2. This word cannot be understood as referring to the sacrament of penance, that is, confession and satisfaction, as administered by the clergy. 3. Yet it does not mean solely inner repentance; such inner repentance is worthless unless it produces various outward mortification of the flesh. 4. The penalty of sin remains as long as the hatred of self (that is, true inner repentance), namely till our entrance into the kingdom of heaven. 5. The pope neither desires nor is able to remit any penalties except those imposed by his own authority or that of the canons. 6. The pope cannot remit any guilt, except by declaring and showing that it has been remitted by God; or, to be sure, by remitting guilt in cases reserved to his judgment. If his right to grant remission in these cases were disregarded, the guilt would certainly remain unforgiven. 7. God remits guilt to no one unless at the same time he humbles him in all things and makes him submissive to the vicar, the priest. 8. The penitential canons are imposed only on the living, and, according to the canons themselves, nothing should be imposed on the dying.


9. Therefore the Holy Spirit through the pope is kind to us insofar as the pope in his decrees always makes exception of the article of death and of necessity. 10. Those priests act ignorantly and wickedly who, in the case of the dying, reserve canonical penalties for purgatory. 11. Those tares of changing the canonical penalty to the penalty of purgatory were evidently sown while the bishops slept (Mt 13:25). 12. In former times canonical penalties were imposed, not after, but before absolution, as tests of true contrition. 13. The dying are freed by death from all penalties, are already dead as far as the canon laws are concerned, and have a right to be released from them. 14. Imperfect piety or love on the part of the dying person necessarily brings with it great fear; and the smaller the love, the greater the fear. 15. This fear or horror is sufficient in itself, to say nothing of other things, to constitute the penalty of purgatory, since it is very near to the horror of despair. 16. Hell, purgatory, and heaven seem to differ the same as despair, fear, and assurance of salvation.

Nor does it seem proved that souls in purgatory, at least not all of them, are certain and assured of their own salvation, even if we ourselves may be entirely certain of it. 20. Therefore the pope, when he uses the words "plenary remission of all penalties," does not actually mean "all penalties," but only those imposed by himself. 21. Thus those indulgence preachers are in error who say that a man is absolved from every penalty and saved by papal indulgences. 22. As a matter of fact, the pope remits to souls in purgatory no penalty which, according to canon law, they should have paid in this life. 23. If remission of all penalties whatsoever could be granted to anyone at all, certainly it would be granted only to the most perfect, that is, to very few. 24. For this reason most people are necessarily deceived by that indiscriminate and high-sounding promise of release from penalty.

Those who believe that they can be certain of their salvation because they have indulgence letters will be eternally damned, together with their teachers. 33. Men must especially be on guard against those who say that the pope's pardons are that inestimable gift of God by which man is reconciled to him.

37. Any true Christian, whether living or dead, participates in all the blessings of Christ and the church; and this is granted him by God, even without indulgence letters. 38. Nevertheless, papal remission and blessing are by no means to be disregarded, for they are, as I have said (Thesis 6), the proclamation of the divine remission. 39. It is very difficult, even for the most learned theologians, at one and the same time to commend to the people the bounty of indulgences and the need of true contrition. 40. A Christian who is truly contrite seeks and loves to pay penalties for his sins; the bounty of indulgences, however, relaxes penalties and causes men to hate them -- at least it furnishes occasion for hating them. 41. Papal indulgences must be preached with caution, lest people erroneously think that they are preferable to other good works of love.

Injury is done to the Word of God when, in the same sermon, an equal or larger amount of time is devoted to indulgences than to the Word.

48. Christians are to be taught that the pope, in granting indulgences, needs and thus desires their devout prayer more than their money.

It is certainly the pope's sentiment that if indulgences, which are a very insignificant thing, are celebrated with one bell, one procession, and one ceremony, then the gospel, which is the very greatest thing, should be preached with a hundred bells, a hundred processions, a hundred ceremonies.

49. Christians are to be taught that papal indulgences are useful only if they do not put their trust in them, but very harmful if they lose their fear of God because of them.

56. The true treasures of the church, out of which the pope distributes indulgences, are not sufficiently discussed or known among the people of Christ.

50. Christians are to be taught that if the pope knew the exactions of the indulgence preachers, he would rather that the basilica of St. Peter were burned to ashes than built up with the skin, flesh, and bones of his sheep.

57. That indulgences are not temporal treasures is certainly clear, for many indulgence sellers do not distribute them freely but only gather them.

For it is clear that the pope's power is of itself sufficient for the remission of penalties and cases reserved by himself. 62. The true treasure of the church is the most holy gospel of the glory and grace of God. 63. But this treasure is naturally most odious, for it makes the first to be last (Mt. 20:16). 64. On the other hand, the treasure of indulgences is naturally most acceptable, for it makes the last to be first. 65. Therefore the treasures of the gospel are nets with which one formerly fished for men of wealth.

69. Bishops and curates are bound to admit the commissaries of papal indulgences with all reverence. 70. But they are much more bound to strain their eyes and ears lest these men preach their own dreams instead of what the pope has commissioned. 71. Let him who speaks against the truth concerning papal indulgences be anathema and accursed. 72. But let him who guards against the lust and license of the indulgence preachers be blessed. 73. Just as the pope justly thunders against those who by any means whatever contrive harm to the sale of indulgences. 74. Much more does he intend to thunder against those who use indulgences as a pretext to contrive harm to holy love and truth. 75. To consider papal indulgences so great that they could absolve a man even if he had done the impossible and had violated the mother of God is madness.

66. The treasures of indulgences are nets with which one now fishes for the wealth of men.

76. We say on the contrary that papal indulgences cannot remove the very least of venial sins as far as guilt is concerned.

67. The indulgences which the demagogues acclaim as the greatest graces are actually understood to be such only insofar as they promote gain.

77. To say that even St. Peter if he were now pope, could not grant greater graces is blasphemy against St. Peter and the pope.

68. They are nevertheless in truth the most insignificant graces when compared with the grace of God and the piety of the cross.

78. We say on the contrary that even the present pope, or any pope whatsoever, has greater graces at his disposal, that is, the gospel, spiritual

79. To say that the cross emblazoned with the papal coat of arms, and set up by the indulgence preachers is equal in worth to the cross of Christ is blasphemy.

85. Again, "Why are the penitential canons, long since abrogated and dead in actual fact and through disuse, now satisfied by the granting of indulgences as though they were still alive and in force?"

80. The bishops, curates, and theologians who permit such talk to be spread among the people will have to answer for this. 81. This unbridled preaching of indulgences makes it difficult even for learned men to rescue the reverence which is due the pope from slander or from the shrewd questions of the laity. 82. Such as: "Why does not the pope empty purgatory for the sake of holy love and the dire need of the souls that are there if he redeems an infinite number of souls for the sake of miserable money with which to build a church? The former reason would be most just; the latter is most trivial. 83. Again, "Why are funeral and anniversary masses for the dead continued and why does he not return or permit the withdrawal of the endowments founded for them, since it is wrong to pray for the redeemed?" 84. Again, "What is this new piety of God and the pope that for a consideration of money they permit a man who is impious and their enemy to buy out of purgatory the pious soul of a friend of God and do not rather, because

Again, "Why does not the pope, whose wealth is today greater than the wealth of the richest Crassus, build this one basilica of St. Peter with his own money rather than with the money of poor believers?" 87. Again, "What does the pope remit or grant to those who by perfect contrition already have a right to full remission and blessings?" 88. Again, "What greater blessing could come to the church than if the pope were to bestow these remissions and blessings on every believer a hundred times a day, as he now does but once?" 89. "Since the pope seeks the salvation of souls rather than money by his indulgences, why does he suspend the indulgences and pardons previously granted when they have equal efficacy?" 90. To repress these very sharp arguments of the laity by force alone, and not to resolve them by giving reasons, is to expose the church and the pope to the ridicule of their enemies and to make Christians unhappy. 91. If, therefore, indulgences were preached according to the spirit and intention of the pope, all these doubts would be readily resolved. Indeed,


they would not exist. 92. Away, then, with all those prophets who say to the people of Christ, "Peace, peace," and there is no peace! (Jer 6:14) 93. Blessed be all those prophets who say to the people of Christ, "Cross, cross," and there is no cross! 94. Christians should be exhorted to be diligent in following Christ, their Head, through penalties, death and hell. 95. And thus be confident of entering into heaven through many tribulations rather than through the false security of peace (Acts 14:22).

JESUS The grace of God be with you in all its fulness and power! Spare me, Most Reverend Father in Christ and Most Illustrious Prince, that I, the dregs of humanity, have so much boldness that I have dared to think of a letter to the height of your Sublimity. The Lord Jesus is my witness that, conscious of my smallness and baseness, I have long deferred what I am now shameless enough to do, -- moved

thereto most of all by the duty of fidelity which I acknowledge that I owe to your most Reverend Fatherhood in Christ. Meanwhile, therefore, may your Highness deign to cast an eye upon one speck of dust, and for the sake of your pontifical clemency to heed my prayer. Papal indulgences for the building of St. Peter's are circulating under your most distinguished name, and as regards them, I do not bring accusation against the outcries of the preachers, which I have not heard, so much as I grieve over the wholly false impressions which the people have conceived from them; to wit, -- the unhappy souls believe that if they have purchased letters of indulgence they are sure of their salvation; again, that so soon as they cast their contributions into the money-box, souls fly out of purgatory; furthermore, that these graces [i.e., the graces conferred in the indulgences] are so great that there is no sin too great to be absolved, even, as they say -though the thing is impossible -- if one had violated the Mother of God; again, that a man is free, through these indulgences, from all penalty and guilt. O God, most good! Thus souls committed to your care, good Father, are taught to their death, and the strict account, which you must render for all such, grows and increases. For this reason I have no longer been able to keep quiet about this matter, for it is by no gift of a bishop that man becomes sure of salvation, since he gains this certainty not even by the "inpoured grace" of God, but the Apostle bids us always "work out our own salvation in fear and trembling," and Peter says, "the righteous scarcely shall be saved." Finally, so narrow is the way that leads to life, that the Lord, through the prophets Amos and Zechariah, calls those who shall be saved "brands plucked from the burning," and everywhere declares the difficulty of salvation. Why, then, do the preachers of pardons, by these


false fables and promises, make the people careless and fearless? Whereas indulgences confer on us no good gift, either for salvation or for sanctity, but only take away the external penalty, which it was formerly the custom to impose according to the canons. Finally, works of piety and love are infinitely better than indulgences, and yet these are not preached with such ceremony or such zeal; nay, for the sake of preaching the indulgences they are kept quiet, though it is the first and the sole duty of all bishops that the people should learn the Gospel and the love of Christ, for Christ never taught that indulgences should be preached. How great then is the horror, how great the peril of a bishop, if he permits the Gospel to be kept quiet, and nothing but the noise of indulgences to be spread among his people! Will not Christ say to them, "straining at a gnat and swallowing a camel"? In addition to this, Most Reverend Father in the Lord, it is said in the Instruction to the Commissaries which is issued under your name, Most Reverend Father (doubtless without your knowledge and consent), that one of the chief graces of indulgence is that inestimable gift of God by which man is reconciled to God, and all the penalties of purgatory are destroyed. Again, it is said that contrition is not necessary in those who purchase souls [out of purgatory] or buy confessionalia. But what can I do, good Primate and Most Illustrious Prince, except pray your Most Reverend Fatherhood by the Lord Jesus Christ that you would deign to look [on this matter] with the eye of fatherly care, and do away entirely with that treatise and impose upon the preachers of pardons another form of preaching; lest, perchance, one may some time arise, who will publish writings in which he will confute both them and that

treatise, to the shame of your Most Illustrious Sublimity. I shrink very much from thinking that this will be done, and yet I fear that it will come to pass, unless there is some speedy remedy. These faithful offices of my insignificance I beg that your Most Illustrious Grace may deign to accept in the spirit of a Prince and a Bishop, i.e., with the greatest clemency, as I offer them out of a faithful heart, altogether devoted to you, Most Reverend Father, since I too am a part of your flock. May the Lord Jesus have your Most Reverend Fatherhood eternally in His keeping. Amen. From Wittenberg on the Vigil of All Saints, MDXVII. He was also crucified for us, suffered under Pontius Pilate, and was buried. And on the third day He rose again according to the Scriptures. He ascended into heaven and sits at the right hand of the Father. He will come again in glory to judge the living and the dead and His kingdom will have no end. And in the Holy Spirit, the Lord and Giver of life, Who proceeds from the Father and the Son. Who together with the Father and the Son is adored and glorified, and who spoke through the prophets. And one holy, Catholic and Apostolic Church. I confess one baptism for the forgiveness of sins and I await the resurrection of the dead and the life of the world to come. Amen. I most steadfastly admit and embrace Apostolical and ecclesiastical traditions, and all other observances and constitutions of the Church. I also admit the Holy Scripture according to that sense which our holy mother the Church hath held, and doth hold, to whom it belongeth to judge of the true sense and interpretations of the Scriptures. Neither will I ever take and interpret them otherwise than according to the unanimous consent of the Fathers. I also profess that there are truly and properly Seven Sacraments of the New Law, instituted by Jesus Christ our Lord, and necessary for the salvation of mankind, though not all for every one; to wit, Baptism, Confirmation, Eucharist,

Penance, Extreme Unction, Holy Orders, and Matrimony; and that they confer grace; and that of these, Baptism, Confirmation, and Holy Orders cannot be reiterated without sacrilege. I also receive and admit the received and approved ceremonies of the Catholic Church in the solemn administration of the aforesaid sacraments. I embrace and receive all and every one of the things which have been defined and declared in the holy Council of Trent concerning original sin and justification. I profess, likewise, that in the Mass there is offered to God a true, proper, and propitiatory sacrifice for the living and the dead; and that in the most holy sacrament of the Eucharist there is truly, really, and substantially, the Body and Blood, together with the soul and divinity, of our Lord Jesus Christ; and that there is made a conversion of the whole substance of the bread into the Body, and of the whole substance of the wine into the Blood, which conversion the Catholic Church calls Transubstantiation. I also confess that under either kind alone Christ is received whole and entire, and a true sacrament. I constantly hold that there is a Purgatory, and that the souls therein detained are helped by the suffrages of the faithful. Likewise, that the saints, reigning together with Christ, are to be honored and invoked, and that they offer prayers to God for us, and that their relics are to be venerated. I most firmly assert that the images of Christ, of the Mother of God, ever virgin, and also of other Saints, ought to be had and retained, and that due honor and veneration is to be given them.


I also affirm that the power of indulgences was left by Christ in the Church, and that the use of them is most wholesome to Christian people.

I condemn, reject, and anathematize all things contrary thereto, and all heresies which the Church hath condemned, rejected, and anathematized. This true Catholic faith, outside of which no one can be saved, which I now freely profess and to which I truly adhere, inviolate and with firm constancy until the last breath of life, I do so profess and swear to maintain with the help of God. And I shall strive, as far as possible, that this same faith shall be held, taught, and professed by all those over whom I have charge. For as much of you, Christopher Columbus, are going by our command, with some of our vessels and men, to discover and subdue some Islands and Continent in the ocean, and it is hoped that by God's assistance, some of the said Islands and Continent in the ocean will be discovered and conquered by your means and conduct, therefore it is but just and reasonable, that since you expose yourself to such danger to serve us, you should be rewarded for it. And we being willing to honour and favour You for the reasons aforesaid: Our will is, That you, Christopher Columbus, after discovering and conquering the said Islands and Continent in the said ocean, or any of them, shall be our Admiral of the said Islands and Continent you shall so discover and conquer; and that you be our Admiral, Vice-Roy, and Governour in them, and that for the future, you may call and stile yourself, D. That none of the colonists shall go to seek gold without a license from the governor or alcalde of the town where he lives; and that he must first take oath to return to the place whence he sets out, for the purpose of registering faithfully all the gold he may have found, and to return once a month, or once a week, as the time may have been set for him, to render account and show the quantity of said gold; and that this shall be written down by the notary before the aIcalde, or, if it seems better, that a friar or priest, deputed for the purpose, shall be also present 6. That all the gold thus brought in shall be smelted immediately, and stamped with some mark that shall distinguish each town; and that the portion which belongs to your Highnesses shall be weighed, and given and consigned to each alcalde in his own town, and registered by the above-mentioned priest or friar, so that it shall not pass through the hands of only one person, and there shall he no opportunity to conceal the truth. 7. That all gold that may be found without the mark of one of the said towns in the possession of any one who has once registered in accordance with the above order shall be taken as forfeited, and that the accuser shall have one portion of it and your Highnesses the other.

8. That one per centum of all the gold that may be found shall be set aside for building churches and adorning the same, and for the support of the priests or friars belonging to them; and, if it should be thought proper to pay any thing to the alcaldes or notaries for their services, or for ensuring the faithful perforce of their duties, that this amount shall be sent to the governor or treasurer who may be appointed there by your Highnesses. 9. As regards the division of the gold, and the share that ought to be reserved for your Highnesses, this, in my opinion, must be left to the aforesaid governor and treasurer, because it will have to be greater or less according to the quantity of gold that may be found. Or, should it seem preferable, your Highnesses might, for the space of one year, take one half, and the collector the other, and a better arrangement for the division be made afterward. 10. That if the said alcaldes or notaries shall commit or be privy to any fraud, punishment shall be provided, and the same for the colonists who shall not have declared all the gold they have. 11. That in the said island there shall be a treasurer, with a clerk to assist him, who shall receive all the gold belonging to your Highnesses, and the alcaldes and notaries of the towns shall each keep a record of what they deliver to the said treasurer. 12. As, in the eagerness to get gold, every one will wish, naturally, to engage in its search in preference to any other employment, it seems to me that the privilege of going to look for gold ought to be withheld during some portion of each year, that there


may be opportunity to have the other business necessary for the island performed. 13. In regard to the discovery of new countries, I think permission should be granted to all that wish to go, and more liberality used in the matter of the fifth, making the tax easier, in some fair way, in order that many may be disposed to go on voyages. I will now give my opinion about ships going to the said Island of Espanola, and the order that should be maintained; and that is, that the said ships should only be allowed to discharge in one or two ports designated for the purpose, and should register there whatever cargo they bring or unload; and when the time for their departure comes, that they should sail from these same ports, and register all the cargo they take in, that nothing may be concealed. 

In reference to the transportation of gold from the island to Castile, that all of it should be taken on board the ship, both that belonging to your Highnesses and the property of every one else; that it should all be placed in one chest with two locks, with their keys, and that the master of the vessel keep one key and some person selected by the governor and treasurer the other; that there should come with the gold, for a testimony, a list of all that has been put into the said chest, properly marked, so that each owner may receive his own; and that, for the faithful performance of this duty, if any gold whatsoever is found outside of the said chest in any way, be it little or much, it shall be forfeited to your Highnesses. That all the ships that come from the said island shall be obliged to make their proper discharge in the port of

Cadiz, and that no person shall disembark or other person be permitted to go on board until the ship has been visited by the person or persons deputed for that purpose, in the said city, by your Highnesses, to whom the master shall show all that he carries, and exhibit the manifest of all the cargo, it may be seen and examined if the said ship brings any thing hidden and not known at the time of lading. That the chest in which the said gold has been carried shall be opened in the presence of the magistrates of the said city of Cadiz, and of the person deputed for that purpose by your Highnesses, and his own property be given to each owner. -

A law of nature, lex naturalis, is a precept, or general rule, found out by reason, by which a man is forbidden to do that which is destructive of his life, or taketh away the means of preserving the same, and to omit that by which he thinketh it may be best preserved. For though they that speak of this subject use to confound jus and lex, right and law, yet they ought to be distinguished, because right consisteth in liberty to do, or to forbear; whereas law determineth and bindeth to one of them: so that law and right differ as much as obligation and liberty, which in one and the same matter are inconsistent. And because the condition of man (as hath been declared in the precedent chapter) is a condition of war of every one against everyone, in which case every one is governed by his own reason, and there is nothing he can make use of that may not be a help unto him in preserving his life against his enemies; it followeth that in such a condition every man has a right to every thing, even to one another's body. And therefore, as long as this natural right of every man to every thing endureth, there can be no security to any man, how strong or wise soever he be, of living out the time which nature ordinarily alloweth men to live. And consequently it is a precept, or

general rule of reason: that every man ought to endeavour peace, as far as he has hope of obtaining it; and when he cannot obtain it, that he may seek and use all helps and advantages of war. The first branch of which rule containeth the first and fundamental law of nature, which is: to seek peace and follow it. The second, the sum of the right of nature, which is: by all means we can to defend ourselves. From this fundamental law of nature, by which men are commanded to endeavour peace, is derived this second law: that a man be willing, when others are so too, as far forth as for peace and defence of himself he shall think it necessary, to lay down this right to all things; and be contented with so much liberty against other men as he would allow other men against himself. For as long as every man holdeth this right, of doing anything he liketh; so long are all men in the condition of war. But if other men will not lay down their right, as well as he, then there is no reason for anyone to divest himself of his: for that were to expose himself to prey, which no man is bound to, rather than to dispose himself to peace. This is that law of the gospel: Whatsoever you require that others should do to you, that do ye to them. And that law of all men, quod tibi fieri non vis, alteri ne feceris. To lay down a man's right to anything is to divest himself of the liberty of hindering another of the benefit of his own right to the same. For he that renounceth or passeth away his right giveth not to any other man a right which he had not before, because there is nothing to which every man had not right by nature, but only standeth out of his way that he may enjoy his own original right without hindrance from him, not without hindrance from another. So that the effect which redoundeth to one man by another man's defect of right is but so much


diminution of impediments to the use of his own right original. Right is laid aside, either by simply renouncing it, or by transferring it to another. By simply renouncing, when he cares not to whom the benefit thereof redoundeth. By transferring, when he intendeth the benefit thereof to some certain person or persons. And when a man hath in either manner abandoned or granted away his right, then is he said to be obliged, or bound, not to hinder those to whom such right is granted, or abandoned, from the benefit of it: and that he ought, and it is duty, not to make void that voluntary act of his own: and that such hindrance is injustice, and injury, as being sine jure; the right being before renounced or transferred. So that injury or injustice, in the controversies of the world, is somewhat like to that which in the disputations of scholars is called absurdity. For as it is there called an absurdity to contradict what one maintained in the beginning; so in the world it is called injustice, and injury voluntarily to undo that which from the beginning he had voluntarily done. The way by which a man either simply renounceth or transferreth his right is a declaration, or signification, by some voluntary and sufficient sign, or signs, that he doth so renounce or transfer, or hath so renounced or transferred the same, to him that accepteth it. And these signs are either words only, or actions only; or, as it happeneth most often, both words and actions. And the same are the bonds, by which men are bound and obliged: bonds that have their strength, not from their own nature (for nothing is more easily broken than a man's word), but from fear of some evil consequence upon the rupture. Whensoever a man transferreth his right, or renounceth it, it is either in consideration of some right reciprocally transferred to himself, or for some other good he hopeth

for thereby. For it is a voluntary act: and of the voluntary acts of every man, the object is some good to himself. And therefore there be some rights which no man can be understood by any words, or other signs, to have abandoned or transferred. As first a man cannot lay down the right of resisting them that assault him by force to take away his life, because he cannot be understood to aim thereby at any good to himself. The same may be said of wounds, and chains, and imprisonment, both because there is no benefit consequent to such patience, as there is to the patience of suffering another to be wounded or imprisoned, as also because a man cannot tell when he seeth men proceed against him by violence whether they intend his death or not. And lastly the motive and end for which this renouncing and transferring of right is introduced is nothing else but the security of a man's person, in his life, and in the means of so preserving life as not to be weary of it. When a year later the Carmelite provincial Paolo Foscarini supported Galileo publicly by attempting to prove that the new theory was not opposed to Scripture, Cardinal Robert Bellarmine, as "Master of Controversial Questions," responded. On April 12, 1615 the saint wrote to Foscarini: "I have gladly read the letter in Italian and the treatise which Your Reverence sent me, and I thank you for both. And I confess that both are filled with ingenuity and learning, and since you ask for my opinion, I will give it to you very briefly, as you have little time for reading and I for writing: "First. I say that it seems to me that Your Reverence and Galileo did prudently to content yourself with speaking hypothetically, and not absolutely, as I have always believed that Copernicus spoke. For to say that, assuming the earth moves and the sun stands still, all the appearances are

saved better than with eccentrics and epicycles, is to speak well; there is no danger in this, and it is sufficient for mathematicians. But to want to affirm that the sun really is fixed in the center of the heavens and only revolves around itself (i. e., turns upon its axis ) without traveling from east to west, and that the earth is situated in the third sphere and revolves with great speed around the sun, is a very dangerous thing, not only by irritating all the philosophers and scholastic theologians, but also by injuring our holy faith and rendering the Holy Scriptures false. For Your Reverence has demonstrated many ways of explaining Holy Scripture, but you have not applied them in particular, and without a doubt you would have found it most difficult if you had attempted to explain all the passages which you yourself have cited. "Second. I say that, as you know, the Council [of Trent] prohibits expounding the Scriptures contrary to the common agreement of the holy Fathers. And if Your Reverence would read not only the Fathers but also the commentaries of modern writers on Genesis, Psalms, Ecclesiastes and Josue, you would find that all agree in explaining literally (ad litteram) that the sun is in the heavens and moves swiftly around the earth, and that the earth is far from the heavens and stands immobile in the center of the universe. Now consider whether in all prudence the Church could encourage giving to Scripture a sense contrary to the holy Fathers and all the Latin and Greek commentators. Nor may it be answered that this is not a matter of faith, for if it is not a matter of faith from the point of view of the subject matter, it is on the part of the ones who have spoken. It would be just as heretical to deny that Abraham had two sons and Jacob twelve, as it would be to deny the virgin birth of Christ, for both are declared by the Holy Ghost through the mouths of the prophets and apostles.


"Third. I say that if there were a true demonstration that the sun was in the center of the universe and the earth in the third sphere, and that the sun did not travel around the earth but the earth circled the sun, then it would be necessary to proceed with great caution in explaining the passages of Scripture which seemed contrary, and we would rather have to say that we did not understand them than to say that something was false which has been demonstrated.But I do not believe that there is any such demonstration; none has been shown to me. It is not the same thing to show that the appearances are saved by assuming that the sun really is in the center and the earth in the heavens. I believe that the first demonstration might exist, but I have grave doubts about the second, and in a case of doubt, one may not depart from the Scriptures as explained by the holy Fathers. I add that the words ' the sun also riseth and the sun goeth down, and hasteneth to the place where he ariseth, etc.' were those of Solomon, who not only spoke by divine inspiration but was a man wise above all others and most learned in human sciences and in the knowledge of all created things, and his wisdom was from God. Thus it is not too likely that he would affirm something which was contrary to a truth either already demonstrated, or likely to be demonstrated. And if you tell me that Solomon spoke only according to the appearances, and that it seems to us that the sun goes around when actually it is the earth which moves, as it seems to one on a ship that the beach moves away from the ship, I shall answer that one who departs from the beach, though it looks to him as though the beach moves away, he knows that he is in error and corrects it, seeing clearly that the ship moves and not the beach. But with regard to the sun and the earth, no wise man is needed to correct the error, since he clearly experiences that the earth stands still and that his eye is not

deceived when it judges that the moon and stars move. And that is enough for the present. I salute Your Reverence and ask God to grant you every happiness."

England was enslaved for a long series of years by the Romans, the Saxons, the Danes, and the French successively. William the Conqueror particularly, ruled them with a rod of iron. He disposed as absolutely of the lives and fortunes of his conquered subjects as an eastern monarch; and forbade, upon pain of death, the English either fire or candle in their houses after eight o'clock; whether he did this to prevent their nocturnal meetings, or only to try, by this odd and whimsical prohibition, how far it was possible for one man to extend his power over his fellowcreatures. It is true, indeed, that the English had Parliaments before and after William the Conqueror, and they boast of them, as though these assemblies then called Parliaments, composed of ecclesiastical tyrants and of plunderers entitled barons, had been the guardians of the public liberty and happiness. The barbarians who came from the shores of the Baltic, and settled in the rest of Europe, brought with them the form of government


called States or Parliaments, about which so much noise is made, and which are so little understood. Kings, indeed, were not absolute in those days; but then the people were more wretched upon that very account, and more completely enslaved. The chiefs of these savages, who had laid waste France, Italy, Spain, and England, made themselves monarchs. Their generals divided among themselves the several countries they had conquered, whence sprung those margraves, those peers, those barons, those petty tyrants, who often contested with their sovereigns for the spoils of whole nations. These were birds of prey fighting with an eagle for doves whose blood the victorious was to suck. Every nation, instead of being governed by one master, was trampled upon by a hundred tyrants. The priests soon played a part among them. Before this it had been the fate of the Gauls, the Germans, and the Britons, to be always governed by their Druids and the chiefs of their villages, an ancient kind of barons, not so tyrannical as their successors. These Druids pretended to be mediators between God and man. They enacted laws, they fulminated their excommunications, and sentenced to death. The bishops succeeded, by insensible degrees, to their temporal authority in the Goth and Vandal government. The popes set themselves at their head, and armed with their briefs, their bulls, and reinforced by monks, they made even kings tremble, deposed and assassinated them at pleasure, and employed every artifice to draw into their own purses moneys from all parts of Europe. The weak Ina, one of the tyrants of the Saxon Heptarchy in England, was the first monarch who submitted, in his pilgrimage to Rome, to pay St. Peter's penny (equivalent very near to a French crown) for every house in his dominions. The whole island soon followed his example; England became insensibly one of the Pope's provinces, and the Holy Father used to send

from time to time his legates thither to levy exorbitant taxes. At last King John delivered up by a public instrument the kingdom of England to the Pope, who had excommunicated him; but the barons, not finding their account in this resignation, dethroned the wretched King John and seated Louis, father to St. Louis, King of France, in his place. However, they were soon weary of their new monarch, and accordingly obliged him to return to France. Whilst that the barons, the bishops, and the popes, all laid waste England, where all were for ruling; the most numerous, the most useful, even the most virtuous, and consequently the most venerable part of mankind, consisting of those who study the laws and the sciences, of traders, of artificers, in a word, of all who were not tyrants-that is, those who are called the people: these, I say, were by them looked upon as so many animals beneath the dignity of the human species. The Commons in those ages were far from sharing in the government, they being villains or peasants, whose labour, whose blood, were the property of their masters who entitled themselves the nobility. The major part of men in Europe were at that time what they are to this day in several parts of the worldthey were villains or bondsmen of lords-that is, a kind of cattle bought and sold with the land. Many ages passed away before justice could be done to human nature-before mankind were conscious that it was abominable for many to sow, and but few reap. And was not France very happy, when the power and authority of those petty robbers was abolished by the lawful authority of kings and of the people? Happily, in the violent shocks which the divisions between kings and the nobles gave to empires, the chains of nations were more or less heavy. Liberty in England sprang from the quarrels of tyrants. The barons


forced King John and King Henry III. to grant the famous Magna Charta, the chief design of which was indeed to make kings dependent on the Lords; but then the rest of the nation were a little favoured in it, in order that they might join on proper occasions with their pretended masters. This great Charter, which is considered as the sacred origin of the English liberties, shows in itself how little liberty was known. The title alone proves that the king thought he had a just right to be absolute; and that the barons, and even the clergy, forced him to give up the pretended right, for no other reason but because they were the most powerful. Magna Charta begins in this style: "We grant, of our own free will, the following privileges to the archbishops, bishops, priors, and barons of our kingdom," etc. The House of Commons is not once mentioned in the articles of this Charter-a proof that it did not yet exist, or that it existed without power. Mention is therein made, by name, of the freemen of England-a melancholy proof that some were not so. It appears, by Article XXXII., that these pretended freemen owed service to their lords. Such a liberty as this was not many removes from slavery. By Article XXI., the king ordains that his officers shall not henceforward seize upon, unless they pay for them, the horses and carts of freemen. The people considered this ordinance as a real liberty, though it was a greater tyranny. Henry VII., that happy usurper and great politician, who pretended to love the barons, though he in reality hated and feared them, got their lands alienated. By this means the villains, afterwards acquiring riches by their industry, purchased the estates and country seats of the illustrious peers who had ruined themselves by their folly and extravagance, and all the

lands got by insensible degrees into other hands. The power of the House of Commons increased every day. The families of the ancient peers were at last extinct; and as peers only are properly noble in England, there would be no such thing in strictness of law as nobility in that island, had not the kings created new barons from time to time, and preserved the body of peers, once a terror to them, to oppose them to the Commons, since become so formidable. All these new peers who compose the Higher House receive nothing but their titles from the king, and very few of them have estates in those places whence they take their titles. One shall be Duke of D--, though he has not a foot of land in Dorsetshire; and another is Earl of a village, though he scarce knows where it is situated. The peers have power, but it is only in the Parliament House. There is no such thing here as haute, moyenne, and basse justice-that is, a power to judge in all matters civil and criminal; nor a right or privilege of hunting in the grounds of a citizen, who at the same time is not permitted to fire a gun in his own field. No one is exempted in this country from paying certain taxes because he is a nobleman or a priest. All duties and taxes are settled by the House of Commons, whose power is greater than that of the Peers, though inferior to it in dignity. The spiritual as well as temporal Lords have the liberty to reject a Money Bill brought in by the Commons; but they are not allowed to alter anything in it, and must either pass or throw it out without restriction. When the Bill has passed the Lords and is signed by the king, then the whole nation pays, every man in proportion to his revenue or estate, not according to his title, which would be absurd. There is no such thing as an


arbitrary subsidy or poll-tax, but a real tax on the lands, of all which an estimate was made in the reign of the famous King William III.

The land-tax continues still upon the same foot, though the revenue of the lands is increased. Thus no one is tyrannised over, and every one is easy. The feet of the peasants are not bruised by wooden shoes; they eat white bread, are well clothed, and are not afraid of increasing their stock of cattle, nor of tiling their houses from any apprehension that their taxes will be raised the year following. The annual income of the estates of a great many commoners in England amounts to two hundred thousand livres, and yet these do not think it beneath them to plough the lands which enrich them, and on which they enjoy their liberty.

Section. 1. All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives. Section. 2. The House of Representatives shall be composed of Members chosen every second Year by the People of the several States, and the Electors in each State shall have the Qualifications requisite for Electors of the most numerous Branch of the State Legislature. No Person shall be a Representative who shall not have attained to the Age of twenty five Years, and been seven Years a Citizen of the United States, and who shall not, when elected, be an Inhabitant of that State in which he shall be chosen. Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons. The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct. No Person shall be a Senator who shall not have attained to the Age of thirty Years, and been nine Years a Citizen of the United States, and who shall not, when elected, be an Inhabitant of that State for which he shall be chosen.

When vacancies happen in the Representation from any State, the Executive Authority thereof shall issue Writs of Election to fill such Vacancies.

The Senate shall chuse their other Officers, and also a President pro tempore, in the Absence of the Vice President, or when he shall exercise the Office of President of the United States.

The House of Representatives shall chuse their Speaker and other Officers; and shall have the sole Power of Impeachment. Section. 3. The Senate of the United States shall be composed of two Senators from each State, chosen by the Legislature thereof for six Years; and each Senator shall have one Vote. Immediately after they shall be assembled in Consequence of the first Election, they shall be divided as equally as may be into three Classes. The Seats of the Senators of the first Class shall be vacated at the Expiration of the second Year, of the second Class at the Expiration of the fourth Year, and of the third Class at the Expiration of the sixth Year, so that one third may be chosen every second Year; and if Vacancies happen by Resignation, or otherwise, during the Recess of the Legislature of any State, the Executive thereof may make temporary Appointments until the next Meeting of the Legislature, which shall then fill such Vacancies.

The Vice President of the United States shall be President of the Senate, but shall have no Vote, unless they be equally divided.

The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present. Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law. Section. 4. The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.


The Congress shall assemble at least once in every Year, and such Meeting shall be on the first Monday in December, unless they shall by Law appoint a different Day.

Section. 5.

Each House shall be the Judge of the Elections, Returns and Qualifications of its own Members, and a Majority of each shall constitute a Quorum to do Business; but a smaller Number may adjourn from day to day, and may be authorized to compel the Attendance of absent Members, in such Manner, and under such Penalties as each House may provide.

Section. 7. Each House may determine the Rules of its Proceedings, punish its Members for disorderly Behaviour, and, with the Concurrence of two thirds, expel a Member. Each House shall keep a Journal of its Proceedings, and from time to time publish the same, excepting such Parts as may in their Judgment require Secrecy; and the Yeas and Nays of the Members of either House on any question shall, at the Desire of one fifth of those Present, be entered on the Journal. Neither House, during the Session of Congress, shall, without the Consent of the other, adjourn for more than three days, nor to any other Place than that in which the two Houses shall be sitting. Section. 6. The Senators and Representatives shall receive a Compensation for their Services, to be ascertained by Law, and paid out of the Treasury of the United States. All Bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills. Every Bill which shall have passed the House of Representatives and the Senate, shall, before it become a Law, be presented to the President of the United States: If he approve he shall sign it, but if not he shall return it, with his Objections to that House in which it shall have originated, who shall enter the Objections at large on their Journal, and proceed to reconsider it. If after such Reconsideration two thirds of that House shall agree to pass the Bill, it shall be sent, together with the Objections, to the other House, by which it shall likewise be reconsidered, and if approved by two thirds of that House, it shall become a Law. Section. 8. No State shall, without the Consent of the Congress, lay any Imposts or Duties on Imports or Exports, except what may be absolutely necessary for executing it's inspection Laws: and the net Produce of all Duties and Imposts, laid by any State on Imports or Exports, shall be for the Use of the Treasury of the United States; and all such Laws shall be subject to the Revision and Controul of the Congress. No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or


in such imminent Danger as will not admit of delay.

Article. II. Section. 1. The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years, and, together with the Vice President, chosen for the same Term, be elected, as follows: Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector. The Electors shall meet in their respective States, and vote by Ballot for two Persons, of whom one at least shall not be an Inhabitant of the same State with themselves. And they shall make a List of all the Persons voted for, and of the Number of Votes for each; which List they shall sign and certify, and transmit sealed to the Seat of the Government of the United States, directed to the President of the Senate. The President of the Senate shall, in the Presence of the Senate and House of Representatives, open all the Certificates, and the Votes shall then be counted. The Person having the greatest Number of Votes shall be the President, if such Number be a Majority of the whole Number of Electors appointed; and if there be more than one who have such Majority, and have an equal Number of Votes, then the House of Representatives

shall immediately chuse by Ballot one of them for President; and if no Person have a Majority, then from the five highest on the List the said House shall in like Manner chuse the President. But in chusing the President, the Votes shall be taken by States, the Representation from each State having one Vote; A quorum for this purpose shall consist of a Member or Members from two thirds of the States, and a Majority of all the States shall be necessary to a Choice. In every Case, after the Choice of the President, the Person having the greatest Number of Votes of the Electors shall be the Vice President. But if there should remain two or more who have equal Votes, the Senate shall chuse from them by Ballot the Vice President. The Congress may determine the Time of chusing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States. No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States. In Case of the Removal of the President from Office, or of his Death, Resignation, or Inability to discharge the Powers and Duties of the said Office, the Same shall devolve on the Vice President, and the Congress may by Law provide for the Case of Removal, Death, Resignation or Inability, both of the President and Vice President, declaring what Officer shall then act as President, and such Officer shall act accordingly, until the Disability be removed, or a President shall be elected.


The President shall, at stated Times, receive for his Services, a Compensation, which shall neither be increased nor diminished during the Period for which he shall have been elected, and he shall not receive within that Period any other Emolument from the United States, or any of them. Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation:--"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States." Section. 2. The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment. He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think

proper, in the President alone, in the Courts of Law, or in the Heads of Departments. The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session. Section. 3. He shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient; he may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper; he shall receive Ambassadors and other public Ministers; he shall take Care that the Laws be faithfully executed, and shall Commission all the Officers of the United States. Section. 4. The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

Article III. Section. 1. The judicial Power of the United States shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior


Courts, shall hold their Offices during good Behaviour, and shall, at stated Times, receive for their Services a Compensation, which shall not be diminished during their Continuance in Office. Section. 2. The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;--to all Cases affecting Ambassadors, other public Ministers and Consuls;--to all Cases of admiralty and maritime Jurisdiction;--to Controversies to which the United States shall be a Party;--to Controversies between two or more States;-between a State and Citizens of another State,--between Citizens of different States,-between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects. In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make. The Trial of all Crimes, except in Cases of Impeachment, shall be by Jury; and such Trial shall be held in the State where the said Crimes shall have been committed; but when not committed within any State, the Trial shall be at such Place or Places as the Congress may by Law have directed. Section. 3.

Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court. The Congress shall have Power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted.

Article. IV. Section. 1. Full Faith and Credit shall be given in each State to the public Acts, Records, and judicial Proceedings of every other State. And the Congress may by general Laws prescribe the Manner in which such Acts, Records and Proceedings shall be proved, and the Effect thereof. Section. 2. The Citizens of each State shall be entitled to all Privileges and Immunities of Citizens in the several States. A Person charged in any State with Treason, Felony, or other Crime, who shall flee from Justice, and be found in another State, shall on Demand of the executive Authority of the State from which he fled, be delivered up, to be removed to the State having Jurisdiction of the Crime. No Person held to Service or Labour in one State, under the Laws thereof, escaping into another, shall, in Consequence of any Law or Regulation therein, be discharged from


such Service or Labour, but shall be delivered up on Claim of the Party to whom such Service or Labour may be due. Section. 3. New States may be admitted by the Congress into this Union; but no new State shall be formed or erected within the Jurisdiction of any other State; nor any State be formed by the Junction of two or more States, or Parts of States, without the Consent of the Legislatures of the States concerned as well as of the Congress.

Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.

The Congress shall have Power to dispose of and make all needful Rules and Regulations respecting the Territory or other Property belonging to the United States; and nothing in this Constitution shall be so construed as to Prejudice any Claims of the United States, or of any particular State.

Article. VI.

Section. 4.

This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened), against domestic Violence.

Article. V. The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the

All Debts contracted and Engagements entered into, before the Adoption of this Constitution, shall be as valid against the United States under this Constitution, as under the Confederation.

The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.

Article. VII.


The Ratification of the Conventions of nine States, shall be sufficient for the Establishment of this Constitution between the States so ratifying the Same. what really deserves the name of virtue. Yet it should seem, allowing them to have souls, that there is but one way appointed by Providence to lead mankind to either virtue or happiness. If then women are not a swarm of ephemeron triflers, why should they be kept in ignorance under the specious name of innocence? Men complain, and with reason, of the follies and caprices of our sex, when they do not keenly satirise our headstrong passions and grovelling vices. Behold, I should answer, the natural effect of ignorance ! The mind will ever be unstable that has only prejudices to rest on, and the current will run with destructive fury when there are no barriers to break its force. Women are told from their infancy, and taught by the example of their mothers, that a little knowledge of human weakness, justly termed cunning, softness of temper, outward obedience, and a scrupulous attention to a puerile kind of propriety, will obtain for them the protection of man; and should they be beautiful, everything else is needless, for at least twenty years of their lives. Thus Milton describes our first frail mother; though when he tells us that women are formed for softness and sweet attractive grace, I cannot comprehend his meaning, unless, in the true Mahometan strain, he meant to deprive us of souls, and insinuate that we were beings only designed by sweet attractive grace, and docile blind obedience, to gratify the senses of man when he can no longer soar on the wing of contemplation. How grossly do they insult us who thus advise us only to render ourselves gentle, domestic brutes ! For instance, the winning softness so warmly and frequently recommended, that governs by obeying. What childish expressions, and how insignificant is the being--can it be an


immortal one?--who will condescend to govern by such sinister methods? "Certainly," says Lord Bacon, "man is of kin to the beasts by his body; and if he be not of kin to God by his spirit, he is a base and ignoble creature!" Men, indeed, appear to me to act in a very unphilosophical manner, when they try to secure the good conduct of women by attempting to keep them always in a state of childhood. Rousseau was more consistent when he wished to stop the progress of reason in both sexes, for if men eat of the tree of knowledge, women will come in for a taste; but, from the imperfect cultivation which their understandings now receive, they only attain a knowledge of evil. Children, I grant, should be innocent; but when the epithet is applied to men, or women, it is but a civil term for weakness. For if it be allowed that women were destined by Providence to acquire human virtues, and, by the exercise of their understandings, that stability of character which is the firmest ground to rest our future hopes upon, they must be permitted to turn to the fountain of light, and not forced to shape their course by the twinkling of a mere satellite. Milton, I grant, was of a very different opinion; for he only bends to the indefeasible right of beauty, though it would be difficult to render two passages which I now mean to contrast, consistent. But into similar inconsistencies are great men often led by their senses: To whom thus Eve with perfect beauty adorn'd My author and disposer, what thou bid'st Unargued I obey; so God ordains. God is thy law thou mine: to know no more Is woman's happiest knowledge and her praise. These are exactly the arguments that I have used to children; but I have added, your reason is now gaining strength, and, till it arrives at some degree of maturity, you must look up to me for advice,--then you ought to think, and only rely on God. Yet in the

following lines Milton seems to coincide with me, when he makes Adam thus expostulate with his Maker: Hast Thou not made me here Thy substitute, And these inferior far beneath me set ? Among equals what society Can sort, what harmony or true delight ? Which must be mutual, in proportion due Given and received; but in disparity The one intense, the other still remiss Cannot well suit with either, but soon prove Tedious alike: of fellowship I speak Such as I seek fit to participate All rational delight-In treating therefore of the manners of women, let us, disregarding sensual arguments, trace what we should endeavour to make them in order to co-operate, if the expression be not too bold, with the Supreme Being. By individual education, I mean, for the sense of the word is not precisely defined, such an attention to a child as will slowly sharpen the senses, form the temper, regulate the passions as they begin to ferment, and set the understanding to work before the body arrives at maturity; so that the man may only have to proceed, not to begin, the important task of learning to think and reason. To prevent any misconstruction, I must add, that I do not believe that a private education can work the wonders which some sanguine writers have attributed to it. Men and women must be educated, in a great degree, by the opinions and manners of the society they live in. In every age there has been a stream of popular opinion that has carried all before it, and given a family character, as it were, to the century. It may then fairly be inferred, that, till society be differently constituted, much cannot be expected from education. It is, however, sufficient for my present purpose to assert that, whatever effect circumstances have on the abilities, every being may become virtuous by the exercise of its own reason; for if but one


being was created with vicious inclinations, that is positively bad, what can save us from atheism? or if we worship a God, is not that God a devil? Consequently, the most perfect education, in my opinion, is such an exercise of the understanding as is best calculated to strengthen the body and form the heart. Or, in other words, to enable the individual to attain such habits of virtue as will render it independent. In fact, it is a farce to call any being virtuous whose virtues do not result from the exercise of its own reason. This was Rousseau's opinion respecting men; I extend it to women, and confidently assert that they have been drawn out of their sphere by false refinement, and not by an endeavour to acquire masculine qualities. Still the regal homage which they receive is so intoxicating, that until the manners of the times are changed, and formed on more reasonable principles, it may be impossible to convince them that the illegitimate power which they obtain by degrading themselves is a curse, and that they must return to nature and equality if they wish to secure the placid satisfaction that unsophisticated affections impart. But for this epoch we must wait-wait perhaps till kings and nobles, enlightened by reason, and, preferring the real dignity of man to childish state, throw off their gaudy hereditary trappings; and if then women do not resign the arbitrary power of beauty--they will prove that they have less mind than man. XXXXX I may be accused of arrogance; still I must declare what I firmly believe, that all the writers who have written on the subject of female education and manners, from Rousseau to Dr. Gregory, have contributed to render women more artificial, weak characters, than they would otherwise have been; and consequently, more useless members of society. I might have expressed this conviction in a lower key, but I am afraid it would have been the whine of affectation,

and not the faithful expression of my feelings, of the clear result which experience and reflection have led me to draw. When I come to that division of the subject, I shall advert to the passages that I more particularly disapprove of, in the works of the authors I have just alluded to; but it is first necessary to observe that my objection extends to the whole purport of those books, which tend, in my opinion, to degrade onehalf of the human species, and render women pleasing at the expense of every solid virtue. Though, to reason on Rousseau's ground, if man did attain a degree of perfection of mind when his body arrived at maturity, it might be proper, in order to make a man and his wife one, that she should rely entirely on his understanding; and the graceful ivy, clasping the oak that supported it, would form a whole in which strength and beauty would be equally conspicuous. But, alas ! husbands, as well as their helpmates, are often only overgrown children,--nay, thanks to early debauchery, scarcely men in their outward form,--and if the blind lead the blind, one need not come from heaven to tell us the consequence. Many are the causes that, in the present corrupt state of society, contribute to enslave women by cramping their understandings and sharpening their senses. One, perhaps, that silently does more mischief than all the rest, is their disregard of order. To do everything in an orderly manner is a most important precept, which women, who, generally speaking, receive only a disorderly kind of education, seldom attend to with that degree of exactness that men, who from their infancy are broken into method, observe. This negligent kind of guesswork-for what other epithet can be used to point out the random exertions of a sort of instinctive common sense never brought to the test of reason?--prevents their


generalising matters of fact; so they do today what they did yesterday, merely because they did it yesterday. This contempt of the understanding in early life has more baneful consequences than is commonly supposed; for the little knowledge which women of strong minds attain is, from various circumstances, of a more desultory kind than the knowledge of men, and it is acquired more by sheer observations on real life than from comparing what has been individually observed with the results of experience generalised by speculation. Led by their dependent situation and domestic employments more into society, what they learn is rather by snatches; and as learning is with them in general only a secondary thing, they do not pursue any one branch with that persevering ardour necessary to give vigour to the faculties and clearness to the judgment. In the present state of society a little learning is required to support the character of a gentleman, and boys are obliged to submit to a few years of discipline. But in the education of women, the cultivation of the understanding is always subordinate to the acquirement of some corporeal accomplishment. Even when enervated by confinement and false notions of modesty, the body is prevented from attaining that grace and beauty which relaxed half-formed limbs never exhibit. Besides, in youth their faculties are not brought forward by emulation; and having no serious scientific study, if they have natural sagacity, it is turned too soon on life and manners. They dwell on effects and modifications, without tracing them back to causes; and complicated rules to adjust behaviour are a weak substitute for simple principles. As a proof that education gives this appearance of weakness to females, we may instance the example of military men, who

are, like them, sent into the world before their minds have been stored with knowledge, or fortified by principles. The consequences are similar; soldiers acquire a little superficial knowledge, snatched from the muddy current of conversation, and from continually mixing with society, they gain what is termed a knowledge of the world; and this acquaintance with manners and customs has frequently been confounded with a knowledge of the human heart. But can the crude fruit of casual observation, never brought to the test of judgment, formed by comparing speculation and experience, deserve such a distinction ? Soldiers, as well as women, practise the minor virtues with punctilious politeness. Where is then the sexual difference, when the education has been the same? All the difference that I can discern arises from the superior advantage of liberty which enables the former to see more of life. It is wandering from my present subject, perhaps, to make a political remark; but as it was produced naturally by the train of my reflections, I shall not pass it silently over. Standing armies can never consist of resolute robust men; they may be welldisciplined machines, but they will seldom contain men under the influence of strong passions, or with very vigorous faculties; and as for any depth of understanding, I will venture to affirm that it is as rarely to be found in the army as amongst women. And the cause, I maintain, is the same. It may be further observed that officers are also particularly attentive to their persons, fond of dancing, crowded rooms, adventures, and ridicule.[1] Like the fair sex, the business of their lives is gallantry; they were taught to please, and they only live to please. Yet they do not lose their rank in the distinction of sexes, for they are still reckoned superior to women, though in what their superiority


consists, beyond what I have just mentioned, it is difficult to discover. The great misfortune is this, that they both acquire manners before morals, and a knowledge of life before they have from reflection any acquaintance with the grand ideal outline of human nature. The consequence is natural. Satisfied with common nature, they become a prey to prejudices, and taking all their opinions on credit, they blindly submit to authority. So that if they have any sense, it is a kind of instinctive glance that catches proportions, and decides with respect to manners, but fails when arguments are to be pursued below the surface, or opinions analysed. May not the same remark be applied to women? Nay, the argument may be carried still further, for they are both thrown out of a useful station by the unnatural distinctions established in civilised life. Riches and hereditary honours have made cyphers of women to give consequence to the numerical figure; and idleness has produced a mixture of gallantry and despotism into society, which leads the very men who are the slaves of their mistresses to tyrannise over their sisters, wives, and daughters. This is only keeping them in rank and file, it is true. Strengthen the female mind by enlarging it, and there will be an end to blind obedience; but as blind obedience is ever sought for by power, tyrants and sensualists are in the right endeavour to keep woman in the dark, because only want slaves, and the latter a plaything. The sensualist, indeed, has been the most dangerous of tyrants, and women have been duped by their lovers, as princes by their ministers, whilst dreaming that they reigned over them. I now principally allude to Rousseau, for his character of Sophia is undoubtedly a captivating one, though it appears to me grossly unnatural. However, it is not the superstructure, but the foundation of her

character, the principles on which her education was built, that I mean to attack; nay, warmly as I admire the genius of that able writer, whose opinions I shall often have occasion to cite, indignation always takes place of admiration, and the rigid frown of insulted virtue effaces the smile of complacency which his eloquent periods are wont to raise when I read his voluptuous reveries. Is this the man who, in his ardour for virtue, would banish all the soft arts of peace, and almost carry us back to Spartan discipline? Is this the man who delights to paint the useful struggles of passion, the triumphs of good dispositions, and the heroic flights which carry the glowing soul out of itself? How are these mighty sentiments lowered when he describes the pretty foot and enticing airs of his little favourite ! But for the present I waive the subject, and instead of severely reprehending the transient effusions of overweening sensibility, I shall only observe that whoever has cast a benevolent eye on society must often have been gratified by the sight of humble mutual love not dignified by sentiment, or strengthened by a union in intellectual pursuits. The domestic trifles of the day have afforded matters for cheerful converse, and innocent caresses have softened toils which did not require great exercise of mind or stretch of thought; yet has not the sight of this moderate felicity excited more tenderness than respect ?--an emotion similar to what we feel when children are playing or animals sporting;[2] whilst the contemplation of the noble struggles of suffering merit has raised admiration, and carried our thoughts to that world where sensation will give place to reason. Women are therefore to be considered either as moral beings, or so weak that they must be entirely subjected to the superior faculties of men.


Let us examine this question. Rousseau declares that a woman should never for a moment feel herself independent, that she should be governed by fear to exercise her natural cunning, and made a coquettish slave in order to render her a more alluring object of desire, a sweeter companion to man, whenever he chooses to relax himself. He carries the arguments, which he pretends to draw from the indications of nature, still further, and insinuates that truth and fortitude, the corner-stones of all human virtue, should be cultivated with certain restrictions, because, with respect to the female character, obedience is the grand lesson which ought to be impressed with unrelenting rigour. What nonsense ! When will a great man arise with sufficient strength of mind to puff away the fumes which pride and sensuality have thus spread over the subject? If women are by nature inferior to men, their virtues must be the same in quality, if not in degree, or virtue is a relative idea; consequently their conduct should be founded on the same principles, and have the same aim. Connected with man as daughters, wives, and mothers, their moral character may be estimated by their manner of fulfilling those simple duties; but the end, the grand end, of their exertions should be to unfold their own faculties, and acquire the dignity of conscious virtue. They may try to render their road pleasant; but ought never to forget, in common with man, that life yields not the felicity which can satisfy an immortal soul. I do not mean to insinuate that either sex should be so lost in abstract reflections or distant views as to forget the affections and duties that lie before them, and are, in truth, the means appointed to produce the fruit of life; on the contrary, I would warmly recommend them, even while I assert, that they afford most satisfaction

when they are considered in their true sober light. Probably the prevailing opinion that woman was created for man, may have taken its rise from Moses' poetical story; yet as very few, it is presumed, who have bestowed any serious thought on the subject ever supposed that Eve was, literally speaking, one of Adam's ribs, the deduction must be allowed to fall to the ground, or only be so far admitted as it proves that man, from the remotest antiquity, found it convenient to exert his strength to subjugate his companion, and his invention to show that she ought to have her neck bent under the yoke, because the whole creation was only created for his convenience or pleasure. Let it not be concluded that I wish to invert the order of things. I have already granted that, from the constitution of their bodies, men seemed to be designed by Providence to attain a greater degree of virtue. I speak collectively of the whole sex; but I see not the shadow of a reason to conclude that their virtues should differ in respect to their nature. In fact, how can they, if virtue has only one eternal standard? I must therefore, if I reason consequentially, as strenuously maintain that they have the same simple direction as that there is a God. It follows then that cunning should not be opposed to wisdom, little cares to great exertions, or insipid softness, varnished over with the name of gentleness, to that fortitude which grand views alone can inspire. I shall be told that woman would then lose many of her peculiar graces, and the opinion of a well-known poet might be quoted to refute my unqualified assertion. For Pope has said in the name of the whole male sex: Yet ne'er so sure our passion to create, As when she touch'd the brink of all we hate.


In what light this sally places men and women I shall leave to the judicious to determine. Meanwhile, I shall content myself with observing, that I cannot discover why, unless they are mortal, females should always be degraded by being made subservient to love or lust. To speak disrespectfully of love is, I know, high treason against sentiment and fine feelings; but I wish to speak the simple language of truth, and rather to address the head than the heart. To endeavour to reason love out of the world would be to outQuixote Cervantes, and equally offend against common sense; but an endeavour to restrain this tumultuous passion, and to prove that it should not be allowed to dethrone superior powers, or to usurp the sceptre which the understanding should very coolly wield, appears less wild. Youth is the season for love in both sexes; but in those days of thoughtless enjoyment provision should be made for the more important years of life, when reflection takes place of sensation. But Rousseau, and most of the male writers who have followed his steps, have warmly inculcated that the whole tendency of female education ought to be directed to one point--to render them pleasing. Let me reason with the supporters of this opinion who have any knowledge of human nature. Do they imagine that marriage can eradicate the habitude of life? The woman who has only been taught to please will soon find that her charms are oblique sunbeams, and that they cannot have much effect on her husband's heart when they are seen every day, when the summer is passed and gone. Will she then have sufficient native energy to look into herself for comfort, and cultivate her dormant faculties? or is it not more rational to expect that she will try to please other men, and, in the emotions raised by the expectation of new conquests,

endeavour to forget the mortification her love or pride has received? When the husband ceases to be a lover, and the time will inevitably come, her desire of pleasing will then grow languid, or become a spring of bitterness; and love, perhaps, the most evanescent of all passions, gives place to jealousy or vanity. I now speak of women who are restrained by principle or prejudice. Such women, though they would shrink from an intrigue with real abhorrence, yet, nevertheless, wish to be convinced by the homage of gallantry that they are cruelly neglected by their husbands; or, days and weeks are spent in dreaming of the happiness enjoyed by congenial souls, till their health is undermined and their spirits broken by discontent. How then can the great art of pleasing be such a necessary study? it is only useful to a mistress. The chaste wife and serious mother should only consider her power to please as the polish of her virtues, and the affection of her husband as one of the comforts that render her task less difficult, and her life happier. But, whether she be loved or neglected, her first wish should be to make herself respectable, and not to rely for all her happiness on a being subject to like infirmities with herself. The worthy Dr. Gregory fell into a similar error. I respect his heart, but entirely disapprove of his celebrated Legacy to his Daughters. He advises them to cultivate a fondness for dress, because a fondness for dress, he asserts, is natural to them. I am unable to comprehend what either he or Rousseau mean when they frequently use this indefinite term. If they told us that in a preexistent state the soul was fond of dress, and brought this inclination with it into a new body, I should listen to them with a halfsmile, as I often do when I hear a rant about innate elegance. But if he only meant to say that the exercise of the faculties will produce


this fondness, I deny it. It is not natural; but arises, like false ambition in men, from a love of power. Dr. Gregory goes much further; he actually recommends dissimulation, and advises an innocent girl to give the lie to her feelings, and not dance with spirit, when gaiety of heart would make her feet eloquent without making her gestures immodest. In the name of truth and common sense, why should not one woman acknowledge that she can take more exercise than another? or, in other words, that she has a sound constitution; and why, to damp innocent vivacity, is she darkly to be told that men will draw conclusions which she little thinks of? Let the libertine draw what inference he pleases; but, I hope, that no sensible mother will restrain the natural frankness of youth by instilling such indecent cautions. out of the abundance of the heart the mouth speaketh; and a wiser than Solomon hath said that the heart should be made clean, and not trivial ceremonies observed, which it is not very difficult to fulfil with scrupulous exactness when vice reigns in the heart. Women ought to endeavour to purify their heart; but can they do so when their uncultivated understandings make them entirely dependent on their senses for employment and amusement, when no noble pursuits set them above the little vanities of the day, or enables them to curb the wild emotions that agitate a reed, over which every passing breeze has power? To gain the affections of a virtuous man, is affectation necessary? Nature has given woman a weaker frame than man; but, to ensure her husband's affections, must a wife, who, by the exercise of her mind and body whilst she was discharging the duties of a daughter, wife, and mother, has allowed her constitution to retain its natural strength, and her nerves a healthy tone,--is she, I say, to condescend to use art, and feign a sickly

delicacy, in order to secure her husband's affection? Weakness may excite tenderness, and gratify the arrogant pride of man; but the lordly caresses of a protector will not gratify a noble mind that pants for and deserves to be respected. Fondness is a poor substitute for friendship! In a seraglio, I grant, that all these arts are necessary; the epicure must have his palate tickled, or he will sink into apathy; but have women so little ambition as to be satisfied with such a condition? Can they supinely dream life away in the lap of pleasure, or the languor of weariness, rather than assert their claim to pursue reasonable pleasures, and render themselves conspicuous by practising the virtues which dignify mankind? Surely shehas not an immortal soul who can loiter life away merely employed to adorn her person, that she may amuse the languid hours, and soften the cares of a fellowcreature who is willing to be enlivened by her smiles and tricks, when the serious business of life is over. Besides, the woman who strengthens her body and exercises her mind will, by managing her family and practising various virtues, become the friend, and not the humble dependent of her husband; and if she, by possessing such substantial qualities, merit his regard, she will not find it necessary to conceal her affection, nor to pretend to an unnatural coldness of constitution to excite her husband's passions. In fact, if we revert to history, we shall find that the women who have distinguished themselves have neither been the most beautiful nor the most gentle of their sex. Nature, or, to speak with strict propriety, God, has made all things right; but man has sought him out many inventions to mar the work. I now allude to that part of Dr. Gregory's treatise, where he advises a wife never to let her husband know the extent of her sensibility or affection. Voluptuous


precaution, and as ineffectual as absurd. Love, from its very nature, must be transitory. To seek for a secret that would render it constant, would be as wild a search as for the philosopher's stone, or the grand panacea; and the discovery would be equally useless, or rather pernicious, to mankind. The most holy band of society is friendship. It has been well said, by a shrewd satirist, "that rare as true love is true friendship is still rarer." This is an obvious truth, and, the cause not lying deep, will not elude a slight glance of inquiry. Love, the common passion, in which chance and sensation take place of choice and reason, is, in some degree, felt by the mass of mankind; for it is not necessary to speak, at present, of the emotions that rise above or sink below love. This passion, naturally increased by suspense and difficulties, draws the mind out of its accustomed state, and exalts the affections; but the security of marriage, allowing the fever of love to subside, a healthy temperature is thought insipid only by those who have not sufficient intellect to substitute the calm tenderness of friendship, the confidence of respect, instead of blind admiration, and the sensual emotions of fondness. This is, must be, the course of nature. Friendship or indifference inevitably succeeds love. And this constitution seems perfectly to harmonise with the system of government which prevails in the moral world. Passions are spurs to action, and open the mind; but they sink into mere appetites, become a personal and momentary gratification when the object is gained, and the satisfied mind rests in enjoyment. The man who had some virtue whilst he was struggling for a crown, often becomes a voluptuous tyrant when it graces his brow; and, when the lover is not lost in the husband, the dotard, a prey to childish

caprices and fond jealousies, neglects the serious duties of life, and the caresses which should excite confidence in his children are lavished on the overgrown child, his wife. In order to fulfil the duties of life, and to be able to pursue with vigour the various employments which form the moral character, a master and mistress of a family ought not to continue to love each other with passion. I mean to say that they ought not to indulge those emotions which disturb the order of society, and engross the thoughts that should be otherwise employed. The mind that has never been engrossed by one object wants vigour,--if it can long be so, it is weak. A mistaken education, a narrow uncultivated mind, and many sexual prejudices, tend to make women more constant than men; but, for the present, I shall not .ouch on this branch of the subject. I will go still further, and advance, without dreaming of a paradox, that an unhappy marriage is often very advantageous to a family, and that the neglected wife is, in general, the best mother. And this would almost always be the consequence if the female mind were more enlarged; for, it seems to be the common dispensation of Providence, that what we gain in present enjoyment should be deducted from the treasure of life, experience; and that when we are gathering the flowers of the day, and revelling in pleasure, the solid fruit of toil and wisdom should not be caught at the same time. The way lies before us, we must turn to the right or left; and he who will pass life away in bounding from one pleasure to another, must not complain if he acquire neither wisdom nor respectability of character. Supposing, for a moment, that the soul is not immortal, and that man was only created for the present scene,--I think we should have reason to complain that love, infantine fondness, ever grew insipid and palled upon


the sense. Let us eat, drink, and love, for tomorrow we die, would be, in fact, the language of reason, the morality of life; and who but a fool would part with a reality for a fleeting shadow ? But, if awed by observing the improbable powers of the mind, we disdain to confine our wishes or thoughts to such a comparatively mean field of action, that only appears grand and important, as it is connected with a boundless prospect and sublime hopes, what necessity is there for falsehood in conduct, and why must the sacred majesty of truth be violated to detain a deceitful good that saps the very foundation of virtue? Why must the female mind be tainted by coquettish arts to gratify the sensualist, and prevent love from subsiding into friendship, or compassionate tenderness, when there are not qualities on which friendship can be built? Let the honest heart show itself, and reason teach passion to submit to necessity; or, let the dignified pursuit of virtue and knowledge raise the mind above those emotions which rather embitter than sweeten the cup of life, when they are not restrained within due bounds. I do not mean to allude to the romantic passion, which is the concomitant of genius. Who can clip its wing? But that grand passion not proportioned to the puny enjoyments of life, is only true to the sentiment, and feeds on itself. The passions which have been celebrated for their durability have always been unfortunate. They have acquired strength by absence and constitutional melancholy. The fancy has hovered round a form of beauty dimly seen; but familiarity might have turned admiration into disgust, or, at least, into indifference, and allowed the imagination leisure to start fresh game. With perfect propriety, according to this view of things, does Rousseau make the mistress of his soul, Eloisa, love St. Preux, when life was fading

before her; but this is no proof of the immortality of the passion. Of the same complexion is Dr. Gregory's advice respecting delicacy of sentiment, which he advises a woman not to acquire, if she have determined to marry. This determination, however, perfectly consistent with his former advice, he calls indelicate, and earnestly persuades his daughters to conceal it, though it may govern their conduct, as if it were indelicate to have the common appetites of human nature. Noble morality! and consistent with the cautious prudence of a little soul that cannot extend its views beyond the present minute division of existence. If all the faculties of woman's mind are only to be cultivated as they respect her dependence on man; if, when a husband be obtained, she have arrived at her goal, and meanly proud, rests satisfied with such a paltry crown, let her grovel contentedly, scarcely raised by her employments above the animal kingdom; but, if struggling for the prize of her high calling, she look beyond the present scene, let her cultivate her understanding without stopping to consider what character the husband may have whom she is destined to marry. Let her only determine, without being too anxious about present happiness, to acquire the qualities that ennoble a rational being, and a rough inelegant husband may shock her taste without destroying her peace of mind. She will not model her soul to suit the frailties of her companion, but to bear with them; his character may be a trial, but not an impediment to virtue. If Dr. Gregory confined his remark to romantic.expectations of constant love and congenial feelings, he should have recollected that experience will banish what advice can never make us cease to wish for, when the imagination is kept alive at the expense of reason.


I own it frequently happens, that women who have fostered a romantic unnatural delicacy of feeling, waste their [3] lives in imagining how happy they should have been with a husband who could love them with a fervid increasing affection every day, and all day. But they might as well pine married as single, and would not be a jot more unhappy with a bad husband than longing for a good one. That a proper education, or, to speak with more precision, a well-stored mind, would enable a woman to support a single life with dignity, I grant; but that she should avoid cultivating her taste, lest her husband should occasionally shock it, is quitting a substance for a shadow. To say the truth, I do not know of what use is an improved taste, if the individual be not rendered more independent of the casualties of life; if new sources of enjoyment, only dependent on the solitary operations of the mind, are not opened. People of taste, married or single, without distinction, will ever be disgusted by various things that touch not less observing minds. On this conclusion the argument must not be allowed to hinge; but in the whole sum of enjoyment is taste to be denominated a blessing? The question is, whether it procures most pain or pleasure? The answer will decide the propriety of Dr. Gregory's advice, and show how absurd and tyrannic it is thus to lay down a system of slavery, or to attempt to educate moral beings by any other rules than those deduced from pure reason, which apply to the whole species. Gentleness of manners, forbearance and long-suffering, are such amiable Godlike qualities, that in sublime poetic strains the Deity has been invested with them; and, perhaps, no representation of His goodness so strongly fastens on the human affections as those that represent Him abundant in mercy and willing to pardon. Gentleness, considered in this point of view, bears on its

front all the characteristics of grandeur, combined with the winning graces of condescension; but what a different aspect it assumes when it is the submissive demeanour of dependence, the support of weakness that loves, because it wants protection; and is forbearing, because it must silently endure injuries; smiling under the lash at which it dare not snarl. Abject as this picture appears, it is the portrait of an accomplished woman, according to the received opinion of female excellence, separated by specious reasoners from human excellence. Or, they [4] kindly restore the rib, and make one moral being of a man and woman; not forgetting to give her all the "submissive charms." How women are to exist in that state where there is neither to be marrying nor giving in marriage, we are not told. For though moralists have agreed that the tenor of life seems to prove that man is prepared by various circumstances for a future state, they constantly concur in advising woman only to provide for the present. Gentleness, docility, and a spaniel like affection are, on this ground, consistently recommended as the cardinal virtues of the sex; and, disregarding the arbitrary economy of nature, one writer has declared that it is masculine for a woman to be melancholy. She was created to be the toy of man, his rattle, and it must jingle in his ears whenever, dismissing reason, he chooses to be amused. To recommend gentleness, indeed, on a broad basis is strictly philosophical. A frail being should labour to be gentle. But when forbearance confounds right and wrong, it ceases to be a virtue; and, however convenient it may be found in a companion-that companion will ever be considered as an inferior, and only inspire a vapid tenderness, which easily degenerates into contempt. Still, if advice could really make a being gentle, whose natural disposition


admitted not of such a fine polish, something towards the advancement of order would be attained; but if, as might quickly be demonstrated, only affectation be produced by this indiscriminate counsel, which throws a stumbling-block in the way of gradual improvement, and true melioration of temper, the sex is not much benefited by sacrificing solid virtues to the attainment of superficial graces, though for a few years they may procure the individuals regal sway. As a philosopher, I read with indignation the plausible epithets which men use to soften their insults; and, as a moralist, I ask what is meant by such heterogeneous associations, as fair defects, amiable weaknesses, etc. ? If there be but one criterion of morals, but one architype for man, women appear to be suspended by destiny, according to the vulgar tale of Mahomet's coffin; they have neither the unerring instinct of brutes, nor are allowed to fix the eye of reason on a perfect model. They were made to be loved, and must not aim at respect, lest they should be hunted out of society as masculine. But to view the subject in another point of view. Do passive indolent women make the best wives? Confining our discussion to the present moment of existence, let us see how such weak creatures perform their part ? Do the women who, by the attainment of a few superficial accomplishments, have strengthened the prevailing prejudice, merely contribute to the happiness of their husbands? Do they display their charms merely to amuse them ? And have women who have early imbibed notions of passive obedience, sufficient character to manage a family or educate children? So far from it, that, after surveying the history of woman, I cannot help agreeing with the severest satirist, considering the sex as the weakest as well as the most oppressed half of the species. What does history disclose but

marks of inferiority, and how few women have emancipated themselves from the galling yoke of sovereign man? So few that the exceptions remind me of an ingenious conjecture respecting Newton-that he was probably a being of superior order accidentally caged in a human body. Following the same train of thinking, I have been led to imagine that the few extraordinary women who have rushed in eccentrical directions out of the orbit prescribed to their sex, were male spirits, confined by mistake in female frames. But if it be not philosophical to think of sex when the soul is mentioned, the inferiority must depend on the organs; or the heavenly fire, which is to ferment the clay, is not given in equal portions. But avoiding, as I have hitherto done, any direct comparison of the two sexes collectively, or frankly acknowledging the inferiority of woman, according to the present appearance of things, I shall only insist that men have increased that inferiority till women are almost sunk below the standard of rational creatures. Let their faculties have room to unfold, and their virtues to gain strength, and then determine where the whole sex must stand in the intellectual scale. Yet let it be remembered, that for a small number of distinguished women I do not ask a place‌

Mouth of the River St. Lawrence by the West End of the Island of Anticosti, terminates at the aforesaid River of St. John.

October 7, 1763 WHEREAS we have taken into Our Royal Consideration the extensive and valuable Acquisitions in America, secured to our Crown by the late Definitive Treaty of Peace, concluded at Paris the 10th Day of February last; and being desirous that all Our loving Subjects, as well of our Kingdom as of our Colonies in America, may avail themselves with all convenient Speed, of the great Benefits and Advantages which must accrue therefrom to their Commerce, Manufactures, and Navigation, We have thought fit, with the Advice of our Privy Council, to issue this our Royal Proclamation, hereby to publish and declare to all our loving Subjects, that we have, with the Advice of our Said Privy Council, granted our Letters Patent, under our Great Seal of Great Britain, to erect, within the Countries and Islands ceded and confirmed to Us by the said Treaty, Four distinct and separate Governments, styled and called by the names of Quebec, East Florida, West Florida and Grenada, and limited and bounded as follows, viz. First — The Government of Quebec bounded on the Labrador Coast by the River St. John, and from thence by a Line drawn from the Head of that River through the Lake St. John, to the South end of the Lake Nipissing; from whence the said Line, crossing the River St. Lawrence, and the Lake Champlain, in 45 Degrees of North Latitude, passes along the High Lands which divide the Rivers that empty themselves into the said River St. Lawrence from those which fall into the Sea; and also along the North Coast of the Baye des Châleurs, and the Coast of the Gulph of St. Lawrence to Cape Rosières, and from thence crossing the

Secondly — The Government of East Florida, bounded to the Westward by the Gulph of Mexico and the Apalachicola River; to the Northward by a Line drawn from that part of the said River where the Chatahouchee and Flint Rivers meet, to the source of St. Mary's River, and by the course of the said River to the Atlantic Ocean; and to the Eastward and Southward by the Atlantic Ocean and the Gulph of Florida, including all Islands within Six Leagues of the Sea Coast. Thirdly — The Government of West Florida, bounded to the Southward by the Gulph of Mexico, including all Islands within Six Leagues of the Coast; from the River Apalachicola to Lake Pontchartrain; to the Westward by the said Lake, the Lake Maurepas, and the River Mississippi; to the Northward by a Line drawn due East from that part of the River Mississippi which lies in 31 Degrees North Latitude, to the River Apalachicola or Chatahouchee; and to the Eastward by the said River. Fourthly — The Government of Grenada, comprehending the Island of that name, together with the Grenadines, and the Islands of Dominico, St. Vincent's and Tobago. And to the end that the open and free Fishery of our Subjects may be extended to and carried on upon the Coast of Labrador, and the adjacent Islands. We have thought fit, with the advice of our said Privy Council to put all that Coast, from the River St. John's to Hudson's Streights, together with the Islands of Anticosti and Madelaine, and all other smaller Islands lying upon the said Coast, under the care and Inspection of our Governor of Newfoundland.


We have also, with the advice of our Privy Council, thought fit to annex the Islands of St. John's [now known as Prince Edward Island] and Cape Breton, or Isle Royale, with the lesser Islands adjacent thereto, to our Government of Nova Scotia. We have also, with the advice of our ivy Council aforesaid, annexed to our Province of Georgia all the Lands Iying between the Rivers Alatamaha and St. Mary's. And whereas it will greatly contribute to the speedy settling of our said new Governments, that our loving Subjects should be informed of our Paternal care, for the security of the Liberties and Properties of those who are and shall become Inhabitants thereof, We have thought fit to publish and declare, by this Our Proclamation, that We have, in the Letters Patent under our Great Seal of Great Britain, by which the said Governments are constituted, given express Power and Direction to our Governors of our Said Colonies respectively, that so soon as the state and circumstances of the said Colonies will admit thereof, they shall, with the Advice and Consent of the Members of our Council, summon and call General Assemblies within the said Governments respectively, in such Manner and Form as is used and directed in those Colonies and Provinces in America which are under our immediate Government: And We have also given Power to the said Governors, with the consent of our Said Councils, and the Representatives of the People so to be summoned as aforesaid, to make, constitute, and ordain Laws, Statutes, and Ordinances for the Public Peace, Welfare, and good Government of our said Colonies, and of the People and Inhabitants thereof, as near as may be agreeable to the Laws of England, and under such Regulations and Restrictions as are used in other Colonies; and in the mean Time, and until such Assemblies can

be called as aforesaid, all Persons Inhabiting in or resorting to our Said Colonies may confide in our Royal Protection for the Enjoyment of the Benefit of the Laws of our Realm of England; for which Purpose We have given Power under our Great Seal to the Governors of our said Colonies respectively to erect and constitute, with the Advice of our said Councils respectively, Courts of Judicature and public Justice within our Said Colonies for hearing and determining all Causes, as well Criminal as Civil, according to Law and Equity, and as near as may be agreeable to the Laws of England, with Liberty to all Persons who may think themselves aggrieved by the Sentences of such Courts, in all Civil Cases, to appeal, under the usual Limitations and Restrictions, to Us in our Privy Council. We have also thought fit, with the advice of our Privy Council as aforesaid, to give unto the Governors and Councils of our said Three new Colonies upon the Continent, full Power and Authority to settle and agree with the Inhabitants of our said new Colonies or with any other Persons who shall resort thereto, for such Lands, Tenements and Hereditaments, as are now or hereafter shall be in our Power to dispose of; and them to grant to any such Person or Persons upon such Terms, and under such moderate QuitRents, Services and Acknowledgments, as have been appointed and settled in our other Colonies, and under such other Conditions as shall appear to us to be necessary and expedient for the Advantage of the Grantees, and the Improvement and settlement of our said Colonies. And Whereas, We are desirous, upon all occasions, to testify our Royal Sense and Approbation of the Conduct and bravery of the Officers and Soldiers of our Armies, and to reward the same, We do hereby command and impower our Governors of our said


Three new Colonies, and all other our Governors of our several Provinces on the Continent of North America, to grant without Fee or Reward, to such reduced Officers as have served in North America during the late War, and to such Private Soldiers as have been or shall be disbanded in America, and are actually residing there, and shall personally apply for the same, the following Quantities of Lands, subject, at the Expiration of Ten Years, to the same Quit-Rents as other Lands are subject to in the Province within which they are granted, as also subject to the same Conditions of Cultivation and Improvement; viz. To every Person having the Rank of a Field Officer—5,000 Acres. To every Captain—3,000 Acres. To every Subaltern or Staff Officer—2,000 Acres. To every Non-Commission Officer—200 Acres. To every Private Man—50 Acres. We do likewise authorize and require the Governors and Commanders in Chief of all our said Colonies upon the Continent of North America to grant the like Quantities of Land, and upon the same conditions, to such reduced Officers of our Navy of like Rank as served on board our Ships of War in North America at the times of the Reduction of Louisbourg and Quebec in the late War, and who shall personally apply to our respective Governors for such Grants. And whereas it is just and reasonable, and essential to our Interest, and the Security of our Colonies, that the several Nations or Tribes of Indians with whom We are connected, and who live under our Protection, should not be molested or disturbed in the Possession of such Parts of Our Dominions and Territories as, not

having been ceded to or purchased by Us, are reserved to them, or any of them, as their Hunting Grounds —We do therefore, with the Advice of our Privy Council, declare it to be our Royal Will and Pleasure, that no Governor or Commander in Chief in any of our Colonies of Quebec, East Florida, or West Florida, do presume, upon any Pretence whatever, to grant Warrants of Survey, or pass any Patents for Lands beyond the Bounds of their respective Governments, as described in their Commissions: as also that no Governor or Commander in Chief in any of our other Colonies or Plantations in America do presume for the present, and until our further Pleasure be known, to grant Warrants of Survey, or pass Patents for any Lands beyond the Heads or Sources of any of the Rivers which fall into the Atlantic Ocean from the West and North West, or upon any Lands whatever, which, not having been ceded to or purchased by Us as aforesaid, are reserved to the said Indians, or any of them. And We do further declare it to be Our Royal Will and Pleasure, for the present as aforesaid, to reserve under our Sovereignty, Protection, and Dominion, for the use of the said Indians, all the Lands and Territories not included within the Limits of Our said Three new Governments, or within the Limits of the Territory granted to the Hudson's Bay Company, as also all the Lands and Territories lying to the Westward of the Sources of the Rivers which fall into the Sea from the West and North West as aforesaid. And We do hereby strictly forbid, on Pain of our Displeasure, all our loving Subjects from making any Purchases or Settlements whatever, or taking Possession of any of the Lands above reserved, without our especial


leave and Licence for that Purpose first obtained. And We do further strictly enjoin and require all Persons whatever who have either wilfully or inadvertently seated themselves upon any Lands within the Countries above described or upon any other Lands which, not having been ceded to or purchased by Us, are still reserved to the said Indians as aforesaid, forthwith to remove themselves from such Settlements. And whereas great Frauds and Abuses have been committed in purchasing Lands of the Indians, to the great Prejudice of our Interests, and to the great Dissatisfaction of the said Indians: In order, therefore, to prevent such Irregularities for the future, and to the end that the Indians may be convinced of our Justice and determined Resolution to remove all reasonable Cause of Discontent, We do, with the Advice of our Privy Council strictly enjoin and require, that no private Person do presume to make any purchase from the said Indians of any Lands reserved to the said Indians, within those parts of our Colonies where We have thought proper to allow Settlement: but that, if at any Time any of the Said Indians should be inclined to dispose of the said Lands, the same shall be Purchased only for Us, in our Name, at some public Meeting or Assembly of the said Indians, to be held for that Purpose by the Governor or Commander in Chief of our Colony respectively within which they shall lie: and in case they shall lie within the limits of any Proprietary Government, they shall be purchased only for the Use and in the name of such Proprietaries, conformable to such Directions and Instructions as We or they shall think proper to give for that Purpose: And we do, by the Advice of our Privy Council, declare and enjoin, that the Trade with the said Indians shall be free and open

to all our Subjects whatever, provided that every Person who may incline to Trade with the said Indians do take out a Licence for carrying on such Trade from the Governor or Commander in Chief of any of our Colonies respectively where such Person shall reside, and also give Security to observe such Regulations as We shall at any Time think fit, by ourselves or by our Commissaries to be appointed for this Purpose, to direct and appoint for the Benefit of the said Trade: And we do hereby authorize, enjoin, and require the Governors and Commanders in Chief of all our Colonies respectively, as well those under Our immediate Government as those under the Government and Direction of Proprietaries, to grant such Licences without Fee or Reward, taking especial Care to insert therein a Condition, that such Licence shall be void, and the Security forfeited in case the Person to whom the same is granted shall refuse or neglect to observe such Regulations as We shall think proper to prescribe as aforesaid. And we do further expressly conjoin and require all Officers whatever, as well Military as those Employed in the Management and Direction of Indian Affairs, within the Territories reserved as aforesaid for the use of the said Indians, to seize and apprehend all Persons whatever, who standing charged with Treason, Misprisions of Treason, Murders, or other Felonies or Misdemeanors, shall fly from Justice and take Refuge in the said Territory, and to send them under a proper guard to the Colony where the Crime was committed, of which they stand accused, in order to take their Trial for the same. The unanimous Declaration of the thirteen united States of America, When in the Course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation. We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.-That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, -That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by

abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.--Such has been the patient sufferance of these Colonies; and such is now the necessity which constrains them to alter their former Systems of Government. The history of the present King of Great Britain is a history of repeated injuries and usurpations, all having in direct object the establishment of an absolute Tyranny over these States. To prove this, let Facts be submitted to a candid world. He has refused his Assent to Laws, the most wholesome and necessary for the public good. He has forbidden his Governors to pass Laws of immediate and pressing importance, unless suspended in their operation till his Assent should be obtained; and when so suspended, he has utterly neglected to attend to them. He has refused to pass other Laws for the accommodation of large districts of people, unless those people would relinquish the right of Representation in the Legislature, a right inestimable to them and formidable to tyrants only. He has called together legislative bodies at places unusual, uncomfortable, and distant from the depository of their public Records, for the sole purpose of fatiguing them into compliance with his measures. He has dissolved Representative Houses repeatedly, for opposing with manly firmness his invasions on the rights of the people. He has refused for a long time, after such dissolutions, to cause others to be elected; whereby the Legislative powers, incapable of Annihilation, have returned to the People at large for their exercise; the State


remaining in the mean time exposed to all the dangers of invasion from without, and convulsions within. He has kept among us, in times of peace, Standing Armies without the Consent of our legislatures. He has affected to render the Military independent of and superior to the Civil power. establishing therein an Arbitrary government, and enlarging its Boundaries so as to render it at once an example and fit instrument for introducing the same absolute rule into these Colonies: For taking away our Charters, abolishing our most valuable Laws, and altering fundamentally the Forms of our Governments: For suspending our own Legislatures, and declaring themselves invested with power to legislate for us in all cases whatsoever. He has abdicated Government here, by declaring us out of his Protection and waging War against us. He has plundered our seas, ravaged our Coasts, burnt our towns, and destroyed the lives of our people. He is at this time transporting large Armies of foreign Mercenaries to compleat the works of death, desolation and tyranny, already begun with circumstances of Cruelty & perfidy scarcely paralleled in the most barbarous ages, and totally unworthy the Head of a civilized nation. He has constrained our fellow Citizens taken Captive on the high Seas to bear Arms against their Country, to become the executioners of their friends and Brethren, or to fall themselves by their Hands. He has excited domestic insurrections amongst us, and has endeavoured to bring on the inhabitants of our frontiers, the merciless Indian Savages, whose known rule of warfare, is an undistinguished destruction of all ages, sexes and conditions. In every stage of these Oppressions We have Petitioned for Redress in the most humble terms: Our repeated Petitions have been answered only by repeated injury. A Prince whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a free people. Nor have We been wanting in attentions to our Brittish brethren. We have warned them


from time to time of attempts by their legislature to extend an unwarrantable jurisdiction over us. We have reminded them of the circumstances of our emigration and settlement here. We have appealed to their native justice and magnanimity, and we have conjured them by the ties of our common kindred to disavow these usurpations, which, would inevitably interrupt our connections and correspondence. They too have been deaf to the voice of justice and of consanguinity. We must, therefore, acquiesce in the necessity, which denounces our Separation, and hold them, as we hold the rest of mankind, Enemies in War, in Peace Friends. We, therefore, the Representatives of the united States of America, in General Congress, Assembled, appealing to the Supreme Judge of the world for the rectitude of our intentions, do, in the Name, and by Authority of the good People of these Colonies, solemnly publish and declare, That these United Colonies are, and of Right ought to be Free and Independent States; that they are Absolved from all Allegiance to the British Crown, and that all political connection between them and the State of Great Britain, is and ought to be totally dissolved; and that as Free and Independent States, they have full Power to levy War, conclude Peace, contract Alliances, establish Commerce, and to do all other Acts and Things which Independent States may of right do. And for the support of this Declaration, with a firm reliance on the protection of divine Providence, we mutually pledge to each other our Lives, our Fortunes and our sacred Honor.

The Definitive Treaty of Peace 1783 In the name of the most holy and undivided Trinity. It having pleased the Divine Providence to dispose the hearts of the most serene and most potent Prince George the Third, by the grace of God, king of Great Britain, France, and Ireland, defender of the faith, duke of Brunswick and Lunebourg, arch-treasurer and prince elector of the Holy Roman Empire etc., and of the United States of America, to forget all past misunderstandings and differences that have unhappily interrupted the good correspondence and friendship which they mutually wish to restore, and to establish such a beneficial and satisfactory intercourse , between the two countries upon the ground of reciprocal advantages and mutual convenience as may promote and secure to both perpetual peace and harmony; and having for this desirable end already laid the foundation of peace and reconciliation by the Provisional Articles signed at Paris on the 30th of November 1782, by the commissioners empowered on each part, which articles were agreed to be inserted in and constitute the Treaty of Peace proposed to be concluded between the Crown of Great Britain and the said United States, but which treaty was not to be concluded until terms of peace should be agreed upon between Great Britain and France and his Britannic Majesty should be ready to conclude such treaty accordingly; and the treaty between Great Britain and France having since been concluded, his Britannic Majesty and the United States of America, in order to carry into full effect the Provisional Articles above mentioned, according to the tenor thereof, have constituted and appointed, that is to say his Britannic Majesty on his part,

hereby agreed and declared, that the following are and shall be their boundaries, viz.; from the northwest angle of Nova Scotia, viz., that angle which is formed by a line drawn due north from the source of St. Croix River to the highlands; along the said highlands which divide those rivers that empty themselves into the river St. Lawrence, from those which fall into the Atlantic Ocean, to the northwesternmost head of Connecticut River; thence down along the middle of that river to the fortyfifth degree of north latitude; from thence by a line due west on said latitude until it strikes the river Iroquois or Cataraquy; thence along the middle of said river into Lake Ontario; through the middle of said lake until it strikes the communication by water between that lake and Lake Erie; thence along the middle of said communication into Lake Erie, through the middle of said lake until it arrives at the water communication between that lake and Lake Huron; thence along the middle of said water communication into Lake Huron, thence through the middle of said lake to the water communication between that lake and Lake Superior; thence through Lake Superior northward of the Isles Royal and Phelipeaux to the Long Lake; thence through the middle of said Long Lake and the water communication between it and the Lake of the Woods, to the said Lake of the Woods; thence through the said lake to the most northwesternmost point thereof, and from thence on a due west course to the river Mississippi; thence by a line to be drawn along the middle of the said river Mississippi until it shall intersect the northernmost part of the thirty-first degree of north latitude, South, by a line to be drawn due east from the determination of the line last mentioned in the latitude of thirty-one degrees of the equator, to the middle of the river Apalachicola or Catahouche; thence along the middle thereof


to its junction with the Flint River, thence straight to the head of Saint Mary's River; and thence down along the middle of Saint Mary's River to the Atlantic Ocean; east, by a line to be drawn along the middle of the river Saint Croix, from its mouth in the Bay of Fundy to its source, and from its source directly north to the aforesaid highlands which divide the rivers that fall into the Atlantic Ocean from those which fall into the river Saint Lawrence; comprehending all islands within twenty leagues of any part of the shores of the United States, and lying between lines to be drawn due east from the points where the aforesaid boundaries between Nova Scotia on the one part and East Florida on the other shall, respectively, touch the Bay of Fundy and the Atlantic Ocean, excepting such islands as now are or heretofore have been within the limits of the said province of Nova Scotia. ARTICLE 3: It is agreed that the people of the United States shall continue to enjoy unmolested the right to take fish of every kind on the Grand Bank and on all the other banks of Newfoundland, also in the Gulf of Saint Lawrence and at all other places in the sea, where the inhabitants of both countries used at any time heretofore to fish. And also that the inhabitants of the United States shall have liberty to take fish of every kind on such part of the coast of Newfoundland as British fishermen shall use, (but not to dry or cure the same on that island) and also on the coasts, bays and creeks of all other of his Brittanic Majesty's dominions in America; and that the American fishermen shall have liberty to dry and cure fish in any of the unsettled bays, harbors, and creeks of Nova Scotia, Magdalen Islands, and Labrador, so long as the same shall remain unsettled, but so soon as the same or either of them shall be settled, it shall not be lawful for the said

fishermen to dry or cure fish at such settlement without a previous agreement for that purpose with the inhabitants, proprietors, or possessors of the ground. ARTICLE 4: It is agreed that creditors on either side shall meet with no lawful impediment to the recovery of the full value in sterling money of all bona fide debts heretofore contracted. ARTICLE 5: It is agreed that Congress shall earnestly recommend it to the legislatures of the respective states to provide for the restitution of all estates, rights, and properties, which have been confiscated belonging to real British subjects; and also of the estates, rights, and properties of persons resident in districts in the possession on his Majesty's arms and who have not borne arms against the said United States. And that persons of any other decription shall have free liberty to go to any part or parts of any of the thirteen United States and therein to remain twelve months unmolested in their endeavors to obtain the restitution of such of their estates, rights, and properties as may have been confiscated; and that Congress shall also earnestly recommend to the several states a reconsideration and revision of all acts or laws regarding the premises, so as to render the said laws or acts perfectly consistent not only with justice and equity but with that spirit of conciliation which on the return of the blessings of peace should universally prevail. And that Congress shall also earnestly recommend to the several states that the estates, rights, and properties, of such last mentioned persons shall be restored to them, they refunding to any persons who may be now in possession the bona fide price (where any has been given)


which such persons may have paid on purchasing any of the said lands, rights, or properties since the confiscation. And it is agreed that all persons who have any interest in confiscated lands, either by debts, marriage settlements, or otherwise, shall meet with no lawful impediment in the prosecution of their just rights. ARTICLE 6: That there shall be no future confiscations made nor any prosecutions commenced against any person or persons for, or by reason of, the part which he or they may have taken in the present war, and that no person shall on that account suffer any future loss or damage, either in his person, liberty, or property; and that those who may be in confinement on such charges at the time of the ratification of the treaty in America shall be immediately set at liberty, and the prosecutions so commenced be discontinued. ARTICLE 7: There shall be a firm and perpetual peace between his Brittanic Majesty and the said states, and between the subjects of the one and the citizens of the other, wherefore all hostilities both by sea and land shall from henceforth cease. All prisoners on both sides shall be set at liberty, and his Brittanic Majesty shall with all convenient speed, and without causing any destruction, or carrying away any Negroes or other property of the American inhabitants, withdraw all his armies, garrisons, and fleets from the said United States, and from every post, place, and harbor within the same; leaving in all fortifications, the American artilery that may be therein; and shall also order and cause all archives, records, deeds, and papers belonging to any of the said states, or their

citizens, which in the course of the war may have fallen into the hands of his officers, to be forthwith restored and delivered to the proper states and persons to whom they belong. ARTICLE 8: The navigation of the river Mississippi, from its source to the ocean, shall forever remain free and open to the subjects of Great Britain and the citizens of the United States. ARTICLE 9: In case it should so happen that any place or territory belonging to Great Britain or to the United States should have been conquered by the arms of either from the other before the arrival of the said Provisional Articles in America, it is agreed that the same shall be restored without difficulty and without requiring any compensation. ARTICLE 10: The solemn ratifications of the present treaty expedited in good and due form shall be exchanged between the contracting parties in the space of six months or sooner, if possible, to be computed from the day of the signatures of the present treaty. In witness whereof we the undersigned, their ministers plenipotentiary, have in their name and in virtue of our full powers, signed with our hands the present definitive treaty and caused the seals of our arms to be affixed thereto. The principle of all sovereignty resides essentially in the nation. No body nor individual may exercise any authority which does not proceed directly from the nation. 4. Liberty consists in the freedom to do everything which injures no one else; hence the exercise of the natural rights of each man has no limits except those which assure to the other members of the society the enjoyment of the same rights. These limits can only be determined by law. 5. Law can only prohibit such actions as are hurtful to society. Nothing may be prevented which is not forbidden by law, and no one may be forced to do anything not provided for by law. 6. Law is the expression of the general will. Every citizen has a right to participate personally, or through his representative, in its foundation. It must be the same for all, whether it protects or punishes. All citizens, being equal in the eyes of the law, are equally eligible to all dignities and to all public positions and occupations, according to their abilities, and without distinction except that of their virtues and talents. 7. No person shall be accused, arrested, or imprisoned except in the cases and according to the forms prescribed by law. Any one soliciting, transmitting, executing, or causing to be executed, any arbitrary order, shall be punished. But any citizen


summoned or arrested in virtue of the law shall submit without delay, as resistance constitutes an offense. 8. The law shall provide for such punishments only as are strictly and obviously necessary, and no one shall suffer punishment except it be legally inflicted in virtue of a law passed and promulgated before the commission of the offense. 9. As all persons are held innocent until they shall have been declared guilty, if arrest shall be deemed indispensable, all harshness not essential to the securing of the prisoner's person shall be severely repressed by law. 10. No one shall be disquieted on account of his opinions, including his religious views, provided their manifestation does not disturb the public order established by law. 11. The free communication of ideas and opinions is one of the most precious of the rights of man. Every citizen may, accordingly, speak, write, and print with freedom, but shall be responsible for such abuses of this freedom as shall be defined by law. 12. The security of the rights of man and of the citizen requires public military forces. The woman who is unmarried has only one feeble right; ancient and inhuman laws refuse to her for her children the right to the name and the wealth of their father; no new laws have been made in this matter. If it is considered a paradox and an impossibility on my part to try to give my sex an honorable and just consistency, I leave it to men to attain glory for dealing with this matter; but while we wait, the way can be prepared through national education, the restoration of morals, and conjugal conventions. Form for a Social Contract Between Man and Woman

We, _____ and ______, moved by our own will, unite ourselves for the duration of our lives, and for the duration of our mutual inclinations, under the following conditions: We intend and wish to make our wealth communal, meanwhile reserving to ourselves the right to divide it in favor of our children and of those toward whom we might have a particular inclination, mutually recognizing that our property belongs directly to our children, from whatever bed they come, and that all of them without distinction have the right to bear the name of the fathers and mothers who have acknowledged them, and we are charged to subscribe to the law which punishes the renunciation of one's own blood. We likewise obligate ourselves, in case of separation, to divide our wealth and to set aside in advance the portion the law indicates for our children, and in the event of a perfect union, the one who dies will divest himself of half his property in his children's favor, and if one dies childless, the survivor will inherit by right, unless the dying person has disposed of half the common property in favor of one whom he judged deserving. That is approximately the formula for the marriage act I propose for execution. Upon reading this strange document, I see rising up against me the hypocrites, the prudes, the clergy, and the whole infernal sequence. But how it [my proposal] offers to the wise the moral means of achieving the perfection of a happy government! . . . Moreover, I would like a law which would assist widows and young girls deceived by the false promises of a man to whom they were attached; I would like, I say, this law to force an inconstant man to hold to his obligations or at least [to pay] an indemnity equal to his wealth. Again, I would like this law to be rigorous against women, at least those who have the effrontery to have


reCourse to a law which they themselves had violated by their misconduct, if proof of that were given. At the same time, as I showed in Le Bonheur primitit de l'homme, in 1788, that prostitutes should be placed in designated quarters. It is not prostitutes who contribute the most to the depravity of morals, it is the women of' society. In regenerating the latter, the former are changed. This link of fraternal union will first bring disorder, but in consequence it will produce at the end a perfect harmony. I offer a foolproof way to elevate the soul of women; it is to join them to all the activities of man; if man persists in finding this way impractical, let him share his fortune with woman, not at his caprice, but by the wisdom of laws. Prejudice falls, morals are purified, and nature regains all her rights. Add to this the marriage of priests and the strengthening of the king on his throne, and the French government cannot fail. But in the way in which this business is now carried on, not only the whole work is a peculiar trade, but it is divided into a number of branches, of which the greater part are likewise peculiar trades. One man draws out the wire, another straights it, a third cuts it, a fourth points it, a fifth grinds it at the top for receiving, the head; to make the head requires two or three distinct operations; to put it on is a peculiar business, to whiten the pins is another; it is even a trade by itself to put them into the paper; and the important business of making a pin is, in this manner, divided into about eighteen distinct operations, which, in some factories, are all performed by distinct hands, though in others the same man will sometimes perform two or three of them. I have seen a small manufactory of this kind where ten men only were employed, and where some of them consequently performed two or three distinct operations. But though they were very poor, and therefore but indifferently accommodated with the necessary machinery, they could, when they exerted themselves, make among them about twelve pounds of pins in a day. There are in a pound upwards of four thousand pins of a middling size. Those ten persons, therefore, could make among them upwards of forty-eight thousand pins in a day. Each person, therefore, making a tenth part of forty-eight thousand pins, might be considered as making four thousand eight hundred pins in a day. But if they had all wrought separately and independently, and without any of them having been educated to this peculiar business, they certainly


could not each of them have made twenty, perhaps not one pin in a day; that is, certainly, not the two hundred and fortieth, perhaps not the four thousand eight hundredth part of what they are at present capable of performing, in consequence of a proper division and combination of their different operations....The division of labor, so far as it can be introduced, occasions, in every art, a proportionable increase of the productive powers of labor. The separation of different trades and employments from one another seems to have taken place in consequence of this advantage. It is the necessary, though very slow and gradual consequence of a certain propensity in human nature which has in view no such extensive utility; the propensity to truck, barter, and exchange one thing for another..... Man has almost constant occasion for the help of his brethren, and it is in vain for him to expect it from their benevolence only. It is not from the benevolence of the butcher, the brewer, or the baker that we expect our dinner, but from their regard to their own interest.As it is by treaty, by barter, and by purchase that we obtain from one another the greater part of those mutual good offices which we stand in need of, so it is this same trucking disposition which originally gives occasion to the division of labor. In a tribe of hunters or shepherds a particular person makes bows and arrows, for example, with more readiness and dexterity than any other. He frequently exchanges them for cattle or for venison with his companions; and he finds at last that he can in this manner get more cattle and venison than if he himself went to the field to catch them. From a regard to his


own interest, therefore, the making of bows and arrows grows to be his chief business, and he becomes a sort of armorer, etc......Book I, Chapter 4. Of the Origin and Use of Money: WHEN the division of labor has been once thoroughly established, it is but a very small part of a man's wants which the produce of his own labor can supply. He supplies the far greater part of them by exchanging that surplus part of the produce of his own labor, which is over and above his own consumption, for such parts of the produce of other men's labor as he has occasion for. Every man thus lives by exchanging, or becomes in some measure a merchant, and the society itself grows to be what is properly a commercial society.But when the division of labor first began to take place, this power of exchanging must frequently have been very much clogged and embarrassed in its operations. One man, we shall suppose, has more of a certain commodity than he himself has occasion for, while another has less. The former consequently would be glad to dispose of, and the latter to purchase, a part of this superfluity. But if this latter should chance to have nothing that the former stands in need of, no exchange can be made between them. The butcher has more meat in his shop than he himself can consume, and the brewer and the baker would each of them be willing to purchase a part of it. But they have nothing to offer in exchange, except the different productions of their respective trades, and the butcher is already provided with all the bread and beer which he has immediate occasion for. No exchange can, in this case, be made between them. In order to avoid the inconvenience of such situations, every prudent man in every period of society, after the first establishment of the division of labor, must naturally have endeavored to manage his affairs in such a manner as to have at all times by him, besides the peculiar produce

of his own industry, a certain quantity of some one commodity or other, such as he imagined few people would be likely to refuse in exchange for their produce....It is in this manner that money has become in all civilized nations the universal instrument of commerce, by the intervention of which goods of all kinds are bought and sold, or exchanged for one another....Book I, Chapter 5. Of the Real and Nominal Price of Commodities, or their Price in Labor, and their Price in Money: EVERY man is rich or poor according to the degree in which he can afford to enjoy the necessaries, conveniences, and amusements of human life. But after the division of labor has once thoroughly taken place, it is but a very small part of these with which a man's own labor can supply him. Labor, therefore, is the real measure of the exchangeable value of all commodities....The real price of everything, what everything really costs to the man who wants to acquire it, is the toil and trouble of acquiring it. What everything is really worth to the man who has acquired it, and who wants to dispose of it or exchange it for something else, is the toil and trouble which it can save to himself, and which it can impose upon other people. What is bought with money or with goods is purchased by labor as much as what we acquire by the toil of our own body. That money or those goods indeed save us this toil.....Book I, Chapter 6. Of the Component Parts of the Price of Commodities: IN that early and


rude state of society which precedes both the accumulation of stock and the appropriation of land, the proportion between the quantities of labor necessary for acquiring different objects seems to be the only circumstance which can afford any rule for exchanging them for one another. If among a nation of hunters, for example, it usually costs twice the labor to kill a beaver which it does to kill a deer, one beaver should naturally exchange for or be worth two deer. It is natural that what is usually the produce of two days' or two hours' labor, should be worth double of what is usually the produce of one day's or one hour's labor. If the one species of labor should be more severe than the other, some allowance will naturally be made for this superior hardship; and the produce of one hour's labor in the one way may frequently exchange for that of two hours' labor in the other.....As soon as stock has accumulated in the hands of particular persons, some of them will naturally employ it in setting to work industrious people, whom they will supply with materials and subsistence, in order to make a profit by the sale of their work, or by what their labor adds to the value of the materials. In exchanging the complete manufacture either for money, for labor, or for other goods, over and above what may be sufficient to pay the price of the materials, and the wages of the workmen, something must be given for the profits of the undertaker of the work who hazards his stock in this adventure. The value which the workmen add to the materials, therefore, resolves itself in this ease into two parts, of which the one pays their wages, the other the profits of their employer upon the whole stock of materials and wages which he advanced....In this state of things, the whole produce of labor does not always belong to the laborer. He must in most cases share it with the owner of the stock which employs him. Neither is the quantity of labor commonly employed in

acquiring or producing any commodity, the only circumstance which can regulate the quantity which it ought commonly to purchase, command, or exchange for. An additional quantity, it is evident, must be due for the profits of the stock which advanced the wages and furnished the materials of that labor....The real value of all the different component parts of price, it must be observed, is measured by the quantity of labor which they can, each of them, purchase or command. Labor measures the value not only of that part of price which resolves itself into labor, but of that which resolves itself into rent, and of that which resolves itself into profit. In every society the price of every commodity finally resolves itself into some one or other, or all of those three parts; and in every improved society, all the three enter more or less, as component parts, into the price of the far greater part of commodities.....Book I, Chapter 7. Of the Natural and Market Price of Commodities: THERE is in every society or neighborhood an ordinary or average rate both of wages and profit in every different employment of labor and stock. This rate is naturally regulated, as I shall show hereafter, partly by the general circumstances of the society, their riches or poverty, their advancing, stationary, or declining condition; and partly by the particular nature of each employment. There is likewise in every society or neighborhood an ordinary or average rate of rent, which is regulated too, as I shall show hereafter, partly by the general circumstances of the society or neighborhood in which the land is situated, and partly by the natural or improved fertility of the land. These ordinary or average rates may be called the natural rates of wages, profit, and rent, at the time and place in which they commonly prevail. When the price of any commodity is neither more nor less than what is sufficient to pay the rent of the land, the wages of the


labor, and the profits of the stock employed in raising, preparing, and bringing it to market, according to their natural rates, the commodity is then sold for what may be called its natural price. Though the price, therefore, which leaves him this profit is not always the lowest at which a dealer may sometimes sell his goods, it is the lowest at which he is likely to sell them for any considerable time; at least where there is perfect liberty, or where he may change his trade as often as he pleases. The actual price at which any commodity is commonly sold is called its market price. It may either be above, or below, or exactly the same with its natural price. The market price of every particular commodity is regulated by the proportion between the quantity which is actually brought to market, and the demand of those who are willing to pay the natural price of the commodity, or the whole value of the rent, labor, and profit, which must be paid in order to bring it thither. When the quantity of any commodity which is brought to market falls short of the effectual demand, all those who are willing to pay the whole value of the rent, wages, and profit, which must be paid in order to bring it thither, cannot be supplied with the quantity which they want. Rather than want it altogether, some of them will be willing to give more. A competition will immediately begin among them, and the market price will rise more or less above the natural price, according as either the greatness of the deficiency, or the wealth and wanton luxury of the competitors, happen to animate more or less the eagerness of the competition.When the quantity brought to market exceeds the effectual demand, it cannot be all sold to those who are willing to pay the whole value of the rent, wages, and profit, which must be paid in order to bring it thither. Some part must be sold to those who are willing to pay less, and the low price which they give for it must reduce the price of the whole. The

market price will sink more or less below the natural price, according as the greatness of the excess increases more or less the competition of the sellers, or according as it happens to be more or less important to them to get immediately rid of the commodity. When the quantity brought to market is just sufficient to supply the effectual demand, and no more, the market price naturally comes to be either exactly, or as nearly as can be judged of, the same with the natural price. The whole quantity upon hand can be disposed of for this price, and cannot be disposed of for more. The competition of the different dealers obliges them all to accept of this price, but does not oblige them to accept of less.Such fluctuations affect both the value and the rate either of wages or of profit, according as the market happens to be either overstocked or understocked with commodities or with labor; with work done, or with work to be done. But though the market price of every particular commodity is in this manner continually gravitating, if one may say so, towards the natural price, yet sometimes particular accidents, sometimes natural causes, and sometimes particular regulations of police, may, in many commodities, keep up the market price, for a long time together, a good deal above the natural price.When by an increase in the effectual demand, the market price of some particular commodity happens to rise a good deal above the natural price, those who employ their stocks in supplying that market are generally careful to conceal this change. If it was commonly known, their great profit would tempt so many new rivals to employ their stocks in the same way that, the effectual demand being fully supplied, the market price would soon be reduced to the natural price, and perhaps for some time even below it. If the market is at a great distance from the residence of those who supply it, they may sometimes be able to


keep the secret for several years together, and may so long enjoy their extraordinary profits without any new rivals. Secrets of this kind, however, it must be acknowledged, can seldom be long kept; and the extraordinary profit can last very little longer than they are kept.A monopoly granted either to an individual or to a trading company has the same effect as a secret in trade or manufactures. The monopolists, by keeping the market constantly understocked, by never fully supplying the effectual demand, sell their commodities much above the natural price, and raise their emoluments, whether they consist in wages or profit, greatly above their natural rate. The price of monopoly is upon every occasion the highest which can be got. The natural price, or the price of free competition, on the contrary, is the lowest which can be taken, not upon every occasion, indeed, but for any considerable time together. The one is upon every occasion the highest which can be squeezed out of the buyers, or which, it is supposed, they will consent to give: the other is the lowest which the sellers can commonly afford to take, and at the same time continue their business.The exclusive privileges of corporations, statutes of apprenticeship, and all those laws which restrain, in particular employments, the competition to a smaller number than might otherwise go into them, have the same tendency, though in a less degree. They are a sort of enlarged monopolies, and may frequently, for ages together, and in whole classes of employments, keep up the market price of particular commodities above the natural price, and maintain both the wages of the labor and the profits of the stock employed about them somewhat above their natural rate. Such enhancements of the market price may last as long as the regulations of police which give occasion to them.... Book I, Chapter 8. Of the Wages of Labor: THE

produce of labor constitutes the natural recompense or wages of labor. In that original state of things, which precedes both the appropriation of land and the accumulation of stock, the whole produce of labor belongs to the laborer. He has neither landlord nor master to share with him. Had this state continued, the wages of labor would have augmented with all those improvements in its productive powers to which the division of labor gives occasion. All things would gradually have become cheaper. They would have been produced by a smaller quantity of labor; and as the commodities produced by equal quantities of labor would naturally in this state of things be exchanged for one another, they would have been purchased likewise with the produce of a smaller quantity. But this original state of things, in which the laborer enjoyed the whole produce of his own labor, could not last beyond the first introduction of the appropriation of land and the accumulation of stock. It was at an end, therefore, long before the most considerable improvements were made in the productive powers of labor, and it would be to no purpose to trace further what might have been its effects upon the recompense or wages of labor. As soon as land becomes private property, the landlord demands a share of almost all the produce which the laborer can either raise, or collect from it. His rent makes the first deduction from the produce of the labor which is employed upon land.Masters are always and everywhere in a sort of tacit, but constant and uniform combination, not to raise the wages of labor above their actual rate. To violate this combination is everywhere a most unpopular action, and a sort of reproach to a master among his neighbors and equals. Masters, too, sometimes enter into particular combinations to sink the wages of labor even below this rate. These are always conducted with the utmost


silence and secrecy, till the moment of execution, and when the workmen yield, as they sometimes do, without resistance, though severely felt by them, they are never heard of by other people. Such combinations, however, are frequently resisted by a contrary defensive combination of the workmen; who sometimes too, without any provocation of this kind, combine of their own accord to raise the price of their labor.....A man must always live by his work, and his wages must at least be sufficient to maintain him. They must even upon most occasions be somewhat more; otherwise it would be impossible for him to bring up a family, and the race of such workmen could not last beyond the first generation.... When the landlord, annuitant, or monied man, has a greater revenue than what he judges sufficient to maintain his own family, he employs either the whole or a part of the surplus in maintaining one or more menial servants. Increase this surplus, and he will naturally increase the number of those servants. When an independent workman, such as a weaver or shoemaker, has got more stock than what is sufficient to purchase the materials of his own work, and to maintain himself till he can dispose of it, he naturally employs one or more journeymen with the surplus, in order to make a profit by their work. Increase this surplus, and he will naturally increase the number of his journeymen. The demand for those who live by wages, therefore, necessarily increases with the increase of the revenue and stock of every country, and cannot possibly increase without it. The increase of revenue and stock is the increase of national wealth....Is this improvement in the circumstances of the lower ranks of the people to be regarded as an advantage or as an inconvenience to the society? The answer seems at first sight abundantly plain. Servants, laborers, and workmen of different kinds, make up the far

greater part of every great political society. But what improves the circumstances of the greater part can never be regarded as an inconvenience to the whole. No society can surely be flourishing and happy, of which the far greater part of the members are poor and miserable. It is but equity, besides, that they who feed, clothe, and lodge the whole body of the people, should have such a share of the produce of their own labor as to be themselves tolerably well fed, clothed, and lodged.The liberal reward of labor, as it encourages the propagation, so it increases the industry of the common people. The wages of labor are the encouragement of industry, which, like every other human quality, improves in proportion to the encouragement it receives. A plentiful subsistence increases the bodily strength of the laborer, and the comfortable hope of bettering his condition, and of ending his days perhaps in ease and plenty, animates him to exert that strength to the utmost. Where wages are high, accordingly, we shall always find the workmen more active, diligent, and expeditious than where they are low.Book I, Chapter 10. Of Wages and Profit in the different Employments of Labor and Stock: THE policy of Europe, by not leaving things at perfect liberty, occasions other inequalities of much greater importance. It does this chiefly in the three following ways. First, by restraining the competition in some employments to a smaller number than would otherwise be disposed to enter into them; Second, by increasing it in others beyond what it naturally would be; and, Third, by obstructing the free circulation of labor and stock, both from employment to employment and from place to place.First, the policy of Europe occasions a very important inequality in the whole of the advantages and disadvantages of the different employments of labor and stock, by restraining the competition in some


employments to a smaller number than might otherwise be disposed to enter into them. The exclusive privileges of corporations, or guilds, are the principal means it makes use of for this purpose. The property which every man has in his own labor, as it is the original foundation of all other property, so it is the most sacred and inviolable. The patrimony of a poor man lies in the strength and dexterity of his hands; and to hinder him from employing this strength and dexterity of his hands; and to hinder him from employing this strength and dexterity in what manner he thinks proper without injury to his neighbor is a plain violation of this most sacred property. It is a manifest encroachment upon the just liberty both of the workman and of those who might be disposed to employ him. As it hinders the one from working at what he thinks proper, so it hinders the others from employing whom they think proper....The pretense that corporations are necessary for the better government of the trade is without any foundation. The real and effectual discipline which is exercised over a workman is not that of his corporation, but that of his customers. It is the fear of losing their employment which restrains his frauds and corrects his negligence. An exclusive corporation necessarily weakens the force of this discipline. Second, the policy of Europe, by increasing the competition in some employments beyond what it naturally would be, occasions another inequality of an opposite kind in the whole of the advantages and disadvantages of the different employments of labor and stock....In the professions, such as law and medicine, if an equal proportion of people were educated at the public expense, the competition would soon be so great as to sink very much their pecuniary reward. It might then not be worth any man's while to educate his son to either of those professions at his own expense.... Third, the policy of Europe, by obstructing

the free circulation of labor and stock both from employment to employment, and from place to place, occasions in some cases a very inconvenient inequality in the whole of the advantages and disadvantages of their different employments....Whatever obstructs the free circulation of labor from one employment to another obstructs that of stock likewise; the quantity of stock which can be employed in any branch of business depending very much upon that of the labor which can be employed in it. Corporation laws, however, give less obstruction to the free circulation of stock from one place to another than to that of labor. It is everywhere much easier for a wealthy merchant to obtain the privilege of trading in a town corporate, than for a poor artificer to obtain that of working in it....Book I, Chapter 11. Effects of the Progress of Improvement upon the Real Price of Manufactures: It is the natural effect of improvement, however, to diminish gradually the real price of almost all manufactures. That of the manufacturing workmanship diminishes, perhaps, in all of them without exception. In consequence of better machinery, of greater dexterity, and of a more proper division and distribution of work, all of which are the natural effects of improvement, a much smaller quantity of labor becomes requisite for executing any particular piece of work, and though, in consequence of the flourishing circumstances of the society, the real price of labor should rise very considerably, yet the great diminution of the quantity will generally much more than compensate the greatest rise which can happen in the price....But in all cases in which the real price of the rude materials either does not rise at all, or does not rise very much, that of the manufactured commodity sinks very considerably.Every improvement in the circumstances of the society tends either directly or indirectly to raise the real rent of


land, to increase the real wealth of the landlord, his power of purchasing the labor, or the produce of the labor of other people. The extension of improvement and cultivation tends to raise it directly. The landlord's share of the produce necessarily increases with the increase of the produce..... Every increase in the real wealth of the society, every increase in the quantity of useful labor employed within it, tends indirectly to raise the real rent of land. A certain proportion of this labor naturally goes to the land. A greater number of men and cattle are employed in its cultivation, the produce increases with the increase of the stock which is thus employed in raising it, and the rent increases with the produce.

Because she has already taken possession of Fiji in the east, and we hope it will soon be known authoritatively that she has taken possession of New Guinea at the northwest, adjoining her Australian possessions, and the islands between complete this chain of islands lying along the Australian coast.

2. The sympathy of the New Hebrides natives are all with Great Britain, hence they long for British protection, while they fear and hate the French, who appear eager to annex the group, because they have seen the way the French have treated the native races in New Caledonia, the Loyalty Islands, and other South Sea islands. 3. Until within the past few months almost all the Europeans on the New Hebrides were British subjects, who long for British protection. 4. All the men and all the money used in civilizing and Christianizing the New Hebrides have been British. Now fourteen missionaries and the Dayspring mission ship, and about 150 native evangelists and teachers are employed in the above work on this group, in which over #6000 yearly of British and British-colonial money is expended; and certainly it would be unwise to let any other power now take possession and reap the fruits of all this British outlay. 5. Because the New Hebrides are already a British dependency in this sense---all its imports are from Sydney and Melbourne and British colonies, and all its exports are also to British colonies. 6. The islands on this group are generally very rich in soil and in tropical products so that if a possession of Great Britain, and if the labor traffic stopped so as to retain what remains of the native populations on them, they would soon, and for ages to come, become rich sources of tropical wealth to these colonies, as sugar cane is extensively cultivated on them by every native of the group, even in his heathen state. . .The islands also grow corn, cotton, coffee, arrowroot, and spices, etc., and all tropical products could be largely produced on them.


7. Because if any other nation takes possession of them, their excellent and spacious harbors, as on Efate, so wellsupplied with the best fresh water, and their near-proximity to Great Britain's Australasian colonies, would in time of war make them dangerous to British interests and commerce in the South Seas and her colonies. 8. The thirteen islands of this group on which life and property are now comparatively safe, the 8000 professed Christians on the group, and all the churches formed from among them are, by God's blessing, the fruits of the labors of British missionaries, who, at great toil, expense, and loss of life have translated, got printed, and taught the natives to read the Bible in part or in whole in nine different languages of this group, while 70,000 at least are longing and ready for the gospel. On this group twentyone members of the mission families died or were murdered by the savages in beginning God's work among them, not including good Bishop Peterson, of the Melanesian mission, and we fear all this good work would be lost if the New Hebrides fall into other than British hands. For the above reasons, and others that might be given, we sincerely hope and pray that you will do all possible to get Victoria and the other colonial governments to help and unite in urging Great Britain at once to take possession of the New Hebrides group. Whether looked at in the interests of humanity, or of Christianity, or commercially, or politically, sure it is most desirable that they should at once be British possessions.

Letter Published by Dr. Steel, Sydney: Some ten years ago, when an abortive effort was made by a number of private

individuals to form a settlement on New Guinea, representations were made to some of the colonial governments on the importance of the annexation of New Guinea by the British government. At the same period simultaneous efforts were made by Presbyterian churches to the governments of Australian colonies respecting the annexation of the New Hebrides. The labor traffic at that time excited great interest on account of its many inhumanities. The government of New South Wales, at the period referred to, formally agreed to recommend the annexation of New Guinea, the Duke of York islands, New Britain, New Ireland, and the New Hebrides. Sir John Robertson, then colonial secretary of New South Wales, addressed a communication to the Earl of Kimberley, the British minister for the colonies, urging the importance of annexation. The answer of the Earl was unfavorable, but the correspondence, which was published by the government of New South Wales, show that this proposal is not now urged for the first time. The population of natives in the New Hebrides is rapidly declining, and these islands will certainly be annexed by some power, as they are so well fitted to grow all kinds of tropical spices and other fruits. They were discovered for the most part by British navigators, traded with by British vessels, regularly visited by her Majesty's ships of war, and finally evangelized by the labors and munificence of British subjects. Letter of Dr. Hugenberg, August 1, 1890 There are also still larger territories---one need only think of Central Sudan, the natural hinterland of the Cameroons, the fate of which has not as yet been settled by any treaty. He who seizes these territories quickest and holds fast the most tenaciously will possess them. Does not everything, and especially the slowness with which the German government moves to assert itself in colonial affairs, point to the fact that our fatherland, be it from one side or the other, will not be spared a new war if it wishes only to maintain the position which it won in 1870? The official memoir which has just appeared concerning the motives of the Anglo-German treaty, leaves no doubt but that a certain indifference to colonial expansion exists in official places. In a tone of contempt it has been said that "the period

of hissing the flag and shooting at the treaty must now be ended!" Similar reverses can be prevented in the future only if foreign countries deal with a sensitive German nationalism! TREATY OF VERSAILLES On June 28,1919, the Allied powers presented the Treaty of Versailles to Germany for signature. The following are the key territorial and political clauses. Article 22. Certain communities formerly belonging to the Turkish Empire have reached a stage of development where their existence as independent nations can be provisionally recognised subject to the rendering of administrative advice and assistance by a Mandatory [i.e., a Western power] until such time as they are able to stand alone. The wishes of these communities must be a principal consideration in the selection of the Mandatory. Article 42. Germany is forbidden to maintain or construct any fortifications either on the left bank of the Rhine or on the right bank to the west of a line drawn 50 kilometres to the East of the Rhine. Article 45. As compensation for the destruction of the coal mines in the north of France and as part payment towards the total reparation due from Germany for the damage resulting from the war, Germany cedes to France in full and absolute possession, with exclusive right of exploitation, unencumbered and free from all debts and charges of any kind, the coal mines situated in the Saar Basin.... Article 49. Germany renounces in favor of the League of Nations, in the capacity of trustee,

the government of the territory defined above. At the end of fifteen years from the coming into force of the present Treaty the inhabitants of the said territory shall be called upon to indicate the sovereignty under which they desire to be placed. AlsaceLorraine. The High Contracting Parties, recognizing the moral obligation to redress the wrong done by Germany in 1871 both to the rights of France and to the wishes of the population of Alsace and Lorraine, which were separated from their country in spite of the solemn protest of their representatives at the Assembly of Bordeaux, agree upon the following.... Article 51. The territories which were ceded to Germany in accordance with the Preliminaries of Peace signed at Versailles on February 26, 1871, and the Treaty of Frankfort of May 10, 1871, are restored to French sovereignty as from the date of the Armistice of November 11, 1918. The provisions of the Treaties establishing the delimitation of the frontiers before 1871 shall be restored. Article 119. Germany renounces in favor of the Principal Allied and Associated Powers all her rights and titles over her overseas possessions. Article 156. Germany renounces, in favour of Japan, all her rights, title and privileges . . . which she acquired in virtue of` the Treaty concluded by her with China on March 6, 1898, and of all other arrangements relative to the Province of Shantung. Article 159. The German military forces shall be demobilised and reduced as prescribed hereinafter Article 160. By a date which must not be later than March 31, 1920, the German Army must not comprise more than seven divisions of infantry and three divisions of cavalry. After that date the total number of effectives in the Army of the States constituting Germany must not exceed 100,000 men, including officers and establishments of depots. The Army shall be devoted exclusively to the maintenance of order within the territory and to the control


of the frontiers. The total effective strength of officers, including the personnel of staffs, whatever their composition, must not exceed four thousand.... Article 231. The Allied and Associated Governments affirm and Germany accepts the responsibility of Germany and her allies for causing all the loss and damage to which the Allied and Associated Governments and their nationals have been subjected as a consequence of the war imposed upon them by the aggression of Germany and her allies. Article 232. The Allied and Associated Governments recognize that the resources of Germany are not adequate, after taking into account permanent diminutions of such resources which will result from other provisions of the present Treaty, to make complete reparation for all such loss and damage. The Allied and Associated Governments, however, require, and Germany undertakes, that she will make compensation for all damage done to the civilian population of the Allied and Associated Powers and to their property during the period of the belligerency of each as an Allied or Associated Power against Germany.

My Dear Senator Knox: You are soon to become secretary of state under Mr. Taft. At the outset both he and you will be overwhelmed with every kind of work; but there is one matter of foreign policy of such great and permanent importance that I wish to lay it before the President-to-be and yourself. I speak of the relations of the United States and Japan. It is utterly impossible to foretell as regards either foreign or domestic policy what particular questions may appear as at the moment of most engrossing interest. It may be that there will be no ripple of trouble between Japan and the United States during your term of service. It may very well be that you will have acute trouble about Cuba, or with Venezuela or in Central America, or with some European power; but it is not likely that grave international complications - that is, complications which can possibly lead to serious war - can come from any such troubles. If we have to interfere again in Cuba, or take possession of the island, it will be exasperating, and we may in consequence have to repeat our Philippine experiences by putting down an annoying but unimportant guerrilla outbreak. But this would represent merely annoyance. The same would be true of anything in Central America or Venezuela. I do not believe that Germany has any designs that would bring her in conflict with the Monroe Doctrine. The last seven years have tended steadily toward a better understanding of Germany on our part, and a more thorough understanding on the part of Germany that she must not expect colonial expansion in South America. As for England, I cannot imagine serious trouble with her. The settlement of the Alaskan boundary removed the one grave danger. The treaties now before the Senate are


excellent, and all we have to fear is some annoying, but hardly grave, friction in the event of the failure of the Senate to ratify them. But with Japan the case is different. She is a most formidable military power. Her people have peculiar fighting capacity. They are very proud, very warlike, very sensitive, and are influenced by two contradictory feelings; namely, a great self-confidence, both ferocious and conceited, due to their victory over the mighty empire of Russia; and a great touchiness because they would like to be considered as on a full equality with, as one of the brotherhood of, Occidental nations, and have been bitterly humiliated to find that even their allies, the English, and their friends, the Americans, won't admit them to association and citizenship, as they admit the least advanced or most decadent European peoples. Moreover, Japan's population is increasing rapidly and demands an outlet; and the Japanese laborers, small farmers, and petty traders would, if permitted, flock by the hundred thousand into the United States, Canada, and Australia. Now for our side. The events of the last three years have forced me to the clear understanding that our people will not permit the Japanese to come in large numbers among them; will not accept them as citizens; will not tolerate their presence as large bodies of permanent settlers. This is just as true in Australia and Colombia as in our Rocky Mountain and Pacific states; but at present the problem is more acute with us because the desire of the Japanese to come here has grown. The opposition to the presence of the Japanese, I have reluctantly come to feel, is entirely warranted, and not only must be, but ought to be, heeded by the national government in the interest of our people and our civilization; and this in spite

of the fact that many of the manifestations of the opposition are unwise and improper to the highest degree. To permit the Japanese to come in large numbers into this country would be to cause a race problem and invite and insure a race contest. It is necessary to keep them out. But it is almost equally necessary that we should both show all possible courtesy and consideration in carrying out this necessarily disagreeable policy of exclusion, and that we should be thoroughly armed, so as to prevent the Japanese from feeling safe in attacking us. Unfortunately, great masses of our people show a foolish indifference to arming, and at the same time a foolish willingness to be offensive to the Japanese. Labor unions pass violent resolutions against the Japanese and almost at the same moment protest against strengthening our military resources on land or sea. Big corporations seek to introduce Japanese coolies, so as to get cheap labor, and thereby invite agitation which they are powerless to quell. The peace societies, and senators and congressmen like Burton of Ohio, Perkins of California, Perkins of New York, Tawney of Minnesota, McCall of Massachusetts, and Bartholdt of Missouri blatantly or furtively oppose the Navy and hamper its upbuilding, while doing nothing whatever to prevent insult to Japan. The California legislature is threatening to pass the most offensive kind of legislation aimed at the Japanese, and yet it reelects a wretched creature like Perkins to the Senate although he has opposed, with his usual feeble timidity and so far as he dared, the upbuilding of the Navy, following Hale's lead. We are therefore faced by the fact that our people will not tolerate, and ought not to tolerate, the presence among them of large bodies of Japanese; and that so long as they


are here in large bodies there is always chance either of violence on the part of mobs or of indiscreet and improper action by the legislative bodies of the Western states under demagogic influence. Furthermore, in Hawaii the Japanese already many times outnumber the whites, and have shown on more than one recent occasion a spirit both truculent and insolent. In Hawaii the trouble is primarily due to the shortsighted greed of the sugar planters and of the great employers generally, who showed themselves incapable of thinking of the future of their children and anxious only to make fortunes from estates tilled by coolie labor. Accordingly, they imported, masses of Chinese laborers and, then masses of Japanese laborers. Throughout my term as President, I have so far as possible conducted our policy against this desire of the sugar planters, against the theory of turning Hawaii into an island of coolie-tilled plantations, and in favor of making it so far as possible the abode of small settlers. With this purpose, I have done everything I could to encourage the immigration of southern Europeans to the islands, and have endeavored so far as I could in the absence of legislation to restrict the entrance of Asiatic coolies. So far as possible our aim should be to diminish the number of Japanese in the islands without any regard to the fortunes of the sugar planters, and to bring in Europeans, no matter of what ancestry, in order that the islands may be filled with a white population of our general civilization and culture. As regards the mainland, our policy should have three sides and should be shaped, not to meet the exigencies of this year or next but to meet what may occur for the next few decades. Japan is poor and is therefore reluctant to go to war. Moreover, Japan is

vitally interested in China and on the Asiatic mainland and her wiser statesmen will, if possible, prevent her getting entangled in a war with us, because whatever its result it would hamper and possibly ruin Japan when she came to deal again with affairs in China. But with so proud and sensitive a people neither lack of money nor possible future complications will prevent a war if once they get sufficiently hurt and angry; and there is always danger of a mob outbreak there just as there is danger of a mob outbreak here. Our task therefore is on the one hand to meet the demands which our own people make and which cannot permanently be resisted, and on the other to treat Japan so courteously that she will not be offended more than is necessary; and at the same time to prepare our fleet in such shape that she will feel very cautious about attacking us. Disturbances like those going on at present are certain to occur unless the Japanese immigration, so far as it is an immigration for settlement, stops. For the last six months under our agreement with Japan it has been stopped to the extent that more Japanese have left the country than have come into it. But the Japanese should be made clearly to understand that this process must continue and if there is relaxation it will be impossible to prevent our people from enacting drastic exclusion laws; and that in such case all of us would favor such drastic legislation. Hand in hand with insistence on the stopping of Japanese immigration should go insistence as regards our own people that they be courteous and considerate, that they treat the Japanese who are here well; and above all that they go on with the building of the Navy, keep it at the highest point of efficiency, securing not merely battleships but an ample supply of colliers and other


auxiliary vessels of every kind. Much of the necessary expense would be met by closing the useless Navy yards. By the way, the fighting Navy should not be divided; it should be kept either in the Pacific or in the Atlantic, merely a squadron being left in the other ocean, and this in such shape that, in the event of war, it could avoid attack and at once join the main body of fighting ships. All this is so obvious that it ought not to be necessary to dwell upon it. But our people are shortsighted and have short memories - I suppose all peoples are shortsighted and have short memories. The minute we arrange matters so that for the moment everything is smooth and pleasant, the more foolish peace societies, led by men like exSecretary of State Foster and ex-Secretary of the Navy Long, clamor for a stoppage in the building up of the Navy. On the other hand, at the very moment when we are actually keeping out the Japanese and reducing the number of Japanese here, demagogues and agitators like those who have recently appeared in the California and Nevada legislatures work for the passage of laws which are humiliating and irritating to the Japanese and yet of no avail so far as keeping out immigrants is concerned; for this can be done effectively only by the national government. The defenselessness of the coast, the fact that we have no army to hold or reconquer the Philippines and Hawaii, the fact that we have not enough battleships nor enough auxiliaries in the Navy - all these facts are ignored and forgotten. On the other hand, the Japanese, if we do not keep pressure upon them, will let up in their effort to control the emigration from Japan to this country; and they must be continually reminded that unless they themselves stop it, in the end this country is certain to stop it,

and ought to stop it, no matter what the consequences may be. There is no more important continuing feature of our foreign policy than this in reference to our dealing with Japan; the whole question of our dealings with the Orient is certain to grow in importance. I do not believe that there will be war, but there is always the chance that war will come; and if it did come, the calamity would be very great. And while I believe we would win, there is at least a chance of disaster. We should therefore do everything in our power to guard against the possibility of war by preventing the occurrence of conditions which would invite war and by keeping our Navy so strong that war may not come or that we may be successful if it does come. MOLOTOV-RIBBONTROP PACT, 1939 http://www.fordham.edu/Halsall/mod/1939p act.asp The Government of the German Reich and The Government of the Union of Soviet Socialist Republics desirous of strengthening the cause of peace between Germany and the U.S.S.R., and proceeding from the fundamental provisions of the Neutrality Agreement concluded in April, 1926 between Germany and the U.S.S.R., have reached the following Agreement: Article I. Both High Contracting Parties obligate themselves to desist from any act of violence, any aggressive action, and any attack on each other, either individually or jointly with other Powers. Article II. Should one of the High Contracting Parties become the object of belligerent action by a third Power, the other High Contracting Party shall in no manner lend its support to this third Power. Article III. The Governments of the two High Contracting Parties shall in the future maintain continual contact with one another for the purpose of consultation in order to exchange information on problems affecting their common interests. Article IV. Should disputes or conflicts arise between the High Contracting Parties shall participate in any grouping of Powers whatsoever that is directly or indirectly aimed at the other party. Article V. Should disputes or conflicts arise between the High Contracting Parties over problems of one kind or another, both parties shall settle these disputes or conflicts exclusively through friendly exchange of opinion or, if necessary, through the establishment of arbitration commissions. Article VI. The present Treaty is concluded for a period of ten years, with the proviso that, in so far as one of the High Contracting Parties does not advance it one year prior to the expiration of

this period, the validity of this Treaty shall automatically be extended for another five years. Article VII. The present treaty shall be ratified within the shortest possible time. The ratifications shall be exchanged in Berlin. The Agreement shall enter into force as soon as it is signed. [The section below was not published at the time the above was announced.] Secret Additional Protocol. Article I. In the event of a territorial and political rearrangement in the areas belonging to the Baltic States (Finland, Estonia, Latvia, Lithuania), the northern boundary of Lithuania shall represent the boundary of the spheres of influence of Germany and U.S.S.R. In this connection the interest of Lithuania in the Vilna area is recognized by each party. Article II. In the event of a territorial and political rearrangement of the areas belonging to the Polish state, the spheres of influence of Germany and the U.S.S.R. shall be bounded approximately by the line of the rivers Narev, Vistula and San. The question of whether the interests of both parties make desirable the maintenance of an independent Polish States and how such a state should be bounded can only be definitely determined in the course of further political developments. In any event both Governments will resolve this question by means of a friendly agreement. Article III. With regard to Southeastern Europe attention is called by the Soviet side to its interest in Bessarabia. The German side declares its complete political disinteredness in these areas. Article IV. they had not the number of tanks and some articles of equipment which were desirable they were a very well and finely equipped army. They had the first fruits of all our industry had to give. That has gone and now here is further delay.

In a long series of very fierce battles, now on this front, now on that, fighting on three fronts at once, battles fought by two or three divisions against an equal or sometimes larger number of the enemy, and fought very fiercely on old ground so many of us knew so well, our losses in men exceed 30,000 in killed, wounded and missing. I take this occasion for expressing the sympathy of the House with those who have suffered bereavement or are still anxious.

How long it will be, how long it will last depends upon the exertions which we make on this island. An effort, the like of which has never been seen in our records, is now being made. Work is proceeding night and day. Sundays and week days. Capital and labor have cast aside their interests, rights and customs and put everything into the common stock. Already the flow of munitions has leaped forward. There is no reason why we should not in a few months overtake the sudden and serious loss that has come upon us without retarding the development of our general program.

The President of the Board of Trade (Sir Andrew Duncan) is not here today. His son has been killed, and many here have felt private affliction of the sharpest form, but I would say about the missing -- we have had a large number of wounded come home safely to this country -- there may be very many reported missing who will come back home some day. In the confusion of departure it is inevitable that many should be cut off. Against this loss of over 30,000 men we may set the far heavier loss certainly inflicted on the enemy, but our losses in material are enormous. We have perhaps lost one-third of the men we lost in the opening days of the battle on March 21, 1918, but we have lost nearly as many guns -- nearly 1,000 -- and all our transport and all the armored vehicles that were with the army of the north. These losses will impose further delay on the expansion of our military strength. That expansion has not been proceeding as fast as we had hoped. The best of all we had to give has been given to the B. E. F., and although

Nevertheless, our thankfulness at the escape of our army with so many men, and the thankfulness of their loved ones, who passed through an agonizing week, must not blind us to the fact that what happened in France and Belgium is a colossal military disaster. The French Army has been weakened, the Belgian Army has been lost and a large part of those fortified lines upon which so much faith was reposed has gone, and many valuable mining districts and factories have passed into the enemy's possession. The whole of the Channel ports are in his hands, with all the strategic consequences that follow from that, and we must expect another blow to be struck almost immediately at us or at France. We were told that Hitler has plans for invading the British Isles. This has often been thought of before. When Napoleon lay at Boulogne for a year with his flat-


bottomed boats and his Grand Army, some one told him there were bitter weeds in England. There certainly were and a good many more of them have since been returned. The whole question of defense against invasion is powerfully affected by the fact that we have for the time being in this island incomparably more military forces than we had in the last war. But his will not continue. We shall not be content with a defensive war. We have our duty to our Allies. We have to reconstitute and build up the B. E. F. once again under its gallant Commander in Chief, Lord Gort. All this is en train. But now I feel we must put our defense in this island into such a high state of organization that the fewest possible numbers will be required to give effectual security and that the largest possible potential offensive effort may be released. On this we are now engaged. It would be very convenient to enter upon this subject in secret sessions. The government would not necessarily be able to reveal any great military secrets, but we should like to have our discussions free and without the restraint imposed by the fact that they would be read the next day by the enemy. The government would benefit by the views expressed by the House. I understand that some request is to be made on this subject, which will be readily acceded to by the government. We have found it necessary to take measures of increasing stringency, not only against enemy aliens and suspicious characters of other nationalities but also against British subjects who may become a danger or a nuisance should the war be transported to the United Kingdom. I know there are a great many people affected by the orders which we have made

who are people affected by the orders which we have made who are passionate enemies of Nazi Germany. I am very sorry from them, but we cannot, under the present circumstances, draw all the distinctions we should like to do. If parachute landings were attempted and fierce nights followed, those unfortunate people would be far better out of the way for their own sake as well as ours. There is, however, another class for which I feel not the slightest sympathy. Parliament has given us powers to put down fifth column activities with the strongest hand, and we shall use those powers subject to the supervision and correcting of the House without hesitation until we are satisfied and more than satisfied that this malignancy in our midst has been effectually stamped out. Turning once again to the question of invasion, there has, I will observe, never been a period in all those long centuries of which we boast when an absolute guarantee against invasion, still less against serous raids, could have been given to our people. In the days of Napoleon the same wind which might have carried his transports across the Channel might have driven away a blockading fleet. There is always the chance, and it is that chance which has excited and befooled the imaginations of many continental tyrants. We are assured that novel methods will be adopted, and when we see the originality, malice and ingenuity of aggression which our enemy displays we may certainly prepare ourselves for every kind of novel stratagem and every kind of brutal and treacherous manoeuvre. I think no idea is so outlandish that it should not be considered and viewed with a watchful, but at the same time steady, eye.


We must never forget the solid assurances of sea power and those which belong to air power if they can be locally exercised. I have myself full confidence that if all do their duty and if the best arrangements are made, as they are being made, we shall prove ourselves once again able to defend our island home, ride out the storms of ware outlive the menace of tyranny, if necessary, for years, if necessary, alone. At any rate, that is what we are going to try to do. that is the resolve of His Majesty's Government, every man of them. that is the will of Parliament and the nation. The British Empire and the French Republic, linked together in their cause and their need, will defend to the death their native soils, aiding each other like good comrades to the utmost of their strength, even though a large tract of Europe and many old and famous States have fallen or may fall into the grip of the Gestapo and all the odious apparatus of Nazi rule. We shall not flag nor fail. We shall go on to the end. We shall fight in France and on the seas and oceans; we shall fight with growing confidence and growing strength in the air. We shall defend our island whatever the cost may be; we shall fight on beaches, landing grounds, in fields, in streets and on the hills. We shall never surrender and even if, which I do not for the moment believe, this island or a large part of it were subjugated and starving, then our empire beyond the seas, armed and guarded by the British Fleet, will carry on the struggle until in God's good time the New World with all its power and might, sets forth to the liberation and rescue of the Old. .

THE COLD WAR

WASHINGTON, OCTOBER 1, 1962: SUBJECT: ANALYSIS OF SAM SITES (CUBAN MISSILE CRISIS) http://avalon.law.yale.edu/20th_century/msc _cuba001.asp 1. The intelligence community has now identified and confirmed a total of 15 SA-2 SAM sites. From the location of these sites, a discernible pattern is developing: a. In the Oriente Province, the identified sites (3) form a triangular pattern around the new military airfield at Holguin. This field is probably not yet operational, but soon could be. At the present time, there are no MIGtype aircraft stationed at this field. The MIGs believed to be assigned to the operational control of the Commander, Eastern Army, are stationed at the airfield at Camaguey, in the Central Army area. When Holguin becomes operational, these aircraft will probably be moved to that location. There are no SA-2 sites identified in the vicinity of Camaguey. b. In the Central Army area, 4 SA-2 sites form a rectangular pattern around the military airfield near Santa Clara. This airfield has had MIGs for several months and is also the field upon which the first MIG 21 was identified. c. In the Western Army area, there are 3 and possibly 4 SA-2 sites forming a liner pattern to provide defense for the military airfield at San Antonia de los Banos and coincidentally for the defense of the Havana-Mariel complex. San Antonio de los Banos is the headquarters for the Cuban revolutionary Air Force and the assembly point for all MIGs, except the MIG-21, which have previously been received in Cuba.


2. Further west in the Pinar del Rio Province a triangular pattern of 3 SA-2 sites cannot be connected with any significant military installation. The only known installation within this triangle are 2 underground facilities whose use and purpose are unknown. The only other military installation in this particular area is the military air base at San Julian near the western tip of Cuba. However, 1 of the 3 SA-2 sites is located at or very near this military airfield, a most unlikely spot to place SA-2s for the defense of this particular air base. Therefore, curiosity is immediately aroused to the purpose of this triangular pattern on the far western tip of Cuba. 3. In the north central portion of the Pinar del Rio Province is a large trapazoid-shaped restricted area controlled by the Soviet military personnel recently introduced into Cuba, measuring 15-20 miles on a side. There are no known military installations in this rough and sparsely populated area. According to reports from refugees arriving in Miami, all Cubans have been evacuated from this restricted area. The purpose of this restricted area is not currently known. 4. Information concerning the deployment of Soviet military personnel and "technicians" recently arriving in Cuba is derived from unevaluated refugee sources, however, an attempt has been made to plot all reported locations to determine whether there is any correlation between the location of Soviet personnel and missiles or missile activity. So far, the pattern indicates that there is a definite correlation, but significantly the greatest concentration of Soviet personnel, activity and camps is in the western end of the Island of Cuba. This would indicate a greater interest on the part of the Soviets in Pinar del Rio than in the other provinces.

5. A single unevaluated report states that the Soviet "SS-4 Shyster" missile may have been delivered to Cuba on or about 11 September. Some confusion is apparent in this report. The SS-4 missile is nicknamed "Sandal," while the "Shyster" carriers a designation of SS-3. This confusion was caused by the interrogators of the source using a recognition manual which designated the SS-4 as the Shyster. However, the description of the missiles reportedly observed by the source could have applied equally to either the Shyster or the Sandal. Both missiles have essentially the same outward appearance except that the Sandal is about 5 feet longer. In all other respects, including the missile carrier, the two appear identical. The source of this report stated that on 12 September he had personally seen some 20 such missiles in the vicinity of Campo Libertad, a small airfield on the western edge of Havana. While this report is still unconfirmed and there are no other reports concerning the presence of either SS-3 or SS-4 missiles, it is significant to note that by using the approximate center of the restricted area referred to above as a point of origin and with a radius of 1100 nm, the accepted range of the SS-4 missile, the arc includes the cities of Philadelphia, Pittsburgh, St. Louis, Oklahoma City, Fort Worth-Dallas, Houston, San Antonio, Mexico City, all of the capitals of the Central American nations, the Panama Canal, and the oil fields in Maricaibo, Venezuela.
