KristalBond Terms & Conditions 1. Care & Maintenance: Your KristalBond Coating is installed with special care by trained craftsmen. After the installation, you may observe some changes such as slight hazing if this occurs this is normal so do not be concerned. Warm weather and direct sun light will shorten the dry-­‐out time, cool weather, shady conditions can lengthen the drying time. Once the liquid has cured, the hazing will disappear. To help in the curing process you should not clean the glass for 7 days after the installation. In general, most glass cleaners work well, however do not use cleaning fluids high in alkaline, acids or with abrasive materials . Always use a soft “lint free” cloth or soft rubber squeegee for drying. NEVER USE BRISTLE BRUSHES, to clean your windows. It is normal after the work is completed for you to inspect your windows much closer than you normally would and notice imperfections in the glass that you did not notice before. These imperfections in the glass are not related to the KristalBond installation. The liquid undergoes stringent inspections both at the factory level and also during the installation process. As a rule of thumb, stand 6 feet away from the window as you inspect the windows and look THROUGH the window rather than looking AT the windows. 2. Warranty: Your KristalBond Warranty is provided directly by the manufacturer and not by KBT America LLC. The manufacturer’s warranty guarantees that your KristalBond coating shall be free of defective materials and workmanship. The manufacturer’s warranty provides for replacement application and any re-­‐installation labor in the event of product defect such as adhesive failure, bubbling, cracking, crazing, peeling or excessive unusual change of color. This limited residential and commercial manufacturer’s warranty is void if the coating has been damaged through abuse, negligence, improper care or because of a window failure or other conditions beyond the seller’s control such as vandalism, acts of God, or civil unrest. Liability from all causes is limited to the replacement of the defective window coating and re-­‐installation labor as per the manufacturer’s warranty. Breakage of glass after the coating has been applied or any other loss or damage other than as expressly stated in the manufacturer’s warranty is not the responsibility of KBT America, LLC. The manufacturer’s warranty does not cover any window film or coating that is applied to the exterior of the glass. The foregoing warranty is exclusive and in lieu of all other warranties whether written, oral or implied. 3. Installation: a. a. Pre-­‐Installation Inspection: Prior to installation, take a few moments to inspect all windows with the installer to note broken glass, loose panes, imperfections in the glass and any special instructions. All stickers and window decals will be removed unless otherwise instructed. Any other items that may affect installation should be discussed with the installer during this time and noted on the agreement. b. b. Knick-­‐Knacks & Window Treatments: To minimize disruptions and streamline installation, we recommend that all items such as plants, pictures, and knick-­‐knacks be removed from the windowsills and surrounding areas. It is also wise to position or remove window treatments to allow for easy access to the entire window surface. The installers will move anything that hinders installation. If you do not want an item removed, discuss this with the installer and note it on the agreement. KBT America LLC is not responsible for any damage that may be caused due to the removal or re-­‐ installation of items. c. c. Airborne Contamination: Your windows will be razor cleaned by the installation crew, however, it is wise to clean the floor and vacuum the surfaces around the window one day prior to installation. All fans should be turned off during the installation process. It is normal for there to be a 5% tolerance for dust, specs or imperfections during installation. d. d. Furniture: It is recommended that you move any furniture or items that may hinder installation. If the furniture is too heavy, the installers are available to move it for you. During installation, the installers will move furniture or any item that may hinder installation. If you do not want an object moved this should be discussed with the installer prior to the installation and noted on the agreement. KBT America LLC is not


responsible for any damage that may be caused due to the moving of furniture or other items. e. e. Clear Access: KBT America LLC shall be provided with clear access to the glass. Property owner shall be responsible to provide clear access to the glass surface. KBT America LLC shall not be responsible to install KristalBond in areas where clear access to the glass is not provided. f. f. Defective Windows/Security Systems: KBT America LLC shall not be responsible for security alarm sensors/wires or for windows that are defective or for windows that show wear and tear. g. g. Visibility: Coatings are not the exact same level of visual quality as naked glass. Some coatings increase the potential for a slight visual distortion and this shall be considered as normal. h. h. After Installation Damage: If other contractors are performing work in the area after the coating has been installed, KBT America LLC shall not be responsible for paint, scratches or other damage caused to the coating. i. i. Tolerance: It is normal for there to be a 5% tolerance for dust, specs or imperfections during installation. Such tolerance is normal and shall be accepted as perfect work. 4. Buyer/Seller Right to Cancel: Buyer and Seller shall have the right to cancel this agreement within 3 days of signing by providing a written notice. The cancellation notice must be post-­‐marked before midnight of the third business day after the contract is signed. If the purchaser decides to cancel this agreement for any reason, deposits are not refundable and shall be considered as damages for marketing, sales, administrative work, scheduling shifts and for inventory handling. 1. Balance Due: The balance due shall be payable immediately upon completion of the work. In the event that it becomes necessary for KBT America LLC to retain the services of a collection service or an attorney to collect any balance due, KBT America LLC shall have the right to recover any and all fees and expenses incurred in the collection of such funds. In addition KBT America LLC shall have the right to collect eighteen percent (or the maximum amount of interest allowed by law) on the balance due from the date of the installation. 2. Arbitration Clause Any controversy or claim arising out of or relating to this quotation, order or subsequent contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. There shall be one arbitrator agreed to by the parties within twenty (20) days of receipt by respondent of the request for arbitration or in default thereof appointed by the AAA in accordance with its applicable rules. The arbitration shall be held in Fort Lauderdale and remain confidential, and the award shall be rendered, in the English language. The AAA award shall be final and binding on the parties and may be entered and enforced in any court having jurisdiction.
