Code of Practice for the Pastoral Care of International Students Liston College has agreed to observe and be bound by the Code of Practice for the Pastoral Care of International Students published by the New Zealand Minister of Education. Copies of the Code are available on request from this institution or from the New Zealand Ministry of Education website at: www.minedu.govt.nz/goto/international

Withdrawals and Refunds of Fees

All refunds of tuition fees to International Students withdrawing from Liston College are at the discretion of the Board of Trustees. Application for refund must be made in writing to the Board of Trustees setting out the special circumstances of the claim. Refund of Tuition fees If a student decides against coming to Liston College, tuition fees will be refunded minus a NZ$500 administration fee. Once an International Student has arrived in New Zealand, refunds (less a NZ$500 administration fee) will be made only in the most exceptional circumstances (i.e. return home because of serious illness or death of a close family member) and then only partial refund may be made as the School will have incurred costs on the student’s behalf for the whole year. The refund policy of the Liston College Board of Trustees is set out below, based on Section 4B(7) of the New Zealand Education Amendment (No.4) Act 1991. In arriving at their decision, the Board of Trustees will take into consideration the special circumstances of the withdrawing student and; • Costs already incurred by the Board. • The salaries of the teachers and support staff and any other components of the fee committed for the duration of the course. • An amount which covers the use of facilities and resources to the date of the withdrawal. • The proportion of the Government or the Catholic School Levies the school is required to pay. • Any other costs already incurred. Please note: • No refund will be made to a student who is excluded from the school by the Board of Trustees¹. • International Students who gain permanent residence or parents who gain work visas after the course has commenced will not be eligible for a refund.

¹ Where a student is excluded from Liston College, the costs associated with the return journey home will be the responsibility of the parent or guardian, not Liston College.

Homestay Fees Outstanding homestay fees will be refunded if the contract for tuition at Liston College or its contracted homestay agency, is terminated. Two weeks notice, or payment of two weeks fees in lieu of notice, must be given. The placement fee is not refundable. How to apply for Refunds All refunds of tuition fees to withdrawing International Students are at the discretion of the Liston College Board of Trustees. Applications for refund must be made in writing to the Board of Trustees, setting out the special circumstances of the claim, such as return home because of serious illness or death of a close family member. This application should include any supporting documents (eg. medical certificates, tickets for return journey etc.)

Immigration: Full details of visa and permit requirements, advice on rights to employment in New Zealand while studying, and reporting requirements are available through the New Zealand Immigration Service, and can be viewed on their website at www.immigration. govt.nz Eligibility for Health Services: Most International Students are not entitled to publicly funded health services while in New Zealand. If you receive medical treatment during your visit, you may be liable for the full costs of that treatment. Full details on entitlements to publiclyfunded health services are available through the Ministry of Health, and can be viewed on their website at www.moh.govt.nz Accident Insurance: The Accident Compensation Corporation provides accident insurance for all New Zealand citizens, residents and temporary visitors to New Zealand, but students may still be liable for all other medical and related costs. Further information can be viewed on the ACC website at www.acc.co.nz Medical and Travel Insurance: International students must have appropriate and current medical and travel insurance while studying in New Zealand. Students can either have a cover arranged by Liston College or produce evidence at the time of enrolment that they have insurance cover from another company that meets the Code requirement. Introduction About Liston College Liston College is a small friendly Boy’s College of 800 Year 7 to 13 students (10 -18 years), conveniently located in the heart of Waitakere City only 15 minutes from downtown Auckland City. Waitakere City is well known for its surf beaches, bush walks, rural character and recreational facilities and mild climate, while having a number of large shopping centres throughout its suburbs. The College is set in spacious grounds and well resourced with up to date teaching and English Language support facilities as well as specialist rooms, including art and computer rooms, science laboratories, music suites, technology workshops and gymnasium. Liston College has much experience in offering education to International Students and preparing them for university study. It offers an excellent opportunity and facilities for International Students to come and study at a New Zealand school. Liston College has both a long term, full time, International Student programme, as well as short term Study Tour programmes. These can be tailored to suit individual needs and circumstances. Homestays can also be arranged. Liston College has a close relationship with St Dominic’s College, a Year 7 -13 Catholic Girls School, a three minute walk away, and St Paul’s School, a Catholic Primary school, five minute car trip away. Many of our families have children in both Colleges and have had their sons go to St Paul’s School.

This ensures that the College meets the various personal, academic and future vocational needs that may be of a concern to International Students and their parents. REFUNDS Please note that once a student has started at Liston College, refunds can only be made in exceptional circumstances as per the School Policy on Withdrawal and Refund of Fees, as well as the Code of Practice. Please read the section on Withdrawal and Refund of Fees. NOTES: ¹ Paid in full, even when a student is enrolled for only part of an academic year. ² A Student Visa will be issued for the same period of time as the Tuition Fees have been paid for. ³ The costs are as at 1 March 2011. These will be charged at the prevailing rate at the time of enrolment. 4 A condition of enrolment is proof of a Comprehensive Insurance cover. This can be arranged through the school if required. 5 Paid only on enrolment or if a student moves home stays. If a student in Year 11 to 13 wishes to sit external examination to gain New Zealand qualifications, fees will vary according to the qualifications sought and the year level the student is studying at. This is set by NZQA and is presently $375.

ACCOMODATION - School organised Home Stay

We provide an extensive network of personnel to support International Students while they are at Liston College. These include: International Students have access to an International Dean as well as a Level Dean. The International Dean is available to specifically assist International Students with day to day issues that they may have as well as courses study, visa requirements, homestay questions, health issues, account queries and parental enquiries. The International Dean interviews each International Student on a regular basis to monitor academic performance and general welfare.

• Regular interviews with students to ensure that they are happy, well cared for and making good progress.

English Language Support

Each International Student enrolled at Liston College has access to English Learning Support and ESOL programmes. This includes: • Small group tuition as part of ESOL support. • Additional hours of ESOL support depending upon student need. • Senior students are prepared for English Literacy standards for qualifications and entry into New Zealand Universities.

Each student is assigned to a Form Class, with whom they will stay with during their time at Liston College. They are the first link in the College’s Guidance network. The Form Teacher has special responsibility for the welfare and progress of all students in their Form Class.

Guidance Counsellor

The Guidance Counsellor is available to all International Students enrolled at Liston College. The Guidance Councellor may be accessed directly by students to discuss any matter – academic, personal, careers, health etc.

Careers and Tertiary Guidance

International Students can access Tertiary studies information as well Careers information from the College’s Career’s Advisor.

Health Nurse

A Health nurse visits the College on a regular basis and is available free to International Students.

School Activities

International Students are encouraged to take part in the life of the College. This includes being involved in numerous activities offered at the College: • Sports teams such as soccer, basketball, volley ball, rugby etc. • Drama and Performing Arts. • Music performance and groups – individual tuition is available in some circumstances. • Special Character groups. • Peer Support and Peer Mentoring Programmes. • Leadership opportunities.

Liston College has a flexible and comprehensive curriculum and qualifications for students from Years 7 to 13 (11-18 years). In the senior school, The National Certificate in Educational Achievement, Levels 1 to 3 is offered as well as University Entrance at Year 13. At Liston College there are opportunities for academic achievement, whether a student wishes to pursue an academic or a vocational pathway. Our flexible and comprehensive curriculum provides real opportunities for each student to achieve and develop their full potential, whether it be spiritually, intellectually, aesthetically or physically. Liston College’s commitment to achievement is demonstrated through a range of learning experiences: a broad curriculum at all levels, learning support and ESOL, and an excellence in learning and teaching. The school sets high academic standards and provides modern facilities in an atmosphere which educates young men in a Christian environment centred on Catholic Values in the tradition of Edmund Rice. International Students arriving at Liston College:

We understand that creating a home away from home is essential for International Students to do well academically and to enjoy their time in New Zealand. Our homestay staff are responsible for organising and monitoring homestay arrangements as well as ensuring the safety and wellbeing of all students placed in Liston College homestays. All International Students enrolled at Liston College are required to be in homestay accommodation organised by the College or our contracted homestay agency or in a homestay approved by the College, in accordance with the Code of Practice guidelines. (A Year 7 or 8 student can only live with his parents or a responsible adult relative or family member (not an agent) nominated in writing by the students parents).

• All families have been visited and undergone a New Zealand Police Vet to ensure the suitability for being a homestay family. • Pre placement inspection of house and family by our Homestay Manager. • Regular check-up and monitoring of homestay situations. • Communication between the homestay family and the student is encouraged prior to the placement of the International Student if he is overseas at the time of application. • Airport pick-up can be arranged. • Accommodation in high quality, executive style homes. • The homestay accommodation will be close to Liston College or close to transport links. • Own room for the student unless specifically asked for otherwise. • Provision to change homestay if either the student or the family is not satisfied¹. • Requirement on homestay parents to monitor and supervise the student, and to set and maintain reasonable standards of behaviour and study. ¹ Where the student or his parents wish to change homestay, another Placement Fee will be charged

Conditions of Enrolment

International Students referred to in these rules are students enrolled at Liston College who do not have permanent residence or citizenship in New Zealand.

There are a number of conditions that must be fulfilled for an International Student to study at Liston College. These include: • Payment of all fees and extra costs as outlined in the Homestay / Fees documents • Compliance with rules of Liston College • A high standard of behaviour in homestay situations

The rules of Liston College include: • The School Code of Conduct • School Rules as per the School Diary

In addition: 1. Students are expected to behave in an orderly, courteous manner and to show consideration towards other people.

2. Students are to be tidily dressed in the correct school uniform as set out in the school prospectus.

3. Students are required to attend all classes, on time, and to remain at school throughout the school day.

4. International Students are to reside in a homestay residence approved by the College.

5. International Students are not allowed to drive or own a vehicle (car or motorbike) while at Liston College.

6. If students wish to travel independently, Liston College will consider applications if: tudents apply in writing to the Director of International Students at least three weeks prior to the • S proposed travel. A full itinerary is included with details of how the student can be contacted at all times including names and contact details of the supervising adult in charge. • Signed consent from their parents taking full responsibility for the student’s welfare while they are away. • A letter from their homestay parents indicating that they have agreed to regular contact conditions with the student during their travel.

If the above rules are breached, or any of the situations listed below occur, the Tuition Agreement may be terminated. If a student wishes to withdraw from the Tuition Agreement, the leaving process must be followed.

Circumstances in which Liston College may terminate tuition:

• In the event of continued, unexplained absenteeism • The exclusion or expulsion of a student in accordance with the Ministry of Education (Stand-down, Suspension, Exclusion and Expulsion) Rules 1999 • Provision of false or misleading information about the student on enrolment • Inadequate progress by the student • Failure by the parent / student to pay fees • Where Liston College is unable to guarantee accommodation due to the student’s behaviour • In the event of criminal behaviour by the student

Agreement Wording

If LISTON COLLEGE (“School”) accepts the Student named (“Student”) in the Application form for tuition in New Zealand, the following terms and conditions shall apply:

1. The School shall provide tuition in accordance with the New Zealand Ministry of Education Code of Practice for Pastoral Care of International Students.

2. The School shall approve and monitor homestay or designated care in accordance with the requirements of the New Zealand Ministry of Education Code of Practice.

3. The Parents or legal guardians of the Student who have signed the application for tuition on behalf of the Student (“Parents”) irrevocably appoint and authorise the Principal of the School (or other such person as may be appointed by the School to carry out the Principal’s duties) to: 3.1 Receive information from any person, authority or corporate body concerning the student, but not limited to, medical education or welfare information; 3.2 Provide consents in respect of any activity carried out and authorised by the School; 3.3 Receive financial information relating to the student, including bank accounts or income of the Student while in New Zealand; 3.4 Provide consents that may be necessary to be given on the Student’s behalf in the event of a medical emergency where it is not reasonably practicable to contact the Parents.

4. The Parents irrevocably authorise the Principal of the school to advise the student’s homestay hosts (whether or not arranged through the School) of all matters and information required to be provided to parents of any student under the Education Act 1989 and agree to appoint the homestay hosts as their agents in New Zealand to receive such information in substitution for the Parents.

5. The Parents agree to provide the School with academic, medical or other information relating to the wellbeing of the student as may be requested from time to time by the School.

6. The School shall use its best endeavours to ensure the safety, health and wellbeing of the student but shall not be liable for: • Any damage or harm caused to the Student or the Student’s property arising out of the Student’s homestay (whether or not such homestay was arranged by or through the School). • Any damage or harm caused to the Student or the Student’s property while attending the School unless the harm was a result of gross negligence on the part of the School. • Any damage or harm caused to the student or the student’s property outside of normal school hours and in the case of Student’s property, shall not be responsible for any damage to such property that may occur outside the School’s premises.

7. Without restricting clause 6, but subject to clause 8, the School’s liability in relation to the supply of services to the Parent is limited to the amount of fees paid by the Parent for provision of the services in respect of which liability arises.

8. Nothing in this Agreement limits any rights the Parent’s and/or student may have under the Consumer Guarantees Act 1993.

9. Either party may terminate this Agreement upon three weeks written notice. If the Agreement is terminated, the Refunds Policy for International Students shall apply.

10. It is acknowledged that the suspension, expulsion and exclusion of student provisions as set out in the Education Act 1989 shall apply to the Student in New Zealand. Any decision under these provisions to expel or exclude the Student shall terminate this Agreement and the refunds policy shall apply. The Parent shall have no claim in damages or for any compensation if this Agreement is terminated in these circumstances.

11. Neither party shall be in default or in breach of their obligations under this Agreement to the extent that the performance of those obligations is prevented by an event of force majeur. Force majeur means an event beyond the reasonable control of the party seeking to rely on force majeur.

12. This Agreement shall be construed and take effect in accordance with the domestic laws of New Zealand. In relation to any legal action or proceedings arising out of or in connection with this Agreement, the Parents irrevocably submit to the jurisdiction of the Courts of New Zealand, agree that proceedings may be brought before any Court, including any forum constituted under the Arbitration Act 1908 within New Zealand, and waive any objection to proceedings in any such court or forum on the grounds of venue or on the grounds that the proceedings have been brought in an inconvenient forum.

13. The Parents agree that the student will comply with school rules and policies including the School Rules for International Students set out in Schedule 2.

14. If an application for homestay has been made by or on behalf of the student then this shall be subject to the undertakings and agreements set out in the Homestay agreement.

15. Notices given under this Agreement must be in writing and given to the addresses set out in the Application forms. Those sent by post shall be deemed to have been received five days after posting.

16. This Agreement shall consist of the Application for Tuition and this Tuition Agreement including the attached Schedules 1 and 2. This Agreement contains the entire understanding of the parties and overrides any prior promises, representations, understandings or agreements. The Terms of the Agreement may be changed by the School in writing to the Parents and shall continue in force while the Student is enrolled within the School.

17. The Parents acknowledge that: a) P ersonal information of Parents and/or student collected or held by the School is provided and may be held, used and disclosed to enable the School to process the Application for Tuition, provide tuition and homestay services to the Student, provide to the Student and/or Parents advice or information concerning products and services the School believes may be of interest to the Student and /or Parents and to enable the School to communicate with the Student and / or Parents for any purpose. b) All personal information provided to the School is collected and will be held by the School at 69 Rathgar Road, Henderson, Auckland, Phone: 09 838 9350 or Fax 09 837 9809. c) If the Student/Parents fail to provide any information requested in the Application for Tuition, the School may be unable to process the application. d) The Student/Parents authorise the School to obtain at any time from any person or entity any information it requires to process and/or accept the Application for Tuition or to perform or complete any of the other purposes under this Agreement. The Parents authorise any such person to release to the School any personal information that person holds concerning the Student / Parents.

18. The conditions in this Tuition Agreement apply for the whole of the time that the student is enrolled at Liston College.

Schedule 1

Withdrawals and Refunds of Fees

All refunds of tuition fees to students withdrawing from Liston College are at the discretion of the Board of Trustees. Application for refund must be made in writing to the Board of Trustees setting out the special circumstances of the claim.

Refund of Tuition fees If a student decides against coming to Liston College, tuition fees will be refunded minus a NZ$500 administration fee.

Once a student has arrived in New Zealand refunds, less a NZ$500 administration fee, will be made only in the most exceptional circumstances (i.e. return home because of serious illness or death of a close family member) and then only partial refund may be made as the school will have incurred costs on the student’s behalf for the whole year.

The refund policy of the Liston College Board of Trustees, as set out below, is based on Section 4B(7) of the New Zealand Education Amendment (No.4) Act 1991. In arriving at their decision, the Board of Trustees will take into consideration the special circumstances of the withdrawing student and; • costs already incurred by the Board • the salaries of the teachers and support staff and any other components of the fee committed for the duration of the course • an amount which covers the use of facilities and resources to the date of the withdrawal • the proportion of the Government or the Catholic School Levies the school is required to pay • any other costs already incurred

Please note: • No refund will be made to a student who is excluded from the school by the Board of Trustees¹. • Students who gain permanent residence or parents who gain work visas after the course has commenced, will not be eligible for a refund.

¹ Where a student is excluded from Liston College, the costs associated with the return journey home will be the responsibility of the parent or guardian, not Liston College.

Homestay Fees

Outstanding homestay fees will be refunded if the contract for tuition at Liston College or its contracted homestay agency, is terminated. Two weeks notice, or payment of two weeks fees in lieu of notice, must be given. The placement fee is not refundable.

How to apply for Refunds

All refunds of tuition fees to withdrawing students are at the discretion of the Liston College Board of Trustees.

Applications for refund must be made in writing to the Board of Trustees, setting out the special circumstances of the claim, such as return home because of serious illness or death of a close family member. This application should include any supporting documents (eg. medical certificates, tickets for return journey etc.)

Agreement Wording

Liston College is a signatory to and complies with the Ministry of Education Code of Practice for International Students. Every International Student is required to board with a Liston College approved family. This may also be his Parents, Aunt, Uncle, or family friends or a homestay family that the school has chosen. In every case the School must have these details, and the student will be monitored and supported by the School’s Director / Dean of International Students.

1. I guarantee the good behaviour of my son in New Zealand. I understand that unacceptable behaviour on the part of my son in the homestay may lead to the termination of my son’s enrolment at Liston College.

2. I undertake that my son will not leave the homestay to live at another address without the permission of the Director / Dean of International Students.

3. I undertake to give written notice to Liston College of at least two weeks when I wish my son to change from one homestay to another category of accommodation, such as living with a parent or designated care.

4. I understand the School’s policy on Withdrawals and Refund of Fees.

5. I undertake to communicate in a timely and prompt manner about any matter which may affect the School’s ability to carry out its responsibilities effectively, including any changes of address or phone numbers for either ourselves or our son.

6. I understand that, in the interests of the personal welfare of my son, the School and the homestay parents may communicate personal information relating to the history, safety and well-being of my son.

7. I understand that my son may not make any national or international telephone calls from the homestay premises unless the charges are reversed or a calling card is used by my son. If any such calls are made, I guarantee to reimburse the homestay for any costs. All internet use will be by agreement with the homestay parents. From time to time students may be asked to contribute to such costs.

8. I understand that the School will use its best endeavours to ensure the safety, health and well-being of my son while at his homestay, however, the school cannot be liable for any damage or harm caused to my son or my son’s property arising out of my son’s homestay.

9. I understand that as an International Student, my son is not permitted to own or drive a car whilst attending Liston College. 10. The Director / Dean of International Students will be the mediator in any disagreement between my son and the homestay parents. 11. From time to time I may be asked to pay a holding deposit / fee for my son’s room over the summer holiday period. It is the parents / caregiver’s responsibility to pay this as and when necessary directly to the homestay family.

12 Fees for the year’s homestay accommodation are paid in advance directly to Liston College. In turn Liston College guarantees to ensure payment to the homestay family.

13. I accept that Liston College is responsible for an International Student at all times while he has a visa from our school.

T to any legal action or proceedings arising out of or in connection with this Agreement, the Parents irrevocably submit to the jurisdiction of the Courts of New Zealand, agree that proceedings may be brought before any court, including any forum constituted under the Arbitration Act 1996 within New Zealand, and waive any objection to proceedings in any such court or forum on the grounds of venue or on the grounds that the proceedings have been brought in an inconvenient forum.

International Students’ Homestay General Information

Current practice:

All homestays in which we place students have been approved following a process set out in the Guidelines to the Code of Practice for the Pastoral Care of International Students.

This includes but is not limited to:

• p roviding the prospective caregiver a copy of the Summary of the Code of Practice for the Pastoral Care of International Students to inform him / them of the responsibilities laid down by the New Zealand Government

• the completion by the prospective caregiver of a written questionnaire to determine their suitability

• a n interview of the prospective caregiver in their home and inspection of that home and its facilities by the Liston College Dean of International Students

• photos may be taken of the home and its environs and made available to the student and his parents

• a discussion with two referees named by the caregiver to attest to their suitability to the role and written records of those discussions made

• police vetting of all people living in the home aged 18 and over, excluding other international students

• entry on our database of relevant information, which is copied for the student and his parents

• t he home will be visited a minimum of three times yearly while your son lives there, and he will be interviewed each term at school to check his safety and wellbeing in it

Broadly, we hope to place students in homes:

• which match the stated needs of the students, as far as possible

• w ithin a reasonable distance of the school, though it may necessitate a bus or train trip to reach Liston College, rather than walking

• where English is the first language, if this is requested

• where the student will have his own bedroom within the home

• where the family (which may be a single parent) will provide convivial company and enjoy welcoming newcomers

• w here the caregivers are able to meet the needs of an international student facing new challenges and requiring support and encouragement

Refund of fees:

• The keys points are:

1. W here a student moves out of their homestay before the end of their contract, the portion of homestay fees will either be returned or transferred to the new homestay. A new Homestay Application Fee, at the prevailing rate, will be charged.

2. Applications for the refund of Homestay Fees must be in writing to Director of International Students giving at least two weeks notice or pay two weeks fees in lieu of notice.

3. If the homestay contract is cancelled prior to the student moving into the homestay, then the homestay fee will be refunded in full less the Homestay Application Fee.

I / We understand that Liston College will: • Visit the home of the Designated Caregiver prior to enrolment to determine that the living conditions are of an acceptable standard. • Assess whether the Designated Caregiver will provide a safe physical and emotional environment for the Student. • Determine that the accommodation is not a boarding establishment (i.e. does not have 5 or more International Students staying in the home). • Follow the provisions relating to boarding establishments as set out in the Code of Practice, if the accommodation designated by the parents is a boarding establishment. • Meet with the Designated Caregiver/s and establish communication with the caregiver. • Meet the Student at least quarterly to ensure the accommodation is suitable. • Require a Police vet to be undertaken if the education provider considers it appropriate.

Important Points:

I / we understand that Liston College will make every endeavour to ensure the safety and welfare of my / our child while studying at their school.

Should there be a concern about the welfare of the student, the school will consult the Pastoral Care staff within the school and will discuss the concerns with the Designated Caregivers and Parents of the Student. Further, I / we understand that should Liston College have any concerns regarding the welfare of my / our child, the School may relocate the Student into another approved school homestay. If necessary, the School will also refer the matter to the relevant welfare authorities or any other appropriate outside agencies.

Should this arrangement change I / we undertake to inform Liston College immediately.
