no simple way to eradicate it as attempting to dig out the plants either by hand or by mechanical digger may make the situation worse, unless followed up by long term herbicide application. Cutting or pulling stems is not effective against large clumps and indiscriminate use of herbicides can cause harm to adjacent habitats/plants. Japanese Knotweed is thus indeed a ‘knotty’ problem. There can be significant implications upon discovery both in terms of the legal situation and its perceived or actual affect upon buildings and habitats. ‘The Green’ Common Agricultural Policy The World population reached 7 billion in 2011 and is predicted to rise to 10 billion in 90 years time¹. Whilst this seems a long way off and there will be many reforms of agricultural subsidies (including perhaps complete removal), between now and then the clear message is that the need for food and energy is steadily increasing; and success or failure to supply this need can make or break Governments. It is therefore puzzling that as the current round of CAP Reform discussions get underway, following the release of the EU Commission’s draft reform proposals on 12 October 2011, the underlying tone is for further land to be managed purely for environmental reasons. A backward step? The key elements of the draft proposals are: • R eplacement of the Single Payment Scheme with a ‘Basic Payment Scheme’ with effect from 2014; • C apping of direct payments dependant on scale of farming; • C rop diversification – 3 crop rotations on arable land; • P ermanent Grassland – permanent grassland to remain permanent after 2014²; • 7 % of eligible land to be managed for environmental benefit³; • Y oung Farmer Support The main cause for concern is the “greening” effects of the proposals which principally include a minimum 3 crop arable rotation and an additional 7% of the land area being managed for environmental purposes. The ability to manage land sustainably so that its productive capacity is maximised whilst ensuring that the environment is well managed and cared for is not for debate; it is a given. But is it really necessary for CAP funding to be subject to further ‘greening’ in order to make it palatable to
the electorate and the EU’s budget makers, when there is a clear need for greater levels of food and energy production? Managers of UK farmland have to balance their role in both food and energy production. Short of embarking on a programme of land reclamation along our coasts, the land area we have is what we have; they are not creating anymore! Hardly surprising then that the UK land market continues to trade at strong levels; particularly as investors looking for alternatives see land as a considerably safer option than other investments. The EU Commission will state that its role is to balance the needs of 27 member states, not just the needs of the UK. Whilst this is true, the principle objective of the continuing CAP discussions/negotiations must surely be the need to apply common sense to these draft proposals. ‘One size fits all’ may not be feasible and it will be for DEFRA and industry representatives from the UK, principally the NFU and CLA, to argue the case for a more balanced approach which recognises the need for greater food and energy security for an ever growing world population. However, with a full-blown Eurozone crisis being played out as we write this article, clarity and stability will no doubt be required on the EU budget as a whole before any meaningful discussions can be had on the detail of the CAP.

The Future of Planning It is a very rare occurrence for planning to be so high profile, but in 2011 planning was regularly making the headlines of the national broadsheets and on the main news bulletins. And why was that, well significant changes were proposed which would potentially affect how the planning process was to be implemented. Since then the Localism Act has come into effect implements further legislative changes to the planning system including the much heralded abolition of the Regional Strategies and the introduction of Neighbourhood Plans. More recently in 2012 the National Planning Policy Framework has been published which condenses over 1000 pages of policy guidance into less than 50 pages. The main emphasis of the framework is the presumption in favour of sustainable development although the statutory status of the development is still the starting point for decision making. Where a proposal for development is in accordance with the development plan then approving that proposal should be made without delay. Where a development plan is absent , silent or relevant policies are out of date planning permission should be granted unless there are identified adverse impacts which would outweigh the benefits or there are specific policies in the framework that indicate development should be restricted. The onus is therefore on the Local Planning Authorities to have up to date Local Plans in place as soon as reasonably possible. Past experience suggests that any change to the system takes significant time and resources to implement. The 2004 Planning Act envisaged that all local planning authorities would have their Local Development

Frameworks in place by September 2007. To date it is estimated that as few as a one third of local planning authorities have an adopted Core Strategy. Many local authorities have been reluctant to progress the preparation of their Local Plans, as they did not know what form they will take although it is now likely that there will be a flurry of activity on this front. However in the interim serious consideration should be given by all those with potential development opportunities as to whether there is merit in the submission of a planning application where a proposal ticks all the sustainable development criteria and particularly, in respect of residential development where the local planning authority may not be able to show a 5 year supply of deliverable housing sites, which is given added weight in the framework document.. As the plan led system will remain and the emphasis will be on local planning authorities to prepare their development plans, the well-known adage will apply even more than ever, ‘you have to be in it to win it’.
Sites will need to be promoted through the relevant planning documents to ensure that they are considered by local planning authorities. If the land is not promoted through this avenue, it will give the local planning authorities good grounds for refusing any planning application within the plan period, which could be as long as 15-20 years. It is therefore vital that we are aware of the sites you wish to promote so that we can protect your best interests. The changes to the planning system will further increase the importance in adopting a clear and well thought through planning strategy when seeking to obtain planning permission or realise development potential. The role and involvement of the planning professional has never been more significant.
