Q. My wife was recently treated at the Hospital and while she was at home recovering, I attempted to get her hospital records, but I was turned away and told that I needed a HIPAA Authorization. What is it and why do I need one. A. The hospital is required by law to protect your wife’s health information. The U.S. Department of Health and Human Services issued privacy rules to implement the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). These rules set the standards for individuals’ privacy rights to control how their health information is used. The Hospital must obtain your wife’s written authorization, before they can disclose her protected health information. Please be advised that the privacy rules have also significantly changed this year, which may result in some confusion in regard to the disclosure of information, until everyone has had an opportunity to learn and understand the new rules. In regard to Individuals, the new rules include numerous changes including the following: a. Individual’s can request to restrict disclosure of protected health information to a health plan: If the disclosure is for purposes of payment or healthcare operations and is not otherwise required by law; and information pertains solely to a healthcare item or service for which the individual, or person on behalf of the individual other than the health plan, has paid the covered entity in full; b. The new rules requires compliance with the Privacy Rule for protected health information of decedents, for 50 years following the date of death; c. In order to facilitate the sharing of immunization records with schools, if certain conditions are met, the new rules permits a covered entity to disclose proof of immunization to a school where state or other law requires the school to have such information prior to admitting the student; and d. The new rules also implement provisions of the Genetic Information Nondiscrimination Act of 2008 (“GINA”), which prohibit health plans and employers from discriminating on the basis of genetic information. The new rules expressly include “genetic information” within the definition of “health information” and prohibits health plans from “using or disclosing genetic information for underwriting purposes”. Genetic Information means, with respect to any individual, information about: the genetic tests of family members of such individual; the manifestation of a disease or disorder in family members of such individual (i.e., family medical history); and any request for, or receipt of, genetic services, or participation in clinical research which includes genetic services, by such individual or family member of such individual. I should also point out that the rules for parties that disseminate protected health information have changed significantly as well and you should consult with an attorney to discuss your practices and procedures. . If you have a general legal question you would like discussed, in future please email your questions to legal@gallowaypatriot.com. Insomnia can result from: • Stressors in life such as unemployment, divorce, or death of a loved one • Illness • Certain medications • Pain • Events that interfere with a normal sleep schedule such as crossing time zones, or night shift work • Depression, anxiety Insomnia is awful and people are desperate to sleep. Afterall, who wants to wake up feeling exhausted and having to take care of the kids all day? Or who wants to be unable to concentrate and have a headache at work? Additionally, insomnia has been associated with car accidents (over 200,000 collisions per year, and kills more people than drunk driving!!), problems with memory, and decreased work productivity. Sleeping pills were originally designed to be taken for a short period of time, not everyday. Experts have stated that they can be invaluable to provide much needed sleep when people have surgery, travel to different time zones, or for stressful events. However, we have become “One Nation Under Sedation.” In 2011, there were 60 million prescriptions written for sleeping aids in the United States (increased from 47 million in 2006). Sleeping pills have also made the news for a number of other reasons: • Heath Ledger, Michael Jackson, and Jack Nicholson • In 2012, a study came out that found an increased risk of death and cancer in people who took more than 18 sleeping pills a year (that means about 2 a month!!). This study did not determine the cause, but shed light on the fact that there is something about people who take sleeping pills that makes them more likely to die earlier. • In January of 2013, The Food and Drug Administration (FDA) recommended that the bedtime dose of zolpidem (also known as Ambien, Ambien CR, Edluar, and Zolpimist) be decreased in women. This statement was made after they received over 700 reports of car accidents in people who had taken a sleeping aid. Although sleeping aids can be appropriate in certain circumstances, if you are suffering from chronic insomnia, you should work on your sleep “hygiene.” Good sleep habits are sometimes difficult to establish but can be very effective in getting you a good night’s sleep. • Create a routine. Try to go to bed at the same time each night and wake up at the same time each morning. One sleep expert stated that weekends are often a problem. He stated that going to bed late or sleeping in makes it difficult once Sunday night and Monday morning roll around. • Avoid naps during the day. Although this may be difficult, it may become easier for you to fall asleep at night. • Avoid late day caffeine and nicotine. These are stimulants. • Avoid alcohol. Although it can make some people drowsy and fall asleep, it can interfere with the quality of sleep or cause waking up in the middle of the night. • Avoid heavy meals at bedtime. • Exercise regularly. However, sleep experts recommend not exercising too close to bedtime because it may stimulate you. • Read a book, take a bath, listen to music, or engage in relaxation techniques (deep breathing, yoga, muscle relaxation). • Improve bedroom comforts when it comes to temperature and noise. • See your doctor to make sure there is not an underlying illness and discuss other possibilities (neurofeedback, acupuncture, sleeping pills…for a short period of time).
